    2 DIRECT EXAMINATION BY MR. LORAINE:

    3 Q. Were you an Elk member?

    4 A. Yes.

    5 Q. I believe you're the present Exalted Ruler,

    6 is that correct?

    7 A. No, I'm not presently.

    8 Q. You were the one that was there when the

    9 property was sold to the City?

    10 A. Yes.

    11 Q. It was bought by Wallace-Bajjali?

    12 A. Yes.

    13 Q. What, if anything, do you have to tell me

    14 about the sale of that property that is

    15 significant to what I'm investigating, if you

    16 know?

    17 A. I really don't know anything significant as

    18 far as the sale of the property goes.

    19 Q. Well, I was told that it was a good price, it

    20 was fair. Is that true?

    21 A. Yes, I think it was a fair price.

    22 Q. And who worked with the Elks Club on getting

    23 this matter transacted?

    24 A. It was brought to us by Gary Box.

    25 Q. All right. And Gary Box is a member of your

    1 lodge?

    2 A. Yes, he is.

    3 Q. And who else worked on it, anybody?

    4 A. There was a couple of Wallace-Bajjali people

    5 that came in later with Gary, but I'm sorry,

    6 off the top of my head I don't recall their

    7 names.

    8 Q. All right. Was there any involvement by Mr.

    9 Woolston in this matter?

    10 A. No.

    11 Q. Was there any involvement with any other

    12 Council member in this matter?

    13 A. No.

    14 Q. So basically it was just a transaction

    15 between Wallace-Bajjali, Mr. Gary Box, and

    16 yourself?

    17 A. Well, I mean the proposal was brought to our

    18 Board of Directors and then before we could

    19 sell property it's a requirement that it's

    20 voted on by our membership so our membership

    21 was informed of the proposal and it was voted

    22 to accept.

    23 Q. Okay. Are you on the Sports Authority for

    24 the City?

    25 A. No, I'm not.

    1 Q. And never have been?

    2 A. No.

    3 Q. Do you know anything about the management

    4 style or --

    5 A. No, I do not.

    6 Q. Okay. Let me just get pretty straight. Did

    7 the City Manager have any involvement with

    8 the sale of the Elks Club property?

    9 A. I'm not aware of any.

    10 Q. All right. What happened after

    11 Wallace-Bajjali bought the property?

    12 A. I mean it closed and I think it's in cue for

    13 the project they described to us.

    14 Q. Did the property ever get to the 353 club or

    15 association, that landholder authority?

    16 A. That I do not know.

    17 Q. All right. Do you know what title company

    18 may have closed that?

    19 A. It closed at the title company on 32nd

    20 Street.

    21 Q. Did you have any role in the selection of the

    22 title company? In other words did you pick

    23 the title company or did Wallace-Bajjali?

    24 A. I don't recall, sir, to be honest.

    25 Q. All right. I don't think we have anything
