official poll watchers at Central Counting. I was a Poll watcher for Justice of the Peace Elect Brian I lutchcson, at the Dal las County Central Counting Station. Mr. Brian Hutcheson was running for Justice of the Peace, on the November 8, 20 16 ballot.

I) 1 arrived at approximately I 0:36 am at the Dallas County Central Counting Station located at 2377 . Stemmons Freeway, Suite 820. Dallas, Texas, 75207, located on the 8th floor of the I lcalth &

Human Services Building, Dallas County Elections Department. 1 went into the Elections Department and announced to the Receptionist that I was there to be a Pol l Watcher for the Central Counting Location. he contacted \!tr. Daniel Brad ley the Election Judge. 1 introduced myscl f to Mr. Daniel Bradley.

2) I was present at the Central Elections Counting tation from I 0:36 am through approximately 6:05 pm. Both Mr. James Aston and I showed up for Poll watching duties pretty close to the same time. We talked with the Election Judge, Mr. Daniel Bradley and presented our ""Appointment of Poll Watcher by Candidate 011 the Ballot or Declared Write-in Candidate" form to him for his approval and signature. Both of us had speci fied in the box named ··Precinct or other location Poll Watcher is to serve:" we speci fied Central Counting Locatiqn as the location we were asked to Poll Watch. I was a Poll watcher in the Primary election in March 2016, I knew what and where the Elections computer, keyboard. monitors. and printer v. ere located. ince my previous effort at poll watching, I observed that the area to physically view the Central Counting elections computer and elections printer was blocked by large bags. J\ccording to Elections Code, Chapter 33.056(a): "A watcher is entitled to sit or stand CQnveniently near the electiQns Qjjicers conducting the oflserved ac_tivity'·.

6) Immediately upon entry. our poll watching activities were obstructed by Mr. Bradley 's instructions to stand only in the ballot board room. We were not there to observe the Ballot Board, we were there as official poll watchers for Central Counting ration activities. Mr. Bradley restricted our ability to .. sit or stand conveniently near the election officers conducting the observed activity" in the Central Counting Station. We were ordered to stand in the Ballot Board Room, where they transfer mail-i n ballots to the E &S Scanner Ballots, at some tables along the glass wall that separates the Ball ot Board Room from Central Counting (See Attachment # I).

The area in which we were told to stand was approximately 20 to 25 feet away from the Central Counting Computer, keyboard, monitors and 15 to 20 feet from the printer used for Central Counting. The continuous feed printer dedicated to printing the real time audit logs "'as si tuated in such a manner as to completely obstruct my abi l ity as a Poll watcher to observe. At 15 to 25 feet it was physically impossible for me to read a 12 font to verify if there were any errors, corruption errors or warnings on the elections computer monitors or printers.

The act of demanding that I stand approximately 20 to 25 feet away from the Elections Computer. is intentional obstruct ion relative to m) abi l ity to w itness the process, and to read the Counting Computer monitor, and/or the associated printer, and there was no way for me to verify any error messages such as corruption error, counting errors, etc.

I asked Mr. Daniel Brad ley about standing in the Central Counting Area, and Mr. Bradley refused and said I could nor stand in Central Counting until 7:00 PM when the counting begins. Which in effect means from the very onset obstructing my access to Central Counting to watch the processing, and preparing to process, election results.

7) Between where the Poll Watchers arc relegated to stand and the central counting area, there is a wall w ith a shel f at one of the Co-Workers Stations obstructing the view of the Monitors, and they had also stacked a huge stack of blue bags stacked high and obstructed my view.

It was so far away there was no physical way I, as a Poll Watcher, could accurate!) do the appointed task. The bags were on the "'orkstation tables that I designated to stand adjacent to. reducing the area to stand and pushing my view further away from the computer, monitor, and printer, further obstructing the view of the Central Counting Area. (Reference Attachment# I).

8) Attachment# I also shows the location of the Election Computer, monitors, keyboard , and printers. Both the printer and the elections computer rack are facing away from the glass so the only part of the printer and computer rack you can physically see is the rear side. I l owevcr, monitors# I and #2 in the corner of Central Counting, were visible but distance made them illegible.

9) At or about I I : 12 the Presiding Judge Dan Bradley, came into the Ballot Board room. and told us that we could not talk to each other. I showed Mr. Dan Bradley the election code in our defense. and showed him in wri ting.

"Sec. 33.058. RESTRJCTIONS ON WATCHER ·s ACTIVITIES. (a) While on duty a watcher may not: (1) converse with an election officer regarding the election. except to call attention to an irregularity or violation of law: (2) converse with a voter: or (3) communicate in any manner with a voter regarding the election."

I showed him that, there were no restrictions on Poll Watchers talking to another Poll Watcher to ask a question or make an observation. Presiding Judge Dan Bradley strongly and multiple times persisted in his disagreement.

10) At approximately 11 :24 AM, a young lady, I believe her name is Liz and two other men (I 'm assuming al l were ES&S employees) were working on one of the three Laptop computers that are adjacent to the Monitor & keyboards (Sec Attachment #I) in the Central Counting Station room

behind the glass window. Also Mr. Mark White (I 'm assuming an ES& employee) was working on his laptop for most of the morning and afternoon. Later in the afternoon, from Mr. icholas Mevellel, we found out that all three laptops# I , #2, & #3 that are near the Monitor & keyboards for the Election Computer, are al l networked together on a E &S network. Even though they were working on the computers that are networked to the Elections Computer, which means they were preparing for the election, the Presiding Judge Dan Bradley denied me access to the workstation in Central Counting ration room to v. itness them ··processing or preparing to process election results. " Mr. Bradley said the Central Counting was closed, yet i t was open to E &S election contractors as evidenced by their activity in the Central Counting tation room.

11) At or about 11 :30 am, Ms. Kristen J. Bickham, Presiding Judge Dan Bradley, and I conference called the ecretary of State Elections, Ms. Ashley Fischer. We talked about three issues we had as Poll Watchers:

I) Can the Poll watchers talk to each other? 2) Can we look at the Elections Computer and Monitors and the associated Printer? 3) Finally asked whether or not we could ··sit or stand conveniently near the election officers conducting the observed activity" for the "processing or preparing to proce~s_ electiQn results. "?

A summary of Ms. Ashl ey Fischer responses to our the questions were: I) We could talk with each other as long as we keep it to a minimum, and onl) about what \\aS happening in the Central Counting and Ballot Board room, 2) We could look at the computer monitor and printer when counting or processing begins, and that we could pick up and read the printouts. However, she clarified you can ·t tear off or remove i l. 3) Ms. Ashley Fischer said we could sit or stand '·near the election officers conducting the observed activity," as long as Mr. Dan Bradley agreed the Counting Room was open. Ms. Fischer's official legal advice to Dallas County regarding that Mr. Bradley had to "agree the Counting Room was open" was a misrepresentation of the election code related to Central Counting Stations and poll watchers.

12) After returning to the room. at about 12:22, Mr. Daniel Bradley insisted we could not touch the paper, or examine it closely. Ms. Kristen Bickham, Mr. James Aston and I challenged Mr. Daniel Bradley. He said that is not what he heard Ms. Ashley Fischer say.

13) Mr. icholas Mevellel, ubcontract employee from ESS, told Ms. Kristen J. Bickham, ammy Bickham, Mr. James Aston, me and Election Judge Dan Bradley, that he and Ms. Toni Pippens­Poole were the only people who had the authority to determine what could be watched. I objected and mentioned that the Elections department needed to follow Election Law.

Mr. Nicholas Mevellel completely discounted following the Election Code, Title 3 Chapter 33: "d. wat~her is entitled to sit or stand conveniently near the elections officer:. condu<;hf!fl the observed activif.J!" or "'processing or preparing IQ RrQCess e_lection results." Mr. icholas Mevellel completely discounted what the ecretary of State Elections Ms. Ashley Fischer had to say concerning being able to watch, and \\ hen we could watch the Process. Again, Mr. Nicholas Mevellel (ES&S) effectively said it was he and Ms. Toni Pippens Poole who would determine what could be watched.

In my opinion Mr. icholas Mevellel (ES&S) was asserting authority he didn't have. I le said only one Poll Watcher could stand adjacent to the Printer to watch. Restricting access to any other Poll Watchers is obstructing their ability to Poll Watch.

14) I decided to call Secretary of State Elections Ms. Ashley Fischer's to clari fy, so I requested permission to leave the room. When I called Ms. Ashley Fischer about my issues, we talked about my March 20 I 6 Affidavit from the Primary Election, and discussed the fact that it and the open records request from the March 2016 election proved they had started processing Voting Results at 4:00 PM, and that I knew she had read my affidavit. I also told her that the on ly way we can veri fy that they have started processing elections results is b) being allowed to\\ atch the Central Counting Printer, since the votes arc transmitted to the Central Counting Computer. I told her that by restricting our access to Central Counting until Mr. Dan Bradley said the Central Counting open to start processing ballots. she was obstructing our ability to observe the activities of ··preparing to prQce~s_ election results.''

15) Once they start processing election results, the process of "preparing to process" election results. is over and I was obstructed and missed my opportunity to monitor acti vities I v, as entitled to watch. Ms. Fischer stuck to her decision, about waiting for Central Counting to ''open."

I told her that Mr. Bradley's responsibility as the Election Judge is to facilitate our rights as Poll Watchers, and to follow the election code, and that her responsibi l ity as Secretary of State Elections Council, is to guarant) v.e arc permitted to exercise our rights as Poll Watchers, and to resolve disputes that come up.

I also told her that I did not feel she was doing her job in resolving our issues with observed activities of ··preparing to process electiQn result{', and that her interpretation and legal advice LO

Dallas County election officers was obstructing me and the other official Dallas poll watchers. I told her that I expect her to do her Job as Secretary of State Elections lawyer. and if she was not willing to do her job, I would report her to the Texas Bar Association.

16) At about I: 12 PM, as I was standing in the designated Poll Watching Area, my location is

designated by (I) (PZ I). I saw what I thought was the cursor move (note: aw hite curser on a blue background screen), from the bottom left to the upper right of the Elections Counting Computer

Monitor# I. As I saw the curser move, I moved across the room to position (!}) (Pl 2) along the designated Poll Watcher Workstation Tables (Reference Attachment # I for my positions, and A ttachment #2 for A Sketch of what I saw on the Monitor).

As I moved I noticed no one was sitting in front of the keyboard, and monitors # I & #2 of the Central Counting Computer. I was focused on try ing to observe what activit) was occurring on the computer screen.

Just as I stopped, someone stood up in front of the monitor, I didn't look at their face to see who it was, I was busy trying to see the screen, then another person walked over blocking even more of the screen, and then a third person blocked my view.

It was obvious they were trying to obstruct my ability to observe what was being done on the Monitors #I of the Central Counting Computer

The Central Counting Computer is a dedicated computer, it is used as a central tabulation computer to aggregate the vote count, and I witnessed the computer being controlled remotely since no one was operating the computer directly and I was obstructed from monitoring that activity.

17) At about I :45 PM, M s. Toni-Pippens Poole came into the Central Counting and into the Ballot Board room . he came in agitated, and yelling at us, '·You can't look into Centra l Counting ... You can't look at the monitor ... You can't watch the Printer ... You are here to ~ atch the Ballot Board."

First, I politely asked what her name was and she said in a very loud voice, ''Toni-Pippens Poole."

I said, --Excuse me Ms. Pippens-Poole, I'm here to watch the Central Counting Locati on. If you like I can show you my official "Appoinlment of Poll Watcher·· Form, and that it specified Central Counting Location." ee A ttachment #4

Again Ms. Pippens-Poole with an even higher tone yelled at us, "You can' t look into Central Counting .... You can't look at the monitor ... You can' t watch the Printer ... You are here to watch the Ballot Board."

Again I told her, " I was there to watch the Central Counting Location." 1 also informed her that Ms. Ashley Fischer Secretary of tale Elections said we could watch Central Counting.

And again Ms Pippens-Poole said, '·You arc here to watch the Ballot Board, and you can't watch Central Counting .. . " I was witness to the conversation with Ms. Ashley Fischer and that is not what Ms. Pippins-Poole was told by Ms. Ashely Fisher. Ms. Pippins-Poole never accepted my offer to see my form, which was signed by her Elections Judge Mr. Dan Brad ley. Which 'Ahcn he signed it in the morn ing he made no objection to me watching the Central Counting Location.

She ordered her staff to get the chairs removed from near the glass window, because she accused us of standing on them. Again I told Ms Pippins-Poole I disagreed with her I had not stood on any of the chairs, and Mr. James Aston also said he had not been standing on the chairs.

Then Ms. Pippins-Poole again said in an agitated voice, ''You can't look into Central Counting & you can't look at the printer." I asked her how we could tell if the Printer was printing if 'AC couldn't watch it Print? Ms. Pippins-Poole with an even higher tone yel led at us. "You can hear the Printer Printing."

I told Ms. Pippins-Poole I can't hear the printer, and Mrs. Pippens-Poole said, "Yes you can."

This time I told her, '· I have a hearing problem, I wear two hearing aids." I pulled one out to show her, and I said, "I can not hear the Printer.·'

I then told Ms. Pippens-Poole. 'Then I guess we are going to have to have an American for Diasabi l ity Act (ADA) decision with the Secretary of State because I am hard of hearing and can not hear the printer. I was sent to represent my candidate to " Poll Watch" Central Counting, not to " Poll I fear" the Central Counting area.•·

I objected to her removing the chairs, because I \,\ anted to sit down. I am not a young man. I'm 65. I have planter fasciitis in both feet, and accord ing to the statue for Poll Watchers . "A watcher i1_ entitled tQJ_it or stand conveniently near the electiQn:j_ officers conducting the observ~d activity". In my opinion again she v iolated the la\\.

18) At around 2:00 to 2: 15 P\11 we headed to the Conference Room with Ms. Pippins-Poole, Mr. Dan Bradley, Ms. Kristen J. Bickham, Mr. Sammy Bickham, Mr. James Aston, and I all went to have a another teleconference with Secretary of State Elections lawyer, Ms. Ashley Fisher.

When we called Ms. Fischer, M s. Pippins-Poole told her that we were there to Pol l Watch the Ballot Board. I tried to explain it but Ms. Pippins-Poole would not listen to any of our comments.

We discussed. when we could Poll Watch Central Counting, and Ms. Pippins-Poole said we had to follow the process when Ballots come in we have to watch the Ballots, Ballot Transfer Process, then Counting the Ballots on the scanner, and then at 7:00 PM when Central Counting Opened we could watch.

Ms Fischer went along with anything and everything Ms. Pippens-Poole had to say, and Ms. Ashley Fischer changed her story about what and where we could watch in Central Counting. At the end of the conversation, after dominating the entire conversation, Ms Pippins-Poole said, '·t think we are all in agreement." Kristen J. Bickham, Mr. Sammy Bickham, and I all said we were not in agreement. Then Ms. Pippins-Poole stood up to end the meeting.

19) Ms. Kristen J. Bickham, Mr. amm1 Bickham, Mr. James Aston, and I sat in the conference room for a few minutes after the meeting and discussed the situation, we individually came to the conclusion that we were all being obstructed in our abilities to Poll Watch the Central Counting Station.

20) We walked back to the des ignated poll watcher's area in the Ballot Board Room. As I was getting my notebook, I noticed that two Boxes of Bal lots were on one of the Tables in the Central Counting room, and Mr. Dan Bradley was looking at them.

Just then the back door opened up and I saw Dal las County Republican Chairman Phil Huffiness Ms. Pippins-Poole, Mr. Dan Brad ley, Ms. Kristen J. Bickham, Mr. Sammy Bickham, Mr. James Aston, and I went into the hallway to have a discussion with Dallas County Republican Chairman Phil I luffines.

Again Ms. Pippens-Poole dominated the conversation, told him were were trying to watch Central Counting, and that it was not open yet. Dallas County Republican Chairman Phil I Iuffines somewhat concurred with Ms. Pippens-Poole that we couldn't watch until Central Counting was open. I disagreed and stated that Central Count had been open all day with observable election activities as noted above and we were being obstructed from monitoring the activities.

In addition, I told Ms. Pi ppens Poole that two Ballot 13oxcs had just landed on one of the tables in Central Counting, and that Mr. Dan Bradley was working on them. and v. ith his activities that means that Central Counting is open.

Ms. Pippens-Poole grumy said, "No there is not."

I said, ''Yes there is if you would like we can go in and look at them."

Just then some Sherrifrs Deputies rounded the corner with some more boxes. Ms. Pippens-Pool yelled orders at them that they should be bringing them in the back door to the Ballot Board Room. After which we all went into Central Counting.

Dallas County Republican Chairman Phil I Iuffincs, started ask ing questions about what the problem was of Ms. Pippins-Poole, Mr. Dan Bradley, and Mr. icholas Mevellel. They al l pretty much stuck with their story that we. the poll watchers, were there to only "'atch the Ballot Board and that we can't watch Central Counting until it is opened.

Dallas County Republican Chai rman Phi l Huffines asked them where we could stand to watch the Central Counting. Mr. Dan Bradley. and Mr. Nicholas Mevellcl said we could stand by the door.

I interjected again that the door is over IO to 15 feet from the Monitor and the Printer, which makes it impossible to watch. Dallas County Republican Chairman Mr. Phil Huffines. said what he Sa-' when he witnessed the early voting count he felt was fai r and he felt they were doing thi ngs correctly.

After repeated objections, Ms. Kristen J. Bickham, Mr. Sammy Bickham, Mr. James Aston, and I stood by the door. See Attachment #3

Around 3:00 to 3: 15 pm (the time is an estimate. I failed to capture the exact time) Mr. icholas Mevellel, subcontract employee from E , stepped up to explain all about the Central Counting Computer and the E & Computers (3 Laptops), and he said that "they were al l networked on an E & etwork." If E & Employees are working on the three ES& Laptops through out the day, all of which \\ ere admittedly networked to the Central Counting Computer, then we had been obstructed from monitoring election activities being initiated by the ES&S subcontractors.

21) Mr. icholas Mevellel went on to say " I'm sure some of you may have seen me order lunch on my computer" and he pointed to one of the ES&S laptops, and said that --the World Wide Web [WWW] was hooked up only to my computer. I lowever, if his computer was connected to the ES&S network and the WWW, then the ES&S network \\as also connected to the WWW, opening access to the elections computer to any computer hacker, giving them direct access to mount the hard drive (or attach to) of the Elections Computer. Thi s act made the Dal las County Central Counting main tabulation system vulnerable to direct access from an outside source.

and Mr. icholas Mevellel told us that once they start tal lying the election results no one could leave. I told them that I intended to leave at 6:00PM so I could go vote. Since I \\ as planning on voting Mr. icholas Mevellel went over and started running some ballots through the E &S Scanner, at that point he showed us the process for hand ling paper ballots.

23) My overall observations are listed below:

a. Ms. Tony Pippens-Poole & Mr. Dan Bradley obstructed our abi lity to poll watch multiple times:

1. Insisting we were there to watch the Ballot Board, versus Central Counting. My poll watching form specified Central Counting Station.

11. Repeatedly denying us to "sit or stand conveniently near the elections officers conducti.mL.l!Je QQJ_erved activity" to watch them ~cessing gr preparing to process election re~ults" in the Central Counting Station room.

111. We were obstructed from monitoring computers and printers and the election activities being conducted by the various ES&S subcontractors whi le they v.crc in the Central Counting Station room.

1v. Forcing us to stand 20 25 feet from the Central Counting Station computers and printers,

v. Forcing us to stand behind the glass, a cubical wall, and a stack of Elections Computer bags, with the computer and printer facing the opposite directions

vi. Repeatedly instructing us that we can' t watch Central Counting, the Central Counting Computer or Printers.

vii . I asked both Mr. Dan Bradley and Mr. icholas Mevellel if I could verify that the Printer TX2 was hooked up to the Elections Computer, and I v. anted to also verify if the computer was attached to the WWW, and they both obstructed and told me I could not go look.

b. Ms. Ashley Fischer knowingly provided fa lse legal instructions and advice to me, the other poll watchers, and the Dallas electi on officials regarding our ri ghts to monitor any election activity.

c. In my opinion Ms. Pippins-Poole's knowingly obstructed me and the other poll watchers via intimidation, yelling, misrepresenting our intent as poll watchers at Central Count, and physically obstructed our view of the crucial e lection activities occurring at the various computers and printers in the Central Counting Station room.

d. Just the act of demanding that we stand approximately 20 to 25 feet away from the Elections Computer, is intentional obstruction relative to our ability to witness the process, and to read the Counting Computer monitor, and/or the associated printer, and there is no way for us to verify any error messages such as corruption error, counting errors, etc.

The intention of a poll watcher is to val idate we have honest and fair elections. With Presiding Judges, election workers, obstructing poll watchers, my observations were that

they were trying to hide something and that the 2016 Dallas County General Election was corrupt. What were Ms. Toni Pippins-Poole, Mr. Dan Bradley and Mr. Nicholas Mevellel hiding that was so important that multiple poll watchers ,,ere intimidated, yell ed at, and obstructed? I personal do not believe Dallas County had a Fair Election!
