Post Graduate level has established the Faculty of Law to promote profound scholarship and enlightened
research in law. SGT University felt the need to establish this Law Faculty to provide highest quality

in this brochure.

RULES OF THE COMPETITION
1. Title SGT University National Moot Court Competition, 2015 (hereinafter referred to as SGTU-NMCC -
th thshall be held from 13 to 16 March, 2015 at SGT University, Gurgaon, Delhi-NCR.
2. LanguageThe language of the Competition shall be English.
3. Eligibility Criteria
3.1 Students of 5 year integrated law degree programme studying in Colleges/Universities, approved by the Bar Council of India, are eligible to participate in the SGTU-NMCC.
3.2 Only one team from a particular College /University can participate in the SGTU-NMCC.
3.3 Only those members designated as Speakers will be permitted to put forth oral arguments in the Competition.
4. Registration
4.1 The participating team shall duly fill the Registration Form provided along with the official rules and send it along with a participation fee of Rs. 3,000/- (Rupees three thousand only) on or before
th5 February, 2015. The Registration fee shall be sent through Demand Draft drawn in favour of "Shree Guru Gobind Singh Tricentenary University" payable at New Delhi.
4.2 The filled-in Registration Form and the DD are to be sent to the following address thby 5 February, 2015:

4.3 Scanned copies of the filled in Registration forms along with the scanned copy of the Demand th

4.4 Only first 24 teams will be considered for participating in SGTUN-MCC on 'first come first served' basis. Next 4 teams will be kept in the waiting list & participating teams will be confirmed of their
thparticipation by an e-mail on 10 February, 2015.In case the team is not selected for participation in the SGTU-NMCC the DD will be sent back to the address provided.

4.1 The participants are required to submit two passport-size photographs of each member of the team along with the
registration form.
th 4.2 Each team shall be allotted a Team Code along with the confirmation email on 10 February, 2015.
4.3 The teams shall submit their written submissions by the Team Code allotted to them and NOT by the name of their
institution.
5. Written Submissions/ Memorial
5.1 All participating teams shall submit 4 sets of written memorials for each side (4 for petitioners & 4 for respondents)
5.2 The cover page of memorials for the petitioner shall be in blue and of the respondent shall be in red.
5.3 The teams shall not indicate their names or the names of their college or the university on memorials. For all
communication purposes, only the Team Code shall be specified.
5.4 The Team Code allotted to all teams (communicated by e-mail) shall be indicated at top right corner of the
memorial.
5.5 All participating teams must submit soft copies of their memorials in PDF format, for both sides by 11:59 P.M., IST
thon 5 March 2015 by e-mailing the same to [email protected] The organizers on receiving the soft copy
of the memorial reserves the right to reject the participation of the team if it is of the opinion that the memorial
is of very low standard.
th5.6 Teams must also get the hard copies of the memorials (4 sets for the petitioner and 4 sets for respondent) on 13
March 2015.
5.7 The written memorials shall conform to the set standards:
5.8 Teams have to prepare memorials for both the sides.
5.9 All Memorials must be in English, and must be printed single side on A4 size sheets, withequal margins of 1'' on all
sides.
5.10 The text font should be Times New Roman, size 12 for the main body, and Times NewRoman, size 10 for the
footnotes.
5.11 The main body must be in 1.5 line spacing. The footnotes may be in single line spacing.
5.12 Each Memorial shall not exceed 35 pages in all. Arguments shall not exceed 25 pages.

5.13 The Memorial must contain all and only, the following parts:
1) Cover page; 2) Table of Contents; 3) Table of Abbreviations; 4) Index of Authorities;5)Statement of Jurisdiction; 6) Statement of Facts; 7) Issues Raised; 8) Summary of Arguments; 9) Arguments Advanced/ Pleadings; 10) Prayer.
th 5.14 Blue Book mode of citation (19 Edition) must be followed.
5.15 Each page must have a margin of at least an inch on all sides.
6. Evaluation Criteria for Written Submission:
Every memorial will be marked on scale of 100 and will be evaluated according to the following criteria:
7. Preliminary Rounds
7.1 There shall be two preliminary rounds on 14th March, 2015 and every team shall be given the opportunity to
argue for each side.
7.2 The Lots for the Preliminary rounds will be drawn on 13th March 2015, after the inauguration of the Moot
Court Competition.
7.3 The Petitioner shall be allotted a total of 15 minutes to speak, including any rebuttals. The Respondent shall
be allotted fifteen 15 minutes for rebuttal and arguments. Any extension of time beyond the specified period
shall be subject to the discretion of the judges.
7.4 The division of time between the speakers is the discretion of the team members, subject to a maximum of 8
minutes for one speaker.
7.5 Before the commencement of each round, each team shall indicate to the 'court officer' as to how they wish
to allocate their time.

7.1 At the end of the preliminary rounds, the top 8 teams will qualify for the Quarter Finals. The top 8 teams will be selected on the basis of number of rounds won.
7.2 A team shall be credited with a win, if its total marks in the respective session are higher than those of its opponent team.
7.3 In the case of a tie, combined total marks of both the preliminary rounds shall be considered. The team with the higher score will advance to the Quarter Finals. If the situation of the tie still persists, then it would be resolved by considering the memorial scores.
8. Quarter Finals
8.1 The Quarter Finals will be a ranking round. The top 4 teams, with the highest total scores in these oral rounds shall qualify for the semi-final rounds.
8.2 The side to be represented by a team shall be determined by way of draw of lots with the teams picking the lots after the completion of the preliminary rounds.
8.3 Each team shall get a total time of 20 minutes to present their case and this shall include the time for 'rebuttal' and 'Sur-rebuttal'. Any extension of time beyond the specified period shall be subject to the discretion of the judges

9. Semi-Finals
9.1 The Semi-Finals will be held on 15th March, 2015. The Semi-Finals will be a ranking round. The top 2 teams, with the highest total scores in oral rounds shall qualify for the final rounds.
9.2 The side to be presented by the team shall be determined by way of draw of lots with the teams picking the lots after the completion of quarter-finals rounds.
9.3 Each team shall get a total of 25 minutes to present their case. This time will include the time for 'rebuttal' and 'Sur-rebuttal'. Any extension of time beyond the specified period shall be subject to the discretion of the judges
9.4 The division of time between the speakers in the discretion of the team members, subject to a maximum of 12 minutes for one speaker.
9.5 Before the commencement of the round, each team shall indicate to the 'court officer' as to how they wish to allocate their time.
10. Finals
10.1 The Final will be held after the Semi-Finals on 15th March, 2015. A team will be credited with a win in the Final if the total marks are higher than those of its opponent team.
10.2 Each team shall get a total of 30 minutes to present their case. This time will include the time for 'rebuttal' and 'Sur-rebuttal'.
10.3 The division of time between the speakers is the discretion of the team members, subject to a maximum of 15 minutes for one speaker.
10.4 Before the commencement of the round, each team shall indicate to the 'court officer' as to how they wish to allocate their time.

11. Dress Code:
Participants are required to strictly adhere to the following dress code during the competition. Failure will result indisqualification
Ladies: White shirt, black trousers/skirts, black tie, black coat, and black shoes.
Gentlemen: White Shirt, black trousers, black tie along with black coat and black shoes.

15. Decision of The Judges Shall Be Final:
The decision of the judges with regard to the outcome of the rounds shall be final.
16. Accommodation:
Accommodation has been arranged for all teams by the Organizers from 12:00 noon, March 13, 2015 to 10:00 a.m , March 17, 2015. Participants requiring accommodation are required to indicate the same in the space provided in the Travel Details and Request for Accommodation form.

1. Dashmesh Educational and Charitable Trust is a registered Trust having its registered office at Gurgaon, Haryana. The Trust runs a charitable Hospital and Research Institute in the name of SGT Hospital and Research Institute in Gurgaon, Haryana. The SGT Hospital and Research Institute conducted a study on the impact of “junk food” on the health of children, the future leaders of this country. Some of the relevant portions of the study conducted by SGT Hospital and Research Institute are as follows:
A. Childhood obesity is one of the most serious public health challenges of the 21st century. Overweight children are likely to become obese adults. As per WHO, about 44% of the diabetes burden and 23% of the CVD burden is attributable to overweight and obesity. Overweight children are more likely than non-overweight children to develop insulin resistance, hyper-insulinemia, diabetes and cardiovascular disease at a younger age, which in turn are associated with a higher chance of premature death and disability.
B. WHO reports that Non-Communicable Diseases are the leading cause of death world-wide:
Unhealthy diets especially the excessive consumption of calories, salt, saturated fat and sugar cause at least 40% of all deaths from NCDs and approximately one quarter of all deaths globally;
Over 80% of global deaths due to cardio vascular diseases and diabetes occur in low and middle income countries. NCDs also kill at a younger age in these countries where 29% of NCD deaths occur among people under the age of 60 compared to 13% in high income countries;
In India, as of 2008, about 53% of all deaths were due to NCDs. The disease burden of NCDs is expected to reach to 57% by 2020 as compared to 29% in 1990.
C. Studies conducted by many agencies have established the link between consumption of HFSS food and obesity. Numerous studies done
among school children of Delhi, Mumbai, Kolkata, Chennai, Gurgaon, Amritsar and some cities of Southern India show that the prevalence of overweight/obesity is high and on the rise. In urban post-pubertal children of Delhi it increased from 16% in 2002 to about 24% in 2006. It is high among the affluent class and children of private schools compared to low and middle income groups.
2. Deeply concerned about the results as revealed by the above study, the Chairperson of the Trust Mr. Man Mohan Singh Chawla filed a PIL in the Hon'ble Supreme Court of India praying that the Hon'ble Supreme Court may be pleased:
A. To immediately ban junk food & carbonated drinks in schools.
B. To initiate measures to discourage the availability of “fast food”, unhygienic food and foods with unhealthy ingredients within 500 yards of the school.
C. To further direct respondents to develop a comprehensive school canteen policy, which emphasizes healthy nutrition among school going children

3. The Supreme Court of India admitted the Petition. On the Admission of his PIL, Mr. Chawla addressed the media, wherein he stated that “On one hand, children are taught in the classroom about good nutrition and the value of a healthy lifestyle, on the other hand we continue to make junk food available to them. Our children's eating habits are engrained in them from a young age, so what are we teaching our children? At what cost is it ok for junk food to be available to them at school?
4. When you have a sumptuous junk meal rich in oil you feel drowsy and fail to concentrate. Over sustained periods of junk food eating, blood circulation drops due to fat accumulation. Lack of vital oxygen, nutrients and proteins particularly can stale your grey

(brain) cells temporarily.
5. It is the right time we change the way kids eat in schools. Banning junk food and carbonated drinks in Schools will set new standards for healthy foods that will make our kids feel better, grow better and learn better and it will improve the nutrition quality of school meals and remove junk food from schools.
6. Hence, this PIL is about making sure our children have nutritious school lunches and breakfasts every day.”
7. He also pointed out that similar petitions are filed and pending in different High Courts.
8. A perusal of the writ petition would reveal that the issue raised is of sale of, what is popularly known as “junk food” in the canteens of the schools, resulting in not only child obesity, but even other critical disorders and diseases. It is highlighted in the writ petition that various States in the United States of America have already banned junk food sale in schools until at least after lunch. There is a reference to a decision in England where fast food take away joints near schools were declared unlawful. A reference is also made to the Tenth Conference of Central Council of Health and Family Welfare, held on January 30, 2009, expressing concern on the increasing consumption of junk food by school children.
9. The Union of India filed the Affidavit wherein it accepted, in principle, that there is need to ban the junk food in Schools. Union of India also informed the Court that Food Safety and Standard Authority of India, a statutory Authority constituted under the Food Safety and Standards Act was looking into the matter to decide whether guidelines needed to be framed for making available healthy food in school canteens as also what efforts need to be made to promote healthy eating habits amongst children and to discourage the consumption of junk food.
10. 1. The Retailers Association of India, 2. The All India Food Processors Association and 3. The National Restaurants Association of India, filed applications before the Hon'ble Supreme Court requesting the Court to implead them as interested parties as any decision of the Court in the instant matter would affect their right to carry on trade/business. Counsel appearing for the above three respondents argued that there is no term such as 'junk food' and “the Food Safety and Standards Act, 2006 as per the definition of “food” in Section 3(j) does not draw any distinction between different kind of foods and that this Court
has carved out a category of food called 'junk food' and hence has violated the statutory scheme of the Act which has been opined by the Supreme Court in the decision dated October 03, 2013 in CA No.965-69/2008 Hindustan Coca Cola Beverages Pvt. Ltd. Vs. Santosh Mittal & Ors. and the decision dated October 22, 2013 in W.P.(C) No.681/2004 Centre for Public Interest Litigation Vs. UOI & Ors.”
11. Students of Swiss Cottage School, Gurgaon approached the Supreme Court to be made party to the court proceeding on the Dashmesh Educational Charitable Trust's plea for ban on sale of junk food and aerated drinks in and around schools.

May it please Your Lordship,
First of all we beg your indulgence for breaking legal protocols and coming here today. We however plead with Your Lordship, that we are doing so, solely moved by the fact that the matter that this Honourable Court is deciding today is not only of vital importance to us as children and citizens of tomorrow, but also to the health of the Nation and the cost to the National Exchequer when this vast population will be stricken by lifestyle diseases tomorrow. And when that would happen we would have failed, because as children we had not raised our voice today when we could and should have done.
We therefore beg Your Lordship's indulgence again. We most humbly submit:
A. That we know that obesity among our peers is increasing day by day.
B. That since obesity and what follows thereafter, like inability to do physical exercises, sports, lethargy to study are killers of children's future, because of the uncontrolled consumption of junk food and beverages made available to the kids, something drastic needs to be done to save us, children.
C. That everyone knows that the immediate cause of obesity lies in the use of Mono Sodium Gluconate (MSG) in the junk foods. Hundreds of studies have been made in various parts of the world and published in scientific journals

directly linking serious lifestyle disorders and nervous ailments with the use of MSG by young victims.
D. That research on this issue has been done worldwide and very clear instances of loss of IQ and other learning disabilities have been found largely among children consuming junk food.
E. That the most harmful effect that is identified among the junk food using children, is a strong addiction to such food leading the user into the pit of dependence and slow death.
F. That we understand that the food production and distribution is a legitimate economic activity and is a fundamental Constitutional right of the promoter to be allowed to do it.
G. That we genuinely would like to place before this Honourable Court our big and serious unanswered question, “does the fundamental right of an individual or a group to engage in economic activity, also endows him with a right to harm others with his product directly or indirect ly? ” “Does the State have a Constitutional obligation to defend the weaker sections of its citizens like the children, who are not grown up enough to make their own proper choices of good food, for lack of adequate information and guidance?”
H. That the protection of the Rights of Children as enshrined in the Charter of Rights declared by the United Nations and was adopted by India, especially Article 24, are being constantly violated and that we take the liberty to place before this Honourable Court Article 24 of the Charter of Rights of Children:
a. Article 24: State/ Parties recognize the right of the child to the enjoyment of the highest attainable standard of health and to facilities for the treatment of illness and rehabilitation of health. States/ Parties shall strive to ensure that no child is deprived of his or her right of access to such health care services.
b. S tates/ Par t ies sh a l l p u rsu e fu l l implementation of this right and, in particular, shall take appropriate measures:
To combat disease and malnutrition, including within the framework of primary
health care, through, inter alia, the application of readily available technology and through the provision of adequate nutritious foods and clean drinking-water, taking into consideration the dangers and risks of environmental pollution;
To ensure that all segments of society, in particular parents and children, are informed, have access to education and are supported in the use of basic knowledge of child health and nutrition, the advantages o f b r e a s t f e e d i n g , h y g i e n e a n d environmental sanitation and the prevention of accidents;
To develop preventive health care, guidance for parents and family planning education and services.
States/ Parties shall take all effective and appropriate measures with a view to abolishing traditional practices prejudicial to the health of children.
I. That the students are fully aware that this is a war between the rich food processing companies and the State that wants their revenue on the one side and the Right of the kids who are the future of India, to live healthy lives and the Right they have for protection from predatory practices by the food companies.
J. That the State is ignoring the fact that the harm done to the health of the children today will only end up in obesity and other lifestyle diseases which will cost to the Nation many times more than the revenue that the State is earning from the peddlers of death in the name of junk which is also called 'Junk Food'. It is not right for our Nation to be dictated by profit and revenue generation alone which happens in some western countries who follow an unmitigated capitalist model and where the State cannot intervene with pro-active policies.
K. That under the Constitution of India, Art. 15 (3) the State can make special provision for the protection of children and that the same should also be invoked to introduce such legislation or issue orders by the Honourable High Court

L. The students are determined to take up cudgels for themselves since adults, the food processing industry and the State are sitting pretty and present their

petition to this Honourable Court personally today, requesting the Honourable Court for the favour of being made a party in the matter of the case of junk food in the schools, and /or issue instructions for protection of their rights by:
A. Broadly determining what is junk food, especially of the packaged type or served as fast food in large numbers and traditionally alien to Indian food habits.
B. Create a ban list in the order of harmful effects through a study carried out by unbiased professionals where children are a party, within a given time frame of 90 days.
C. Ban such evidently harmful foods and beverages from the canteens of the Schools or from the immediate neighborhoods of Schools.
D. Stop food companies from enticing kids by giving out toys or other such attractions that increase addiction in children for the usage of junk foods and beverages.
E. Mandate the printing of bold labels stating the existence of harmful ingredients, as decided by the experts committee, specially chemicals that although approved in some western counties as food preservatives and taste enhancers are addictive in nature and have been found to be directly linked with diseases primarily in young victims.
