Carol singers were targeted and prayer meetings were disrupted. This year the incidents of such violence have gone up. As such the rough observation has been that the anti Christian activities are observed more often in the month of December, the month of biggest Christian festival. As such violence is also spread more in Adivasi-dalit areas while Christian mission schools in urban areas are earning a high respectability with parents opting them as the top choice for their children’s education. The fright being instilled among this section is a part of the agenda which is opposed to the liberal democratic society with values of equality. We recently saw the release of the revised edition of the book, ‘Who Killed Laxmanand’. The author, Anto Akkara has been pursuing the case doggedly. He recounts the horror unleashed in the aftermath of Swami’s murder. It was VHP volunteers who thrashed some Christians and dumped them into police station as being the killers of Swami. They were released only after prolonged Court harassment. Again another set of Christians have been implicated and the investigation and legal proceedings are tardy. The author argues for a proper inquiry into this murder as it was used as a trigger for the biggest anti Christian violence in the Country in which nearly one hundred people lost their lives. We also carry the petition of eminent citizens endorsing the appeal of Admiral Ramdas for a proper high level inquiry in to the suspicious circumstances in which Justice Loya lost his life. Just to recall the judge was to give his verdict in case related to Amit Shah, for which an earlier judge was transferred. The story of Caravan Magazine has raised the questions which need an answer.     From the Editors Desk The month of Christmas saw a rising violence against Christians, particularly priests. Carol singers were targeted and prayer meetings were disrupted. This year the incidents of such violence have gone up. As such the rough observation has been that the anti Christian activities are observed more often in the month of December, the month of biggest Christian festival.     The 10

    th Dr. Asghar Ali Engineer

    Memorial Lecture was organized by

    CSSS in collaboration with India Arab

    Cultural Centre, Jamia Millia Islamia

    University in Delhi on 8th December

    2017. The Lecture titled "Some

    Reflections on the Limits of Liberalism"

    was delivered by Prof. Akeel Bilgrami

    from Columbia University. The Lecture

    was chaired by the honourable Vice

    Chancellor of Jamia Millia Islamia

    University, Prof. Talat Ahmad. The

    Lecture was attended by over 60

    persons. Those who attended the Lecture

    included prominent academics,

    professors, activists and students.

    Before the Lecture commenced, Prof.

    Akeel Bilgrami released a book called

    Babri Masjid, 25 Years On..... This

    book is published by Gyan Publisher and

    edited by Sameena Dalwai, Irfan

    Engineer and Ramu Ramnathan.

    After the release of the book, the Chair

    expressed pleasure of organizing the Dr.

    Asghar Ali Engineer Memorial Lectures

    at Jamia. Prof. Bilgrami began the

    Lecture by reminiscing his interaction

    with Dr. Asghar Ali Engineer. The

    Lecture centred around the freedom of

    speech and liberty by citing theories and

    ideas of John Raul's and Rousseau. With

    elaboration and examples, Prof. Bilgrami

    presented a comprehensive framework to

    understand the relationship between free

    speech and liberalism. He also explained

    the ideas of populism which helped to

    understand the socio political context in

    India today. The lecture was well

    appreciated which reflected in the

    responses and questions posed by the

    audience.

    Christmas in the Midst of Unseen Violence

    There have been times when the Christian community celebrated Christmas with peaceful heart. Gone are those days when we thought of Christmas as times of peace, joy and happiness. The carol singing was considered as taking the message of peace and joy that come with a birth of Christ to the people but the recent happenings of violence against the carol team in different parts of county and the threat calls issued by the hardcore Hindu fundamental organizations have made it an event inviting troubles and violence. Under this circumstances the question comes to our minds is that, will the Christianity that has faced numberless persecutions throughout the history stop preaching the message of peace? Will these mindless violences force the Christians from doing charity and humanitarian services as demanded by Christ?

    How much truth is there in the allegation of forced conversion of people belonging to the economically weaker sections, very specially tribals and scheduled caste? The Christians in most of the states are very minuscule minority which has no politically voice. The number of families in most village Churches can be counted on fingers. So how

    will the powerless Christians force the villagers to get converted to

    Christianity? The Churches in these villages are mostly very shabby and runs in small rooms which silently proclaim the bad economic condition of the churches and families associated with it. How could one justify the allegation of alluring Hindus with regular or irregular economic aid to get converted Christianity?

    The Christian community must be running more than twenty five thousand educational intuitions across the country. And adding to it, the Christian community in the country runs thousands of charity organizations supporting millions of peoples to improve their lives. If these organizations and educational institutions as alleged by the fundamental organizations, were working with the sole aim of conversion, then what would have been the population of Christians in the country? If these allegations to be true then how could many of leaders of the Hindu fundamental organizations and Bhartiya Janta Party leaders including Mr. L.K. Adwani (Former Deputy Prime Minister) remain a Hindu? In the recent years in Chhattisgarh many personal working in educational institutions were attacked in very many ways including very serious allegations of sexual abuses. In spite of all these the faith of people in the services offered by the community is still in a growing pace.

    So do the allegations of using educational and charity organizations for conversion stand ground?

    If we analyses these attacks on the institutions, some of them are organized just to popularize to fundamental list ideology and to stop Christians from working for the poor and downtrodden peoples belong to be lower strata of the society. Some of them are planned and executed to get access to the administration of the educational intuitions so that leaders of fundamental organize get their choice of students get admitted to the schools. One of the majour reasons could also be that the Christian community is branded as supporters of Congress Party and the socio-political organizations following Hindutva ideology take political vendetta on the Christians. It is true that there may be few incidents of violence taking place due to religious reasons.

    A clear study of attacks on Christians could reveal the fact that in many of these cases fundamental organizations have executive their vicious plans with the help of the police. In some of the incidents the victims were beaten up, man handled and very badly abused in the presence of the police or in the police stations but police made little efforts to stop them. In the case of the recent attacks on priests and brothers (Christians) in Satna and Bhuranpur and Aligarh in U.P are clear examples of police supported violence. There are many cases reported that the members of

    the fundamental organizations in the midst of the prayer came with the police and took away the pastor and believers who objected to the police stations. If police find that the arrested persons have no influence in the higher ups, then they are mentally and physically tortured and in many cases police register cases under the Freedom of Religion Act and other sections of IPC and send them to jail. One might tend to ask the question, are these police men safeguarding the rights of people or executers of the plans of the fundamental organizations?

    There are serious violations of freedom of religion guaranteed in the Article 25 of the Constitution of India which grantees every citizen freedom to practice and propagate his/her faith. How could one interpret conducting prayers in houses, conventions, retreats, Bible studies, carol singing, etc as methods of forcing or alluring people to conversion? The misinterpretation and misuse of the provisions in the Freedom of Religion Act is a clear violation of the spirit of the Article 25 of the Constitution of India. We need to place the Christmas and the worries of the Christians in the background of these rising unseen violent situations. In the midst of most uncertain times we pray, Oh! Lord, Have Thine Own Way, yes it calls for a total surrender of oneself at the feet of the Cross, Wish you all a Happy Christmas.

    Me, the Anti-National?

    Farooque was a Kashmiri. He hated India. His cousin was killed by security forces while at a demonstration in Srinagar. This was 1990. We were classmates; I always took him head on for his anti-India rhetoric. Those were the times when no one minded his rhetoric and our arguments, and life went on. Then came March 1992 and the cricket world cup. The determined Imran Khan and Pakistan came from behind and won the cup. I bunked college the day Pakistan won because I did not have the courage to face Farooque, who was of course ecstatic beyond words and was looking to rub salt in my wounds. I was madly in love with cricket and equally devoted to the team which had let me down but I knew defeat was part of the game, as much as of life.

    But 1992 also came with hate. The 400-year-old Babri Masjid was pulled down within four hours by kar sevaks. That become a defining moment in Indias secular history and Farooque taunted me on being the citizen of a country which could not protect the mosque from a group of rabid communalists. I was hurt but was confident that this was the handiwork of a lunatic fringe which shall never find

    toe space within the pluralistic and secular India I was so proud of. Again, life went on and we graduated from college. India too graduated from an innocent past and the mid-1990s saw the swift embracing of neoliberal policies. People changed and jumped classes overnight. Farooque left the country and we lost contact.

    And then 2002 happened. Yes, it happened not as a year but as a moment of perfidy for the thousands of Muslims who lived in different parts of Gujarat, imagining it to be their home. I emailed a Muslim and a Hindu friend from Ahmadabad asking about their well-being. Both were copied on the same mail. The Muslim guy replied in short Alive while my Hindu friend wrote, Ashamed to be alive. I was thankful that I had lost touch with Farooque. The brevity of the message from my Hindu friend gave me a lot of hope. They will never be able to hijack this country, I thought, but a tiny doubt had crept up in me. Like an insect, it sat over my being, fluttering its wings whenever the doubt was reinforced. Then came 2014 and the insect matured into a dark black stag beetle. It grew two tiny biting mandibles when Mohammad Akhlaq was lynched in 2015

    and then grew bigger and bigger as it fed itself on the lynching of Junaid Khan, Majloom Ansari, Pehlu Khan and the like.

    The Champions Trophy this year saw India defeating Pakistan in its very first match, but we lost the finals to a resurgent Pakistani side. To my horror, I didnt feel as bad as I had when we had failed to reach the finals of the 1992 world cup, which was won by Pakistan. I couldnt explain what deferred me from being sad. Sadness, like happiness, should have a reason and I was scared to face this reason. It was like a disfigured person looking at his/her face in the mirror for the very first time. Was I turning into an anti-national, like Farooque? Why would I not mind India losing to its arch rival? I assumed that the stag beetle within me was preying on my nationalism.

    And that evening my phone rang with urgency. It was Farooque after 25 years he had traced my number through a common friend. We talked for half an hour, discussing our lives and careers.

    Aur miyan, abhi bhi nationalist hee ho? (So, are you still a nationalist?) he asked me in his usual provocative tone. I was ashamed not because he had the reason and audacity to pose the question, but because I sidestepped his question and abstracted our conversation into something irrelevant. Irrelevance, the best disguise for survival.

    Report- Khudai Khidmatgar Sanji Virasat Yatra from Rajghat to Deoband

    Khudai Khidmatgar organised a yatra from Rajghat-New Delhi to Deoband-Uttar Pradesh on 30th November in memory of Indian Freedom Fighter Sheikh Ul Hind Moulana Mahmoodul Hasan, during his 97th Death anniversary. The yatra began from Rajghat-Gandhi Ji Memorial, the yatra flagoff by Social Activist Swami Agniwesh, Journalist Dr. Manimala, All India Majlis E Mushawarat National President Navaid Hameed and Khudai Khidmatgar National Convenor Faisal Khan, with a short addressing in front of the yatris gathered. Khudai Khidmatgar taking effort to remember the heroes of freedom struggle from its revival, all those leaders who played an exemplary role in nation building, the young generation should know and remember the forgotten heroes like Bibi Amtus Salam, sheikh

    Ul Hind, the culture of Sanji Virasat and many more. In those series we organised this yatra too. Social Activist Swami Agniwesh during his address, mentioned that the yatra in memory of Sheikh Ul Hind Moulana Mahmoodul Hasan is the need of the hour, to unite the society beyond all forms of differences, especially the youth gathered here are the real inspiration to the nation and will bring the social change, we must also try our best to counter the negative preaching and hate among the people by the name of religion. Khudai Khidmatgar National Convenor Faisal Khan said, It is the historical event of the organisation, Khudai Khidmatgar as like other activities it has now remembering the sacrifice

    and contribution of Sheikh Ul Hind to this nation and organizing the yatra on his name, Khudai Khidmagar working to fulfill the dreams of Moulana as he expressed the eagerness that Hindus and Muslims should come together to develop the nation and our people. All India Majlis e Mushawarat National President Navaid Hameed addressed the gathering, by remembering the historical participation of Sheikh Ul Hind and his interest to strengthen the hands of Mahatma Gnadhi Ji during freedom struggle and harmony in the society, he also remembered the contribution of Moulana and several other Islamic Scholars (Ulama) who worked very progressively for the social and national liberation. Senior Journalist Dr. Manimala said that, the activities of Khudai Khidmatgar gives me new hope, we spend our young days with revolutionary like Lok Nayak Jaya Prakash Narayanan, Ram Manohar Lohia, and many other exemplary personalities. As of now I am happy to see all those Leaders within each and every Khudai Khidmatgars, we are having the capacity of giving new hope and directions to this society to counter present challenges. The participants in the yatra are the members of Khudai Khidmatgar from Delhi, Uttar Pradesh, Haryana, Jammu and Kashmir, Karnataka, Bihar, Tamil Nadu, Kerala.

    The Yatra lead by Khudai Khidmatgar Western Uttar Pradesh Co-Ordinator Kamar Intekhab. Yatra began at Rajghat crossing Ghaziabad, Meerut, Kathauli, Muzaffar Nagar, Khampur, and finally reached at Deoband- the grave of Sheikh Ul Hind. The yatra received a huge welcome at Ghaziabad by the members of Muslim Maha Sabha and Ghaziabad District Khudai Khidmatgar, mean time the yatris distributed pamphlets and conducted meeting, like wise a meeting conducted at Meerut Shahi Eidgah Maidan by Meerut District Khudai Khidmatgar, Where Socialist party President Dr. Prem Singh, Khudai Khidmatgar volunteers from Kerala Sadik pattalam, Sushil Khanna, Philip Christy whome were among the yatris were also presented their talks and views on the aim of yatra and need to work towards social harmony and realize the dream of SANJI VIRASAT. When yatra reached Muzaffar Nagar, a huge gathering received the yatra and organised a meeting near Meenakshi Chowk, likewise in Khatauli, and in Deoband also. Finally Islamic Seminary DARUL ULOOM DEOBAND Vice Chancellor Moulana Abul Qasim Banarasi invited the yatra team to had a discussion and to convey his wishes for this historical initiative and advised the team to take up similar initiatives timely and seriously, since the nation needs a better Hindu as well as a better Muslim by which we could

    protect this nation from hate politicians and fake religious people. It is too sad to know that more than 90 percent of Activists to a common man does not know about Sheikh Ul Hind, then how the messages of these personalities transform to the society, is a biggest question in front of all.

    REPORT: REJINAGAR SHARIYATI VIOLENCE

    Drawing on inclusive narratives and interactions with the survivors of the Rejinagar Shariyati violence, common people, perpetrators and activists who resisted; this report anatomises how Radical Islam hypothesised to engulf Popular Islam or Sufism. This meticulous field study makes a significant and timely contribution to the discussions on radicalisation of society, administrative inaction and particularly peoples resistance. It is a little but in-depth research we have been able to complete. Here our team members were Akbar Ali Sekh, Suman Nath, Subha Protim Roy Chowdhury, Amitava Sen Gupta and Faruq Ul Islam. This report is drafted and written by Suman Nath, edited by Subha Protim Roy Chowdhury and published by Anupam Das Adhikary. 'Rejinagar Shariyati Violence' is available in the following centers. Ramdas, former Chief of the Naval Staff, requesting for a high level judicial enquiry into the mysterious circumstances of the death of Judge Brijgopal Harkishan Loya, the Special CBI Judge presiding over the trial of BJP President Amit Shah and several Gujarat Police Officers in the Sohrabuddin fake encounter case.

    Former Chief Justice of Delhi High Court, Justice A.P. Shah had also recently spoken out about the allegations, opining that not enquiring

    into the allegations made by the family would send a very wrong signal to the judiciary, particularly the lower cadre. He had also expressed concerns over allegations of corruption, as Judge Loya was allegedly offered a bribe of Rs.100 crore.

    Former Bombay High Court Judge, Justice B.H. Marlapalle, also has sought an SIT probe into the Judges death.

    STOP CRIMINALISING TRIPLE TALAQ: PUNITIVE ACTION IS NOT DETERRENCE

    Appeal for a wider consultation with womens groups for gender-just family laws

    The government has tabled a Bill titled Muslim Women (Protection of Rights on Marriage), 2017, on the first day in this winter session of the Parliament. This Bill proposes to make the practice of triple talaq a criminal offence, leading to imprisonment of husband who pronounces instant talaq.Created in the name of safeguarding womens rights, this problematicBill fails in its primary mission, and is instead designed to be another tool by which to criminalise Muslim men by making the practice of triple talaq a criminal offence, leading to imprisonment.

    We would like to state at the outset that Bebaak Collective, along with other womens groups of this country, are opposed to this arbitrary and

    repressive move. If this law is passed, then it is going to adversely affect Muslim women and children, whose survival is at stake. That this step has been hurriedly taken without inviting the opinion of womens rights groups and other civil society stakeholders involved in the issue is cause for further concern.

    Why no criminalisation?

    There is no rationale to criminalise the practice of talaq-e-biddat. Using penal actions leading to imprisonment to discourage the practice of triple talaq will not help in getting justice for women. When a woman reports a complaint about triple talaq, she wants to continue

    staying in matrimonial home and draw financial support from her marital home. Imprisoning the husband will deprive her of both, making her and her children even more vulnerable.

    Since marriage is a civil contract between two adult persons, the procedures to be followed on its breakdown should also be of civil nature. We do not believe in retributive justice, which emphasises punitive measures instead of the ensuring the rights of women. It is essential to think of civil redressal mechanisms and reparative justice to ensure that Muslim women are able to negotiate for their rights both within and outside of marriage.

    The Bill is limited to triple talaq and is not addressing related issues of polygamy, the practice of halala and other issues of discriminations faced by women in marriage and family.We believe that piecemeal legislations will not address larger issues of subordination of women within patriarchal structures.The penal action to discourage the practice of instant triple talaq is a myopic view as it leaves many other issues of economic and social security of women unaddressed. In addition, in our present conjuncture, the move to imprison Muslim men will add to the prevailing insecurity and alienation of the Muslim community. Family and community members might create undue pressures on the woman not to report against her husband.

    Criminalisation of instant triple talaq will further stifle the voices of Muslim women instead of offering them avenues for justice. Our effort as womens groups and the government should be to strengthen the negotiating capacities of women bystrengthening their economic and social rights.In any case, if there is a need for criminal intervention e.g. in cases of domestic violence, or when triple talaq is construed as violence, in such cases, the aggrieved woman can use the existing provisions of the Protection of Women from Domestic Violence Act, 2005 and Section 498A of the Indian Penal Code. These two legal options for women encompass both criminal and civil provisions.

    Appeal for broader consultation on the proposed Bill about tripletalaq

    Overtime, social movements have stressed that law/policy making by the government should be developed in the spirit of a democratic, participatory and transparent process with a view to incorporate the lived experiences of the affected sections of society. More recent legislations, like the Protection of Women against Domestic Violence Act, 2005, the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and the Criminal Law (Amendment) Act, 2013 are results of long struggle of the womens movements. All these laws or amendments were preceded by and benefitted from wide consultations with the civil society and affected sections, where voices and experiences of

    women and marginalised groups were heard, and legislations formulated accordingly to promote gender equality.

    Our appeal to the Members of the Parliament is not to hastily pass this legislation but to reflect on the repercussions of the same, through meaningful consultations with a broad range of stakeholders, particularly with womens groups.

    Underlying Principles:

    As a secular democratic country, all laws in India (whether personal or not) must be tested against the Constitutional mandate. If there is a contradiction, then the principles of equality must prevail. Arbitrariness and discrimination cannot be permitted on the grounds that a particular practice or law is an essential or non-essential part of religion. Since all the Personal Laws are discriminatory against women in varied ways, we must aim to create new laws or amendexisting laws to ensure they are in consonance with the fundamental rights of equality and non-discrimination.In recognition of the fact that gender relations in society are unequal, these lawsmust provide special safeguards to secure the rights of women.

    Our demands:

    Marriage among Muslims is a contract and hence cannot be dissolved in a unilateral manner. There can be no more injustice than to be constantly at

    the fear of being unilaterally divorced, with no judicial recourse available. We appeal that all the forms of unilateral talaq (including talaq-ahsan and talaq-hasan) should be invalidated as it vests power in the hands of the man, and reinforces unequal relations within the marriage. Accordingly, the matters related to talaqunder the Muslim Personal Law (Shariat) Application Act, 1937 should not be applicable.

    Muslim women have the option to approach court for divorce under the Dissolution of Muslim Marriages Act, 1939. This law should be available to men too. There should be legal provisions to deal with the matters of dower and maintenance of the wife, child custody, right to reside in matrimonial home, and other economic obligations.

    The matrimonial home as the residence of a married woman has to be ensured in law, along with an equitable right of ownership and access to all property belonging to the partners at marriage.

    In order to discourage the practiceof talaq-e-biddat, we suggest that when a complaint is received against any qazi, religious or social organisation for encouraging, abetting or administering instant triple talaq, their registration should be cancelled.

    The practice of nikah-halalashould be made a punishable offence. This practice makes the woman vulnerable to all kinds of physical, sexual, emotional and economic abuse, thereby denying them their right to live with dignity and self-respect. Any person who solemnises or acts as a witness to a marriage knowing that it has been contracted as nikah-halala so as to facilitate

    remarriage with the previous husband should also be punished.

    The Ministry of Minority Affairs should formulate a scheme to spread awareness about the Supreme Courts judgment, take cognisance of complaints of its violation and the issues arising out of such matters with appropriate authorities, provide monetary relief and socio-legal aid to women who are affected by the violation of this judgment.

    Bebaak Collective is one of the interveners in the Supreme Court, who supported the petition of Ms. ShayaraBano challenging the constitutionality of triple talaq, nikah-halala and polygamy. We were represented by Senior Advocate Indira Jaising.

    For unity, we must forget differences of

    caste and creed and remember that we

    are all Indians, and all equal. There can

    be no distinction between man and man

    in a free country. All must have equal

    opportunities, equal rights and equal

    responsibilities. This is difficult for

    achievement in practice, but we must

    continuously strive towards that end.

    There is one more thing that we have to

    do to maintain peace and order in this

    country. For a few years at least, till we

    are able to stand on our own legs, we

    must forget that we can every now and

    then threaten the government. We

    cannot function if the government is to

    be challenged day after day by groups of

    people who want to have their own

    way. What they want may be, according

    to their own honest thinking, very good;

    but Gandhiji has put before us the ideal

    of obtaining what we want by peaceful

    methods and through truth and non-

    violence. If people begin to threaten

    and challenge government's authority

    and try to overthrow it to gain their

    objectives by force, the latter would not

    be able to do anything constructive.

    Forces are existing in this country which

    would create chaos and disorder, which

    would weaken the country instead of

    strengthening it

    ...We in the government have been

    dealing with the RSS movement. They

    want that Hindu Rajya or Hindu culture

    should be imposed by force. No

    government can tolerate this. There are

    almost as many Muslims in this country

    as in the part that has been partitioned

    away. We are not going to drive them

    away. It would be an evil day if we

    started that game, in spite of partition

    and whatever happens. We must

    understand that they are going to stay

    here and it is our obligation and our

    responsibility to make them feel that

    this is their country. It is, of course, their

    responsibility, on the other hand, to

    discharge their duties as citizens of this

    country.We must all understand that

    partition is behind us. It has to come to

    stay. I honestly believe that it is good for

    both the new nations to be rid of a

    perpetual source of trouble and

    quarrels. In 200 years of slavery, the

    administration created a situation in

    which we began to drift away from each

    other. It is good that we have agreed to

    partition in spite of all its evils; I have

    never repented my agreeing to

    partition.

    From the experience of one year of joint

    administration when we have not

    agreed to partition, I know we would

    have erred grievously and repented if

    we had not agreed. It would have

    resulted in a partition not into two

    countries but into several bits.

    Therefore, whatever some people may

    say, I am convinced and I remain

    convinced that our having agreed to

    partition has been for the good of the

    country.

    ...People are impatient; they want more

    wages for labour. Do they think we want

    to starve labour? Are we foreigners?

    Some people say we are capitalist

    agents. One thing I learnt from

    Mahatma Gandhi is that a public man

    should not have any property, and can

    challenge any government or any

    Communist to play this game with me.

    But my quarrel is what those who,

    contrary to the second part of

    Mahatmaji's advice to us, want to use

    violence. There should be no terrorism

    amongst ourselves. So long as people

    were playing that game when we were

    under a foreign power, we made

    allowance for it; we are paying for it

    also, because an evil once tolerated

    grows. That is what we see in

    Hyderabad.

    Why are these Communists creating

    trouble there? How did they grow? It

    was because the Hyderabad

    government was foolish enough to

    allow them to grow for its own ends and

    we had no control over them then to be

    able to suppress them. And what is it

    that we see there now? In three or four

    months' time, 200 or more young

    Congressmen, their own brothers, have

    been murdered. Is it a sign of freedom

    that in the first year of freedom you

    have 200 Congressmen killed in cold

    blood in a small area? Once these

    terrorists are driven out from that area,

    where will they go? Inside your border.

    They will harass you; they will play the

    same game with you. To the

    Communists, my appeal may be in vain,

    because they do not listen. I told them

    immediately after my release from jail

    last time that I was prepared to take all

    the Communists into the Congress, to

    forget the past and keep the doors open

    provided they give up violence and

    cease to draw their inspiration from

    foreign countries.

    Even now our offer is open, but if

    terrorism is the only method they want

    to employ, because they cannot defeat

    us at the polls and separate us from the

    masses of India, then it is our

    misfortune that we have to put our own

    dear young men and women into prison

    or to drive them underground.

    ... That is one section of the people,

    with whom we have to deal; the other is

    the RSS. I have made them an open

    offer: "Change your plans, give up

    secrecy, eschew communal conflict,

    respect the Constitution of India, show

    your loyalty to the Flag and make us

    believe that we can trust your words. To

    say one thing and to do another is a

    game which will not do." In one year of

    freedom we have experienced many

    things and learnt many lessons.

    Whether they are friends or foes,

    whether they are our own dear young

    children, we are not going to allow them

    to play with fire, so that the house is not

    set on fire. It would be criminal to allow

    young men to indulge in acts of violence

    and destruction, to let the lessons that

    our neighbouring countries have learnt

    be wasted on us.

    Thus I have spoken to the RSS and to

    the Communists. Then you have our

    Sikh friends. Some of them, have also

    begun to threaten us and throw

    challenges. They are the only

    community in India which is allowed,

    with the unanimous voice of the

    Constituent Assembly, to keep arms. No

    other community is allowed to keep a

    sword or a kirpan. Why did we do this?

    Not in order that they might threaten

    the government with the use of force.

    Government is prepared to hand over

    power to anybody who can take people

    with him. But if anybody is going to play

    false and threaten the popular

    government, the latter will not fail the

    people...

    after independence, India confronted

    challenges from both the Left and the

    Right. The Left had ideological issues

    and proclaimed soon after

    independence that "yeh azaadi jhooti

    hai" and thus began a critical tirade

    against the newly elected government.

    Being the home minister, Sardar Patel

    confronted these forces and even

    exhorted the communists to join the

    Congress and be part of the nation

    building project. The idea of India or

    Indian nationalism was not ideologically

    or otherwise sectarian for Patel. He was

    threatened by the RSS from the Right,

    and this threat was more serious as it

    was clothed in the nationalist garb.

    Patel questioned their definition of

    nation and nationalism and even

    warned them saying, "They (RSS) want

    that Hindu Rajya or Hindu culture

    should be imposed by force. No

    government can tolerate this." The

    address included here was delivered in

    Madras in 1949 where Patel referred to

    threats from the Left as well as from the

    Right. Those were difficult early days

    and Patel categorically said that India as

    a new nation belongs to all, we are all

    Indians without any discrimination.]

    rights activists on Friday criticised the

    manner in which the murder of Swami

    Laxmanananda in 2008 was investigated

    tried and convicted for the crime without

    proper evidence.

    The speakers who demanded a probe

    into the real conspiracy behind

    Laxmananandas killing were

    attending the release of a revised edition

    of journalist Anto Akkaras book Who

    Killed Swami Laxmanananda. The book

    examines the killing of the Vishwa

    Hindu Parishad (VHP) leader in

    Odishas Kandhamal and the consequent

    widespread violence against members of

    the Christian community in the district.

    Christians were targeted after

    Swamis killing

    In the latest edition, Akkara has looked

    at how following the 81-year-old

    swamis death, nearly 100 Christians

    were killed and 300 churches and 6,000

    houses plundered in a spate of violence

    that rendered nearly 56,000 homeless.

    At the launch of the book, Akkara also

    played a video clip of Laxmanananda in

    which he is shown saying: The actual

    intention of the Europe, US, the Pope

    and Sonia Gandhi was to convert the

    entire region into the independent

    Christian land. God has sent me from

    Himalaya and it was stalled. That is why

    their campaign was to drive away

    swamiji and create a Christian land. As

    long as I am alive I shall not let you do

    that.

    Akkara says this video was cited in the

    documentary The Agony of

    Kandhamal (which was produced by the

    India Foundation) and was allegedly

    used as evidence to prove the

    Christian conspiracy behind the murder

    of the Swami.

    Swami killed in suspicious

    circumstances

    He also alleged that Laxmananandas

    trusted bodyguard was missing on the

    day the swami was attacked and that the

    police guards ran away when the

    assailants entered the ashram.

    Following the murder, Akkara claimed,

    four Christians including a 13-year old

    illiterate boy were picked up by VHP

    workers, thrashed and then dumped in

    police stations. Vishva Hindu Parishad

    (VHP) leader Praveen Togadia

    announced the names of Swamis

    killers and not the police. That is how

    the nation was fooled about the

    Christian conspiracy behind the

    Swamis murder.

    Further, the journalist said, when the

    police could not fix the first batch of

    killers who had been detained for 40

    days, they were let off with an affidavit

    that read due to fear, we had taken

    shelter in police.

    Then, Akkara said, the investigation

    team arrested the second batch of

    killers this time seven innocent

    Christians from remote Kotagarh jungle

    in two batches. Akkara said judge

    Biranchi N. Mishra of the fast track

    court who had presided over the final

    two years of trial was transferred in 2013

    before the verdict was delivered.

    Seven Christians convicted without

    worthwhile evidence

    The judgement in the case was delivered

    by a third judge in October 2013 and all

    the seven accused were convicted and

    sentenced to life imprisonment. This,

    Akkara claimed, happened even though

    no worthwhile evidence was brought

    before the fast track court judges.

    Akkara, who subsequently also brought

    the family members of these seven

    innocent convicts to Delhi, to let the

    media know their real story, said

    surprisingly, two years after this

    conviction, the same police officers who

    had ensured the conviction of the

    innocent Christians told the Justice

    Naidu Commission of Enquiry that the

    much trumpeted Christian conspiracy

    theory was baseless.

    He said the swamis claim of coming to

    Kandhamal to not let it become a

    Christian land was parroted in various

    VHP statements on the murder from day

    one. Since the swami had named even

    the Pope and Sonia Gandhi as people

    who considered him a threat, it was easy

    to spread the rumour that Christians had

    killed him. Therefore, he charged that

    Swamis murder was actually a supari

    (contract) killing.

    Latest edition questions books,

    authors and publishers role

    In the latest edition of the book, Akkara

    has written about attempts to cover up

    the real controversy. He has claimed that

    he stumbled upon this mammoth fraud

    from documents gifted by then

    Rashtriya Swayamsevak Sangh

    spokesperson Ram Madhav to the head

    of the Kerala Catholic Church during a

    visit in 2012.

    The author claimed from these

    documents it was revealed that two men

    Michael Parker and Brannon Parker

    supposedly authored the same book on

    Kandhamal under different titles.

    Harvest of Hate Kandhamal in

    Crossfire by Seattle-based

    anthropologist Michael Parker was

    published by the India Foundation in

    2009, Akkara said. The bulky book

    carried a publishers note by then India

    Foundation director Nirmala Sitharaman,

    who is now Indias defence minister.

    Interestingly, he said, in her introduction

    to Harvest of Hate, Sitharaman had

    described the author Michael Parker as

    born in India while the profile at the

    end of the same book declared that

    Parker was born in the US.

    The same Michael Parker book, Akkara

    said, was now being marketed

    worldwide as ORISSA in the

    CROSSFIRE Kandhamal Burning by

    Brannon Parker.

    On downloading this book from the

    Internet, Akkara said he discovered that

    the name of the publisher India

    Foundation was there but there were

    no contact numbers. But there was an

    address 343, Chandanwadi

    Apartment, Sector 10, Dwarka, New

    Delhi 110045 which turned out to be

    that of a house owned by national

    security adviser Ajit Kumar Doval.

    NHRC accused of taking it easy

    Akkara said a DVD titled The Agony of

    Kandhamalwas also brought out by

    India Foundation which portrayed

    Hindus as victims by forging testimonies

    of Christian victims. He lamented that

    the National Human Rights Commission

    (NHRC) played a dubious role in the

    Kandhamal cover up by not even issuing

    a press release in the last nine years.

    Having taken 25 trips to Kandhamal in

    pursuit of the truth, Akkara also

    questioned why no action has been taken

    by the Odisha government on the

    enquiry report of Justice Naidu

    Commission which was submitted

    December 22, 2015.

    Seeking a probe into the massive cover-

    up of the real conspiracy, senior

    Communist Party of India (Marxist)

    leader Brinda Karat said: Akkaras

    book has brought out the absurdities and

    discrepancies of the judgement

    convicting seven persons in the case

    wherein a resolution of a church, that

    later turned out to be fudged, is the only

    evidence.

    She said after some Maoists claimed that

    they were responsible for the killing of

    the swami, all efforts were made by the

    prosecution to manufacture evidence

    to show that the seven accused had links

    with the Maoists. This is the most

    outrageous travesty of justice, she said.

    Karat said she had visited the seven

    accused in jail in 2015 and had also

    urged the President of India to ensure

    that they were not victimised the way

    they were. The judgment is an example

    of what it should not be, she said,

    adding that the review has unfortunately

    dragged for a long while in the High

    Court.

    Make Naidu Commission findings

    public

    Demanding that the Naidu Commission

    report be made public, she alleged that

    BJP ensured in this case that every

    single process of justice was subverted.

    Even when it came to those accused of

    killing Christians and raping a nun, she

    said while 13 were convicted for

    murders all are out on bail. As for the

    rape case, she said only one convict was

    in jail in 2015 and in all probability he

    too would have come out.

    On the questions raised by the book,

    Karat asked, who are the Parker

    brothers?

    She also wondered why no question of

    plagiarism arose despite both the books

    having the same text. She also noted that

    when Teesta Setalvad handed some

    documents to the United Nations, she

    was accused of treason. Why is it then

    that no questions are being asked of Ram

    Madhav for handing over documents to

    US agencies? she asked.

    Seeking an enquiry into the role of India

    Foundation and Doval in the whole

    episode, Karat said the books were

    written to project the Christian

    community in a certain light. This

    shows that there was a method in which

    the propaganda machinery was set up

    with complicity of people in the political

    scene. Karat said truth also needs to

    come out because the issue also pertains

    to the rights of dalits and adivasis as all

    the seven convicts belong to these.

    Soft Hindutva a challenge to idea of

    India

    Releasing the book, veteran journalist

    Kuldip Nayar emphasised the need to

    preserve the countrys plurality,

    cautioning that some forces are

    disfiguring the country by enforcing

    majoritarianism, leading to slipping of

    the idea of India. He decried that a

    soft kind of Hindutva (Hindu

    nationalism) was spreading across the

    country that needed to be challenged by

    people, especially the younger

    generation.

    General Secretary of CPI, D. Raja, said

    an atmosphere of hatred and fear was

    being spread through cultural fascism

    and called for fighting it to save the

    country.

    Leader of the United Christian Forum,

    John Dayal, questioned why the appeal

    against the fast track court order was

    getting delayed. Are they delaying the

    judgment (on the appeal of the

    Christians) because dont want to answer

    the question who killed the swami?

    Stating that a senior VHP leader was in

    Kandhamal the day the swami was

    killed, Dayal said everybody knows

    who killed the swami, they just do not

    want to say it.

Each chapter of the critique, divided into six sections Ideological Challenges, Rooting of Divisive Violence, Hindutva: Revivalism of Caste Hierarchy, Women and Communal Politics, Emotive Issues to the Fore and Threats to Democracy engages the reader in a thought-provoking dialogue on various dimensions of the theme. Communalism, a strategy of those having vested interests to oppose social reformation, is often translated into action by constructing an image of the past drawing from scriptural or religious traditions that trigger emotive issues a trend which is common to fundamentalists belonging to both majority and minority communities. While the former keep alive emotive issues such as cow slaughter, beef ban, Ram Mandir, ghar wapsi or love jihad, the latter spread hate and conservative ideas adding fuel to fire which, in turn, result in polarisation of the society and escalate the brewing communal conflict in the country. Unfortunate reality that emerges is that time and again the state and its various arms are unable to take a neutral stance exposing their bias towards one side which is evidently that of the majority community. The political leadership, bureaucracy and police failing to protect innocent lives only raise a signal of impunity to the perpetrators of communal violence which further enhances mistrust and apprehension. All this, the author argues, is part of a

    game of marginalising the minority community and reaping the harvest of majority support in the electoral arithmetic. The discussion is, however, not limited to the issue of religious polarisation alone. The author critically examines that the issues of marginalised sections Dalits, Adivasis, women, workers and religious minorities are intensely interwoven with each other. This insight leads the author to conclude that fundamentalism, rather than recognising the qualitative change in the formation of India as the nation state...is stuck to the pastoral-feudal-preindustrial society with the values of caste and gender hierarchy.
