AGENDA MEMORANDUM

To: Honorable Town Chairperson and Town Supervisors From: Chris Pagels, Stormwater Superintendent Date: April 13, 2020 RE: Everglade Dredging Update

ACTION TYPE: All items discussion only BACKGROUND & SUMMARY: The Everglade Dredging, Phase 2, is a continuation of a drainage project started in 2015 to improve drainage in the Everglade Wetland Complex. Phase 1 was primarily along the north side of Everglade Road, starting at STH 76 and heading east 4,600 feet to just east of Donna Drive. Phase 2 starts where phase 1 left off, heading downstream for approximately 2,800 additional feet. To begin the DNR permitting process for phase 2, all landowners must sign a temporary construction access agreement or be co-applicants on a Chapter 30.20 (Stream Dredging Application) permit application. Most property owners within the scope of the proposed project have signed off since August of 2019. One landowner must still sign off for the project to be permitted by DNR (see attachment). Several meetings have been conducted with this landowner, with the most recent discussion at the end of March. The owner would like firm construction plans before signing. However, these plans aren’t typically developed until after approval from all parties have been obtained. To keep this project moving forward, town staff will discuss and develop an LOA with Cedar Corp seek future approval from Town Board to begin a preliminary construction plan. Town staff will also bring information regarding financial compensation for the use of subject property to dispose of dredge spoils and temporary loss of farmland during construction. A wetland review for this property has been approved by DNR, see Wetland Concurrence Map. This shows the upland areas where dredge spoils can be placed and incorporated into the native soils. Discussion was held amongst the Commission in support and against cost sharing the expense of the project. Discussion points included possible causes for the timing of the maintenance, potential contents of the pond and how it would be difficult to quantify the materials, what the Stormwater charge paid on taxes is utilized for and the setting of a precedence for future pond maintenance throughout the Town.

Gregozeski suggested the District will continue with the project and after final costs have been calculated, the figures will be brought forward to the Commission to review and determine final charges. Gregozeski stated this could be done under the prior resolution. If the Commission is in agreement, the Board could vote to reconsider its prior action to rescind and proceed with reviewing the final costs when the project is completed.

Motion by Jack Anderson, second by Dean Culbertson reconsider the motion to rescind prior action on Resolution 11-20 - adopting special charges pursuant to Wis. Stats. 66.0627, for services related to the maintenance of the stormwater facility or drainage improvements in the Green Ridge Terrace Subdivision, Lots 1-100.

ACTION TYPE: This item is for discussion only. BACKGROUND & SUMMARY: This report lists the major items that were worked on or completed during the month of March:

Stepped Erosion/Stormwater Enforcement. Stop Work Orders issued. Letters to occupied homes in final yard installation process.

Elevation studies for Town projects and resident drainage complaint inquiry.

Stormwater basin inspections.

Routine maintenance on stormwater ponds plugged with debris.

Developed Residential Home Inspection Policy

Beta testing new GIS stormwater infrastructure (ponds, basins) form.

Capital Improvement Projects: List the items worked on and status during the month of March.

Greenridge Terrace Dredging: Contractor awarded bid waiting for conditions to dry enough and road weight limits to come off.

DNR Stormwater Planning Grant: Cedar working on LOA for Board approval. Upper Fox/Wolf River TMDL was approved on 2-27/20

STH 15 East Basin: Cedar Corp final design

STH 15 West Basin: Cedar Corp final design, web-based meeting held April 2nd with property owner. Working around Railroad issues and final design considerations.

Season Fields Drainage: Town completed vegetation management near pond. Ditch cleaning to occur once conditions allow. Site on PW Action item List till completed. Site access still too wet.

Air North Storm Retrofit (formerly Pebble Ridge to School Specialty): Conceptual plans developed and discussed with Outagamie County Airport Zoning and Drainage District Staff. Property owner discussions to be scheduled soon.

Everglade Phase 2: Memo for this board meeting.

Everglade Phase 1: Perform maintenance dredging in the 2015-16 area along Everglade Road. DNR determined that this project will be permitted through Chapter 30 and not Local Roads program. Design will be a part of the Everglade phase 2 Cedar LOA.

Everglade Phase 3: Design will be a part of the Everglade phase 2 Cedar LOA.

Community Park Dredging: Cedar working on construction plan amendments DNR requested. DNR staff is working remote during Covid-19.
