SEPARATION and SUPPORT AGREEMENT
________________ hereinafter referred to as "Husband," and _____________ hereinafter
referred to as "Wife," hereby agree to the following:
A. Preliminary Matters
1. Husband and Wife were lawfully married on JULY 8, 1995 at San Nicolas Parish Church, in
the City of Cebu. Because certain problems have developed between Husband and Wife, they
became separated in fact and have lived separately and apart since the year 2000.
2. Husband and Wife have made a complete, fair, and accurate disclosure to each other of allfinancial matters affecting this agreement.
3. Husband and Wife have each been advised and counseled by attorneys of their choosing
regarding their legal rights as related to this agreement.
4. This agreement is intended to be a final disposition of the matters addressed herein and may be
used as evidence and incorporated in the dissolution of community property regime.
5. Should a dispute arise regarding the enforcement of this agreement, the prevailing party will be
entitled to his or her reasonable costs and attorney's fees.
B. Custody and Visitation
The children of this marriage is only one (1) named JEROME DOMINIC, born on November 16,
1995.
The said child is under the custody of the Wife and shall remain under her custody and will reside
with her henceforth.
Husband, being an Overseas Filipino Worker, will have visitation right over the said child at any
day of the week during the time that Husband is in the country.
C. Child Support
Husband will pay to Wife the amount ofPesos: Five Thousand Only (PhP5,000.00), as and for
child support, beginning on the month that he will be deployed back to his overseas job. The said
amount of monthly support will be increased each year depending on the need of the child and thefinancial capacity of the Husband.
D. Family Home
There being no family home, the Wife will fix her residence for her and their child.
E. Non-interference
Husband and Wife agrees never to interfere with each others personal life henceforth, except over
matter pertaining to the welfare of their child.
F. Attestation
Agreed to on this _______th day of May 2010, in Mandaue City, Philippines.
