SHIMLA, SEPT 24 At least 25 people drowned and several others were missing this morning after a bus fell into the Gobind Sagar reservoir at Rayian near Bilaspur, 95km from here. 25 bodies have so far been recovered while 15 injured persons have been taken to a Bilaspur hospital, Bilaspur deputy commissioner Ajay Sharma said, adding that efforts are on in full swing to trace the missing. The 40-seater bus was packed to capacity and some people were said to have been also travel- ling on its roof, spark- ing fears that the toll may be higher. A number of students and labourers who were making their daily com- mute from Rishikesh to Bilaspur are among the victims. The bus has been pulled out of the reser- voir. The ill-fated bus belonging to a private transportation company was on its way from Rishikesh to Bilaspur and most of the passen- gers on board were locals. Divers of Bhakra Beas Management Board (BBMB) have joined efforts to fish out the bodies. A large crowd of locals has gathered at the spot making anxious enquiries about the vic- tims of the mishap. Acting on the Central government's assurance that it is “fully prepared” to face the cancellation of the coal block allocations and will not have any difficulty to take the coal industry forward, a three- judge bench led by Chief Justice of India R.M. Lodha passed the order, opting that the "natural consequence" of its August 25 judgment declaring the allocations would be to can- cel them. On the Centre's request to save 40 functional coal blocks and six ready-to- function ones, the court said 42 of them would continue to function for the next 6 months, till March 31, 2015, to give the government "breathing space to manage the emerging situa- tion". These 42 blocks would have to pay an additional levy of Rs. 295 per metric tonne of coal extracted to make up for the loss highlighted in the CAG report in the coal scam. The four functional coal blocks exempted from cancel- lation are two ultra mega power projects, one operated by NTPC and another by SAIL. Reacting to the order, Attorney-General Mukul Rohatgi, who represented the Centre in the case, told the media that the "government would now decide which of the blocks will be auctioned and which not to". He said the six- month gap in implementation of cancellation of 42 functional coal blocks would ensure that the transition would happen with the “least disturbance”. On the impact of the cancellation on industries, Mr. Rohatgi said “private industries can come back by way of auction”. NEW DELHI, SEPT 24An end to Delhi’s parkingmess may finally be in sightwith officials in the munici-pal corporations coming upwith innovative solutions,including high charges incongested areas and involv-ing locals in decision mak-ing.

Though officers have pro-posed parking rate hikes inthe past, politicians in thecorporations have shot downthe plans, fearing electoralbacklash. But, now, the BJP-led municipal corporationsare working on a uniformrate hike as the party’s Stateleadership has decided todeal with the issue seriously.

Delhi BJP president SatishUpadhyay has asked allthree corporations to formu-late a policy regarding park-ing rates. The South DelhiMunicipal Corporation’sStanding Committee, whileMr. Upadhyay was headingit, last week increased park-ing rates.

At a meeting with theUrban DevelopmentSecretary on Monday, thethree Commissioners of the

civic bodies and representa-tives of the Public WorksDepartment, the DelhiPolice and the DelhiDevelopment Authoritybrainstormed on out-of-the-box solutions.

South Delhi MunicipalCorporation CommissionerManish Gupta said onTuesday that the civic bodyshould not subsidise parkingfor the rich, but should worktowards making pedestrianmovement easier. He addedthat the SDMC agreed withthe recommendations of theBhure Lal Committee,which says that surfaceparking should be pricedhigh to dissuade users. Hesaid he reiterated the com-mittee’s findings at themeeting with the UDSecretary.

“Surface parking in con-gested areas that have goodMetro connectivity likeLajpat Nagar market shouldbe exorbitant so peoplechoose to use public mar-ket,” said Mr. Gupta.

A senior North DelhiMunicipal Corporation offi-cial said that simply impos-

ing hefty charges anddeclaring ‘no-parkingzones’ would not work.

“We have to see parkingnot as a right and a facilityfor all, but a service at a pre-mium so we can disincen-tivise people from crowdingthe roads. The rates shouldbe prohibitively high in con-gested markets likeKarol Bagh so peopletake the metro,” said theofficial.

While officers have agreedthat the rates need to go upfrom the current Rs.10, theexact policy is still underformulation. The NorthCorporation has 96 parkingsites, out of which 32 arecurrently running as freesites as there were disputeswith the contractors and thetenders were cancelled. Theprocess of re-tenderingthese sites is on, said DeputyCommissioner DharmenderKumar.

According to officers,increasing the rates will notonly dissuade users, but willalso hit the parking mafiathat continues to overchargecustomers.

The Delhi SikhGurdwara ManagementCommittee, led by ShiromaniAkali Dal (Badal), is now ona warpath to turnaround adecision by the previous dis-pensation under rivalShiromani Akali Dal (Delhi).As per an agreement signedon February 10, 2005, owner-ship of the Master Tara Singhcar parking will go to NewDelhi Municipal Council(NDMC) after a lease periodof 25 years.

DSGMC has declared that itwill go to the Centre, courtsand, if required, take to thestreets to get rid of the owner-ship clause. DSGMC hasalleged that ownership of theparking was "illegally" trans-ferred to NDMC during thetenure of SAD (Delhi) chiefand former DSGMC presi-dent Pramjeet Singh Sarna.

"It is surprising that Sarnawrote to NDMC onDecember 11, 2004, forapproval of a building planand two months later hedecided to hand over theparking lot to NDMC after 25years," said DSGMC presi-dent and SAD (Badal) Delhipresident Manjit Singh GK.

Reacting to the allegations,SAD (Delhi) issued a strong

rebuttal. "The Badal factionhas been leveling false, frivo-lous and baseless allegationsagainst us in the name ofGurdawara Bangla Sahibparking issue," Sarna said in astatement.

SAD (Delhi) pointed outthat the parking lot was neverthe property of the gurdwaracommittee but governmentland.

Rejecting the argument,Additional Sessions Judge KaveriBaweja said: “The fact that shedid not tell her husband anythingcannot be said to imply that nosuch incident had occurred or itwas with her consent.”

The court also directed that thevictim be paid adequate compen-sation under the VictimCompensation Scheme by theDelhi Legal Aid ServicesAuthority.

The court held accusedMohammed Bilal Qureshi guiltyof ‘raping same woman repeated-ly’ under Section 376 (2) (n),abduction under Section 366 and

criminal intimidation underSection 506 of the Indian PenalCode.

“…it appears from the completereading of the testimony of victimthat she had no option but toremain quiet as she was beingkept under threat by Qureshi andher consent in these circum-stances, cannot be said to be freeor voluntary. Under this fear,the woman continued to be sexu-ally exploited by him,” the courtsaid.

The woman alleged that theaccused sexually assaulted her bycalling her at different places onthe pretext of repaying the money.She further said in her complaintshe could not inform about it toher husband as the accused usedto intimidate her that he woulddisclose to her husband that shehad lent Rs.50,000 to him andthey were having an affair.

However, one day she told herhusband about it after being fedup with her continuous exploita-tion and later lodged a complaintwith the police.

NEW DELHI, SEPT 24The Delhi High Court hasdismissed an appeal of theHaryana StateEnvironmental ImpactAssessment Authority(SEIAA) against a SingleBench verdict restraining itfrom prosecuting MarutiSuzuki India Limited fornot getting prior environ-ment clearance for itsresearch and developmentunit and test track inRohtak.

A Division Bench com-prising Chief Justice G.Rohini and Justice R. S.Endlaw, which did not findany merit in the appeal,observed in its judgmenton Monday that the matterwas being pursued “to sat-isfy the ego of some offi-cers”.

The High Court’s May26 order, challenged beforethe Division Bench, waspassed with the consent ofboth the parties, restrainingthe Haryana Authorityfrom initiating proceedingsagainst Maruti. TheSEIAA contended in itsappeal that the law onenvironmental matters didnot provide for “amicablesettlement” of disputes.

The Single Bench hadheld that if the validity of anotification, issued in2006, was upheld andMaruti, as well as its direc-tors, undertook to obtainpost facto environmentalclearance for its project inRohtak and all future proj-ects in Haryana, the Statewill consider not initiatingany criminal action against

the company.The Court said no steps

had been taken to elicit thecomments of theAdditional Advocate-General, who would havebeen in a position toinform on whose instruc-tions he had made thestatement before the SingleJudge.

In its 21-page judgment,the Division Bench said itwas unable to comprehendthe argument that the con-sent earlier given on behalfof the Haryana Authoritywas contrary to the statute.“It appears that Haryana, atthat time, was more inter-ested in the notification [of2006] as interpreted andenforced by it, being notchallenged and the disputebeing amicably settled.”

a budget of $74 million, nearly a tenth of theamount the US space agency Nasa spent onsending the Maven spacecraft to Mars.

Isro successfully ignited the main 440Newton liquid engine and eight smallthrusters that fired for 24 minutes andtrimmed the speed of the craft to allowsmooth orbit. A confirmation of orbit entrywas received at around 8am (0230 GMT).

After completing the 666 million kilometre(414 million miles) journey in more than 10months, the spacecraft called Mangalyaan -meaning Mars craft in Hindi - will now studythe red planet's surface and scan its atmos-phere for chemical methane. It will not landon Mars. Isro scientists will operate five sci-entific instruments on the spacecraft to gath-er data, the space agency's scientific secre-tary V Koteswara Rao told Reuters.

"By giving seven seats to four constituents(including RPI), they (Sena and BJP) haveinsulted us," the farmers' leader from westernMaharashtra said, adding we apologise topeople of Maharashtra for our mistake inaligning with such parties.

He alleged that there was a systematic planto oust them from the Mahayuti.

"We had asked Sena and BJP two monthsago if we had become a burden for them. Wewill go to people and organise a Sangharshyatra in the state to expose our betrayal,"Khot said.

"We were used. They offered us sevenseats. We said we don't want a single seat.Instead, at last night's meeting, we asked thatRPI leader Ramdas Athawale and RSP leaderMahadev Jankar be made chief minister byrotation," he said.

Khot alleged that everyone tried to getmore seats by using them.

"Both the parties (Sena and BJP) indulgedin that. We will tell this to people ofMaharashtra and expose them," he said.

While, Jankar said, the Sena and BJPstabbed us in the back.

"They stabbed us while talking sweetly. Wewill expose their real face to people ofMaharashtra," Jankar said.

"They treated us like beggars. Now wewon't go to them. They should come to us ifthey want to talk to us," he said.

Barricades to prevent hundreds of activistsfrom reaching the mahapanchayat affectedvehicular movement on several connectedLutyens’ Zone streets.

The recent eviction of Charan Singh’s sonand the former Union Minister from the bun-galow has triggered a series of protests inparts of Uttar Pradesh and Delhi. During onesuch protest held at Muradnagar, activistsunsuccessfully tried to cut off water supply toDelhi from the Gang Nahar plant.

Fearing a repeat, the Delhi Police hadimposed Section 144 of the CriminalProcedure Code in New Delhi, but theactivists, who had come from Uttar Pradesh,Delhi and Haryana, defied prohibitory ordersand tried to march towards the bungalow. Mr.Ajit Singh and his son Jayant Chaudhary,

however, stayed away from the mahapan-chayat.

Fearing the situation might go out of handdue to the arrival of a large number of pro-testers, the police blocked entry to TughlaqRoad from Aurobindo Marg and Akbar Road.Activists of the two parties were alsodetained at Prithviraj Road, SafdarjungRoad, Man Singh Road and several otheradjoining roads here. As a measure of abun-dant precaution, the Race Course metro sta-tion was also closed from 8.30 a.m.

By 2.30 p.m., the police had detained closeto 250 demonstrators and took them toParliament Street and Tilak Marg police sta-tions. But those detained remained defiantand accused the Centre of not respecting thelegacy of Charan Singh, whom theydescribed as the “greatest farmer leader” thecountry has ever produced.

Some also said the move to evict Mr. AjitSingh from the bungalow could have adverseeffect on the BJP’s electoral prospects in theHaryana Assembly elections, because of theRLD leader’s clout in the State. They threat-ened that more agitations will be launched onthe issue in the days to come.

This time around, do thesame paper without the sectional time limits.Do notice the different choices you make inquestion selection. Your own strong andweak areas in the testing arena will be clear-ly highlighted in this exercise.

There is nothing like taking a series ofmodel examinations that replicate the actualexamination in content, style and level of dif-ficulty. These tests need to be taken underexact test conditions — in one sitting andunder supervision. You will need to get intocomplete examination mode by shuttingyourself off from all external distractions andcomplete the examination. Do this multipletimes so that you become hard-wired toendure the 170-minute focus test. Also, thesemodel examinations should give you a verygood national performance feedback relativeto the other candidates across India who willbe your competitors in the actual examina-tion.The benefit of model examinations canbe extracted only if you include aPerformance Analysis Session after eachexam. Ideally, these sessions should happenwithin 48 hours of the model exam so that thequestions and your approaches in the examare still fresh in your mind. Another visit canbe done after the results or relative ranking ofmodel exams are published.

Ganga clean-up ....on the executive's efforts to rejuvenate the2,500 km-long river.

In response, the government said theCentre's efforts alone will not help the riverget a second lease of life, instead the“thought to keep the Ganga clean must come

We want you to commit to us.” Justice Thakur told Solicitor General RanjitKumar, representing the government.

Mr. Kumar said a commitment would be ofno avail unless the five Ganga basin Statesalso commit. He said it is primarily theresponsibility of these States to implementthe clean-up. The Centre, on its part, can onlymake the project and give funds to the States.

``The States should also commit as I(Centre) am committing to this court to cleanthe Ganga. Otherwise, we will roll out theproject and a babu sitting in some town willspoil our efforts,” Mr. Kumar said.

But Justice Thakur raised doubts about theCentre's political equations with the fiveStates.

“All these five States... all of them areruled by parties different from yours. Willthey co-operate with you? You have a differ-ent combination in the Centre,” JusticeThakur asked, assuring that the court woulddo the necessary to aid the Centre's efforts forGanga.

The government's three-phase Gangaclean-up plan includes a tentative Rs. 51,000crore project by the Ministry of UrbanDevelopment to extend sewerage coverage to118 urban habitations spread across the riverbank.

Another proposal is by the Ministry ofDrinking Water and Sanitation to make all1,649 grampanchayats located along theGanga banks free from open defecation.

The third is to enforce zero liquid dischargefrom “grossly” polluting industries locatedacross the five Ganga river basin States.

It said the long-term plan is to "restore thewholesomeness of river Ganga in terms ofdefining concept of ensuring Nirmal Dhara,Aviral Dhara and maintaining geological andecological integrity of the river".

Regulation of crop production has been aformidable challenge for the Board as thefarmers went on an overdrive in 2013-2014producing 316 million kg, much higher thanthe authorised crop size of 274 million kg.The Board has ensured that the entireTobacco was sold on auction floors ensuringthat farmers and traders have a win-win situ-ation.

Man slaps cleric ...about Navratri, police said.

"A man identified as Rakesh today slappedand pushed Imam Mehadi Hasan just outsidethe court when police were taking the imamto produce him before the judicial magistrateat Thasra in Kheda district," a police officersaid. The man has been detained, he said.Hasan did not sustain any injury in the inci-dent, police said. Later, principal civil judgePV Bhatt sent Hasan to 14 days' judicial cus-tody as he stated that he would not hire anadvocate to defend himself and also refusedto seek bail. Hasan, a Gujarat-based cleric,had shot into limelight when he offered askull cap to then chief minister NarendraModi during his 2011 Sadbhavna fast.

The ongoing agitation demanding that a governmentbungalow in Delhi’s Lutyens’ Zone be convertedinto a memorial for late Prime Minister Charan

Singh is an attempt by Rashtriya Lok Dal leader Ajit Singhboth to revive his waning political fortunes and keep thepiece of prime property under his control. Under orders tovacate the 12 Tughlaq Road building, which he is occupy-ing long after he ceased to be a Union Minister, Mr. Singhis seeking to perpetuate his family’s control over the spa-cious bungalow. It is true that some buildings that hostedeminent personages in the past have been given to founda-tions, trusts and institutions floated by political leaders.However, this should not be the norm, as there is a short-age of official accommodation for serving Ministers,judges and senior civil servants. The Supreme Court has inthe past authorised the eviction of allottees staying beyondtheir tenure and framed guidelines to prevent overstaying.In July 2013, the Court suggested that official buildingsshould not be converted into memorials. The rule wasalready in force then, as the Union Cabinet had as early asin 2000 banned such conversion. Further, there is already amemorial to Chaudhary Charan Singh, named appropriate-ly Kisan Ghat, to commemorate the champion of farmers’causes, in Delhi. Mr. Ajit Singh’s demand, therefore, isuntenable. He has mobilised both his supporters and theBharatiya Kisan Union, headed now by Rakesh Tikait, topress his demand to convert the bungalow into a memori-al to Charan Singh. The government has done the rightthing by moving to evict him by appropriate methods. Mr.Singh was given due notice and sufficient time to vacatethe premises. Power and water supply have been cut off. Itis to ward off such legal measures by political means thatthe former Union Minister’s supporters have taken to thepath of agitation. The authorities had to thwart an attemptby the protesters to stop water supply to Delhi by tamper-ing with a regulator. The latest is a ‘mahapanchayat’ calledby Mr. Singh at his residence, a move seen by the Delhiauthorities as a bid to mobilise a huge crowd of farmersand bring further pressure on the government. The DelhiPolice have banned the ‘mahapanchayat’ and detainedthose who tried to gather there. Mr. Singh must take fullresponsibility for the situation and any possible disruptionof law and order. Haryana Chief Minister Bhupinder SinghHooda and a few other leaders have waded into the contro-versy by voicing support for Mr. Singh’s demand in whatappears to be a pitch for Jat votes ahead of the HaryanaAssembly elections. The entire episode is yet anotherexample of the political class positioning itself againstpublic interest in pursuit of its narrow ends.

The Supreme Court ofIndia has, thankfully,decided to reconsider an

earlier order calling for reveal-ing the identity of the whistle-blower while hearing a petitionalleging gross misconductagainst the Director of thecountry’s foremost policeagency, the Central Bureau ofInvestigation (CBI). OnSeptember 15, a bench com-prising Justices H.L. Dattu andS.A. Bobde had made an egre-gious demand on the petitioner,Centre for Public InterestLitigation (CPIL) that it wouldaccept an affidavit filed on theNGO’s behalf only if itrevealed the source of its infor-mation. Earlier, CPIL had sub-mitted to the court, amongother documents, what italleged to be the visitor’s regis-ter to the CBI Director RanjitSinha’s residence, exposingseveral persons accused ofcrimes in the 2G-spectrum andcoal scam cases having methim. These meetings, accord-ing to the NGO, showcased theDirector’s complicity with theaccused, which compromisedtrials of critical public impor-tance.

In response to the SupremeCourt’s original demand for thename of the whistle-blower,CPIL filed a fresh affidavitinforming the court that it wasloath to revealing the name ofits source. “Several whistle-blowers have unfortunatelybeen killed after their identitywas revealed,” the affidavitstates. What’s more, along withits new affidavit, CPIL filed afresh plea requesting the courtto recall its earlier order. TheBench will now considerCPIL’s petition, after hearingthe opinion of the SpecialPublic Prosecutor AnandGrover, when it reconvenes onOctober 10.Why anonymity matters

Any decision from the court

on the admissibility of CPIL’splea could have, in the judges’own words, “great ramifica-tions.” At a time when lawsaround the world are beingstrengthened to encouragewhistle-blowing of corruptionat the highest levels, it wouldbe grossly pitiable were thecourt to disregard CPIL’s peti-tion purely on the basis of theNGO’s failure to reveal thename of its informant. If thecourt persists with its originaldemand for the name of thewhistle-blower — albeit in asealed cover — as a pre-condi-tion to taking the document onrecord, it will only serve to fur-ther weaken the state of whis-tle-blower protection laws inIndia, potentially closing thedoor on future crusades againstcorruption. Unless theanonymity of whistle-blowersis preserved and protected, it islikely that instances of dishon-esty by public officials willbecome not merely the norm —if it isn’t already so — but alsovirtually undetectable.

Anonymity, as John PaulStevens, a former justice of theU.S. Supreme Court wrote, byevoking J.S. Mill’s On Liberty,in his majority opinion inMcIntyre v. Ohio ElectionsCommission (1995), can be “ashield from the tyranny of themajority.” It can “protectunpopular individuals fromretaliation — and their ideasfrom suppression — at thehand of an intolerant society.”No doubt Mr. Stevens’ viewswere expressed in the contextof protecting political speechunder the First Amendment ofthe U.S. Constitution. But thebasis for such right toanonymity equally applies towhistle-blowers. To accordthem such freedom would pro-vide them a protection fromretaliation. As the affidavitfiled by CPIL informs us, whis-tle-blowers, whose identitieshave been revealed, have often

faced the wrath of the realoffenders: Satyendra Dube, S.Manjunath, Amit Jethwa andShehla Masood are but a fewinformants killed after theiridentities became public.

The argument against theprotection of anonymity can-vassed by Mr. Sinha’s counsel,that the Supreme Court wasoriginally inclined to accept, isthat the identity of the source isintegral to a proper adjudica-tion on the genuineness of theclaims, in this case, the veraci-ty of the logbook. But such aposition is both misconceivedand dangerous. As CPIL’s affi-davit reveals, there are a num-ber of ways in which theSupreme Court can probe intothe authenticity of the logbook.Just by way of example, saysthe NGO, the 23 Indo-TibetanBorder Police (ITBP) and CBIguards, who were stationed atthe residence of the CBIDirector can be examined byMr. Grover, and, if they sodeem fit, can be cross-exam-ined by Mr. Sinha’s lawyers.

There are numerous otherways in which the veracity ofthe logbook can be verified.The CBI is hardly in need oftutoring on such endeavours. Innumerous instances, the bureauitself has taken pains to protectthe anonymity of its sources,prosecuting the accused basedon confidential information,where even the complainanthas, at times, been kept uniden-tified.Admissibility of evidence

It might well be the case thatthe logbook from Mr. Sinha’sresidence was obtainedthrough illegal, or even unethi-cal, means. But the law of evi-dence in India, quite contraryto the American position, doesnot proscribe the admissibilityof evidence illegally obtained.India’s rules of evidence aremodelled on English law,where courts consistentlyrefuse to exclude evidence

obtained through an illegalsearch or seizure. The only testof admissibility is the relevan-cy of a document. Althoughthese are arguments to be madeand countered at a subsequentstage of the proceedingsagainst Mr. Sinha, there can belittle doubt that a register com-prising the names of the visi-tors to the CBI Director’s resi-dence is relevant in determin-ing his alleged complicity withthe accused in matters of suchenormous public significance.

What’s more, the SupremeCourt’s original objection toCPIL’s affidavit on the basis ofOrder IX Rule 13 of theSupreme Court Rules, 2013,appears not only pedantic butalso incorrect. Order IX com-prises the rules of filing an affi-davit in the Supreme Court.Rule 13 specifically states thatan “‘affidavit’ includes a peti-tion or other documentrequired to be sworn or veri-fied; and sworn includesaffirmed. In the verification ofpetitions, pleadings or otherproceedings, statements basedon personal knowledge shall bedistinguished from statementsbased on information andbelief. In the case of statementsbased on information, thedeponent shall disclose thesource of his information,including official records.”

Here, CPIL’s assertion aboutMr. Sinha’s complicity with theaccused appears to be based ona visitor’s register to his resi-dence. The assertion is admit-tedly a statement based oninformation and belief. But allthat CPIL was required to dis-close in its affidavit, and theverifying petition to its affi-davit, in order to maintain con-sonance with the rules, is thatits statements were based onthe logbook; this is so, becausethe source of the informationthat CPIL has asserted in itsaffidavit is the logbook byitself, and not the person who

secured the logbook from Mr.Sinha’s residence. In this case,the information in question isthe meetings held by Mr. Sinhawith numerous personsaccused of crimes in the 2Gspectrum and coal block cases,and the source of that informa-tion is the visitor’s logbook.The NGO is, under law, man-dated to disclose no additionalevidence.

Furthermore, as CPIL hashighlighted in its new affidavit,the Supreme Court in publicinterest litigation has oftenrelaxed the rules of procedurewhere questions of enormousnational significance are atplay. Ensuring a fair, uncom-promised trial of the accused inthe 2G spectrum and coal blockcases, given the enormity ofthe alleged crimes committed,is of particular public impor-tance. Even if the documentpresented to the court by Mr.Bhushan appears on the face ofit to be forged, the court mustallow the petitioner, possiblywith the aid of the special pub-lic prosecutor, an opportunityto establish the veracity of thedocument independent of anexamination of the whistle-blower’s authenticity. Ademocracy — where the meek-est deserve protection from themajority — ought to accord itswhistle-blowers the highestprotection, including the safe-guard of anonymity; whistle-blowers, as the history of otherdemocracies have shown us,represent a strong check onunbridled government power.If the shield of anonymity isallowed to wither, the jurispru-dence of our courts will onlyserve to encourage the worstforms of governmental trans-gression. The attention of theSupreme Court ought to be onthe message, and not the mes-senger.

The picture of PrimeMinister Narendra Modiand Chinese President

Xi Jinping sitting on the veran-dah of Hriday Kunj atSabarmati Ashram, which wasMahatma Gandhi’s residencefrom 1917 to 1930, is both wellcomposed and deeply coded.There are many messagesembedded in the photograph,and since China is the theme ofthe moment let us try decodingthem using Confucius’ sayingthat “a picture is worth a thou-sand words.” A student ofrealpolitik would see in it ahigh level of comfort betweenthe two world leaders with noawkwardness and no sign ofone being daunted by the repu-tation of the other. The bodylanguage conveys respect foreach other. From a state centricperspective, this is a perfectphotograph. A public relationsofficer could not ask for morefor it has all the soft power ele-ments needed for such a meet-ing; two heads of governmentrelaxing on a verandahexchanging opinions on world,domestic, or perhaps even per-sonal affairs. In form it is sim-ilar to the highly choreo-graphed photographs of G7heads of government headingout for a game of golf.

Symbols and societyIn this perfect picture, Prime

Minister Modi and PresidentXi Jinping, representatives of2.5 billion people, look sorelaxed as they sit on theverandah talking. It seems thatthey could be sitting on abench by the Sabarmati river-front gossiping. To an analystof realpolitik, the photographannounces India’s acceptanceas a global power. The mes-sage that comes across, loudand clear, is that for the twoheads of government the pic-ture alone was important, thelocation was not. It was a state-ment of state power. It needed

to tell the world that the twoleaders, and therefore the twocountries, can, and will, dobusiness with each other. Forthe purposes of the photo-graph, the verandah could beanywhere.

But it was not anywhere.And that is where the problemof another reading comes. Theverandah is that of theMahatma’s home at HridayKunj. To complicate mattersfurther, this is not just anyhome, say a place like BirlaHouse in Delhi, but his homein the Sabarmati Ashram. Whyis the fact of two state leaders,sitting casually on the veran-dah of Gandhiji’s home inSabarmati Ashram, with theirback to the home, worthy ofsuch detailed analysis? Whydoes one want to give the pho-tograph more semiotic contentthan it can apparently support?

The answer lies in the impor-tance that symbols have forany society. Symbols give asociety a sense of worth andpurpose, allowing it to distin-guish the special from the ordi-nary, the valued from theworthless. Symbols play a sig-nificant part in the making of aculture. A modern state needsto add elements to its culturethat are consistent with its phi-losophy. This it does by con-ferring meaning on a new actor place. Any society, especial-ly the ones as ancient as Indiaand China, have, in their histo-ry, created many sites on theirterritory that they come toregard as hallowed land. Thissacred status is given eitherbecause an event of impor-tance has taken place there,such as Jallianwalla Bagh, orbecause an important moralstatement, that went on todefine the core of that civilisa-tion’s weltanschauung, wasenunciated there, such asBuddha’s sermon at Sarnath, orbecause an iconic figure isburied there, such as the shrineto the Sufi saint Moinuddin

Chisti at Ajmer Sharif.To finesse the argument, we

must distinguish between hal-lowed sites and important sitesin the symbolic landscape of asociety. A hallowed siterequires one sort of behaviourfrom the visitor and an impor-

tant site another. At Red Fort,for instance, an important sitewhere the Prime Minister givesthe Independence day address,one would expect one sort ofbehaviour, while atDeekshabhoomi, where Dr.Ambedkar converted toBuddhism, a hallowed site, onewould expect another. Whenthe 12 gram sabhas atNiyamgiri in Odisha votedagainst mineral exploration atNiyamgiri hill, they were vot-ing to preserve the sacrednessof the hill and in opposition tocapitalist behaviour which theyconsidered disrespectable oftheir sacred site. Sacrednesswas more important thanwealth. Sometimes, societiesestablish such preferences.

The question then arises iswhether Hriday Kunj meritsthe status of a sacred site.From the biographies ofGandhiji, one learns how cen-tral it was in the struggle forfreedom. You read of how he

chose the site, between a jailand crematorium, “as hebelieved that a satyagrahi hasto invariably go to eitherplace.” You learn of the morn-ing prayers that were, and are,held there. The ashram websitetells you that his vision for the

ashram was for it “to serve asan institution that would carryon a search for truth and a plat-form to bring together a groupof workers committed to non-violence who would helpsecure freedom for India.” Itwas one of the main centres ofIndia’s freedom movement. Itwas a site from which satya-graha emerged as a moralstatement against state power,especially imperial power.

The moral with the politicalThe ashram is a moral mes-

sage in material form. Whenyou walk into its campus, youdefinitely feel you are in a hal-lowed place. It is simple in itsconstruction and yet you cansee in its layout a thing ofbeauty. It gives you a feeling ofspiritual power. Even a non-believer would feel this. InGandhiji’s home, a simplecharka, complete in its mini-malism, sits on the verandah.When you look at it, you are

astounded by the thought thatthe spinning of this simpleinstrument galvanised a nation.From this humble abode, adream was launched thatbrought an imperial power toits knees. The sacredness ofHriday Kunj is so palpable.

The demonstration of statepower, the photograph, seemsso out of place here since thisis a site that combines moralforce with political power. Itembodies the spirit of India’sfreedom movement. It is tocontemporary India what, Isuppose, Mao’s mausoleum isto contemporary China, a placeof reverence, a site from whichits new civilisation will be con-structed.

What makes it even morehallowed is that, in addition toit being so central to our strug-gle for swaraj, it is also anashram. This gives it a doublesacredness. The ashram was toGandhiji a place where itsmembers were required topractise certain observances ifthey were to qualify for publicservice. If the membersacquired the habit of theseobservances then, and onlythen, would they serve thecause of Truth. From this otherreading, the picture we are dis-

cussing seems to disregard thesacredness of the site. It shouldhave been taken on anotherverandah, perhaps at the Nehrumemorial.

The other storyOne could argue that I am

overstating the case. Two pow-erful heads of government incasual conversation amounts tono offence. But the body lan-guage tells another story. It istoo suggestive of the strategis-ing that marks state power. Becasual. Appear relaxed.Convey confidence.Communicate parity. It shows,to the discerning viewer, thenew posturing that heads ofgovernment must adopt in thisage of instant communication.Every gesture is important andchoreographed because it getscarried worldwide instanta-neously. So don’t yawn,demonstrate power causally.

What I was hoping to see,instead, was humility in thephotograph. When anybodyvisits Gandhiji’s Ashram, eventhe U.S. President, they mustfeel humbled for they are in thepresence of a sacred spacefrom which a moral civilisa-tional movement was launchedwith the tools of satya andahimsa. What can be seen inthe photograph, the thousandunspoken words, is in its placethe arrogance of state power.You get a sense of a place com-mandeered by state diktat.Rather than the visitors sub-mitting to the codes of theashram, the ashram is com-pelled to submit to the instruc-tions of the state, given bysome state babu. Gandhijiwould have gone on a fastagainst this arrogance.

Again I may be accused ofexaggeration, of being the can-tankerous academic. So let uslook for more clues in the pic-ture. Notice that there are noother people in the picture. Forexample, none of the trusteesof the ashram are there, as one

would expect to be showingthe dignitaries around, demon-strating the wonders of theCharka and its philosophy.Should not at least one of thetrustees be in the picture? Hadthey been asked to move awaywhen this photograph for his-tory was being taken? That isexactly the point. Should notthe state have submitted itselfto the codes of the ashram ordo we not think about thesesubtle but important matters inthis new order? Here is a civil-isation that prides itself on itsrituals, read U.R.Ananthamurthy’s Samskara, somuch so that we penalisesocial transgression. But in thishistoric photograph, theashram, its trustees and work-ers do not have even a tokenplace. China and India are bothold civilisations in which thesymbolic has an importantplace. The new states we arebuilding are unmindful of thecore moral message that statepower will not, I repeat, willnot get primacy in all spaces.Old cultures give a lot of valueto sacred spaces that havecodes of behaviour that mustbe respected. This photographreveals that state powerimposed itself on the ashram,blanking out the latter’s pres-ence. Gandhiji wanted theashram to be a training groundfor politics, where the obser-vances of the ashram wouldserve as the bedrock of a moralpolity. The photograph, revers-es this fundamental relation-ship, imposing, in contrast, thestate’s values on the ashram. Isthis something to think about?

KOCHI, SEPT 24Talks on resuming trainservices to HarbourTerminus Railway Stationare gathering pace with therailways speeding up worksto complete Venduruthy railoverbridge.

The construction of thebridge lagged indefinitelythough Venduruthy roadoverbridge – work on whichbegan much later – wasthrown open to vehiclesover two years ago. Therailways opted for a newbridge after a dredgerdeployed by Cochin Portrammed the old bridge builtduring British era.

“With final works gainingpace, the bridge is sched-uled to be commissioned byMarch 2015,” saidErnakulam Area Managerof Southern Railway RajeshChandran. With the bridgegetting ready, the railwayshas accorded priority torevive Harbour Terminusstation as a hub for passen-ger and goods trains. Mostpassenger and goods trainsfrom Ernakulam beganservice from the station, till

Ernakulam Junctionemerged as a terminal sta-tion. Mr. Chandran said theproposal to resume trainservices to the station wasunder active consideration.

“Indian Navy’s approval iskey to restart operationsthrough the line that islocated near naval airport.”

The Navy had objected toinstalling overhead electriclines over the stretch, citingsafety of its aircraft. Toovercome this issue, therailways had volunteered toswitch off power supply tothe lines during aircraft takeoff. Though a proposal wasmooted to substitute electric

At least sixpassenger/MEMU trainsfrom northern and southerndistricts could terminatetheir trip at HarbourTerminus once the line iselectrified, thus decongest-

ing Ernakulam Junction sta-tion.

The railway, port andother stakeholders are keenon augmenting transporta-tion of goods to and fromKochi port through rail.While providing fast andhassle-free movement ofgoods, this will in turnboost revenue forT h i r u v a n a n t h a p u r a mRailway Division.

In the meantime,Ernakulam Old RailwayStation Vikasana Samiti, anNGO spearheading thedemand to renovate the sta-tion and rail lines locatedbehind the High Court ofKerala, has planned a call-ing-attention meeting onOctober 1 on the 40-acrepremises.

“We expect green signalfrom the Railway Ministryfor the project since the sta-tion can decongest the twomajor stations in the city,speeding up trains that areoften held up in the periph-ery due to unavailability ofvacant track,” said M.R.Rajendran Nair, chairmanof the samiti.

Venduruthy ROB work back on track in KochiMANGALORE, SEPT 24 Numerous students andmembers of the AkhilBharatiya VidyarthiParishad (ABVP) marchedthrough the city onTuesday demanding thearrest of those who postedindecent pictures ofwomen on a social net-working site.

According to the protes-tors who took out a rallyfrom Besant Women’sCollege to the PoliceCommissioner’s Office, afake Facebook account hadbeen created by unknownpersons where pictures ofgirls from the city werebeing posted.

“By posting morphedpictures of girls, the cul-prits behind the page are

jeopardising the future ofthe girls and damagingtheir reputation. There is areal possibility that thesegirls may even discontinuetheir education to escapefrom the humiliation,” saidLavin Kotian, district

organising secretary ofABVP. Gathering in frontof the police commission-er’s office, the organisationaccused the cyber crimecell of the police of ignor-ing a complaint filedagainst the page and its

creators.“Even though a com-

plaint has been filed at theBarke police station, thepolice has done little toarrest the people behindthese morphed photos,”said Mr. Kotian.

ABVP protests against indecent internet photos

CHENNAI, SEPT 24A 22-year-old man who flew into thecity from an ‘affected region’ wasadmitted to Rajiv GandhiGovernment General Hospital (GH)late Monday night, as a precautionagainst the deadly Ebola virus.However, as of Tuesday evening, hewas doing well, hospital authoritiessaid. The man, who flew in fromNigeria via Abu Dhabi, had been illwith fever for several hours. Since hehad just arrived from a country thathas had about 20 cases of Ebola, hewas identified by public health offi-cials at the airport’s screening pro-gramme and taken to the isolationward at GH, where he is currentlyunder observation.

“A fever profile was done and thepatient was put under treatment. Histemperature has gone down and he isnow doing well,” said GH Dean R.Vimala. Doctors at GH said all safe-ty precautions were being taken andthat the standard protocol was beingfollowed.

A blood sample was taken and sentfor testing for the virus, said S.Balasubramanian, joint director (epi-

demics), Directorate of PublicHealth. “The results are expectedwithin the next three days, and untilthen, we will keep the patient underobservation,” he said.

The man, a lab technician, hasbeen working at a private clinic inNigeria for the past four months andhails from Ariyalur district, hospitalofficials said.

His family has been informed andhis cousins were at the hospital onTuesday, an official said.Incidentally, the man was trained as atechnician at Madras MedicalCollege, which is attached to GH.

This is the second case of anadmission to GH, the first being of a25-year-old from Theni district whowas admitted on August 9 and wasdischarged the following day.

At over 180 decibels,aircraft engine exhaust canbe an ordeal — and ahealth hazard — for thosein proximity to the aircraft.

A solution, however,might in the horizon,thanks to researchers at theIndian Institute of Science.A “nozzle” developed by ateam from the Departmentof Aerospace Engineeringcould reduce noise signifi-cantly, they say in a paperin the journal, AppliedThermal Engineering.

The nozzle works byslowing down the hot,high-energy aviation fuelexhaust, explained co-author Gopalan Jagdeesh,professor at the depart-ment. “In a conventionalcone-shaped nozzle, theexhaust is released withmassive momentum, car-rying huge energy and cre-

ating noise. But the newnozzle [shaped like petals]allows the exhaust tospread and get assimilatedquickly into the coldatmosphere,” he said.New-age fridges too

In fact, the new nozzlesaw a doubling of the rateof exhaust assimilationinto the ambient air,according to the paper.The device does more thanjust make airplanes qui-eter, it improves theengine performance, saidProf. Jagdeesh. The nozzlealso has potential applica-tions in creating eco-

IISc.’s nozzle can reduce aerial noise

CHENNAI, SEPT 24Three-tier protection is inplace at Anna ArignarZoological Park inVandalur, to protect ani-mals from human visitorsand visitors from wild ani-mals, say zoo authorities.

On Tuesday, a 20-year-old man accidentally fellinto the white tiger’senclosure at New Delhizoo, and was later mauledby the big cat.

According to wildlifeauthorities, such accidentsare unlikely to happen atVandalur zoo as the carni-vore enclosures are pro-tected three ways — witha high-rise moat, a chainlink fence to separate visi-tors from the enclosures,and stand-off railings.

The chain link fence isabove a normal humanbeing’s height.

Visitors are allowed upto only 50 per cent of thecircumference of the car-nivore enclosures. Theremaining area is cor-doned off to visitors.

Similarly, the lion’senclosure is also providedadequate cover and thevisitors cannot go beyond

a certain point, saidK.S.S.V.P. Reddy, zoodirector and additionalprincipal chief conservatorof forests.

Zoo officials said, stu-dents visiting in groupsalways pose a major chal-lenge to animal keepers asthe youngsters often taketo taunting and tormentingthe animals by throwingsticks, stones or food itemsat them.

According to veterinari-ans, in the event of anaccident similar to whathappened at the NewDelhi zoo, the only way todrive the animal awayfrom the victim is bybursting crackers.

MANGLORE, SEPT 24Farmers, who are members ofthe Central Arecanut andCocoa Marketing andProcessing Cooperative Ltd,can now hope to have theirchildren pass the civil serviceexaminations.

The cooperative will soonlaunch a project under whichthe aspirants will be trained forthe examinations.

Announcing this at the 40thannual general body meetingof the cooperative here onTuesday, the president,Konkodi Padmanabha, saidthat 30 per cent of the memberdevelopment funds will bereserved for the training.

The objective will be to helpchildren of farmer members ofthe cooperative get into theIndian Administrative Service,Indian Police Service, IndianForeign Service, IndianRevenue Service and othercivil services for which exami-nations and interviews are con-

ducted by the Union PublicService Commission.

Training will also be given tochildren for the examinationsconducted by the KarnatakaPublic Service Commission.

Campco to train farmers’ children forcivil service examinations in Mangalore

HYDERABAD, SEPT 24The Telangana government on Wednesday decided toinclude the Rs.300-a day-honorarium for home guards inthe non-plan budget with a view to ensure prompt pay-ment every month and release their arrears for threemonths before Dusshera. Making the announcement at apress conference here, Home Minister Nayini NarasimhaReddy and Finance Minister Eatala Rajender said thewages of home guards accumulated every month as theywere not budgeted in the past. The files pertaining to theirhonorarium were sent to the Finance Department everytwo months resulted in delay in releasing the amount. Toensure their payments on the lines of other governmentstaff, the amount of Rs. 300 would be deposited in homeguards’ accounts on the first of every month.

They said there were 19,000 home guards in the serviceof police in the State. The decision taken on Wednesdaywas part of Chief Minister K. Chandrasekhar Rao’s pollpromise.

Special Judge A AWalimohammad recentlyconvicted the trio -Vitthal Mhasu Patil (28),Rajendra Saw aliasRanjit Shiv Charan Saw(30) and Raju @Nanjunda ShivappaGowda (29) - and sen-tenced them to three-yearRI.

The three were alsofined Rs 2,000 each, fail-ing which they will haveto undergo another sixmonths' imprisonment.

The four others arrest-ed in the case wereacquitted. One of theaccused, ParwezHamidulla Ansari, is stillabsconding, the courtnoted and ordered thatthe case against him willbe dealt with later afterhis arrest.

The minor girls whowere pushed into fleshtrade were from variousplaces, including Assam,West Bengal, Odisha,Indore, Madhya Pradeshand also Bangladesh.

In most parts of India, power cutsare a common occurrence. Astechnology has spread, the

demand for power at all hours hasgrown. Keeping that in mind,Kunhar Peripherals hasdesigned a UPS that can becharged by the sun. Withabundant sunlight but notenough electricity in India,a solar-powered portableUPS seems like a productthat many would want. Butdoes the Porta-Solar pro-vide enough power to justi-fy an investment of Rs.5,000? We used it for a cou-ple of weeks to find out.

DesignAt first glance, the

Powersafe Porta-Solarmight appear a little intimi-dating. It looks like itbelongs in an engineer'sworkshop rather than ahome. It's not the kind of prod-uct you should start using withoutreading the manual. For example,we couldn't figure out at first whatthe three LEDs on the front of theUPS were supposed to indicate astheir icons are not self-explanatory.

The Porta-Solar has a solar charg-ing port on the front along with threeUSB ports, a button to turn on theUPS, and another which controls thethree two-pin plug points on itsback. There's also three-pin inlet onthe back which lets you charge theUPS via domestic AC power.

The Porta-Solar is quite compactfor a UPS, but looks can be decep-tive and it weighs a surprising 3kg.Its portability is further diminishedby the solar panel, which takes upquite a bit of space. The solar panelisn't included in the package, so youwill have to buy it separately.

PerformancePowersafe says the UPS is rated at

70W and recommends that you buya solar panel of at least 24W tocharge it with. We tested it with a36W solar panel. This product isclearly meant to be used as a second-ary power backup solution. Youcan't expect it to replace an inverter

or a generator.The UPS takes a long time to

charge using solar power.

Powersafe recommends that you letit charge for at least 8 hours. Duringour tests, we found that it took morethan that to go from zero to fullcharge on AC power. Charging timeincreased even further when we triedusing the solar panel.

That wouldn't have been much ofan issue if the UPS had been able toprovide sufficient power backup. Wefound that it ran out of power afterwe charged three smartphones (aniPhone 5s, a Nexus 5 and an HTC8S). If you use a basic featurephone, then you might have enoughpower to charge it four or five times.The company says that you will getaround 6-7 hours of power, but thatmight only be the case if you use alow-power CFL.

We tested it with a 15W bulb andfound that the UPS could power itfor 5 hours 40 minutes on a fullcharge. While this could be veryuseful in rural areas where loadshedding is frequent, we felt that thebattery backup time isn't sufficient.If you want to power a bulb andcharge a phone at the same time, thebackup isn't going to last too long.

Note that this UPS wasn't able topower a 60W bulb. It's meant to be

used with CFLs, but these costRs. 200-300 each, which will

sufficient for short powercuts. During one of our tests, we hadan hour-long outage at night. Wemanaged to keep a Wi-Fi router run-ning during this time and alsocharged a phone. Similarly, this UPSmight be useful to take along withyou if you are visiting a place witherratic electricity supply.

VerdictThe Powersafe Porta-Solar is tar-

geted at rural consumers, and itsability to be charged using solarpower will be useful in those parts.Its main appeal lies in the fact that itcan be used at near-zero operatingcost. Thanks to solar power, onceyou buy the UPS and a solar panel,there are no additional runningexpenses. At Rs. 5,000 though, weexpected better performance. Thesolar panel costs around Rs. 1,000 toRs. 2,000 more, further driving theprice up. The long charging time andrelatively low power capacityrestrict its appeal.

However, if you are looking for abackup power source that runs atnear-zero cost, the Porta-Solar is adecent product.

Motorola on Wednesday said it would reveal theIndia pricing of the Moto X (Gen 2)by 12 noon, and keeping to its

word, the company has announced its latestflagship smartphone will be priced at Rs.31,999 (16GB), while the wood and leatherback panel variants will be priced at Rs.33,999.

It will available from midnight exclu-sively via Flipkart - no details have beenprovided about if the 32GB model willarrive in India.

NEW DELHI, SEPT 24 The government on Wednesday saidthat the National SportsDevelopment Bill was “ready” and itwill be introduced in Parliament inthe upcoming winter session of theHouse.

“The Bill is ready and circulated toall the stake holders. After a changein the government, fresh commentswere sought. IOA has been draggingits feet but we will present the Bill inthe next session of the Parliament,”Ajit Sharan, Secretary Sports, said ata press conference.

All the National SportsFederations (NSFs) accredited to thegovernment need to comply with thestipulations that office bearers retireat the age of 70 years and except forthe President who is allowed threeconsecutive terms, none of the otheroffice-bearers would be eligible tocontest a third term immediatelyafter completing two successiveterms.

IOA had initially objected to ageand tenure guidelines even as someNSFs have already implementedthem.

Sharan made the statement in pres-ence of Sports Minister SarbanandSonowal, who through his secre-taries, made a presentation, listingachievements after completing 100days in the office and policies forfuture.

Sonowal, who hails from the NorthEast, that his ministry was commit-ted to support sportspersons so thatthey can “realise their potential”.

Talking about accountability ofNSFs, Sharan said it was “delicatematter”.

“The NSFs are autonomous bodiesand subject to RTI. They have beenadvised to put information on theirwebsites, relating to expenditure,(criteria for) selection of athletes,money spent on office bearers. Byputting this information in publicdomain is part of accountability,” hesaid.

Asked specifically about BCCI ifthe government was a failure to

bring the cricket board under theRTI, Sharan said they were not.

“The High Court in Chennai hasput a stay and we could not get thatvacated but efforts have been thereto bring BCCI within the ambit ofRTI,” Sharan explained.

About Boxing India getting provi-sional recognition from AIBA to runthe affairs of the sport in the country,Sharan said after that the IOA AdhocCommittee, which was managing thesport’s issues, has been dissolvedand they are considering BoxingIndia’s application for recognition asNSF.

Competitions with prize moneyworth Rs. 1 crore in each sports, willbe held exclusively for Indian ath-letes. The first such competition forboxing will be held from December14 to 18 while for archery it will beorganised from January 15-19.

“Top-16 athletes in each sport willcompete against each other and thewinner is expected to get Rs. 2 lakhat least,” he said.

ANTIGUA, SEPT 24 Still recovering from a hamstring injury, swashbucklingbatsman Chris Gayle was on Wednesday left out of theWest Indies’ 15-member squad for the one-day seriesagainst India scheduled next month.

Dushyant was the only athlete tomanage a podium finish as hegrabbed a bronze in the men’s light-weight single sculls event on whatturned out to be a mixed day for theIndian contingent.
