SMOKE FREE ENVIRONMENT SPECTATOR HOUSE POLICY
PURPOSE The Smoke-Free Environment Act 2000 (The Act), which commenced on 6 September 2000 aims to “reduce exposure to tobacco and other smoke in enclosed public spaces”. New amendments to the Act have extended the prohibition on smoking in enclosed public places as from 7 January 2013, and this policy has been updated to reflect these changes. This policy forms part of ATC’s work health and safety commitment to ensuring a safe workplace for all, and with compliance with the Smoke-Free Environment Act 2000. SCOPE This policy applies to all premises, and other venues owned, controlled or occupied by ATC (ATC premises), and to all ATC officers, management, and other employees, contractors, racing industry participants, visitors, and patrons and guests. POLICY Smoking is not permitted; § within buildings (including grandstand viewing decks) § within 4 metres of any entrance / exit to buildings § within Betting Rings or Bookmaker Arenas § within 10 metres Children’s Playgrounds § at Taxi Ranks and Bus Stops
DEFINITIONS Enclosed public place - enclosed, in relation to public places means having a ceiling or roof and, except for doors and passageways, completely or substantially enclosed, whether permanent or temporarily.
Outdoor public place – means a public place that is not an enclosed public place.
Commercial outdoor dining area – means an outdoor public place that is: a. a seated dining area; or b. within 4 metres of a seated dining area on premises that are licensed premises under
the Liquor Act 2007 or the premises of a restaurant as defined in that Act; or c. within 10 metres of a place at a food fair where food is sole or supplied for consumption
at the event, with a food fair being an organised event at which the principal activities are the sale or supply of food for consumption at the event and the consumption of that food.
