Your Committ'ee on Education, to which was referred S.B. No.1164, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO INTERSTATE COMPACT ONEDUCATIONAL OPPORTUNITY FOR MILITARY CHILDREN,"
begs leave to report as follows:
The purpose of this bill is to remove barriers to educationalattainment faced by children of military families due to frequentmoves and the deployment of their parents by enacting theInterstate Compact on Educational Opportunity for MilitaryChildren.
The Department of Education, Department of Defense, Chamberof Commerce of Hawaii, and a concerned individual supported thisbill. The Office of the Governor supported this measure withamendments. The Department of the Attorney General offeredcomments.
Your Committee has amended this bill by:
(1) Changing the membership of the State Council onEducational Opportunity for Military Children by:
(A) Including a complex area superintendent from theLeeward district;

(B) Removing the representatives from SchofieldBarracks, Naval Base Pearl Harbor, Hickam Air ForceBase, and Marine Corps Base Hawaii; and
(C) Including a representative each from the Air Force,Army, Marine Corps, and Navy;
(2) Providing immunity to the compact commissioner and anyperson representing the State in the interstatecommission in their individual or official capacity, andthe member state, from suit and liability caused by orarising out of actions, errors, or omissions of theinterstate commission;
(3) Changing the effective date to July 1, 2009; and
(4) Making technical, nonsubstantive amendments for clarity,consistency, and style.
As affirmed by the record of votes of the members 'of yourCommittee on Education that is attached to this report, yourCommittee is in accord with the intent and purpose of S.B. No.1164, S.D. 2, as amended herein, and recommends that it passSecond Reading in the form attached hereto as S.B. No. 1164, S.D.2, H.D. 1, and be referred to the Committee on EconomicRevitalization, Business, & Military Affairs.
