Control of Goods (Open General Import Licence) (Standards Assessment) Notice, 2015

IT is hereby notified that the Ministeroflndustry and Commerce, in terms of section 4 (1) (a) of the Control of Goods (Import and Export) (Commerce) Regulations, 1974, published in Rhodesia Government Notice 766 of 1974,hereby makes the following notice:-

Title

1. This notice may be cited as the Control of Goods (Open General Import Licence) (Standards Assessment) Notice, 2015.

Interpretation

2. In this notice-

"assessment" means confirmation, through the provision of objective evidence, that requirements ofthe applicable standards have been fulfilled through one or more of the following tasks: shipment inspection, verification of documentation, sample testing and risk assessment;

"Assessment Agent" means Bureau Veritas Inspection Valuation Assessment Control (Private) Limited company which specialises in professional verification of conformity services on behalf of the Government of Zimbabwe;

"Certificate of Conformity" means a verifiable document issued by the Assessment Agent which is proof that the products specified therein conform to the national standards;

"country of origin" means the country where goods intended for shipment to Zimbabwe are dispatched;

"free on board (FOB) value" has the meaning accorded to it in terms of the Customs and Excise Act [Chapter 23 :02];

"non-conformity report" means a report issued by the AssessmentAgent which is a statement that the products specified therein do not conform to the national standards.

Application

3. Subject to any other law in Zimbabwe, this notice shall apply to any person who imports the goods specified in the Schedule with a Free on Board Value of more than one thousand United States dollars (US$1 000) or its equivalent.

Assessment

4. ( 1) The assessment of goods shall be conducted in the country of origin by the Assessment Agent.

(2) It is the duty of both the importer and the exporter to ensure that goods liable for assessment in terms of section 3 above have been assessed by the Assessment Agent.

(3) The exporter of the specified goods shall be liable to pay assessment fees to the Assessment Agent specified in the Second Schedule.

Procedure

5. ( 1) An application for assessment shall be made on a Request for Certificate Form attached on the Fourth Schedule.

(2)The application shall be accompanied by supporting documentation specified therein which shall together with the Request for Certificate Form, be submitted to the assessment agent.

(3) The Assessment Agent representatives contact details are listed in the Third Schedule below.

Certificate of conformity

6. (1) The Assessment Agent shall issue a Certificate of Conformity for goods which have been assessed and are compliant with the national standards.

(2) The Certificate of Conformity shall be made available to the exporter after the assessment inspection.

Non- compliance

7. (1) Goods that arrive at a port of entry without a valid Certificate of Conformity shall not be imported into Zimbabwe,

and shall be re-shipped or returned to the country of origin at the cost of the importer.

Exemption

8. If the Minister deems it within the national interest to do so, he or she may exempt any imports from the provisions of this order.
