Anderson 8329 Involved 09:49:09 Ofc. Anderson said, “Get back”, then got on the radio and asked for “back up”. Ofc. McNew yelled, “Taser”. Subject Lyles said, “You can’t do that either motherfuckers.”

Anderson 8329 Involved 09:49:17 Ofc. Anderson said, “I don’t have a Taser”. Ofc. McNew got on the radio and said, “We need help, we got a woman armed with two knives”. Both officers yelled commands, “Get back”.

Anderson 8329 Involved 09:49:22 Shots fired.

Anderson 8329 Involved 09:49:27 Ofc. Anderson yelled, “Shots fired, shots fired”. Ofc. McNew got on the radio and said, “Shots fired. The suspect is down. We need officers on scene, we need medics, we are not under control”.

Anderson 8329 Involved 09:50:42 Ofc. McNew got on the radio and advised, “Officers are ok. At this point we do have multiple juveniles on scene, we need other officers here”.

Anderson 8329 Involved 09:51:36 Officers Anderson and McNew began discussing how to get the children out.

Anderson 8329 Involved 09:52:22 Ofc. McNew asked something unintelligible. Ofc. Anderson replied, “No, she just took that one swing at me”.

Anderson 8329 Involved 09:52:46 Ofc. Anderson said, “I’ve got her covered.” He then asked, “Do we have fire in route?”

Anderson 8329 Involved 09:53:00 Ofc. McNew said, “I can’t get out can you get out?”

Anderson 8329 Involved 09:53:21 Ofc. McNew got on the radio and said, “Union One, I don’t know if I’m getting out or not, we are in a building back of the property, it’s all the way in the back”.

Anderson 8329 Involved 09:53:39 The first back up unit arrived. As he ran to the building, he left his siren on in his patrol car.

Anderson 8329 Involved 09:53:41 Someone asked on radio for an update on the status of the suspect, whether or not they were still outstanding. Ofc. Anderson said on radio, “One Union Three, suspect is down on the ground”.

Anderson 8329 Involved 09:53:57 Ofc. McNew said, “Ok, when they get here, we need to get the children out.” Shortly after, the first backing officer could be heard. They began coordinating on getting the children out.

Anderson 8329 Involved 09:55:34 Ofc. McNew said to Ofc. Anderson, “Hey Jason, a lot going on, take some breaths, maintain your position till we get other officers in here…(unintelligible)”.

Anderson 8329 Involved 09:55:57 More back up officers began arriving.

Anderson 8329 Involved 09:56:07 A female carrying a child and a juvenile male were running away from the building.

Anderson 8329 Involved 09:56:44 Ofc. McNew said, “Don’t touch anything, just remember”.

Anderson 8329 Involved 09:56:50 Ofc. McNew said to Ofc. Anderson, “Deep breaths, they’re gonna come, they’re gonna you know talk to you, they’re gonna ask…(unintelligible)…at this point…(unintelligible)”. Ofc. Anderson said, “There’s still a knife right there”.

Anderson 8329 Involved 09:57:17 Ofc. McNew said, “Shick (Ofc. Schickler) help him render aid”.

Anderson 8329 Involved 09:57:25 Ofc. Anderson said, “Do we have Fire in route”. Ofc. McNew got on the radio and asked if Fire was in route. Dispatch advised that Fire was staging and asked if it was clear for them. Ofc. McNew said, “Affirm, send them in”.

Anderson 8329 Involved 09:58:05 More back up officers arrived. One plain clothed FTO officer attempted to access the patrol vehicle with the siren still on but it was locked.

Anderson 8329 Involved 09:58:16 Dispatch asked if anyone on scene could advise if there were sufficient units. An officer got on the radio and said, “We’re don’t need any additional units…(unintelligible)…need uh medics to the apartment now.”

Anderson 8329 Involved 09:58:44 SFD Engine 38 said on SPD radio, “Engine 38’s arriving”.

Anderson 8329 Involved 09:59:23 Officers could be heard saying, “I’ve got bio clus too. You got any gauze?”

Anderson 8329 Involved 10:00:33 An officer told Ofc. Anderson to go downstairs.

Anderson 8329 Involved 10:01:10 Officers are heard briefing Firefighters on the situation.

Anderson 8329 Involved 10:01:50 Ofc. McNew told another officer, “We haven’t checked any other rooms, any other floors”.

Anderson 8329 Involved 10:02:14 Ofc. McNew got on radio and said, “One Union One can I get a Guild Rep please?”

Anderson 8329 Involved 10:02:35 Ofc. Anderson, Ofc. McNew, and a plain clothed Ofc. Gingrey, could be seen walking toward Ofc. Anderson’s patrol vehicle. A Sergeant passing by asked Ofc. McNew something. He then mentioned the Public Safety Statement before asking Ofc. McNew, “What do we got in terms of suspect… (unintelligible)?” Ofc. McNew stopped to talk to him and responded by saying, “The suspect’s down inside they’re working on her now…(unintelligible).” Ofc. Anderson and Ofc. Gingrey continued walking.

Anderson 8329 Involved 10:04:02 Another officer asked Ofc. McNew, “Is he in cuffs?” Ofc. McNew responded by saying, “It’s a she and she is not. They’re rendering aid right now.”

Anderson 8329 Involved 10:46:48 Someone asked Ofc. McNew about the children. Ofc. McNew talked about who had the children.

McNew 7451 Involved 09:41:56 Ofc. McNew arrived.

McNew 7451 Involved 09:42:30 Ofc. McNew and Ofc. Anderson discussed the officer safety caution. Ofc. Anderson mentioned that he had been out to the address for a DV incident involving Subject Lyles’ son.

McNew 7451 Involved 09:44:45 Ofc. McNew said, “Oh she didn’t want to let them leave” and, “Don’t let her behind us”.

McNew 7451 Involved 09:45:22 Subject Lyles answered the callbox. Ofc. Anderson said, “Hi this is Officer Anderson, Seattle Police Department”. Subject Lyles opened the lockout building door via her phone.

McNew 7451 Involved 09:46:41 Officers Anderson and McNew contacted Subject Lyles and began the initial burglary investigation.

McNew 7451 Involved 09:49:03 A noise, followed by Ofc. McNew saying, “Get back”. Subject Lyles said, “Do it, do it”.

Summary:

Based on the physical evidence, along with witness and officer statements, the following occurred:

On 06/18/2017, at approximately 0855 hours, Subject Lyles, Charleena C DOB 04/24/1987 called 911 to report a burglary to her residence, 6818 62nd Ave NE #4303.

6818 62nd Ave NE is in an apartment complex called Brettler Family Place, which is owned by Solid Ground and managed by Mercy Housing. The building is in the back of the complex and is not visible from 62nd Ave NE.

Subject Lyles told the 911 call taker, “I would like to report a break in. Can an officer come to my house?” Subject Lyles reported, “I just walked in. I noticed that there’s some stuff missing out of my house and my door was open…” She advised the call taker, “…me and my kids are here” but no suspects were present. She reported that the lock on the door was “loose”. The call taker asked her, “What’s the time frame that we’re looking at here? Like could this have happened anytime overnight or did you leave to go to the store for an hour and came back and it was like that?” Subject Lyles said, “Yeah, I left to go to the store and came back but um…” The call taker asked to clarify the time frame. Subject Lyles replied, “It was (unintelligible) happened maybe about a few hours ago, or something. It wasn’t that long.” The call taker said, “So about the last two to three hours?” He received no response so he asked again, “So it would have happened within the last two to three hours?” Subject Lyles responded, “Yes”. The call taker advised Subject Lyles that an officer would respond and ended the 911 call.

At approximately 0859 hours, Officer Anderson #8329 was dispatched as a single officer to take the report. He has CIT training and was also certified to carry a Taser, but was not carrying it at the time of this incident. Officer Anderson was in full SPD uniform and was equipped with OC Spray and a baton as less lethal tools. Officer Anderson was driving a marked patrol vehicle equipped with Digital

In-Car Video (DICV), which was active and recording during the incident. Officer Anderson arrived at the location, parked his patrol vehicle, and conducted a routine record’s check on the address. Officer Anderson located an officer safety caution on Subject Lyles. See NCIC Officer Safety Caution below:

Officer Anderson read the report that resulted in the officer safety caution. The report detailed that officers had responded to Subject Lyles’ residence for a report of a physical domestic disturbance and during the contact, Subject Lyles brandished a large pair of scissors. (See SPD 2017-200822 for details). Due to the officer safety caution, Officer Anderson requested a second unit respond.

Officer McNew #7451 responded to the scene, arriving at approximately 0941 hours. He has attended the 40-hour Crisis Intervention Training (CIT) and several eight hour courses of annual additional CIT training. Officer McNew was in full uniform and carrying a baton as his less lethal tool. Officer McNew was driving a marked patrol vehicle equipped with Digital In-Car Video (DICV) which was active and recording during this incident.

Officer Anderson briefed Officer McNew about the officer safety caution on Subject Lyles as they walked to her apartment building. Officer Anderson buzzed Subject Lyles from the call box at the door of the lockout building. Subject Lyles allowed entry through the remote buzzer without incident.

At approximately 0946 hours, Officers Anderson and McNew knocked on Subject Lyles’ door. Subject Lyles answered the door. They exchanged pleasantries and Subject Lyles gave them permission to enter her apartment. Subject Lyles was wearing a black thigh length down jacket with a fur lined hood. The temperature inside of Subject Lyles’ apartment was warm. The door to Subject Lyles apartment opened

up into a hallway. To the left were two bedrooms and a bathroom. To the right there was a galley style kitchen and living room.

Interior of Subject Lyles’ Apartment (#4303)

Officers Anderson McNew began conducting a routine burglary investigation. Subject Lyles walked Officers Anderson and McNew to the back bedroom, reporting that a PlayStation 4 had been stolen from that bedroom. Subject Lyles then walked Officers Anderson and McNew back into the kitchen/living room area. Subject Lyles was standing next to the kitchen counter peninsula in the entrance to the living room, Officer McNew moved into the kitchen, and Officer Anderson stood in the area by the front door. Subject Lyles appeared to calmly answer Officer Anderson’s questions. Subject Lyles reported that an Xbox had also been stolen from the living room area. Both Officer Anderson and Officer McNew reported that they observed Subject Lyles move her hands in and out of her pockets but they did not tell her to keep her hands out of her pockets or frisk her. Officer Anderson explained that he did not frisk Subject Lyles for weapons because she was the victim of a crime, appeared to be calm and cooperative and didn’t present any threats at that time. Officer McNew explained that he did not frisk Subject Lyles for weapons because she was the complainant of a crime and inside her own apartment. He explained that Officers don’t generally frisk complainants or victims of crimes.

At approximately 0949 hours, Officer Anderson was reportedly looking at and writing notes in his notebook and saw Subject Lyles’ hand move from her right side then saw a flash of a knife. Subject Lyles, who was approximately three feet from Officer Anderson, reportedly pointed the blade at him,

and thrust the knife at him in a stabbing motion towards his stomach. Officer Anderson reported that he had to suck in his stomach and jump back to avoid being stabbed, dropping his notebook, which was later located at the scene on the floor in Subject Lyles’ apartment. Officer Anderson described Subject Lyles’ emotions had changed completely from when he was talking to her and when she tried to stab him. He described Subject Lyles as intensely focused like she was coming to get him.

Officer McNew reported that he was standing in the kitchen looking noting old pans of food, listening to Officer Anderson conducting his burglary investigation. Subject Lyles appeared to be calmly answering questions, and he was thinking that they were about done with the investigation when he heard a commotion. He looked up and saw Subject Lyles had a knife in her hand. Officer McNew described how Subject Lyles’ emotions had changed from calm, non-threatening, and nonchalant to her yelling with a grimaced face and her body being tensed with her muscles tightened and body postured.

Officer Anderson reported that he drew his department issued Glock 9 mm handgun, yelled the command “Get back” at Subject Lyles, and got on SPD North Radio and said, “Back up”. Subject Lyles stepped back a couple of feet toward the living room. The kitchen counter was partially between Subject Lyles and Officer McNew. There was nothing between Subject Lyles and Officer Anderson. Officer McNew reported that he drew his department issued Glock 9 mm handgun. Subject Lyles reportedly focused on Officer McNew, and raised the knife, which was in her right hand with the blade pointed at Officer McNew, over her shoulder. Officer McNew described Subject Lyles raising the knife as a “windup of a baseball player that’s about to throw something”. Officer McNew reported that he believed Subject Lyles was going to throw the knife at him so he ducked down to avoid being struck by the knife. Officer McNew reported that he didn’t feel the knife hit him so he stood back up and saw that Subject Lyles was now holding two knives; one in each hand.

Officer Anderson and Officer McNew both yelled the command “Get back” to Subject Lyles. Subject Lyles said, “Do it. Do it.” Officer McNew yelled to Officer Anderson, “Taser”. Officer Anderson said, “I don’t have a Taser.” Subject Lyles said, “You can’t do that either motherfuckers.” Officer McNew got on North Radio and said, “We need help. We got a woman with two knives.” On page sixteen of his first statement, Officer Anderson answered questions on why he was not carrying his Taser. The following is a paraphrased version of his explanation: He stated that his battery had died and because it wouldn’t be an effective tool without battery power, he put it in his locker and replaced it with OC spray. He was contemplating turning the Taser into the Taser coordinator and not carry it anymore but had not made the decision yet. He believed he had told his squad mates that he was no longer carrying his Taser. On page seventeen, paragraph five, of Officer Anderson’s first statement, he explained why he felt a Taser would not have been an effective tool at the time of the incident even if

the main hallway, through the fire door separating the hallway from the stairwell, and over to a window at the top landing of the stairwell in order to broadcast “One Union One, I don’t know if I’m getting out or not. We are in the…uh… building to the back of the property. It’s all the way in the back.”

Officer Schickler was the first arriving backup officer. Officer Schickler exited his patrol car and ran into the apartment building. Officer McNew, who was still holding told Officer Schickler the first priority was to get the children out safely. Officer Schickler entered the apartment and got

out of the bedroom. Officer McNew yelled to Officer Schickler, “Schick, cover his eyes”. Officer Schickler then recovered from the living room and took her and downstairs. Officer Schickler spotted a neighbor of Subject Lyles, , and asked if she would take the children and wait by a patrol vehicle. She stated that she would. Officer Schickler ran back upstairs and took from Officer McNew, handing him off to another officer outside. Officer Schickler and the next arriving officers, plain clothed FTO Officer Barton and his student, Officer Ladd, ran upstairs, confirmed that there were no more threats and the scene was secure, then began rendering first aid and performing CPR on Subject Lyles. The next arriving officers all began assisting in rendering first aid on Subject Lyles. Officer Anderson asked, “Do we have Fire in route?” Officer McNew got on the radio and asked if Fire was in route. He was advised that Fire was “staging” and asked if they could move in. Officer McNew said, “Affirm (yes), send them in.”

Seattle Fire Department Engine 38 arrived and went upstairs. The first arriving firefighter told the officers who were performing first aid and CPR on Subject Lyles to move her out into the main hallway so they would have more room to work. Officers and Firefighters moved Subject Lyles into the T intersection of the main hallway. Officers, Firefighters, and Paramedics continued their attempt to revive Subject Lyles but were unsuccessful. Paramedics contacted the King County Medic One doctor, who was at Harborview Medical Center, and provided him with information on Subject Lyles’ condition. Based on the assessment, the doctor advised them to cease life-saving efforts. Subject Lyles was pronounced deceased at the scene. Seattle Fire personnel cleaned up some of their equipment and cleared the scene, leaving Subject Lyles’ body in the main hallway.

Officer Proctor, Officer Sobania, and plain clothes FTO Officer Gray-McVey met with and took custody of Subject Lyles’ children. On DICV, Officer Gray-McVey asked what had happened. stated that he did not know and that he was sleeping and heard the gunshots. Seattle Victim Support Team personnel arrived and took custody of the children. The children were later taken into Child Protective Services custody. None of the children were physically injured.

Officer Anderson was asked if he believed he had any alternatives to the use of force. The following is an excerpt from Officer Anderson’s statement related to that question (Statement 3, Page 5, Paragraph 5): “There was no time. We didn’t have any shielding and we didn’t have distance between us. There was… literally feet between us.”

Officer McNew was asked if he believed he had any alternatives to the use of force. The following is an excerpt from Officer McNew’s statement related to that question (Page 18, Paragraph 11): “At the point where I decided to use force, as I explained before, the subject had unabated access to me, to my person, uh, and she was armed. I didn’t feel that there was any other…reasonable alternative.”

The King County Medical Examiners responded to the scene and took custody of Subject Lyles’ body. (KCME #1206) They transported her body to the King County Medical Examiners’ Office. An autopsy was conducted by the King County Medical Examiner’s Office on 06/19/2017. The autopsy revealed that Subject Lyles was struck seven times by gunfire:

• Entrance wound midline abdomen

• Entrance wound right abdomen

• Grazing wound right side chest

• Entrance wound right hip

• Entrance wound right back

• Entrance wound left back

• Entrance wound right arm

The autopsy also revealed that Subject Lyles was approximately 14-15 weeks pregnant. Toxicology reports revealed that Subject Lyles did not have alcohol or detectable narcotics in her system at the time of the incident. The King County Medical Examiners’ Office determined Subject Lyles’ cause of death was multiple gunshot wounds sustained in a confrontation with police. The manner of death was classified as a homicide.

Video from the hallway outside of Subject Lyles’ apartment for the 24 hours prior to the incident was obtained. Upon reviewing the video, it was determined that no one entered her apartment during the timeframe in which Subject Lyles reported that the burglary had occurred, and that Subject Lyles had not left the apartment to go to the store on the morning of 06/18/2017. Subject Lyles had briefly left her apartment to take the garbage out but nobody entered her apartment during the time she was gone.

Investigation:

1. 06/18/2017 1044 hours: Received a call from Det. Simmons, who relayed to me, that there was an OIS and that I needed to respond. He provided me with an address for the scene, 6818 62nd Ave NE #4303. It was my furlough and I was not at home at the time so I explained that I would be a little delayed in response.

2. 06/18/2017 1145 hours: I arrived at the scene and received a briefing of the incident by A/Lt. Peter Pieper. I learned that officers had been dispatched to a non-in progress burglary call at 6818 62nd Ave NE #4303. A check of the address showed that the complainant, later identified as Subject Lyles, Charleena C DOB 04/24/1987, had an NCIC hit listing her as a “threat to law enforcement”. The caution was in response to an incident that occurred on 06/05/2017, where she threatened officers with a large pair of scissors and repeatedly made homicidal statements towards officers during the encounter. Although a non-in-progress burglary would typically be a single officer call, two officers responded due to the hazard. At some point while taking the report, Subject Lyles produced a knife and threatened officers. Both officers fired their duty weapons. Subject Lyles was pronounced deceased by SFD. Three children were present during the incident. I learned that the involved officers were S. McNew and J. Anderson. I inquired if DICV had been shut down. He stated that it had. I inquired if there were any other injuries to officers or civilians. He stated that there were not. I inquired if Public Safety Statements had been obtained. I learned that A/Sgt. Schroeder had issued the Public Safety Statements and that both Officers Anderson and McNew had been separated and assigned an officer to stay with them. I advised that I would need the Public Safety Statements.

3. 06/18/2017 1155 hours: I met with Homicide Det. Mooney. He stated that he had arrived earlier and had went up to the apartment with CSI Sgt. Grinstead. He explained that there was a knife visible just inside the doorway. I pointed out the visible surveillance cameras to Det. Mooney. I asked if he would work on getting a copy of any video showing the incident or SPD response. He said he would.

4. 06/18/2017 1200 hours: I spoke with CSI Sgt. Grinstead and explained that I was the primary detective on the case and would need to observe the scene. He said that they were currently photographing the hallway area and had not been inside yet. He explained that he would let me know when I could enter the scene.

5. 06/18/2017 1205 hours: I observed the partial scene in the hallway from the top of the stairwell near the fire door. I observed the body of Subject Lyles in the hallway, strapped to a backboard. I could not see the apartment where the shooting occurred.

6. 06/18/2017 1208 hours: I spoke with Officers Schickler, Barton, Murphy, and Ladd who had attempted first aid. I inquired if they had witnessed the shooting. They had not. I asked them if Subject Lyles had said anything to them. She had not. I asked if they had any biohazard contaminates on their clothing. One of the officers had some blood on his duty boots. I advised them if they did have biohazard contamination, to go change and head to the FIT office per A/Capt. Hirjak. Officer Ladd provided the name of a witness who had heard the gunshots:

7. 06/18/2017 1210 hours: I met with Det. Mooney. He provided me with the case number for the hazard report on file (2017-200822). He advised that he had spoken with

and had arranged to get surveillance video from 0855 hours to 1100 hours.

8. 06/18/2017 1215 hours: I spoke with Ofc. Nelson and his student, Ofc. Hogg. He provided me with a handwritten list of incidents that Subject Lyles had been listed in the SPD report system since 05/15/2017. The list contained five previous incidents and gave a brief description of whether Subject Lyles was the victim, suspect, or other, and what the report was for. It also had a brief description of this incident at the top. The back of the paper had an unrelated statement crossed out by a large X.

9. 06/18/2017 1225 hours: I met with and briefed Sgt. Verhaar and Det. Corbin on what I knew so far.

10. 06/18/2017 1233 hours: Along with Lt. Fitzgerald, myself and Det. Corbin met with the siblings of Subject Lyles, . Lt. Fitzgerald explained to the family that Subject Lyles was deceased and that Seattle Police had shot her. They explained that they knew she was struggling with mental health problems but were upset that she was shot.

11. 06/18/2017 1245 hours: I stood by while Det. Corbin attempted to get an audio statement from . Miss refused to provide a recorded statement but was willing to give a statement if it wasn’t recorded.

12. 06/18/2017 1302 hours: I was advised by A/Capt. Hirjak that we would not be attempting to interview Subject Lyles’ children today. He stated that they could be interviewed on a later date using the child interview protocols established by the King County prosecutor’s office.

13. 06/18/2017 1310 hours: I observed persons from the King County Medical Examiner’s Office (KCME) arrive and enter the crime scene.

14. 06/18/2017 1355 hours: I spoke with the KCME Investigator who took custody of Subject Lyles’ body. She explained to me the property that Lyles still had on her person and I signed the paperwork acknowledging it. I inquired about the autopsy and was told that it would probably be tomorrow at approximately 0830 hours. She advised me to call in the morning before the autopsy to confirm.

15. 06/18/2017 1415 hours: I conducted a scene walkthrough with Ofc. McNew. Also present were Det. Corbin, SPOG Rep. Hughey, Attorney Karen Cobb, CSI Sgt. Grinstead, and CSI Det. Biggs. At the direction of Officer McNew, Det. Biggs first placed placard A where Ofc. McNew believed he was when he first saw the knife. At the direction of Officer McNew, Det. Biggs placed placard B where Ofc. McNew believed Subject Lyles was when he first saw the knife. I photographed the location of the placards. Det. Biggs then placed placard A where Ofc. McNew believed he was at the time shots were fired. Det. Biggs then placed placard B where Ofc. McNew believed Subject Lyles was at the time shots were fired. I photographed the location of the placards.

16. 06/18/2017 1435 hours: I left the scene and drove to the FIT Office.

17. 06/18/2017 1455 hours: I arrived at the FIT Office. I briefed A/Capt. Hirjak, Sgt. Veerhar, OPA Lt. Strozier, and Sgt. Truscott from training on what I had learned so far. I was directed by A/Capt. Hirjak to conduct a round count as soon as possible.

18. 06/18/2017 1530 hours: I conducted a round count of Ofc. McNew’s department issued Glock 17 9mm (Serial #RVD552). There was one round chambered in his firearm. Twelve rounds in the magazine that was in his weapon (magazine #1), sixteen rounds in magazine #2, and sixteen rounds in magazine #3, for a total of 45 rounds. Det. Corbin photographed the round count and uploaded the photos into DEMS and the case file. I did a weapons exchange and provided Ofc.

Anderson’s department issued Glock 17 9mm (Serial #WMZ479). There was one round chambered in his firearm. Twelve rounds in the magazine that was in his weapon (magazine #1), sixteen rounds in magazine #2, and sixteen rounds in magazine #3, for a total of 45 rounds. Det. Corbin photographed the round count and uploaded the photos into DEMS and the case file. I did a weapons exchange and provided Ofc. Anderson with a new department issued Glock 17 9mm (Serial #PUN846). I packaged Ofc. Anderson’s duty weapon and placed it in a secured locker in my office. Based on shell casings and bullets recovered at the scene, it was later determined that Officer Anderson fired four rounds.

19. 06/18/2017 1550 hours: I learned from A/Capt. Hirjak that I was not going to be interviewing Ofc. Anderson today.

20. 06/18/2017 1600 hours: I spoke with SPOG Rep. Hughey and Attorney Cobb. I scheduled Ofc. Anderson’s interview for 06/20/2017 at 0930 hours.

21. 06/18/2017 1730 hours: I took a recorded statement from Ofc. McNew (See transcribed statement). Also present during Officer McNew’s statement were FIT Det. Corbin, Sgt. Verhaar, SPOG Rep. Hughey, Attorney Cobb, and OPA Sgt. Beemster. Upon completion of the interview, Ofc. McNew’s statement was uploaded into DEMS and the case file. A CD copy was provided to Ofc. McNew, SPOG Rep. Hughey, and Attorney Cobb. I scheduled a preliminary date for Ofc. McNew’s follow-up interview (06/23/2017 at 1300 hours).

22. 06/19/2017 0742 hours: I called the King County Medical Examiner’s Office. I inquired on what time the autopsy of Subject Lyles would be. I was told it should start around 0800 hours.

23. 06/19/2017 0810 hours: I arrived at the King County Medical Examiner’s Office to attend the autopsy of Subject Lyles. I spoke with Dr. Brian Mazrim, the pathologist who would be performing the autopsy. Per his request, I provided him with a briefing on how many shell casings and rounds were located at the scene. I was provided with the KCME case number (17-1206).

24. 06/19/2017 1038 hours: I received a briefing by Dr. Mazrim. I learned that Subject Lyles had seven gunshot entry wounds. Dr. Mazrim verified that Subject Lyles was pregnant and estimated

that she was 14 to 15 weeks along. There were no other signs of injury or illness. I learned that three fired bullets were located in Subject Lyles’ body.

25. 06/19/2017 1305 hours: I learned that CSI had located seven fired cartridge casings, four fired bullets, and seven knives; two of which were on the floor, in the apartment.

26. 06/20/2017 Out sick.

27. 06/21/2017 0915 hours: Myself, Det. Simmons, and Video Specialist II J. Fong with the SPD Video Unit, drove to 6818 62nd Ave NE and met with , the Director of Planning, Development, and Operations for Solid Ground. escorted us to the server room for the building. Video Specialist II Fong successfully uploaded video from the building showing the 24 hours prior to the shooting.

28. 06/21/2017 1100 hours: I reviewed the video from the previous 24 hours. I verified that no burglary had occurred to Subject Lyles’ apartment as reported. I verified that Subject Lyles had not left the apartment to go to the store prior to the 911 call reporting the burglary. I determined that between 06/17/2017 at 1850 hours (based on the timestamp in the video, which is approximately 10 minutes slow), and 06/18/2017 at 0858 hours.

29. 06/21/2017 1357 hours: I called Ofc. Anderson and inquired where his Taser was. He stated that it was in his locker at the Seattle Police North Precinct. I asked if we had permission to retrieve his Taser from his locker. He stated that we could and provided me with the combination for his locker. I asked Ofc. Zylak if he could drive to the North Precinct and retrieve the Taser, which he did.

30. 06/21/2017 1500 hours: I called the KCME to inquire about the toxicology report and confirmation on the number of rounds located in Subject Lyles’ body. I left a voicemail requesting contact.

31. 06/21/2017 1615 hours: I conducted a Taser download of Ofc Anderson’s Taser. It revealed that on 06/08/2017, Ofc. Anderson had performed a spark test at 0328 hours. The Taser performed a “Low Battery Reset”. Ofc. Anderson tried two more times and the Taser performed a “Low Battery Reset” each time. The Taser had not been activated until I activated it, upon receiving it at 1605 hours. I observed the screen of the Taser read “Change Battery”. I

32. 06/21/2017 1750 hours: I called Subject Lyles’ sister . I inquired about interviewing the children. I explained that I would arrange for an expert in interviewing children to conduct the interview. She stated that she believed it would be ok but stated that she wanted to talk to the rest of Subject Lyles’ family. I provided her with my contact information and requested she call me back when they had discussed it and made a decision.

33. 06/22/2017 0900 hours: I was told by A/Capt. Hirjak to write a search warrant for records pertaining to complaints obtained by Solid Ground against Subject Lyles, complaints made by Subject Lyles to Solid Ground, and any action taken by Solid Ground. I was also tasked with writing a search warrant to examine three cell phones recovered by CSI for any data. I completed the search warrant for records from Solid Ground. I asked Det. Simmons to write the search warrant for the cell phone records.

34. 06/22/2017 1033 hours: I conducted the follow-up interview of Ofc. McNew. Also present were FIT Det. Corbin, FIT Sgt. Davisson, OPA Sgt. Beemster, SPOG Rep. Stuckey, and Attorney Ted Buck. Upon completion of the interview, I uploaded Ofc. McNew’s statement into DEMS and the case file. I then made a CD copy for Ofc. McNew, SPOG Rep. Stuckey, and Attorney Ted Buck.

35. 06/22/2017 1156 hours: I sat in on the follow-up interview of Ofc. Anderson. Also present were FIT Sgt. Davisson, OPA Sgt. Beemster, SPOG Rep. Stuckey, and Attorney Ted Buck. Upon completion of the interview, I uploaded Ofc. Anderson’s statement into DEMS and the case file. I then made a CD copy for Ofc. McNew, SPOG Rep. Stuckey, and Attorney Ted Buck.

36. 06/23/2017 1130 hours: I drove to the King County Courthouse with Det. Simmons. We met with King County Superior Court Judge H. Hill. She reviewed my search warrant and stated that she was not going to sign it. She stated that the information being requested could most likely be obtained via subpoena on a later date. She reviewed the search warrant for the cell phones and signed it.

42. 06/26/2017: 0630 hours: I received an SPD Tip Sheet. The tip was received on 06/23/2017. The tipster, , is an employee of Solid Ground. He reported that a Solid Ground Staff member had taken a report from a resident regarding Subject Lyles having pulled a knife on a ten-year old boy and threatening to kill him. The staff member was able to review a video of the incident, contacted the involved victim, and completed an internal report but did not contact Seattle Police. He claimed that he had copies of emails and other files from staff members related to the incident. wished to remain anonymous out of fear of retaliation by his boss but was willing to be contacted over the phone and/or meet in person for further information.

43. 06/26/2017 1300 hours: I called . He stated that he is the for Solid Ground. He stated that initially he wished to remain anonymous but

decided that he is willing to be named because he is concerned that Solid Ground is covering up information that could have prevented the shooting. He also believed that some of the employees that were made aware of the incident in which Subject Lyles threatened to kill the ten-year old resident, are mandatory reporters of that type of behavior and they had not reported it to the police. Mr. stated that he had sent emails regarding the follow up in that incident and inquired why it hadn’t been reported to the police. He stated that he was basically told to drop it. Mr.

stated that he was not at work today so he did not have access to the email and reports but stated that if I needed them that he would send them to me tomorrow when he was at work.

mentioned that he was home and awoke to sirens like her but he was not home when detectives took her statement.

141. 08/08/2017 1608 hours: I attempted to call , the mother of , who provided a statement on the day of the incident. In statement she

mentioned that her mother was at work but didn’t say whether she was home at the time of the incident. also mentioned her older brother was home but no statement was taken from him. I received an automated message saying the number was not reachable.

142. 08/08/2017 1630 hours: I called , who lives in apartment # I took a recorded statement from I later uploaded his statement into the case file and DEMS. In his statement, stated that he heard shots and within seconds was looking out the peep hole of his apartment door, and saw Subject Lyles on the ground in the main hallway with nobody around. Surveillance video from the main hallway, and DICV audio contradicts that time frame. also stated that he observed officers and firefighters doing CPR.

In her statement, she mentioned that her two teenage children were home as well but no statements were taken. She stated that her children were out of town this week. 153. 08/14/2017 1010 hours: I received an email from FIT A/Capt. Hirjak that I needed to coordinate access to Subject Lyles’ apartment so a laser scan of the residence could be conducted. I was furloughed but responded that I would arrange it as soon as possible.

154. 08/14/2017 1428 hours: I received another email from FIT A/Capt. Hirjak advising that it would be an outside contractor conducting the scan of the apartment.

155. 08/15/2017 0841 hours: I called with Solid Ground. I explained that we needed access to Subject Lyles’ apartment. He stated that Solid Ground has a company coming out later in the week to decontaminate the apartment due to the methamphetamine contamination.

156. 08/15/2017 0842 hours: I called A/Capt. Hirjak and advised him of the need to expedite the scan process. He advised me that we could have the person conducting the scan here on 08/16/2017.

157. 08/15/2017 0844 hours: I called and explained that we could conduct the scan on 08/16/2017. He stated that Solid Ground would only grant access to the apartment with a search warrant. I explained that we would obtain a search warrant. He also explained that due to the methamphetamine contamination, whoever entered the apartment would need to “suit up” per state law.

158. 08/15/2017 0854 hours: I called A/Capt. Hirjak and explained that Solid Ground was demanding a search warrant for us to enter the apartment. I also explained that anyone who entered the apartment would need to wear protective equipment due to the contamination. He relayed that the person conducting the scan would be available in the afternoon. Probably around 1400 hours.

use of Tyvek suits and gloves. She explained that for entrances into the apartment in short stints, no masks or respirators would be needed. She stated that for that length, her company would use a half respirator with double stack cartridges/filters.

202. 08/28/2017 1300 hours: I called the WSP Toxicology Lab. I spoke with , the Forensic Scientist who conducted the Toxicology Report on Subject Lyles. I inquired on how long methamphetamine remains in the blood stream. She explained that meth has a half-life of six to fifteen hours, meaning that within that time, half of the dose someone took would be metabolized through the blood stream. Within twelve to thirty hours, it is no longer detectable in the blood. I inquired whether exposure to levels of methamphetamine from within the apartment would be enough to register in the blood. She explained that most likely it would not. I inquired whether tests were done to detect any prescription medications. She stated that they had and none were

detected. She explained that some medications may not be detected using the current test WSP uses. There is currently no way to test for those medications.
