Fire Chief Bradley introduced the Staff Report and gave background of the item explaining that it has been presented for consideration at a few previous SSJCFA Board Meetings and all questions or concerns have been vetted through. Vice-Chairperson Ransom asked about the make-up of the number of board members and that she has conferred with attorneys and she would like to see the composition of the board to include an additional member increasing the board size to five. Chief Bradley stated that there had been discussing when the JPA agreement was being formed that the 5th board member be a member at-large and not from one of the parent agencies. Chairperson Smith shared that the Tracy Rural Fire Protection District is firmly against having a fifth person at this time. After discussion, Vice-Chairperson Ransom asked that a future

Fire Chief Bradley asked that the item be pulled due to noticing issues and that it will be brought back for consideration at the next Board Meeting once proper required noticing had occurred.

4.3. Accept Proposal to Conduct Annual Fiscal Audit of the South San Joaquin County Fire Authority

Fire Chief Bradley introduced the Staff Report and gave background of the item stating that the JPA agreement required an annual fiscal audit and then turned it over to Division Chief Vargas for further discussion. Vice-Chairperson Ransom asked about the cost and scope of each proposed auditor and Karin Schaider, City of Tracy Finance Director, asked about the anticipated completion date of the audit. Chief Bradley shared that it will be within the JPA’s required 180-day time frame while still getting the City of Tracy what they need in the time frame they need for their auditors.

ACTION: Motion was made by Board Member Rickman and seconded by Vice-Chairperson Ransom to accept the Proposal to Conduct the Annual Fiscal Audit of the South San Joaquin County Fire Authority. ACTION: Motion was made by Board Member Rickman and seconded by Board Member Muniz to approve the second amendment to agreement authorizing the South County Fire Authority and the City of Tracy to provide Advanced Life Support services as an integrated component of the San Joaquin County Emergency Medical Services System. ITEM: APPROVE THE ADOPTION OF THE MASTER FEE SCHEDULE RELATED TO FIRE PREVENTION ACTIVITIES AND FIRE RESPONSE FOR THE SOUTH SAN JOAQUIN COUNTY FIRE AUTHORITY

RECOMMENDATION

It is recommended the South San Joaquin County Fire Authority Board of Directors approve the resolution for the Authority’s Master Fire Fee Schedule related to Fire Prevention and Fire Response.

BACKGROUND

When the new Joint Powers Authority was established on February 20, 2018, member agencies assigned fire prevention responsibilities to the newly formed Authority. State regulations and the Joint Powers Agreement (Section 1.4 subsection M) allows the Authority to establish a Master Fee Schedule to levy and collect fees for fire protection services, and emergency response related activities. The Authority conducted a detailed cost of services study to establish the Master Fee Schedule. The primary purpose for conducting this study was to establish the initial fees and to ensure that fees do not exceed the costs of services provided.

DISCUSSION

Public agencies are permitted by State law to impose user fees for services and regulatory activities they provide. User fee activities are those services and functions the Authority provides to individuals who receive a direct or personal material benefit from the services, while regulatory fees are those imposed to recover costs associated with the Authority’s power to certain activities such as development and construction. Per State law, fees may not exceed the estimated and reasonable cost of providing the service or performing the activity.

The Authority provides consultation and review of new construction projects to ensure plans are in compliance with fire and life safety specifications required by local and State fire codes. Sworn and non-sworn members of the Authority also perform inspections of buildings. Inspection criteria are established by local and State statutes and fire codes designed to protect the public's safety.

During the past year, the South San Joaquin County Fire Authority performed a fee study with a goal of determining appropriate levels of fees compared to the cost of the services provided. The study included a cost of service analysis, which evaluated direct and indirect labor costs, specific direct non-labor costs, and allocated Authority overhead. This analysis was used to derive a fully burdened labor rate. The final step was to establish fees based on the full cost of service.

Fees examined in the study included: • Annual Operational Fire Permit and Inspection Fees• Construction Permit Fees• Fire Review and Building Construction Review Fees• Development and Engineering Service Review Fees• Miscellaneous Administrative and Fire Operation Fees

A comparison of six fire agencies (City of Modesto, City of Stockton, City of Manteca, City of Lathrop and East Contra Costa Fire Protection District) fee schedules revealed that the average cost for fire prevention activities was $189.00 per hour compared to the South County Fire Authority proposed fee of $157.13 per hour for inspections and $169.52 per hour for plan reviews.

FISCAL IMPACTS

Adopting a fee schedule for the Authority will allow the Authority to charge fees consistent across the Authority’s jurisdiction. Adopting a fee schedule commensurate to the services provided will move the Authority closer to the goal of 70% cost recovery of Community Risk Reduction services. The FY2019-20 preliminary budget assumed a revenue projection of $970,876 or 70% of total expenditures for fire prevention services. APPROVING THE ADOPTION OF THE MASTER FEE SCHEDULE RELATED TO FIRE PREVENTION ACTIVITIES AND FIRE RESPONSE FOR THE SOUTH SAN JOAQUIN

COUNTY FIRE AUTHORITY

WHEREAS, the Board is created pursuant to a Joint Powers Agreement, dated February 20, 2018, which was entered into between the Tracy Rural Protection Fire District and the City of Tracy; and

WHEREAS, the Joint Powers Agreement, Section 1.4 subsection (m), authorizes the Board to “Levy and collect payments and fees for Fire Protection Services”; and

WHEREAS, the approval of this resolution establishes a Master Fee Schedule incorporating all of the 2019-2020 Authority Fire Prevention Fees; and

WHEREAS, the Board desires to adopt and establish the Annual Master Fee Schedule; and

WHEREAS, the adoption of the Master Fee Schedule is necessary to authorize the levy of the subject fees for funding the necessary services performed by the Authority.

NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF THE AUTHORITY AS FOLLOWS:

THAT the Master Fee Schedule be adopted and established as set forth in Exhibit “A” attached to this Resolution and incorporated by reference as if set out in full;

THAT the fees listed in Exhibit “A” including Annual Operational Fire Permits, Miscellaneous Administration Fees, and Miscellaneous Fire Authority Fees, shall be effective upon the adoption and approval of this Resolution by the Board. The fees listed in Exhibit “A” including Construction Permit Fees and Development and Engineering Services Fees shall not become effective and in full force and effect until 12:01 a.m. on the sixty-first day after this Resolution is approved by the Board.

ITEM: APPROVE THE ADOPTION OF SOUTH SAN JOAQUIN COUNTY FIRE AUTHORITY MAINTENANCE AND OPERATING BUDGET FOR FY2019-20

RECOMMENDATION

Staff recommends the South San Joaquin County Fire Authority (Authority) Board of Directors approve the budget for FY2019-20.

BACKGROUND

Per the joint powers agreement of the South San Joaquin County Fire Authority, the Authority shall adopt an annual budget for maintenance and operational costs on or before September 1, of each fiscal year. The Authority’s operating budget is comprised of revenue from both member agencies. Each agency contributes their proportional share of the operating budget to the Authority in accordance with the joint powers agreement.

The preliminary budget was approved on June 18, 2019 by the Authority Board of Directors and incorporated forecasts for the estimated operating expenses.

DISCUSSION

The Authority worked to keep budgeted expenditures for services and supplies flat while adjusting for anticipated increases in personnel related expenses. FY2019-20 projected increases include personnel expenses reflecting CalPERS adjustments, increasing health insurance costs, and salary increases as approved in existing labor contracts. These expenses are projected to increase costs by approximately 6.5%.

In addition, the Authority included individual augmentations in the FY2019-20 budget. These included added costs for emergency dispatching services due to an increase in emergency responses. Additional expenses include a communications system study, emergency medical services training aids, and firefighter protective equipment extractor (washing machine) to comply with industry safety standards, and approved funding for special counsel to guide the

authority through impending ALS contract negotiations. The amount of all augmentations for FY2019-20 total $332,200.

The Authority’s Community Risk Reduction Division has completed hiring of all approved staff positions during FY2018-19 and has developed an updated fee schedule. With the updated fee schedule, which includes fire specific fees not blended with building fees, it is anticipated revenues will increase substantially. Using a 70% cost recovery model, the Authority projects revenue of $970,876 for FY2019-20.

FISCAL IMPACTS

The fiscal impact is directly related to and in accordance with the Fire Authority joint powers agreement specifically, section 5.4 Responsibility for Maintenance and Operations.

The cost split percentage is calculated on 21 daily staffed positions for the Authority. The City of Tracy procuring 15 of those positions or 72%, and the Tracy Rural Fire District procuring 6 of those positions, or 28%.

Per the JPA Agreement, each member agency is required to fund forward 120 days’ worth of maintenance and operating expenses. This funding requirement would result in the City of Tracy funding approximately $4.9M million per installment, and the Tracy Rural Fire District funding approximately $1.4M per installment.

Staff also recommends the JPA agreement be amended requiring each member agency to fund forward 180 days. Funding 180 days forward would ensure the Authority does not run short of operating revenues during peak times of a year (e.g. mutual aid/fire season). This item will be brought to the JPA board as a separate agenda item.

Additionally, each member agency will incur expenses outside of the Authority operating budget related to each agency fiscally maintaining their respective facilities and apparatus. These expenses are estimated to be an additional $459,897 for the City of Tracy, and $79,903 for the Tracy Rural Fire District.

APPROVING THE ADOPTION OF SOUTH SAN JOAQUIN COUNTY FIRE AUTHORITY MAINTENANCE AND OPERATING BUDGET FOR FY2019-20

WHEREAS, Tracy Rural Fire Protection District and the City of Tracy formed the South San Joaquin County Fire Authority in order to provide fire services to both jurisdictions, and

WHEREAS, The Authority maintenance and operating budget is comprised of revenue provided from its member agencies in accordance with the cost sharing formula within the Joint Powers Agreement, and

WHEREAS, The Joint Powers Agreement requires the Authority to adopt a final budget on or before September 1 of each fiscal year, and

WHEREAS, The preliminary budget was approved by the Authority Board of Directors on June 18, 2019, and

WHEREAS, Both member agencies proportionate share of Authority costs will be incorporated into their respective FY2019-20 budget once adopted, and

WHEREAS, The FY2019-20 Budget for the South County Fire Authority maintenance and operating expenses are broken down into program areas as follows:

RECOMMENDATION

Staff recommends the South San Joaquin County Fire Authority Board of Directors assign the position of Administrative Division Chief as the Authority’s Controller/Treasurer in accordance with the California Government Code Section 6505.6.

BACKGROUND

The South San Joaquin County Fire Authority (“Authority”) was established February 20, 2018 with the intent of improving fire services within the Authority’s jurisdiction. As part of the joint powers agreement, the Authority manages all expenditures within the approved general budget. To appropriately manage the financial matters of the Authority, it is necessary to identify a Controller/Treasurer as identified in Section 2.2 (c) of the Joint Powers Agreement.

DISCUSSION

The SSJCFA joint powers agreement authorizes the Authority to do all acts essential for the exercise of powers including the use of all financial mechanisms available to the Authority, subject to the provisions of the agreement.

Section 2.2 (c) of the agreement specifies a controller/auditor shall be appointed by the board to ensure that there shall be strict accountability of all funds and reporting of all receipts and disbursements of the Authority. The Controller/Treasurer shall have the duties and obligations set forth in Sections 6505 and 6505.5 of the California Government Code.

California Government Code Section 6505.6

In lieu of the designation of a treasurer and auditor as set forth in Section 6505.5, the agency or entity may appoint one of its officers or employees to either or both of such positions. Such offices may be held by separate officers or employees or combined and held by one officer or employee. Such person or persons shall comply with the duties and responsibilities of the office or offices as set forth in Subdivisions (a) to (d), inclusive, or Section 6505.5

In the event the agency or entity designates its officers or employees to fill the functions of treasurer or auditor, or both, pursuant to this section, such officers or employees shall cause an independent audit to be made by a certified public accountant, or public accountant, in compliance with section 6505.

The authority has previously appointed an independent auditor which complies with provisions of Section 6505.6 “causing and independent audit by a certified public accountant”. The acceptance of this report shall ensure the Board of Directors and Authority staff comply with fiscal accountability and compliance law.
