DETAIL TENDER NOTICE

E - Tenders are invited from competent, resourceful, experienced and reputed agencies for the work mentioned below

1) Name of Work: Fourth yearly Survey of Properties for Assessment of Taxes and All Related Activities for Saswad Municipal Council

Brief Scope Of Work: - Saswad Municipal Council intends to automate its entire property tax assessment. The larger objective is to conduct door to door survey of all properties within the municipal limits and implement property tax assessment system which will handle automated workflows and involves GIS and satellite imaginary based data integration. The work involves detailed door to door survey of properties and computerization to be done for purpose of assessment and taxation of Properties Land & Buildings in the Saswad Municipal Council,

1. ACTIVITY- I:

The first activity shall be a review exercise for conduct of household surveys for collection of attributes: This would involve: 1. Review of existing situation, collection of all available data including

list of wards, list of properties in each ward/sectors and property codes etc., only part of the information may be available.

2. Ground marking/on-site validation of ward boundaries and major and minor streets, in consultation with Saswad Municipal Council Officials

3. Procurement and Updating of Base map showing ward boundaries and major and minor streets, properties (available maps and details of ward boundaries shall be made available by Saswad Municipal Council.

4. Develop an Unique Identification Number system for each property, in consultation with Saswad Municipal Council Official

5. Acquisition of information of the Municipal functions and water and sewerage charges, property taxation types, identification of defaulters, streamlining of process, norms and parameters, technical, financial and managerial information requisites, etc.

2. ACTIVITY-II

The second activity includes Actual Physical Survey producing property database in required format, and linking of detail at data of properties, collected during household survey to provide an improved information base for municipal decision related to property tax, water charges, sewerage charges, etc. after validation and reconciliation with database. This shall require development and use of a “unique” property identification number (to be developed under activity.

1. Field survey: The Agency will organize a detailed property survey to collect information on total built up area, area on each floor and Taking and recording Internal Measurements of Each and Every room of the property for Carpet area calculations and verification of total taxable area with floor wise structure and usage detail for each property as per the suggested format and its database generation and integration with Base Map. During the survey the Agency shall collect and verify the following information for each property as per property survey format given in Annexure Separately. The agency shall be responsible for conducting Door to Door Survey and collect and computerized the information. Surveyors will record all information about the property like:

Date of survey Respondent Name and its status Property Usage like Residential/Non-residential/Mix

Category in case of Non-residential use of property as given in the Field data sheet format Following details to be collected through contact survey for property/holdings:

Owner Name, Father/Husband Name of Owner, Property Address, Mobile number of property owner

2. Deliverables: - The selected agency shall provide Printed Ward wise Computerized Property tax assessment case papers along with Photo and plans printed showing all Calculations and old records details, GIS based Zone Map showing all ward and zone boundaries for Taxations, Primary tax assessment lists in annexure, Individual Notices of taxes as per Annexure and Resisters of objections, Hearing Note sheets, Posting after Hearings, Final assessment lists etc. complete with required stationary, printings and bindings. Registered licensed software with all survey data for the above work of assessment and making the data available Municipal e governance software in excel format. The agency shall carry out the entire work as per the specifications, Coordination’s and guidelines laid by Chief Officer, Authorized Valuation Officer, and Municipal Council Saswad.

1. The agency selected shall assist to carry out the work of enumeration and listing

of owners/occupiers of each property for which Municipal Council Concerning Ward Inspector and resisters will be provided to the agency.

2. The selected agency shall assist and coordinate to carry on detail property survey and collect the specified parameters by the Municipal Council as Floor, Age, Use, Type of Construction, and area, each floor plan of each property. The agency shall use laser measuring tools or manual tape measurements, and a variety of other tools available for use for field survey

3. The agency selected will not use any pirated software and will be constrained to use own registered or licensed software for purpose of the contracted works computerization and assessment of taxes. The Software should be capable to calculate and adopt the taxation as per the law. After survey, the data should be entered in software for calculation of assessment on ratable value, along with the automated property tax assessment module as per the Requirements of Municipal Council. All the collected data and information shall be entered and computerized in the software and digital photo and computerized plans of all individual properties shall be linked to the database for One Click viewing and printings on the desired reports. The agency shall provide GIS based draft base map of the properties, showing property numbers on the satellite imaginary and linking the property tax and basic information on the satellite image of the properties for quick reference by providing the Integrated Property information on GIS module in the same software to be provided for the property tax assessment by the agency. The data should be provided by the agency for porting in the e governance module to Municipal Council after successful completion of the works

4. To take internal measurement of each structure / tenement and to give carpet

area in Sq.M of each property / structure / tenement. Separate detailed measurement sheets to be submitted for each property / tenement / structure and Integrate field data collected with photographs and other documents

5. The agency should provide android tablet computer application for property tax collection purpose enable with Bluetooth printer. Hardware Specification and software requirement shall be approved by Municipal Council and agency jointly. The software should be interactive with the property tax assessment software as above for data import, export and updation.

6. Software Specifications

The Selected bidder shall provide Property Assessment Module which will have following functionalities: 1. It should provide – It should be multiple access level, configurable.

2. Provision for viewing photo , plans and property details

3. It should allow Office level data entry to complete assessment form

4. The data should be in English/Unicode /and Marathi language. All the software should be legal copies.

5. It should provide Configurable RV calculation engine and Provision for tax bill calculation for assessed properties.

6. Provision of automatic Special notice generation.

7. It should support activities like Objection and Hearing for citizen complaints

8. It should support Bilingual data capturing. It should provide configurable language selection as primary language as Marathi and secondary as English or vice versa.

9. It should support Property Deactivation service

10. The software should be capable to prepare assessment register, notice of taxes, bills etc. all annexure as required for the working of property tax department. The software should be capable for automated Property tax calculation as per the rules and regulations, statutory provisions laid by the law and Municipal Council and prepare GIS based draft base line map of the properties peripheries , showing property numbers on the satellite imaginary and linking the property tax and basic information on the satellite image of the properties for quick reference by providing the Integrated Property information on GIS module in the software to be provided for the property tax assessment by the agency.

11. The software should be centralized and interactive with the android mobile based application for data authorization of devises, import, export, and processing of data for property tax collection updation and detailed report generations. The software should be interactive with online property tax collection amounts and data fetching. Etc

12. The selected agency shall provide the data in required format and shall

be assisting Municipal Council for data porting in e- gov module if

required by the Council.

13. The agency shall computerize the plan and provide drawings of

properties in soft copy format in CD. The plan shall be duly linked with

the software property database.

14. Agency will be responsible for Data entry of survey

15. Integrate and link all surveyed information with the database of

concern property.

16. To prepare and submit Hard copies of all Property tax ward map in

colored in.A3 size paper.

17. Technical support team should be provided in Saswad Municipal

Council Office for training of software and assessment of properties.

18. Free operational support against call from municipal council stating

detailed need of assistance for period of One year from the date of

successful commissioning of the entire system.

3. Annual Maintenance Technical Support (ATS) for all Software component Supplied under this project.

The successful bidder shall Provide the latest updates, patches / fixes, version upgrades, etc.

Bidder has to ensure that annual technical support is available for software application for the period of agreement.

Software version management and software documentation management reflecting features and functionality of the solution.

Database / Application Software tuning to enhance the performance of the overall system

The cycle of yearly services will be from posting of tax collection, Preparation and printing of Property tax updates bills, all procedural updation in the software as ferfar, wadh ghat entries etc., Preparation and printing of demand and collection registers etc complete. All the hardware stationary, bindings etc. shall be provided by the successful agency for his works. The other terms and conditions of the agreement shall be binding to the agency.

a. To prepare a GIS layer of property tax Recovery blocks by survey showing all necessary boundaries like ward and municipal boundaries on satellite imaginary on GIS platform as suggested by SASWADMUNICIPAL COUNCIL for the entire SASWADMUNICIPAL COUNCIL( SaswadMunicipal Council)area

4. Training 1. The agency shall Prepare and organize training programs to facilitate the departmental users in the efficient usage of the whole system.

2.The selected agency shall provide training to departmental users to efficiently use the system.

3.Annual Maintenance Technical Support (ATS) for all Software component Supplied under this project.

5. Qualification Criteria for selection of agency: All bidders shall submit the qualification documents in online tender procedure with proper index and numbering of pages. Only relevant and required documents should be submitted in following sequence only. The technical qualification criteria shall be as below.

1. The bidding agency must be a firm, or proprietorship, or company registered under Indian companies Act. Attested copy of the registration of the issued by the competent authorities should be submitted along with the bid. The bidder can also be single business entity meeting the qualification criteria. Joint Venture, consortiums shall not be allowed.

2. The agency should have completed at least 5 similar projects for any Municipal Council in Maharashtra state. The previous completed project should be involving onsite Numbering, door to door survey of properties, providing plans and digital photos of every property, Providing Registered Software for atomized property tax assessment works ,computerized and atomized assessment of property and publication of final assessment list as per clause 121 of Maharashtra Municipal Council, Nagar Panchayat and Industrial Township act 1965, in Maharashtra state Work Completion certificates from Municipal Council in similar works contracts along with Number of properties surveyed and assessed should be provided.

3. The average annual turnover of the Agency in last 3 financial year i.e. 2013-14, 2014-15, 2015-16 should not be less than Rs. 2 Crores. The copy of the certificate from registered CA for the same should be submitted along with Audited balance sheet.

4. The Bidder should not be declared insolvent or black listed by any authority

(undertaking to be submitted). The bidder should submit the affidavit on stamp paper with Executive Magistrate for non-blacklisting and ineligibility/ banned by any central or state Government agency as per annexure. And declare that the bidder shall use and provide non pirated software of property tax assessment as per the given scope of work in the tender.

5. Statutory Registrations: - The Agency should submit its registration copies as under 1. Income tax returns copies of last three years 2013-14, 2014-15, 2015-16. 2. Service Tax Registration Certificate from Central Excise Department.

3. Employee Provident Fund Registration Certificate. 4. Workmen Compensation Insurance Certificate for employees. 5. Employee State Insurance Corporation registration Certificate.

6. Place of work: Within the Limits of Saswad Municipal Council,

7. Earnest Money Deposit: (To be Paid Online Only)

The earnest money deposit shall be Rs 50,000/- (Rupees Fifty Thousand only) the Earnest money deposit shall be paid online only.

Note:

1. This Earnest Money Deposit for tender is not indicative of any project cost.

2. Exemption certificate for Earnest Money will not be accepted. 3. It will not carry any interest

8. Security Deposit :- Performance Security Deposit: Security deposits shall be deducted through running account (R.A.) bills as per law. And shall be released as follows –

1. Security Deposit will be released after 6 months of successful

completion of the work. 2. The Security deposits shall not carry any interest.

9. Duration for the work :

The Survey work shall be completed and assessment work along with software and database and related works shall be submitted to within 6 months from the date of work order.

Extension of time period: The Chief Officer may grant extension of

time if necessary and on written application by the agency with proper justifications.

10. Validity of offers: 90 days from the date of submission of offer. 11. Cost of Blank tender form: Rs. 5000/- (Rs. Five Thousand Only.) Payment Should be made through online portal

12. AGENCY TO INFORM HIMSELF FULLY: -

The Agency shall be deemed to have fully acquainted himself with the work & site conditions and carefully examined the special conditions, the specifications, and shall be deemed to have fully informed himself regarding the local conditions, and various prevailing laws at time beings.

The Agency shall also be deemed to have fully acquainted with various items involved in the works and as well as deemed to have fully acquainted himself with the fact that the work is to be carried out at various locations in Saswad Municipal Council limits The Agency should therefore plan his schedule of work properly so as to complete the work within stipulated time limit. Saswad Municipal Council will not be liable for any loss or damage sustained by the Agency.

13. REJECTION OF OFFER:-

The Offer, which does not fulfill any of the conditions of the tender specifications or are incomplete in any respect are likely to be rejected without assigning any reason therefore. Also the Chief Officer Saswad Municipal Council reserves the right to reject any or all tenders without assigning any reason thereof.

14. MANNER OF SUBMISSION OF OFFER AND ITS ACCOMPANIMENTS: -

The offer should be unconditional. Conditional tender is liable for rejection. The technical bid and The Financial bid of Tenders shall be submitted strictly on line as prescribed below.

A) Technical bid: - To be Submitted online only on the website https://www.maharashtra.etenders.in (Submission of hard copies or Sealed Envelope of Hard copies will be submitted before Date : 30/05/2017 16.00 hrs. allowed)

The “Technical Bid” for the work of “Appointment of Agency for Survey of Properties for Assessment of Property Tax and All Related Activities for Saswad Municipal Council “shall contain the documents as mentioned in the Pre-Qualification Conditions and List of annexure as per the Tender and shall be Submitted online the website https://www.maharashtra.etenders.in or before the Submission date.

It shall be the responsibility of the agency to ascertain timely submission of this technical bid The financial bid shall not be considered for opening if the submission of technical bid is not done properly. Saswad Municipal Council will not be responsible to untimely or improper submission of the technical bid.

Technical bid to be submitted online. The Agency shall upload the attested copies /originals of the documents mentioned in prequalification conditions .The EMD should be paid online only. The Financial offer should not be submitted in the technical bid, if the financial offer is submitted in the technical bid then the tender is liable for rejection.

B) Financial bid :- (To be submitted Online only) on the website https://www.maharashtra.etenders.in financial bid shall be submitted

online on the specified web-site.The Financial offer should not be submitted in the technical bid, if the financial offer is submitted in the technical bid then the tender is liable for rejection. (Submission of hard copies or Sealed Envelope of Hard copies will be submitted before Date : 30/05/2017 16.00 hrs. allowed)

The offer should be based on the scope of work given in the tender document and Should be inclusive of all taxes, levies, duties and all other charges including Traveling, lodging and boarding or any other expenses of the agency and other Employees of the Agency. The rates shall be excluding service tax only. Agency should not quote the financial offer anywhere directly or indirectly in “Technical Bid”.

C) Opening of Offer:- Tenders will be opened in the office of the Chief Officer, Saswad Municipal Council. Technical Bid:- Technical Bid” of the offer will be opened first to verify its contents as per requirement. If the various documents do not meet the Requirements of the Council the agency may be asked to submit the requisite paper within a definite time frame as per the desire of offer opening authority and if the agency fails to submit those document within the stipulated time frame then a note will be recorded accordingly by the offer opening authority and the said Agency’s Financial bid will not be considered for further action.

Financial Bid:- This shall be opened after only if contents of “Technical Bid”

are found acceptable to the Saswad Municipal Council. The Offer shall then be read out. The right to negotiate with any of the bidders

whose offer has been found to be responsive to the Saswad Municipal Council is reserved with the Chief Officer Saswad Municipal Council.

The acceptance of the Bid shall be communicated to the successful bidder in writing either by the bid opening authority or any other officer of the Saswad Municipal Council authorized to do so. In the event of failure of the successful bidder to sign the Agreement within the stipulated time frame, he would be disqualified and his EMD will be forfeited. Subsequently the next most competitive bidder would be invited to take up the project. The successful bidder and the Saswad Municipal Council will enter into an Agreement as per tender conditions. The original copy of the bid documents including revisions amendments, correspondence with and by the bidder and Saswad Municipal Council will be the part of agreement. The earnest money deposit of the unsuccessful bidder shall be returned after due procedure.

The earnest money deposit of the unsuccessful bidders will be returned without any interest, within 30 days after the agreement is signed with the successful bidder as above or after expiry of bid validity period whichever is applicable.

Right to reject any or all Offers without assigning any reason thereof, is reserved by the Chief Officer, Saswad Municipal Council, Saswad.

15. TERMS & CONDITIONS OF TENDER

1. Unit

An Unit means an individual property, flat, shop, tenement, occupier, assessed separately for the purpose of property tax.

2. Site Conditions

It shall be presumed that the Agency has satisfied himself as to the nature and location of the works, general and local conditions, and has estimated the cost and quoted his rates accordingly. Municipal Council will bear no responsibility for lack of such acquaintance with site conditions and consequences thereof.

3. Extras, Omissions and Discrepancies

In all case of the omissions, doubts or discrepancies in the Quantities, Specifications and items of works, reference shall be made to the Chief Officer whose elucidation and elaboration shall be considered as final.

4. Study of Tender

The Agency should ensure technical feasibility of their tender offer, after inspecting the Locations. 5. Indemnity-

The Agency shall indemnify regarding all actions, suits, claims and demands brought or made against in respect of any matter or thing done or omitted and done by the Agency and loss or damage to the consequence of any accident or action or suits being brought against the information of the work of this contract.

6. Permit and Licenses –

The Agency shall secure all permits and licenses at his own expenses and pay all necessary charges and fees. And shall do lawful execution of the work 7. Patents copyrights:

Whenever the Agency desires to use any software, device, material or processes covered by letters patent or copy right the same shall be secured by suitable legal agreement with the patentee or owner, copy or their agreement shall be filed with Chief Officer. Saswad Municipal Council will not be responsible for any claims for damages registered by any third party Agencies for the use of Patented and Copy Right protected products such as Hardware’s and software’s by the successful Bidder. However Municipal council shall procure and manage the required support software in its computer server in office to run the provided software.

8. Payment will be made as per availability of funds.

The Contractor shall submit his bills as per the schedule mentioned in the tender document. Payment will be made as per availability of funds. 9. Penalty for delay in project execution If the selected agency failed to complete and submit the steps of contract within the stipulated time period mentioned in agreement, penalty of Rs 500 per day shall be applicable.

01. Currency : The currency for the purpose of the proposal shall be Indian Rupees (INR) only.

11. The Agency shall be fully responsible for any accidents that may occur to the staff on his work, on duty or to any property and report the same to the Chief Officer and other concerned and he shall pay all necessary compensation as per rule

12. If necessary the contractor will have to carry out the work on Sunday and holidays also. The Agency must arrange for the placement of its staff in such a way that the breakdown of power supply etc. does not affect their proper deployment. The Saswad Municipal Council will not entertain any claim for the idle time payment whatsoever. The Agency will report at regular intervals regarding the progress of the work after the award of the contract. 13. Termination of the Contract

Termination of the contract in the Event of Agency’ Default

1. The Chief Officer Saswad Municipal Council shall be entitled to

terminate the contract of this work. The procedure for such termination shall be as follows: A. The Chief Officer Saswad Municipal Council will submit the report Stating reasons of Delay and Non Performance of Agency to the Chief Officer, Saswad Municipal Council B. On receipt of the report, the Chief Officer Saswad Municipal Council may give hearing to the agency as an opportunity to put up their case. C. The Chief Officer can take the decision as deem fit regarding termination of the contract of the work. The decision shall be communicated to the agency in writing.

2. Settlement of Disputes:

A. If any dispute or difference or claims of any kind arises between

the Saswad Municipal Council and the Agency in connection with, construction, interpretation or application of any terms and conditions or any matters or thing in any way connected with or in connection with or arising out of this contract, or the rights, duties or liabilities of any party under this contract, whether before or after the termination of this agreement, then the parties shall meet together promptly, at the request of other party, in an effort to resolve such dispute, difference or claim by discussion between them. No third party intervention other than that of the court of law is allowed.

B. No Arbitration Jurisdiction to settle the dispute:

There is no intention of refer ring dispute (if any) to the Arbitration. Any dispute arise out of the contract of the said work shall be referred to the Court of Law at Saswad only. It is made specific here that in no case the matter shall be referred to any Arbitration or conciliation or any other form of ADR. The dispute (if any), shall be subjected to Saswad Jurisdiction only.

C. Free Operational Support period for One Year .

Operational Support period: The operational support period will start after the successful completion of the work and satisfactory implementation of the system. The agency should acquire the completion certificate of the work from the Chief Officer after which the operational support period will commence. In the operational support period the agency will deploy a team of relevant experts and operators to support Saswad Municipal Council during the Suggestion and Objection process , Hearing Process , Finalization of Demand and Generation of Final demand , during this process if needed the Agency is expected to revisit the surveyed properties for checking, remeasuring and validation along with necessary corrections in the data entered in the system The operational support period will be free of cost . During this period the agency should also survey missing properties and newly completed properties. The Operational support period will be of 12 months after successful completion of the work. This support period shall be only for assisting municipal council on temporary basis whenever need only for a period of five days in month maximum. The Agency should note that it will be their responsibility to do any type of modifications suggested in the survey work during the hearing process by Chief Officer, it will be the responsibility of the agency. If it is observed that the said staff of agency are not attending the office and not performing their duties as mentioned in the tender condition, it will be the responsibility of the agency to remove such type of employee and appoint another suitable person.

16. Compensation under workmen’s Compensation Act or any other law in force

1. The Agency shall be responsible for and shall pay any compensation

to his workmen payable under the Workman’s Compensation Act 1923 (VIII of 1923) (hereinafter called the said Act) or any other statute in force for injuries caused to the workmen. If such compensation payable is paid by Saswad Municipal Council as principle under Sub-section (1) of Section 12 of the said Act on behalf of the Agency, it shall be recoverable by the Chief Officer, Saswad Municipal Council from the Agency under sub-section (2) of the said act.

2. The Agency should follow all the labor laws and other laws and

enactments of India.

3. The Agency shall provide all necessary personal safety equipment and first aid apparatus available for the use of the persons employed on the site and shall maintain the same in condition suitable for immediate use at any time and shall comply with the following regulations in connection therewith. A. The workers shall be required to use the equipment so provided

by the Agency and the Agency shall take adequate steps to ensure proper use of the equipment by those concerned.

B. When work is carried on in proximity to any place where there is a risk or danger, all necessary equipment shall be provided and kept ready for use and all necessary steps shall be taken for the prompt rescue of any person in danger.

C. Adequate provision shall be made for prompt first – aid treatment of all injuries likely to be sustained during the course

of the work.

17. Defect Liability The Defect liability period for the entire work and the system developed shall be 12 calendar months from the date of successful Completion of the work

If at any time during the aforesaid period the said survey & Data Entry work is found defective in any manner whatsoever, the Agency shall forthwith on receipt of notice in that behold from the Chief Officer, Saswad Municipal Council duly commence rectification work and completely carry out at his cost in every respect all the work that may be necessary for rectifying and setting right the Defects specified therein and in the matter prescribed and under the supervision of the Chief Officer

18. Precautions For Works: The Agency shall comply with all the prevalent rules and regulations, bye-laws and directives given from time to time by any local or public authority in connection with this work and shall pay all fees, which are livable on him

19. Language:

All notices, certificates, correspondence or other communications under or in connection with this Contract Document, the project and all works shall be in English or and Marathi Language.

20. Escalation

No compensation, in any form, shall be granted on account of cost escalation in any item or for addition in taxation or imposition of new tax etc. The Agency should deploy their staff in Saswad Municipal Council. It will be responsibility of the agency to make necessary Arrangement of their staff regarding lodging & Boarding Expenses. No Expenses will be borne by Saswad Municipal Council. The Entire responsibility of the Staff Deployed at Saswad Municipal Council by the Agency will be the responsibility of the Agency .

21. Extension of Time Limit

The stipulated period for as mentioned in the scope of work shall be 6 calendar months from the issue of work order .Saswad Municipal Council reserves the right to extend the time period of assignment of services mentioned in the scope of work if felt necessary

22. Data Collection, Entry and its validation:

The agency shall conduct survey of each and every property within Municipal Limits comprising of all the residential, industrial, commercial, Government, Non-Government, Public, semi-public, educational and other properties with all the units in that particular property which are liable for assessment of property tax as per Rules and Regulations of Saswad Municipal Council and enter the data into the software application. The agency should also have printed forms for collection of data. The agency will also be responsible to make correction in the already entered data as per the decision on first hearings taken during the suggestion /objection procedure as per finalization of the objections by the Municipal Chief Officer for generation of Final Demand Notice.

23. Completeness of Contract:

The contract will be deemed as complete after publishment of final assessment lists. Further AMC may be commenced with consent of both parties. All disputes related to this tender shall be subjected to jurisdiction of Civil Court at Saswad. The dispute (if any) shall not be referred to arbitration or any other alternative dispute redrassal mechanism.
