REGULAR MEETING WEDNESDAY, JULY 1, 2020

1. CALL TO ORDER/ROLL CALL/PLEDGE OF ALLEGIANCE The Sauk Centre City Council met in a Regular Meeting on Wednesday, July 1, 2020 at 6:30 p.m. due notice being given thereof. Present were Council Members Joe Fuechtmann, Diane Kelly, Keith Johnson, Heidi Leach and Mayor Warren Stone. Also present was City Administrator Vicki Willer, Police Chief Friedrichs, Public Works Supervisor Clink, City Planner Morton and City Engineer Yapp. Mayor Stone presided thereat. 2. APPROVAL OF AGENDA A motion was made by Council Member Leach and was seconded by Council Member Kelly to approve the agenda, with changes. A vote being recorded as follows: For: Council Members Leach, Kelly, Johnson, Fuechtmann and Mayor Stone. Against: None. The motion passed. 3. APPROVAL OF MINUTES A motion was made by Council Member Kelly and was seconded by Council Member Fuechtmann to approve the July 1, 2020 Regular Meeting Minutes, with changes. A vote being recorded as follows: For: Council Members Kelly, Fuechtmann, Johnson and Mayor Stone. Against: None. Abstain: Council Member Leach. The motion passed. 4. PUBLIC OPEN FORUM (Comments Limited to 3 Minutes) None. 5. PUBLIC HEARINGS None. 6. REPORTS/PRESENTATIONS a. Removed from agenda. b. City Engineer Yapp updated the Council on the following projects: 2018 Project:

• Complete with the exception of the re-seeding which will happen this fall. Retainer will be held until re-seeding is complete.

2020 Project:

• Pipe work has begun and should take approximately 2-3 weeks • Street work will begin following pipe work • Easements – see 7e

7. ACTION ITEMS a. On June 3, 2020, the City Council approved the sale of the City’s older hotmix trailer. The

trailer was advertised through online bidding with MinnBid with the successful buyer listed below.

Council Member Johnson introduced Resolution No. 2020-49, Resolution Authorizing Sale of Excess Vehicles. The motion was seconded by Council Member Leach. A vote being recorded as follows: For: Council Members Johnson, Leach, Fuechtmann, Kelly and Mayor Stone. Against: None. The motion passed.

b. Stearns County Attorney’s Office has released the following to the City as a forfeited

vehicle: 2003 Dodge Ram

Council Member Fuechtmann introduced Resolution No. 2020-50, Resolution Declaring Property as Excess and Authorizing Advertisement for Sale. The motion was seconded by Council Member Kelly. A vote being recorded as follows: For: Council Members Fuechtmann, Kelly, Leach, Johnson and Mayor Stone. Against: None. The motion passed.

c. The City leases the mezzanine of the Civic Arena to the Department of Public Safety for

Driver’s License Testing. The lease is Wednesday morning on a weekly basis. The lease is up for renewal and the Department is requesting to continue. The lease amount is $2,340 per year. A motion was made by Council Member Kelly and was seconded by Council Member

Leach to approve Amendment No. 4 to Lease No. PS0257 with the State of Minnesota. A vote being recorded as follows: For: Council Members Kelly, Leach, Johnson, Fuechtmann and Mayor Stone. Against: None. The motion passed.

d. The City previously approved multiple Outdoor Premise Permits allowing alcohol

establishments to serve alcohol outdoors during the time the Shutdown did not allow indoor seating.

With indoor seating now allowed on a limited basis, the Council should decide if the Permits are now void or if they should continue until indoor seating is no longer limited. A motion was made by Council Member Kelly and was seconded by Council Member Leach to approving continuing Outdoor Premise Permits until seating limitations are lifted. A vote being recorded as follows: For: Council Members Kelly, Leach, Fuechtmann, Johnson and Mayor Stone. Against: None. The motion passed.

e. Easements for the 2020 Public Improvement Project have been secured and are ready for

payment as follows:

g. Pam Borgmann, representing the CVB is requesting that the City Council approve a streetclosure for Sinclair Lewis Avenue from Main St. to Oak St. for an Art Crawl on September19, 2020 from 8:00 a.m. to 5:00 p.m.

A motion was made by Council Member Kelly and was seconded by Council MemberLeach to recommend Stearns County approval of a street closure for an Art Crawl onSeptember 19, 2020 from 8:00 a.m. to 5:00 p.m. A vote being recorded as follows: For:Council Members Kelly, Leach, Fuechtmann, Johnson and Mayor Stone. Against: None.The motion passed.

h. Application has been received from David Eke representing D&K Beltline Properties fora minor subdivision (lot split) of Lot 1, Block 1, Sauk Centre Industrial Park. The propertyis located at 414 Lincoln Loop.

A Certificate of Survey has been provided and all property pins have been located or set.The proposal is to split off a portion of the southerly half of Lot 1 and add it to the northerlyhalf of lot 1. The property is zoned I/C and meets all zoning criteria. The intent of the splitis to create a larger northerly lot.

Council Member Fuechtmann introduced Resolution No. 2020-51, Resolution ApprovingMinor Subdivision. The motion was seconded by Council Member Kelly. A vote beingrecorded as follows: For: Council Members Fuechtmann, Kelly, Leach, Johnson andMayor Stone. Against: None. The motion passed.

i. The HRA is submitting a tax credit application to MN Housing on July 16. If awarded (wewill know last Thursday in December) the Ridge Apartments will go through a substantialrehabilitation starting in October of 2021. Scope of works as follows:

• All new flooring in each unit and common areas.• All new kitchen and bathroom cabinets and countertops.• All new appliances.• All new plumbing fixtures.• All new integrated LED lighting in units and common areas.• All new doors, trim and hardware in units and common areas.• All new parking lot.• Air Source Heat Pumps for all units.• Air-to-Air Exchange for common areas.• Replace exterior doors and add handicapped accessible door.• All new siding, shingles and garage doors on garages.

Work will start in October 2021 and be complete the following spring once the parking lot has been replaced.

The HRA has requesting the support of the City Council for this project.

Council Member Kelly introduced Resolution No. 2020-42, Resolution Supporting Affordable Housing Rehab Proposal. The motion was seconded by Council Member Fuechtmann. A vote being recorded as follows: For: Council Members Kelly, Fuechtmann, Leach, Johnson and Mayor Stone. Against: None. The motion passed.

8. UNFINISHED BUSINESS None. 9. NEW BUSINESS a. Mike Wiesser, representing Artify, submitted a proposal for 6 “book benches” to be

installed around the community. The benches are painted to resemble books.

Potential locations include: Oak/5th St. Triangle, Jaycee Park, Sinclair Lewis Park, Community Garden or Conservation Park, Jitters, Boyhood Home, Learning Tree, Posit Office & Bike Trail. Because several of the locations are on City property, approval is sought for the placement.

Pam Borgmann stated that the benches are fiberglass and painted with artist paint and

covered with a 25 year coat. Their plan is to solicit artists to paint the benches so they are professionally complete.

By general consent, the Council authorized placement of benches on City property.

b. As part of the planning process for the redevelopment of T.H. 71 (Main Street) MnDot will

be conducting demonstration projects in the City. The Demonstration Projects will show how different design ideas can be incorporated into the new design.

Three areas will be demonstrated.

1. Bump Outs for Pedestrian walkways at all corners of 4th St. S and Main Street. 2. Bump Outs for Pedestrian walkways at the SW and SE corners of Sinclair Lewis

Avenue and Main St. 3. Bike Lane on the bridge over Sauk River.

c. The budget process for 2021 has begun.

Department heads will be working on proposals to be presented to the Finance Committee later in July. A full Council workshop will be held in August.

d. Requests have been sent to both Collective Bargaining Units with Teamsters Local 320

requesting proposals for the upcoming negotiations. 10. CONSENT AGENDA The Council considered the following Consent Agenda Items: a. A vote being recorded as follows: For: Council Members Johnson, Leach, Kelly, Fuechtmann and Mayor Stone. Against: None. The motion passed. 11. INFORMATIONAL ITEMS a. Charter Channel Lineup Changes b. Fireworks have been scheduled for July 17th. Fundraising is in progress through Go Fund

Me and donations can also be dropped of City Hall or Mn National Bank. c. Sauk Centre Cruise Night take place on Thursday evenings. d. City Council Seat Openings (Johnson/Kelly) – 2. General Election November 3, 2020.

Affidavits can be submitted July 28, 2020 through August 11, 2020. e. Absentee Ballot Dropoff Location – Anyone in Stearns County can drop off absentee

ballots at Sauk Centre City Hall. City staff can act as a witness. f. Cares Act Funding is being released. The City of Sauk Centre should be receiving

approximately $340,000. It is recommended that the goal be the City grant the majority of the funding to local business that have been hurt by the shutdown.

The Sauk Centre Fire Relief Retirement Benefit increases $100 each year.

The current benefit per year of service is $2,200.

The increased benefit will be $2,300. The assets of the Association exceed the total benefit liabilities with no additional contributions required.

This increase requires an Amendment to the Bylaws for the Relief Association and acknowledgement by the City Council.

Subject: Sauk Centre CARES Act Small Business Grant

Description/Summary

The City of Sauk Centre will receive funding from the Coronavirus Relief Act (CARES).

The funding can be used to reimburse itself for COVID related costs. After that reimbursement the City can create a program to grant the funding to local businesses to the extent they have been impacted by the shutdown.

City staff has been working with Stearns County and other cities in the county to develop a program with similar requirements. It is expected that a Policy will be ready for consideration at the meeting.

Expected Criteria for Sauk Centre Businesses:

• Business must be located with the City limits of Sauk Centre• Grant can be used to reimburse for expenses incurred less revenue

generated from March 18 to July 1.• Funding cannot be used to replace lost revenue.• Businesses must have fifty or fewer employees.• Funding must be spent before November 15 or it must be sent to Stearns

County• Maximum grant expected to be $10,000

Attention: Sauk Centre Mayor and City Council

Reference: Candidates for upcoming EMT initial class

The Ambulance Service is requesting to advertise to seek candidates for an upcoming EMT class. With the increasing call volumes and job changes for current EMT’s, we could use additional staffing to help cover shifts and for back up needs.

There will be an EMT initial class beginning mid to late August that will run through the middle of December. We are hoping to find 2-4 candidates to send to this class.

A RESOLUTION SETTING A PUBLIC HEARING ON A VACATION OF A DRAINAGE & UTILITY EASEMENT COMMENCED BY A PETITION OF A

MAJORITY OF AFFECTED LANDOWNERS

WHEREAS, a petition signed by the majority of property owners abutting a drainage & utility easement located in the City of Sauk Centre was received by the City Clerk on the 10th day of July 2020; and

WHEREAS, the petition requested that the City Council pursuant to Minnesota Statute 412.851 vacate a portion of the easement described as:

That portion of the drainage and utility easement dedicated on Outlot A, East River Heights, a duly recorded plat on file and of record in the Office of the County Recorder, Stearns County, Minnesota, said vacation is described as follows: INSERT LEGAL HERE.

The Senior Center has been closed since March 13, 2020.

The City has been asked multiple times when it will be allowed to re-open.

The CDC and Dept of Health lump Senior Centers into Community Centers for Guidance. The City has been conservative in opening the Senior Center and has aligned more closely with Senior Living facilities.

Gov. Walz has issued orders that allows for indoor gatherings. A new number is expected to announced in the next few days and will be available at meeting prior to making a decision.

RESOLUTION AUTHORIZING INSTALLATION OF TRAFFIC CONTROL SIGN

WHEREAS, the Sauk Centre City Council has recently received a request for a Dead End or No Outlet Sign notifying motorists that Sixth Street SE is not a through-way and does not connect with any other road, and

WHEREAS, the City Council has statutory authority to regulate such signs on City Streets, and

WHEREAS, the City Council concurs that the request is reasonable.

In November 2019 a resident of East River Circle requested that the City conduct a Speed Study on East River Circle.

The Council at the time denied the request due to timing.

The resident has again requested a study be done. He believes the traffic is moving much faster than the 30 mph limit and feels the limit should be even lower.

RESOLUTION 2020-57 REQUESTING A SPEED STUDY BE CONDUCTED ON

EAST RIVER CIRCLE WITHIN THE CORPORATE LIMITS OF THE CITY OF SAUK CENTRE

WHEREAS, East River Circle is under the jurisdiction of the City of Sauk Centre and is located within the corporate limits of the City, and

WHEREAS, the area of the City of Sauk Centre served by the roadway has seen significant growth in recent years resulting in increased pedestrian traffic, and

WHEREAS, this increased traffic has resulted in concerns for the safety of these pedestrians, which concern has been brought before the City Council.

NOW THEREFORE BE IT RESOLVED by the City of Sauk Centre City Council that the State of Minnesota initiate a speed study to be conducted to determine the appropriate speed for vehicular traffic on East River Circle, and

BE IT FURTHER RESOLVED, that the Speed Study consider pedestrian safety including an analysis to determine if installation of sidewalks is warranted

RESOLUTION NO. 2020-58 RESOLUTION ACCEPTING CONTRIBUTION

WHEREAS, a contribution of $1,600.17 was received by the City from the Big Sauk Lake Association, and

WHEREAS, the Big Sauk Lake Association has requested that the City allocate the contribution to the Sauk Centre Park Department for picnic tables at the beach.

WHEREAS, a contribution of $25.00 was received by the City from the Family of Rosie Spanier, and

WHEREAS, the family of Rosie Spanier has requested that the City allocate the contribution to the Sauk Centre Fire Department.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SAUK CENTRE, MINNESOTA that the City accept the contribution received and commend the Big Sauk Lake Association and the Family of Rosie Spanier for their generosity.
