In case you’ve been out of the loop, incommunicado, disconnected, or generally unaware, September, 2005,

is once again recognized as Life Insurance Awareness Month (LIAM).

I started this column in that manner because, in a recent edito-rial (July 4/11, 2005) in the National Underwriter (NU), Edi-tor-in-Chief Stephen Piontek was questioning why there had not been more “hubbub” about the noteworthy, national event. He went on to note that his magazine had only published two articles on the topic. That was curious in itself, since, as Edi-tor-in-Chief of the widely popular insurance magazine, Mr. Piontek presumably has some infl uence on its content.

Mr. Piontek’s point is valid. As insurance professionals, we need to promote the value of life insurance, and we need to

take advantage of every opportunity. That’s why Life Insur-ance Awareness Month is so important.

One of the purposes of NAIFA-Columbus is education. In def-erence to Mr. Piontek, the NAIFA-Columbus board has been working to make Life Insurance Awareness Month as “big” as possible. That’s why we are very pleased to announce that the President and CEO of the American College, Laurence Barton, PhD, will be our speaker at the September luncheon.

The American College has been expanding educational oppor-tunities, such as the Horizons program (CLU, ChFC and CFP courses in a local, interactive classroom environment), and the Financial Services Specialist (FSS) designation.

The NAIFA-Columbus board is excited about this unusual opportunity, and we hope you are excited, as well. Plan on attending this event, andplease bring non-member colleagues!

Congratulations to NAIFA-Columbus LILI Graduates!Recent LILI Graduates Bryan Todd and Cort Bradbury were presented their LILI certificates by NAIFA Past President Robert M. Nelson, CLU, ChFC. The presentation was part of the annual Ohio Association Leadership Conference this past July. Bob Roach also completed the LILI program during this session.

LILI (Leadership in Life Institute) is a six-month program for NAIFA members who are leaders or potential leaders in our local associations. Leadership of others begins with leadership of oneself. By building on and expanding the personal abili-ties of candidates, LILI creates a tremendous opportunity for personal growth in every aspect of your life.

Ray has over 32 years of experience in the financial service industry. From 1973 to 1993 he worked as an agent and in manage-ment positions with Prudential and American General. In 1193 He joined American Express working as Region Vice Presi-dent and Field Vice President. In 2003 her returned to personal production as a Financial Advisor with Ameriprise (formerly American Express).

Ray is a Past President of NAIFA-Columbus, an MDRT , NSAA, NQA qualifier and LUTC instructor. While at American Express, Ray developed training techniques that lead to the Life Insurance Training Manual that is still used by financial advi-sors within American Express.

In 2004, Ray qualified for The President’s Recognition Award. The President’s Recognition Award recognizes American Express financial advisors who demonstrate exceptional written advice.

Ray and his wife Diane have been married for 32 years and have two daughters. Ray is a former board member and Big Brother of Big Brothers/Big Sisters of Columbus, Ohio.

New Dynamics for Financial Advisors: Education and Wealth ManagementSpecial Guest Speaker: Dr. Larry Barton, President and CEO of The American College

Larry Barton, Ph.D., is the eighth President and Chief Executive Officer of The American College. He is also a Professor of Management at The American College.

Prior to joining The American College, Dr. Barton served as president and chief executive officer of Heald College, and prior to that he served as President of DeVry University in Phoenix, Arizona. At both of these institutions, he was responsible for major curriculum innovations as well as enhancements to distance learning platforms. A former professor of management and business at Pennsylvania State University Graduate Center at Great Valley, Dr. Barton has also served on the faculties of Boston College, Harvard Business School and the University of Nevada at Las Vegas (UNLV). He received a coveted Senior Fulbright Scholarship to Japan from the U.S. Information Agency in 1987.

Dr. Barton is the author of three textbooks devoted to enhancing and expanding students’ understanding of financial and business risk: Crisis In Organizations (1990: Thomson); Ethics: The Enemy in the Workplace (1995: Thomson); and Crisis in Organizations II (2001: Thomson). He is editor and subject advisor for the new book, Crisis Management (2004: Harvard Business School Press). Dr. Barton serves on the Editorial Board of Management Decision (MCB University Press) and since 1995 has served a reviewer for the Journal of Business and Economic Perspectives at the University of Tennessee.

As a specialist in risk and crisis management, Dr. Barton has helped world-class industry leading organizations, including British Petroleum, The Walt Disney Company, Honda, ExxonMobil, and many others improve their business functions and strengthen their ability to handle unexpected challenges. From 1995-1999 Dr. Barton served as vice president of communications and public affairs for Motorola, Inc., where he led industry partnerships and public affairs, managing regional teams in London, Geneva, Hong Kong and Tokyo.

Dr. Barton has offered keynote speeches and presentations at over 130 financial and academic conferences in nearly 20 countries. His articles have appeared in The New York Times, Boston Globe, USA Today, and more than 40 academic journals worldwide. Dr. Barton has been interviewed on CNBC, CNN, public radio’s Marketplace and other network programs on issues related to financial services, business insurance and crisis preven-tion. He has been profiled in The Wall Street Journal and other publications. In 2005, for the second consecutive year, Insurance Newscast recog-nized Dr. Barton as “One of the 100 Most Powerful People in Insurance.”

Dr. Barton holds an A.B., magna cum laude, from Boston College in speech and communications, the MALD (Master of Arts in Law and Diplo-macy) degree in international business from the Fletcher School of Law and Diplomacy at Tufts University, and a Ph.D. in public affairs and inter-national communications from Boston University.

Congress Endorses Life Insurance Awareness MonthIt is now offi cial - by Congressional declaration, September 2005 is Life Insurance Awareness Month!

The Life Insurance Awareness Month resolution passed the House (H.Con. Res. 181) and Senate (S.Res. 223) in the same week. In a tremendous showing of support and coordination, the resolution passed the House on Monday, July 25 by a vote of 377 to 4 and was “hotlined” in the Senate (meaning it was approved unanimously) the following Thursday, July 28.

NAIFA gives special gratitude to all the House and Senate members who worked to pass Life Insurance Awareness Month. Senators Saxby Chambliss (R-GA) and Ben Nelson (D-NE) worked the bill through a diffi cult Senate process quickly. The Senate resolution included the following cosponsors: Senators George Allen (R-VA), Tim Johnson (D-SD), John Thune (R-SD), Susan Collins (R-ME), David Vitter (R-LA) and Mel Martinez (R-FL).

On the House side, Representatives Judy Biggert (R-IL) and Paul Kanjorski (D-PA) worked side-by-side with 68 cosponsors to get the resolution approved be-fore the August recess and in time for September. A list of those co-sponsors is available at www.capwiz.com/naifa under LIAM Updates (House).

NAIFA appreciates the lobbying support of the attend-ees of the 2005 National Leadership Conference Day on the Hill and those that responded to the Life In-surance Awareness Month Action Alert. It is NAIFA’s hope that last week’s congressional action will help raise public awareness about the importance of life insurance and encourage consumers to evaluate their life insurance needs.

NAIFA National Conventionand Career Conference

Why Convene?David F. Woods, CLU, ChFC, LUTCF, NAIFA CEO

Once upon a time, “the boys” would get together each year in some city for a “convention.” Often, too often, it would be a four or fi ve day party -- lots of good food, too much liquor and who knows what else. In fact, my fi rst NALU Convention was in Atlantic

City in 1967, nearly 40 years ago. I went at my own expense to receive the Louis I. Dublin Public Service Award on behalf of my local association. I have two lasting impressions of that meeting.

The fi rst is of a presentation by the chair of what was then the Federal Law and Legislation Committee, Jack Bobo. Jack, of course, went on to become president and then later CEO of NALU. But then he was clearly a comer. His presentation on the range of issues facing us was brilliant and persuasive. I remember having the temerity to challenge him on a point. I don’t recall what it was but, in typical Bobo fashion, he demol-ished my argument, which left me frustrated but impressed.

My second impression and memory is not so favorable. It was clearly party time for a large number of the delegates. The li-quor fl owed freely and, as often happens when it does, things got noisy and raucous. I left early. It was not what I had come for.

Compare and contrast Atlantic City 1967 with Las Vegas 2004. In 1967 there were no casinos in Atlantic City like there are in Las Vegas. Anyone who had not been to a NAIFA Convention between 1967 and 2004 might well go expecting the worst. Las Vegas??? But what a difference 37 years makes. In Las Vegas last September, despite all the temptations and oppor-tunities for diversion, the business sessions were packed. The afternoon workshops often had standing room only. A series of vitally important bylaws were approved by the National Coun-cil and an election was held that brought into offi ce some of the most qualifi ed and talented new trustees NAIFA has ever had.

Delegates and their spouses (very few, if any, spouses were in Atlantic City) enjoyed what Las Vegas had to offer, but after hours. I have been to all but two or three conventions since Atlantic City and I can state without reservation, this was one of the best, if not the best.

Why do I write about this? Well, obviously I’m promoting your attendance at the 2005 NAIFA Convention in Baltimore. David Smithkey and his Convention Committee have put to-gether a program that is every bit as good as the one in Las Vegas, perhaps better.

But my broader reason is to reflect on the differences and simi-larities between Atlantic City 1967 and Baltimore 2005. As our industry has grown and become more sophisticated, so, too has our association. Where Atlantic City certainly did “the business of NALU,” the primary reason for every convention, the atmosphere was far less professional and family-focused than will be the case in Baltimore in September.

Of course, some things don’t change. As was true in 1967, NAIFA members today want substance, knowledge, the chance to vote on issues affecting the future of NAIFA and the industry. As always, they also want a chance to meet new people and to get ideas that will help them grow professionally and as leaders.

But where Atlantic City 1967 was pretty much a party inter-rupted by some business, Baltimore 2005 will be about the business of NAIFA, professional growth and leadership de-velopment and having some fun along the way. It will be a meeting that will make you proud to be a NAIFA leader. It will inspire you to strive to be the kind of professional and leader you want to be and give you new ideas and skills to help you get there. It will be about growth, about Charting a Course for the Future. It will be about helping you achieve personal and professional greatness.

It will be the meeting of a lifetime. Although Baltimore and Atlantic City are only 100 or so miles apart, the distance be-tween the spirit of Atlantic City 1967 and that of Baltimore 2005 will be vast. Be there!

In the nick of time, both houses of Congress passed legislation in late June to allow businesses and non-profits to send commercial faxes to their clients and members without getting prior written consent from the fax recipients.

The Junk Fax Prevention Act of 2005 (S. 714) maintains the “established business relationship” (EBR) exception to the FCC’s do-not-fax rules. Under a new rule, which was scheduled to go into effect on July 1, businesses and non-profits would have been required to obtain written consent from all fax recipients, even those with whom the sender has an EBR, before faxes of a com-mercial nature could be sent.

NAIFA opposed the FCC’s omission of an EBR excep-tion from the do-not-fax rules because NAIFA members should be able to send faxes to their own clients with-out the unnecessary burden of having to get prior writ-ten consent. NAIFA supported legislation to correct the FCC’s fax rule for the past two years and successfully postponed implementation of the FCC rule during this period as part of a coalition of association and business groups addressing this issue. The new law restores the EBR exception to the do-not-fax rule, but the bill also contains important new requirements.

The new law requires all unsolicited commercial faxes to contain a clear notice on the first page of the fax that tells recipients they can request not to receive faxes in the future and that such a request must be complied with promptly. This opt-out notice must give fax recipi-ents the sender’s telephone and fax numbers, and a cost-free method, available 24/7, to inform a sender that a recipient does not want faxes in the future. In ad-dition, fax numbers used on the basis of an EBR must be obtained directly from the recipient or from a public source which obtained the number from the recipient (fax numbers in the possession of a sender at the time of the new law’s enactment may also be used).

These new requirements may be the subject of addi-tional FCC rulemaking. President Bush is expected to sign the new law quickly. If the bill signing is delayed, the FCC issued an order postponing implementation of its revised fax rules until January 9, 2006, again in response to a petition submitted by the Fax Ban Coalition. NAIFA is a prominent member of the coalition.

AHP Bill Passes; Shaddegg Bill PulledThe week of July 25 was designated as “health” week in the U.S. House of Representatives as five health-related bills were scheduled for consideration. Two bills were critical to NAIFA/AHIA members.

Association Health Plan The House passed HR.525 on July 27. HR.525 allows trade and professional associations to offer health insurance to their members by becoming, in effect, health insurance companies themselves.

AHP legislation has passed the House five times. HR.525 now goes to the Senate, where NAIFA and NAIFA’s health insurance division, the Association of Health Insurance Advi-sors (AHIA), have bottled up similar legislation for 10 years. AHIA and NAIFA are working for a similar outcome again this year.

The association health insurers created by HR.525 would op-erate under an ERISA provision exempting them from state law solvency standards, insurance department oversight and other consumer protections, as well as any benefits mandated by state law. No meaningful federal regulatory or solvency standards are substituted for current state based protections. AHP insurance plans would mirror to a large degree the thoroughly discredited Multiple Employer Welfare Arrange-ments that flourished in the 1970s under a similar ERISA preemption. MEWAs spawned widespread fraud and abuse until Congress changed the law in the early 1980s and gave regulation back to the states.

Shaddegg Bill - Interstate Sale ofIndividual Health Insurance Policies In somewhat of a surprise, a bill to allow the interstate sale of individual health insurance policies that many members of Congress had labeled “can’t miss” . . . did. HR.2355, called the Shaddegg bill after its author, Rep. John Shaddegg (R-AZ), never made it to the floor of the House during “health week.” The bill was approved by the Energy and Commerce Commit-tee on July 20, and though it passed Committee by only one vote, it was widely expected to pass the full House.

Basically, HR 2355 would allow insurers to register an indi-vidual health insurance policy in a state of their choosing and then market the policy in any state. The insurance laws of the state where the policyholder resides would not regulate the terms or conditions of the policy nor would they provide any consumer protections.

Some of the same policy issues raised against AHPs by AHIA apply to the sale of individual policies in interstate commerce. State regulatory officials through the NAIC offered sugges-tions to address state concerns. Though some changes were made to HR.2355, they were not enough to overcome objec-tions raised by the congressional delegations in some larger states with community rating laws governing the individual policy market.

Supporters of HR.2355 indicate they will be looking for ways to modify the bill to make it acceptable to critics both inside and out of Congress. No timetable has been set to bring it to the floor.

MEMBERSPOTLIGHT

C. Paul Sutor, CLU, ChFC has 44 years experience in the insurance in-dustry. Paul began his career in La-Porte, IN in 1961 with MetLife. Paul and his family moved to Toledo where he was an Assistant Manager for Met-ropolitan Life. In 1984, the family made the move to Columbus where he continued with Metropolitan as a Bro-kerage Manager.

In May of 1992, Paul joined The Principal Financial Group as a Brokerage Sales Manager. In his tenure over the last 12½ years with Principal, Paul has served as Agency Manager, General Manager, Managing Director and, since January of 2003, as Regional Managing Director of the Principal Finan-cial Group Ohio Business Center.

Paul earned his CLU designation in 1985 and ChFC in 1988. There have been many accomplishments during his career including multiple qualifications for MDRT (Million Dollar Round Table) and MART (Management Achievement Round Table). He has been a member of the FSP for 20 years and is a Past President of the Columbus Chapter and a Hall of Fame Award recipient.

Paul retired from Principal Financial Group at the end of July. Paul believes you never really retire from this industry and still plans to continue with some personal pro-duction as well as taking some extra time to spend with his lovely wife, Dee, and his children and grandchildren.
