S Tech Consulting was retained by MidPen Housing Corporation to conduct a pre-demolition asbestos and lead-based paint assessment of the commercial property located at 1710 Moorpark Avenue in San Jose, California. A portion of the existing church facility will be demolished to clear the land for redevelopment.
Prior to conducting renovation or demolition, the EPA and Cal-OSHA require the sampling of building materials to determine whether asbestos is present. When asbestos is identified and will be disturbed, it must be handled and disposed of by trained and licensed personnel, to prevent the creation of an airborne asbestos hazard. Lead paint is regulated by EPA and OSHA to prevent creating a lead exposure hazard for workers and especially children.
The assessment was conducted on September 18, 2019 by Sean Tillema, a State of California Certified Asbestos Consultant (CAC 07-4257) and a State of California Department of Public Health Lead Related Construction Certified Inspector / Risk Assessor (LRC-2901).
This executive summary is not to be utilized as a stand-alone document. The report shall be read in its entirety. Any interpretation, use, or conclusions resulting from the data contained in this report is the responsibility of the reader.
The following conclusions were arrived at from the field investigation and laboratory analysis. See the report body and recommendations for specific information on the items listed below and how best to proceed. Site plans and asbestos sample locations are provided in Appendix ‘A’. Asbestos laboratory reports are provided in Appendix ‘B’. Selected Site Photos are provided in Appendix ‘C’.
Asbestos
✴ In the attic of the Swedish Hall office wing, the seam tape insulation associated with duct registers contains 25% Chrysotile asbestos. The cloth tape is classified as a friable, Regulated Asbestos Containing Material (RACM). There are six registers, approximately Total of 12 square feet of material.
✴ In the attic of the Swedish Hall office wing, the flex joint associated with heating furnace is assumed to contain asbestos. The cloth material is classified as friable, RACM. There is one flex joint present.
✴ Throughout the building, there is a layer of vinyl floor tile containing up to 4% Chrysotile asbestos. The flooring is classified as Category I, Non-Friable Asbestos Containing Material (ACM). The asbestos flooring layer is found either exposed, under carpeting, under a newer layer of floor tile, or assumed under ceramic tile. See the flooring plan in Appendix ‘A’ for a color coordinated detail of the flooring conditions. All flooring is installed over concrete. There is approximately 9,410 square feet of flooring. Note, at the time of the assessment, we were unable to conduct destructive investigation to verify concealed floorings under the ceramic tile. Until more destructive assessment can occur, the asbestos flooring is assumed to be under the ceramic tile.
✴ The black flooring mastic, associated with the above listed asbestos containing floor tile, contains up to 5% Chrysotile asbestos. The mastic is applied over concrete. Removed manually, the mastic is classified as a Category I, Non-Friable ACM. Removed by a more likely mechanical means, the mastic is rendered friable and must be handled as RACM. There is approximately 9,410 square feet of asbestos containing flooring mastic. Note, further investigation is necessary to determine conditions under the ceramic floor tiled areas.
✴ The roofing flashing mastic, associated with the main roof and the chapel roof connection, contains 4% Chrysotile asbestos. The mastic is classified as a Category I, Non-Friable ACM. There is approximately 50 square feet of asbestos containing roofing mastic.
✴ The joint compound, associated with the drywall in the Swedish Hall office wing, contains a trace asbestos content of less than (<) 0.1% Chrysotile, confirmed by 1000 point count analysis. Materials containing less than one percent asbestos, confirmed by more precise point count analysis, are not regulated by the EPA for renovation, demolition, or disposal. For Cal-OSHA compliance, the taping compound is referred to as ‘Unclassified Asbestos’, falling below the threshold of classification for ACM (>1%) or ACCM (>0.1%). While disturbance to the drywall system does not require the contractor to be DOSH asbestos registered, contractors must remain in compliance with Cal-OSHA Title 8 Section 1529. Throughout Title 8 Section 1529 there are universal health and safety requirements pertaining to asbestos in any amount or concentration. There is approximately 2,830 square feet of material.

✴ The acoustical plaster, associated with the gable wall of Swedish Hall and the Luther Hall ceiling and storage closets, contains a trace asbestos content of less than (<) 0.1% Chrysotile, confirmed by 1000 point count analysis. Materials containing less than one percent asbestos, confirmed by more precise point count analysis, are not regulated by the EPA for renovation, demolition, or disposal. For Cal-OSHA compliance, the acoustical plaster is referred to as ‘Unclassified Asbestos’, falling below the threshold of classification for ACM (>1%) or ACCM (>0.1%). While disturbance to the acoustical plaster does not require the contractor to be DOSH asbestos registered, contractors must remain in compliance with Cal-OSHA Title 8 Section 1529. Throughout Title 8 Section 1529 there are universal health and safety requirements pertaining to asbestos in any amount or concentration. There is approximately 1,545 square feet of material.
✴ A notification for the demolition of the structure must be submitted to the Bay Area Air Quality Management District (BAAQMD) a minimum of ten working days prior to beginning demolition related work. If the identified asbestos containing flooring mastic will be removed by a mechanical method, the notification should reflect the removal of Regulated Asbestos Containing Material (RACM). Once the notification is submitted a ‘J’ number will be issued by the BAAQMD for the project. A copy of this survey must be submitted with the demolition notification and should remain onsite during the course of asbestos and demolition related work.
Lead
✴ Interior and exterior, EPA defined Lead-Based Paint (>1.0 mg/cm2 by XRF) is present in coatings on metal windows sashes anticipated to be impacted by the scope of the demolition. The paint on the window sashes was intact at the time of the assessment.
✴ For Cal-OSHA Lead in Construction (CCR Title 8, Section 1532.1) compliance all paints are assumed to contain a quantifiable lead content. Contractors should either have historical exposure assessment data available or should conduct exposure assessments on representative employees working on the project. Tasks that are likely to create high lead exposure are abrasive blasting, flame torching, and mechanical grinding.
✴ It is the responsibility of the environmental and demolition contractors to comply with all EPA and DTSC waste disposal regulations when conducting lead related work and demolition activities. Any paint chips generated from paint film stabilization are assumed RCRA hazardous waste and must be disposed of accordingly. All wastes must be disposed of in the proper facility.
Additional Pre-Demolition Requirements
✴ As part of the pre-demolition environmental remediation, the environmental contractor must walk through all buildings and remove universal wastes such as fluorescent light bulbs and tubes, ballast containing light fixtures, coolants, and any household hazardous waste. All items must be properly segregated and packaged for proper disposal, prior to demolition. The owner must be provided copies of all waste manifests.
General Requirements for Proceeding
Verification of material quantities and site working conditions are the responsibility of the contractors that will be performing future abatement and demolition activities at this site. All estimates in this report will be verified prior to bidding on any environmental or demolition related work. Discrepancies or questions should be addressed prior to bidding, not after.
Concealed areas may harbor additional suspect material. Care should be taken when accessing wall cavities or other areas that provided limited access during the survey. Asbestos cement pipes and insulated pipes are commonly concealed in wall cavities and underground utilities. Care should be taken when excavating. Should any additional materials be discovered, call us and we will sample and analyze accordingly.

Introduction
S Tech Consulting was retained by MidPen Housing Corporation to conduct a pre-demolition asbestos and lead-based paint assessment of the commercial property located at 1710 Moorpark Avenue in San Jose, California. A portion of the existing facility will be demolished to clear the land for redevelopment.
The purpose of the assessment was to evaluate the presence, extent and condition of any above-ground, accessible suspect asbestos materials and lead-containing paints associated with the construction and finish materials for the structure in the scope of the assessment. Both the EPA and Cal-OSHA, amongst other agencies, require such hazards be identified to protect the public, workers, and the environment during renovation and demolition. Specifically, the scope of the project is detailed below:
Asbestos
o The performance of an asbestos survey inspection of the subject structure in the demolition scope of work, in accordance with the Bay Area Air Quality Management District’s requirements.
o An initial investigation to locate suspect ACMs. o Physical assessment of suspect materials. o The collection of bulk samples from suspect ACMs. o Laboratory analysis of collected samples.
Lead-Based Paints and Lead Containing Materials
o A visual inspection of the painted surfaces and glazed surfaces of the subject structure in the demolition scope of work.
o The usage of a portable X-ray Fluorescence device to determine lead content in paints and ceramics. o Laboratory analysis of collected samples where necessary.
Laboratory analysis was performed by AmeriSci Los Angeles, an independent and accredited NVLAP and AIHA laboratory.
All field inspection activities were conducted by Sean Tillema, Certified Asbestos Consultant (CAC 07-4257), and a Lead Related Construction Inspector/Assessor (LRC-2901).
Field inspection activities occurred on September 18, 2019.

Property Description
The site is a church facility constructed in the 1950s. There has been at least one addition to the original construction. The facility consists of a church that is connected to office administration wings. There are also connected classrooms and community halls associated with the structure. The church, chapel, and choir room are not included in the scope of the demolition. All other areas of the facility will be demolished to allow for a new housing development to be constructed.

Property Description - continued
The subject structure in the scope of the demolition is a single story church facility on a slab on grade foundation. The facility was built in the 1950s and has at least one addition (office wing) to the original construction. There is a basement under the church section that is not a part of the scope of the demolition. There was limited access to attic spaces and plenum areas at the time of the assessment. The ceramic flooring could not be impacted to investigate for concealed floorings at the time of the assessment.
The exterior of the facility is clad in stucco siding. Roofing includes rolled asphalt roofing on flat sections of the roof and composite asphalt shingle roofing on the pitched sections of the roof. Windows are a combination of fixed and operable with window putty being present on the operable metal windows.
Interior walls and ceilings are a combination of plaster with button board and textured drywall. Swedish Hall has a wood ceiling. There are limited areas of acoustical plaster present in both the Swedish and Luther Halls. Flooring includes vinyl floor tile, carpet, and ceramic. The original vinyl floor tile is throughout the facility and assumed to be concealed underneath the ceramic tile.
Climate control for the facility is provided by a central HVAC system. The ducting is predominantly roof-mounted rigid metal that is wrapped in silver bubble insulation. The office wing has a furnace in the attic with rigid metal ducting that is insulated with fiberglass insulation. There is a white seam tape associated with the registers and an assumed asbestos containing flex joint associated with the furnace.

Asbestos Containing Materials
Asbestos-containing material (ACM) is defined by the Federal Environmental Protection Agency (EPA) as material containing more than one percent asbestos as determined by Polarized Light Microscopy(PLM), however, the California Department of Occupational Safety and Health (CalOSHA) classifies any material having greater than one tenth of one percent (>0.1%) asbestos as Asbestos-Containing Construction Material (ACCM). In combination, the EPA and OSHA requirements govern the testing, handling and disposal of materials containing asbestos.
The EPA’s National Emission Standards for Hazardous Air Pollutants or NESHAP regulations dictate requirements for activities involving renovation and demolition of buildings containing asbestos. In San Clara County, the NESHAP regulations are administered and enforced by the Bay Area Air Quality Management District (BAAQMD). Outlined in the NESHAP regulations, 40 CFR 61, Subpart M, are categories for each asbestos containing material (ACM, >1%) based on friability or the potential for a material to become friable. The word ‘Friability’ refers to a material’s likeliness to release airborne fibers in-situ, or under mechanical pressure.
At the time of the asbestos survey, a material may be classified as non-friable in its undisturbed state but may be rendered friable from damage or during removal phase based on the method of removal. For example, the usage of mechanical removal methods (floor buffers, floor chippers, grinders, saws, heavy equipment) will likely create a friable waste stream. Friable materials, or non-friable materials rendered friable, are referred to as ‘Regulated Asbestos Containing Material’ (RACM). These materials require notification to the local air quality management district (AQMD) or air pollution control district (APCD), prior to asbestos removal occurring.
Non-friable materials are divided into two categories; Category I Non-Friable ACM and Category II Non-Friable ACM. The categories relate to the type of material and their likelihood for becoming friable when disturbed. This report identifies materials in their state at the time of the survey as there is no way to predict what particular removal method a contractor may choose to employ.
OSHA has its own classifications for asbestos and work related to asbestos. Cal-OSHA requires a State of California Division of Occupation Safety & Health (DOSH) registered asbestos contractor to perform removal work when a material has greater than 0.1% asbestos (ACCM). Trace asbestos, falling below classification as either ACM or ACCM are referred to as ‘Unclassified Asbestos’. Even trace materials are regulated under 8 CCR 1529, which maintains universal requirements to protect construction workers and general industry employees from unnecessary exposure to asbestos.
Prior to the asbestos sampling, a visual assessment of the suspect building materials that may be impacted by the construction activities was completed. During the visual assessment, the building materials suspected of containing asbestos were categorized by homogeneous areas. Materials are classified as homogenous when they appear uniform, have a consistent texture and appear to have been installed at the same time.
The laboratory testing for the bulk samples was conducted in accordance with the recommended EPA Interim Method for Determination of Asbestos in Bulk Samples (EPA-600/R-93/116, July 1993). All bulk samples were submitted to AmerSci Los Angeles, a NVLAP accredited laboratory. Samples were analyzed on a standard laboratory turnaround, unless otherwise noted in the chain of custody in Appendix ‘B’. A total of fifty bulk samples were collected from the areas in the scope of work for the project. At the laboratory, the samples were separated into sixty-seven individual materials for analysis. Following the review of the initial PLM analysis, three materials were subjected to more precise point count analysis to allow for better characterization of the asbestos content in the materials.
The following page provides a summary of each material identified containing asbestos at the site. Laboratory reports are provided in Appendix ‘B’.

Lead-Containing Paints
Lead-Based Paint (LBP), as defined by EPA, is of concern both as a source of direct exposure through ingestion of paint chips, and as a contributor to lead interior dust and exterior soil. Lead was widely used as a major ingredient in most interior and exterior oil-based paints prior to 1950. Lead compounds continued to be used as corrosion inhibitors, pigments and drying agents from the early 1950's. In 1972, the Consumer Products Safety Commission limited lead content in new paint to 0.5% (5000 ppm) and, in 1978, to 0.06% (600 ppm). Today, for purposes of lead paint inspection, EPA defines LBP as paint containing greater than 0.5% (5000 ppm) lead by weight or greater than 1.0 mg/cm2 by surface area.
Along with lead being added to paint, prior to 1978 United States manufacturers of ceramic tile used compounds of lead in the glaze on tile and porcelain. These lead compounds enhanced the glass-like properties of the glaze and offered the manufacturers a wider range of pigment colors. The process of firing the glaze at high temperatures fused the lead compounds into the glaze; and in normal use these lead compounds remained locked in the glaze and presented no health risk to people. However, crushing, abrading or shattering of a glaze can release a fine dust in which the lead becomes bioavailable. This dust poses hazards to the worker and can result in unnecessary lead contamination of interior spaces and soil. Often times the lead content of glazings far exceeds that of paints, posing both exposure and disposal issues for demolition projects.
For employee protection, OSHA does not define a lower ‘safe’ lead level. In an occupational setting, the activity being conducted and the duration of that activity can result in a significant lead exposure even for paints containing low levels of lead. The term ‘Lead Containing Paint (LCP)’ refers to paints containing any level of paint above the analytical limits of detection. The presence of LCP requires contractor compliance with Title 8, California Code of Regulations, Chapter 4, Subchapter 4, Article 4, Section 1532.1(p). The Cal-OSHA Lead in Construction Standard details specific actions the contractor must take to determine the exposure to his employees. Based on the exposure assessment or historical data, various engineering and personal protective measures must be implemented.
Lead sampling on this project was conducted by X-ray Fluorescence (XRF), which has the ability to instantly analyze all layers of paints to the substrate.
The results of the XRF analysis determined the following:
✴ Interior and exterior, EPA defined Lead-Based Paint (>1.0 mg/cm2 by XRF) is present in coatings associated with the operable windows anticipated to be impacted by the scope of the demolition.
✴ For the contractor’s employee Cal-OSHA compliance, all paints had a quantifiable lead content and are subject the requirements of the Cal-OSHA Lead in Construction Standard (Title 8 CCR Section 1532.1), when conducting trigger tasks which could result in occupational exposure to lead. Such high risk trigger tasks include abrasive blasting, flame torch usage, and mechanical grinding.

When conducting renovation or demolition, A State of California C-22 Licensed Asbestos Abatement Contractor who is Division of Occupational Safety & Health (DOSH) registered, must be retained when disturbing materials containing greater than 0.1% asbestos (Asbestos Containing Construction Material). All work must be conducted in strict accordance with Cal-OSHA’s asbestos standard, 8 CCR 1529 and the requirements of the Bay Area Air Quality Management District (BAAQMD) Rule 11. Waste must be disposed of in the correct landfill for the classification of asbestos being removed.
A notification for the demolition of the structure must be submitted to the Bay Area Air Quality Management District (BAAQMD) at least ten working days prior to beginning asbestos and demolition related work. If the identified asbestos containing flooring mastic will be removed by a mechanical method, the notification should reflect the removal of Regulated Asbestos Containing Material (RACM). A ‘J’ number must be issued for the project, prior to proceeding with asbestos removal or demolition. A copy of this survey must be submitted with the demolition notification and should remain onsite during the course of asbestos and demolition related work.
Following the completion of asbestos removal, a final clearance inspection should be conducted prior to demolition occurring. The environmental contractor must schedule the final inspection prior to removal of the negative pressure enclosure.
All parties working on this project should be aware that concealed spaces may harbor additional suspect material. Asbestos cement pipes may be concealed within wall cavities and found in underground utility pipes. Destructive investigation for concealed floorings under the ceramic flooring could not be conducted at the time of the assessment. There was also limited access to the attic and plenum areas. Should any additional suspect materials be identified during the course of the demolition work, stop work and contact us to assess and sample if necessary.
Lead
Testing by X-ray Fluorescence (XRF) has determined EPA defined Lead-Based Paint (LBP) is present on interior and exterior metal window sashes associated with the structure in the scope of the demolition. Any disturbance to components coated with LBP should be done so using lead-safe work practices, including the usage of HEPA vacuums. Any loose and flaky coatings should be stabilized prior to demolition.
For compliance with the requirements of the Cal-OSHA Lead in Construction Standard (CCR Title 8, Section 1532.1), all paints associated with the building contain a detectable lead content. Employers who task employees with activities that could result in an occupational exposure to lead must follow the requirements of the Cal-OSHA standard to ensure their employees are protected. Contractors involved in the demolition of this facility, should collect exposure data on their employees or have historical data from similar tasks and projects. It is the responsibility of the environmental and demolition contractors to comply with all EPA and DTSC waste disposal regulations when conducting lead related work and demolition activities. All wastes must be disposed of in the proper facility and manifests must be provided to the owner.
Note: The church, choir room and chapel were not part of this assessment. Should future renovation or demolition occur in these areas, they must be assessed prior to disturbing any building materials.
