CHANGES 2012-2013 Bullying added as new offense type

Non-drug, non-violent, and non-criminal related offense has been added as a new offense type

Any offense committed by any student (general education students and students with disabilities) which results in an in-school or out-of-school suspension must be reported

BULLYING "Bullying" for the purposes of requirements related to Chapter 92

of the Acts of 2010 legislation is defined as the following:

The repeated use by one or more students [aggressor(s)] of a written, verbal or electronic expression or a physical act or gesture or any combination thereof, directed at a target that: (i) causes physical or emotional harm to the target or damage to the target's property; (ii) places the target in reasonable fear of harm to him/herself or of damage to his/her property; (iii) creates a hostile environment at school for the target; (iv) infringes on the rights of the target at school; or (v) materially and substantially disrupts the education process or the orderly operation of a school. For the purposes of requirements related to this law, bullying shall include cyber-bullying. See section 5 of the legislation for more details on the definition of cyber-bullying and more.

Prohibition of Bullying, Cyber-Bullying and Retaliation

Acts of bullying, cyber-bullying, and retaliation are prohibited: on school grounds, property immediately adjacent to school grounds, at

a school sponsored or school related activity, function or program whether  on or off school grounds, at a school bus stop, on a school bus or other vehicle owned, leased or used by a school district or school, or through the use of technology or an electronic device owned, leased or used by a school district or school and

at a location, activity, function or program that is not school related, or through the use of technology or an electronic device that is not owned, leased or used by a school district or school, if the bullying creates a hostile environment at school for the target, infringes on their rights at school or materially and substantially disrupts the education process or the orderly operation of a school. Nothing contained herein shall require schools to staff any non school related activities, functions, or programs.

Data reviews have shown that the balance between student offenders and disciplinary actions is skewed Student offenders are being reported without a

disciplinary action ESE expects to see a discipline record for all

offenses and is implementing a validation designed to ensure that there are disciplinary records for at least 85% of reported student offenders

New Report - View Offense/Discipline Count Comparison Report

This report will be available from the open date through the close date of the SSDR

It is recommended that this report is monitored to prevent any last minute issues

Report will display all of the offenses where the number of students disciplined is less than the number of student offenders. Data is only displayed if the 85% calculation is not met.

If the threshold of 85% is met, the report will show no data and you will see the following message: “You have met the 85% threshold for reporting all of the

discipline records for your student offenders”
