1. Introduction

The Stand-By Partnership Programme (SBPP) is a central element of OCHA’s sustained efforts to strengthen its response capacity to new and escalating humanitarian emergencies, in a climate of ever-increasing demands on limited funds. With the invaluable support of a growing number of external Stand-By Partner organizations, the SBPP allows for the rapid deployment of humanitarian experts for temporary support to Country Offices confronted with sudden emergencies and sharp increases in workload. Through the SBPP a diversity of experienced, motivated, often NGO-savvy humanitarian relief professionals can be fielded quickly, at virtually no cost to OCHA, to support field operations where urgently needed. While the SBPP is managed and coordinated by OCHA, it capitalizes on the human resource expertise of Stand-By Partner organizations for many aspects of the recruiting, fielding and administering of Stand-By personnel. This results in a cost-effective and flexible way of temporarily augmenting OCHA’s capacity on the ground and allows OCHA funds to be stretched to address ever multiplying humanitarian crises. Objective of the SBPP Users’ Guide The SBPP is managed by the Surge Capacity Section (SCS), Emergency Services Branch, OCHA Geneva. This Users’ Guide aims to provide OCHA managers in the field and at headquarters with practical advice to facilitate optimal use of this valuable source of experienced, gratis personnel. Explained herein are criteria for engagement and procedures indicated at every stage of the deployment cycle, from the initial request to completion of the assignment.

2. Criteria for Use of Stand-By Partner Experts

As stipulated in General Assembly Resolution 51/243 of 15 September 1997 and reiterated in subsequent resolutions and instructions, the use of gratis personnel is authorized on an exceptional basis to provide temporary and urgent assistance in case of 1) unforeseen emergency situations and 2) a critical need for specialized expertise not available within the United Nations, as detailed below: Category 1: The field contexts in which OCHA operates are fluid with related peaks in workload which are often induced by sudden and difficult to predict ‘shocks’ in the humanitarian environment. In order to cope with these types of situations (or other ‘force majeure’ situations, e.g. the sudden departure of a number of essential office staff due to a government decision, illness, etc.), Experts may be assigned to provide interim assistance in the immediate aftermath of a new or escalating crisis. These assignments are fixed for an initial 3 to (maximum) 6 month period and should be kept as short as possible. If the increase in workload is expected to persist, OCHA is obliged to ensure that additional resource allocation takes place at the earliest possible opportunity so that the additional workload can be dealt with through regular (human) resources. The resource situation should be reviewed and adjusted (e.g. through a cost plan revision and the creation of a new post) during the initial phase of the Expert deployment to enable regular staff to arrive in situ before the end of the Expert assignment, to avoid any gap and to ensure hand over and continuity of tasks. On average, the duration of SBPP deployments to OCHA in recent years falls within the 4-5 month range. This is compliant with the above parameters and should be maintained so as to ensure disciplined, appropriate and durable utilisation of the SBPP as an emergency staffing mechanism. Category 2: In addition, Experts can be exceptionally used to perform very specialized functions1 where OCHA lacks the appropriate expertise and resources. In the case of a protracted crisis, and at any subsequent occasion where a budget is being prepared, the need for these specialized functions must be

reviewed. If the need remains, then consideration must be given to establishing internal capacity to meet these needs through the recruitment of specialized personnel. The initial duration of these assignments too will be for a limited and specified period of time and cannot exceed 12 months. If the need is likely to last longer, OCHA has the obligation to plan accordingly and create alternative staffing options. In sum, SBP Expert utilization is warranted and justified if the following criteria are met:

� An OCHA Country/Regional Office is confronted with a sudden and unforeseen need for additional human resource capacity for core OCHA coordination functions or to carry out very specialised activities, up to maximum of 6 months deployment;

� Regular human resources have not yet been adjusted to the new demands placed on the office; � All efforts are made to keep SBP assignments as short as possible by, inter alia, the rapid

recruitment of regular staff once budgets have been adjusted.

In sum, SBP Expert utilization is not authorised if: � The need for additional human resource capacity is of a regular, non-urgent and foreseeable nature; � There is an empty regular post/function in the office that could have been filled to address the

sudden or specialised tasks at hand. The above interpretation of the SBPP legal documents on the criteria of usage and duration of deployment is contained in Annex 1 – Two Pager Legal Brief.

3. Recipients of Stand-By Partner Personnel Stand-By personnel are primarily deployed to existing OCHA Country Offices faced with a new crisis, a deterioration of an ongoing emergency or a ‘force majeure’ type situation where additional staffing resources are needed to reinforce existing capacities. Stand-By personnel can also be utilized in other situations such as opening of a new OCHA Office or in temporary support of a Resident Coordinator/Humanitarian Coordinator, where there is no OCHA presence in country (yet). In addition, Stand-By personnel can be made available, through OCHA, to UN integrated missions to perform purely humanitarian tasks. In these rare and specific situations where Stand-By personnel are deployed to UN integrated missions, deployments are fully coordinated with OCHA Country or Regional Offices and a local Letter of Agreement has to be signed to confirm modalities of deployment. In cases where Stand-By personnel are deployed to entities, within the UN Secretariat, other than OCHA, these receiving entities have the responsibility to ensure that adequate support to Stand-By personnel is provided in accordance with section 7 (General Terms and Conditions) and section 8 (Roles and Responsibilities of the Requesting Office) below.

4. Stand-By Partner Organizations The Surge Capacity Section maintains Memoranda of Understanding (MoU’s) with twelve external partners listed below (Annex 2 – Template MoU). These organizations manage active rosters or databases of pre-screened, qualified, experienced personnel from which they submit candidates to OCHA in response to an official request for a Stand-By Partner deployment:

5. Profiles of Experts In general, the primary strength of partner rosters are mid-level (P-3) Experts with a Humanitarian Affairs Officer (HAO) profile. Among other tasks, generalist HAOs can be requested to perform the following:

� Coordination of humanitarian response and cluster support/coordination. � Liaison with relevant partners and organize/chair meetings. Facilitate consultations between UN

agencies, humanitarian partners and national authorities on emergency relief related matters. � Participate in joint inter-agency needs assessments and identify gaps. � Draft situation reports (collect, compile and analyze information) and produce timely updates

including identification of gaps. Other profiles are increasingly sourced through the SBPP and dedicated partners are strengthening their capacities to provide OCHA with required technical profiles when needed. In particular, more Civil Military Coordination Officers, Public Information Officers (including Advocacy and Reporting Officers), Information Management Officers (including Geographical Information Systems Officer and Web-developer) are being made available to OCHA field operations.

6. Legal Background The basis of the SBPP and the Secondment of type II gratis personnel are outlined and defined in the General Assembly resolutions and Staff Rules listed below. Most relevant excerpts from General Assembly resolutions, Administrative Instructions and SBPP Memorandum of Understanding are included in Annex 4 - Legal Table.

7. How to Request a Stand-By Partner Deployment

a. As soon as a short term need - matching the criteria listed under section 2 above - arises in an OCHA field location, and the decision is taken to initiate a request for a Stand-By Partner deployment, the Country Office and CRD Desk Officer will inform the SBPP focal point in SCS ([email protected]).

b. The CRD Desk Officer in New York and a focal point in the Country Office (usually the Head of

Office or the Deputy Head of office) are both responsible vis-à-vis SCS for all aspects of the request. A formal request is initiated by submitting to SCS a completed Official Request Form for Stand-By Partner personnel, including the Terms of Reference (ToR) format attached (Annex 5 - Emergency Surge Capacity Request Form). The Emergency Surge Capacity Request Form is available on the Surge Capacity Section Intranet page, under ‘Key Documents’ (http://ochanet.unocha.org/TI/Surge_Capacity/Pages/default.aspx).

c. The field focal point will ensure proper completion of the ToR format included in the Emergency

Surge Capacity Request Form and send it to the Desk Officer in New York.

d. The Desk focal point will see to the completion of the Emergency Surge Capacity Request Form, including all signatures required, and submit it, together with the completed ToR Format, to the SBPP focal point in SCS.

e. Once SCS receives a scanned copy of the signed Emergency Surge Capacity Request Form, SCS

reviews it for completeness and suitability under the criteria governing the Stand-By Partnership Programme. If this is assured and Geneva clearances are obtained, SCS sends the Emergency Surge Capacity Request Form to Stand-By Partner organizations.

f. Stand-By Partner organizations attempt to match the need with available candidates from their

rosters and submit CVs of qualified candidates to SCS.

g. SCS screens for general suitability and shares the CVs with field and Desk focal points. If the request is for a specialized profile, the concerned technical section will be consulted as well.

h. In general, availability of candidates cannot be assured beyond 1 week after a candidate’s CV is

shared with the field. Some Stand-By Partner organizations require a response within 72 hours. For this reason, it is the expectation of SCS and of our Stand-By Partner organizations that the field will make a selection and revert to SCS within 72 hours if possible and, at the outside, within a week.

i. SBPP focal point in SCS informs the concerned Stand-By Partner organization of the field’s

selection, and the Stand-By Partner organization promptly initiates deployment procedures. Experts are hired and fielded by the Stand-By Partner organization, with some administrative support from SCS. Areas in which SCS assists in this vein are: a) letter of support for visa, if necessary, b) obtaining a UN Certificate, c) request for security clearance for Expert from UNDSS, d) sharing administrative contact details with the Expert, and e) liaising between Stand-By Partner organization and receiving Country Office for any further coordination required.

j. Once the Expert is ready to travel, SBPP focal point informs the receiving office (copying Desk

Officer) of ETA (Estimated Time of Arrival), requesting Country Office to meet the Expert at the airport and to reserve accommodation for her/him for an initial period. SCS also shares with the receiving office a copy of the relevant MoU and this User’s Guide for reference purposes. The SBPP focal point remains at the disposal of Country Offices with Stand-By Partner Experts for

any additional questions that may arise.

8. General Terms and Conditions

Employment

Stand-By Partner organizations are responsible for all deployment costs (remuneration, insurance, visas, travel, per diem/DSA which covers accommodation) EXCEPT any work-related which will be covered by OCHA (see In-country Expenses under section 9). Experts also sign a contract with the Stand-By Partner organizations (Annex 6 - Undertaking) which outlines their responsibilities towards OCHA and binds them to the same rules and regulations applicable within OCHA. Experts perform their functions under the authority of, and in full compliance with, the instructions of OCHA.

Status of the Expert

The Expert is granted the status of “Expert on Mission for the United Nations” according to Article VI, sections 22 and 23, of the Convention on the Privileges and Immunities of the United Nations of 13 February 1946 (please refer to Annex 4 – Legal Table for reference). Although the Expert is not considered a staff member or an official of the United Nations, she/he is to be fully integrated in the OCHA team in the country/region of deployment. Whilst several terms can be used to define Stand-By Partner Expert (deployee/secondee/gratis personnel/Stand-By Personnel), for consistency purposes, we will only use the term Expert in this document.

UN Certificate

Experts are entitled to carry a UN Certificate. SCS Geneva sees that this is issued following the OCHA Administrative Office clearance and made available to the Expert once fielded. The UN Certificate is to be returned to SCS Geneva upon completion of the assignment. Please note that Experts who have not returned to SCS their expired UN Certificates at the end of their assignments cannot be issued new UN Certificates in case they redeploy with OCHA.

Working Hours

Experts have the same working hours as OCHA staff. If time off during weekends is not possible due to the exigencies of work, Experts will follow whatever system for compensatory time off is used within OCHA.

Leave Entitlement and Rest and Recuperation (R&R)

R&R entitlements consist of five working days off plus two working days off for the travel from and to the duty station. The R&R days may be combined with weekends. OCHA does not meet travel, subsistence and accommodation costs for the R&R breaks. Leave and R&R plans must be approved in advance by the Head of the OCHA office in the country of deployment and confirmed with the Stand-By Partner organization. The specific entitlements of an Expert in this regard will be shared with the receiving office at the time of deployment.

Housing

Receiving offices should assist and advise Experts on how to find local housing when/where possible. In situations where local housing is not an option, the Expert should be provided with similar housing arrangements to those of OCHA staff. Costs associated with accommodation are borne by the Stand-By Partner organization either directly or as part of Expert’s DSA/salary. The Country Office ensures that hotel bookings have been made for the first few nights.

Access to Working Facilities

The Expert will benefit from the same back-up support as OCHA provides to its own international staff exercising similar functions in the office of deployment. This includes access to transport and

communication equipment, working space and other working facilities necessary for the Expert to operate. OCHA will instruct the Country Office concerned to ensure that the necessary equipment and infrastructure is available upon arrival of the Expert at the duty station. A small number of Stand-By Partner organizations can arrange for an Expert to be deployed with a laptop and some other equipment if no other solution is available locally. In such a case, the matter must be highlighted by the receiving office at the time a request for an Stand-By personnel deployment is submitted, so that Stand-By Partner organizations can be approached bearing this in mind. OCHA Vehicle – Self Drive Request In accordance with Administrative Instruction ST/AI/2006/1 (Annex 7), Experts may be authorized to drive an OCHA owned motor vehicle upon approval from the OCHA representative or OCHA Head Office, and upon completion of the OCHA Vehicle – Self Drive Request (Annex 7). The Experts must also meet the local requirements for a driving license.

Travel Costs

The Stand-By Partner organization covers travel to and from the duty station designated by OCHA in its requests. When Experts are based in an OCHA sub-office, stop-over in the capital for security and other briefings is required and should be arranged accordingly (by the Stand-By Partner organization with the support of SCS or the Country Office) at the beginning and at the end of the expert’s assignment. To the extent possible, it is preferable that the arrival date and time of the Expert coincides with working days/hours and not over a weekend or during the night. If Experts are required to travel internally, regionally or internationally for duty purposes, the OCHA Country Office covers the costs (see also In-country Expenses under section 9) of the duty travel and any related mission expenses, including DSA, while on mission.

General Security

OCHA shall afford Experts, through existing UN modalities involving inter alia UNDSS, the same protection and physical security measures afforded to its own staff. Experts must at all times be fully informed of the security situation in the field. Experts shall be included in all OCHA security arrangements in a manner consistent with UNDSS published directives.

Security Relocation/Evacuation

Like OCHA staff, Experts are relocated or evacuated as per authorization from OCHA and UNDSS. OCHA shall facilitate the security evacuation of Experts, as required, in consultation with the Stand-By Partner organizations. Stand-By Partner organizations reserve the right, in consultation with OCHA, to withdraw Experts if the security risk to them is deemed unacceptable by the Stand-By Partner organization. All costs and expenses associated with evacuation shall be assumed by the Stand-By Partner organization. Medical Evacuation During field assignments, Stand-By Partner organizations ensure that Experts are covered by adequate medical and life insurance, as well as insurance coverage for illness, injury disability or death incurred during the deployment to the UN. In the event an Expert needs to be evacuated for medical reasons, this should be arranged by Stand-By Partner organizations.

Duration of assignment/Contract Extension

Experts’ assignments are of limited duration as per the boundaries set by the General Assembly Resolution (please refer to Annex 1 – Two pager legal brief for more information). Expert assignments generally last between three to six months maximum in case of a need to provide interim assistance in the immediate aftermath of a new or escalating crisis. In situations where Experts are deployed to perform very specialized functions, the duration of assignments should be kept as short as possible and cannot exceed twelve months. As early as possible, OCHA has the obligation to plan and create more regular staffing arrangements

(revision of cost plan and creation of short or regular posts). All efforts should be made to ensure that mid-term or regular staffing arrive just before the end of Experts’ assignments to avoid any gap and to ensure hand over and continuity of tasks. Generally, no extension of Expert assignments can be considered beyond six months (in case of a need to provide interim assistance in the immediate aftermath of a new or escalating crisis) and twelve months for very specialized functions. Within these limits (six months maximum in case of urgent assistance or twelve months maximum for very specialized functions), if an extension is required, the requesting Country Office will address a request by email to the SBPP focal point within SCS ([email protected]), copying the concerned CRD Desk Officer, one month prior to the foreseen end of mission. This request must include a justification for the extension which addresses the following three points:

� How the qualities of the Expert match the job that remains to be done? � Why this position still needs to be covered by a Stand-By Partner deployment (OCHA human

resource planning)? � Which measures are being undertaken to replace the Expert upon her/his departure if necessary?

Stand-By Partner organizations require this information in order to be able to justify a request for additional financial resources from their respective sponsors. Stand-By Partner organizations have differing policies regarding extensions. Assuming the request is within the scope of what the Stand-By Partner organization concerned will consider, the SBPP Focal Point will transmit the request for extension to the Stand-By Partner organization, and relay the response, which is usually prompt, to the Country Office, copying the Desk Officer. An extension will normally begin immediately upon expiration of the original contract, unless the Expert, in agreement with her/his Stand-By Partner organization and the requesting office, chooses to take leave between contracts. Exceptions to the above will require a special review and clearance procedure involving management and the OCHA Administrative Office, coordinated through the Surge Capacity Section.

9. Roles and Responsibilities of the Requesting Office As mentioned above, while Experts are not technically considered officials of the United Nations, they are nonetheless to be fully integrated in the OCHA team in the country/region of deployment. While most of their administrative arrangements are handled by their own Stand-By Partner organization, they will obviously have to depend on the OCHA office and/or the Resident Coordinator/Humanitarian Coordinator’s Office for certain practicalities. This is to be expected and they are to be afforded the same support and consideration as any other team member. If any question or difficulty emerges which cannot be solved at field level, the SBPP focal point in SCS should be approached for support and mediation.

Prior to Arrival of Expert

The receiving Country Office prepares ahead of time for the Expert to have access to the same office facilities as OCHA staff, i.e. office space, computers, stationary and other consumables, transport facilities for work purposes. The Country Office ensures that the Expert is met at the airport and that hotel arrangements have been made for the first few nights. While housing is paid for by the Stand-By Partner organization, the receiving office should advise the Expert in identifying suitable longer term housing.

Briefing

It is the responsibility of the supervisor, or other senior staff, and UNDSS to fully brief the Expert promptly after her/his arrival. This briefing should cover, among other things, the range of substantive, administrative and security elements that are addressed in the Terms of Reference format. It is further recommended that supervisor and Expert meet a few weeks into the mission and at the half way point to fine-tune and confirm the ToR and assess progress. Security

The Expert must be included in all OCHA security arrangements throughout the deployment. The security aspects of the above mentioned briefing will include an explanation of all security procedures, including communication and call signs. A security debrief at the end of the assignment is also expected. The Expert will be provided with access to radio and any other necessary communication and MOSS equipment.

Changes in Terms of Reference

If an important change in the ToR of the Expert is deemed necessary by the Country Office, it should be discussed initially between the Expert and the direct supervisor. If an agreement is reached, the Country Office informs the SBPP focal point, who in turn contacts the Stand-By Partner organization concerned in order to seek final approval of the potential change in ToR. Desk focal point (or field) should notify SBPP focal point of any changes, tentative or not, of duty station, ToR, and travel itinerary/dates back to home station for follow-up with Stand-By Partner organization.

In-country Expenses

The receiving Country Office is responsible for covering the following in-country expenses related to the assignment:

� Any expenses at the duty station related to the assignment itself, such as rental of vehicles or mobile phones, office equipment, communications costs, etc.

� Travel-related and DSA expenses for any work-related travel in the country or region that is required.

Debriefing

A debriefing should be organized between the departing Expert and her/his supervisor in the field. Following this discussion, the supervisor will prepare the performance evaluation form (see below). In the event that the Expert transits through Geneva or New York, the Desk or SBPP focal point will organize a briefing/debriefing schedule for the Expert, involving all concerned sections. As per agreements between OCHA and Stand-By partner organizations, Stand-By partner organizations are responsible to arrange and pay for travel to and from duty station, but stop-overs at HQ for briefings/debriefings are not part of the agreement. In some specific cases (including deployment of specialized profiles) some Stand-By Partner organizations are flexible and generously agree to bear the extra costs related to briefings and debriefings in OCHA HQ.

Performance Evaluation

At the end of the Expert’s assignment, the Field will share with SCS a debrief report and a performance evaluation form completed and signed by the Expert and her/his supervisor in the field. The evaluation form to be used has been provided by the Stand-By Partner organization to the Expert (Annex 8 – Performance Evaluation Form), and once completed will be shared with the Stand-By Partner organization as well. If there is any question in this regard, the SBPP focal point can be contacted. The performance evaluation report is important feedback for the Expert, for the Stand-By Partner organization, and for the Stand-By Partnerships Programme.

10. Striving for Successful Deployments Training – Selected Stand-By Partner roster candidates may receive, OCHA and Stand-By Partner organization trainings, and in some cases specialized training organized by other agencies. In the selection of training participants, priority is given to roster members with substantive field experience. Good ToR’s – A thoughtful completion of the Terms of Reference format by the requesting Country Office goes a long way towards assuring: a) an effective match between a candidate and the need, and b) that the groundwork has been laid for a smooth deployment and results based performance management.

Field choice – The Country Office has the final say in the choice (or non-selection) of an Expert, usually from amongst a pool of at least two or three, but often times more, candidates. These will have been pre-screened by SCS, which in the case of specialized profiles will always consult the technical Section concerned. Early Communication – In case of a substantive or practical concern in relation to a SBPP deployment, early communication among all concerned (i.e. OCHA office, Expert, SCS, OCHA Administrative Office and Stand-By Partner organization) tends to avoid that a concern becomes unmanageable (e.g. dispute on tasks, performance, team dynamics, early termination of assignment). Effective line management – Everyone benefits from Experts being properly integrated into the existing field team and lines of reporting being made clear and functional from the outset. Performance Evaluations – SCS actively pursues the performance evaluation report at the end of an Expert’s assignment and incorporates this feedback into its future planning.

SURGE CAPACITY SECTION STAND-BY PARTNERHIP PROGRAMME (SBPP)

LEGAL BASIS FOR THE SECONDMENT OF STAND-BY EXPERTS The purpose of this note is to address frequently asked questions and provide standard guidance on:

� the limitations and criteria for utilizing Stand-By Partner Experts � the duration of SBPP assignments � the function of Experts in the field

Excerpts from General Assembly Resolutions, Administrative Instructions and SBPP Memoranda of Understanding are included in this document to clarify the legal basis which underpins the conditions and length of deployments by “type II gratis personnel” (or “experts on mission”). The interpretation of how these clauses apply in practical terms within OCHA is summarized below, divided into two categories: need for additional resources in case of unforeseen/critical emergency situations and the need for specialized expertise for a finite duration.

Interpretation Category 1: The field contexts in which OCHA operates are fluid with related peaks in workload which are often induced by sudden and difficult to predict ‘shocks’ in the humanitarian environment. In order to cope with these types of situations (or other ‘force majeure’ situations, e.g. the sudden departure of a number of essential office staff due to a government decision, illness, etc.), Experts may be assigned to provide interim assistance in the immediate aftermath of a new or escalating crisis. These assignments are fixed for an initial 3 to (maximum) 6 month period and should be kept as short as possible. If the increase in workload is expected to persist, OCHA is obliged to ensure that additional resource allocation takes place at the earliest possible opportunity so that the additional workload can be dealt with through regular (human) resources. The resource situation should be reviewed and adjusted (e.g. through a cost plan revision and the creation of a new post) during the initial phase of the Expert deployment to enable regular staff to arrive in situ before the end of the Expert assignment, to avoid any gap and to ensure hand over and continuity of tasks. On average, the duration of SBPP deployments to OCHA in recent years falls within the 4-5 month range. This is compliant with the above parameters and should be maintained so as to ensure disciplined, appropriate and durable utilisation of the SBPP as an emergency staffing mechanism. Category 2: In addition, Experts can be exceptionally used to perform very specialized functions

2 where OCHA

lacks the appropriate expertise and resources. In the case of a protracted crisis, and at any subsequent occasion where a budget is being prepared, the need for these specialized functions must be reviewed. If the need remains, then consideration must be given to establishing internal capacity to meet these needs through the recruitment of specialized personnel. The initial duration of these assignments too will be for a limited and specified period of time and cannot exceed 12 months. If the need is likely to last longer, OCHA has the obligation to plan accordingly and create alternative staffing options. In sum, SBP Expert utilization is warranted and justified if the following criteria are met:

� An OCHA Country/Regional Office is confronted with a sudden and unforeseen need for additional human resource capacity for core OCHA coordination functions or to carry out very specialised activities, up to maximum of 6 months deployment;

� Regular human resources have not yet been adjusted to the new demands placed on the office; � All efforts are made to keep SBP assignments as short as possible by, inter alia, the rapid recruitment

of regular staff once budgets have been adjusted.

In sum, SBP Expert utilization is not authorised if:

� The need for additional human resource capacity is of a regular, non-urgent and foreseeable nature; � There is an empty regular post/function in the office that could have been filled to address the sudden or

specialised tasks at hand.

Annex 3 – Memorandum of Understanding

MEMORANDUM OF UNDERSTANDING

between the United Nations, acting through its Office for the Coordination of

Humanitarian Affairs,

and

PARTNER

WHEREAS it is the shared intention of the United Nations Office for the Coordination of

Humanitarian Affairs (hereafter referred to as “OCHA”) and PARTNER to improve the humanitarian

coordination efforts of the United Nations through assessment, early planning, design and

establishment of coordination mechanisms in field locations designated as humanitarian emergencies

by the United Nations Emergency Relief Coordinator;

WHEREAS it is the shared view of OCHA and PARTNER that, when required, in line with

resolutions and decisions of the United Nations General Assembly on humanitarian assistance, in

particular General Assembly resolutions 46/182 and 47/168, the establishment of an international

presence, including the humanitarian coordination component of a United Nations response, should be

undertaken as expeditiously as possible;

WHEREAS OCHA’s capacity to respond to such requests can be enhanced through the establishment

of a stand-by capacity made available by PARTNER, through a roster of qualified and experienced

expert personnel, to complement OCHA’s internal staffing capacity;

WHEREAS by its resolution 46/182, the General Assembly indicated that the United Nations should,

building upon the existing capacities of relevant organizations, establish a central register of, inter alia,

all specialized personnel and teams of technical specialists available within the United Nations system

and from Governments and intergovernmental and non-governmental organizations, that can be called

upon at short notice by the United Nations, and that the United Nations should continue to make

appropriate arrangements with interested Governments and intergovernmental and non-governmental

organizations to enable it to have more expeditious access, when necessary, to their emergency relief

capacities;

WHEREAS pursuant to the guiding principles set out in the Annex to General Assembly resolution

46/182, humanitarian assistance is to be provided by OCHA with the consent of the affected country

and in principle on the basis of an appeal by the affected country;

WHEREAS the Secretary-General may accept type II gratis personnel on an exceptional basis in

accordance with the conditions established by the General Assembly in its resolution 51/243 of 15

September 1997 and guidelines approved by the General Assembly in its resolution 52/234 of 26 June

1998, and as implemented in ST/AI/1999/6,3

NOW THEREFORE OCHA and PARTNER (hereafter collectively referred to as the “Parties”) agree

as follows:

ARTICLE 1

NATURE OF COOPERATION AND

ADMINISTRATIVE OBLIGATIONS

Obligations regarding the Stand-by Roster

1.1 The Parties agree that PARTNER shall, in consultation with OCHA, establish a stand-by roster

of specialized personnel and teams of technical specialists (hereafter referred to as the “Stand-by

Roster”) who will be available for rapid recruitment and deployment, upon selection by OCHA, in

accordance with the terms of the present MoU and any agreement concluded thereafter, to Country Offices managed by OCHA. These individuals are hereafter referred to as “Experts”.

Skill profile

1.2 The Experts on the Stand-by Roster shall have the appropriate skills profile as specified by

OCHA and communicated to PARTNER.

1.3 The skills profile for inclusion of Experts on the Stand-by Roster shall be reviewed jointly by

the Parties at least once a year. They should take into account the evolving or current needs of the

United Nations field operations. However, the final decision on the content of a skills profile shall be

taken by OCHA.

1.4 During the annual review of the skills profile, the general validity of the roster will be reviewed.

At that time the Parties will ascertain whether the Experts who are on the roster should be maintained

for the subsequent year, and if the names of newly identified suitable Experts should be added to the

roster. Through regular communications between the Parties outside the review period it is agreed that

candidates may be placed on the roster by PARTNER should they meet the established skills profile

for inclusion agreed by OCHA and PARTNER.

Deployment readiness

1.5 PARTNER recognizes that the work and services of an Expert will be performed under harsh

or hostile conditions, including, but not limited to, conditions caused by civil unrest, war, natural

disasters and other emergencies.

1.6 Experts on the Stand-by Roster, in addition to the required professional qualifications, must

possess the required attributes, such as maturity, cultural sensitivity, adaptability, ability to work in a

team, ability to work in difficult climatic and geographical conditions, versatility and flexibility to

work under emergency conditions where demands may be constantly changing.

Selection

1.7 PARTNER shall maintain the Experts Roster for United Nations partners as established by its

own internal procedures. On the basis of a request from OCHA, PARTNER will select candidates

from the Roster and forward details of selected candidates to OCHA. These candidates will be

evaluated by OCHA to ensure that the best qualified Experts are selected on the basis of the

recruitment standards established by the United Nations, in terms of qualifications, experience and

other relevant factors, taking into account the date of availability of the Experts. OCHA shall select

Experts from those suggested to OCHA by PARTNER for deployment, pursuant to this MoU, in

accordance with the needs of the particular situation, as determined solely by the United Nations, and

in conformity with this MoU as well as applicable United Nations resolutions, rules, policies and

procedures. When selecting an Expert for a mission, due regard shall be paid to the need to achieve a

gender balance and the importance of ensuring that personnel are obtained from as wide a

geographical base as possible.

Mobilization and Deployment

1.8 PARTNER shall ensure that the Experts on the Stand-by Roster shall, when the stand-by

capacity is activated at the request of OCHA, be prepared to deploy to any location in the world within

72 hours of the confirmation of suitability of a candidate by OCHA, and, as such, should have

completed all the necessary formalities, including required medical clearances.

1.9 PARTNER, in cooperation with OCHA, shall ensure that the Experts are provided with general

briefing kits on the United Nations and OCHA, including its structure, together with facts about

working in a multi-cultural environment, security related issues and stress management. In addition,

PARTNER shall ensure that the Experts are provided with data concerning the specific situation in the

country of deployment, the structure of the United Nations presence in-country and the requirements

of the OCHA presence. OCHA shall provide operational and administrative briefings upon arrival of

the Experts to the deployment location.

1.10 When requesting Experts, OCHA will provide PARTNER with written Terms of Reference

specific for the assignment and justification for the need to deploy the Experts.

The Terms of Reference shall include:

• The profile of the Experts required;

• Duty station to which the Experts should report;

• The anticipated period of the Assignment three (3) to (6) months, unless otherwise agreed.

1.11 PARTNER shall be responsible for making all travel arrangements for the Experts travelling to

the closest port of entry to the duty station designated by OCHA in its request, and return to the

Experts’ home station on completion of the deployment. PARTNER shall initiate travel arrangements

and inform OCHA of the expected arrival of the Experts. All travel and related costs in connection

with the travel of the Experts to the closest port of entry to the duty station, and return to the Experts’

Stand-by Personnel’s home station, shall be borne by PARTNER and OCHA shall have no liability in

this respect.

1.12 OCHA shall provide the Experts with office space, support staff, equipment, and other

resources necessary to carry out tasks assigned to them while deployed.

1.13 OCHA shall undertake the field administration and oversight of the Experts during the

assignment and shall designate a Supervisor for each of the Experts prior to their deployment.

1.14 OCHA shall integrate the Experts into the framework of its operations and shall provide the

necessary operational and administrative support in-country. Experts shall be accorded the same

support, except as otherwise provided in this agreement, as regular international OCHA staff.

1.15 PARTNER shall arrange for entry visas and any other necessary travel-related documents for

the deployment of the Experts to the closest port of entry to the assignment designated by OCHA in its

request. OCHA shall, as and when requested by PARTNER, assist as appropriate.

1.16 In addition, costs incurred by the Experts undertaking travel at the request of the UN in the

discharge of their functions within the country of deployment, shall be paid by the United Nations in

accordance with the United Nations regulations, rules, policies and procedures on the same basis as

costs incurred by staff members, including payment of daily subsistence allowance when the Expert is

required to travel away from the duty station over night.

1.17 Experts shall have the same Rest and Recuperation Break (R&R) entitlements as OCHA staff

members. OCHA does not meet travel, subsistence and accommodation costs for the R&R breaks.

PARTNER will provide seconded Experts with five working days off plus two working days off for

travel from and to duty station where R&R entitlements apply.

1.18 OCHA will ensure that the deployment of Experts in humanitarian emergency operations under

this MoU has received the consent of the affected country.

1.19 OCHA shall immediately notify PARTNER of changes in the nature, scope, operational

content, terms of reference or timing of the assignment, as may affect the deployment of the Experts.

1.20 Experts shall be issued with an identity card stipulating their OCHA affiliation.

Category of Expert

1.21 The Experts provided by PARTNER under this MOU shall be “type II” gratis personnel who

are personnel provided to the United Nations by a government, intergovernmental or non-

governmental organization responsible for the remuneration of the services of such personnel and who

do not serve under any other established regime such as that applicable to interns, associate experts or

personnel provided on a non-reimbursable loan. The status, obligations, terms and conditions of the

Experts are set forth in Article 2 below.

1.22 OCHA shall ensure that Experts provided by the PARTNER shall, inter alia, be included in all

OCHA security arrangements, consistent with the Office of the United Nations Security Coordinator’s

published directives.

1.23 PARTNER reserves the right, in consultation with OCHA, to withdraw Experts if the security

situation deteriorates, or if the risk to Experts is deemed unacceptable by PARTNER.

ARTICLE 2

STATUS, OBLIGATIONS, TERMS AND CONDITIONS OF THE

DEPLOYED STAND-BY ROSTER EXPERTS

Obligations of the Experts

2.1 PARTNER agrees to the terms and obligations specified in Articles 2.2 to 2.7 below and shall,

as appropriate, ensure that the Experts performing services under the present MoU comply with those

obligations.

2.2 PARTNER shall ensure that Experts perform their functions under the authority of, and in full

compliance with, the instructions of OCHA.

Standards of Conduct

2.3 Experts shall undertake to respect the impartiality and independence of the United Nations and

shall neither seek nor accept instructions regarding the services performed under the present MoU

from any Government or from any authority external to the United Nations.

2.4 Experts shall refrain from any conduct that would adversely reflect on the United Nations and

shall not engage in any activity that is incompatible with the aims and objectives of the United Nations.

They shall comply with all rules, regulations, procedures or directives issued by the United Nations

and which are relevant to the performance of their functions.

2.5 Experts shall serve in a personal capacity and not as representatives of a government or of any

other authority external to the United Nations. They shall exercise the utmost discretion in all matters

relating to their functions and shall not communicate, at any time, without the authorization of OCHA,

to the media or to any other institution, person, government or other authority external to the United

Nations, any information that has not been made public, and which has become known to them by

reason of their association with the United Nations. They shall not use any such information without

the written authorization of OCHA and, in any event, such information shall not be used for personal

gain. These obligations do not lapse upon expiration of the present agreement or completion of the

expert’s assignment to OCHA.

2.6 Each Expert shall sign an undertaking in the form attached to this MoU as the Annex 1.

2.7 As gratis personnel, the Experts may not supervise United Nations staff members in the

exercise of their official duties or be involved in decisions affecting the status, rights and entitlements

of staff members. Exceptionally, however, the Experts having managerial responsibilities may

supervise staff members who provide direct support to them.

Duration of functions

2.8 As gratis personnel, the Experts will be deployed on a short-term basis to humanitarian

emergencies for which the UN Emergency Relief Coordinator is mandated to provide coordination

services, and pending a decision on the level of funds required for the Office to institutionalize its

response. Thus, the initial period of deployment of the Experts, other than for United Nations Disaster

Coordination and Assessment (UNDAC) missions, will be 90 days and will not normally exceed 180

days. OCHA shall inform PARTNER of the expected duration of the initial deployment for each

Expert.

Remuneration, medical and life insurance, pension and other social security benefits

2.9 All expenses in connection with the services of the Experts, other than the expenses for which

the United Nations is responsible as expressly provided in this MoU, shall be paid by PARTNER,

including salaries, allowances and benefits to which the individuals involved are entitled and travel

costs to and from the location of assignment. During the entire period of service under the agreement

PARTNER shall also ensure that the Experts are covered by adequate medical and life insurance, as

well as insurance coverage for illness, injury, disability or death incurred in the service of the United

Nations.

2.10 The United Nations does not accept any liability for claims for compensation in respect of

illness, injury or death of the Experts arising out of or related to the provision of services under the

present MoU, except where such illness, injury or death results directly from the gross negligence of

the officials or staff of the United Nations. Any amounts payable by the United Nations shall be

reduced by the amounts of any coverage under the insurance referred to in Article 2.9 of the present

MoU.

Accountability

2.11 Without prejudice to any other right of the United Nations to terminate the service of Experts,

unsatisfactory performance or failure to conform to the standards of conduct set out in this MoU may

lead to the termination of service, for cause, at the initiative of the United Nations. One-month notice

shall be given in such cases. In addition, the service of Experts may be terminated at any time when it

is considered in the interest of the United Nations, or when their services are no longer required as per

operational requirements of OCHA. The continued service of Experts is always subject to availability

of necessary funding and continued OCHA presence in the country of deployment.

2.12 Any serious breach of the duties and obligations that, in the view of the Secretary-General,

would justify separation before the end of the notice period will be immediately reported to

PARTNER, with a view to obtaining agreement on an immediate cessation of service. The Secretary-

General may decide to limit or bar access to United Nations premises by the individual concerned

when the circumstances so warrant.

2.13 PARTNER will reimburse the United Nations for financial loss or for damage to United

Nations-owned equipment or property, caused by expert personnel provided by PARTNER if such loss

or damage (a) occurred outside the performance of services with the United Nations, or (b) arose or

resulted from gross negligence or willful misconduct or violation or reckless disregard of applicable

rules and policies by such personnel.

2.14 The United Nations shall be responsible for dealing with claims by third parties where the loss

of or damage to their property, or death or personal injury was caused by the actions or omissions of the

Experts in the performance of services to the United Nations under the agreement with PARTNER.

However, if the loss, damage, death or injury arose from gross negligence or willful misconduct of the

Experts provided by PARTNER, PARTNER shall be liable to the United Nations for all amounts paid

by the United Nations to the claimants and all costs incurred by the United Nations in settling such

claims.

2.15 Expert personnel may not apply for or be appointed to posts in the United Nations Secretariat

for a period of six months after the end of their service under this MoU. This restriction shall be

incorporated in the undertaking to be signed by Experts.

Legal Status

2.16 Experts shall not be considered in any respect as being officials or staff of the United Nations.

2.17 While performing functions for the United Nations, the Experts shall be considered as “experts

on mission” within the meaning of Article VI, Sections 22 and 23 of the Convention on the Privileges

and Immunities of the United Nations, of 13 February 1946. When required to travel on behalf of the

United Nations, they shall be provided with a United Nations Certificate in accordance with Article

VII, Section 26 of the above-mentioned convention.

Annual Leave

2.18 Annual leave may be taken by the Experts in accordance with their terms of service with

PARTNER, but may not exceed leave entitlements of United Nations staff members. Accordingly, the

Experts deployed for a period of six months or less may be granted leave up to a maximum of one and

one half days for each full month of continuous service.

2.19 Leave plans must be approved in advance by, or on behalf of, the Head of the OCHA office in

the country of deployment.

Medical Clearance

2.20 Before being deployed pursuant to the terms of this MoU, Experts shall be required to submit a

statement of good health prior to commencement of work and to take full responsibility for the

accuracy of that statement, including confirmation that they have been informed regarding inoculations

required for the country or countries to which their travel is authorized.

Evaluation of performance

2.21 At the end of the assignment, a performance evaluation form for each Expert shall be

completed and signed by his/her supervisor, the content of the form shall be in accordance with the

United Nations Appraisal System. The form will be reviewed annually to ensure its continued

relevance. OCHA shall provide PARTNER with the signed form.

2.22 OCHA and PARTNER shall on a regular basis, and as appropriate exchange information on the

performance of the Expert and progress of the assignment. PARTNER, in consultation and cooperation

with OCHA, may send representatives to monitor the performance of the Expert.

ARTICLE 3

GENERAL CONDITIONS

ENTRY INTO FORCE, DURATION AND TERMINATION

3.1 Without limiting any of the preceding provisions, the implementation of this MoU will be in

compliance with the respective resolutions, administrative and financial regulations, rules and

procedures of the United Nations and shall be subject to the availability of funds.

3.2 This MoU shall enter into force upon signature by both Parties and shall be effective until it is

terminated by written notice from either Party as stipulated in Article 3.4. The present MoU may be

amended by written consent of the Parties. Each Party shall give full consideration to any proposal for

an amendment made by the other Party. Any such amendment shall become an integral part of this

MoU.

3.3 The United Nations and PARTNER shall consult with each other in respect of any matter that

may arise in connection with the present agreement.

3.4 This MoU may be terminated by either Party by written notice to the other and shall terminate

90 days after receipt of such notice. However, ongoing activities and commitments will not be affected

by this termination, unless the Parties have agreed otherwise.

3.5 PARTNER shall not be entitled to any compensation under the terms of this MoU.

ARTICLE 4

SETTLEMENT OF DISPUTES

Arbitration

4.1 Any dispute between the United Nations and the Government relating to the interpretation and

application of the present Agreement which is not settled by negotiation or other agreed mode of

settlement shall be submitted to arbitration at the request of either Party. Each Party shall appoint one

arbitrator, and the two arbitrators so appointed shall appoint a third, who shall be the chairman. If

within thirty (30) days of the request for arbitration either Party has not appointed an arbitrator, or if

within fifteen (15) days of the appointment of two arbitrators the third arbitrator has not been

appointed, either Party may request the President of the International Court of Justice to appoint an

arbitrator. The procedure for the arbitration shall be fixed by the arbitrators, and the expenses of the

arbitration shall be borne by the Parties as assessed by the arbitrators. The arbitral award shall contain

a statement of the reasons on which it is based and shall be accepted by the Parties as the final

adjudication of the dispute.

4.2 Nothing in or relating to this MoU shall be deemed a waiver, express or implied, of any

privileges and immunities of the United Nations, including its subsidiary organs.

IN WITNESS WHEREOF, the respective representatives of the United Nations, and PARTNER have

signed the present Memorandum of Understanding.

SBPP PARTNER INFORMATION SHEET

ActionAid Australia is an Australian-based specialist humanitarian aid and development NGO with a mission for basic human security and the empowerment of local communities to escape poverty. The organization is specialized in emergency response and preparedness, the protection of the rights of refugees and internally displaced people, sustainable livelihood recovery, and the prevention of future

crises, including peace-building. ActionAid Australia gives support in areas like complex emergencies, natural disasters and in situations of civil unrest. Through its Protection Program and Rapid Response Register, ActionAid Australia seconds a range of experienced individuals as protection experts on short-term deployments as protection staff in a number of specialities and regions. Its roster consists of 74 candidates with profiles like Humanitarian Affairs Officers, Senior Humanitarian Officers, Protection/IDP Officers, Gender Based Violence Officers/Coordinators and Child Protection Officers. 46 of the 74 members have experience of working with OCHA/UN. Notable linguistic expertise in ActionAid Australia’s roster is French, Spanish, Arabic, Russian, Hindi, Tamil, Sinhala, Dari, Indonesian, Krio and Kiswahili.

CANADEM is mandated to assist the UN identify civilian experts for international field missions. To do this, it maintains an international roster of over 10,000 registrants. CANADEM is also a key implementing partner for the Canadian Department of Foreign Affairs and the Canadian International Development Agency. It has undertaken large projects all over the world and

currently operates the Canadian Governance Support Office in Kabul, Afghanistan. CANADEM’s expert database is strong in the following areas: policing, legal reform, human rights, water and sanitation, and civil engineering. They provide support in complex emergencies, natural disasters and in civil unrest. Profiles available in CANADEMS roster are Humanitarian Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Information Management Officers, Geographic Information Systems Officers, Protection/IDP Officers and ICT Officers. French and English are the dominating language skills among CANADEM’s roster members among which 3000 have experience from working with OCHA/UN.

The Danish Refugee Council (DRC) is one of the largest Danish NGOs with the aim to protect refugees against persecution and to promote durable solutions. The organization covers a broad spectrum of tasks within relief, rehabilitation and recovery. Internationally, DRC works in the context of conflict-induced displacement, early recovery and return situations. The DRC Stand-By roster has 250 trained specialists available for rapid secondment to UN organizations. The objective is to contribute to UN’s

provision of emergency and rehabilitation assistance to refugees, IDPs and other groups affected by war or crisis. Complex emergencies, natural disasters and civil unrest are in the field of DRC’s expertise. Its roster consists of Humanitarian Affairs Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Geographic Information Systems Officers, Protection/IDP Officers, ICT Officers, Emergency Officers, Logisticians and Reconstruction Officers. Many of the roster members speak French, Russian and Spanish. DRC has 35 expert candidates with previous OCHA/UN experience.

Department for International Development (DFID) is the part of the UK government that manages Britain's aid to poor countries and works to get rid of extreme poverty. The organization is led by a senior cabinet minister. It works in 150 countries and has 2,600 staff, half of whom work abroad. DFID has headquarters in London and East Kilbride, near Glasgow, and 64 offices overseas.

The organization works with governments of developing countries, charities, businesses and international bodies, including the World Bank, the UN agencies and the European Commission, who all share its ambition to achieve the Millennium Development Goals. DFID is able to provide Stand-By experts such as Humanitarian Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Information Management Officers, Geographic Information System Officers, Protection/IDP Officers and ICT Officers in situations of complex emergencies, natural disasters and civil unrest.

The Iceland Crisis Response Unit (ICRU) has its main focus on deployments to Afghanistan, the Middle-East, the Balkans and Africa. Its chief international partners are the UN, ISAF (NATO), EU and OSCE. ICRU is a department within the Ministry for Foreign Affairs and part of the Directorate for Development Co-operation. ICRU participates in a wide range of missions, and supplies a diverse pool of 150 active personnel in times of complex emergencies and civil unrest. Experts available in its roster are Humanitarian Affairs Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers,

Geographic Information Systems Officers, Protection/IDP Officers and Gender and Development Officers. Deployments are

The Information Management and Mine Action Programs (iMMAP) aims to alleviate the suffering of victims of natural disasters and armed conflict by providing decision-support services to humanitarian agencies through the management of reliable, timely and appropriate strategic and geographic information. iMMAP’s mission is to be the first port of call for Information and Knowledge Management expertise within the humanitarian community. IMMAP maintains a diverse roster of talented field personnel on which it can call at short notice to respond to sudden-onset emergencies. The technical skill set encompasses a range of

applied sciences and technologies that include the social sciences, public health, systems analysis, statistics, survey and assessment methodology, computer mapping, graphic design, and application development.

Irish Aid is the programme of overseas development assistance of the Irish government. It is, in fact, the Development Cooperation Division of the Irish Department of Foreign Affairs. Poverty reduction, to reduce vulnerability and increase opportunity, is the overarching objective of Irish Aid. Complex emergencies and natural disasters are two categories supported by Irish Aid and the geographic priority focus of the organization is Africa. The Stand-By personnel offered by Irish Aid are Humanitarian

Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Protection/IDP Officers, ICT Officers, Logisticians and other officers in the field of Engineering, Public Health and Education. Approximately 10 of Irish Aid roster members have previous experience from working with OCHA/UN and it has some Spanish and French speakers in its roster.

Swedish Civil Contingencies Agency (MSB) is commissioned by the Swedish government to establish and maintain an emergency preparedness organization for both national and overseas disaster and humanitarian aid operations in cases of complex emergencies, natural disasters and civil unrest. MSB works with humanitarian operations and humanitarian mine action as well as capacity building, early recovery and support for peace-promoting missions. It has 1700 experts available in

several areas of expertise including: Humanitarian Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Information Management Officers, Geographic Information Systems Officers, ICT Officers and Logistics Officers. The organization has a range of candidates with good knowledge of French, Arabic and Spanish. 750 of the 1700 MSB experts have previous OCHA/UN experience. MSB also has a capacity in form of modules such as base camp support, water and sanitation modules and medical emergency response teams.

The Norwegian Refugee Council (NRC) is an independent, humanitarian non-governmental organization which provides assistance, protection and durable solutions to refugees and internally displaced persons worldwide. The Norwegian Capacity to International Operations (NORCAP) is NRC’s emergency Stand-By roster. NRC cooperates closely with the UN and other organizations around the world as well as in Norway. The emergency Stand-By roster is

one of the main pillars of NRC and they provide support to the SBPP in situations of complex emergencies and natural disasters. NORCAP consists of more than 800 candidates of Humanitarian Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Information Management Officers, Geographic Information Systems Officers, Protection/IDP Officers and ICT Officers. 500 of these candidates have previous experience from working with OCHA/UN. Notable language skills in the NORCAP are Arabic, French, Spanish and Portuguese.

Qatar Charity (QC) is a non-government organization which was established in 1992 in order to support the Qatari society and other needy communities abroad. Its mission is to support the abilities of the most needy groups to fulfil human dignity and social justice in cooperation with partners. Its vision is to be an example, a pioneering, distinguished Islamic institution which combines originality, creativity and professionalism in the field of humanitarian aid and development. QC is one of the

largest charities in the Gulf, its activities covering more than 40 countries in Africa, Asia and Europe, through its registered field offices in various countries or local civil societies as implementing partners.

RedR Australia is accredited with RedR International – a network of autonomous RedR organizations based in the UK, Australia, New Zealand, India, Canada, Southern Africa and Malaysia. RedR Australia is a member of the Australian Council for International Development, the Australian NGO umbrella body. It is contracted by AusAID to provide support to UN agencies in emergency relief. Its mission is to relieve suffering in complex emergencies, natural disasters and civil unrest by selecting, training and providing

competent and effective personnel to humanitarian relief agencies world-wide. RedR Australia does not run its own projects but has Stand-By Partner Agreements with OCHA, UNHCR, WFP and UNICEF. There are approximately 180 candidates available for deployment in the RedR roster with the following profiles: Humanitarian Affairs Officers, Senior Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Protection/IDP Officers, ICT Officers, Logisticians and Civil Engineers. 128 of these candidates have previously worked with OCHA/UN.

Swiss Development Cooperation Directorate Humanitarian Aid (SDC/HA) has a long history of working with and supporting UN agencies worldwide before, during and after conflicts, complex emergencies, natural/technological disasters, civil unrest and other protracted situations. SDC/HA has a roster of about 620 personnel consisting of Humanitarian Affairs Officers, Senior

Humanitarian Officers, Civil Military Coordination Officers, Public Information Officers, Reporting Officers, Information Management Officers, Geographic Information Systems Officers, Protection/IDP Officers and Logisticians. SDC/HA has a limited number of experts permanently on mission, but the majority of its members maintains normal full time employment elsewhere. As a result, the average activation time of SDC/HA secondment is about four weeks. In exceptional cases, SDC/HA can provide limited equipment inputs to its Stand-By personnel. About 30 of these candidates have experience of working with OCHA/UN. Notable languages of the roster are Arabic, French, Russian, German, Portuguese and Spanish.

Criteria for Deployment

2.1 (b) “To provide temporary and urgent assistance in the case of new and/or expanded mandates of the Organization, pending a decision by the General Assembly on the level of resources required to implement those mandates.” 2.2 “Gratis personnel may not be sought or accepted as a substitute for staff to be recruited against posts authorized for the implementation of mandated programmes and activities.”

Preamble: "Recognizing that the use of gratis personnel, other than those performing supplementary activities, should be on an exceptional and temporary basis and for specialized functions only." 7. "…lack of adequate staff resources should not give rise to acceptance of type II gratis personnel and that in the future clearer demonstration and justification should be given that acceptance of gratis personnel meets the requisite criteria contained in paragraph 4 of resolution 51/243;"

2.5 "...They shall exercise the utmost discretion in all matters relating to their functions and shall not communicate, at any time, without the authorization of OCHA, to the media or to any other institution, person, government or other authority external to the United Nations, any information that has not been made public, and which has become known to them by reason of their association with the United Nations...These obligations do not lapse upon expiration of the present agreement or completion of the expert’s assignment to OCHA."

Loss or Damage of UN Property & Equipment

12.3 "The donor will reimburse the United Nations for financial loss or damage (a) occurred outside the performance of services with the United Nations, or (b) arose or resulted from gross negligence or wilful misconduct or violation or reckless disregard of applicable rules and policies by such gratis personnel."

2.13 "PARTNER will reimburse the United Nations for financial loss or for damage to United Nations-owned equipment or property, caused by expert personnel provided by PARTNER if such loss or damage (a) occurred outside the performance of services with the United Nations, or (b) arose or resulted from gross negligence or wilful misconduct or violation or reckless disregard of applicable rules and policies by such personnel.”

Misconduct, Poor Performance, Early Termination

12.1 "Unsatisfactory performance, or failure to conform to the standards of conduct set out above, may lead to termination of service, for cause, at the initiative of the United Nations. One month notice shall be given in such cases."

2.14 "The United Nations shall be responsible for dealing with claims by third parties where the loss of or damage to their property, or death or personal injury was caused by the actions or omissions of the Experts in the performance of services...However, if the loss, damage, death or injury arose from gross negligence or wilful misconduct of the Experts provided by PARTNER, PARTNER shall be liable to the United Nations for all amounts paid by the United Nations to the claimants and all costs incurred by the United Nations in settling such claims."

Remuneration 8.1 "All expenses in connection with the services of gratis personnel, including salaries, allowances and benefits to which the individuals involved are entitled and travel costs to and from the location where the gratis personnel are based, shall be paid by the donor."

Rest & Recuperation (R&R)

1.17 “Experts shall have the same Rest and Recuperation Break (R&R) entitlements as OCHA staff members. OCHA does not meet travel, subsistence and accommodation costs for the R&R breaks. PARTNER will provide seconded Experts with five working days off plus two working days off for travel from and to duty station where R&R entitlements apply.”

3.1 "In order to achieve the purpose defined in section 1.1, ORB [R&R] shall be granted after three months of qualifying service. ORB shall not be granted during the last month of mission service." Section 3.5 "ORB [R&R] is granted for five working days. No additional days shall be authorized as ORB for travel purposes. Section 3.6 "... ORB [R&R] may be taken in conjunction with weekends or official holidays."

Travel - Official business

8.2 "Costs incurred by gratis personnel undertaking official travel in the discharge of their functions shall be paid by the United Nations on the same basis as costs incurred by staff members, including payment of daily or mission subsistence allowance, as applicable."

2.17 “While performing functions for the United Nations, the Experts shall be considered as “experts on mission” within the meaning of Article VI, Sections 22 and 23 of the Convention on the Privileges and Immunities of the United Nations, of 13 February 1946. When required to travel on behalf of the United Nations, they shall be provided with a United Nations Certificate in accordance with Article VII, Section 26 of the above-mentioned convention.” 1.11 “PARTNER shall be responsible for making all travel arrangements for the Experts travelling to the closest port of entry to the duty station designated by OCHA in its request, and return to the Experts’ home station on completion of the deployment….”

Security 1.22 ”OCHA shall ensure that Experts provided by the PARTNER shall, inter alia, be included in all OCHA security arrangements, consistent with the Office of the United Nations Security Coordinator’s published directives.” 1.23 “PARTNER reserves the right, in consultation with OCHA, to withdraw Experts if the security situation deteriorates, or if the risk to Experts is deemed unacceptable by PARTNER.”

Medical Coverage

8.1 “During the entire period of service under the agreement, the donor shall also ensure that gratis personnel are covered by adequate medical and life insurance, as well as insurance coverage for illness, disability or death incurred in the service of the United Nations.”

GENERAL COMMENTS on Staff’s overall performance:

Instructions And Guidelines

1. The following guidelines should be used in evaluation the Standby Staff’s performance. They are aimed at ensuring consistent

application of evaluation rating by the evaluating officers:

Unsatisfactory: The performance/quality of service failed to meet the minimum standards of acceptability. The lack of required

quality contributed to the complete or near failure of the deployment. Only Adequate: The performance/quality of service was only adequate. More had in fact been expected. On the other hand, the

deficiency was not so grave as to jeopardize the objectives of the deployment.

Satisfactory: The performance/quality of service was sufficient for the satisfactory completion of the deployment.

Very good: The performance/quality of service was of a higher standard than expected and resulted in a fully satisfactory

completion of the tasks given to the Standby Staff. Exceptional: The rating should be reserved for Standby Staff whose performance/quality of service was of an exceptional

degree, and therefore considered worthy of special note.

2. Part 1 and Part 2 of the form should be completed upon arrival of the Standby Staff. The remaining parts should be completed before

the departure of the Standby Staff.

3. It is essential to bear in mind that the performance/quality of service should be evaluated in terms of the objectives and requirements

of the deployment for which s/he was engaged.
