1.17 ServicePackagea. AnyoftheOneTimeRegistrationFeesarenon-refundableuponcancellationorterminationofthecontract,regardlessofremainingsubscriptionperiod.b. Unlessotherspecifiedbyus,ViewQwestFibreBroadbandBundlewillbeprovidedtosubscriberfor24months,andthereafterthemonthlysubscriptionasselectedinthisapplicationformwill

continueautomaticallyuponsubscriptionexpiry.ViewQwestisnotliableforthesubscriptionamountuponsubscriptionexpiryshouldsubscriberchoosenottore-contractafter21monthsintothecontract.

c. Contractperiodwillcommenceupondateofserviceactivation.d. Subscribersmayupgradetheirservicebefore21stmonthofthecontractperiod,onlytoaplanwithahighermonthlysubscriptionfee.Subscribersarenotallowedtodowngradetheirservice

duringthecontractperiod.Oncetheupgradeisapprovedandprocessed,theoriginalcontractperiodwillendandreset.Anyremainingbillrebate,freesubscriptionsoranyotherfreebieswillbeforfeitedandreplacedbythoseofferedwiththenewcontract.Thenewcontractperiodwillcommencefromthedateofserviceactivationoftheupgradedserviceforanother24months.

e. Subscribersmayre-contracttheirserviceafter21stmonthofthecontractperiod,toaplanofasameorhighermonthlysubscriptionfee.Oncethere-contractisapprovedandprocessed,theoriginalfibrebroadbandcontractperiodwillendandreset.Thenewcontractperiodwillcommencefromthedateofserviceactivationoftheupgradedserviceforanother24months.

Terminationofanyservicehastobesentintocs@viewqwest.com.Anyverbalinstructionshallnotbehonoured.h. Fromtimetotimethepremiummaybeoutofstockonthedayofinstallationoftheservice.Insuchcases,ViewQwestundertakestoobtaintheitemandprovideittothesubscriberwithina

reasonabletime.Serviceprovisionandbillingwillbeunaffectedbythisdelay.i. ViewQwestwillnotbeliableforanydamagesincludinglossofprofits,revenue,businessandanticipatedsavingsforanyserviceinterruptedduetoreasonsbeyondViewQwest’scontrolbutnot

limitedtoanyeventofforcemajeure.j. ViewQwestwillnotberesponsiblefortheperformanceofthesubscriber’swirelessconnectionspeed.Thewirelessconnectionissubjectedtoenvironmentalfactorswithinthehome,which

includebutnotlimitedtowalls,electronicdevices,pillarsandmirror.Wirelessconnectionmayfluctuateduetothefactorsmentionedabove,whicharenotwithinViewQwest’scontrol.ViewQwestshallnotbeliableforanylossordamageduetosuchfluctuation.Subscriberissolelyresponsibleforprovidingnecessaryequipmentathisorherowncosttoextendwirelesscoverageshouldtheneedarise.

1.18 NetLinkTrustandViewQwestServiceInstallationa. ShouldtherebeissueswiththeFibreTerminationPoint,ViewQwestundertakestoliaisewithNetLinkTrusttoresolvetheissuesbutisnotresponsibleandaccountableforanydelayindelivery

ofViewQwestserviceasaresultoftheissues.b. ShouldtheissuepertainingtoFibreTerminationPointpersistsmorethan15daysfromthedaytheissueisreported,customercanchoosetocancelViewQwestservicewithnopenaltyfee.c. ShouldcustomerchoosetocancelViewQwestserviceuponsuccessfulNetLinkTrustactivationandpriortoViewQwestinstallation,heorsheshallbeliabletopayforthetotalmonthly

subscriptionsfortheremainingcontractandthecostpriceofallthefreepromotionalitemsgiventothecustomer.d. ViewQwestpaysNetlinkTrustupfrontfortheFTPinstallationandthesubscribercommitstoreimburseViewQwestthroughthe“FibreTerminationPointinstallation–Monthlyinstallmentplan”,

ifselectedinsteadoftheone-timepayment.Intheeventthatthesubscriberterminatesorrecontractorupgradetheirsubscriptionbeforetheendofthiscontract,theremainingchargesshallapply.

e. IfnoonsiteinstallationisconfirmedpriortoNetLinkTrustactivation,ViewQwestonsiteserviceinstallationdatemustbebookedwithin30daysoftheNetLinkTrustactivationdate.FailuretoconfirmontheonsiteinstallationdatewillsubjectsubscribertothemiscellaneouschargeasstatedinTable1(b).

f. Ifinstallationhasbeenselected,subscriberorauthorizedrepresentativehastobepresentduringthescheduledinstallationappointmentdateandtimeattheserviceinstallationaddress.FailuretobeavailableonthedateofViewQwestonsiteinstallationappointmentwillresultinsubscriberbeingsubjectedtothemiscellaneouschargestatedinTable1(b).

g. ThereisnoNetLinkTrustinstallationonSundays.h. TopostponeViewQwestonsiteinstallation,subscriberwillhavetonotifyViewQwest5workingdaysinadvanceoftheconfirmedViewQwestonsiteinstallationappointmentdate.Subscriberis

allowedtopostponetheonsiteinstallationdate,aslongasitiswithin30daysoftheinitialonsiteinstallationappointmentdate.Postponingofonsiteinstallationformorethan30daysoftheinitialonsiteinstallationdateissubjectedtomanagement’sapproval.Shouldthepostponementbeapproved,itwillbeatthediscretionofViewQwesttochargethesubscriberthemonthlysubscriptionfortheuninstalledperiod.

i. CancellationofconfirmedViewQwestonsiteinstallationappointmentafterNetLinkTrustactivationdatewillsubjectsubscribertothemiscellaneouschargeasstatedinTable1(b).j. Shouldtherebeanyadditionalinstallationormaterialrequired,itwillbeatthediscretionofthesubscriberandarenotreimbursablebyViewQwest.k. SubscriberistoprovideViewQwestauthorisedpersonnelwithassistance,co-operation,facilitiesandenvironmentalconditionsforinstallationofViewQwestservice.Suchfacilitiesincludebut

notlimitedtohousingofequipment,secureandconstantelectricalsupply,back-upelectricalsupplyandelectricalnecessitiesneededtoenabletheinstallationandactivationofViewQwestservice.

l. TheOpticalNetworkUnit(ONU)akaModemisunderwarrantyfortheentiredurationofthesubscription.Incaseofloss,defects,damage,misuse,actsofGod,accidentorunauthorisedalteration/repair,replacementoftheONUwillbechargeableat$267.50.



m. ViewQwestreservestherighttoreplaceanyhardware,withanequivalentintermsofperformance,withoutpriornoticetothesubscriber.n. ViewQwestwillnotberesponsibleforrouterspurchasedfromthirdpartiesnorexistingon-premisecablingrelatedtotheprovisionofViewQwestservices.o. Intheeventthatasubscriberoptstouseanexistingrouterthatissupported,ViewQwestundertakestoinstallitfreeofcharge,ifit’spartofthebroadbandbundle.Iftherouterisnota

supportedmodel,ViewQwestundertakestoinstallitonabest-effortbasisandwillchargeafeeuponsuccessfulinstallation.AsuccessfulinstallationisdefinedastheavailabilityofInternetaccessviatherouter’sEthernetport(s)aswellasinternetaccessviaWi-Fi™(ifavailableontherouter).

p. ViewQwestinstallationanddeliveryarenotavailableduringSingaporePublicHolidays.q. Self-installationofequipmentfor1GbpsFibreBroadbandBundlesign-up:

i. AfterNetLinkTrustactivationdate,relevantequipmentwillonlybedeliveredtocustomer’sserviceaddressforself-installation.Onsiteinstallation(i.e.ViewQwestengineerwillbesenttopremisetoassistwithinstallation)ischargeableat$80pertripforweekdays(9amto6pm),$120forweekdays(6pmto8pm)andSaturday(9amto6pm).

ii. Shouldtherebeanyhigh-lossissue(indicatedbyaredalarmlight),customersaretocallintoinformViewQwest.ViewQwestwillthenarrangeforanonsitevisittocheckontheissue.Therewillnotbeanyonsiteinstallationchargeshoulditbegenuinehighlossissue.

iii. Ifequipmentisfaultyupondelivery,ViewQwestwillarrangetoreplacetheequipment.Arrangementtoreplacetheequipmentwillnotbechargeableshoulditbeagenuinefaultyequipment.Otherwise,adeliveryfeeof$50willbeimposedtothecustomer.

iv. ViewQwestwillchargeatechnicalonsitecasefeeof$150ifanonsiteisscheduledbythesubscriberforrectificationofissuesthatarenotsupportedbyViewQwest.v. Customerswillhavetoreceivetheequipmentwithin5workingdaysafterthelastdeliveryattemptbycourierservice.Failuretoreceivetheitemswithin5workingdaysafterlastdelivery

vi. DPEXistheofficialcourierserviceofViewQwestforthedeliveryoftheitems.Shouldyouhaveanyenquiriesregardingthedeliveryofyouritem,[email protected]+6567818888.

vii. TrackingIDwillbeavailableforyourinformationafteryouritemisreceivedbyDPEX.viii. Monthlypaymentof$69.90forFibernet™1GbpsFreedomASUSAXMeshPlaniseffectiveforthe24monthuponserviceactivation.Customerswillbebilled$69.90/mthforFibernet™1GbpsFreedomASUSAXMeshPlanafterthestipulatedcontractterm,unlessthiscontractisreplacedbyanewserviceuponre-contract,orbyanewserviceofgreatervalueifthecontractdurationis lessthan22months.

o. Monthlypaymentof$79.90forFibernet™2GbpsFreedomASUSAXMeshPlaniseffectiveforthe24monthuponserviceactivation.Customerswillbebilled$79.90/mthforFibernet™2GbpsFreedomASUSAXMeshPlanafterthestipulatedcontractterm,unlessthiscontractisreplacedbyanewserviceuponre-contract,orbyanewserviceofgreatervalueifthecontractdurationis lessthan22months.

p. BillingforMonthlyPaymentPlanswillbedonemonthlyandinadvanceforsubscriberwhooptedforthemonthlypaymentplan.ThesubscriberherebyagreestopayViewQwestforallcharges incurredontheirmonthlyinvoice.Allchargesarecalculatedandbilledasperlistedhere(validasatthetimesigningthisform).

q. Subscriberisrequiredtochecktheinvoicessenttotheregisteredemailperiodically.However,issuanceofinvoiceisnotcompulsoryforsubscribertomakepaymenttoViewQwest.r. Billsaretobesettledfullwithin7netdaysfromthebilldate,asstatedintheinvoice.Failuretodosowillresultinsuspensionorterminationofserviceregisteredunderthesubscriber’saccount,

untilfullpaymentismade.s. SubscriberisresponsibleforverifyingtheaccuracyofthebillandinformingViewQwestofanydiscrepancywithin7netdaysfromthebilldate,failingwhichsubscriberwillbedeemedtohave

acceptedthebillascorrectlyrenderedandfinal.t. Ifthereisanydisputeinthefeesstatedinthebill,subscribermustinformViewQwest’sbillingdepartmentinwritingwithin7netdaysfrombilldate.Uponacknowledgingthedispute,

ViewQwestwillinvestigatethedisputeandprovidearesponsetothesubscriberassoonaspossible,andthedecisionwillbeconclusiveandbindinguponthesubscriber.IfthedisputeisresolvedinfavourofViewQwest,subscriberisliabletopaythedisputedamountimmediately.

u. Subscriberisresponsibleforverifyingtheaccuracyofthepayment.PaymentisdonethroughdeductionofsubscriptionfromthesubmittedCreditorDebitCard,orsuchothermodeofpaymentasmaybemadeavailablebyViewQwestfromtimetotime.

1.20 ServiceSuspensionandTerminationa. ServiceSuspension

i. Serviceregisteredunderthesubscribermaybesuspendedduetonon-paymentorrequestbythecustomer.ii. Ifsubscriberfailstosettle2billsconsecutively,anemailwillbesenttothesubscriberasareminderforthemissedpayment.iii. SubscribermayrequesttoextendtheduedateorpayonalaterdateasreviewedandapprovedbyViewQwestonacasetocasebasis.iv. Ifsubscriberfailstosettlethetotalamountwithin3daysfromthedateofemailorfailstopayonthelaterdate,ViewQwestwillcontactthesubscribertoinformaboutthesuspension.v. Ifthereisnoresponsebythesubscriber,theserviceregisteredunderthesubscriber’saccountwillbesuspendedwithoutpriornotice.vi. Ifnopaymentismadewithin14daysafterthesuspension,theserviceregisteredunderthesubscriberwillbeterminatedwithnopriornoticeandsubscribershallnothaveobjectiontothe

termination.ViewQwestmightundertakenecessarylegalactionagainstthesubscribertorecovertheamountduebythesubscriber.vii. TheserviceregisteredunderthesubscriberwillbefullyrestoredonlyaftersubscriberhaspaidfullythetotalamountowingtoViewQwest.viii. Subscribermaychoosetosuspendtheservicefornomorethansixmonthswithinthecontractterm,afterwhichthemonthlysubscriptionplanchargeswillresumeaspernormal.ix. Therewillbearecurringchargeof$16.05(afterGST)permonthtothemonthlybillduringtherequestedsuspensionperiod.x. Theremainingcontracttermwillbeextendedbythenumberofmonthstheservicewassuspended.xi. b. ServiceTerminationi. Serviceregisteredunderthesubscribermaybeterminatedwithnopriornoticeduetonon-payment,duetonoticefromsubscribertoterminatetheservicewithViewQwestoranyother

reasonsasaresultofsubscriber’snegligencefortheimproperuseoftheservice.ii. Shouldtherebeanyremainingfreemonthsofsubscriptioninthecaseofearlytermination,subscriberwillnotbeentitledtothosemonthsandisliabletoreimburseViewQwestforthe

totalmonthlysubscriptions.iii. Areactivationchargeof$79.25mustbepaidinadvanceshouldtheservicesberequiredagain.iv. SubscriberwhowishestoterminatetheserviceshallinformViewQwest’sCustomerService7daysinadvanceoftermination.Theterminationwillbedonewithin3to5workingdaysupon

returnofallhardwareorequipmentprovided(ONU,PatchCableandPowerAdaptor)ingoodworkingorderandconditiontoViewQwest’sMainshowroom,failingwhichViewQwestmayinitsoptiondeemtheservice(andanyplansthereof)tobecontinuingatthefullstipulatedcharges.

v. Subscriberwhowishestoterminatetheservicebeforethe24thmonthwillbeliableforthetotalmonthlysubscriptionsfortheremainingmonthsandterminationpenaltiesifapplicable.vi. Subscribershallreturnallleasedhardwareorequipment(ONU,PatchCableandPowerAdaptor)ingoodworkingorderandconditiontoViewQwest,failingwhich,theequipmentwillbe

consideredlostandthesubscribershallbeliabletopaytheapplicablechargesasstatedherein.vii. IntheeventsubscriberterminatestheFibreBroadbandServiceregisteredunderthesubscriber,allValueAddedServicesexceptTrendMicroHomeNetworkSecurityshallalso
