Foundation Annual Report

President’s Message

Dear Bar Colleagues:

I am happy to report that the Iowa Bar Foundation has had a good and productive year. First, the Foundation’s financial health, impaired during the financial crisis of 2008, continues to improve.

In addition, the Foundation was able to make a number of important grants, including support for (1) the ISBA’s Loan Repayment Assistance Program; (2) Iowa Legal Aid’s medical-legal program, which provides medical related legal advice through a partnership with healthcare providers; and (3) the ISBA’s Rural

Practice Committee internship project, which provides funding for summer clerkships for rural law offices.

Moreover, in the beginning of our fiscal year, in September of 2011, the Foundation held a retreat to determine what priorities the foundation should have moving forward, consistent with the Foundation’s mission, which is to advance jurisprudence and the administration of justice through education and research. A consensus was reached establishing civic education as the chief priority of the Foundation. Discussion was also had about a capital campaign with civic education as its focus.

Since the retreat, there have been discussions with leadership from a number of other groups, including the ISBA, the Iowa Association for Justice, and the Iowa Defense Counsel concerning interest in working with the Foundation to promote civics education for Iowa residents. The Foundation’s role will be to raise funds to support the projects identified by these various other stakeholders.

It is anticipated that the recent outcome of the judicial retention election, which reaffirms the strength of Iowa’s judiciary, will energize the efforts of the Foundation and the other stakeholders to continue to build the public’s understanding of the importance of a fair and impartial court system. It is the Foundation Board’s hope that when we formulate our campaign to support ongoing civic education efforts, you will respond – as you have in the past – with both financial and moral support for our efforts. Together we can work for a common cause – increased public understanding of our courts and a stronger judicial system.

The Bar Foundation Board takes its commitment to the profession and to the State’s lawyers very seriously. If you see some project or opportunity you think meets the Foundation’s objectives, please let us know about it. And if you see some way for us to improve in the job we are doing, please let us hear from you.

The Iowa State Bar Foundation was established in 1944 to support the efforts of The Iowa State Bar Association to advance jurisprudence and the administration of justice through education and research. Since its inception, the investments of the Foundation funds have been directed by a finance committee which makes its recommendations to the Board of Directors for final action. The finance committee has always dealt with the trust property with the greatest of care and through the years has had a great deal of success. The Board of Directors has always believed that they should limit grants to the income from the funds of the Foundation and not invade the principal. Grants are generally made for law-related subjects, and to a great extent, to projects which carry the approval of The Iowa State Bar Association.

In all of its initiatives, the Foundation strives to be a catalyst, convener and collaborator for change that furthers its mission for the benefit of Iowans. The Foundation strives to accomplish this mission through financial grants to government agencies and not-for-profit organizations for projects furthering its mission; through publications that further public understanding of the law; through ongoing efforts to bring courts and communities together to improve the access and experience of the public with local courts; and to address the role of courts as a community’s institution of last resort.

The Board of Directors consists of nine regular members and any retired president who serves as a member ex officio, without power to vote. The term of office of each elected Director is three years, and until their successors are duly elected and qualified, and not more than one of the three Directors selected annually shall be a voting member of the Board of Governors of The Iowa State Bar Association.

The officers of this Corporation consist of a President, one or more Vice Presidents, a Secretary and a Treasurer. The offices of Secretary and Treasurer may be held by the same person. These officers are selected by the Board of Directors and hold office with the term of two years or until their successors are elected.

2011 - 2012 Grants

This request is for the funding of two summer clerkship positions in county attorneys’ offices: one in Mason City, IA and one in Sidney, IA. Two Creighton University students will spend 10 weeks of the summer clerking in the two above-mentioned county attorney offices with the goal that they will return to county attorney offices in rural Iowa counties after graduation and admission to the Iowa bar.

The Rural Practice Committee initially received resumes from about 50 students at Creighton, Drake and the University of Iowa law school who were interested in a summer internship program with rural practitioners. The Committee also had 20 rural practitioners that had agreed to hire students for the summer. The challenge was to match the students with practitioners. Phil Garland, Co-chair of the Rural Practice Committee went to all three of the schools and held a mini career day where the students and practitioners could meet.

In addition to these matches, wherein the acquiring attorney paid the student’s salary, committee co-chair Phil Garland arranged for clerkships for two students at county attorney offices. Those clerkships were financed by the Foundation that matched money from Creighton University.

Many of the rural communities in Iowa have lost a significant number of lawyers over the years. With this grant request the

committee’s efforts to expose law students to practice opportunities in small towns throughout the state with the hope that after being exposed to these practices they would realize the opportunities available in rural Iowa. This grant advances the Foundation’s objective of increasing access to justice for Iowans by exposing students to rural Iowa law practice and to encourage recent law graduates to at least look into practicing in small town Iowa.

$5,000 - Rural Practice Committee of The Iowa State Bar Association

This request was for continued support for The Iowa State Bar Association to once again sponsor a booth at the Varied Industries building during the 2012 Iowa State Fair. The Iowa State Bar Association will have members present to provide education regarding various topics of law, not legal advice. Numerous informational brochures will be made available for handouts. The booth will be double size and part of the space will be used so that the public can see information about the ISBA Foundation. It is expected that approximately 1 million people will visit the Iowa State Fair.

The objective of this project is to educate the public regarding legal issues and the profession. It is also intended to improve and maintain a good public image of the legal profession and this Association. In addition, the project also tries to connect the public with our courts and the judicial system.

$10,000 – ISBA Public Service Project on behalf of The Iowa State Bar Association

This request was for continued support of The Iowa State Bar Association Loan Repayment Assistance Program (“ISBA-LRAP”) which exists to support law school graduates in choosing employment in the public interest field and in retaining such employment. To fulfill this mission, the ISBA-LRAP provides assistance to help repay their educational loan expenses. This assistance is designed to support participants who would otherwise be precluded from accepting qualifying employment or who would be unable to continue to work in qualifying employment because of salaries that do not support their student loan burden.

An applicant must be licensed to practice law in the state of Iowa. They must be employed at a qualifying public interest organization providing legal services to the poor, enhancing the administration of justice, or providing law related education to the public. Types of employment include: Public interest 501c(3) nonprofit organizations; Civil legal aid providers; Governmental agencies; Public defenders and Prosecutors.

Part-time attorneys are eligible but the assistance shall be pro-rated. An applicant’s annual salary from qualifying employment may not exceed $50,000. Undergraduate, graduate and law school loans will be considered in determining the amount of assistance. An assistance amount of $5,000 per year may be awarded to each approved participant. The intent of the award is to assist applicants with making loan payments and not to simply reduce the principal amount.

One primary purpose of the bar association is to advance the sciences of jurisprudence. The ISBA needs to do everything it can to encourage attorneys to enter the public service field. Access to justice for all is dependent upon attorneys who are committed to serving the public.

$20,000 - Loan Repayment Assistance Program of The Iowa State Bar Association

This request was to off-set expenses incurred by the U.S. District Court, Southern District of Iowa for hosting a judicial delegation from the Ukraine. The dinner offered a speaker with members of the bar and Judges of the Federal Court in attendance. The delegation was brought to the U.S. by the Open World Leadership Center of the Library of Congress Rule of Law program to foster international understanding of the American Court system.

$1,500 – United States District Court for the Southern District of Iowa

This request is for funding the Hispanic Outreach Legal Advice Clinic (HOLA Clinic). The Hispanic outreach clinic provides assessment of legal problems and legal advice to all individuals seeking assistance regardless of income, county of residence, type of legal issue or immigration status. Potential clients are screened for income eligibility, merit of legal issue, and nature of the legal problem. Individuals who fall within the guidelines of the PCBA VLP are then referred to volunteer attorneys for further representation if needed. Individuals who do not meet the criteria for the PCBA VLP are referred to

other organizations, agencies or private attorneys for additional assistance. The program is closely coordinated with Iowa Legal Aid and Justice for Our Neighbors. If individuals meet the guidelines of those programs, appropriate referrals are made. The coordination of services ensures that the programs are not duplicating services. The HOLA Clinic has provided assistance to almost 2000 individuals in the 8 years that the program has been operating. Attorneys have donated close to 6000 hours of their time providing legal representation to the participants in the clinic.

$5,000 - Polk County Bar Association Volunteer Lawyers Project

The Foundation’s support of Iowa Legal Aid’s work over the years has proved to be critical in meeting the legal needs of low-income Iowans. In the past, the Foundation has supported Iowa Legal Aid’s Volunteer Lawyers Project efforts, its Legal Hotline for Older Iowans, and Pro Se Coordination Project. Most recently, the Foundation has supported Iowa Legal Aid’s Health and Law Project.

The Health and Law Project is a collaboration of Iowa Legal Aid attorneys and health care providers that work together to identify and resolve legal issues causing or exacerbating the chronic health conditions of low-income Iowans. Through this project, trained health care providers identify during routine office visits legal issues facing their low-income patients and refer those patients to project attorneys. Project attorneys then address those legal issues so that the patient’s overall health can improve.

Low-income families face numerous socioeconomic challenges – including challenges such as substandard housing, utility shortages, inadequate nutrition, and inappropriately denied public services - that can increase the risk of health problems and hospitalizations. By addressing these issues through legal channels, stress will be reduced; access to preventative medicine, funding sources, benefits, appropriate housing and safer environments will be increased; and general well-being will be improved-factors that are associated with better health outcomes. Lawyers, as part of the health care team, can play a crucial role in helping low-income patients resolve legal problems that are negatively impacting their lives and their health, thereby enhancing the health and well-being of our communities.

With Funding from the Foundation, Iowa Legal Aid will:• Improve the lives of low-income Iowans by addressing the underlying legal problems affecting their

health.• Educate partner health care staff to identify legal issues confronting their low-income patients and

refer patients to the Health and Law Project so staff can better address health issues.• Educate low-income Iowans about the Health and Law Project and the resources available to

help them address their basic needs and secure a healthier and more supportive environment for themselves and their children.

The Iowa Legal Aid Health and Law Project was initiated in 2006 in Council Bluffs, Des Moines, Ottumwa and Sioux City. Since that time, the project has expanded to Dubuque, Fort Dodge and Marshalltown. In addition to expanding to other areas of the state, the Health and Law Project has also expanded from just collaborating with community health centers to include local hospitals and health agencies.

$30,000 – Iowa Legal Aid and ISBA Health Law Section for Iowa Legal Aid Health and Law Project

The objective of this project is to educate the public regarding jury service. It provides the Court with an updated resource for use with jury pools. In addition, the project also provides civic education to connect the public with our Courts and the judicial system. The previous jury orientation video that the ISBA produced on behalf of the Court was 20 years ago. Over time, many bar members and Court personnel expressed

the need for an updated version. A new Jury Orientation video has been produced and was just recently distributed statewide to all judicial districts and courthouses. It is also available on the ISBA website. It will be viewed by every citizen of Iowa who is called to be part of a jury pool in their respective county. Thousands of individuals will view this educational piece over the lifetime of the video.

$800 – ISBA Public Service Project on behalf of The Iowa State Bar Association

Grant applications must be received in the office of The Iowa State Bar Association by May 15 to be considered at the June meeting and by November 1 to be considered at the December meeting of the Bar Foundation. Late applications will not be considered. You will be notified of the Foundation’s decision in writing following its respective meeting.

One of the best ways to remember a deceased lawyer is through a memorial gift to the profession to which he or she devoted an entire life. Surviving family members can point with pride to the accomplishments memorialized in a tangible form.

The Iowa State Bar Foundation is a 501(c)(3) not-for-profit charitable organization. Contributions to the Foundation are an excellent way of reducing your tax liability and providing funds for the many worthwhile programs the Foundation supports. Celebrating, Recognizing, Commemorating, Honoring, Appreciating, Sympathizing, Acknowledging, Memorializing, Congratulating. Whenever you have cause for celebration, need a special way to say “thank you,” or want to convey your sympathies with a personal touch, the Iowa State Bar Foundation welcomes gifts year-round as expressions of remembrance to family and friends.

The Iowa State Bar Foundation is grateful to those members of The Iowa State Bar Association who participate in the voluntary check-off donation to the Foundation. All members of the ISBA are encouraged to participate when ISBA membership dues are mailed in May of each year.

Hundreds of Iowa attorneys give each year by way of general contributions. These gifts, of all sizes, provide unrestricted funds – a pool of resources that can be easily directed by the Foundation Board.

Gifts of marketable stocks or mutual fund shares that have appreciated (increased in value) can have an immediate impact on your favorite program and also create an immediate income tax deduction for you based on the asset’s current value.

Many contributors multiply their support for the Foundation each year by making use of their employer’s matching gift programs. The Foundation is grateful to these companies and foundations for their generosity. To find out if your company participates in such a program, ask your HR department.

One of the most effective means of giving to the Foundation is a planned gift. Gift planning is the process of carefully selecting the best methods and assets for making a gift, such as cash, stocks, bonds, real estate, life insurance, trusts, and bequests. A planned gift can enable you to assist the Foundation in its mission of education, research, and service while also reducing your burden of income, capital gains, or estate taxes.

Dear Fellows of the Iowa State Bar Association:

It is truly my honor and pleasure to have served as president of the Foundation Fellows for the year 2011-2012 I welcome Diane Kutzko as incoming Foundation Board President and look forward to her leadership and enthusiasm as the Foundation moves forward.

Membership in the Fellows is by nomination and invitation only and is limited to those members of The Iowa State Bar Association who have demonstrated adherence to the highest principles and traditions of the legal profession as

well as service to the public and to the community in which they live. Fellows membership is limited in number to 250, whereas there is no limit in the Life Fellows membership. Presently, there are 39 Foundation Fellows and 262 Life Fellows.

As you can see, there is plenty of opportunity to add to our membership. The financial commitment is manageable, with the nominee given the option of completing the $1,000.00 contribution through eight annual payments of $125.00.

Please consider nominating a worthy lawyer, judge, or professor to become a Fellow. Nomination forms are available on The Iowa State Bar Association’s website under the Foundation link, or by contacting Mary Hill at the Bar Association Office.

During the past year, the Foundation was able to award more than $70,000 in grants to well-deserving organizations that provide services such as legal aid, Hispanic outreach and summer clerkships in rural law offices. Please remember that only by your contributions and support can the Foundation remain a positive force in serving both the public and the legal profession in Iowa.
