The site is a 5.43 acre irregularly shaped lot CR zone, Scenic Corridor Overlay and Las Virgenes Road Gateway Master Plan Existing Elevation: 953 street, 953 front, 960 middle, 945 rear, Finished floor of hotel, 954 Subject site and Rondell Street created under Tract Map 34801 in 1981 Site was graded for Rondell Street and drainage facilities Site was graded in again 1985 for commercial development 1998 the City adopted the LV Gateway Master Plan, which recommended the site to be re-zoned to CR, with auto related uses such as a hotel and park and ride 2004 the City considered purchasing the site for a park-and-ride and transit facility to store and repair busses and shuttles

Project History • On November 10, 2014, Rondell Oasis LLC filed an application

to construct a 4-story hotel with 127 rooms, the request included the following permits: – Conditional Use Permit, Site Plan Review, Scenic Corridor Permit, Oak

Tree Permit, Street Vacation and Development Plan

• The project was reviewed by the following – Development Review Committee, December 2, 2014 – Traffic and Transportation Commission, December 3, 2014 – Architectural Review Panel, February 27, 2015 – Architectural Review Panel, March 27, 2015 – Architectural Review Panel, April 17, 2017 – Architectural Review Panel, April 24, 2017

Project History • On November 4, 2015, the Draft Initial Study and Mitigated

Negative Declaration (IS/MND) was circulated for public review and comment for 30 days

• The Planning Commission held two public hearings on February 3rd and 4th, 2016, and adopted PC Resolution No. 2016-608 recommending to City Council adoption of the Final IS/MND and approval of the hotel project inclusive of: – 73,000 square-foot four story hotel – 127 rooms – On-site amenities such as a pool, business room, – Surface level parking with 152 parking stalls (approximately 90 spaces

were located in Rondell Street) – Street Vacation

Approved Hotel On June 22, 2016, the City Council adopted Resolution No. 2016-1496 approving File No. 140001318 for the following: • Construction of a 67,000 square-foot three-story hotel with up

to 127 rooms, and associated on-site improvements. • City did not vacate Rondell Street and committed to improving

Rondell Street with perpendicular parking per the site plan of the approved project.

Current Request • On December 28, 2016, Rondell Oasis, LLC, submitted a formal

request seeking the City’s commitment to construct the entire parking lot and enter into a joint use agreement with the City

• On January 11, 2017, Council directed staff to begin negotiations with the property owner

• City staff determined the most viable option is for Rondell Oasis, LLC to dedicate the proposed parking lot portion of its property to the City

Review Authority

• Government Code Section 65402 requires the Planning Commission to review all real property acquisition and make findings of consistency with the General Plan and forward those findings to the City Council

• Section 17.68 of the CMC requires the Planning Commission to review a proposed Development Agreement and make a recommendation to the City Council

Land Acquisition • General Plan Consistency:

– Policy II-11, promote a mix of retail and commercial areas that contribute to a sound economic base

– Policy VI-11, maintain an adequate supply of parking to support the functions of the uses the parking serves and facilitate transportation programs

– Policy VI-13, reduce the need for vehicular travel through development of convenient park-and-ride facilities

– Policies VI-23 and 24, improve access to transit options for residents and businesses through development of park-and-ride facilities

– Figure VI-2 identifies Rondell as a potential location

Land Acquisition • Las Virgenes Gateway Master Plan:

– Objective 2.4, provide safe and efficient vehicle access – Land Use section identifies Rondell Property and Street as the

preferred location for a park-and-ride for transit users and the Anza trail to the east (pages 4:5 and 4:9)

– Circulation Section, provide a park-and-ride facility on Las Virgenes Road in the vicinity of the Rondell property (page 8:6)

Development Agreement • Concentration of development rights from the area of

dedication to the hotel site (i.e. floor area ratio, site coverage, etc.)

• Establishes time frames in order to coordinate construction of both projects

• Extends existing entitlements for two years after execution of the Development Agreement

• Identifies that the following conditions of approval for the hotel project are moot: 9, 21, 39, 41, 43, 46, 47, 49, 50 and 52

The proposed Development Agreement provides assurances for the City and Developer that the entire project will be coordinated and completed together. This Agreement, therefore, is necessary to assure the Developer that the hotel approvals will not be (1) reduced in density, intensity or use; or (2) subjected to new rules, regulations, ordinances or official policies or delays which are not permitted by the Agreement. Similarly, the Agreement provides the City with sufficient reserved powers during the Term of the agreement to remain responsible and accountable to its residents during construction and operation of the project. Applicable trail conditions, 42, 44 and 45 These conditions are subject to Council approval of the final design, but this is now becoming a public works project for a park-and-ride.

CEQA The Final IS/MND was adopted by City Council via Resolution No. 2016-1496. The Proposed Project and public park & ride lot and associated improvements along Rondell Street are in substantial conformance with the project analyzed in the adopted IS/MND, therefore no additional environmental review is necessary.

Staff Recommendation Staff recommends that the Planning Commission adopt Resolution No. 2017-646, recommending that the City Council adopt an Ordinance approving a Development Agreement between the City of Calabasas and Rondell Oasis, LLC providing for the acquisition of vacant land and construction of a public parking lot and concentration of related development rights for an approved hotel.
