– European citizenship … must become a tangible reality.

– The area of freedom, security and justice must above allbe a single area in which fundamental rights areprotected.

The enlargement of the Schengen area must continue– The enlargement of the Schengen area must continue.

– Respect for the human person and human dignity and forthe other rights set out in the Charter of FundamentalRights and the European Convention on Human Rights arecore values. For example, the exercise of these freedomsand citizens' privacy must be preserved beyond nationalborders, especially by protecting personal data.

B) A Europe of law and justice: The achievement of aEuropean area of justice must be consolidated so asto move beyond the current fragmentation. Priorityshould be given to mechanisms that facilitate accessto justice, so that people can enforce their rightsthroughout the Union.

Cooperation between public professionals and theirtraining should also be improved, and resourcesshould be mobilised to eliminate barriers to therecognition of legal acts in other Member States.

should be developed in order to further improvesecurity in the Union and thus protect the lives andsafety of European citizens and tackle organisedcrime, terrorism and other threats. 1. Mutual trust between authorities and services, as well asbetween decision-makers, in the different Member States

2. Implementation. Increased attention needs to be paid inthe coming years to the full and effectivethe coming years to the full and effectiveimplementation, enforcement and evaluation of existinginstruments.

3. Evaluation. The Member States, in cooperation with theCommission, shall undertake an objective and impartialevaluation of the implementation of the policies in thearea, in particular to promote the full application of theprinciple of mutual recognition.

police and customs officers and border guards. The aim is that asubstantive number of professionals by 2015 will haveparticipated in a European Training Scheme or an exchange withanother Member State, which might be part of training schemesthat are already in place. For this purpose existing traininginstitutions should in particular be used.

5. Networking. Such networks should primarily meet using existingstructures such as Europol, Eurojust and Frontex or at theinvitation of the Presidency as host country. Other Networks ofprofessionals existing in this area should also continue to receiveUnion support. Among those are the European Network of theCouncils of the Judiciary and the Network of the Presidents ofthe Supreme Judicial Courts.

The Stockholm ProgrammeDeveloping a core of common minimum rulesTo facilitate mutual recognition of judgments andjudicial decisions and police and judicial cooperation incriminal matters, the Union may adopt commonminimum rules.

C i i l lCriminal lawThose areas of serious crime with a cross-borderdimension should become the object of commonincriminations and common minimum levels of maximumsanctions. Priority should be given to terrorism,trafficking in human beings, illicit drug trafficking, sexualexploitation of women and children and childpornography and computer crime.

1. eJustice

EJustice is an EU project that aims at increasingthe use of modern technology within the justicesector, including setting up a common European, g g p pInternet portal. The project is to simplify cross-border judicial cooperation and make it easier foreveryone to search for information on laws andlegal procedures in the Member States. SEEcountries need to connect to this system.

2. Combating crime• increased and effective cooperation is necessary. European

cooperation is crucial in combating cross-border organisedcrime. It is a matter of developing cooperation among lawenforcement actors, i.e. the SEE police services, customsenforcement actors, i.e. the SEE police services, customsauthorities and public prosecutors, as well as with Eurojustand Europol. Border control is also an important tool in thefight against cross border crime.

• Remove the practical obstacles that still exist among thedifferent SEE countries regarding cooperation ininvestigating and preventing crime. There is need for abetter information exchange among law enforcementauthorities.

3. Rights of a crime suspect

• Cooperation within the EU in the area of criminallaw is based on the trust of the Member States’ ineach another’s legal systems. The principle ofmutual recognition and enforcement of eachother’s judgments and decisions is offundamental importance to this cooperation.

• Therefore, all SEE countries will undertake thesame steps to implement confidence-buildingmeasures, necessary for developing a moreeffective cooperation.

4. Border control and customs cooperation

• EU border control is an important tool in thefight against transborder crime. SEE countriesneed to learn from the EU experience and todevelop a joint strategy and an action plan in thisfield, where all the regional actors to have welldefined their roles and competences.

Conclusions of the SEE JHA Strategy meetings

1. To create an effective regional cooperation framework, by consolidating theexisting regional legal instruments (PCC-SEE, SELEC) and networks, ratherthan setting up new ones.

2. To strengthen the regional cooperation for magistrates (prosecutors andjudges), and for justice officials, and to integrate them with the currentlybetter structured and organized police and law enforcement networks.

5. A greater regional involvement of the EU Member States that are members ofthe RCC Board, especially the three SEECP countries – Bulgaria, Greece,Romania and Slovenia s expected.

7. A holistic and multidisciplinary approach integrating judges, prosecutors andjustice officials with the police and law enforcement will address thecooperation in the following sub-areas:

– Fight regionally trans-border organized crime

– Anticorruption

– Migration, asylum, refugees

• Trafficking and smuggling of goods , hazardous materials and arms

• Trafficking in human beings and sexual exploitation of children

• Money laundering

• Illegal migration

• Drugs trafficking

• Corruption

• Links between organized crime and terrorism

– New threats:

• Cyber crime

• Card frauds

• Environmental crimes
