EUREQUIREMENTS
1.4EUCouncilDirective2002/59/EC(VesselTrafficMonitoringDirective)requiresallshipscallingataportofaMemberStatetobefittedwithaVDR.ThisincludesshipsonUKdomesticvoyages.ShipsoperatingonlyincoastalwatersthatareclassifiedfordomesticpassengeshipsasECclassesB,CorD(seeTable3inAnnex1)maybeexempted.
2.)DOWNLOADANDPLAYBACKEQUIPMENT
AnamendmenttotheperformancestandardsforVDRsandSVDRswasadoptedon12May2006(IMOResolutionMSC.214(81)).Thisrequirestheequipmenttobefittedwithaninterfacecompatiblewithaninternationallyrecognisedformat,sothatstoreddatacanbedownloadedandplayedbackbyinvestigationgauthoritiesonaportablecomputer.
TheseadditionalrequirementsforinterfacingtoallowdownloadandplaybackapplytoallVDRandSVDRequipmentfittedonorafter1June2008
3.)EXEMPTIONS
3.1)ExemptionstoCarriageRequirements(existingvessels).
3.1.1)Regulation20.3ofSOLASChapterVstatesthat:Administrationsmayexemptships,otherthanroropassengerships,constructedbefore1July2002frombeingfittedwithaVDRwhereitcanbedemonstratedthatinterfacingaVDRwiththeexistingequipmentontheshipisunreasonableandimpracticable.Howevercargoshipsbuiltbefore1July2002mustfitVDRsorSVDRsaccordingtothetimetableinsection1above.
3.1.2)EUCouncilDirective1999/35/ECstatesthat:ForVDR'stobeplacedonboardroroferriesandhighspeedpassengercraftbuiltbeforeentryintoforceofthedirective,exemptionsforcompliancewithsomeoftherequirementsmaybegranted.
3.1.3)EUCouncilDirective2002/59/ECrequiresthatallshipscallingataportofaMemberStatearefittedwithaVoyageDataRecorder(VDR)..meetingtheperformancestandardsofIMOResolutionA.861(20).AndthatanyexemptionsgrantedtororoferriesorhighspeedpassengercraftunderArticle4(1)(d)ofCouncilDirective1999/35/ECof29April1999onasystemofmandatorysurveysforthesafeoperationofregularroroferryandhighspeedpassengercraftservicesshallterminateon5August2002.ThisDirectivecameintoforceinFebruary2004.
3.1.4)Undercurrentproposals,therewillbenoexemptionforearlyscrappingofroroandpassengervessels.
3.2)Exemptionstorequirementtointerfacetocertainitemsofequipment.
3.2.1)TherehavebeenrequestsforpartialexemptionsforretrofittedVDRs.Technically,itispossibletointerfacealmostanysensortotheVDRusingsomeformofadditionalinterfacebox.Howevercost,reliability,accuracy,degradationofsensoroutputandapprovalofsuchinterfacesmustbetakenintoconsideration.
3.2.2)InformationtobeinterfacedtoVDRsandSVDRs,itssourceandformataregivenintheAppendixfollowingthesenotes.Equipmenttobeinterfacedcanbedividedintonumberofcategories:

3.3)Navigationalequipment.
3.3.1)MostitemsofnavigationalequipmentwillalreadyhavethestandardIEC61162(NMEA0183)interfaceandsointerfacingwillbepossible.Forthosethathavesomeotherformofelectrical/electronicinterface,itshouldbepossibletointerfacetotheVDRviaaninterfacebox.
3.3.2)Inthecaseofapieceofnavigationalequipmenthavingnoelectronicinterface,itmaybenecessarytoreplacethatequipmentinordertoobtainaninterface.Otheroptionsmayinclude:
3.3.3)Atechnicalsolutionachievedbyobtainingasuitablesignalfromwithintheequipmentandconvertingthistothecorrectformat,withoutnullifyingtheequipment'sTypeApproval.
3.4)Communicationsaudio:Standardaudiointerfacesexistandareinusesointerfacing,possiblywiththeaidofanadditionalbufferamplifier/mixershouldnotpresentaproblem.
3.5)Bridgealarms,hullopening,watertightandfiredoorstatus.
3.5.1)Asdefinedintheperformancestandard,therequirementistorecordinformationdisplayedonthebridge.Bridgeindicatorsarelikelytohavesimpleon/offstatusrepresentedbyclosingcontactsorthepresence/absenceofavoltage.Technically,itwillnotbedifficulttoconvertsuchsignalstotherequiredIEC61162format.
3.6)RudderandEngine(includingthrusters)orderandresponse.
3.6.1)Thesesystemsmaybeengineeredinmanyways(somenotusingelectricityorelectronics)andoldersystemsaremostunlikelytohaveanyformofinterface.Newelectromechanicalsensorsmayneedtobeinstalledtosensemechanicalpositionsofcontrolsandtheoutputsfromthesesensorsconvertedtothecorrectformat.
3.6.2)Carewillisneededwhenrunningcablingfromtheseadditionalsensorstothebridge/locationoftheVDRtoavoidcausingadditionalproblems.
3.7)ApprovalofInterfaceBoxes.IEC61996requiresthatinterfaceboxesshouldmeettherequirementsofIEC60945.ThisstandarddealsonlywithenvironmentalandEMCissues.
4.)SYSTEMINSTALLATIONTEST
4.1)TheVDR,andpossiblytheinterfaceboxes,willbeTypeApprovedbuttoensurethecorrectfunctioningofaninstalledVDRsystem,anoverallinstallationtestorcheckwillberequired.Thiswillrequireeachofthesensorinputstobe'exercisedinturn,informationrecordedandtherecordinganalysedforaccuracy.Thereappeartobeanumberofoptionsforconductingtestingincluding:
4.1.1)Duringtheprovingofsensorequipmenttheresultswouldbeathoroughtestofthesystemfromsensortoreplayedoutput.
4.1.2)Afterallsensorequipmenthasbeenprovenasfarasthebridge,simulating,wherenecessary,inputstotheVDRwillrequirefacilitiestoinjectorsimulateinputs.
4.1.3)Duringfunctionaltestsofship'sequipmentbyasurveyorlesscomplexthanafullmethodicalcheckbutmightnotproveeverysensor

4.2)Surveyorcertificationisachievedthroughwitnessingaproving/demonstration(bytheprimecontractor/manufacturer/installer)ofallaspectsoftheVDRsystemtothesatisfactionofthesurveyor.
5.)AnnualPerformanceCheckandCertification.
5.1)Regulation18.8ofSOLASChapterVrequiresthat:
Thevoyagedatarecordersystem,includingallsensors,shallbesubjectedtoanannualperformancetest.Thetestshallbeconductedbyanapprovedtestingorservicingfacilitytoverifytheaccuracy,durationandrecoverabilityoftherecordeddata.Inaddition,testsandinspectionsshallbeconductedtodeterminetheserviceabilityofallprotectiveenclosuresanddevicesfittedtoaidlocation.Acopyofthecertificateofcomplianceissuedbythetestingfacility,statingthedateofcomplianceandtheapplicableperformancestandards,shallberetainedonboardtheship.
5.2)Ifinterpretedliterally,thiscouldrequireafullcheckoftheentiresystem(andsensors)whichwouldbeevenmorecomplicatedthantheSystemInstallationTest(4above).Thisisconsideredtooonerousforanannualcheck,theessenceofwhichisperceivedtobetoensuredataisrecordedandreplayedreliably.Thefollowingwouldbemoreappropriate:
5.3)Onboardinspectionofequipmenttoensurebatteries,enclosuresandlocationaidsareingoodconditionandoperational.Thisshouldbeundertakeninaccordancewiththemanufacturer'sinstructionsbysuitablyqualified/experiencedpersonnel.Successfulcompletionofthemaintenanceroutineshouldberecordedintheshipsonboardplannedmaintenancelog.
5.4)A12hourrecordingshouldcoveranoperationalperiodwhenthemajorityofsensorswillbeexercised.E.g.arrival,disembarkation,embarkationanddepartureofaroroferry.Downloadofthisrecordeddataorexchangeofrecordingmedium.Offlineanalysisofrecordeddatabythemanufacturerscertifiedrepresentativetoverifytheaccuracy,durationandrecoverabilityoftherecordeddata.Acertificateconfirmingthesatisfactoryresultsofthistestshouldberetainedonboard.
6.IMOGUIDELINESONVOYAGEDATARECORDERS(VDR)OWNERSHIPANDRECOVERY
1.)OwnershipofVDR/data:
Theshipownerwill,inallcircumstancesandatalltimes,owntheVDRanditsdata.however,intheeventofanaccidentthefollowingguidelineswouldapply.
2.)RecoveryofVDR:
RecoveryoftheVDRisconditionalontheaccessibilityoftheVDRorthedatacontainedtherein.
a.)Inthecaseofanoncatastrophicaccident,recoveryofthememoryshouldbestraightforward.Forexample,insomeVDRsitcanbeaccomplishedbyremovalofaharddiscfromtheVDRunit.Thisactionwillhavetobetakensoonaftertheaccidenttobestpreservetherelevantevidenceforusebyboththeinvestigator[1]andtheshipowner.Astheinvestigatorisveryunlikelytobeinapositiontoinstigatethisactionsoonenoughaftertheaccident,theownermustberesponsible,throughitsonboardstandingorders,forensuringthetimely

preservationofthisevidenceinthiscircumstance.
b.)Inthecaseofabandonmentofavesselduringanemergency,mastersshould,wheretimeandotherresponsibilitiespermit,recoverthememoryandremoveittoaplaceofsafetyandpreserveituntilitcanbepassedtotheinvestigator.
c.)Inthecaseofacatastrophicaccident,wheretheVDRisinaccessibleandthedatahasnotbeenretrievedpriortoabandonment,adecisionwillneedtobetakenbytheFlagStateincooperationwithanyothersubstantiallyinterestedStates[2]ontheviabilityandcostofrecoveringtheVDRbalancedagainstthepotentialuseoftheinformation.IfitisdecidedtorecovertheVDRtheinvestigatorshouldberesponsibleforcoordinatingitsrecovery.Thepossibilityofthecapsulehavingsustaineddamagemustbeconsideredandspecialistexpertisewillberequiredtoensurethebestchanceofrecoveringandpreservingtheevidence.Inadditiontheassistanceandcooperationoftheowners,insurersandthemanufacturersoftheVDRandthoseoftheprotectivecapsulemayberequired.
3.)CustodyofVDR/data:
Inallcircumstances,duringthecourseofaninvestigation,theinvestigatorshouldhavecustodyoftheoriginalVDRdata,perhapsintheformofthewholeorpart(s)oftheVDRitself,inthesamewayasifhehascustodyofotherrecordsorevidenceundertheCodefortheInvestigationofMarineCasualtiesandIncidents.
4.)ReadoutofVDR/data:
Inallcircumstancestheresponsibilitytoarrangedownloadingandreadoutofthedatafromtherecoveredmemoryinwhateverformshould,inthefirstinstance,beundertakenbytheinvestigatorwhoshouldkeeptheshipownerfullyinformed.Additionally,speciallyinthecaseofacatastrophicaccidentwherethememorymayhavesustaineddamage,theassistanceofspecialistexpertisemayberequiredtoensurethebestchanceofsuccess.
5.)Accesstothedata:
AlthoughtheinvestigatorwillhavecustodyoftheoriginalVDRmemoryinwhateverformforthedurationoftheinvestigation,acopyofthedatamustbeprovidedtotheshipowneratanearlystageinallcircumstances.Furtheraccesstothedatawillbegovernedbytheapplicabledomesticlegislationoftheflagstate,coastalstateandtheleadinvestigatingstateasappropriateandtheguidelinesgivenintheCodefortheInvestigationofMarineCasualtiesandIncidents.
1.TheterminvestigatorreferstotheMarineCasualtyInvestigatoroftheflagStateor,whereithasbeenagreed,underthetermsoftheCodeforInvestigationofMarineCasualtiesandIncidents,thatanotherStatewillleadtheinvestigation,theMarineCasualtyInvestigatorofthatState
