    The Environmental Safeguards Management Framework (ESMF) provides the guidelines and proceduresto be followed to assess and mitigate the environmental and social impacts related to the civil works to becarried out under the Public Sector Capacity Building Project.

    1. Background

    The project development objective is to enhance the effectiveness, efficiency and productivity of two keypublic sector agencies (Department of Census and Statistics [DCS] and Auditor Generals Department[AGD]) through an investment package that includes organizational strengthening, capacity building,information management, communication improvements, physical and information technologyinfrastructure, and Information and Communication Technology (ICT) support.

    2. Project Description

    Component I: UpgradingStatistical Capacity (US$14.05 million of which US$12.05 million fromIDA): This component is based upon the detailed SMP and its complementing and amplifyingImplementation Plan, and will help to develop tools for demand-driven core data collection anddissemination. Areas of support include skill development, information and technology, clientrelations, and physical infrastructure development. The elements of the component are as follows:

    Organizational Development:

    Technical Assistance (TA) to design and implement a data collection and coordinationstrategy by DCS with other data collection agencies to reduce duplication of work andtransaction costs

    Skill development programs that follow international statistical standards, including training,workshops, and study tours

    Statistical and IT Infrastructure and Client Service:

    TA for IT-related needs assessment in terms of survey design, data collection, transmission,processing, management, and dissemination

    Design, development and implementation of the IT and statistical systems required per theDCS need assessment

    Training and workshops on IT implementation issues Hardware and software for data development and information sharing Consultant services to design and improve client-oriented data sharing and consultation, as

    well as a user-education strategy to facilitate statistically accurate use of data among users

    Training focused on user services and responsiveness to user needs Web-based data dissemination and clear articulation of policy to improve data sharingData Development:

    TA to design and develop an integrated meta- and data- base on major economic and socialstatistics

    Study visits to familiarize technical staff with international best practice Statistical series training and implementation of a staff assessment review systemPhysical Infrastructure: Construction and equipment of a modern building to house all 18 DCSdepartments currently accommodated in eight separate locations in and around Colombo. Thissingle structure would eliminate significant challenges in coordination and communication, aswell as costly, unsafe, time-consuming transport of physical data to storage. IDA will finance allcomponent costs except the cost of land for the building (US$2 million) which is provided byGOSL.

    Component II: Improving Auditing Standards (US$12.05 million of which US$10.55 million isfrom IDA): The component addresses weaknesses in the financial management of public resources,

    the effectiveness of the public audit function, and the availability of public access to information. Thecomponents action plan is based on the AGDs IDP. To modernize AGD, elements of the componentfocus on human resource (HR) development, communications and external relations, auditingmethodologies, and IT/physical infrastructure.

    Audit Methodology:

    Consultancy services to prepare manuals and guidelines to assist AGD to move from purelycompliance audits to financial, investigative and performance audits over the medium term

    Specialized training program on improved audit methodologies for investigative andperformance auditing of public entities

    Human Resource Development:

    Consultancy services to design the HR development strategy and training modules, as well asan objective staff assessment and promotion system

    Local and foreign training of international best audit practice Twining arrangements for public auditing staffCommunications and External Relations:

    Consultancy services to implement a communications infrastructure and tools forcommunicating with Parliament, auditees, and the general public

    Funding for mechanisms strengthening media access to AGD information and hardware tosupport better media relations

    IT and Equipment/Fittings:

    Hardware and software to implement the IT operating systems Training for staff on IT-based audit over the medium term Furniture, fittings, and communication, networking, and IT infrastructure for the AGD

    independent building and customization of offices through carrying out of works.

    Physical Infrastructure: Construction and equipment of a modern building to house AGD. The

    current building that AGD is occupying is to be demolished under an environmental plan of thegovernment. Using funds to re-wire an old building is inefficient. The new construction permits acomplete modernization of electronics and wiring, as the IT strategy suggests a WAN connectinghead office and the regional offices. IDA will finance all component costs except the cost of landfor the building (US$1.5 million) which is provided by GOSL.

    3. Project Location: The project will be implemented throughout Sri Lanka.

    4. Environmental Safeguards

    Projects and Programs financed with IDA resources need to comply with World Bank operational policies.Accordingly, the components and activities eligible for funding under this project will be required tosatisfy the World Banks safeguard policies, in addition to conforming to environmental legislation of the

    Government of Sri Lanka (GOSL). Considering the nature of the civil works proposed to be financed underthe project, it is not anticipated that there will be significant and/or irreversible adverse environmental andsocial impacts. Hence the proposed operation is classified as Category B for safeguards and theSafeguards Policy that will be triggered under this project is OP/BP 4.01 - Environmental Assessment.

    In order to ensure compliance with OP 4.01, an Environmental Safeguards Management Framework(ESMF) has been prepared based on which safeguards assessments will be conducted for the civil worksfinanced under the project, once specific sites are identified. The ESMF has identified the institutionalarrangements for safeguards assessments and monitoring and has formed the basis for appraising theenvironmental and social aspects of the project.

    Sri Lanka has a well established construction industry and the country has institutionalized a process forobtaining building approval which ensures that the proposed construction follows constructionspecifications and other relevant regulatory requirements if the Urban Development Authority and therespective Local Authorities. The project therefore plans to prepare Environmental Management Plans(EMP) based on an environmental analysis of the potential impacts identified through an EnvironmentalInformation Questionnaire, in lieu of Environmental Impact Assessments (EIAs). The details of the processare described below.

    5. The Potential for Environmental and Social Impacts

    As mentioned above, based on the scope of the project, the building construction civil works financedunder the project are the only activities that are likely to have potential environmental impacts

    6. Potential Environmental and Social Impacts and its Mitigation for Civil Works supported

    under the Project

    As the nature of the civil works proposed to be financed under the project are not likely to cause significantand/or irreversible adverse environmental and social impacts, site specific Environmental ManagementPlans (EMP) based on an environmental analysis of the potential impacts, through an EnvironmentalInformation Questionnaire (EIQ), would be sufficient for the routine building construction work. As thelocation of the proposed civil work has not been identified at this stage, a site specific EnvironmentalAssessment cannot be conducted. The preparation and approval of the EMP will be a pre-requisite forfund disbursements for any civil work under the project and therefore the EMP should be submitted forIDA Clearance.

    In the event that any land-filling of low lying land and/or land located in environmentally sensitive areas orin an area where there are GOSL restrictions on building construction is proposed for any buildingconstruction under this project, a full Environmental Impact Assessment (EIA) is a pre-requisite for funddisbursement. The Terms of Reference (TOR) for such an EIA needs IDA approval and the EIA needs tobe reviewed and cleared by IDA. These are pre-requisites for fund disbursement for the civil works underthese circumstances. It has also been agreed that construction specifications, developed by the Institute forConstruction Training and Development (ICTAD) and the relevant regulation of the Urban DevelopmentAuthority and the respective Local Authorities will be followed during construction/renovation activities

    that will be supported under the Project. In addition, all GOSL approval permits forconstruction/renovation of buildings will be obtained prior to fund disbursements for the respective civilworks.

    An Environmental Information Questionnaire (EIQ), which is similar to the Initial EnvironmentalExamination format of the Central Environmental Authority, will be required to be completed for each site.A model EIQ is contained in Attachment 1 of the ESMF. The Questionnaire should contain information onthe site locations, geography, political/administrative aspects, physical nature of the site (such astopography, slope, soil, water) Ecological (environmentally sensitive habitats, protected areas etc) featuresof the site and overall environment such as sewage disposal, water supply, sanitation etc. In addition, itwould identify the environmental impacts from the construction activities.

    Environmental Management Plan: Based on the information obtained from the EnvironmentalInformation Questionnaire, a site specific Environmental Management Plan will be prepared. The EMPwill indicate the impacts predicted, mitigation measures to minimize the impacts, identify the institutionalarrangements for undertaking the mitigation measures and monitoring arrangements, implementationschedules of the mitigation arrangements and reporting requirements and cost estimates and sources offunds. The EMP will also include specific guidelines for debris disposal as well as resource extraction (eg.sand, timber, metal etc) for all specific construction activities financed under the project. Some of theadditional issues to be considered during the preparation of the EMP are contained in Annex 2. As thebuilding construction activities are scattered and limited in scale, it is not expected that there will besignificant accumulated environmental damage due to project activities. The recent Tsunami related

    reconstruction has created a demand for construction material such as sand, clay for bricks and timber.Therefore in order to avoid encouraging illegal extraction of such resources required under this project, allconstruction contracts under this project will include clauses in the contracts to ensure that sand, clay andtimber are obtained from authorized locations and sources that are licensed by relevant GOSL authorities.

    Construction Specifications: Though construction activities per se, are likely to have minimal on siteenvironmental impacts, most of the negative environmental impacts are likely to be seen off site, whereconstruction materials such as sand, clay for bricks and timber will be sourced.

    Therefore, all tender/bidding documents for construction/renovation activities will include clauses to (a)ensure that contractors obtain construction materials from authorized sites with proper licenses, (b) ensurethat they will adhere, to the construction specifications developed by the Institute for Construction,Training and Development (ICTAD) and adhere to relevant regulations of the Urban DevelopmentAuthority and other agencies involved in providing building approval/renovation permits (c) ensure that allGOSL approval permits for construction of buildings for the respective civil works will be obtained (d) inaddition, for the construction of new buildings, the contractors will be required to adhere to the mitigationmeasures contained in the EMP, which will form part of the contract conditions. A list of some of theICTAD specifications, additional items to be addressed in an EMP and technical specifications to beincluded in civil works contracts are contained in Attachment 2.

    7.0 Social Aspects: Although the project supports small investments in infrastructure, particularly inrefurbishing existing government buildings for information technology and office space, no acquisition ofprivately owned land or displacement of people is expected under the project. Civil works will be carriedout on publicly owned land free of any squatters or encroachers.

    8.0 Physical Cultural Resources

    Physical cultural resources include monuments, structures, works of art, or sites of significance points ofview, and are defined as sites and structures having archaeological, historical, architectural, or religioussignificance, and natural sites with cultural values. This includes cemeteries, graveyards and graves. Thebuilding construction works under the project are not expected to pose any risk of damaging culturalproperty, assuming that it will not include large-scale excavations, movement of earth or demolition. The

    construction works will be ineligible for support under the proposed operation if it damages culturalproperty, religious monuments, structures and cemeteries including any activities that affect the propertiesinscribed in the World Heritage List:

    Ancient City of Polonnaruwa Ancient city of Sigiriya Golden Temple of Dambulla Old Town of Galle and its Fortifications Sacred City of Anuradhapura Sacred City of Kandy Other archaeological and historical sites

    For Construction activities that do not damage physical cultural resources but could have an adverse impacton them, should be reviewed for their potential impact on cultural property and clear procedures will needto be identified in order to protect such property. In addition, relevant procedures/approvals laid down bythe Department of Archeology, will be required to be followed/obtained, for such construction activities.The procedures to be followed for Chance findings are stated in Attachment 2.

    9.0 Institutional Arrangements for Implementation and Monitoring the Environmental

    Management Plans

    The Procurement Officers of the respective Implementing Agency shall be responsible to coordinate therelevant procedures outlined in the ESMF. They shall make arrangements to obtain the necessary expertiseto complete the Environmental Information Questionnaire and prepare the EMP for the site. In addition,

    they will be responsible to ensure that all GOSL approval permits are obtained prior to any funddisbursements for the respective building works. The construction specifications specified by ICTAD andthe EMP will form part of the Conditions of Contract for all civil works contracts. Non-compliance withthese conditions should be linked to financial penalty clauses in the contract as well. Compliancemonitoring of the building codes and the EMP will be the responsibility of the Procurement Staff and theConstruction Supervisory Consultants of the respective implementing agency/building works, respectively.Compliance will also be monitored during IDA supervision missions

    10. Consultation and Public Disclosure

    Since it is most likely that building construction activities are likely to be within existing premises, limitedin scale or in authorized commercial development areas, demarcated by the Urban Development Authority,it is not anticipated that there will be any public concerns with regard to the project. However, in the eventthat there is any wider public interest with any potential adverse impacts resulting from the civil worksunder this project, the respective implementing agency is required to consult the affected public. In theevent that there are any affectees on sites being identified for the building works, all relevant stakeholderswill be consulted (according to the World Bank guidelines) and EMPs will be placed for public comment.The ESMF has been disclosed in-country and in IDAs Public Information Center.

    Safeguards Procedures for Inclusion in the Technical Specifications of Contracts for civil works

    I General

    1. In order to avoid encouraging illegal extraction of such resources, all construction contracts underthis project will include clauses in the contracts to ensure that sand, clay and timber are obtained fromauthorized locations and sources that are licensed by relevant GOSL authorities. All building constructionand renovation will adhere to the existing building and other applicable codes of practice in Sri Lanka. Toensure that the building contractor is responsible for adherence to the following Institute for ConstructionTraining and Development (ICTAD) specifications which will be included in the contract documents:

    SCA/3/1 - Irrigation and land DrainageSCA/3/2 - Water Supply, Sewerage & Storm Water DrainageSCA/3/3 - Reclamation WorksSCA/3/4 - Ground Water Exploration & ExploitationSCA/4 - Building Works (Vol I)SCA/4 - Building Works (Vol II)

    SCA/6 - Coastal Harbour Engineering WorksSCA/8 - Electrical & Mechanical Works

    2. Any other Standard Specifications approved by the Government of Sri Lanka.

    3. In addition, the contractor is required to pay attention to and address the following in theEnvironmental Management Plan:

    1. Electromagnetic radiation issues such as the location of telecommunication towers andconsequences of permitting such towers to be built on top of school buildings, buildings near H/Tcables etc.

    2. Addressing noise pollution during construction activities.3.

    4. The Contractor and his employees shall adhere to the mitigation measures set down and take allother measures required by the Engineer to prevent harm, and to minimize the impact of his operations onthe environment.

    5. The Contractor shall limit construction works to between 6 am and 7 pm if it is to be carried out inor near residential areas.

    6. The Contractor shall avoid the use of heavy or noisy equipment in specified areas at night, or insensitive areas such as near a hospital.

    7. To prevent dust pollution during dry periods, the Contractor shall carry out regular watering ofearth and gravel haul roads and shall cover material haulage trucks with tarpaulins to prevent spillage.

    II. Transport

    1. The Contractor shall use selected routes to the project site, as agreed with the Engineer, andappropriately sized vehicles suitable to the class of road, and shall restrict loads to prevent damage to roadsand bridges used for transportation purposes. The Contractor shall be held responsible for any damagecaused to the roads and bridges due to the transportation of excessive loads, and shall be required to repairsuch damage to the approval of the Engineer.

    2. The Contractor shall not use any vehicles, either on or off road with grossly excessive, exhaust ornoise emissions. In any built up areas, noise mufflers shall be installed and maintained in good conditionon all motorized equipment under the control of the Contractor.

    3. Adequate traffic control measures shall be maintained by the Contractor throughout the duration ofthe Contract and such measures shall be subject to prior approval of the Engineer.

    III. Workforce

    1. The Contractor should whenever possible locally recruit the majority of the workforce and shallprovide appropriate training as necessary.

    2. The Contractor shall install and maintain a temporary septic tank system for any residential laborcamp and without causing pollution of nearby watercourses.

    3. The Contractor shall establish a method and system for storing and disposing of all solid wastesgenerated by the labor camp and/or base camp.

    4. The Contractor shall not allow the use of fuelwood for cooking or heating in any labor camp orbase camp and provide alternate facilities using other fuels.

    5. The Contractor shall ensure that site offices, depots, asphalt plants and workshops are located inappropriate areas as approved by the Engineer and not within 500 meters of existing residential settlementsand not within 1,000 meters for asphalt plants.

    6. The Contractor shall ensure that site offices, depots and particularly storage areas for diesel fuel

    and bitumen and asphalt plants are not located within 500 meters of watercourses, and are operated so thatno pollutants enter watercourses, either overland or through groundwater seepage, especially duringperiods of rain. This will require lubricants to be recycled and a ditch to be constructed around the areawith an approved settling pond/oil trap at the outlet.

    7. The contractor shall not use fuelwood as a means of heating during the processing or preparationof any materials forming part of the Works.

    IV. Quarries and Borrow Pits

    1. Operation of a new borrow area, on land, in a river, or in an existing area, shall be subject to priorapproval of the Engineer, and the operation shall cease if so instructed by the Engineer. Borrow pits shallbe prohibited where they might interfere with the natural or designed drainage patterns. River locationsshall be prohibited if they might undermine or damage the river banks, or carry too much fine materialdownstream.

    2. The Contractor shall ensure that all borrow pits used are left in a trim and tidy condition withstable side slopes, and are drained ensuring that no stagnant water bodies are created which could breedmosquitoes.

    3. Rock or gravel taken from a river shall be far enough removed to limit the depth of materialremoved to one-tenth of the width of the river at any one location, and not to disrupt the river flow, ordamage or undermine the river banks.

    4. The location of crushing plants shall be subject to the approval of the Engineer, and not be close toenvironmentally sensitive areas or to existing residential settlements, and shall be operated with approvedfitted dust control devices.

    V. Earthworks

    1. Earthworks shall be properly controlled, especially during the rainy season.

    2. The Contractor shall maintain stable cut and fill slopes at all times and cause the least possibledisturbance to areas outside the prescribed limits of the work.

    3. The Contractor shall complete cut and fill operations to final cross-sections at any one location assoon as possible and preferably in one continuous operation to avoid partially completed earthworks,especially during the rainy season.

    4. In order to protect any cut or fill slopes from erosion, in accordance with the drawings, cut off

    drains and toe-drains shall be provided at the top and bottom of slopes and be planted with grass or otherplant cover. Cut off drains should be provided above high cuts to minimize water runoff and slope erosion.

    5. Any excavated cut or unsuitable material shall be disposed of in designated tipping areas as agreedto by the Engineer.

    6. Tips should not be located where they can cause future slides, interfere with agricultural land orany other properties, or cause soil from the dump to be washed into any watercourse. Drains may need tobe dug within and around the tips, as directed by the Engineer.

    VI. Historical and Archeological Sites and Cultural Property

    1. Cultural property include monuments, structures, works of art, or sites of significance points of view,and are defined as sites and structures having archaeological, historical, architectural, or religioussignificance, and natural sites with cultural values. This includes cemeteries, graveyards and graves. Thefollowing procedures for identification, protection from theft, and treatment of discovered artifacts shouldbe followed and included in standard bidding documents.

    If the Contractor discovers archeological sites, historical sites, remains and objects, including graveyardsand/or individual graves during excavation or construction, the Contractor shall:

    (a) Stop the construction activities in the area of the chance find.

    (b) Delineate the discovered site or area.(c) Secure the site to prevent any damage or loss of removable objects. In cases of removable antiquities

    or sensitive remains, a night guard shall be present until the responsible local authorities and the staffof the Ministries of Cultural Affairs and National Heritage take over;

    (d) Notify the supervisory Engineer who in turn will notify the responsible local authorities and the staff ofthe Ministries of Cultural Affairs and National Heritage immediately (less than 24 hours).

    (e) Contact the responsible local authorities and the staff of the Ministries of Cultural Affairs and NationalHeritage who would be in charge of protecting and preserving the site before deciding on the properprocedures to be carried out. This would require a preliminary evaluation of the findings to beperformed by the archeologists of the Ministries of Cultural Affairs and National Heritage (within 72hours). The significance and importance of the findings should be assessed according to the variouscriteria relevant to cultural heritage, including the aesthetic, historic, scientific or research, social andeconomic values.

    (f) Ensure that decisions on how to handle the finding be taken by the responsible authorities and the staffof the Ministries of Cultural Affairs and National Heritage. This could include changes in the layout(such as when the finding is an irremovable remain of cultural or archeological importance)conservation, preservation, restoration and salvage.

    (g) Implementation for the authority decision concerning the management of the finding shall becommunicated in writing by the Ministry of Cultural Affairs and National Heritage; and

    (h) Construction work will resume only after authorization is given by the responsible local authorities andthe Ministry of Cultural Affairs and National Heritage concerning the safeguard of the heritage.

    3. During project supervision, the Site Engineer shall monitor the above regulations relating to thetreatment of any chance find

    4. Relevant findings will be recorded and submitted to the World Bank.

    VII. Disposal of Construction and Vehicle Waste

    1. Debris generated due to the dismantling of the existing structures shall be suitably reused, to theextent feasible, in the proposed construction (e.g. as fill materials for embankments). The disposal ofremaining debris shall be carried out only at sites identified and approved by the project engineer. Thecontractor should ensure that these sites (a) are not located within designated forest areas; (b) do not impactnatural drainage courses; and (c) do not impact endangered/rare flora. Under no circumstances shall thecontractor dispose of any material in environmentally sensitive areas.

    2. In the event any debris or silt from the sites is deposited on adjacent land, the Contractor shallimmediately remove such, debris or silt and restore the affected area to its original state to the satisfaction

    of the Supervisor/Engineer.

    3. Bentonite slurry or similar debris generated from pile driving or other construction activities shallbe disposed of to avoid overflow into the surface water bodies or form mud puddles in the area.

    4. All arrangements for transportation during construction including provision, maintenance,dismantling and clearing debris, where necessary, will be considered incidental to the work and should beplanned and implemented by the contractor as approved and directed by the Engineer.

    5. Vehicle/machinery and equipment operations, maintenance and refueling shall be carried out toavoid spillage of fuels and lubricants and ground contamination. An 'oil interceptor" will be provided forwash down and refueling areas. Fuel storage shall be located in proper bunded areas.

    6. All spills and collected petroleum products shall be disposed of in accordance with standardenvironmental procedures/guidelines. Fuel storage and refilling areas shall be located at least 300m fromall cross drainage structures and important water bodies or as directed by the Engineer.
