History

• Decisions were taken at the United Nations Conference on the Human Environment held in Stockholm, 1972, in which India participated, to take appropriate steps for the preservation of the natural resources of the earth.

Water(Prevention and Control of Pollution) Act, 1974

Purpose of the Act

An Act to provide

for the prevention and control of water pollution and the maintaining or restoring of wholesomeness of water, for the establishment, with a view to carrying out the purposes aforesaid, of Boards for

the prevention and control of water pollution,

for conferring on and assigning to such Boards Powers and functions relating thereto and for matters connected therewith

Water(Prevention and Control of Pollution) Act, 1974 "pollution" means such contamination of water or such alteration of the physical, chemical or biological properties of water or such discharge of any sewage or trade effluent or of any other liquid, gaseous or solid substance into water (whether directly or indirectly) as may, or is likely to, create a nuisance or render such water harmful or injurious to public health or safety, or to domestic, commercial, industrial, agricultural or other legitimate uses, or to the life and health of animals or plants or of aquatic organisers

State Board Functions • to plan a comprehensive programme for the prevention,

control or abatement of pollution of streams and wells in the State and to secure the execution thereof;

Section 24-PROHIBITION ON USE OF STREAM OR WELL FOR DISPOSAL OF POLLUTING MATTER

• No person shall knowingly cause or permit any poisonous, noxious or polluting matter determined in accordance with such standards to enter (whether directly or indirectly) into any 5[stream or well or sewer or on land]; or to impede the proper flow of the water of the stream leading

or likely to lead to a substantial aggravation of pollution

Section 25- Restrictions on new outlets and discharges

No person shall, without the previous consent of the State Board,-- (a) establish or take any steps to establish any industry, operation or process, or any treatment and disposal system or an extension or addition thereto, which is likely to discharge sewage or trade effluent into a stream or well or sewer or on land (such discharge being hereafter in this section referred to as discharge of sewage); or (b) bring into use any new or altered outlets for the discharge of sewage; or (c) begin to make any new discharge of sewage

• An application for consent of the State Board under sub-section (1) shall be made in such form, contain such particulars and shall be accompanied by such fees as may be prescribed.

• (3) The State Board may make such inquiry as it may deem fit in respect of the application for consent referred to in sub-section (1) and in making any such inquiry shall follow such procedure as may be prescribed.

• [(4) The State Board may -- • (a) grant its consent referred to in sub-section (1), subject

to such conditions as it may impose, being-- • (i) in cases referred to in clauses (a) and (b) of sub-section

(1) of section 25, conditions as to the point of discharge of sewage or as to the use of that outlet or any other outlet for discharge of sewage;

46 Publication of name of offenders

If any persons convicted of an offence under this Act commits a like offence afterwards, it hall be lawful for the court before which the second or subsequent conviction takes place to cause the offender’s name and place of residence, the offence and the penalty to be published at the offender’s expense in the newspaper

47(1) Offence by companies Every person who at the time the offence was committed was in charge of the conduct of the business of the company as well as the company shall be liable to proceeded against and punished accordingly

Responsibility of waste generators-Rule 8

• (1) The waste generator shall.- (a) take steps to minimize generation of plastic waste and segregate plastic waste at source in accordance with the Solid Waste Management Rules, 2000 or as amended from time to time.

• (b) not litter the plastic waste and ensure segregated storage of waste at source and handover segregated waste to urban local body or gram panchayat or agencies appointed by them or registered waste pickers’, registered recyclers or waste collection agencies;

Construction and Demolition Waste Management Rule 2016

• Waste generators who generate more than 20 tons or more in one day or 300 tons per project in a month shall segregate the waste into four streams such as concrete, soil, steel, wood and plastics, bricks and mortar

• Waste generators as above shall have to pay for the processing and disposal of construction and demolition waste generated by them

• The service providers shall prepare within six months from the date of notification of these rules, a comprehensive waste management plan
