The IPWEA NSW Development Engineering Forum is NSW’s leading forum for streamlining engineering processes within the public works and engineering sector. This Forum is relevant for all levels of Public Works professionals presenting a broad range of information and discussion platforms.

WHO IS IPWEA NSW? The Institute of Public Works Engineering Australasia NSW Division (IPWEA NSW) is a professional organisation providing member services and advocacy for those involved in and delivering public works and engineering services to the community.

The Institute has been around for over 100 years and Membership primarily consists of Public Sector/Local Government professionals specialising in Infrastructure and Public Works.

Members come from the wide range of professions involved in Public Works and Services including Engineers, Technicians, Public Works Directors, Contractors, Consultants, Managers, and Strategic Planners. Our Members include those working in the areas of roads, bridges, asset management, water supply and sewerage, stormwater systems, airports, cemeteries, parks and gardens, and coastal and harbour facilities.

TERMS AND CONDITIONSAll sponsors/partners must agree to the following terms and conditions for partnering in the 3rd Annual Development Engineering Forum.IPWEA NSW reserves the right to accept or reject any application for sponsorship at its discretion. Sponsorship packages which may be limited in number, will generally be allocated to those organisations who apply earliest. Application of sponsorship packages regardless of the preference is at the discretion of IPWEA NSW, whose decision will be final.Confirmation and Payment:To confirm your booking, please complete the Acceptance and Booking Form and return it to Events Manager, Jenny Ban at IPWEA NSW together will full payment of total booking cost.• On receipt of the Acceptance and Booking Form, written

confirmation and a tax invoice will be sent to you.• Full payment is subject to the IPWEA NSW terms of trading, payable

within 14 days of receiving invoice. If your payment is not received by the due date, the sponsorship will become available to other interested organisations. As spaces are limited, returning an Acceptance and Booking Form does not guarantee a place as a Sponsor.

• In the event of any late payment beyond the invoice due date, admin fees of 1.5% percent of the full amount will be added onto the invoice on a monthly basis until the balance is settled. Such fees will be in addition to the outstanding sponsorship fee and will not be negotiable.

Sponsorship Benefits, Obligations and Due Dates:• The Sponsor agrees to pay the sponsorship fee in accordance

with the amount and payment terms set out in the Sponsorship Agreement.

• The Sponsor will act at all times in a manner which is consistent with the good name, goodwill and reputation of IPWEA NSW.

• IPWEA NSW is responsible for administration of the event/activity and coordinating all details in relation to the venue at which such events/activities are held.

• The Sponsor is permitted to bring up to the specified amount of full day Forum passes and speaker passes stated per entitlement to the event. Any additional passes must be registered online at the fixed Member/Non-Member rates per person.

• The Sponsor is responsible for providing the required artwork, logos and text as relevant by the due date(s) advised by IPWEA NSW.

• Logos will be requested in a jpeg format, high resolution 300dpi. Should an alternative format be received IPWEA NSW cannot be held responsible for the quality of logos displayed in any of the promotional material.

• In the event that materials, information or artwork required by IPWEA NSW are not received by the designated due date(s), the use for their intended purpose cannot be guaranteed. The value of these entitlements will not be refunded.

• Promotional/Marketing material is to be provided and set up by the sponsor/company representative on the day of the event. Marketing material can include pull up banners, flyers/pamphlets and items for display on trestle tables.

Cancellation Policy:Cancellation of your sponsorship must be received by IPWEA NSW in writing. • Due to the considerable administration associated with this Forum,

a cancellation fee equivalent to 25% of the full payment amount will be incurred, should confirmed agreements be cancelled prior to 30th June 2020.

• Cancellations made between 1st July 2020 and 1st August 2020 will pay a cancellation fee equal to 50% of the full payment amount of the confirmed agreement.

• Cancellations made after 1st August 2020 will incur 100% cancellation fee.

• If the event is cancelled by IPWEA NSW, less than 3 months prior to the scheduled date, Sponsors are entitled to a 75% refund.

• If the event is rescheduled by IPWEA NSW and the Sponsor can reasonably demonstrate their inability to participate, they may be entitled to a partial refund after fixed costs have been met.

Exceptional Circumstances:IPWEA NSW reserves the right to change the venue, delivery method and duration if exceptional circumstances demand it.• In the event of a change of venue, delivery method and/or duration,

the agreement to participate will remain in force as long as the Sponsor is informed at least one month before the planned forum.

• IPWEA NSW will use reasonable endeavours to remedy the impact of exceptional circumstances.

• IPWEA NSW is not responsible for any further costs incurred by partners in connection with the event.

• Whilst IPWEA NSW take precautions to ensure that your property is not damaged or stolen, we decline responsibility for any loss of damage which will befall the person or property of the Sponsor from any cause whatsoever.

• It is the responsibility of Sponsors to ensure their insurance cover is adequate to their risk and requirements.

• IPWEA NSW reserves the right to cancel this agreement for non-compliance of the terms and conditions outlined within this agreement by giving the Sponsor one month notice of cancellation. This will include any action by a Sponsor that results in criticism and bad publicity which could reflect badly on IPWEA NSW.

• If either party goes into liquidation, is wound up, dissolved (except for the purpose of reconstruction or amalgamation), enters into a scheme or arrangement, is placed under official management or in receivership the other party may cancel this agreement by giving one month written notice of their intention to cancel. Any sponsorship monies unspent will remain the property of IPWEA NSW.

Force Majeure:IPWEA NSW is not responsible for any delays or non-compliance of its obligations due to acts, events or causes beyond its control.• Should IPWEA NSW be unable to hold the 3rd Annual Development

Engineering Forum due to Force Majeure, Sponsors will receive a partial refund after fixed costs have been met.

• Force Majeure events include acts of God, war, acts of any government including by the issue of orders under the Public Health Act 2010, explosions, pandemics, epidemics, quarantine restrictions, lockout and severe weather.

• Where a force majeure event occurs, the parties will work together in good faith to agree a mutually agreeable course of action with regard for the delivery of the Services (or the non-delivery of the Services in the case of conference cancellation).

Disputes: In the event of a dispute arising, the parties agree to negotiate towards an agreeable outcome. If the parties cannot agree on a breach of the terms and conditions, IPWEA NSW may cancel the contract with one month’s written notice to the Sponsor. Consequential Damage:IPWEA NSW will not be liable for any indirect or consequential damages arising out of a breach of this sponsorship contract.Additional Staff:All packages include a defined number of passes as outlined in the Sponsorship entitlements. Any additional representatives can attend and must be registered online at the fixed Member/Non-member rates per person.Venue:The Sponsor, representatives and invitees of the sponsor are also to observe the rules, regulations and procedures as prescribed by the venue hosting the Development Engineering Forum.Gifts:If your package entitles you to provide Forum attendees with a branded gift and you wish to take up the opportunity, the gift needs to be approved by the Events Team at IPWEA NSW prior to attending the Forum. Gifts brought on-site without the Events Team being made aware will not be allowed for distribution. This policy also includes raffles and donations conducted during the Forum or associated with the Forum.Australian Privacy Act:The delegate list will be provided after the Forum and will exclude any delegates who have withheld permission to publish their details in accordance with the Australian Privacy Act.
