Agricultural experts say that, at best,even with the money government has putaside for farm inputs, only 15% of theresettled farm land will be prepared andready to plant with the onset of the rains.We are at the beginning of what weatherexperts have predicted will be a difficultand erratic rainy season in Zimbabwe.

This would have been a hard enoughyear for professional farmers and theirworkers, who would have been expectedto feed the revised 6.8 million starving

(a) Based upon a comprehensivereport by the National Institute ofMedicine and other studies, including astudy published by the New EnglandJournal Of Medicine, it is evident thatmillions of Californians, perhaps morethan f ive million, are presentlyreceiving a substantial volume ofhealthcare services from complementaryand alternative healthcare practitioners.Those studies further indicate thatindividuals utilizing complementaryand alternative healthcare services cutacross a wide variety of age, ethnic,socioeconomic, and other demographiccategories.

(b) Notwithstanding the widespread

utilization of complementary andalternative medical services byCalifornians, the provision of many ofthese services may be in technicalviolation of the Medical Practice Act(Chapter 5, commencing with Section2000, of Division 2 of the Business AndProfessions Code). Complementary andalternative healthcare practitioners couldtherefore be subject to fines, penalties,and the restriction of their practice underthe Medical Practice Act even thoughthere is no demonstration that theirpractices are harmful to the public.

(c) The Legislature intends, byenactment of this act, to allow access byCalifornia residents to complementaryand alternative healthcare practitionerswho are not providing services thatrequire medical training and credentials.The Legislature further finds that thesenonmedical complementary andalternative services do not pose a knownrisk to the health and safety of Californiaresidents, and that restricting access tothose services due to technical violationsof the Medical Practice Act is notwarranted.

SECTION 2

Section 2053.5 is added to theBusiness And Professions Code, to read:

2053.5. (a) Notwithstanding any otherprovision of law, a person who complieswith the requirements of Section 2053.6shall not be in violation of Section 2051,2052, or 2053 unless that person doesany of the following:

(1) Conducts surgery or any otherprocedure on another person thatpunctures the skin or harmfully invadesthe body. [What about acupuncture?]

(2) Administers or prescribes x-rayradiation to another person.

(3) Prescribes or administers legenddrugs or controlled substances to anotherperson.

(4) Recommends the discontinuance oflegend drugs or controlled substancesprescribed by an appropriately licensedpractitioner.

(5) Willfully diagnoses and treats aphysical or mental condition of anyperson under circumstances orconditions that cause or create risk ofgreat bodily harm, serious physical ormental illness, or death.

(6) Sets fractures.(7) Treats lacerations or abrasions

through electrotherapy.(8) Holds out, states, indicates,

advertises, or implies to a client orprospective client that he or she is aphysician, a surgeon, or a physician andsurgeon.

(b) A person who advertises any


services that are not unlawful underSection 2051, 2052, or 2053 pursuant tosubdivision (a) shall disclose in theadvertisement that he or she is notlicensed by the state as a healing artspractitioner.

SECTION 3

Section 2053.6 is added to theBusiness And Professions Code, to read:

2053.6. (a) A person who providesservices pursuant to Section 2053.5 thatare not unlawful under Section 2051,2052, or 2053 shall, prior to providingthose services, do the following:

(1) Disclose to the client in a writtenstatement using plain language thefollowing information:

(A) That he or she is not a licensedphysician.

(B) That the treatment is alternative orcomplementary to healing arts serviceslicensed by the state.

(C) That the services to be provided arenot licensed by the state.

(D) The nature of the services to beprovided.

(E) The theory of treatment uponwhich the services are based.

(F) His or her educational, training,experience, and other qualif icationsregarding the services to be provided.

(2) Obtain a written acknowledgementfrom the client stating that he or she hasbeen provided with the informationdescribed in paragraph (1). The clientshall be provided with a copy of thewritten acknowledgement, which shall bemaintained by the person providing theservice for three years.

(b) The information required bysubdivision (a) shall be provided in alanguage that the client understands.

(c) Nothing in this section or inSection 2053.5 shall be construed to dothe following:

(1) Affect the scope of practice oflicensed physicians and surgeons.

(2) Limit the right of any person toseek relief for negligence or any othercivil remedy against a person providingservices subject to the requirements ofthis section.
