    We propose to select indigenous SPV manufacturers or their authorised

    representatives for installation, commissioning, testing and maintenance of SPV DLS systems

    in remote villages in Rajasthan.

    1. Name of Work:-

    Installation/Commissioning/Maintenance of DLS in remote villages situated in the

    State of Rajasthan.

    2. Earnest Money Deposit :-

    Earnest Money Deposit will be furnished as mentioned in the TENDER documentalongwith the proposal, in the form of a Bank Draft in favour of the Chairman &Managing Director, Rajasthan Renewable Energy Corporation Ltd., payable at Jaipur.

    3. Proposal :-The proposal is to be submitted by 24

    thSept., 2010 upto 14.00 hrs.

    SECTION 1

    INTRODUCTION & ABREVIATIONS

    1. Background

    With the help of Central Financial Assistance from MNRE under their RemoteVillage Electrification (RVE) programme of 2010-2011 and grant from theState Govt., RREC wishes to select competent, experienced and financiallysound manufacturers / suppliers to install, commission and maintain SolarPhotovoltaic Domestic Lighting Systems (DLS) to the beneficiaries ofunelectrified hamlets (having population more than 300/households more than60) in Rajasthan.

    Above work is to be carried out on Turn Key Basis which includes collectionof beneficiaries share of cost after adjusting MNRE/GOR financial assistance,supply of SPV systems with all accessories and equipments, installation,testing, commissioning and maintenance thereof for five years. Expected

    number of systems to be installed is about 18,000 Domestic LightingSystems. The names of remote hamlets and list of beneficiaries will beprovided to successful bidder.

    2. Mode of Execution of RVE Scheme

    The price for proposal evaluation shall be the cost/rate quoted in the PriceSchedule Annexure-3A. To further clarify, installation and commissioning costshall be added to the cost of supply for comparison and evaluation. Proposersare required to quote rate / cost on FIRM basis and no price variation on anyaccount shall be considered.

    The selected manufacturers / authorised suppliers shall supply, install andcommission systems to identified beneficiaries and provide maintenanceservices for 5 years free of charge. They shall also be required to set up theirrepair and maintenance centres for providing effective repair/maintenanceservices to the beneficiaries / users and meet conditions given in Section 2.

    The Programme shall be carried out as per guidelines at Section-2 and asgiven hereunder:-

    (i) The manufacturer shall be allowed to install the systems conformingthe MNRE specifications / guidelines after authorisation by RREC.

    (ii) For this RREC shall give specific targets / limits to each selectedmanufacturer and fix prices for sale of systems to the user.

    (iii) The manufacturers may claim subsidy from RREC by submittingcomplete list of buyers alongwith full addresses, date of sales, modelsand makes and serial numbers of systems & PV modules supplied andduly verified by RRECs field Project Officer or authorisedrepresentative from Head Office.

    SECTION 2

    SCOPE OF WORK

    Scope of work covers supply, installation, testing & commissioning &maintenance of DLS to the identified beneficiaries in the unelectrified hamlets(having population more than 300/households more than 60) in the Stateconforming to technical specification enumerated in relevant Annexures.Detailed scope of work is given here under :-

    2.1 Work of installation of DLS shall involve :

    (a) Survey the identified hamlet.(b) Initiate hamlet electrification only if at least 25% of the identified

    beneficiaries deposit their share.(c) Establishing After Sales Service Centres in concerned tehsils

    to cater the maintenance needs of beneficiaries.(d) Survey the total requirement of hamlet allotted to the supplier

    and despatch only that quantity for which beneficiaries arecoming forward with their contribution.(e) If at the end of completion period, any quantity is left unaccepted

    by the beneficiary, that quantity will automatically stand reducedfrom the ordered quantity.

    (f) Completion of work of supply, installation, commissioning andtesting as per schedule given at the time of allotting targets.

    (g) Regular maintenance of installed DLS as per tender document.

    RREC reserves the right to allot any areas / districts / hamlets to amanufacturer/authorised representative of the SPV systems.

    2.2 Eligible Beneficiary for SPV Home Lighting Systems:

    The names of remote hamlets already identified and the list of eligiblebeneficiaries already identified will be provided to the successful bidderalongwith the work order.

    SECTION 3

    EXPERIENCE AND COMPETENCE

    Manufacturers of SPV modules/authorised suppliers or such firms who haveentered into a Memorandum of Understanding (MOU) for supply of solarmodules with established firms engaged in manufacturing of Solar Modulesshall be eligible to compete in this tender. To substantiate this, necessarydocuments, certificates with manufacturing firms shall have to be attachedwith the proposal.

    Proposers shall also have to attach details of experience gained in the field ofinstallation and maintenance of Solar Photovoltaic Domestic Lighting Systems(DLS) in rural areas amounting to at least Rs. 50 lakhs in any of the last threefinancial years. It may be noted that such firms which have not carried outworks related to installation of DLS in villages costing more than the sum asnoted above shall not be considered a responsive offer. Schedule in which

    experience details are to be furnished by the firms shall be as per Annexure-2supported by certificates from the concerned SNA. Copies of the work ordersissued by different offices must also be enclosed in proof of experience.

    Under this programme, the villages and beneficiaries (left out) are alreadyidentified. However, the villagers may not be in a position to make payment ofhis full share in one go. The supplier may have to visit 2-3 times before he canrealise full beneficiary share. Afterwards the supplier has to submit his claimfor subsidy amount duly verified by the concerned Project Officer of RREC tothe RREC HQ. The subsidy amount is released on satisfaction of the RREC.Thus a prospective supplier shall have to have adequate infrastructure toscout for willing beneficiaries, install the system and provide him satisfactory

    after-sales-service. The bidder must satisfy himself about the grand realitiesof the project so as to avoid any problems later on.

    As per MNRE guidelines the systems are to be operational for at least 5 yearsafter installation. First two years are guarantee period during whichmaintenance services are to be provided free of cost. As such establishing anafter-sales-service network is a must. RREC thus would require the supplierto first organise infrastructure for after-sales-service in the district and thenstart the work of installation of systems. The payment of subsidy amount forDLS supplied and installed shall be made by RREC only upon establishmentof after-sales-service centres to the satisfaction of RREC, which would be atleast at Tehsil HQ level.

    SECTION 4

    FINANCIAL CAPABILITY

    Proposers shall have to attach firms Balance Sheet for the last two years,

    and valid latest Sales Tax clearance certificate from appropriate authorities

    and a brief write-up in support of their financial capability to take up the

    proposed works envisaged in this RFP document. If no write up is submitted,

    it will be assumed that proposer does not have required capacity.

    SECTION 5

    PRICE SCHEDULE

    Proposers shall quote their lowest rates / costs in the format given atAnnexure-3 and in the following manner :-

    (A) Rates/Costs for supply of material i.e. SPV systems as per priceschedule.

    (B) Rates for installation, testing and commissioning of SPV systems.

    (C) The proposals shall be submitted strictly as in Annexure 3.

    (D) Rates shall be quoted both in words as well as in figures.

    (E) The rate of Central Sales Tax / State Sales Tax / VAT should be clearlymentioned and whether inclusive / exclusive.

    (F) The rate of Service Tax should be clearly mentioned and whetherinclusive / exclusive.

    (G) If the tenderer does not mention the tax separately, the rates quotedwill be deemed inclusive of all taxes, duties, levies etc. whatsoever.

    Annual Maintenance Contract will be for a period of five years including firsttwo years of warranty period during which maintenance, free of cost, shall beprovided.

    SECTION 6

    PRE-REQUISITES AND PROPOSAL EVALUATION

    1. Pre-requisites:Following are the pre-requisites for the proposer to be consideredresponsive to this RFP :(i) The manufacturer should be approved and empanelled with

    MNRE. For assessing this manufacturer shall furnish latest typetest reports from MNRE / BIS. Copies of relevant papers mustbe inclosed.

    (ii) The tenderer has financial capability to take up the proposedwork to be supported by CA certified balance sheet for last twoyears. The tenderer must have minimum Turn Over of Rs. 5.0crores in each of past 2 years (2008-09 & 2009-10).

    (iii) The Tenderer is a manufacturer of SPV modules or he is an

    authorised supplier of such manufacturer and he has a validMOU with the manufacturer.

    (iv) Certificate from the Nodal Agency certifying satisfactoryperformance of the tenderer in the past 5 years with them.

    (v) The tenderer has carried out similar works of at least Rs. 50 lacsin any of the last three financial years. Out of this, work of Rs. 25lacs should have been carried out in the mode as described atpara 2 of Section-1. Certificate from the SNA is required to beproduced.

    (vi) Details of After Sales Service Centre existing and proposed to

    be set up in the State of Rajasthan.(vii) The tenderer shall also state his DLS manufacturing capacity

    and capacity already booked supported by documents liketurnover of last year, work orders received and works executed(certificate from the concerned SNA would be required as asupporting document).

    (viii) Proposer shall state his marketing capabilities in reference torequirement of the RRECs Rural Electrification programme asdetailed in Section 2 & 3.

    2. Evaluation :

    The price for proposal evaluation shall be the cost/rate quoted in thePrice Schedule Annexure-3. To further clarify, cost of supply,installation & commissioning & maintenance and all applicable taxesshall be summed up for comparison and evaluation. Proposers arerequired to quote rate/cost on FIRM prices basis and no price variationon any account shall be considered.

    In evaluation of bids the purchase of stores (Preference to Industries ofRajasthan) Rules 1995 shall be applicable.

    INSTRUCTIONS TO TENDERERS

    8.1 Proposers are required to furnish all information and documents ascalled for in this Document in English Language. Any printed literaturefurnished by the proposer may be in another language, provided thatthis literature is accompanied by an English translation, in which case,for the purpose of interpretation of the document, the English versionwill govern.

    8.2 The proposal should be filled-in only with ink or typed. No proposalfilled-in by pencil or otherwise shall be considered.

    8.3 All additions, alterations and over-writings in the proposal oraccompanying documents must be clearly initialled by the signatory to

    the proposal. The amounts in Rs. Must be written in figures as well aswords without any cuttings, over writings etc..

    8.4 The proposal shall be submitted by a single bidder or the Leader of aConsortium and the documents should have been purchased in theirown name. The RFP Document is not transferable.

    8.5 All documents for stated work shall be submitted along with 2 (two)copies in the following manner (i.e. in triplicate).

    (a) The original document shall be enclosed in a separate sealedcover and marked as ORIGINAL COPY on tope of the envelope.

    PROPOSAL FOR RVE (TN-5) PROGRAMME shall besuperscribed on top left hand corner of the sealed cover. Fullname and address of proposer shall be written clearly on leftlower corner of the sealed cover. The cover containing demanddraft for EMD and cover containing price offer shall also be keptin original copy cover.

    (b) The balance two copies of document shall be put in separatesealed covers and marked as COPIES on top of sealed cover.Worlds Proposal for RVE Programme (TN-5) shall besuperscribed on the top left corner. Full name and address ofbidder shall be written clearly on top of the sealed cover.

    (c) Both the ORIGINAL and the COPIES of the Proposal shall beput inside one single packet, sealed and words Proposal forRVE Programme shall be superscribed on the top left corner.Name and full address of the proposer shall be put on the lefthand bottom corner of each packet.

    (d) The proposal shall be submitted in Three parts viz., Part AEarnest Money, Part B techno-commercial bid and Part-C pricebid. First EMD envelope shall be opened, then techno-

    commercial bid shall be opened of those bidders who satisfy theEMD condition. The price bids of only those bidders shall beopened whose bids are considered responsive. Date of openingof price bid shall be intimated in due course of time. Bank draftfor Earnest Money shall be sealed in a third envelope andclearly marked with details of EMD.

    8.6 Documents shall be sold upto & before 14.00 hrs. on 21st Sept. 2010and shall be submitted at the following address on or before 21st Sept.2010 by 14.00 hrs. RREC may at its discretion, extend the deadline forsubmission of the proposals.

    8.7 The Proposal received after the closing date and time shall not beconsidered. RREC shall retain all documents submitted by the bidder.RREC takes no responsibility for delay, loss or non-receipt ofdocuments sent by post / courier / or other means.

    8.8 (i) The proposal submitted by due date and time at the aboveaddress shall be opened on the appointed day at the sameoffice at 16.00 hrs. Representatives of proposers may attend theopening if they so choose.

    (ii) Price preference / purchase preference clause / rules as invogue/issued from time to time by the State Govt. in legal to

    evaluation of the proposals shall be applicable.

    (iii) If the tenderer quotes for a quantity whose EMD works out to avalue more than Rs. 10.00 lakhs then EMD in the form of BankGuarantee is also acceptable.

    8.9 (i) Proposals shall be accompanied with Earnest Money Deposit(EMD) 2% of the value of the offered quantity subject tominimum as given in the table below in the form of a crossedDemand Draft in favour of CMD, RREC which is payable atJaipur.

    (iii) The tenderer must quote the rates only if the supplier in capableto supply minimum of 2000 Nos. DLS or more during thisfinancial year (2010-11). The papers to establish his capacity ofabove fact must be kept in the techno-commercial bid.

    8.10 The documents shall be properly checked and signed beforesubmission to ensure that all information / documents required areincluded.

    8.11 Transfer of document purchased by one party to another is notpermissible.

    8.12 Intending proposers are required to carefully go through theinstructions included in the document and furnish complete information,necessary documents and schedules.

    8.13 Any Bidder wishing to undertake visit to site to become familiar with

    site conditions may do so. For any guidance in this respect, bidder maycontact Chairman & Managing Director, Rajasthan Renewable EnergyCorporation or his authorised representative.

    8.14 All costs towards site visit, conference and submission of documents,shall be borne by the bidders themselves.

    8.15 Bidders are informed that RREC is neither under any obligation toselect any bidder, nor to give any reason for either qualifying ordisqualifying any bidder. RREC is also not under any obligation toproceed with the programme or any part thereof.

    8.16 At any time prior to opening of price proposals, RREC either at theirown initiative or in response to clarifications requested by a prospectiveproposer, may modify RFP by issuing an amendment. Suchamendment(s) shall be sent by e-mail/fax to all RFP documentpurchasers. Such amendments will also be uploaded on our websitewhich can be referred to.

    8.17 The proposals as submitted shall invariably indicate that proposal isFIRM and that proposals shall remain valid and open for a period of notless than six months from the date of opening.

    8.18 After opening of proposals and till final selection of successful

    manufacturer(s), no correspondence of any type will be entertained,unless called for by RREC. Any type of uncalled for clarifications onprices and or rebates shall not be accepted.

    8.19 In the event of the proposer not responding to further negotiations asrequired for selection of suppliers, RREC reserves the right to forfeitthe bid security / Earnest Money Deposit amount furnished by suchproposers.

    8.20 Any deviation from any clause of this document must be properly speltout in a deviation statement to be submitted alongwith the proposal,giving details of page number and clause number and detailing thedeviation. RREC reserves the right to accept or reject any deviation ormodify the relevant clause of the document to the extent required bythe deviation. Deviation statements in the prescribed proforma(Annexure-4) must be attached with the proposal.

    8.21 RREC will review the proposals to determine whether the proposalsare substantially responsive to the requirement of this document.Proposals considered non-responsive are liable for rejection for thefollowing reasons:

    (i) Proposal is not received by the due date & time and proposal isnot accompanied with the required documents & schedules.

    (ii) Proposal is not accompanied by Earnest Money Depositindicated in clause 8.9.

    (iii) Document has not been purchased by the proposer in his ownname.

    (iv) Proposal is not a FIRM proposal.(v) Proposal is not valid for at least six (6) months.

    (vi) Experience certificate & Certificate for module making capabilityor an MOU with a reputed MNRE empanelled SPV modulemanufacturer is not attached with the offer as per Section-3.

    (vii) Prices not quoted in prescribed proforma / schedule.

    (viii) Proposal is not meeting any other pre-requisite as spelt outelsewhere in this document.

    (ix) If proposer modifies his bid or any part thereof after submissionto RREC.

    8.22 RREC shall take up detailed evaluation of the responsive proposalsonly.

    8.23 RREC reserves the right to reject any proposal in following cases:

    (i) At any time, a material misrepresentation is made or uncovered,

    or(ii) The proposer does not respond promptly and exhaustively to

    requests for supplemental information required for theevaluation of the proposal within the time allowed:

    8.24 RREC attaches great importance to maintenance of the systems as itis felt that without proper maintenance after installation of system,consumers may be deprived of the benefits of electricity. To achievethis objective, successful proposers shall proceed to first establishafter-sales service network in the district chosen for installation of

    These conditions should be read very carefully by the proposer while filling intheir quotations.

    THE SUPPLY & INSTALLATION COMMISSIONING & MAINTENANCE OFSPV SYSTEMS

    9.1 The last date of receipt of the proposal is as indicated above.Proposals received after due date and time will not be considered. Theproposals of such Firms shall only be considered who meet theconditions set for a responsive Firm and who have purchased theproposal form / specifications from RREC by depositing the prescribed

    fee of the tender documents which is non-refundable. If due to anyreason the due date is declared a Holiday, the proposals will beopened on next working day at the same time.

    9.2 The proposals should be submitted addressed to the Chairman &Managing Director, RREC, Jaipur and placed in a sealed cover. Aseparate envelope be attached for earnest money. Only on receipt ofearnest money, proposals will be opened.

    9.3 Intending proposer shall have to deposit earnest money as per clause8.9 without which tenders will not be considered. The amount shouldbe deposited in favour of Chairman & Managing Director, RREC,

    Jaipur in the form of a Bank Draft.

    9.4 (i) The Earnest Money will be refunded to the unsuccessfulproposers within one month after finalisation of the proposals orearlier whereas in case of successful proposer it will be adjustedtowards security deposit.

    (ii) The earnest money of successful tenderer will be adjustedtowards security deposit and balance amount towards securityshall be got deposited at the time of execution of agreement or

    commencement of supply whichever is earlier. Security depositcan also be in the form of Bank Guarantee.

    (iii) The amount of SD shall be 5% of the amount of subsidy payablewhich is to be deposited with in 7 days of placing of the workorder. This SD in case of successful tenderers shall be kept tillthe allotted targets are achieved. The S.D. shall be returnedafter three months from the date of successful installation of lastsystem. The SD may be deposited as the Bank Guarantee in theprescribed format which may be obtained from RREC. The BankGuarantee shall be valid up to the period of three monthsbeyond the scheduled date or actual date of completion of theorder, whichever is later.

    9.5 Without earnest money deposit as per clause NO. 8.9 & No. 9.0 (A), noproposal will be considered.

    9.6 Acceptance of the proposal(s) will rest with the Chairman & Managing

    Director, RREC, Jaipur who does not bind himself to accept the lowestoffer and may reject any proposal without assigning any reasonsthereof.

    9.7 No foreign exchange will be provided by the department.

    9.8 The rates quoted for supply of SPV systems must be FIRM and fixed,FOR site(s) as per prescribed format.

    9.9 (A) The payment of subsidy amount for supply of SPV systems shallbe released after receipt of funds under the programme fromMNRE/State Govt. as per following terms:-

    (i) 70% of subsidy amount after receipt of claim from the supplierwith following documents duly verified by RRECs concernedP.O. The subsidy will be released only after receipt of the samefrom GOI/MNRE/GOR.

    (a) Complete list of buyers (beneficiaries) with full address,phone numbers (if available).

    (b) Date of commissioning.(c) Model(d) Make(e) Serial Nos. of PV modules and systems.

    (f) Address proof of beneficiary like Ration Card, VotersIdentification Card number etc. (copy of such documentto be deposited with the concerned P.O.).

    (ii) 20% of subsidy amount after 3 months of verification by theProject Officer that the system has performed satisfactorily for 1month after installation. Supplier will submit physical verificationcertificates for all the installed DLS duly verified by PO of RREC.

    (iii) 10% of subsidy amount after 5 years from date of installation.This amount can also be released against a Performance BankGuarantee (PBG) of equal amount, valid for 5 years. If anyrecoverable amount is found during inspections by RRECofficials or POs of RREC or 3rd party authorized by RREC, afterservice notice to the supplier, such amount will be recoveredfrom the suppliers PBG.

    The requirement of PBG for release of above payments isequally applicable for PSUs of GOI/GOR also.

    (B) In case of failure of attending to complaint beyond 7 days oflodging, one month maintenance charges are liable to berecovered.

    (C) Material received at site should be stored in premises arrangedby the supplier. Supplier shall be responsible for safety ofmaterial stored which shall be adequately insured. Insurance

    charges shall be borne by the supplier.

    (D) An agreement in the format at Annexure-7 shall be entered intowith in 7 days of placing of the work order without which nopayments shall be released.

    (E) RREC reserves the right to get 5% or suitable no. of DLSrandom verification of systems by Head Office. If anydiscrepancy is found during inspection, the same is recoverablefrom the payments of the supplier.

    (F) The manufacturer / supplier may sell the systems through their

    authorised dealer / sub-dealer to the beneficiaries. Themanufacturer/ dealer / sub-dealer will ensure invoice to thebeneficiary. To claim subsidy, a copy of this invoice duly verifiedby the concerned P.O. should be submitted to RREC H.O.,Jaipur alongwith the claim letter of the manufacturer/ supplier. Itshould also be accompanied by a copy of invoice through whichthe material has been sold to their dealer / sub-dealer. A copy ofExcise Duty gate pass should also be enclosed and the serialNo. of SPV panel should invariably be mentioned on bills/invoices / E.D. Gate Pass etc.

    9.10 RREC may not authorise any tenderer for the DLS for which proposals

    have been invited or may authorise for less than the quantitycommunicated in the RFP document or may not authorise for anyquantity, the manufacturer(s) shall not be entitled to claim anycompensation. RREC reserves the right to split the tendered quantityamongst more than one bidders.

    9.11 Proposals will be valid for a period of 6 months from the date of theiropening for the purpose of communicating acceptance by thedepartment. The proposals with validity of less than 6 months will not

    be considered. The validity can be further extended with mutualconsent.

    9.12 In the event of breach of any of the conditions of the contract at anytime on the part of the manufacturer the contract may be terminatedsummarily by Chairman & Managing Director, RREC, Jaipur withoutcompensation to the contractor.

    9.13 The price of the systems including installation charges andmaintenance charges quoted shall remain fixed and firm during theperiod of contract.

    9.14 (a) Complete literature and specifications of the material offeredmust accompany the tender.

    (b) All type tests / routine tests conducted at MNRE approved. TestHouses on solar module, fixture, charge controller, battery shall befurnished.

    9.15 The systems offered shall be guaranteed by the manufacturer for useand services for a period of 24 months from the date of commissioning.Any part found defective during its operation shall have to be replacedfree of cost.

    9.16.1 (i) The time specified for delivery and completion of work in thecontract tender shall be deemed to be the essence of thecontract and the successful manufacturer(s) shall arrangesuppliers & complete work within the period on receipt of orderfrom the department. The date of commissioning of the systemsshall be considered as date of delivery.

    (ii) If bidder does not comply to his proposed schedule, RREC mayreallocate the remaining work to any/all other interested Firm, soas to achieve the targets.

    9.17 Should the successful manufacturer(s) fail to complete the work in theperiod specified in the authorisation letter / contract, the departmentmay at its discretion allow an extension in time of completion, subject torecovery from the manufacturer an agreed liquidated damages and notby way of penalty a sum equal to the following percentage of the valueof the systems which the manufacturer has failed to supply for period ofdelay as stated below:-

    (a) Delay upto one fourth period of the prescribed delivery period -2.5%.

    (b) Delay exceeding one fourth but not exceeding half of theprescribed delivery period 5%

    (c) Delay exceeding half but not exceeding three fourth of theprescribed delivery period 7.5%

    (d) Delay exceeding three fourth but not exceeding the period equalto the prescribed delivery period 10%

    1. Fraction of a day in reckoning the period of delay in supplyshall be eliminated if it is less than half a day.

    2. The maximum amount of agreed liquidated damages shallbe 10%.

    3. If the supplier requires an extension of time in completionof contractual supply on account of occurrence of anyhindrance, he shall apply in writing to the purchasingauthority for the same immediately on occurrence of thehindrance but not after the stipulated date of completion ofsupply.

    4. Delivery period may be extended with or without liquidateddamages if the delay in supply of goods is on account ofhindrances beyond the control of the tenderer.

    9.18 Any escalation on account of any statutory increase in or freshimposition of customs duty, sales tax etc. shall be payable duringstipulated delivery schedule. However, the benefit on account of

    decrease in these shall be availed by the department if accrued duringthe stipulated / extended delivery period. The supplier shall be requiredto intimate any increase / decrease in the rates to RREC.

    9.19 When a tenderer is unable to complete the work within the specified orextended period, the department shall be entitled to award the work toother agencies without notice to the tenderer but on his (i.e. tenderers)account and risk, the goods or any part there of which the tenderer hasfailed to complete or if not available, the best and nearest availablesubstitute there of, or to cancel the contract of such work and tenderershall be liable for any loss or damage which the agency may sustain byreasons of such failure on the part of the tenderer. But the tenderer

    shall not be entitled to any gain on such work got done against defaults.The recovery of such loss or damages shall be made from any sum dueto the tenderer under this or any other contract with the Agency or theB.G. available with RREC. If recovery is not possible from the bill andthe tenderer fails to pay the loss or damages within one month, therecovery shall be made under Rajasthan Public Dues Recovery Act.1952 or any other law for the time being in force.

    9.20 While making the risk purchases, the RREC may exercise its owndiscretion and if possible resort to limited tender system issuing shortterm notices irrespective of the value of tender. In all cases whereorders are cancelled due to non supply of stores, it will be treated as

    breach of contract and the department shall take action accordingly. It isclarified that the Corporation may resort to risk purchase withoutgranting any extension. Such defaulting tenderer would be debarredfrom participating in any further tenders of RREC & shall be black listed.

    9.21 The tenderers are required to study carefully the conditions of the RFPdocument, the enclosed specifications and the relevant provision of therelevant BIS/ISS specifications wherever necessary before submittingthe proposal. Technical particulars of the material offered must comply

    with the enclosed specifications and the relevant provisions of theBIS/ISS. Tenders are called for ISI marked stores, the material ISImarked only shall be supplied by the tenderer & the same standardstores shall be accepted.

    9.22 Only such manufacturers/ suppliers who have facilities of manufacturingsolar modules or such firms which have entered into an MOU withestablished firms for supply of modules lshall be eligible for participationin this invitation. All tenderers shall therefore, furnish such declarationsand attach required documents with the proposal. (This includes validMOU with MNRE approved SPV module manufacturer, manufacturingcapacity of SPV module manufacture and supply orders in hand).Attested copies of the papers must be enclosed with the tender.

    9.23 Any changes in the constitution of the firm/company shall be notifiedforth with by the supplier in writing to the Corporation and such changeshall not relieve the tenderer from any liability under the contract.

    9.24 Proposers will have to submit Sales Tax registration certificate numberand sales tax clearance certificate from the sales tax / commercial taxofficer concerned along with the proposal without which proposals willnot be considered.

    9.25 The proposer shall sign these conditions on each page at the end intoken of acceptance of all the terms and it would be attached with theproposal along with the declaration. He should also sign at the bottomof each of the pages of his tender. Annexure at 5 & 6 are also to besigned by tenderer & attached with the tender.

    9.26 Material not approved shall be rejected by the RREC and will have to

    be replaced by the tenderer at his own cost within the time limit fixed byRREC.

    9.27 The rejected material must be removed by the manufacturer within 15days of intimation of rejection.

    9.28 The authorisation for installing SPV system can be repudiated at anytime by the RREC if the systems are not supplied and installed to itssatisfaction. The reasons for repudiation shall be recorded by RREC. Incase of non-performance in any form and shape of the terms &conditions of the agreement, the CMD, RREC, Jaipur has power tocancel the authorisation pertaining to the supply and installation of

    systems.

    9.29 Direct or indirect canvassing on the part of the proposer or hisrepresentatives will be a disqualification.

    9.30 If a tenderer imposes conditions, which are in addition to/or incontravention with the conditions mentioned herein, his tender is liableto be summarily rejected & the EMD will be forfeited. In any case noneof such conditions will be deemed to have been accepted unlessspecifically mentioned in the letter of authorisation issued by RREC.

    9.31 Legal proceedings, if any, arising out of the tender contract shall haveto be lodged in courts situated in Jaipur, Rajasthan only.

    9.32 If any dispute arises out of the contract with regard to the interpretation /meaning and the breach of the terms of the contract, the matter shall bereferred to by the parties to the Chairman, Board of Directors of RREC,Jaipur whose decision shall be final and binding.

    9.33 If any question is raised or issue arises between the user (beneficiary)of the SPV DLS systems and the manufacturer/supplier and matter istaken to a consumer court, RREC shall not be responsible in anymanner and shall not be made a party in it. The beneficiaries all rightsof a consumer & supplier is bound to perform its duties as per terms &conditions of this tender & orders of RREC.

    9.34 The material shall be subjected to Pre-despatch inspection. Thesuccessful bidder will offer the material for inspection along with routine

    test certificates. Detailed instructions for inspection of material Pre-despatch & at site shall be made available to the successful bidder.

    ORAlternatively RREC, at its discretion, may collect upto 1% samples onrandom basis out of a lot supplied at site and get these tested at aMNRE recognised test house at suppliers cost, which includestransportation and inspection charges.

    9.35 In case the material being supplied is found sub standard or not as perspecifications of this bid, the supplier shall be bound to replace thewhole lot or will be penalised at the sole discretion of CMD of RREC.

    9.36 Price Preference to the Industries situated within Rajasthan shall beadmissible as per The Purchase of Stores (Preference to Industries ofRajasthan) Rules, 1995.

    9.37 All the papers to be attached with this bid must be self attested (selfsigned) by the authorized signatory or the firm.

    9.38 The tenderer shall furnish a declaration on Rs. 100/- Non-Judicial stamppaper declaring that the firm has never been declared black listedanywhere in the past, no criminal case or court case is pending againstthe tendering firm & the firm has never been punished by any court of

    law in the past.

    It is hereby clarified that RRECs role is limited to making payment of subsidy

    as received from MNRE / State Grant towards cost of equipment upon

    satisfying the terms and conditions applicable.

    This proposal includes supply of DLS, and its installation & maintenance,

    hence the provisions of WCT are applicable. The tenderer may like to obtain

    (III) 75% of the rated capacity of the battery should be between fullycharged & load cut off conditions.

    VI) ELECTRONICS

    (I) The inverter should be of quasi sine wave/sine wave type, withfrequency in the range of 20-35 kHz. Half-wave operations notacceptable.

    (II) The total electronic efficiency should be at least 80%.(III) No blackening or reduction in the lumen output by more than

    10% should be observed after 1000 ON/OFF cycles (twominutes ON followed by four minutes OFF is one cycle).

    (IV) The idle current consumption should not be more than 10 mA.(V) Electronics should have temperature compensation for proper

    charging of the battery through out the year.(VI) Necessary lengths of wires / cables, switches suitable for DC

    use and fuses should be provided.

    VII) PV MODULE(S)

    (a) The PV module(s) shall contain crystalline silicon solar cells.(b) The power output of the module(s) under STC should be a

    minimum of 37 W.(c) The operating voltage corresponding to the power output

    mentioned above should be 16.4 V.(d) The open circuit voltage of the PV modules under STC should

    be at least 21.0 volts.(e) The terminal box on the module should have a provision for

    opening for replacing the cable, if required.(f) A strip containing the following details should be laminated

    inside the module so as to be clearly visible from the front side.

    VIII) ELECTRONIC PROTECTIONS

    (i) Adequate protection is to be incorporated under no loadconditions e.g. when the lamps are removed and the system isswitched ON.

    (iii) Fuses should be provided to protect against short circuit

    conditions.

    IX) MECHANICAL COMPONENTS

    (i) Metallic frame structure (with corrosion resistance paint) to befixed on the roof of the house to hold the SPV module(s). Theframe structure should have provision to adjust its angle ofinclination to the horizontal between 0 and 45, so that it can beinstalled at the specified tilt angle.

    (i) The system should be provided with 2 LED indicators a greenlight to indicate charging in progress and a red LED to indicatedeep discharge condition of the battery. The green LED shouldglow only when the battery is actually being charged.

    (ii) There will be a Name Plate on the system, which will give.

    (a) Name of the Manufacturer & Distinctive Logo.(b) Serial Number.

    (iii) Components and parts used in solar home lighting systemsshould conform to the latest BIS specifications wherever suchspecifications are available and applicable.

    (iv) The PV module(s) will be warranted for a minimum period of 10years from the date of supply and the solar home lightingsystem (including the battery) will be warranted for a period oftwo years from the date of supply.

    Annexure- 7AGREEMENT

    (On non judicial stamp paper of appropriate amount as per GOR order)

    1. An agreement made this day of .Between (hereinafter called theapproved supplier which expression shall, where the context so admits,be deemed to include his heirs/successors, executors andadministrators, of the one part and the RREC (hereinafter called thecorporation which expression shall, where the context so admits, bedeemed to include his successors in office and assigns) of the otherpart.

    2. Whereas the approved supplier has agreed with the Corporation tosupply to the of the State of Rajasthan at its HeadOffice as well as at branches offices throughout Rajasthan, all thosearticles set forth in the schedule appended hereto in the manner setforth in the conditions of the tender and contract appended herewith

    and at the rates set forth in column . Of the saidschedule.

    3. And whereas the approved supplier has deposited a sum of Rs... in .

    4. Now these Presents witness:(1) In consideration of the payment to be made by the Corporation

    appended the approved supplier will duly supply the said articlesset forth in . And .. thereof in the manner setforth in the conditions of the tender and contract.

    (2) The conditions of the tender and contract for open tenderenclosed to the tender notice No. TN-2 and also appended tothis agreement will be deemed to be taken as part of thisagreement and are binding on the parties executing thisagreement.

    (3) Letters Nos. .. received from tenderer and lettersNos. .. issued by the corporation and appended tothis agreement shall also form part of this agreement.

    (4) (a) The Corporation does hereby agree that if the approvedsupplier shall duly supply the said articles in the manneraforesaid observe and keep the said terms and conditions thecorporation will through pay or cause to be paidto the approved supplier at the time and the manner set forth inthe said conditions, the amount payable for each and everyconsignment.

    (b) The mode of payment will be as specified below (as pertender conditions):-1. ..2. ..3. ..

    5. The delivery shall be effected and completed within the period notedbelow from the date of supply order :-

    6. (1) (i) In case of extension in the delivery period with penalty, therecovery shall he made on the basis of following percentages of valueof stores which the tenderer has failed to supply:-(a) Delay upto one fourth period of the prescribed delivery period -

    2%.(b) Delay exceeding one fourth but not exceeding half of the

    prescribed delivery period - 5%.

    (c) Delay exceeding one half but not exceeding three fourth of theprescribed delivery period - 7%.(d) Delay exceeding three fourth of the prescribed delivery period

    10%.Note:- (i) Fraction of a day in reckoning period of delay in supplies shall

    be eliminated if it is less than half a day.(ii) The maximum amount of agreed liquidated damages shall be

    10%.(iii) If the supplier requires an extension of time in completion of

    contractual supply on account of occurrence of any hindrances,he shall apply in writing to the authority which had placed thesupply order, for the same immediately on occurrence of the

    hindrance but not after the stipulated date of completion ofsupply.

    (2) Delivery period may be extended with or without penalty if thedelay in the supply of goods is on account of hindrance beyondthe control of the tenderer.

    7. All disputes arising out of this agreement and all questions relating tothe interpretation of this agreement shall be decided by the Corporationand the decision of the Corporation shall be final.

    8. The supplier is bound to supply, install, commission & maintain the

    referred DLS at beneficiaries households as per terms & conditions ofthis tender failing which the recoveries will be done as narrated indifferent clauses of this tender document (which forms part of thiscontract).

    9. In case of any dispute, the jurisdiction of court of law will remain Jaipur(Rajasthan).

    UNDERTAKING TO BE SUBMITTED BY A FIRM FOR FAITHFULLYCARRYING OUT THE ASSIGNED WORK(on appropriate Non-Judicial stamp paper)

    In consideration of the CMD, RREC, E-166, Yudhishthir Marg, C-Scheme,Jaipur (hereinafter called RREC) having authorised us ..(name of the supplier), office at (hereinafter called thesupplier) for installation work of DLS / HLS in villages and on successfulcompletion of the job (hereinafter referred as RVE works) RREC having beenagreed to disburse the financial assistance due under the programme supplierdoes hereby undertake to carryout the RVE work as per terms and conditionof the RFP document and authorisation letter issued to us by RREC.

    We do hereby further undertake that in case we are unable to carryout outduties as undertaken above. RREC would have the right to forfeit the entire

    /EMD/security amount deposited by us for RVE work with them or invokeBank Guarantees submitted with RREC.

    We at .. (Name of the firm) further agree that theundertaking herein contained shall remain in full force and effect for the periodof the year from the date of this undertaking or for such period for which thisundertaking is executed including Guarantee / Warrantee period.
