The World Bank policy on indigenous peoples, underscores the need that subproject developers identify indigenous peoples, consult with them, ensure that they participate in, and benefit from Bank-funded operations in a culturally appropriate way - and that adverse impacts on them are avoided, or where not feasible, minimized or mitigated. In case of Vietnam and the REDP, this policy has been modified to consider ethnic minorities, rather than indigenous peoples.

OPIBP 4.37 Safety on Dams The Safety on Dams Safeguard requires that experienced and competent professionals design and supervise construction, and that the borrower adopts and implements dam safety measures through the project cycle. The policy also applies to existing dams where they influence the performance of a project. In this case, a dam safety assessment should be carried out and necessary additional dam safety measures implemented.

OPlBP 7.50 Projects on International Waterways

The objective of OP/BP 7.50 is to endure that World Bank-fmanced projects affecting international waterways would not affect relations between the World Bank and its Borrowers and between states and also not affect the efficient ufilization and protection of international waterways. 1. INTRODUCTION 1.1. Project background

Energy development is required for industrialization and modernization of the country. The rapid development of agriculture, industry leads to the increased demand for power development. '

Ha Tay hydropower project is mainly aimed to: Meet the power demand of the local province; Contribute considerable budget for Gia Lai province through the tax; Contribute to increase intellec~al standard of the local people; Create the beautiful landscape that can be serve for tourism and other economic activities; Shift economic basis of the province from agriculture, forestry to industry.

1.2. Project sponsor Project is planned to be sponsored by the World bank (WB).

1.3. Project objectives Main objective of Ha Tay hydropower project is electricity production. The total installed capacity is

Nin,m=9 MW, energy produced is 35.2 mill, kwh and will be evacuated to the national power grid.

Beside this objective, Project will enable to develop local economic; supply water for residential and agricultural purposes; supply water for downstream during dry season; enable to develop ecotourism.

1.4. Responsibility for preparation of EMP

Project owner - Song Da Tay Nguyen hydropower joint stock company is responsible for preparation and implementation of EMP. Independent consultant supports the Project owner to prepare EMP according to the Environmental safeguard framework (ESF) designed for the Renewable Energy Development Project.

Project reservoir volume at the normal water level us 1.18 mill. m3. According to Vietnam Government regulation, full EIA is required and Gia Lai Provincial committee will approve this EIA. Project EIA has been prepared in December 2007 and was approved by Gia Lai people committee by Decision No 7301QENBND dated 161612008 on approval of EIA report for Ha Tay hydropower project invested by Song Da Tay Nguyen hydropower joint stock company.

2.3. Environmental setting

Air quality Ha Tay hydropower project is set in the area with sparse population with limited number of transportation

vehicles. Industrial and handicraft activities are very few. Therefore air condition in the Project area is very clean, no air pollution is observed.

During preparation of EIA report, Project owner and consultant have collected water samples in the Project sites. Sampling points are for examples: 100m in the upstream of the dam, 100m from downstream of the dam, at the dam site, at the reservoir site etc. Water samples were analyzed and the following conclusions were made:

- pH has an average value. Water is neutral; - COD, BOD, coliform content is low, no organic pollution was observed; - NO2, NO3 were in low level; - All samples were met TCVN 599-2005 on the quality of the surface water.

Topography and land resource Topography of the Project area is quite complex. There is a mix of hills, high land and low land.

Project site is located in 2 communes: Ha Tay and Dak To Ver. The elevation difference is about 200 m. The slope is from 2.5 to 4%. Along the Project site are steep hills.

Soil in the Project area is very fertile, suitable for a lot of high value annual and long term trees.

2.4. Brief description on social condition in Project area

Dam site of Ha Tay hydropower project is located in Ha Tay commune, Chu Pah district; the reservoir area is located in Dak To Ver commune (Chu Pah district) and Dak So Mei commune (Dak Doa district). Main land acquisition is in Dak To Ver commune.

Ha Tay commune was established and belonged to Chu Pah district since 1997. It was separated from the previous Mang Yang district. At the present time Ha Tay commune has 9 villqges. Total area of Ha Tay commune is 22,147 ha. Popt.11ation of the commune is 3,119 peoples with 568 households. Main of popillation is Bana ethnic.

Ha Tay is the most remote commune of the district. Population is sparse, far from commune center. Since 1998 up to now, the Government invests a lot for stabilization of livings, production for local peoples.

Forested area in the Dak To Ver commune is 3,700 ha.

Main living activities of local people is forest agriculture, plantation of industrial trees and husbandry. Average income of local people is 2.5 million VNDlyear. Average amount of food is 450 kg/person/year.

Local people are able to access to the finance program of poverty alleviation to invest for production and husbandry.

People in Project area are mostly ethnics. Main source of income is from agricultural production of dry crops, industrial crops.

Infrastructure facilities for people in Project sites are available: schools, health care station, electricity and good roads. Local people still keep their special cultural characters and tradition such as costumes, house arrangement, cemete ry... Beside that the equipment of modern life such as satellite, motorbikes ... were observed during site investigation.

Only soil erosion in dam and power plant sites can be impact surface water. - Water turbidity is increase due to landslide, erosion in places mentioned above; - Rain water run off will sweep waste water, solid wastes, oil and grease ... ,from the living and construction activities; - During reservoir filling up, certain amount of vegetation will be flooded. Biological degradation process will deteriorate water quality during 6 to 12 first months. - Sources of water pollutants:

- Sewage; - Wastes from construction sites: workshop for

equipment repairing, concrete production - Rock washing station, grinding station; - Rain water run offs; - Oil and grease; - Solid wastes from human livings; - Biomass flooded.

- Main work amount that might cause air pollution problems: Soil excavation: 162,512 m3 of soil and rocks; Damming up of 145,000 m3 of soil and rocks; Concrete work: 46,640 m3 Steel work: 1 ,I 66 tons

- Amount of vehicles and construction machines will be gathered to the Project area; - Pollutants: dust, emission from vehicles S02, N02, CO, THC - Source caused noise impacts

This 36.1 ha is area of planted rubber trees of Chu Pah rubber company; Workers might cut tree for fire wood, logging for there daily needs; Clearing, leveling of new residential areas for new resettlement site.

- Type of trees to be cut is: shrubs, cassavas, rubber trees. They have economic value rather than ecological values. Rubber trees

Noise and vibration of vehicles and construction machines; use of explosive materials; material transportation; mining activities; etc ... Almost 300 workers gather in the Project site;

- Animal need to charlge their living habits. They tend to move to father and more quiet sites; - Habitats are fragmented by new access roads; - During reservoir filling up, animals will moved from the area. They are subjects for illegal hunting or they will be left in the isolated island newly created in the reservoir. - Slow moving animals or reptiles will be flooded and died. - Local people reveal that there is no animal was observed or hunt in this area. - New water birds might occur more when the reservoir is filled UD; . . I - Impact on birds is very minor.

During rainy season - Reservoir will keep part of coming water, the remaining water is run through 27 m wide spill dam; - Water flow is changed from the downstream of dam to the power house. 'This distance is 168 m. At this area, the stream run through many windings, so flow will reach to the natural balance as when it was no power plant. During dry season - Water flow is maintained by water amount running through - - turbines 20.99 m3ls. Based on the experience from other reservoirs for hydropower,

CONSTRUCTION PHASE - Site investigation activities by Project owner and consultants lead to the fact that local people thinking, worry about their life might be changed in the future. - During construction, transportation of construction materials will effect the transportation in the area. - 04 households will need to be relocated from their original home places. At the present time, these four families live in the area that will be flooded. They will be resettled in upper part of their original home land. Distance to the previous living place is about 500 m. Therefore impacts caused to their life are limited. - Project will permanently occupy 153.44 ha and 5.5. ha will be temporarily occupied. - It estimated that 278 workers and engineer will be gathered in the Project area. From these number, there will be 220 workers, 30 staffs will work in administrative and management and about 28 persons are followers. - Different living habits, different income can cause conflict with local people. - However, the construction sites are quite far from residential area (more than 4 km).

The Contractor shall be held responsible for any damage caused to local roads and bridges due to the transportation of excessive loads, and shall be required to repair such damage.

The Contractor shall not use any vehicles, either on or off road with grossly excessive, exhaust or noise emissions. In any built up areas, noise mufflers shall be installed and maintained in good condition on all motorized equipment under the control of the Contractor.

Adequate traffic control measures shall be maintained by the Contractor throughout the duration of the Contract and such measures shall be subject to prior approval of the Project owner.

Storage site for diesel will be located in fallout area in the right dam site. It is 1000 m far from the dam. This location is more than 4 km far from residential areas as well as far from surface water hoe. Equipment are stored in water-resistant floor (for example: covered by plastic layer) to prevent the leaching to

soil and contamination of underground water and to prevent oil spill.

Construct dykes along storage site or keep fuel in tanks with 110% volume of fuel to avoid oil spill. Volume of diesel oil is expected less than 10,000 liters.

Equip tools for fire control and provide proper training for workers. Regular check for the availability of these equipment on the sites.

All hazardous materials shall be stored on impervious surfaces (preferably a synthetic liner), in well ventilated buildings that are locked and fenced when not in use.

Explosive materials will not be stored in Project site. These materials will be stored for a very short time before use. Storage site will be located with more than 100 m far from surface water body, farm from camp site, construction sites.

Three campsites will be established in the right dam site, 500 m far from dam. This site is located in area mixed of degraded forest and fallout and cassava field. Project will use provincial road No 14, 20 km of provincial road No 670, and 6 km access road of Chu Pah ~ u b b e r Company. At the present time, the access road of Chu Pah rubber company is small, about 2 m wide. Project owner will extend and upgrade road to use as access road for Ha Tay hydropower project. Provincial road No 670 is still in not stable conditions, in case Project vehicles cause any damage, Project owner and contractor need to repair. Project vehicles are not allowed to create debris, obstacles, mud. If vehicles drop mud, debris ... the Contractor and Project owner are responsible for cleaning. Project use the existing road of Chu Pah rubber company as Ha Tay project access road,-so Project will not create new access road to the area. Project is carried out in the area of dry crop land (cassava), planted rubber forest and fallout ... so the extension of existing access road will not cause problem in term of creation of new access road to the undisturbed or ecologically valuable sites. Drainage will be constructed to prevent an upgraded access road from soil erosion and landslide; During extension of the existing road, Project owner will control to make sure cut trees only in required areas. Not allow to cut trees outside the required land. Water for three camp sites will be taken from the source that is allow by the local government; Supplied water will be analyzed to ensure quality before use; Intake water for camp site should not affect clean water supply for local people.

Stock pile and borrow pits

The contractor shouldensure that these sites (a) are not located within-designated forest areas; (b) do not impact natural drainage courses; and (c) do not impact endangeredlrare flora. Under no circumstances shall the contractor dispose of any material in environmentally sensitive areas. In the event any debris or silt from the sites is deposited on adjacent land, the Contractor shall immediately remove such, debris or silt and restore the affected area to its original state to the satisfaction of the Project owner. All arrangements for transportation during construction including provision, maintenance, dismantling and clearing debris, where necessary, will be considered incidental to the work and should be planned and implemented by the contractor to the satisfaction of the Project owner.

In any borrow pit and disposal site, the Contractor shall: Identify and demarcate locations for stockpiles and borrow pits, ensuring that they are 15 meters away from critical areas such as steep slopes, erosion-prone soils, and areas that drain directly into sensitive water bodies Limit extraction of material to approved and demarcated borrow pits

Stockpile topsoil when first opening the borrow pit. After all usable borrow has been removed, the previously stockpiled topsoil should be spread back over the borrow area and graded to a smooth, uniform surface, sloped to drain. On steep slopes, benches or terraces may have to be specified to help control erosion. Excess overburden should be stabilized and replanted. Where appropriate, organic debris and overburden should be spread over the disturbed site to promote replanting. Natural replanting is preferred to the extent practicable. Existing drainage channels in areas affected by the operation should be kept free of overburden. Once the job is completed, all construction -generated debris should be removed from the site.

Chance find of cultural artifacts, and areaslstructures of local cultural value

If the Contractor discovers archeological sites, historical sites, remains and objects, including graveyards andlor individual graves during excavation or construction, the Contractor shall:

Stop the construction activities in the area of the chance find; Delineate the discovered site or area; Secure the site to prevent any damage or loss of removable objects. In cases of removable antiquities or sensitive remains, a night guard shall be arranged until the responsible local authorities or the National Culture Administration take over; Notify the supervisory Engineer who in turn will notify the responsible local authorities and the National Culture Administration immediately (within 24 hours or less); Responsible local authorities and the National Culture Administration would be in charge of protecting and

This would require a preliminary evaluation of the findings to be performed by the archeologists of National Culture Administration. The significance and importance of the findings should be assessed according to the various criteria relevant to cultural heritage; those include the aesthetic, historic, scientific or research, social and economic values; Decisions on how to handle the finding shall be taken by the responsible authorities and National Culture Administration. This could include changes in the layout (such as when finding an irremovable remain of cultural or archeological importance) conservation, preservation, restoration and salvage; Implementation for the authority decision concerning the management of the finding shall be communicated in writing by relevant local authorities; and Construction work could resume only after permission is given from the responsible local authorities or National Culture Administration concerning safeguard of the heritage.

All construction materials supplied to the subproject, e.g. stone, concrete, sand, etc. must be provided by contractors with valid operating permits and necessary environmental approvals.

Workers will not be allowed to remove plants, trap or hunt animals, or fish; such actions.will be cause for dismissal; Workers will not be allowed to have firearms in camps.

The Contractor's responsibilities include the protection of every person and nearby property from construction accidents. The Contractor shall be responsible for complying with all national and local safety requirements and any other measures necessary to avoid accidents, including the following:

Carefully and clearly mark pedestrian-safe access routes; If school children are in the vicinity, include traffic safety personnel to direct traffic during school hours; Maintain supply of supplies for traffic signs (including paint, easel, sign material, etc.), road marking, and guard rails to maintain pedestrian safety during construction; Conduct safety training for construction workers prior to beginning work; Provide personal protective equipment and clothing (goggles, gloves, respirators, dust masks, hard hats, steel-toed and shanked boots, etc.,) for construction workers and enforce their use; Post Material Safety Data Sheets for each chemical present on the worksite; Require that all workers read, or are read, all Material Safety Data Sheets. Clearly explain the risks to them and their partners, especially when pregnant or planning to start a family. Encourage workers to share the information with their physicians, when relevant; Ensure that the removal of asbestoscontaining materials or other toxic substances be performed and disposed of by specially trained workers; During heavy rains or emergencies of any kind, suspend all work.

Project owner and contractors need to ensure that all of Project sites need to be cleaned and rehabilitated after construction completion. Rehabilitate and return the temporary land acquired sites to their original conditions or replant trees whenever possible. Arrange the good looking landscape in the Projects after construction is completed.

Turbines andlor associated rotating equipment should be designed to meet international standards (-80 db @ 1 meter); Provide requirement for design and procurement of turbines and equipment; Regular monitoring of the noise level in the power house.

- During rainy season, reservoir will keep part of coming water, the remaining water is run through 27 m wide spill dam; Water flow is changed from the downstream of dam to the power house. This distance is 168 m. At this area, the stream run through many windings, so flow will reach to the natural balance as when it was no power plant. - During dry season, water flow is maintained by water amount running through turbines 20.99 m3ls. - Power house is 168 m far from the dam so impacts on the stream in this section is limited; - Inform downstream people on the regulation of reservoir.

6. PLAN FOR STRENGHTHENING OF CAPACITY FOR ENVIRONMENTAL MANAGEMENT During Project preparation phase

o Song Da Tay Nguyen company- Project owner has attended traning course by the WB for preparation of Project document, especially for preparation of EMP and public consultation.

- During Project construction phase o Song Da Tay Nguyen company as Project owner will send staff to participate WB training on Safeguard

8. PLlBLlC CONSULTATION

The following activities have been and will be carried out (from 2007 to 2008) by the Project owner for public consultation:

Activity 1: Site investigation

Activity 2: Meet and interview Project affected HHs and inform Project construction plan. Collect related information on preparation of EMP and Project resettlement pl in (RP).

Activity 3: Organize public consultation meeting to receive comments on EMP

- 02 public meetings has been carried out in Dak To Ver (7h January, 2008) and Ha Tay communes (85 January 2008) - Chu Pah district - Gia Lai province Long commune- Dam Rong district (Project location) in 2"4, August 2008.

- Participants of these meetings are consisted of representatives from:

Representatives of these two communes people committees; Representatives of social association such as Farther Front, staffs working with poverty alleviation program, Women Union etc.

- Agenda and content of public consultation meeting:

o Project owner informed and described about Ha Tay hydropower project;

o Project owner described about Project potential environmental impacts including both positive and negative impacts;

o Public consultation board and Project owner asked for comments from participants on Project potential environmental impacts and proposed EMP;

o Participants gave comments for the raised issues.

- Comments received from participants:

o Project bring a good benefits for local areas such as: upgrading roads so transportation and agricultural activities in this area will be more convenient

o Generate a clean energy amount to speed up rural electrification, agricultural activities; increase quality of life for local people;

o Local people will have more opportunities to extend their service such as providing food for workers;

o Reservoir will be used for fishery;

o During construction phase, Project will cause impact on the life of local people;

o Project will require land acquisitio~. Project owner should well implement compensation and support program for affected HHs;

o Impacts on air quality, noise, dust .. will last during 1.5 to 2 years. Project need to implement mitigation measures as proposed in EMP;

o Participants agreed on support for Project development and Project owner should closely work with local government and local people to manage environmental issues;

- All of comments were considered by the Project owner and they were integrated to this EMP.

Activity 4: Integration of comments from Activity 3 and revise EMP accordingly.

Activity 5: Disclosure of EMP and approval of EMP

- To address disclosure requirements of OP 4.01, Song Da Tay Nguyen joint Stock company as Project owner will:

Provide notices on Commune people committee office about the availability of these documents to inform to local peoples;

Provide contact person (telephone, address) to receive comments from interested peoples and parties;

English version of EMP and related doctiments will be sent to Vietnam Information Development Centre at 63 Ly Thai To in Hanoi, for access by NGOs and public.

English language copies of the EMP report will be sent to World Bank for publication on World Bank Info Shop.

Activity 6: Receive comments, feedbacks and modification of EMP, RAP accordingly.

- After disclosure of Project EMP, RAP documents in the above-specified place, Project owner will collect all comments (if there are) and consider and made a proper modification if it is required.

9. CONCLUSIONS

1. Ha Tay hydropower project in Chu Pah district- Gia Lai province is considered as category B Project by the WB - screening. By construction of the Project, 153.44 ha of land will be permanently acquired and 5.5. ha will be temporarily acquired. Four HHs living in the reservoir will be resettled. New resettled site is 500 m far in upper part of the previous living site. Resettlement Plan has been developed and will be implemented by the Project owner.

2. Environmental impacts that might cause by project are very limited. Main short term impacts include: noise, dust. water quality deterioration, soil erosion ... among them the dust can be a most serious problem in dry season at construction sites. But, construction sites are at least 4 km far from residential. area, so it will not cause significant impacts to local people. Water spray will be applied in construction site to limit dust impacts on workers.

3. Labour influx is also can be an important issues among the Project impacts. Camp sites are located far from residential area; Code of work conduct and HlVlAlDs information education program can mitigate this impact.

4. Loss of vegetation cover can be considered as a longer term impact. But only there is no natural forest land present in the Project site. Trees to be cut are rubber trees from Chu Pah rubber company. After completion of construction site, Project owner and contractor will be responsible for rehabilitation of the site and replant trees to reduce this impact.

5. EIA of the Project has been approved by in December 2007 by Gia Lai province People Committee. Public consultation meeting has been carried out on January 2008 at affected communes.

6. Ha Tay Project brings many positive impacts, contributes to the poverty alleviation of the area. So implementation of the Project should be supported by relevant agencies.
