Introduction

GhostConvey collaborated with SARS to use our Conveyancing system as an additional channel to

request Transfer Duty Declarations.

The integration between GhostConvey and SARS will enable our users to:

o Complete all necessary information in GhostConvey.

o Print the SARS Declaration for signature by all parties to confirm that all the information

is correct.

o Submit the request for a Transfer Duty Declaration directly to eFiling.

o Receive correspondence and status updates from SARS directly to GhostConvey’s

Message Centre. When processing these messages, correspondence will be saved to

the Attached Documents menu.

o On request from SARS, submit supporting documents using GhostConvey.

o If necessary, make corrections in GhostConvey and send the amendment to SARS.

o Receive the TDC01 in GhostConvey.

o Receive the Transfer Duty Receipt after payment has been made

o View Transfer Duty figures sent by SARS in the Final Account.

o Electronically cancel submitted Transfer Duty Declaration requests at any time.

Registering for SARS eFiling

Users will only be able to submit a request for a Transfer Duty Declaration on the new system once

they have activated their Transfer Duty account.

Follow SARS’s guidelines on Registering on eFiling for Transfer Duty Purposes.

Activating GhostConvey for SARS eFiling

1. Click on the GhostConvey menu.

2. Hover your cursor over the File menu and click on “Register with SARS”.

3. The Register application with SARS window will be displayed. This window enables you to capture the user name and login key that were created when registering for eFiling.

4. Tick the Remember password? checkbox in order to avoid having to re-capture the logon details every time. Note: If you don’t tick the Remember password? checkbox you won’t be able receive correspondence from SARS when performing a Send/Receive.

5. Click OK to complete the registration process Note: When activating SARS eFiling, GhostConvey will perform additional validation [ ] to ensure that all the fields captured meet SARS’s requirements.

Completing the request for a Transfer Duty Declaration in GhostConvey

GhostConvey caters for all Transfer Duty Transaction Types except for Transfer of Shares / Members Interest / Beneficiaries. Using GhostConvey to submit the request means that there is no need to recapture the transaction details on the eFiling website. SARS tab The SARS tab has been updated with additional fields to cater for various transaction types. GhostConvey will pre-populate the fields on this tab based on the information that was captured on previous tabs. You will be required to complete any fields that were not pre-populated.

1. Transaction type drop-down box

The Transaction type is pre-selected based on the Cause of Action that was selected in the Transfer tab. Use the Transaction type drop-down box to change the type of transaction that will be submitted to SARS, if necessary. The fields displayed on the SARS tab will change depending on the option that is selected in the drop-down box.

Print list In the current electronic process via eFiling, there are 5 forms that the Conveyancer has to utilise in respect of Transfer Duty:

• TD1 & TD2 - these two are linked and are the declarations by Seller and Buyer • TD3 - Application for exemption of Transfer Duty • TD4 - Transfer of Shares/Member’s Interest/Beneficiaries • TD5 - Vattable Transactions

The new TDC01 form that will be available on eFiling will in effect, consolidate the 5 current forms into a single flexible form. SARS documents will no longer be available in the SARS Declarations group. This will be replaced by the SARS Declaration document that will be available in the Documents for Signature group. Note: This document must be signed by both Transferor and Transferee and kept on file for reference purposes. You will not be required to submit this document to SARS.

Submitting a request for a Transfer Duty Declaration

1. Select the Transfer matter from the Matter list

2. In the Matter Diary’s Anytime Tasks section, click on SARS: Submit Transfer Duty.

3. A message will then appear in the matter’s Messages menu.

SARS will send a Notice of Assessment.

Depending on the outcome of the validation and review process, SARS has the option to do the following:

Accept the Declaration as it stands Request additional supporting documents Reject the Declaration Conduct a revise assessment.

Note: Payment can only be made once the Declaration has been approved or accepted by

SARS.

Accessing letters/notifications from SARS All letters or notifications can be accessed from the Attached Documents menu. In the example below, SARS sent a ‘Request for Supporting Documents’ notification.

Submitting Supporting Documents

1. Whenever a ‘Request for Supporting Documents’ notification is received, the Submit to SARS

button will become active in the Attached Documents menu.

2. Clicking on the Submit to SARS

button will open the Submit to SARS window. This window enables you to select the relevant supporting documents that need to be submitted to SARS. Note: You will only have one opportunity to submit supporting documents to SARS. Therefore, you need to ensure that all the documents are selected.

3. Click on the Browse button to upload the relevant documents.

4. Click on the checkbox to select the documents to be submitted. You can select multiple documents.

5. Click on the Submit button to send the documents to SARS.

Submitting Supporting Documents (continued) 6. After clicking Submit,

GhostConvey will prompt you with a warning message to ensure that all the requested supporting documents have been selected. At this stage, you can click OK to confirm or Cancel to select additional documents.

7. Once the documents have been

submitted, GhostConvey will display a message confirming that the documents have been queued.

8. A message will then appear in the matter’s Messages menu. This message will list the documents that were submitted to SARS.

Status Changes Status changes made by SARS will be displayed in the matter’s Messages menu. Performing a Send/Receive in GhostConvey will import the status changes. You are also able to query the status of the transaction with SARS by clicking on the SARS Query Status task in the Matter Diary.

Submitting a Request for Correction

1. If you need to make corrections to the request for

Transfer Duty Declaration, you can do so by making the necessary changes to the matter.

2. When complete, select the SARS: Amend transfer duty task.

Note: Corrections can be submitted at any time before payment is made.

3. A message will then appear in the matter’s Messages menu.

Making a payment using eFiling Once the user has accepted the notice of assessment, the payment facility will be available on the eFiling website.

Refer to SARS’s guidelines below, as documented in the eFiling user guide for Transfer Duty:

The eFiling website offers a secure method to process payments which are transferred directly into the relevant SARS bank account.

Payments can either be made by: Credit Push - Payment transactions that are initiated on the eFiling site and presented to

the banking product as bill presentation (i.e. payment request). Only once the user has logged into the banking product and authorised the payment request, is this transaction regarded as an effective payment. Credit Push transactions are assumed to be irrevocable.

Authorised Debit Pull - Payment transactions initiated on the eFiling site and authorised for each transaction. The transaction is assumed to be successful after the user has authorised it on eFiling. This payment mechanism utilises the inter-banking facility, ACB. This mechanism involves the initiation of payment instructions from the originating bank to the client’s bank. The Debit Push mechanism can however be reversed on instruction to the bank by the initiating party or may be reversed due to insufficient funds once the request is processed by the originating bank. Please ensure correct branch details are provided to ensure the payment is successful.

When payment is made, it can only be made in respect of Transfer Duty, with no other

taxescombined in the same payment. This is done to facilitate the generation of the Transfer Duty Receipt.

When the Transfer Duty payable is more than R500 000, the payment needs to be split into multiple payments. Only one receipt will be generated, even if split payments are made.

Where multiple Transfer Duty transactions are paid with one payment, the receipt number will be the same on the different Transfer Duty receipts. The values of the separate Transfer Duty transactions (paid with one payment) will be required to populate the financial value on the separate receipts.

If the user makes a payment on the original Declaration and it by increasing the value, they will be required to only pay the difference via the eFiling payment facility. The receipt will be cancelled and reissued once full payment has been received for the outstanding amount.

Transfer Duty Receipt The Transfer Duty Receipt will be accessible from the Attached Documents menu. You are able to

preview or e-mail it from here. The receipt will only be sent once SARS has confirmed that payment

has been received in full in its bank account.

Cancelling a submitted request for Transfer Duty Declaration

1. You have the option of cancelling the request for Transfer

Duty Declaration by clicking on the SARS: Cancel transfer

duty task.

Requesting a Refund using eFiling A request for cancellation after payment was made will automatically be seen as a request for a refund.

Therefore, the supporting documents must be attached to process the refund. This should be done via

the eFiling website.

Refer to SARS’s guidelines below, as documented in the eFiling user guide for Transfer Duty: Refunds are still processed using a manual process as they cannot be transferred electronically.

The following supporting documents must be supplied for an application for a refund: Copy of Deeds search REV 16 – Claim for Refund out of Revenue; Part A completed and signed eFiling Proof of Payment – indicating that the payment was successful Printed Transfer Duty Receipt from eFiling.

In addition, the following supporting documents must be supplied as applicable to the request: Cancellation agreement/declaration OR proof of sequestration/liquidation/deceased estate Official letterhead with bank account details OR a copy of a cancelled cheque.

SARS will assess the documents received and will take one of the following actions: Approved

o The eFiling website status will be updated to “Payment refunded” o The client will be able to collect the refund cheque at the SARS branch or on request

SARS will post the cheque via registered mail Rejected

o The client will be notified of the reason for rejection.

Where the refund was approved, for all transaction types excluding “Cancellation of transaction”: Debt equalisation (if applicable) will be performed prior to the refund being issued.

Note: If the refund request is more than five (5) years from date of acquisition, the refund will not be processed by SARS.
