As you know our solar projects unfortunately did not receive Council support last Wednesday. However, as proposed byKeith Lowry in the meeting, and subsequently discussed with him over the phone, we have put together a proposal
whereby we would offer an annual fee of S¿OO per project to Mulmur Township if we receive Council support and are
awarded a contract. I am attaching here the letter for your review and to circulate to council members as you see fit. I
believe Keith had mentioned this could be included on the Agenda at the next September L6th meeting as an actionitem.

BACKGROUND & DISCUSSION
The Township follows various policies and procedures as approved by Council. Thesepolicies should be reviewed from time to time and thus we have conducted a cyclical review, inconjunction with an outside consultant, of our entire Human Resources Policy and ProceduresManual. We have updated, streamlined, organized and added several policies to bring themanual up-to-date. We have ensured that these policies are in line with the currentEmployment Standards Act. Reorganization of the policies has eliminated duplications and
contradictions and has made it easier to locate pertinent information in a timely manner.
These policies will be presented to Council over the next three Council meetings. During thefirst meeting the Terms and Conditions of Employment and the Workplace Conduct Policies
will be reviewed. Compensation Management will be presented at the second Council meeting
and Leaves of Absence will be presented at the third Council meeting.
Overview of Changes:. Added the Alcohol and Other Drugs Policy which was already in place but not included
in the manual. Hiring Policy was consolidated to include the previous Employee File of Reference
Policy and the Employment of Related Persons Policyo Hiring Policy - now includes an outside consultant as part of the hiring committee for
the CAO/Clerk position. Previous policies did not stipulate action for CAO/Clerk position so this was added to
the Termination Policy and the Problem and Conflict Resolution Policy

POLICY STATEMENT AND RATIONALE:
The Township shall establish a fair, effective and transparent process to attract, retain and develop thebest qualified employees to meet the staffing requirements of the Township. Candidates will be selectedon the basis of the requirements of the job according to the job description with attention to the applicant'seducational, technical qualifications, experience and general aptitude for the position.
SCOPE:
All employees in the Township of Mulmur.
POLICY, PROCEDURE AND IMPLEMENTATION
1, EMPLOYMENT CRITERIA
All employees must be over the age of 16 at the start of their employment. All employees must fileproof of age and their social insurance number when they have been accepted for employment.
2. GENERAL HIRING PROCESS
a) Part-time, Contract and Seasonal Positions: The Department Head, CAO/Clerk and/ordesignate are authorized to interview and hire the employee. Applicants are required to sign acontract outlining the conditions of their employment with the Township of Mulmur.
b) Full-time Positions: The Department Head shall short-list the applicants who will be interviewedby the Department Head, CAO/Clerk and/or designate. The Department Head shall check thereferences prior to an offer of employment being extended. The CAO/Clerk shall notify Councilonce the hiring is completed.
c) Department Head Positions: The CAO/Clerk shall short-list the applicants who will beinterviewed by the CAO/Clerk, a designate and the Mayor or designate. The CAO/Clerk shallcheck the references prior to an offer of employment being extended. The CAO/Clerk willrecommend the preferred candidate to Council for approval.

d) GAO/Clerk Position: Council shall appoint a hiring committee consisting of three members ofCouncil and outside consultant. The Committee and the consultant shall review the applicationsand choose no less than two (2) candidates to be interviewed. The Committee and outsideconsultant shall perform an initial interview. A secondary interview will be conducted by Councilin conjunction with the outside consultant. The final selection will be approved by Council.
3. PROBATIONARY PERIOD
a) Newly hired and appointed employees are subject to a probationary or evaluation period - seeProbation and Evaluation Policy.
4. ADVERTISING PROCESS
All positions will be posted internally concurrent with any external advertising deemed appropriate bythe Department Head and/or CAO/Clerk.
5. HIRING RELATIVES
a) A Related Person, for the purpose of this policy, is defined as a person's spouse throughmarriage or common law, any parent, child or sibling and includes the corresponding steprelationships.
b) A Related Person cannot work in a position in which an Employee directly supervises and/or is
able to influence the working relationship of the Related Person or would otherwise create aperceived conflict of interest. Examples of influence include, but are not limited to the following:
a. Participating in a panel interviewb. Participating in the areas of:
. Compensation and benefits
. Designation of duties
. Hiring or Promotions
. Handling complaint processesr Discipline and terminations. Approving expenses or overtime. Having access to confidential information pertaining to the Related Person
c) This policy prohibits the hiring of a related person of any Council member while in office.
d) Potential conflicts of interest are to be reported to the CAO/Clerk for determination, prior to ahiring decision being made, whose decision will be final and binding.
e) Conformity with this policy requires that relationships be disclosed prior to acceptance ofemployment with the Townshíp and subsequent relationships are to be reported to iheCAO/Clerk. No employee will suffer termination through the terms of this article if a familialrelation develops during the tenure of employment. Should any violation of this policy occur, theDepartment Head and CAO/Clerk, in consultation with the employees directly affected will reviewthe circumstances of the reporting relationship and attempt to rectify the situation. Any resultantaction will not violate either affected employee's rights as established in applicable Ontario law.
6. CRIMINAL RECORD CHECKS
Where deemed appropriate by the CAO/Clerk, the provision of a criminal record check is requiredprior to the final offer of employment being given to a prospective employee.

7. DRIVERS ABSTRACT
Candidates who may be using a Township vehicle as part of their specified duties are to provide a
clean Driver's Abstract prior to final offers of employment being extended. The candidate will pay
associated costs. Employees are to report any changes to their Driver's Abstract to their DepartmentHead and/or the CAO/Clerk. After hire, the Township may obtain a Driver's Abstract at any time. Theloss of a driver's license, failure to disclose changes or provide an abstract, and multiple or seriousinfractions may result in disciplinary action or termination.
8. OFFEROF EMPLOYMENT
Following the interview process, offers of employment will first be made verbally and will be
contingent upon delivery of the above noted criteria. A final offer of employment will then be made inwriting and shall include a copy of this policy for reference. New employees are required to sign backan employment agreement when accepting a position with the Township of Mulmur.
9. RECORDS RETENTION
The Township will maintain accurate and comprehensive employee files.
A separate employee file is maintained for all employees and is referred to as the 'Employee File ofReference'. The files of reference and the information contained therein are strictly confidential and
stored under lock and key with restricted access to any and all digital files. Access to an employee'sfile of reference is limited to the employee (under supervision), the CAO/Clerk, HR and others as maybe required by law.
Files of reference will contain all matters pertaining to the employee's employment and may includebut are not limited to:

2. DURATION
Probation Period: Newly hired full-time employees must serve a probationary period of a minimum of six
(6) months. Probation periods are determined and communicated, in writing, by the CAO/Clerk or theDepartment Head at the time of hiring.
Periods of leave do not count towards completion of probationary periods. lnitial probation periods may
be extended with written approval of the CAO/Clerk.
Evaluation Period: An evaluation period of three (3) months to six (6) months, as determined by the
CAO/Clerk or Department Head, will be applied following the transfer, promotion or appointment of an
existing employee to a new position. lnitial evaluation periods may be extended by either party with the
written approval of the CAO/Clerk.
3. CRITERIA
The following criteria will govern during the probationary and evaluation periods

b. Progress in meeting established goals
c. Peer to peer feedback
A minimum of one (1) performance appraisal meeting shall be conducted during the probation and
evaluation period. Prior to the end of the probation and evaluation periods, a written evaluation will alsobe completed by the appropriate designate with the employee based on the job description, skills,performance goals and objectives. ln the case of the CAO/Clerk, the Hiring Committee will conduct the
review. The purpose of the review is to determine whether the probationary period will be ended,
extended, or the employee's services terminated. This evaluation will be retained in the employee file ofreference.
4. CONDITIONS
For newly hired employees, the Township may terminate employment without cause, notice orpay in lieu of notice during the first three (3) months. ln the remaining months of the probationaryperiod the Township may terminate employment, with or without cause, in accordance with thenotice provided for under the Emptoyment Standards Act, 2000. No further notice or pay in lieu ofnotice will be paid to the employee.
All recommendations for termination must be reviewed and approved by the CAO/Clerk; and in
the case of the termination of the CAO/Clerk the determination shall be made by Council.
Where improvement is required for employees who have been transferred, promoted or
appointed to a new position, the employee's direct supervisor, with participation by the employee,will develop a performance improvement plan, and schedule the implementation of that plan. Theplan will include details on both benchmarks and milestones, as well as the supports that will be

2. NOTICE OF RESIGNATION
All employees are required to give written notice of their intention to resign. The Township of Mulmur
requires a minimum notice of two (2) weeks so that the organization has reasonable time to determine
resourcing requirements and/or recruit a suitable replacement. The written notice should indicate the
effective date of the resignation and should be provided directly to the employee's Supervisor.
The Township of Mulmur reserves the right to relieve the emptoyee of the requirement to attend work forthe duration of the two (2) week notice period. Relieving an employee of duties during this period does
not constitute termination on behalf of the Township of Mulmur.

3. TERMINATION
The Township of Mulmur reseryes the right to terminate an employee's employment in accordance withits obligations under the Employment Standards Act, 2000 and common law jurisprudence.
An employee may be terminated without notice or pay in lieu of notice as a result of just cause. "JustCause" includes but is not limited to misconduct, poor work performance, theft, fraud, unauthorizedabsence without good reason, assault, gross insubordination, harassment, and breach ofconfidentiality/non-disclosu re.
4. CONTRACT TERMS AND CONDITIONS
At the expiration of a contract period, as outlined in the terms and conditions of a time-specificemployment contract, an employee is considered to be terminated. A contract period may be extended bymutual agreement. Such extensions shall be in writing and executed by both the Township of Mulmurand the contract employee.
5. TERMINATION PROCESS
a. Consultation: The Department Head will consult with the CAO/Clerk throughout the terminationprocess. Council will be responsible for the termination process of the CAO/Clerk.
b. Record-Keeping: Employee files of reference and all records regarding terminated employeeswill be retained by the Treasurer, or designate, according to applicable legislative requirements.
c. Notification: The CAO/Clerk shall notify Council of all terminations of employment.
d. Documentation/Processing: All documentation and processing of an employee's terminationwill be completed by the Department Head or CAO/Clerk.
e. Gonsultation: Upon resignation andlor termination, Department Heads will maintain ongoingconsultation with the CAO/Clerk.
f. Access and Property/Equipment: The Department Head or CAO/Clerk is responsible forensuring that:
Physical access to the Township of Mulmur's premises (other than public areas) is
terminated.Electronic access to the Township of Mulmur's lnformation Technology systems is
terminated.All of the Township of Mulmur's property is retrieved.
g Current and Historical Work Files: The Department Head or CAO/Clerk is responsible toensure that all work-related files are retrieved and fully secured.
h. Debt Obligation: The Department Head or CAO/Clerk is responsible for consulting with alldepartments to determine the amount of any outstanding debt obligations, i.e. vacation usedbefore earned. The Department Head or CAO/Clerk will inform the employee of their debtobligation(s) to the Township of Mulmur, if such debt exists. All debt will be collected accordingly.

The work at the Township of Mulmur is varied with numerous services being provided on an extendedbasis and, as such, requires flexibility in the work week to meet deadlines and public expectations. Thefollowing is the procedure related to hours of work, lunch periods and breaks.
SGOPE:

1. ADMINISTRATION
a) Hourly Employees shall work 37.5 hours in a Mon - Fri work week. ln each working day hourlyemployees are entitled to two paid 15-minute rest periods and an unpaid half-hour eating period.
b) Salary Employees shall work 35 hours in a week. ln each working day salaried employees shallbe entitled to receive two paid 1S-minute rest periods and an unpaid one-hour eating period.
c) lt is mandatory practice that lunch periods are to be coordinated by support staff to ensure frontcounter and telephone coverage. The Supervisor will assist where required.
d) Snacks are permitted to be eaten at one's workstation; however, meals (breakfast or lunch) mustbe taken in the lunchroom.
e) Administration office hours are Monday to Friday 8:30 am - 4:30 pm
2. PUBLIC WORKS
a) Hourly Employees shall work 40 hours in a Mon - Fri work week. ln each working day PublicWorks hourly employees are entitled to two paid 15-minute rest periods and an unpaid half-houreating period. Fifteen minute breaks in the morning and the afternoon are based on shiftschedule and allowable time frames. Breaks and lunches cannot be combined.

b) Salary Employees shall work 40 hours in a week. ln each working day Public Works salariedemployees are entitled to two paid lS-minue rest periods and an unpaid one-hour eating period.
3. ALL EMPLOYEES
a) All employees are expected to report to work in advance of start time in order be ready to work atthe scheduled time.
b) Scheduled hours of work may include evening and weekend work, at the discretion of theemployee's Supervisor and/or CAO/Clerk.
c) Actual schedules shall be approved on an individual basis by the employee's Supervisor and aresubject to change. Schedules for part-time, contract and seasonal employees shall be determinedby the employee's immediate Supervisor.
d) Lunch periods and breaks are not to be forfeited to shorten the work day or to accumulateovertime. Time made up either before or after regular hours for time taken for personal reasons ispermitted with prior notification and approval of the Supervisor.

Employees who are under the influence of alcohol or other drugswhile at work are not able to meet this commitment, and may threaten the safety of residents, the public,
fellow employees and others.
SCOPE:
All employees in the Township of Mulmur.
POLICY, PROCEDURE AND IMPLEMENTATION:
1. ln relation to the foregoing, the following definitions apply
Alcohol: Any beverage which contains ethyl alcohol, including beer, wine, liqueurs, and spirits. Very lowalcohol products (e.9. beer with 0.5% alcohol by volume) are included in this definition.
lllicit Drugs: Drugs which cannot be legally possessed under Canadian law, including a wide range of'street' drugs (e.9. marijuana, cocaine, heroin) and prescription drugs obtained without a physician'sprescription.
lmpairment: Physical dysfunction resulting from alcohol or other drug use such that an employee isunable to perform duties to acceptable standards of safety, efficiency or propriety.
Prescription Drugs: Drugs which have been legally obtained with a physician's prescription.
Under the lnfluence: Once consumed, alcohol and drugs ultimately enters the bloodstream where theyimpair normal brain function. ln this context, the term "under the influence" refers to the presence of anyalcohol or drugs in the bloodstream. lt suggests that employees will allow adequate time for the body toremove all alcohol and other drugs from the bloodstream before coming to work or otherwise assumingjob responsibilities.

EXPECTATIONS REGARDING THE USE OF ALCOHOL AND OTHER DRUGS:
As a condition of employment, employees of the Township of Mulmur, students, volunteers and othersworking on Township property or in Township vehicles, are expected to comply with the following:
1. Not to be in possession of, use or be under the influence of illicit drugs while at work on Townshipproperty or in Township vehicles, or otherwise carrying out Township duties and performing jobresponsibilities.
2. Not to be at work on Township property or in Township vehicles, or otherwise performing jobresponsibilities, while under the influence of alcohol.
Employees are expected to exercise reasonable judgment regarding the amount of alcohol consumed atsocial functions sponsored by the Township. Employees who are unable to drive home safely from suchevents are expected to make alternate arrangements.
VIOLATIONS OF EXPECTATIONS
1 . lt is the responsibility of all staff to identify employees for whom they have reasonable grounds tosuspect a violation of this policy. Where the violation involves impairment, staff will ensure thatthe employee in question engages in no safety sensitive activities.
2. Upon confirmation that the employee in question is likely to be under the influence of alcohol orother drugs as specified in this policy, or otherwise in violation of the policy, the managementrepresentative will excuse the employee for the remainder of the shift with or without pay
depending on the supervisor's assessment of the circumstances and working situation. Thatdecision will be recorded, with reasons, in the report filed for the each and every incident.
3. lf the employee is too impaired to drive home safely alternative transportatlon arrangements willbe made.
4. Violation of this policy will result in a meeting with the appropriate Supervisor. The offendingemployee will be informed, in writing, of the violation and the appropriate penalty. The offendingemployee will be reminded that various forms of assistance can be accessed, includingprovisions for short-term disability, flexible scheduling and the Employee Assistance Program.
5. Should a second violation occur, the offending employee will be sent home for the remainder ofthe shift without pay, and suspended without pay for five working days. The Department Headand the CAO/Clerk will convene a meeting with the employee and serve the employee with aletter of reprimand. The letter will outline the penalty for a third violation of the policy, andencourages the employee to seek assistance for problems related to the policy violation. Theoffending employee will acknowledge in writing the letter of reprimand.
6. Should a third violation occur, the offending employee will be sent home without pay and will berequired to meet with the CAO/Clerk, at which point the employment relationship with theTownship of Mulmur will be terminated.
7. Encouragement to seek assistance is intended to offer a resource that can be used to helpmanage alcohol or other drug consumption. No employee will be compelled to make use ofassistance, nor will employee efforts to resolve problems be monitored. All efforts undertaken toresolve problems are voluntary and strictly confidential.
B. lt is the responsibility of management representatives to document clearly all steps taken in theapplication of the policy.

Other positions are required to provide their own vehicle and mileage will be paid at a rate as setby the Township.

1. TOWNSHIP VEHICLES AND MOTORIZED EQUIPMENT:
a. Vehicles are provided to the Director of Public Works and Public Works Supervisor forbusiness purposes. The employee shall maintain a travel log that documents patrol whiletraveling to/from work to residence.
b. Township vehicles and motorized equipment are to be used exclusively for the Township'spurposes and may not be used for personal purposes or to transport persons other thanTownship employees and/or business related individuals.
c. Smoking is not permitted in any Township vehicle or motorized equipment, and is to takeplace in designated areas outside buildings, vehicles and other work environments.
d. Vehicles and motorized equipment that are taken home by an employee shall be returned to(or remain at) the appropriate Township location when the employee is away from work dueto vacation, illness or any other reason, as directed.
e. Employees are expected to take all steps necessary to avoid endangering themselves and
others while operating a vehicle or motorized equipment on Township business, such as:
. Conducting a circle check of the vehicle daily, before use;
. Complying with all laws governing motor vehicle operations;

Employees at the Township of Mulmur are highly visible to the public and an employee's choice ofapparel influences the public's image of the Township. The Township shall provide employees with
clothing and safety equipment necessary to perform their job while in compliance with requirements of theOccupationat Health and Safety Act.lt is noted that while influential, the fashion industry, clothing trends,
and fads do not define the workplace nor the appropriateness, or acceptability of the attire worn by
employees. Professional attire and appropriate safety attire are required at all times while performing job
duties.

POLICY. PROCEDURE AND IMPLEMENTATION:
PUBLIC WORKS EMPLOYEES
1. The Township will supply a uniform which includes: coats, pants, shirts, hard hats and safetygear/clothing as required for safe work practices and recognizing the nature of the work performed.
Township of Mulmur hats are the only ones permitted to be worn. Any clothing and safety equipmentsupplied by the Township shall not be altered. Exception to standard supplied uniform will be made at
the Department Head's discretion.
2. Full Time Public Works employees will be entitled to an allowance of $150 a year to be used forsafety footwear.
a. Clothing will be replaced, as needed and with the purchase approved by the Director ofPublic Works, at the cost of the Township. The clothing remains the property of the
Township and the employee must return it when the employment relationship ends. The
Director of Public Works shall set a schedule for the annual replacement of clothing.
b. All Public Works employees shall wear safety equipment, including but not limited to safety
footwear, hardhats, vests and safety glasses.
c. ContracVseasonal employees shall provide their own safety footwear

1. Administrative employees are expected to dress in a business casual manner that projects aprofessional and positive image while performing their duties.

3. Exception will be made for "Dress Down Friday" where acceptable attire will include jeans withoutrips/tears, cargo-type or similar pants, capris, and athletic shoes.

2. The Supervisor, Department Head or CAO/Clerk will document the discussion and will makeevery attempt to resolve the situation. One copy of the discussion will be kept for Townshiprecords and one copy given to the employee.
3. Should the resolution not be satisfactory to the employee, the employee may elect to advance theissue in the following manner:
a. The employee may request, a meeting with the Department Head or CAO/Clerk. Themeeting and resolution will be documented and one copy will be kept for Townshiprecords and one copy will be given to the employee,
b. Should the response not be satisfactory to the employee, the employee may elect toadvance the issue to the CAO/Clerk, if not already done. The CAO/Clerk will provide theresponse to the employee, in writing, and all documentation will be retained on file.

PROGRESSIVE DISCIPLINE
The goal of Progressive Discipline is to ensure that employees achieve success in work performance.
The Íownship of Mulmur recognizes that from time to time, employee performance may be less than
satisfactory and a process of progressive discipline is introduced to give effect to a course of action toimprove an employee's level of performance.
1. COUNSELING AND COACHING
Frank and timely dialogue shall take place between Supervisors and/or Department Heads and
employees with regard to job-related problems. Dialogue is aimed at ensuring that all parties
involved understand the problem and that any ambiguity is eliminated.
a. Upon reaching an understanding of the existing problem, the Supervisor and/or
Department Head and the employee agree to a written plan of remedial action to correct
the problem. Further, this plan shall include performance expectations and a specified
deadline for improvement.

b. The Supervisor and/or Department Head is responsible for fully documenting this meetingand the plan of remedial action. Documentation shall be provided to the employee and acopy is placed in the employee's file of reference.
ln the event that culpable behavior has not improved, further discussion and planningmay be required and the process above is repeated. Written documentation shall beprovided to the employee outlining the problem, the solution and/or course of action andspecific dates for resolution. A copy of this documentation shall be placed in theemployee's file of reference.
d. This memo, unless otherwise stated, is not a written warning for disciplinary purposes
Alternatively, managerial intervention in the form of training, job reassignment, discipline,etc. may be initiated.
2. DISCIPLINE
A process for discipline may be introduced to further reinforce the need for improvement or todeal with an immediate infraction of a more serious nature. Timeliness of disciplinary action is ofcritical importance in order to correcVimprove employee performance.
a. ln the event that an employee's actions warrant discipline, the Department Head shallclosely consider the circumstances and the gravity of the offence prior to taking writtendisciplinary action or suspension.
b. All warnings, both verbal and written, and related incidents with respect to employeediscipline/job related problems shall be documented. Documentation is placed in theemployee's file of reference and a copy is provided to the employee.
c. Disciplinary action, dependent on circumstance and gravity, may commence with any ofthe following, depending on the severity of the offence and the employment record:

A BY-LA\ry TO CONFIRM THE PROCEEDINGSOF THE COUNCIL OF TIIE CORPORATION OF THETOWNSHIP OF MULMUR FOR SEPTEMBER 16,2015
WHEREAS Section 5(l) of The Munícipal Act,2007, as amended, provides that the powers of amunicipality shall be exercised by its Council:
AND WHEREAS Section 5(3) of The Municipal Act, 200I, as amended, provides that
municipal powers shall be exercised by by-law;
NOW THEREFORE BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THECORPORATION OF THE TO\ryNSHIP OF MULMUR ENACTS AS FOLLOWS:
All actions of the Council & Committees of Council, of the Corporation of the
Township of Mulmur for September 16, 2015 in respect to every report, motion, by-law, or other action passed and taken by the Council or Committees of Council,including the exercise of natural person powers, are hereby adopted, ratified and
confirmed as if each report, motion, resolution or other action was adopted, ratifiedand confirmed by its separate by-law.
2. The Mayor of the Township and the proper offrcers of the Corporation of the
Township of Mulmur are hereby authorized and directed to do all things necessary to
give effect to the said action, to obtain approvals where required and except where
otherwise provided, to execute all documents necessary in that behalf.
READ a first, second and a third time and finally passed this 16th day of September, 201 5
