    BILL SUMMARY

    The Public Employee Collective Bargaining Law

    Community schools

    Prohibitsemployeesofcommunityschoolsfromcollectivelybargaining,exceptfor

    conversioncommunityschools.

    Allows the governing authority of a conversion community school to opt out of

    collectivelybargainingwiththecommunityschoolsemployees.1

    Police and fire department supervisors

    Removesa limitationon thedefinitionof supervisor withrespect tomembersof

    police and fire departments, potentially making more people supervisors and

    ineligibletocollectivelybargain.2

    Contract employees and employees of regional councils of government

    Excludespersonsworkingpursuant toa contractbetweenapublic employerand

    privateemployerandoverwhomtheNationalLaborRelationsBoardhasdeclined

    jurisdictionfromthosepersonseligibleforcollectivebargaining.3

    Excludesemployeesofaregionalcouncilofgovernmentfromthosepersonseligibleforcollectivebargaining.4

    Faculty of state institutions of higher education

    Adds faculty who participate in the governance of a state institution of higher

    education, who are involved in personnel decisions, selection or review of

    administrators, planning and use of physical resources, budget preparation, and

    determination of education policies related to admissions, curriculum, subject

    matter, and methods of instruction and research to those employees who are

    consideredmanagement

    Requires the public employer to deduct from the compensation of a striking

    employeeanamountequaltotwicetheemployeesdailyrateofpayforeachdayor

    partthereofthattheemployeeengagedinastrike.10

    Providesthatanemployeethatstrikesinviolationofaninjunctioncanbefinedno

    morethan$1,000orimprisonedfornolongerthan30days.11

    Bargaining units and exclusive representatives

    Changes the time limitationswithinwhich theStateEmploymentRelationsBoard

    mustactuponarequestforrecognition.12

    Allows the Board to determine appropriate units, remove classifications from a

    bargainingunit,orholdanelectionregardlessofanagreementoramemorandumof

    understandinggrantingnonexclusiverecognition.13

    Removes

    the

    provision

    prohibiting

    the

    appeal

    of

    a

    decision

    of

    the

    Board

    that

    determinestheappropriatebargainingunit.14

    Prohibitsanappropriateunitof firefighters from includingrankand filemembers

    Subjects for collective bargaining

    Makesthefollowinginappropriatesubjectsforcollectivebargaining: (1)employer

    paidcontributionstoanyofthefivepublicemployeeretirementsystems,(2)health

    carebenefitsforwhich theemployer isrequired topaymorethan85%of thecost,

    (3)theprivatizationofapublicemployersservicesorcontractingoutofthepublicemployers work, and (4) the number of employees required to be on duty or

    employedinanydepartment,division,orfacilityofthepublicemployer.16

    Permitspublicemployerstonotbargainonanysubjectreservedtothemanagement

    anddirectionofthegovernmentalunit,evenifthesubjectaffectswages,hours,and

    termsandconditionsofemployment.17

    Prohibits an existing provision of a collective bargaining agreement that was

    modified,renewed,orextendedthatdoesnotconcernwages,hours,andtermsand

    conditionsfrombeingamandatorysubjectofcollectivebargaining.18

    Allowsthepublicemployertodoanyofthefollowing,unlessthepublicemployer

    specifically agrees otherwise in an express written provision of a collective

    bargainingagreement:

    o Hire,discharge,transfer,suspend,ordisciplineemployees;

    o Determinethenumberofpersonsrequiredtobeemployedorlaidoff;

    o

    Determinethe

    qualifications

    of

    employees;

    o Determine the starting and quitting time and the number of hours to be

    workedbyitsemployees;

    o Makeanyandallreasonablerulesandregulations;

    o Determinetheworkassignmentsofitsemployees;

    o Determinethebasisforselection,retention,andpromotionofemployees;

    o Determinethetypeofequipmentusedandthesequenceofworkprocesses;

    o Determinethemakingoftechnologicalalterationsbyrevisingeitherprocess

    orequipmentorboth;

    o Determine work standards and the quality and quantity of work to be

    produced;

    o Selectandlocatebuildingsandotherfacilities;

    o Establish,expand,transfer,orconsolidateworkprocessesandfacilities;

    o Transferorsubcontractwork;

    processes,orworkwithor to anyothermunicipal corporationor entityor

    effectorchangeinanyrespectthelegalstatus,management,orresponsibility

    ofsuchproperty,facilities,processes,orwork;

    o Terminateoreliminatealloranypartofitsworkorfacilities.19

    Collective bargaining agreement provisions and approval

    Prohibitsacollectivebargainingagreementfromprohibitingapublicemployerthat

    isinastateoffiscalemergencyfromservingawrittennoticetoterminate,modify,

    ornegotiatetheagreement.20

    Prohibitsacollectivebargainingagreementfromprohibitingapublicemployerthat

    is in a state of fiscalwatch from serving awritten notice tomodify a collective

    bargainingagreementsothatsalaryorbenefitincreases,orboth,aresuspended.21

    Prohibitsacollectivebargainingagreementfromprohibitingapublicemployerfrom

    enteringintoacontractwithanotherpublicorprivatesectorentitytoprivatizethe

    publicemployersservicesorthecontractingoutofthepublicemployerswork.22

    Prohibitsa collectivebargainingagreement from containingaprovision thatdoes

    anyofthefollowing:

    o Limitsapublicemployerindeterminingthenumberofemployeesitemploys

    orhasworkingatanytime,inanyfacility,building,classroom,onanywork

    shift,

    or

    on

    any

    piece

    of

    equipment

    or

    vehicle;

    o Provides for thepublicemployer topayanyportionofapublicemployees

    statepensioncontributionsorpayments;

    o Providesforanhourlyovertimepaymentratethatexceedstheovertimerate

    requiredbythefederalFairLaborStandardsAct.

    o Requiresthepublicemployer toadhereto,follow,orcontinueanypractices

    orbenefitsnot specifically set forth in thespecificwrittenprovisionsof the

    agreement.23

    Prohibits a collective bargaining agreement from containing certain provisions

    regardingthedeferredretirementoptionplan.24

    Prohibits a collective bargaining agreement from containing any provision that

    allowsaccrualofleavecreditsinexcessofthefollowing:

    o 6weeksannuallyofpaidvacationpriorto20yearsofservice;

    o 12paidholidaysannually;

    o 3paidpersonaldaysannually.25

    Prohibits a collective bargaining agreement from containing a provision for the

    exchangeorsellbackofapublicemployeesaccumulatedpaidsickleavebalanceat

    thepublicemployeesfinalretirementordeaththatprovidesforacashpaymentthat

    exceeds 50% of the public employees total sick leave accumulations and for

    accumulatedsickleaveinexcessof1,000hours.26

    Prohibitsapublicemployerfromagreeingtoaprovision inacollectivebargaining

    agreementthatrequiresthepublicemployer,whenareductioninforceisnecessary,

    touseemployeelengthofserviceastheonlyfactorwhenmakinglayoffs.27

    Prohibitsapublicemployerfromagreeingtoaprovision inacollectivebargaining

    agreement that requires the employer topaymore than 85% of the costpaid for

    benefits.28

    Requires theparties to consider,whendetermining the abilityof the employer to

    pay for any terms, only the financial status of the employer at the time period

    surroundingthenegotiationsandtheemployersinabilitytopayforthoseterms.29

    Prohibitsthepartiesfromconsidering,whendeterminingtheabilityoftheemployer

    to pay for any terms, any potential future increase in the income of the public

    employer thatwouldonlybepossibleby theemployerraisingrevenue, including,butnot limited to,passinga levyorabond issue,or theemployersability tosell

    assets.30

    Conflicting provisions of agreements

    Makes lawspertainingto theprovisionofhealthcarebenefitstopublicemployees

    prevailoverconflictingcollectivebargainingagreements.31

    School districts, educational service centers, community schools, and STEMschools

    Prohibits a public employer that is a school district, educational service center,

    community school, or STEM school from entering into a collective bargaining

    agreement thatdoes specified things, suchas establishingamaximumnumberof

    studentswhomaybeassignedtoaclassroomorteacher.32

    Requirescollectivebargainingagreementsbetweensuchaneducationrelatedpublic

    employerandpublicemployeestocomplywithallapplicablestateorlocallawsor

    ordinances regarding wages, hours, and terms and conditions of employment,

    unless

    the

    conflicting

    provision

    establishes

    benefits

    that

    are

    less

    than

    provided

    in

    the

    laworordinance.33

    Requires the employer and the State Employment Relations Board to post in a

    conspicuouslocationonthewebsitemaintainedbytheboardandtheemployerthe

    termsof the lastcollectivebargainingagreementsofferedbytheemployerand the

    exclusiverepresentativeatspecifictimes.35

    Revises the factors that a person or group administering an alternate dispute

    resolutionproceduremusttakeintoaccount.36

    If either party rejects a fact finding panels recommendations, permits the public

    employer to implement, inwhole or inpart, any of those recommendations that

    havebeenapprovedbytheappropriatelegislativeauthority.37

    Removes the mandatory final offer settlement conciliation procedure for public

    employeeswhodonothavetherighttostrike.38

    Requiresapublicemployer toreportcertain informationaboutcompensationpaid

    topublicemployeesunderacollectivebargainingagreement.39

    Specifies that expressions ofviews, opinions, and arguments arenotunfair labor

    practices,andcannotbeusedasevidenceofsuch,withoutathreat.40

    Reviseswhatconstitutesanunfairlaborpractice.41

    Public employee pay

    Createssalaryrangesbyremovingthestepsfromthesalaryschedules.44

    Requires meritbased pay for most public employees, including board and

    commissionmembers,andmakesother,relatedchanges.45

    Requiresperformancebasedpayforteachersandnonteachingschoolemployees.

    o Requiresaschoolboardtomeasureperformancebyconsideringthelevelof

    license theteacherholds,whetherthe teacher isa highlyqualifiedteacher,

    thevalueaddedmeasuretheboardusestodeterminetheperformanceofthe

    students assigned to the teachers classroom, the results of the teachers

    performanceevaluationsorpeerreviews.46

    Prohibits apublic employer from violatingOhio or federal civil rights lawwhen
