40E-6.011 Policy and Purpose
The South Florida Water Management District (District) hereby
gives notice: On April 9, 2020, the District's Governing Board
issued SFWMD Order No. 2020-010-DAO-ROW to
Miccosukee Tribe of Indians of Florida (Application No. 14-
0710-3). The petition for waiver was received by the District on
March 10, 2020, superseding and replacing a previous petition
received on March 19, 2018. Notice of receipt of the petitions
requesting the waiver were published in the Florida
Administrative Register, Vol. 44, No. 58 on March 22, 2018
and Vol. 46, No. 50 on March 12, 2020, respectively. No public
comment was received on this item. This Order provides a
waiver of the District's criteria for utilization of the District
right of way to allow an airboat concession along the L-29
Canal; Section 16, Township 54 South, Range 36 East, Miami-
Dade County. Specifically, the Order grants a waiver from
Florida Administrative Register Volume 46, Number 79, April 22, 2020

subsections 40E-6.011(4) & (6), Fla. Admin. Code, which
prohibits the placement of permanent and semi-permanent
above-ground structures within 40 feet of top of canal bank
within Works or Lands of the District and paragraph 40E-
6.221(3)(j), Fla. Admin. Code, which prohibits buildings, sheds
in excess of 100 square feet, portable toilets, commercial signs
and parking within Works and Lands of the District, and which
also sets forth that docks shall comply with a minimum low
member elevation. Generally, the Order sets forth the basis of
the Governing Board decision to grant the waiver as follows: 1)
the proposed use will not interfere with the District's current
ability to perform necessary construction, alteration, operation,
and routine maintenance activities; and 2) the Order granting a
waiver from the subject rule is based upon a substantial
hardship and principles of fairness.

The Florida Housing Finance Corporation hereby gives notice:

48.023(2) F.A.C. for HTG Paradise, LLC, to allow for
calculation of the minimum set aside percentage based on
income averaging. Florida Housing determined that the
Petitioner had demonstrated that it would suffer a substantial

The State of Florida, Department of Law Enforcement (FDLE),
Office of Criminal Justice Grants will be submitting an
application to the United States Department of Justice, Bureau
of Justice Assistance, for Federal Fiscal Year 2020 funds made
available under Part E of Title I of the Omnibus Crime Control
and Safe Streets Act of 1968, Section 500 as amended.
A copy of the application will be available for review and
comment by the public at FDLE, Business Support Program,
Office of Criminal Justice Grants, Tallahassee, Florida 32308.
Interested parties should contact the Office of Criminal Justice
Grants at (850)617-1250 to obtain a copy of the application for
review.
If the Bureau of Justice Assistance approves this application,
units of local government will be eligible to receive subawards
from the Department of Law Enforcement. "Units of local
government" means any city, county, town, township, borough,
parish, village, or other general-purpose political subdivision of
a State and includes Native American Tribes that perform law
enforcement functions as determined by the Secretary of the
Interior.
Chapter 11D-9, Florida Administrative Code, governs program
administration and funding. Local governments should
thoroughly review rule provisions before applying for subaward
funds.
FDLE will provide a notice of funding availability to the chief
official of each county and each city. The notice will state the
amount of funds available to the county and include information
about the application process.
