SECTION 3 ENVIRONMENTAL COMPLIANCE

3.1 SCOPE

Except as otherwise detailed herein, the Design-Builder shall be responsible for preparing its design, carrying out construction activities, performing Quality Control, and undertaking other activities as needed to ensure compliance with the Project’s Environmental Requirements and all applicable environmental laws and regulations.

This Project Requirement identifies certain required actions to be performed by the Design-Builder to ensure that the Environmental Requirements are complied with throughout the duration of the Project.

3.2 ENVIRONMENTAL APPROVALS

Upon completion of the Federal Environmental Approval Worksheet (FAEW) it has been determined that this Project is a Class II, Categorical Exclusion with documentation. In accordance with Federal Highway Administration regulations 23 CFR 771.117(d), this project meets the description of a “D” list “Bridge rehabilitation, reconstruction or replacement or the construction of grade separation to replace existing at-grade railroad crossings.” Additionally, the project will not individually or cumulatively have a significant environmental impact and is excluded from the requirements to prepare an Environmental Impact Statement (EIS) or an Environmental Assessment (EA) under NEPA.

The Department has determined that this project is a SEQRA Non-Type II Action in accordance with 17 NYCRR, Part 15 - Procedures for Implementation of State Environmental Quality Review Act. SEQR Non-Type II projects include actions for which the environmental impacts are not clearly established and require an Environmental Assessment (EA). The project is being progressed as SEQR Non-Type II (EA) because the South Cascade Drive/Miller Road Bridge over the Cattaraugus Creek has been determined to be National Register Eligible. Under 17 NYCRR Part 15.14(d) (6), a Type II action has “no effect on any district, site, structure or object that is listed, or may be eligible for listing, on the National Register of Historic Places.” This project, with its potential effects on the bridge, does not meet the Type II criteria and is therefore classified as a Non-Type II (EA) project under SEQR.

If during detailed design and/or construction, the Design-Builder introduces design elements, variations, or methodologies that potentially induce environmental impacts not already anticipated, then the Design-Builder shall coordinate with the Department to re-evaluate the NEPA process for this Project and obtain all the necessary Environmental Permits/Approvals prior to proceeding with construction. The Department will not be responsible for delays to the construction schedule related to changes made or proposed by the Design-Builder during detailed design or construction that require additional NEPA/SEQRA evaluation and approvals. This requirement applies to proposed variations which may affect resources covered under Section 106, Section 4(f), Executive Order 11990 (wetlands), Section 404 USACE permitting or NYSDEC Section 401 permitting, NYSDEC Article 15 permitting, and other applicable federal and state environmental regulations.

3.3 REQUIREMENTS

3.3.1 General A) The Design-Builder shall procure all Environmental Approvals as needed for all Design-

Builder-located areas, including staging, borrow and disposal sites, and any other areas used by the Design-Builder, for its convenience, in the execution of the Project.

B) The Design-Builder shall be responsible for preparing all permit application materials and for obtaining all environmental permits/approvals. For any such permits/approvals required to be obtained by the Design-Builder that must formally be issued in the Department’s name, other than the SPDES NOI, the Design-Builder shall allot 5 business days for the Department to review and comment on the completeness and adequacy of application materials. It shall then be at the Design-Builder’s discretion to address any Department comments or elect to risk moving forward with the application materials as submitted. The Department will cooperate with the Design-Builder as reasonably requested by the Design-Builder, including execution and delivery of appropriate applications. The Department will not be responsible for any delay or additional costs associated with the Design-Builder’s environmental permit/approval applications.The Design-Builder shall be responsible for obtaining all new Environmental Approvals. For any such approvals required to be obtained by the Design-Builder that must formally be issued in the Department's name, the Department will cooperate with the Design-Builder as reasonably requested by the Design-Builder, including execution and delivery of appropriate applications and other documentation prepared by the Design-Builder in a form accepted by the Department.

C) The Design-Builder shall be solely responsible for compliance with and violations of any Environmental Requirements.

D) In the event the Design-Builder requests changes to any environmental permits/approvals obtained by the Department for the project, the Design-Builder shall be responsible for the preparation of all information including materials, investigations, surveys, testing and documentation as necessary to support said permit modification request. Based on the Design-Builder’s provision of said information, the Department will undertake the requested permit/approval modification with the respective permitting agencies on the Design-Builder’s behalf. The Department will not be responsible for any delay or additional cost associated with the Design-Builder’s requested environmental permit/ approval modification.

E) The Design-Builder shall be aware that Cattaraugus Creek is a designated River in the Nationwide Inventory, Wild and Scenic River and is protected under Presidential Directive dated August 2, 1979. As such, the Design-Builder should avoid any design elements, variations, or methodologies that would adversely affect, alter or preclude the values of the designated study or inventory river (Cattaraugus Creek) by obstructing the free flow or changing Cattaraugus Creek to any degree that would have an adverse effect on the natural, cultural and recreational values of the Inventory river segment to such a degree as to declassify Cattaraugus Creek as a Wild and Scenic River.

F) The Design-Builder shall be aware of the possible presence of the Northern Long-eared Bat (myotis septentrionalis), which is proposed to be listed as a federally endangered species in April 2015. This project has been preauthorized by FHWA and the US Fish and Wildlife Service for the removal of thirty seven (37) trees greater than three (3) inches diameter breast height (dbh). All thirty seven (37) trees will be cut down during the US Fish and Wildlife Service approved winter cutting window of October 1, 2014 to March 31, 2015,

under the Department’s Landscape Environmental Block Project, PIN 5807.95. Under PIN 5807.95, twenty four (24) of the thirty seven (37) trees will be cut, but not removed from the project site. These trees are directly under the bridge or on the adjacent slopes, within the highway Right of Way, between the north and south abutments. The Design-Builder will be responsible for disposal of these trees and removal of any stumps, if necessary, to perform its work, as well as any additional clearing and grubbing of brush smaller than 3” dbh. The remaining thirteen (13) of the thirty seven (37) trees, near the approach slabs and within the highway Right of Way, will be cut and removed from the project site under PIN 5807.95. If project conditions change and additional tree removals are deemed necessary, whether under clearing and grubbing or tree removal, prior authorization will be required before the start of any tree cutting work beyond the approved thirty seven (37) trees. Additional tree removals will be allowed only after coordination and approval by the Department, FHWA and the US Fish and Wildlife Service.

3.3.2 Environmental Plans The Design-Builder shall be responsible for preparing the following documents in conformity with all Environmental Requirements. The Design-Builder shall submit the following Environmental Documents:

A) Stormwater Pollution Discharge Elimination System (SPDES) Permit application, including Notice of Intent (NOI). See Section 3.3.3 - Soil Erosion and Water Pollution Control.

B) Stormwater Pollution Prevention Plan (SWPPP; see Section 17 – Drainage and Stormwater)

C) Erosion Control Plan

D) Lead Exposure Control Plan & Health and Safety Plan (HASP)

The Design-Builder is advised that the Department considers the paint on the steel of the existing bridge to be contaminated/hazardous due to the possibility of remnant lead based paint. As such, items for the protection of workers and the environment will be required. The Design-Builder shall perform all work in accordance with the Lead Exposure Control Plan and Construction Health and Safety Plan provided to the Department by the Design-Builder and all other applicable NYSDOT and OSHA requirements.

3.3.3 Soil Erosion and Water Pollution Control A SPDES General Permit for Stormwater Discharges from Construction Activity (GP-0-10-001) may be necessary if soil disturbance during construction exceeds one acre. The Design-Builder shall calculate the approximate amount of qualifying soil disturbance as soon as practical during the design process

The Design-Builder shall prepare the final Stormwater Pollution Prevention Plan (SWPPP) and Notice of Intent (NOI) (including any required water quality calculations). Discharges covered under the SPDES General Permit shall not commence until the date authorized on the SPDES Acknowledgement Letter from the New York State Department of Environmental Conservation (NYSDEC).

Regardless of whether or not a SPDES permit is required, an Erosion Control Plan is required by the Department. The Erosion Control Plan shall comply with the SPDES General Permit for Stormwater Discharges from Construction Activity (GP-0-10-001).

3.3.4 Performance The Design-Builder shall perform all activities required under each of the foregoing plans until Final Acceptance of the Project, except to the extent that the plans provide for activities to be undertaken by the Department or third parties. Provisions in said plans for activities to be undertaken by the Department or third parties are subject to prior written acceptance by the Department.

3.3.5 Invasive species A review of the existing corridor did not indicate any significant presence of known invasive. No other instances of target invasive plant species have been encountered within the Project limits. If any invasive species are discovered during the Project, the Design-Builder shall be responsible for controlling target invasive species in accordance with the guideline presented in EI 09-001 and the special specifications presented in EI 09-002 and in accordance with Federal Executive Order 13112. 3.3.6 Asbestos Containing Materials An Asbestos Screening and Assessment of the impacted structures was performed by a NYS Department of Labor licensed firm using certified inspection staff. Only accessible areas were inspected. Bulk sample collection of suspect asbestos-containing materials was limited to areas of the bridge that could be accessed from the bridge itself or reached from the ground and/or by use of a ladder from below. No investigation was conducted by LaBella Associates to determine the presence of asbestos associated with underground utilities on or in the immediate vicinity of the existing bridge. Available record drawings of the bridge were reviewed and did not reveal the presence of any suspect asbestos-containing materials.

Suspect asbestos-containing materials identified during this screening/assessment were sampled and analyzed for asbestos content. Based on laboratory analysis, no asbestos-containing materials were identified. The complete Asbestos Assessment Report, dated September 15, 2010, is located in the Reference Documents section of the Project Web Site.

If during the course of the work, asbestos-containing materials are encountered, the Design-Builder shall perform all abatement, containment, removal and disposal activities and provide project/air monitoring services in accordance with 12 NYCRR 56. Furthermore, should removal and disposal of asbestos-containing materials be required, it shall be performed in accordance with all applicable safety and health codes. If necessary, this work shall be paid for under the Force Account pay item.

New York State Department of Labor asbestos licensure and applicable staff certification(s) are required for any Work where confirmed or presumed asbestos-containing materials are impacted. All necessary asbestos inspection, sampling, laboratory analysis or Project design and project/air monitoring work shall be conducted in conformance with policy and guidance provided in the NYSDOT Environmental Manual and in accordance with NYCRR 56.

3.3.7 Inaccessible/Assumed Asbestos-containing Materials Asbestos-containing materials may be associated with various underground utilities located within the Project limits. The Department has not investigated or determined if asbestos-containing materials are associated with underground utilities on or in the immediate vicinity of the bridge. Any asbestos-containing materials associated with these utilities shall be the responsibility of the utility owner. The Design-Builder shall coordinate with the utility owners for the remediation of any asbestos-containing materials which may be identified.

3.4 ENVIRONMENTAL PERMITS Fills and other demolition and construction activities in and adjacent to waters of the US necessary for completion of this project are subject to Section 404 of the Federal Clean Water Act, Section 401 of the Federal Clean Water Act and 6NYCRR Part 608 Article 15 of the New York State Environmental Conservation Law. The United States Army Corps of Engineers (USACE) and the New York State Department of Environmental Conservation (NYSDEC) are the agencies responsible for enforcement of these regulations and as such will be closely coordinated with for all project activities. It is anticipated that USACE and NYSDEC permits will be required for any potential impacts to the bed and banks at/or below the Ordinary High Water (OHW) level of Cattaraugus Creek and any tributaries thereof, as well as impacts to any wetland areas. No wetland or water quality permits have been issued for this project. Should the Design-Builder propose impacts to waters of the US, the Design-Builder is responsible for coordinating with the Department to obtain any necessary permits from the USACE and NYSDEC. The Department will not be responsible for any delays related to permitting. The Design-Builder should anticipate that it may be difficult to obtain USACE and NYSDEC permits for a design/demolition plan that involves dropping the existing bridge into the creek without prior removal of the concrete deck and any loose or contaminated/hazardous debris. It is recommended that Proposers investigate the potential impacts on schedule when considering that option. For the purposes of establishing the required schedule as described in Section 1.12 of this RFP, the Design-Builder shall assume that the regulatory timeframe for issuance of a permit from the USACE includes the following:

1) Approximately 30 calendar days for a completeness review and request for further information if needed; and

2) Approximately 45 calendar days for final authorization after a complete application has been received by the USACE.

The Design-Builder is responsible for addressing any and all comments that the USACE may have on the Design-Builder’s application. Any time spent responding to comments by the USACE is not included in the above permitting timeframe. The short-listed firms should consider the NYSDEC in-stream work restriction dates when developing their proposals. NYSDEC will not allow any in-stream work from September 15th to May 31st in order to minimize potential impacts to fish and other aquatic species. For the purposes of establishing the required project schedule as described in Section 1.12 of this RFP, the Design-Builder shall assume that the regulatory timeframe for issuance of the Water Quality Certification by NYSDEC is approximately ninety (90) calendar days from the time a complete application is received by the NYSDEC. The Design-Builder is responsible for addressing any and all comments that the NYSDEC may have on the Design-Builder’s application. Any time spent responding to comments from the NYSDEC is not included in the ninety (90) calendar day timeframe. The Design-Builder shall assume that both the USACE and NYSDEC will require that all correspondence between the NYSDEC, USACE and the Design-Builder be sent through the Department and that the Department will take 7 5 business days to transmit the correspondence.

3.4.1 Temporary Access and Dewatering Proposed temporary access and dewatering structures should not consist of erodible fill (loose sand, soils, inadequately sized rip rap, etc.). The Design-Builder should be aware that the Cattaraugus Creek is listed on the Inventory of Wild and Scenic Rivers. Therefore, all temporary access and dewatering materials will need to be completely removed from the creek once work is completed. 3.4.2 General Water Quality and Permit Requirements Unless otherwise indicated in the Contract Documents, the Department shall apply for and obtain any and all permits required for construction involving waters of the US as defined by the USACE. It shall be assumed that demolition and construction may affect waters of the US, which shall require at a minimum a Nationwide permit from the USACE. All construction activities occurring within regulated waters of the US shall be completed in full compliance with the permits obtained for said construction, and the Design-Builder shall be fully liable for all consequences arising as a result of the Design-Builder’s failure to comply with all requirements and conditions of the permits. For those Environmental Approvals not secured as of the date of Notice to Proceed, the Design-Builder shall cooperate with and assist the Department in securing the approvals and monitoring during construction. If the work proposed by the Design-Builder requires that changes be made to the environmental permits already obtained by the Department for the project, the Design-Builder shall be responsible for the preparation of all information necessary to support permit modifications. For any such approvals that must formally be issued in the Department's name, the Department will cooperate with the Design-Builder as reasonably requested by the Design-Builder, including execution and delivery of appropriate applications and other documentation prepared by the Design-Builder in a form approved by the Department. The Department will not be responsible for any delay or additional cost associated with the Design-Builder’s requested permit/ approval modification. All work within or in the vicinity of streams, water impoundments, wetlands or irrigation supplies shall be completed in compliance with applicable permits, as determined by the Construction Quality Assurance Engineer. All waterways shall be cleared as soon as practical of debris or other obstructions placed or resulting from construction operations and which are not part of the finished work. Equipment refueling and maintenance and concrete dumping in the vicinity of water courses are strictly prohibited. These activities shall be performed in proper containment areas. Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged into or near waterways or impoundments or into natural or manmade channels leading to them. 3.4.3 Environmental Plan Deliverables

At a minimum, the deliverables shall include the items listed in Table 3-1 – Environmental Compliance Deliverables for the Department’s review.

Each of the deliverables listed in Table 3-1 – Environmental Compliance Deliverables, shall be provided to the Department as indicated in Table 3-1.

The Design-Builder shall be aware of and comply with the Migratory Bird Treaty Act (MBTA) and shall inspect the Project Area and Highway Right-of-Way, including the bridge substructure and superstructure, for bird nesting activity before performing bridge demolition, clearing and grubbing, and tree removal. In particular, the Design-Builder should be aware of known and possibly active nest sites of various birds of prey, including hawks and falcons, in the immediate vicinity of the bridge as there have been siting’s in the general project area. Any activities that are in close proximity to or may impact or interfere with the nests of these birds must be coordinated through the Construction Quality Assurance Engineer in coordination with the Department’s Construction Environmental Coordinator. There are no records on any protected migratory birds known to have nested on the existing bridge.

All questions relating to migratory birds and nesting should be directed to the Construction Quality Assurance Engineer.

inches in the soil where each sample is taken, shall be kept. Records shall be kept using the NYSDOT Subsurface Exploration Log Form (US Units).

9.3.5 Software Requirements The Design-Builder shall use Bentley gINT® or similar commercial software to develop and maintain an electronic database of subsurface information including in-situ test and laboratory test results, and to produce boring records.

9.3.6 Geotechnical Data Report The Design-Builder shall be responsible for preparing a geotechnical data report, signed and sealed by the Lead Geotechnical Engineer Designer. The geotechnical data report shall serve as a factual depiction of the subsurface conditions and at a minimum it shall include:

A) A detailed description of the investigation methods;

B) Complete records with summary tables of investigation;

C) Complete records with summary tables of laboratory test results; and

D) An exploratory hole location plan, showing locations of any existing (pre-award) exploratory holes for which data was used by the Design-Builder plus locations of post-award exploratory hole locations undertaken by the Design-Builder.

The Design-Builder shall provide the Department with a copy of the final log for each subsurface investigation exploratory hole progressed.

9.3.7 Retaining Walls The Design-Builder shall design and construct retaining walls in accordance with Section 10 of this Part 3 - Project Requirements. The Design-Builder shall provide retaining wall designs to address internal, external, and global (overall) stability and settlements (total and differential) of the walls in accordance with the AASHTO LRFD Bridge Design Specifications.

All retaining walls shall be evaluated and designed for seismic stability internally and externally (i.e. sliding and overturning). With regard to overall seismic slope stability (global stability) involving a retaining wall, with or without liquefaction, the lead Engineer shall evaluate the impacts of failure due to seismic loading, if failure is predicted to occur.

9.3.8 Geotechnical Instrumentation & Construction Monitoring Wherever vibration-producing activities are occurring at the project site, the northbound and southbound US 219 structures over Cattaraugus Creek in addition to any other structures, buildings and utilities within 300 feet of vibration-producing operations, shall be monitored in accordance with the specifications of item 634.99020017 (or superseding specifications) to address the potential impacts to nearby receptors due to construction or demolition activities associated with this Project. The term “receptor” includes buildings, utilities, newly constructed elements, and existing structures, for which construction impacts or Work above recommended limits may be detrimental.

The Design-Builder shall provide weekly construction instrumentation monitoring reports to the Department. Monitoring reports shall be interpretive in nature, and shall enumerate any corrections applied to the data including, but not limited to, any notification measures taken regarding data. The weekly reports shall include clear and explicit statements of reading exceeding any pre-determined threshold values. The Design-Builder shall maintain the

SECTION 15 WORK ZONE TRAFFIC CONTROL AND ACCESS

15.1 SCOPE

The Design-Builder shall be responsible for the planning and provision of Work Zone Traffic Control (WZTC), required to perform the Project Work until Project Completion. This Project Requirement applies to any roads, ramps, cross roads, local streets, maintenance roads, driveways, and active paths within and/or affected by the Project.

The Design-Builder shall provide WZTC for the safe and efficient movement of people, goods, and services through the Project area(s) while maintaining access and minimizing negative impacts to residents, commuters, businesses, and NYSDOT maintenance operations.

Note that, as used in this section, “Work Zone Traffic Control plan” or “WZTC plan” is the equivalent of “Maintenance and Protection of Traffic plan” or “MPT plan” as described in Chapter 16 of the Highway Design Manual (HDM).

15.2 STANDARDS AND REFERENCES

The Design-Builder shall perform the work zone traffic control activities in accordance with the Contract Requirements and the applicable Standards, Codes and Manuals listed in Section 1.6, unless otherwise stipulated in this Project Requirements, or otherwise applicable to the Project.

15.3 REQUIREMENTS

15.3.1 General Requirements The Design-Builder shall maintain two-way traffic with a minimum of one lane in each direction at all times on all roadways in the project area including South Cascade Drive, Scobey Hill Road, Schwartz Road, Miller Road, and US 219. An offsite detour utilizing the structure carrying US 219 northbound traffic, as shown in the Directive Plan, is required to accommodate South Cascade Drive and Miller Road traffic. Detailed requirements for this detour are described in Section 15.3.5 below and the Directive Plan is included in Part 6 - RFP Plans.

The Design-Builder shall be responsible for snow and ice control for a portion of the offsite temporary detour shown on the Directive Plan in Part 6. The specific limits of Design-Builder responsibility begin at the temporary intersection with Schwartz Road, proceed northbound along US 219, and end at the temporary intersection with South Cascade Drive. Snow and ice control shall follow the Department’s Highway Maintenance Guidelines, Chapter 5, Snow and Ice Control (see Part 7 – Engineering Data). This detour shall be maintained following the criteria for a Class B highway. The Department shall provide snow and ice control for all other state-owned highways and bridges as described in Part 2, Section 105-12.

15.3.2 Work Zone Traffic Control Plan The Design-Builder shall prepare and submit a WZTC Plan, in accordance with the above General Requirements, for managing traffic operations and controlling access until Project Completion.

The WZTC Plan shall be submitted to the Design Quality Assurance Engineer a minimum of two (2) weeks prior to initiation of any Work in proximity to traffic or the implementation of any change in traffic patterns.

The WZTC Plan shall include:

A) Contingency plans for reasonable unforeseen interruptions; and

B) Duration of each WZTC stage, including duration of road closure(s) and lane closure(s), if any.

The Design-Builder shall notify local officials and affected police jurisdictions to facilitate safe and effective enforcement. The WZTC Plan shall recognize the need for approval of the use of local public roads.

The Design-Builder shall produce a clear design of each stage, with associated traffic clearly delineated, in chronological order. Each significant change in traffic patterns shall be presented as a separate stage.

The Design-Builder shall be responsible for updating the WZTC Plan as necessary throughout the Contract, so that at all times the current traffic control on site is representative of the design drawings that have been accepted by the Department.

For requirements regarding notifications of any proposed changes to traffic patterns, see Section 7.3.3. 15.3.3 General Restrictions.

15.3.3 General Restrictions 15.3.3 Access to Commercial Properties and Driveways The Design-Builder must provide uninterrupted access to all commercial properties and driveways at all times.

15.3.4 Closure Restrictions and Detours The Design-Builder shall maintain two-way traffic at all times on all roadways affected by the Project. An offsite temporary detour will be required to maintain local traffic as shown on the Directive Plan in Part 6. The offsite temporary detour, including temporary intersections with Schwartz Road and Cascade Drive shall be designed for the SU-30 Design Vehicle. This offsite temporary detour shall accommodate emergency vehicles, pedestrians, bicyclists and other legal-sized vehicles (including farm equipment, snowmobiles and horse-drawn buggies) and shall be maintained and open at all times during construction. A separate signed truck detour must be provided for the WB-67 Vehicle.

US 219 may be restricted to one lane in each direction, with a maximum 10-mile-per-hour reduction in the current speed limit if necessary, for the duration of the contract to accommodate off-site detours.

Temporary connections and crossovers for US 219 shall be designed and constructed to applicable standards for the purposes of providing an off-site detour. The Design-Builder is prohibited from placing any fill for the temporary detours in the existing landslide area north of Cattaraugus Creek. Therefore, no fill will be allowed north of metric Sta. SB 50+400 along US 219. A diagram indicating the location of this landslide area is included in Part 7 – Engineering Data of this RFP.

Upon restoration of US 219 traffic onto the new bridge, all facilities constructed for the temporary detour shall be removed, including all ramps and crossovers. Grading in these areas shall be restored to the satisfaction of the Construction Quality Assurance Engineer and appropriately seeded and mulched.

15.3.5 Minimum Lane Widths during Construction The Design-Builder shall maintain a minimum travel lane width of 12 feet for all roadways within the project limits during construction.

15.3.6 Portable Variable Message Signs The Design-Builder shall provide at least 6 Portable Variable Message Signs for the duration of this Contract. The Portable Variable Message Signs shall be deployed as necessary for the various WZTC schemes developed. The portable variable message signs provided shall meet the requirements of NYSDOT Item No. 619.110202 (Portable Variable Message Boards with Cellular Option)

It is anticipated that the development of messages will primarily be the responsibility of the Construction Quality Assurance Engineer and operations staff at Niagara International Transportation Technology Coalition (NITTEC). Any VMS not able to be controlled by NITTEC shall be removed from the project and replaced with a VMS that can be controlled by NITTEC.

For requirements regarding notifications of placement of Variable Message Signs, see Section 7.3.3.

15.3.7 Temporary and Interim Pavement Markings The Design-Builder shall provide temporary and interim pavement markings during all construction phases conforming to the requirements of the NYSDOT Standard Specifications. Any temporary pavement markings that will be left in place after November 1, shall have epoxy pavement markings applied over them in accordance with Section 685 of the Standard Specifications.

Any temporary pavement markings placed shall be removed prior to completion of the Project to the satisfaction of the Construction Quality Assurance Engineer.

15.3.8 Coordination with Regional and Main Office Traffic and Safety The Design-Builder is advised that the Design Quality Assurance Engineer, Regional Traffic Engineer, Construction Safety Coordinator, and Health & Safety Representative, along with the work zone inspection teams (regional and main office), are available to provide support for WZTC activities. The Design-Builder, through the Construction Quality Assurance Engineer, will be required to notify NITTEC (particularly with respect to the use of Variable Message Signs in the Project area).

15.3.9 Emergency Response and Transportation Management Plans The Design-Builder shall notify the Construction Quality Assurance Engineer immediately following any impacts on motorists due to construction activities and/or unforeseen circumstances. The Construction Quality Assurance Engineer will be responsible for disseminating the information to the appropriate personnel/entities for appropriate response to mitigate impacts to motorists.

The Design-Builder shall prepare an Emergency Response Plan to be implemented in the event US 219 or the temporary detour is shut down for unforeseen or unplanned circumstances. The Plan shall be implemented when the anticipated duration of closure exceeds twenty (20) minutes. The Plan shall be submitted to the Department’s Project Manager for review and comment a minimum of two (2) weeks prior to the beginning of Work. Work on this Project shall

not begin until the Design-Builder receives written notification from the Department’s Project Manager that the Emergency Response Plan has been reviewed by the Department and all Department comments have been resolved.

The Emergency Response Plan shall include a notification and communication plan that describes how the Design-Builder will promptly inform the appropriate personnel/entities of an unforeseen or unplanned circumstance. The Department’s Project Manager will provide a list of personnel and entities that need to be contacted in this section of the Emergency Response Plan.

The Design-Builder shall also provide the Department’s Project Manager with a Transportation Management Plan (TMP) per FHWA’s Final Rule on Work Zone Safety and Mobility, 23 CFR 630 Subpart J. The Emergency Response Plan shall be a component of the TMP and shall be located in the contingency section of the TMP.

15.3.10 Required Weekly Reporting The Design-Builder, through the Construction Quality Assurance Engineer, shall file weekly reports with NITTEC. The reports shall be filed by noon on Thursdays, regardless of whether any changes have been made to the existing traffic pattern or not. 15.3.11 Drivers First Initiative Section not used.
