October 13, 2020 To: Southwest Harris County MUD No. 1 Re; Texas Pollutant Discharge Elimination System (TPDES) General Permit No. TXR040000, Small MS4 (Phase II) General Permit
The following provides a status update regarding the District’s Stormwater Management Program (SWMP), Notice of Intent (NOI) Stormwater Guidance Manual (SWGM) and Annual Report:
All deadlines have been met.
The District’s SWMP/NOI, SWGM, and Year 1 Annual Report are under review by the TCEQ.
The District is in compliance with the permit during the review process.
Permit year 2 ends December 31, 2020.
Year 2 Annual Reports are due to the TCEQ within 90 days.
Once approved, report will be posted on websites.
Below is a summary of actions to be taken once the SWMP/NOI and SWGM are reviewed by the TCEQ:
The District is required to publish the executive director’s preliminary decision concerning the SWMP & Notice of Intent (NOI).
The notice must be published in a newspaper of general circulation in the municipality or county where the small MS4 is located.
Must state public location where copies of the NOI and SWMP may be viewed. Must provide opportunity for the public to submit comments on the NOI and SWMP
and request a public meeting. Comment period is 30 days. If no comments then permit certificate is issued. If ‘significant public interest exist’ a public meeting must be held.
The District will file with the Chief Clerk a copy and an affidavit of the publication of notice(s) within 60 days of receiving the written instructions from the Chief Clerk.
Once SWMP & NOI are approved, post documents to Cleanbayous.org.
