PROPOSED CONSENT CONDITIONS

Snells Beach / Algies WWTP Short and Long-term – Proposed Consent Conditions
Under section 108 of the RMA, these consents are subject to the following conditions:
General Conditions
These conditions apply to all resource consents:
a) Discharge permit (REG-67908) – To discharge contaminants to air associated with
the operation of the existing and new Snells Beach / Algies Bay Wastewater Treatment
Plant (“WWTP”); and
b) Discharge permit (REG-67909) – To discharge of treated wastewater to the Hauraki
Gulf, associated with the operation of the existing and new Snells Beach / Algies Bay
WWTP.
Location
The existing and new Snells Beach / Algies Bay WWTP Location: 120 Hamatana Road,
Snells Beach
Legal Description of Land: Lot 3 Deposited Plan 193583
The existing and new Snells Beach / Algies Bay WWTP Map Reference: At or about New
Zealand Transverse Mercator [2000] (“NZTM”) Map Reference 1754100E, 5967900N.
Discharge Point Location: Coastal Marine Area, Hauraki Gulf. Approximately 2 km south of
Martins Bay and approximately 420 m offshore from the MHWS.
Discharge Point - Map Reference: At or about NZTM Map Reference 1758374E, 5963000N.
Term of Consent
1. These consents shall expire 35 years from the date of commencement, unless it has lapsed,
surrendered or been cancelled at an earlier date pursuant to the Resource Management Act
1991.
2. Under section 125 of the RMA, the consent shall lapse five years after the date of its
commencement unless:
a. The consent is given effect to; or
b. The Council extends the period after which the consent will lapse.
PROPOSED CONSENT CONDITIONS
Activity in Accordance with Plans
3. The discharge activities shall be carried out in general accordance with the plans and
information submitted with the application, detailed below, and all material referenced by the
Council as consent number XX:
Application Form, and Assessment of Environmental Effects prepared by Mitchell
Partnerships Limited, dated 27 June 2016; or
Any subsequent plans or information that has received written approval from the
Manager.
4. In the event of any conflict between the document listed above and the conditions of this
consent, the conditions shall prevail.
5. The Consent Holder shall ensure that all staff and contractors undertaking works on site are
aware of, and adhere to, all conditions of this consent.
Works
6. Prior to the decommissioning of Storage Pond 2 of the existing Snells Beach / Algies Bay
WWTP, but no later than five years following the commencement of this consent, the
Consent Holder shall install, and have operational, a suitably sized membrane filtration plant
as part of the wastewater treatment system as is described in the Assessment of
Environmental Effects prepared by Mitchell Partnerships Limited, dated 27 June 2016.
7. Within one month of the installation of the membrane filtration plant required by Condition 6,
the Consent Holder shall notify the Manager in writing that the upgrade works are completed
and provide ‘as-built certification’ from a suitably qualified engineer that the membrane
filtration plant has been installed, and is operating, in accordance with industry standard.
8. Within five years of the commencement of this consent, the Consent Holder shall construct
and operate a new wastewater treatment system at the Snells Beach / Algies Bay WWTP
site.
9. Within one month of the completion of the new WWTP required in accordance with Condition
8, the Consent Holder shall notify the Manager, in writing, that the construction works are
completed and provide ‘as-built certification’ from a suitably qualified engineer that the new
WWTP has been installed, and is operating, in accordance with industry standard.
Standards - Short Term Discharges
10. Conditions 11 and 12 below apply to the continued operation of the existing Snells Beach /
Algies Bay WWTP, and shall apply until the new WWTP has been commissioned in
accordance with condition 8 above, but in any event for no longer than 5 years from
commencement of this consent (Short Term Standards):
a. Discharge volume from the wastewater treatment system to the coastal marine area
shall not exceed a maximum daily flow of 4,000 m3 per day;

b. The discharge of treated wastewater shall be tidally staged such that discharges shall
not occur between 2.5 and 0.5 hours before high and low water, except when pond
levels necessitate longer periods of discharge; and
c. The population serviced shall not exceed 4,400 PE.
11. Treated wastewater discharges from the existing Snells Beach / Algies Bay WWTP shall be
equal to or better than the limit specified for that parameter as set out in Table 1. Collection
of treated wastewater samples shall occur weekly and take place following treatment and
prior to discharge the rising main outfall pipeline.

12. Further to those parameters identified in Table 1, the Consent Holder shall also undertake
discharge quality monitoring prior to discharging to the rising main outfall pipeline for the
parameters identified in Table 2 below.

13. The Consent Holder shall ensure that all chemical analyses and sampling techniques are
carried out in accordance with the latest edition of “Standard Methods for the Examination
of Water and Wastewater”, APHA AWWA WEF, or other standards approved in writing by
the Manager.
PROPOSED CONSENT CONDITIONS
14. If no discharge is occurring on a scheduled sampling day, a sample shall be collected as
soon as reasonably practicable following resumption of normal operation.
Standards - Long Term Discharges
15. Conditions 16 and 17 below apply to the operation of the Snells Beach / Algies Bay WWTP
once it has been upgraded in accordance with condition 8 above (Long Term Standards):
a. Discharge volume from the wastewater treatment system to the coastal marine area
shall not exceed a maximum daily flow of 29,000 m3 per day; and
b. The population serviced by the new Snells Beach / Algies Bay Wastewater Treatment
System shall not exceed 30,000 PE.
16. Treated wastewater discharges from the new WWTP shall be equal to or better than the limit
specified for that parameter as set out in Table 3. Collection of treated wastewater samples
shall occur weekly and take place following UV treatment and prior to discharge to the rising
main outfall pipeline.

17. Further to those parameters identified in Table 3, the Consent Holder shall also undertake
discharge quality monitoring prior to discharging to the rising main outfall pipeline for the
parameters identified in Table 4 below.

18. The Consent Holder shall ensure that all chemical analyses and sampling techniques are
carried out in accordance with the latest edition of “Standard Methods for the Examination
of Water and Wastewater”, APHA AWWA WEF, or other standards approved in writing by
the Manager.
19. If no discharge is occurring on a scheduled sampling day, a sample shall be collected as
soon as reasonably practicable following resumption of normal operation.
General Standards - Short Term and Long Term Discharges
20. For the duration of this consent, the Consent Holder shall advise the Manager in writing
immediately in the event that problems are detected in association with the exercise of this
consent that could pose an environmental risk by affecting discharge quality and shall outline
a schedule of action to remedy issues.
21. The Consent Holder shall ensure that no new trade, industrial, non-domestic or other strong
wastes shall be permitted to be discharged into the existing or new WWTP except in
accordance with the Trade Waste Bylaw / Te Ture a Rohe Waiparui a Mahi 2013 or any
Operative Trade Waste By-law that may supersede this.
22. The Consent Holder shall ensure that for the duration of this consent, the wastewater
treatment system is maintained and operated by a suitably qualified and experienced
wastewater plant operator. This operator shall oversee the operation and management of
the wastewater treatment system and perform the operational and maintenance
responsibilities specified in the Environmental Management Plan (Condition 43).
23. At all times during the term of this consent, the Consent Holder shall maintain flow meters
to continuously measure the total daily inflow to the wastewater treatment plant and the total
daily volume discharged to rising main outfall pipeline prior to entering the coastal marine
area. The discharge volume meters must be maintained to ensure an accuracy of plus or
minus 5 percent.
24. The Consent Holder shall record daily inflow and discharge volumes from the meters
required by Condition 23. Records shall be kept of the volumes discharged to the rising
main outfall pipeline prior to entering the coastal marine area, the date and the wastewater
treatment plant inflow.
Monitoring - Short Term and Long Term Discharges (Surface Water)
25. The Consent Holder shall design a surface water monitoring programme for the coastal
marine area surrounding the outfall discharge point of the existing Snells Beach WWTP and
the new WWTP. The purpose of the surface water monitoring programme is to measure
water quality in the receiving and surrounding coastal environments to ascertain any
changes in water quality attributable to the discharges from the WWTPs and to confirm

predictions on effects. The programme shall be implemented within one month of the
commencement of this consent as follows:
a. The surface water monitoring programme shall, as a minimum, monitor the following
parameters:

b. The surface water monitoring programme shall include as a minimum:
i. The parameters which are being monitored (as identified in (a) above);
ii. The location, methodology and frequency of all surface water monitoring;
iii. The review and reporting methods; and
iv. A procedure for modifying the surface water monitoring programme.
Revisions to the surface water monitoring programme shall be to a standard acceptable to
the Manager and shall be submitted to the Manager for approval in a certifying capacity prior
to the proposed date of commencement.
26. The surface water monitoring programme shall form part of the Environmental Management
Plan required under Condition 43 below.
27. The Consent Holder shall undertake the activities in accordance with the surface water
monitoring programme developed in Condition 25.
PROPOSED CONSENT CONDITIONS
Monitoring - Short Term and Long Term Discharges (Shellfish)
28. The Consent Holder shall design a Shellfish Monitoring Programme for the coastal marine
area surrounding the outfall discharge point of the existing Snells Beach / Algies Bay WWTP
and the new WWTP. The programme shall be implemented within one month of the
commencement of this consent and, as a minimum, monitor shellfish at least annually at an
inshore site adjacent to the outfall for E.coli and viruses, at a site at Martins Bay as well as
one near Mahurangi Heads. The shellfish monitoring programme shall include as a
minimum:
i. The parameters which are being monitored;
ii. The location, methodology and frequency of all monitoring;
iii. The review and reporting methods; and
iv. A procedure for modifying the shellfish monitoring programme.
Revisions to the Shellfish Monitoring Programme shall be to a standard acceptable to the
Manager and shall be submitted to the Manager for approval in a certifying capacity prior to
the proposed date of commencement.
29. The shellfish monitoring programme shall form part of the Environmental Management Plan
required under Condition 43 below.
Monitoring Long Term Discharges (Benthic Habitats)
30. Within one month of the new WWTP becoming operational, the Consent Holder shall engage
a suitably qualified person to design and implement a Benthic Habitat Assessment
Programme to identify any changes in spatial habitats in order to provide a basis to assess
any changes in benthic communities in Martins Bay and surrounding the outfall which may
be attributable to the discharges from the new WWTP and to confirm predictions on effects.
The Benthic Habitat Assessment Programme shall, as a minimum, include:
a. Monitoring of:
i. Benthic ecology;
ii. Sediment texture;
iii. Sediment organic carbon content, including total nitrogen and total phosphorous
concentrations;
iv. Heavy metals; and
v. Macroalgal cover and extent.

b. Mapping of spatial habitat changes within the coastal marine area at the outfall
discharge location and the surrounding area from available aerial/satellite photos;
c. Review of any relevant benthic monitoring data from Auckland Council monitoring
programmes;
d. Consider reasons for any changes in spatial habitat and benthic communities and the
role of discharges from the new WWTP; and
e. Any other issue considered important by the Consent Holder.
31. The Benthic Habitat Assessment Programme shall be to a standard acceptable to the
Manager and shall be forwarded to the Manager by 30 September of each year that it is
required.
32. The Benthic Habitat Assessment Programme shall form part of the Environmental
Management Plan required under Condition 43 below.
Monitoring Long Term Discharges (Emerging Contaminants)
33. The Consent Holder shall engage a suitably qualified person to undertake an Emerging
Contaminants Risk Assessment of the treated wastewater from the new WWTP within one
month becoming operational and subsequently at five yearly intervals thereafter. The
Emerging Contaminants Risk Assessment shall as a minimum include:
a. A review of changes in the state of knowledge of emerging contaminants relevant to the
new WWTP either since the commencement of these consents or the previous
Emerging Contaminants Risk Assessment, whichever is more recent.
b. Consideration of whether additional samples are required for the purposes of the
Emerging Contaminants Risk Assessment.
c. Measurement of emerging contaminants if determined necessary and the results of any
samples collected.
d. An assessment of the risks to the environment from emerging contaminants in the
treated wastewater discharged from the new WWTP.
The Emerging Contaminants Risk Assessment shall be to a standard acceptable to the
Manager and shall be forwarded to the Manager by 30 September of each year that it is
required.
34. The Emerging Contaminants Risk Assessment shall form part of the Environmental
Management Plan required under Condition 43 below.
PROPOSED CONSENT CONDITIONS
Monitoring - Short Term and Long Term Discharges (Air Quality)
35. The Consent Holder shall ensure that all processes on site are operated, maintained,
supervised, monitored and controlled to ensure that emissions to air authorised by this
consent are maintained at the minimum practicable level.
36. No noxious, offensive or objectionable (in the opinion of an enforcement officer) dust and/or
odours shall be caused by discharges from the activities authorised by this consent beyond
the boundary of the site.
37. No hazardous air contamination, caused by discharges from activities authorised by this
consent, which causes, or is likely to cause, an adverse effect to human health, the
environment or property, shall occur beyond the boundary of the site.
38. All sludge removal from the storage ponds and subsequent de-watering and disposal shall
be carried out in a manner that minimises odour to the extent practicable.
39. The Consent Holder shall prepare and maintain an Odour Management Plan, as part of the
Environmental Management Plan, to describe measures to control and reduce the potential
for odour generation to occur, which could give rise to off-site effects. The Odour
Management Plan shall as a minimum include the following:
a. Locations of odour treatment equipment;
b. Monitoring requirements for odour treatment equipment, e.g. moisture content and
pH for biofilter media and pressure drop across biofilter media;
c. Frequency and location of odour monitoring; and
d. Alert / Response Level.
The Odour Management Plan shall be to a standard acceptable to the Manager and shall
be submitted to the Manager for approval in a technical certification capacity within six
months from the date of commencement of this consent.
40. Within one month of commissioning the new WWTP in accordance with condition 8, the
Consent Holder shall provide an updated Odour Management Plan for the new WWTP to
the Manager for approval in a technical certification capacity
41. Once approved in accordance with Condition 39, the Odour Management Plan shall be
implemented as soon as the Consent Holder receives the Manager’s approval of the Odour
Management Plan.
42. The Odour Management Plan shall form part of the Environmental Management Plan
required under Condition 43 below.
PROPOSED CONSENT CONDITIONS
Short and Long Term Discharges (Environmental Management Plan)
43. The Consent Holder shall prepare an Environmental Management Plan, the purpose of
which is to integrate operational practices, environmental monitoring programmes and
reporting of results required by the conditions of these consents. The Environmental
Management Plan shall as a minimum include the following matters:
Inspection and Maintenance
a. The Inspection and Maintenance section shall outline the practices and procedures
with respect to inspection and maintenance to be adopted to ensure compliance with
conditions of this consent and shall as a minimum address the following:
i. Inspection and maintenance programme, including schedules and logs,
designed to verify the correct functioning of the whole wastewater treatment
and discharge system;
ii. Identification of staff and/or contractor responsibilities; and
iii. Quality control procedures.
Treated Wastewater and Receiving Environment Monitoring and Reporting
b. The Monitoring and Reporting section shall outline the practices and procedures with
respect to monitoring and reporting to be adopted to demonstrate compliance with the
conditions of these consents and shall as a minimum address the following:
i. Measurement of wastewater to enable the ongoing efficiency of the treatment
plant to be assessed including but not limited to the following aspects:
a. The performance of the treatment plant with respect to reducing a
range of determinands, specifically including the measurement of
the parameters in Table 1 and 2, as required by Conditions 11 and
12, and Table 3 and 4, as required by Conditions 16 and 17, in the
final treated wastewater; and
b. Dissolved oxygen levels in the aerated lagoon.
ii. Enable the potential environmental effects of the discharge on the receiving
environment to be assessed, including, but not limited to the following:
a. Surface monitoring programmes, including sampling locations and
monitoring parameters, as required by Condition 25 of these
consents;
b. Shellfish monitoring programme by Condition 28;
c. Benthic Habitats Assessment Programme required by Condition 30;

d. Emerging Contaminant Risk Assessment required by Condition 33;
e. The Odour Management Plan required by Condition 39 of these
consents; and
f. Other aspects of the existing and new Snells Beach / Algies Bay
WWTP that have the potential to create adverse environmental
effects, including noise.
iii. The Monitoring and Reporting section shall outline the practices and procedures
with respect to monitoring and reporting to be adopted to demonstrate on-going
compliance with the conditions of this consent and shall as a minimum address
the following:
a. Location and type of monitoring equipment;
b. Maintenance and calibration of monitoring equipment;
c. Schedule and log of monitoring requirements; and
d. Encompass field collection methodologies, protocols, data
recording procedures and standards, and record keeping.
Viral Monitoring Plan
c. Within one month of the new WWTP becoming operational in accordance with
condition 8, the Consent Holder shall prepare a Viral Monitoring Plan (VMP)
detailing a programme of regular checks of viral removal through the WWTP to
monitor the treatment plant performance. The VMP shall include procedures to
measure viral removal through the treatment plant process and how this may then
be converted to process monitoring of the UV dose. The viral reduction targets
shall be 4 log reduction (based on FRNA-Bacteriophage indicator virus) shall be
achieved for initially for dry and wet weather flows. When informed by the Auckland
Regional Public Health Service of any suspected outbreak of communicable
disease in the community that could adversely affect the recreationally targeted
shellfish / kaimoana via the discharge from the WWTP, the Consent Holder shall
respond by monitoring viral reduction through the WWTP as per the VMP and the
results from the monitoring shall be made available to the public and the Regional
Public Health as soon as practicable.
Within one month of the five year anniversary of the commencement of the VMP,
and every five years thereafter as required, the Consent Holder shall undertake a
review of the VMP to determine the appropriateness of the continuation of the viral
monitoring at the new WWTP. The review shall, as a minimum, evaluate the
effectiveness of virus removal from the treated wastewater samples collected over
the previous five years. Where it is shown that the new WWTP is achieving a high
level of virus removal, i.e. consistently greater than 4 log removal, the Consent
Holder may formally request that any further viral monitoring requirements cease.
Any such request shall be submitted in writing to the Manager for approval and the

viral monitoring requirements shall not cease until such approval is received. The
Manager shall provide approval if it is satisfied that the Consent Holder has
demonstrated that the new WWTP is continuously achieving greater than 4 log
removal and can demonstrate that it can continue to do so for the duration of the
consent as wastewater flows increase.
Responding to Complaints
d. The Responding to Complaints section shall outline the practices and procedures
for responding to any complaints received as required under Condition 50 of these
consents.
Contingency and Incident Management
e. The Contingency and Incident Management section shall outline the practices and
procedures to be adopted with respect to contingency and incident response
planning in order to avoid non-compliance with conditions of the consent.
The Environmental Management Plan shall be to a standard acceptable to the Manager.
44. The Environmental Management Plan shall be submitted to the Manager for approval in a
certifying capacity within six months of the consents commencing except for those parts
approved under Conditions 25, 30, 33, 28 and 39 which shall be submitted in accordance
with the timeframes required by those conditions.
45. The Consent Holder shall undertake the requirements of the Environmental Management
Plan once it has been finalised. All subsequent significant updates to the Environmental
Management Plan throughout the term of this consent shall be submitted to the Manager for
approval in a certifying capacity.
46. Any amendments to the Environmental Management Plan shall be approved by the Manager
prior to implementation.
Reporting Conditions
47. An Annual Performance Report shall be submitted to the Manager by September 30 of each
year. The report shall:
i. Collate, analyse and interpret all relevant data and information pertaining to this
consent for the previous year from 1 July to 30 June;
ii. Include comment on general plant performance and any trends in changes in the
discharge volume and/or the discharge quality standards over time;
ii. Include a consideration of compliance with each consent condition; and
iii. Identify any actions required and submit a timetable to rectify any non-compliance.
PROPOSED CONSENT CONDITIONS
48. The Consent Holder shall engage a suitably qualified person to assess the surface water
quality monitoring undertaken as part of these consent conditions by 30 September of the
fifth anniversary of the commencement of this consent and subsequently at five yearly
intervals thereafter. This assessment shall as a minimum:
i. Report on any trends in the concentration of parameters measured;
ii. In combination with the results of coastal water quality monitoring undertaken by
Auckland Council, assess whether there is any evidence for nutrients sourced from
new WWTP could breakthrough to coastal marine area surrounding the outfall
approximately 2 km south of Martins Bay, in sufficient quantities to cause deterioration
of coastal water quality; and
iii. Review recorded concentrations in treated wastewater and from the monitoring
undertaken in accordance with Condition 25 and assess whether the WWTP is
operating efficiently and effectively.
This assessment shall be to a standard acceptable to the Manager and shall be forwarded
to the Manager by 30 September of each year that it is required.
Complaints Record
49. All complaints received by the Consent Holder about the discharges shall be logged
immediately. The information shall include:
a. The date, time, location and nature of the complaint;
b. Name, phone number and address of the complainant unless the complainant wishes
to remain anonymous;
c. Action taken to remedy the problem;
d. Any equipment failure and remedial action taken;
e. The weather conditions at the time of the complaint including estimates of wind
direction, wind strength, temperature and cloud cover; and
f. The date and name of the person making the entry.
50. Details of any complaints received that affect the Consent Holder's ability to comply with the
conditions of consent shall be provided to the Auckland Council within 24 hours of receipt of
the complaint(s) or on the next working day. All other complaints shall be provided in the
Annual Report required by Condition 47.
Review
51. The conditions of this consent may be reviewed by the Manager pursuant to section 128 of
the Resource Management Act 1991 (RMA), by giving notice pursuant to section 129, on

the fifth anniversary of the commencement of these consents and subsequently at intervals
of not less than five years thereafter in order to:
a. To deal with any significant adverse effects on the environment arising from the exercise
of the consent, which was not foreseen at the time the application was considered and
which is appropriate to deal with at the time of review; and / or,
b. To consider the adequacy of conditions that prevent nuisance and adverse effects
beyond the boundary of the site particularly if regular or frequent complaints have been
received and validates by a Council enforcement officer; and / or
To consider developments in technology and management practices that would enable
practical reductions in the discharge of contaminants
c. To alter the monitoring requirements, including requiring further monitoring, or
increasing or reducing the frequency of monitoring.
Charges and Access
52. This consent (or any part thereof) shall not commence until such time as the following
charges, which are owing at the time the Council's decision is notified have been paid in full:
a. All fixed charges relating to the receiving, processing and granting of this resource
consent under section 36(1) of the RMA; and
b. All additional charges imposed under section 36 of the RMA to enable the Council
to recover its actual and reasonable costs in respect of this application.
c. All initial consent compliance monitoring charges, plus any further monitoring
charges to recover the actual and reasonable costs incurred to ensure compliance
with the conditions attached to this consent.
Advice Note: The initial monitoring deposit is to cover the cost of inspecting the site,
carrying out tests, reviewing conditions, updating files, etc., all being work
to ensure compliance with the resource consent. In order to recover actual
and reasonable costs, monitoring of conditions, in excess of those covered
by the deposit, shall be charged at the relevant hourly rate applicable at the
time. The consent holder will be advised of the further monitoring charge.
Only after all conditions of the resource consent have been met, will the
council issue a letter confirming compliance on request of the consent
holder.
53. The servants or agents of the Council shall be permitted to have access to the relevant parts
of the property at all reasonable times for the purpose of carrying out monitoring procedures,
inspections, surveys, investigations, tests, measurements or take samples while adhering
to the Consent Holder's health and safety policies.
PROPOSED CONSENT CONDITIONS
Advice notes
1. A copy of the consent and these conditions should be held at the Snells Beach / Algies Bay
Wastewater Treatment Plant site.
2. Compliance with the consent conditions will be monitored by the Council In accordance with
section 35(d) of the RMA. This will typically include site visits to verify compliance (or non-
compliance) and documentation (site notes and photographs) of the activity established
under the consents. In order to recover actual and reasonable costs, Inspections will be
charged at the relevant hourly rate applicable at the time.
3. The Consent Holder Is advised that the discharge limits in this consent have been agreed
to enable the plant to continue to operate in the short term, but they do not necessarily
represent levels appropriate for the receiving environment in the longer term.
4. The Consent Holder Is advised that, the Council may at any time undertake source emission
testing and/or any other monitoring to ensure compliance with the conditions of this consent.
The Consent Holder Is advised that they will be required to pay for the costs of this
monitoring.
