MINI Maintenance Programs - 2003 Models

Maintenance Programs are a benefit designedto help reduce the cost of scheduled and un-scheduled maintenance.

MINI Cooper and MINI Cooper S passengercars purchased from any Authorized MINI Dealerin the United States are covered by Full Mainte-nance for 36 months or 36,000 miles, which-ever occurs first. Coverage begins on the dateof first retail sale or the date the vehicle is firstplaced in service as a demonstrator or com-pany vehicle, whichever is earlier.

Any authorized MINI Dealer in the United Stateswill perform the scheduled or additional mainte-nance services on your vehicle at no expenseto you. The maintenance schedule intervals arebased on normal driving conditions and opera-tion. Should you request more frequentmaintenance service, the cost of theseservices will not be covered by the Main-tenance Program.

Coverage

Full Maintenance covers all factory recom-mended maintenance, as determined by theservice interval indicator. Additional items thatneed replacement due to normal wear and tear,and that are not covered by the original MININew Passenger Car Limited Warranty - such asbrake pads, brake rotors, and wiper blades - areincluded, provided wear and tear exceeds MINIspecifications. Any adjustments required dueto normal operating conditions are also in-cluded. See pages 6-9 of this statement foradditional information.

Maintenance Intervals

Time intervals should be followed using themaintenance interval as indicated by the MINIService Interval Indicator on the check controlpanel in the dashboard.

This MINI Service and Warranty Information State-ment should be presented to your MINI Dealerwhen maintenance is required. Your MINI Dealerwill stamp this book documenting the servicesor maintenance performed.

Exclusions from coverage

– Items reimbursable under your MINI NewPassenger Car Limited Warranty.

– Gasoline and gasoline additive.– Windshield washer additive (except when in

conjunction with scheduled maintenance).– Tires, wheel alignment, tire balance and ro-

tation.– Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, doorpanels and all chrome trim.

– Damage detected when performing the rustperforation inspection.

– Damage which results from negligence, im-proper operation of the vehicle, wear andtear or deterioration due to driving habits orconditions, improper repair, environmental in-fluences, flood, accident or fire damage, roadsalt corrosion, alteration, installation of non-MINI accessories, or use of improper, poorquality or contaminated fuel.

– Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined.

– Maintenance or repair after the vehicle isdeemed a total loss.

– Maintenance or repairs performed by otherthan an Authorized MINI Dealer within theUnited States.

– Vehicles used in competitive events.– Oil changes performed outside the recom-

mended maintenance intervals as indicatedby the Service Interval Indicator.

Upgrades

Note: For those vehicles covered by FullMaintenance for 36 months/36,000 miles,MINI offers the possibility to upgrade toFull Maintenance for 48 months/50,000miles. This upgrade can be purchasedthrough your authorized MINI Dealer dur-ing the first 36 months or 36,000 miles ofownership, whichever occurs first. See yourdealer for details. Maintenance System

The MINI Maintenance System has been de-vised with the following objectives: to maximizevehicle safety, reliability, and resale value by mini-mizing breakdowns resulting from wear, and mini-mizing cost and inconvenience by computingmaintenance intervals based upon the specificmanner in which each individual vehicle is driven.

Maintenance intervals on motor vehicles have con-ventionally been specified based upon accumu-lated mileage. However, the type of driving condi-tions has a major influence on routine mainte-nance requirements; distance traveled is only oneof the significant factors. A vehicle driven for 50,000miles of short trips in the city with numerous coldstarts, prolonged periods of idling, stop-and-go driv-ing, and high engine speeds during accelerationrequires more frequent maintenance intervals thana vehicle driven for 50,000 miles for long distancesat low engine speeds primarily at operating tem-perature.

MINI’s service interval indicator which computesthe actual optimum maintenance requirements isbased not only upon the accumulated mileage,but takes into account important factors such asengine coolant temperatures, high or low enginespeeds, short or long trip driving, and number ofvehicle starts. The maintenance interval may there-fore be maximized with considerable savings toowners of vehicles subjected to light duty.

The service interval indicator consists of amileage reading, and the inscriptions “OIL SER-VICE” and “INSPECTION”.

Whenever the ignition is switched on, the dis-play shows the next scheduled type of serviceand the remaining distance until the serviceshould be performed. The distance is based onyour driving style.

If the maintenance interval has been exceeded,a “—” symbol reminds you of the urgent needfor servicing. In the interests of road safety andreliability, you should avoid driving your MINIwhen the “—” symbol is showing, and havethe essential maintenance work performed with-out delay.

After each maintenance is performed the serviceindicator is reset in order to compute the nextservice interval.

If the service interval indicator displays an illogicalreading, or if there is no display, consult an autho-rized MINI Dealer.

If the speedometer, tachometer or coolant tem-perature gauge should develop a fault, the serviceinterval indicator will probably cease to operate cor-rectly as well, since it depends on correct speed,distance and temperature readings. The fault mustbe located and rectified by an authorized MINIDealer.

A detailed list of all maintenance operations in-cluded in each of the elements of the MINI Main-tenance System is found on pages 5-14. Theseelements are as follows:

Quality Certification I will be performed by yourselling dealer and certified on the following page.

The performance of certain subsequent mainte-nance elements, as required by the MINI NewPassenger Car Limited Warranty, will be speci-fied at intervals computed by the MINI serviceinterval indicator as follows:

– Oil Service: Engine oil changed with theengine at operating temperature. Note:change oil at least once per year. Your MINI isfactory-equipped with a newly-developedsynthetic engine oil. At the time of the printingof this booklet MINI High-Performance Syn-thetic 5W-30 Oil (Part Number 07 51 0 143829) and Mobil 1 5W-30 and 5W-40 oils arestrongly recommended and approved by theMINI Division of BMW of North America, LLCfor the Cooper and Cooper S models. TheMINI Division is evaluating various syntheticoils for inclusion in our list of recommendedmotor oils.

For the most current list of synthetic oils, pleasecontact your authorized MINI Dealer, or callthe MINI Division at 1-866-ASK-MINI (275-6464).

If you need to add oil between oil changesand are unable to obtain MINI High Perfor-mance Synthetic Oil, Mobil 1 or anotherspecial oil on the list, use a synthetic oil withan API rating of SJ or higher.

– Inspection I: Major vehicle maintenance asspecified in the following pages under In-spection I.

– Inspection II: Additional major vehicle main-tenance as specified in the following pagesunder Inspection II.

The following maintenance elements must beperformed at the mileage/time stated (time inter-vals begin from the vehicle’s production date):

– Brake Fluid Service: Change brake fluid ev-ery two years.

– Engine Coolant Service: Change cool-ant every four years.

– Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced every 100,000miles to maximize vehicle fuel economy andminimize exhaust pollution. The replace-ment of the oxygen sensor is required underthe terms of the applicable MINI emissionsystem warranties.

– Spark Plug Service: Replace spark plugsevery 100,000 miles. Your MINI is equippedwith platinum-tipped spark plugs. These allowa longer service life than conventional sparkplugs.

For your convenience, you may also wish to haveyour MINI Dealer perform any necessary opera-tions to fulfill any state inspection requirements inyour area concurrent with the maintenance ele-ments specified above during other repairs.

Make sure that confirmation of maintenance workis always entered in this Service and WarrantyInformation Statement. You may need this forany warranty claims that become necessary, andlater on as evidence that your car has been giventhe correct and regular maintenance that justi-fies its resale or trade-in value.

The most modern technological advances notonly have been applied to the design and pro-duction of your vehicle, but also to computing ofthe optimum maintenance interval for your typeof operations and driving style. Your MINI Dealerhas made a substantial investment in uniqueMINI special service tools to enable its MINI factorytrained service technicians to perform quality re-pairs on your MINI in minimal time. Your MINIDealer looks forward to serving your every ser-vice need and to help maximize your satisfactionwith your MINI, its longevity, and resale value.

Unscheduled Maintenance

Only use fuels advertised to have adequate de-tergency and low alcohol content. Use of fuelswith insufficient detergent and/or excess alcoholcan cause driveability problems that necessi-tate cleaning intake valves and fuel injectionvalves, and, when applicable, adjusting the en-gine idle. We suggest having this work per-formed by your authorized MINI Dealer, perhapswhile regular maintenance is performed. YourMINI Dealer can also recommend a gasolineadditive that will provide sufficient detergency.While this recommended unscheduled mainte-nance is not required in order to maintain theemission warranty, cleaning of intake valves or,when applicable, fuel injection valves, or adjust-ment of engine idle, necessitated by use of in-appropriate fuel, is not covered by warranty be-cause no defect in material or workmanship orcomponent failure is involved.

Undercarriage

Check transmission for leaks. • •Half-shafts: Check for leaks at flexible boots. • •Visually check fuel tank, lines and connections for leaks. • •Check condition, position, and mounting of exhaust system. Examine for leaks. • •

Check power steering system for leaks. Check power steering fluid level; add fluid if necessary. • •Check steering for absence of play, condition of suspension track rods, front axle joints, steering linkage and joint disc. • •Check overall thickness of front and rear disc brake pads using special tool. If replacement is necessary: Examine brake disc surfaces.Clean brake pad contact points in calipers. Grease wheel centering hubs. Check thickness of parking brake linings only when replacing • •rear brake pads.Check brake system connections and lines for leaks, damage and incorrect positioning. • •

Check parking brake actuation. Adjust if necessary. • •

Check all tire pressures (including spare if equipped). Correct if necessary. Check condition of tires (outer surface [left/right]),tread wear and pattern; in case of uneven tread wear, readjust wheel alignment if requested (invoice separately). • •Inspect entire body according to terms of rust performation limited warranty. (Must be performed at least every two years). • •

Engine Compartment

Read out diagnostic system. • •Check engine cooling system/heater hose connections for leaks. Check coolant level and antifreeze protection level.Add coolant if required. • •Check windshield washer fluid level and antifreeze protection. Check battery state-of-charge indicator and charge if required. • •

Check lighting system, i.e.: headlights, foglights, parking, back-up, license plate, interior,glove box, flashlight, illuminated makeup mirrors, luggage compartment/area lights. • •

Check turn signals, hazard warning flashers, brake lights, horn, headlight dimmer and flasher switch. • •

Check wipers and washer systems; wiper blades, washer jet positions. • •

Visually examine all SRS airbag units for torn covers, obvious damage or attachment of decals, decorations or accessories. • •

Check central locking system. • •

If your car is driven only for short distances ofless than 10 miles over a prolonged period oftime, without an occasional drive at highwayspeeds, the engine’s charging system will notmaintain the battery. Insufficient use of the ve-hicle could result in short-term starting problemsand in the long-term could damage the battery.

In case the car is not operated for more thanfour weeks it is advisable to:

a) consider using a proper trickle charger, fol-lowing the charger manufacturer’s instruc-tions, to maintain the battery’s state of charge;or

b) consult your MINI Dealer regarding batteryremoval. Once removed, the battery must becharged and stored in a cool, dry place whereit can be protected from freezing. If the bat-tery will be stored for over 3 months, it mustbe recharged every 3 months, or else it willbecome damaged and useless.

Please consult with your MINI Dealer for furtherguidance and information.

Extensive corrosion protection measures nowmake it possible to offer a six-year limited anti-corrosion warranty against rust perforation onyour vehicle provided that the vehicle is main-tained in accordance with the provisions of theMINI New Passenger Car Limited Warranty asoutlined in the Warranty Section of this State-ment (page 30).

The major degree of corrosion protection is dueto the electrophoretic dip painting process whichcathodically deposits paint particles on all bodyparts, attracting paint particles into the minutestcavities or seams. Body parts are designed toprovide optimum corrosion protection.

During manufacture, exterior body parts receivean additional corrosion protection coat. Hood,trunk, doors and other body parts with metalfolds are coated with PVC and sealed from theoutside.

All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during andafter assembly.

Requirements for maintaining the six-year limitedanti-corrosion warranty are outlined in the War-ranty Section of this Statement (page 32).

Restoring corrosion protection

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

MINI will not accept any liability for any partsand accessories not approved by the MINIDivision of BMW NA.

Underbody maintenance

The underbody has to be cleaned at least once ayear, in spring, with plain water in order to removemud, chemical sediments and other deposits. Ifthose materials are not removed, corrosion (rust)will occur.

Your MINI Dealer will do this anti-corrosion ser-vice for you.

WARNING

Do not apply additional undercoating or rust-proof-ing on or near the exhaust manifold, exhaust pipes,catalytic converter or heat shields. During driv-ing, the substance used for undercoating couldoverheat and cause a fire.

During a specific period (usually the earlier of 12months or 12,000 miles, though this periodvaries by state), some states require us orour authorized MINI Dealer, to repair in a rea-sonable number of attempts, any defect orcondition which substantially impairs the use,value, or safety of a new vehicle sold, leasedor registered in that state.

A “reasonable number of attempts” is generallydefined as: (i) two or more attempts to repair thesame defect (the number of attempts may varyby state); or (ii) that the same defect has causedthe vehicle to be out of service by reason ofrepair for more than 30 days (this period mayvary by state), except for delays created by con-ditions beyond our control.

If we are unable to correct a defect or conditioncovered by these statutes in a reasonable num-ber of attempts, we may be obligated either toreplace the vehicle or reimburse the owner/les-see in an amount equal to the purchase price orlease payments paid by the owner/lessee, lessthe amount directly attributable to use of thevehicle by the owner/lessee.

The MINI Roadside Assistance Program reflectsthe MINI Division of BMW NA’s commitment toyour complete satisfaction with the MINI owner-ship experience.

It is available for U.S. version MINIs in all 50 states,Canada, and Puerto Rico 24 hours a day, 365days a year.

It is a valuable benefit provided to you at no addi-tional cost. (Subject to certain limitations and ex-clusions noted on pages 26-28).

Owner’s Eligibility

You are covered if your vehicle is:

– A new MINI passenger car, distributed by theMINI Division of BMW NA, and purchased atan authorized MINI Dealer, OR;

– A new, U.S. version, MINI passenger car pur-chased under the Diplomatic or Military Salesprograms, operated in any of the 50 states,Canada and Puerto Rico.

Coverage is provided for the vehicle itself, regard-less of the driver. Protection is concurrent withthe MINI New Passenger Car Limited Warranty.

Getting Started

A temporary Roadside Assistance IdentificationCard can be found inside of your vehicle portfolio.It contains the 24-hour toll-free number for Road-side Assistance.

For your convenience a decal, showing the sameinformation as the ID card, has been affixed inthe trunk compartment.

In a few weeks you will receive a permanent MINIRoadside Assistance ID card by mail. The date ofpurchase and the vehicle identification number(VIN) are embossed on the card.

This card should be carried by the driver of yourMINI passenger car.

Calling For Assistance

The toll-free MINI Roadside Assistance numberis answered by a MINI Roadside Assistance ser-vice representative. In order for you to receivequick and reliable services, it is essential that youprovide detailed and accurate information to theservice representative.

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle Identification Number(found on your vehicle registration or your per-manent MINI Roadside Assistance ID card).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearby crossroads/intersections, highway mile markers, streetnumbers, landmarks, etc.).

7. Location you are calling from (including a tele-phone number where you can be reached).If you are calling from a public phone waitthere for the return call. Do not leave this loca-tion without informing the Roadside Assistanceservice representative.

8. A description of your vehicle’s problem. Spe-cific and accurate information will enable theRoadside Assistance service representativeto provide the proper help.

Dispatch Service

A service provider will be dispatched to the siteof your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements such asflat tires, dead batteries, and out of fuel condi-tions is provided by MINI Roadside Assistance.

The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. The MININew Passenger Car Limited Warranty does notcover any of the above on-site services.

Lock-Out

Please contact MINI Roadside Assistance forlockout situations. MINI Roadside Assistance willattempt to reunite the owner with a spare key bycalling someone at customer’s residence or bysending a taxicab to pick you up. (Cost of taxi isnot reimbursable.) Be sure the vehicle is in asafe location in the above situations. As a lastresort, we will have your MINI towed to dealer-ship. The MINI dealership can assist with keyreplacement. These services will be providedup to a maximum of $100.00 per incident.

Sign-and-Drive

Usually, you will be able to sign a receipt, so theprovider of the service can be reimbursed directlyby MINI Roadside Assistance.

Parts, materials, and fuel should be paid for byyou directly to the provider of the services.

Services

Towing Service

In the event of a mechanical breakdown normallycovered under the MINI New Passenger Car Lim-ited Warranty, your vehicle will be transported (atno cost) to the nearest authorized MINI Dealer.Your vehicle is also covered in the event of anaccident or collision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to the near-est authorized MINI Dealer on the next businessday.

If you request that the vehicle be taken to a loca-tion other than the nearest authorized MINI Dealer,any additional expense will be your responsibility.

Towing requests for vehicles disabled because ofcasualty, fire, act of God, acts of war (declared orundeclared), or violation of law (federal, state orlocal) are accepted at the expense of the owner/driver.

If it is necessary for you to have your vehicle towedthrough your own arrangements, you must con-tact MINI Roadside Assistance for priorauthorization and instructions on claim pro-cedures. All claims must be submitted withinsixty (60) days of the disablement or occurrence,accompanied by the original receipts. Claims

Trip Interruption Benefits

Trip interruption benefits are provided for me-chanical breakdowns as follows:

– Breakdowns that are warranty related, and;

– Must occur in excess of 100 miles from thedriver’s residence, and;

– Repairs cannot be completed during normalbusiness hours on the same day of break-down.

Reimbursements will be made for meals, lodg-ing, car rentals, and alternate transportation tobring the driver and the MINI passenger car to-gether after the vehicle has been repaired by anauthorized MINI Dealer. Original receipts mustaccompany all reimbursement requests.

Trip interruption coverage is limited to $750.00 perincident, to a maximum of five days per incident.

Always contact MINI Roadside Assistance fortrip interruption benefits. They will assist in mak-ing all the necessary arrangements.

Exclusions

Specifically excluded from coverage are:

– Fines, taxes, or impound towing fees causedby a violation of local or state law.

– Expenses related to hazardous weather con-ditions (removal from snow, ice, etc.).

– Expenses for the removal of snow tires, andmounting or removal of snow chains.

Warrantor

The MINI Division of BMW NA warrants 2003U.S. specification vehicles distributed by the MINIDivision against defects in materials or workman-ship to the first retail purchaser, and each subse-quent purchaser.

Warranty Period

The warranty period is 48 months or 50,000 miles,whichever occurs first.

Warranty Begins

This warranty begins on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

Warranty Coverage

To obtain service under this warranty, the vehiclemust be brought, upon discovery of a defect inmaterial or workmanship, to the workshop of anyauthorized MINI Dealer, during normal businesshours. The MINI Dealer will, without charge forparts or labor, either repair or replace the defec-tive part(s) using new or authorized remanufac-tured parts. The decision to repair or replace saidpart(s) is solely the prerogative of the MINI Divi-sion. Parts for which replacements are madebecome the property of the MINI Division.

In all cases, a reasonable time must be allowedfor warranty repairs to be completed after thevehicle is received by the authorized MINI Dealer.

Safety Belt Warranty - Kansas

Safety belts are covered under the MINI NewPassenger Car Limited Warranty for defects inmaterial or workmanship for a period of 10 years,unlimited mileage from the date of purchase. Inorder to be eligible for this coverage, the vehiclemust be a new vehicle retailed in the State ofKansas and the repair must be performed by anauthorized MINI Dealer in Kansas.

Modification of the vehicle or installation of anyperformance accessories or components at-tached to the vehicle which alters the originalengineering and/or operating specifications orwhich result in damage to the other original com-ponents, electrical interference, electrical short,radio static, water leaks, or wind noise.

Tires are warranted by their respective manu-facturer as detailed in the applicable tiremanufacturer’s warranty statements. Instruc-tions for proper tire care and maintenance arecontained in the Owner’s Manual. Should youexperience difficulty in obtaining warranty ser-vice from a tire manufacturer, your authorizedMINI Dealer will assist you in resolving the diffi-culty.

Non-MINI Parts – While you may elect to usenon-genuine MINI parts for maintenance or re-pair services, the MINI Division is not obligatedto pay for repairs that include non-genuine MINIparts or for any damage resulting from the useof non-genuine parts.

The MINI Division of BMW NA warrants this origi-nal vehicle against defects in materials or work-manship which will result in rust perforation ofthe vehicle body for a period of 6 years, withoutmileage limitation, commencing on the date offirst retail sale, or the date the vehicle is firstplaced in service as a demonstrator or com-pany vehicle, whichever is earlier.

To obtain service under this warranty, the ve-hicle must be brought, upon discovery of anyrust perforation, to the workshop of any autho-rized MINI Dealer. This MINI Dealer will, withoutcharge for parts or labor, either repair or replacethe defective part(s). The decision to repair orreplace said part(s) is solely the prerogative ofthe MINI Division of BMW NA. Parts for whichreplacements are made become the propertyof the MINI Division.

REQUIRED MAINTENANCE:

In order to keep this warranty in effect, the ve-hicle must be inspected at every MINI Inspec-tion I and II or at least every two years.

The Inspection/Maintenance consists of:

• Repairing any damages to undercoating orpaint due to stone chips, gravel erosion,scratches, or other external influences.

This limited warranty applies only to U.S. speci-fication vehicles distributed by the MINI Divi-sion of BMW NA.

In accordance with the defect warranty provi-sions of section 207(b) of the Clean Air Act,MINI warrants to the first retail purchaser, andeach subsequent purchaser, that the passen-ger car: (a) was designed, built and equippedso as to conform, at the time of sale, with allregulations of the U.S. Environmental Protec-tion Agency applicable at the time of manu-facture; and (b) is free from defects in materialsand workmanship which would cause it to failto conform with applicable regulations for aperiod of 2 years or 24,000 miles, whicheveroccurs first, except for specific emission con-trol components (as listed on page 36), forwhich the warranty period is 8 years or 80,000miles, whichever occurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehicle,whichever is earlier.

Warranty claims must be made as soon asreasonably possible after a defect is discov-ered. To make a claim, the car must bebrought to any authorized MINI Dealer duringnormal business hours.

The MINI Dealer will, without charge for parts orlabor (including diagnosis), either repair or re-place the defective part, if any. The decision

whether to repair or replace said parts is solelythe prerogative of the MINI Division of BMW NAand must be expected to correct the failure ofthe warranted part. Parts for which replace-ments are made become the property of theMINI Division. In all cases, a reasonable timemust be allowed for warranty repairs to be com-pleted after the car is received by the MINI Dealer.

For assistance in determining which specificparts or components of your vehicle are cov-ered under this warranty, please contact yourMINI Dealer.

It is the owner’s responsibility to have all sched-uled inspection and maintenance services per-formed (at the owner’s expense), as prescribedin the maintenance schedule for the MINIEmission Control System. Service intervalsare computed by the onboard MINI serviceinterval indicator and displayed on the instru-ment panel. The instructions for proper main-tenance and use can be found in the Owner’sManual. It is strongly recommended that anyreplacement parts used for maintenance,repair or replacement of emission control sys-tems be certified MINI Service Parts or MINIAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner may electto have maintenance, repair or replacementof the emission control systems performed byany automotive repair establishment, or electto use parts other than certified MINI ServiceParts. However, the cost of such service orparts will not be covered under this warranty,

except in emergency situations. In an emer-gency situation, where an authorized MINIDealer or a warranty replacement part is notreasonably available (within 30 days), repairsmay be performed at any available serviceestablishment using any equivalent part. TheMINI Division of BMW NA will reimburse theowner for such emergency repairs (includinglabor, parts and diagnosis not to exceed theMINI Division’s rates for labor, parts, and diag-nosis in said area) that are covered under thiswarranty. Replaced parts and paid invoicesmust be presented at an authorized MINI Dealeras a condition of reimbursement for emergencyrepairs not performed by an authorized MINIDealer.

The use of replacement parts, which are notof equivalent quality, may impair the effective-ness of the emission control system. If otherthan certified MINI Service Parts or MINI Au-thorized Remanufactured Parts are used formaintenance, repair or replacement of com-ponents affecting emission control, the ownershould obtain assurances that such parts arewarranted by their manufacturer to be equiva-lent to genuine MINI parts in performance anddurability. The MINI Division of BMW NA as-sumes no liability under this warranty with re-spect to parts other than genuine MINI parts.

However, the use of non-MINI replacement partsor non-EPA certified parts does not invalidatethe warranty on other components, unless non-MINI parts or non-EPA certified parts cause dam-age to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, improper adjustment, modification, al-teration, tampering, disconnection, improper orinadequate maintenance, use of leaded fuel orfuels containing more than 10% ethanol, or otheroxygenates with more than 2.8% oxygen byweight (i.e., more than 15% MTBE or more than3% methanol plus an equivalent amount of co-solvent).

The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services, the repair or re-placement of maintenance parts beyond thefirst required inspection/maintenance, or if thepart has been replaced earlier for reasons otherthan it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has been re-placed or altered and the true mileage cannotbe determined.

The car, if the vehicle identification number isaltered or cannot be read, or if the car has beendeclared a total loss or sold for salvage pur-poses.

In those states and jurisdictions that have es-tablished periodic vehicle emissions tests to en-courage proper vehicle maintenance and re-quire the vehicle to pass an emissions test ap-proved by the U.S. Environmental ProtectionAgency and:

1. The passenger car was distributed by theMINI Division of BMW NA; and

2. The car has been maintained and operatedin accordance with the instructions for propermaintenance and use set forth in theOwner’s Manual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judgedby an EPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a pen-alty or other sanction (including the denial ofthe right to use the car) under local state orfederal law if the non-conformity is not rem-edied within a specified period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, MINI Divi-sion of BMW NA warrants that if the car is eligiblefor coverage under this warranty, any non-con-formities in the car, which cause it to fail an EPA-approved emissions test will, without charge forparts or labor (including diagnosis), be adjusted,repaired, or replaced, at the option of the MINIDivision of BMW NA to proper specifications, inorder to make the car comply with applicable

emissions standards. The decision to adjust,repair or replace parts is solely the prerogative ofthe MINI Division and must reasonably be ex-pected to correct the failure of the warrantedpart.

This limited warranty begins on the date of firstretail sale, or the date the vehicle is first placedin service as a demonstrator or company vehicle,whichever is earlier. This limited warranty con-tinues for a period of 2 years or 24,000 miles,whichever occurs first, except for specific emis-sions control components (as listed on Page36), for which the warranty period is 8 years or80,000 miles whichever occurs first.

This limited warranty is made subject to the termsand conditions that apply to the Emission ControlSystem Warranty and the MINI New PassengerCar Limited Warranty.

No claim under this warranty will be denied onthe basis of use of a properly installed EPAcertified emission part for maintenance andrepair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in the main-tenance or repair of a vehicle only if the vehiclemanufacturer presents evidence that the uncer-tified replacement part is either defective inmaterials or workmanship or not equivalent froman emission standpoint to the original equip-ment part.

Maintenance, replacement, or repair ofemission control devices and systems maybe performed by any automotive repair es-tablishment or individual using any certi-fied part.

Immediately after the car has failed an EPA ap-proved emission short test, your claim can bemade at any authorized MINI Dealer. The MINIDealer will honor or deny your claim within thetime period specified by local or state laws (notto exceed 30 days), to avoid further penalties orsanctions. lf the claim is denied, the MINI Dealerwill notify you in writing of the reason(s). Theauthorized MINI Dealer is required by law to honorthe claim if notice of denial is not received by theowner within the specified time period.

The California Air Resources Board and the MINIDivision of BMW NA are pleased to explain theemission control system warranty on your 2003vehicle. In California, new motor vehicles mustbe designed, built, and equipped to meet theState’s stringent anti-smog standards. The MINIDivision of BMW NA must warrant the emissioncontrol system on your vehicle for the periods oftime listed below provided there has been noabuse, neglect, or improper maintenance to yourvehicle.

Your emission control system may include partssuch as the fuel injection system, the ignitionsystem, catalytic converter, and engine computer.Also included may be hoses, belts, connectors,and other emission-related assemblies.

Where a warrantable condition exists, the MINIDivision will repair your vehicle at no cost to youincluding diagnosis, parts and labor.

Manufacturer’s Warranty Coverage:

– For 3 years or 50,000 miles, whichever oc-curs first:

1. If your vehicle fails a Smog Check inspection,all necessary repairs and adjustments will bemade by the MINI Division to ensure that yourvehicle passes the inspection. This is youremission control system PERFORMANCEWARRANTY.

2. If any emission-related part on your vehicle isdefective, the part will be repaired or replacedby the MINI Division. This is your short-termemission control system DEFECTS WAR-RANTY.

– For 7 years or 70,000 miles whichever occursfirst:

If an emission-related part, specially noted onpage 40 as having coverage for 7 years or 70,000miles is defective, the part will be repaired orreplaced by the MINI Division. This is your long-term emission control system DEFECTS WAR-RANTY.

Owner’s Warranty Responsibilities:

– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owner’s Manual. The MINI Divi-sion recommends that you retain all receiptscovering maintenance on your vehicle, butthe MINI Division cannot deny warranty solelyfor the lack of receipts or for your failure toensure the performance of all scheduled main-tenance.

– You are responsible for presenting your ve-hicle to an authorized MINI Dealer as soon asa problem exists. The warranty repairs shouldbe completed in a reasonable amount of time,not to exceed 30 days.

This limited warranty applies to California certi-fied vehicles distributed by the MINI Division ofBMW NA registered and operated primarily inCalifornia.

The MINI Division of BMW NA warrants to theoriginal purchaser and each subsequent ownerthat the vehicle is:

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Checktest or upon discovery of the defect, to the work-

shop of any authorized MINI Dealer, during nor-mal business hours. The MINI Dealer will honoror deny your claim within 30 days. If the claim isdenied, the MINI Dealer will notify you in writingof the reason(s). The MINI Dealer is required bylaw to honor the claim if notice is not given to theowner within 30 days.

The MINI Dealer will, without charge for parts orlabor (including diagnosis), either adjust, repairor replace the defective part and other partsaffected by the failure of the warranted part, ifany. If your vehicle failed the California SmogCheck test or an EPA approved short test, thenthe MINI Division will repair your vehicle so that itwill pass this test. Items that require scheduledreplacement are warranted up to the replace-ment interval specified in the Service section ofthis Statement. The MINI Division may repair apart in lieu of replacing it when performing war-ranty repairs. Parts for which replacements aremade become the property of the MINI Division.After 3 years or 50,000 miles, and in accordancewith paragraph (c) above, such repairs are lim-ited to the repair or replacement of those partsidentified in the California Emission Control Sys-tem Limited Warranty List.

If your California registered vehicle is between 7and 8 years old and has been driven less than80,000 miles, then your vehicle is eligible foradditional warranty coverage under the FederalEmissions Warranty.

A repair performed as the result of a smog checktest failure due to a defect in a part, which iswarranted for 7 years/70,000 miles, is covered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repairto be completed, after the car is received by theMINI Dealer.

It is the owner’s responsibility to have all requiredmaintenance services performed (at the owner’sexpense), as prescribed in the maintenanceschedule for the MINI Emission Control System.Service intervals are computed by the serviceinterval indicator and displayed on the instru-ment panel.

In an emer-gency situation, where an authorized MINIDealer is not reasonably available or a war-ranty replacement part is not available within30 days, repairs may be performed at anyavailable service establishment or by any indi-vidual using any replacement part.

A repair not completed within 30 days consti-tutes an emergency. The MINI Division of BMWNA will reimburse the owner for such emergencyrepairs (including labor, parts and diagnosis notto exceed MINI suggested retail price for all war-ranted parts replaced and labor charges basedon the manufacturer’s recommended time al-lowance for the warranty repair and the geo-graphically appropriate hourly labor rate) that arecovered under this warranty. Replaced partsand paid invoices must be presented to an au-thorized MINI Dealer as a condition of reimburse-ment for emergency repairs not performed byan authorized MINI Dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof emission control systems. If other than genu-ine MINI Service Parts or Authorized Remanu-factured Parts are used for maintenance, repairor replacement of components affecting emis-sion control, the owner should obtain assurancesthat such parts are warranted by their manufac-turer to be equivalent to genuine MINI parts inperformance and durability. The MINI Division ofBMW NA assumes no liability under this war-ranty with respect to parts other than genuineMINI parts.

However, the use of non-MINI replacement partsdoes not invalidate the warranty on other com-ponents, unless non-MINI parts cause damageto warranted parts.

What is not covered

This limited warranty does not cover malfunc-tions caused by any of the following: accident,flood, misuse, modification, alteration, tamper-ing, disconnection, improper or inadequate main-tenance, except if performed by an authorizedMINI Dealer doing warranty repair work, use ofleaded fuel or fuel other than as specified in theOwner’s Manual.

The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has been re-placed or altered and the true mileage cannotbe determined.

The car, if the vehicle identification number isaltered or cannot be determined, or if the carhas been declared a total loss or sold for sal-vage purposes.

General

The warranty gives you specific legal rights, andyou may also have other rights which vary fromstate to state.

THE DURATION OF ANY IMPLIED WAR-RANTIES, INCLUDING THE IMPLIED WAR-RANTY OF MERCHANTABILITY, IS LIM-ITED TO THE DURATION OF THE EXPRESSWARRANTIES HEREIN. THE MINI DIVISIONOF BMW NA HEREBY EXCLUDES INCI-DENTAL AND CONSEQUENTIAL DAM-AGES, INCLUDING LOSS OF TIME, INCON-VENIENCE, OR LOSS OF USE OF THE VE-HICLE, FOR ANY BREACH OF ANY EX-PRESS OR IMPLIED WARRANTY, INCLUD-ING THE IMPLIED WARRANTY OF MER-CHANTABILITY, APPLICABLE TO THISPRODUCT.
