3 Fifth Set of Requests for Production of Documents.

5 UNENUMERATED REQUEST FOR PRODUCTION:

6 Notice is hereby given pursuant to Rule 26(a)(1)(A)(iv) of the Federal

7 Rules of Civil Procedure. Plaintiff request [sic] that the Defendant, or the attorney

advising the Defendant produce the following documents. Please produce the

documents to the Plaintiff at CTF/State Prison, P.O. Box 705, Soledad, California

93960-0705. Or at such place as all parties shall hereafter agree [sic]. ,

11 Initial disclosures in general except as otherwise provided by stipulation or

12 court order. [sic] Require each party disclose to other parties certain information

13 regarding witnesses, documents, damage computations, and liability insurance

14 without awaiting a discovery request Fed.R.Civ.P 26(a)(1).

15 Furthermore, any liability insurance policy that may be used to satisfy a

16 potential judgment must be made available for inspection and copying as part of

17 the insured party's [Defendant's] initial disclosures pursuant to Federal Rules of

18 Civil Procedure 26(a)(1)(A)(iv).

19 Moreover, such liability insurance-policies, including all exhibits, addenda,

20 and the declaration page, must be made available for inspection and copying by

21 Plaintiffs without the necessity of a formal discovery request.

22 RESPONSE TO UNENUMERATED REQUEST FOR PRODUCTION:

23 Objections: Defendant objects to this Request because it is vague and

24 ambiguous' as to what document is being sought for production. Defendant also

25 objects to this Request because the vague and ambiguous nature of this Request is

26 complicated by the compound nature of the Request as a result of Plaintiffs failure

27 to identify by number and delineate the document request accordingly. Further, this

28 Request is overbroad because it is not reasonably limited to the subject matter or

1 time period pertinent to this lawsuit. Accordingly, this Request is not reasonably

2 calculated to lead to the discovery of admissible evidence nor related to the subject

3 matter of this lawsuit. This Request is also compound and, much of which, does not

4 contain a request for production, but is argumentative because it purports to argue

5 Plaintiff's interpretation of the law, i.e., Federal Rule of Civil Procedure 26.

9 Objections: Defendant objects to this Request because it is overbroad in its

to scope of subject matter because it seeks the identification of individuals who have

11 no personal knowledge of Plaintiff s floor sleeping claim, as there were multiple

12 shifts for each day during this time period, most of which are not pertinent to

13 Plaintiff s floor sleeping claim (i.e., presumably, in the evenings). Accordingly,

14 this Request is not reasonably calculated to lead to the discovery of admissible

15 evidence. Finally, this Request is duplicative of a previous discovery request

16 propounded by Plaintiff, specifically, Plaintiffs Request for Production, Set Two.

23 largest jail systems in the world. There are multiple jail facilities within the

24 LACJ system. With the exception of Men's Central Jail, no other jail facility

25 gives rise to Plaintiffs claims in this lawsuit. Accordingly, Defendant objects to

26 this Request on the grounds that it is not reasonably calculated to lead to the

27 discovery of admissible evidence. This Request is overbroad because it seeks

6 only retained for several years.

7 allegations in Plaintiffs operative pleading. In addition, this Request is

8 overbroad as to the scope of subject matter, since Plaintiffs operative pleading

9 only asserts claims regarding floorsleeping and unsanitary conditions. As a

10 result, the Request improperly seeks information that is not reasonably calculated

11 to lead to the discovery of admissible evidence and is burdensome and

12 oppressive. Additionally, nearly every activity undertaken by the Los Angeles

13 County Sheriff s Department ("LASD") in operating the Los Angeles County Jail

14 system involves the supervision of inmates. Therefore, this Request is overbroad

15 and burdensome because it would require the production of virtually every LASD

16 policy regarding the the Los Angeles County Jail system.
