Welcome to the Autumn edition of Risk Manager Magazine. As this is my first column as the newly elected Chairman it is only right that I thank my immediate predecessor Chairperson Geraldine Dempsey for her stewardship for the past two years. This appointment is a great honour for me. Working closely with the committee I intend to ensure that the association remains as vibrant, active and relevant as it was since its foundation in serving the interests of its members.

AIRM website With that in mind, I’m delighted to announce the launch of our new website www.airm.ie. As well as modernising the visual aesthetic, streamlining and simplifying the layout for the end user, the website contains some important new functionality.

Relaunching the website was a time-consuming affair so I’d like to specially thank Geraldine Dempsey for her involvement in bringing the website from its initial specification through to its final delivery. I would also like to thank Hugh Sexton and Stephen Heffernan for the role they played in selecting the web designer.

Past SeminarsSince the last publication, in our April seminar, Paul Foran, former Health and Safety Authority Inspector and Managing Director of OHSS, dealt with the specialist role that Occupational Hygienist’s play in assisting the risk manager in determining a worker’s exposure to hazardous chemicals and the efficacy of existing risk control measures. More information regarding the seminar, including where to

download the speaker’s presentation, is available later in the magazine.

Our Autumn schedule began with Caitriona O’Donovan, Dr. John Fallon and Noelle Dromgoole, Health Friendly Air, addressing the issue of Indoor Air Exposure in Irish Buildings and the Law.The seminar focused on the health effects of indoor air quality in office environments, outlining the various risk exposures; prevalence of workers suffering ill-health, clarifying the concept of “Sick Building Syndrome” and “Building related illness”, outlining the regulatory framework and standards of care.

A compelling argument was made for the need for preventative maintenance programmes, overseen by

HVAC engineers, to be supplemented by accredited competent air quality specialists to ensure the invisible bacterial microbes that can cause ill-health problems for exposed workers are addressed. Delegates were also informed how noise and light equally impaired a worker’s wellbeing and the standards of care employers’ are legally required to meet. Annual Site VisitOur annual site visit in May involved a trip to Wheatfield Prison, Clondalkin, which represented a rare insight to the inner workings of a “live” prison for youth offenders. What I found most stiking was how the Governors and their staff achieved a balance between providing a secure facility that didn’t compromise the integrity of emergency evacuation procedures or endangered the lives of their prison officers.

The Governors sought to limit the scale of any outbreak of violence by segregating cell blocks, alternating prisoners access to the exercise yards and administering prison privilege system. Attitudes to managing prisoners has clearly progressed; unruly prisoners weren’t confined to “isolation” rooms devoid of any stimuli but were instead placed in “segregation” units designed in an inherently safe manner to meet the prisoner’s basic needs plus some the luxury access to a TV.

It was interesting to note that despite the advancement in technology the Governors have found that less sophisticated but more robust security systems provided a more cost effective solution. Moreover prison designs dating back to the Victorian era were

able to provide sufficient levels of inmate supervision at a fraction of the staffing levels required in more modern prison designs.

Annual Golf OutingOur annual golf outing took place in May at Killeen Golf Club, Naas. Turnout was higher than expected and I understand everyone enjoyed this social event. I’d like to make a special thank you to Peter O’Toole, Nigel Tonge and Nigel Dawkins for running the event so seamlessly.

Upcoming SeminarsIn our October seminar Paul Dwyer, Paul C Dwyer & Associates, will address the risks of cyber crime, the cyber crime economy, and the importance of risk management. The seminar will deal with how cyber crime applies to/affects a company’s Business Continuity Plan, Data Protection protocols; security protocols for employees who work off-site, and identity theft.

2011 Committee MembersFinally, I would like to announce the officers and members of the Committee for 2011 as elected at our AGM in April. Stephen Heffernan takes up the post as Secretary, while John Dunny retains his role as Treasurer. The remaining committee members include Michael Brennan, Hugh Sexton, Tom English, Peter O’Toole, John Hamilton, Jason Kelly, Geraldine Dempsey, Ray Green, Nigel Tonge, John O’Reilly, and Lesley Doyle. Brendan Kavanagh stepped down from the committee and was appointed an Honourary member given his role in founding the association and active participation in advocating the role of risk management over the years.

Sadly our colleague Phil Lewis Farrell stepped down from the Committee as she is emigrating to New Zealand. We are reliably informed the Rugby World Cup had nothing to do with her decision. We wish Phil and her family a happy future.

This Booklet was produced to assist, in preventing farm related crime and builds on the success of existing good crime prevention practices and positive Garda / Community partnerships throughout the country. It was originally developed in collaboration with the Police Service of Northern Ireland (PSNI) and this Launch coincided with the recent Garda Síochána Supporting Safer Communities Week 20-27th September 2011.

Farm Security is a priority for An Garda Síochána, particularly in the context of curbing increases in the commission of Metal Theft crimes around the country, which have unfortunately included the theft of items, such as farm machinery and farm gates.

The Launch was attended by local Garda management, PSNI officers and members of the Donegal Branch of the Irish Farmers Association (IFA). The presence of the PSNI was particularly significant in reflecting the positive ongoing collaboration between An Garda Síochána and the PSNI within the joint ‘Cross Border Policing Strategy’.

At the Launch, members of the IFA and An Garda Siochána unveiled a new overt marking / identification system for items of farm machinery, tractors and quads etc. This unique marking initiative is intended to act as both, a crime prevention deterrent, and as a detection measure, enabling Gardaí to more easily trace items back to their owners.

Crime Prevention is everybody’s business, and this Farm Security Booklet will support mutually beneficial endeavours in preventing, reducing and detecting Farm related crime.

The Civil Law (Miscellaneous Provisions) Bill 2011 was signed into law by the President on the 2nd August 2011. This new legislation provides for amendments across a range of civil and regulatory law including the Private Security Services Act 2004. The amendments relating to the Authority are contained in Part 4 of the Act and together with the 2004 Act will be cited together as the Private Security Services Acts 2004 and 2011.

The new legislation is based on our experience over the last 6 years of operations and strengthens the provisions of the 2004 Act in regards to licensing and enforcement as well as introducing some new provisions.

Speaking during the Oireachtas debate on the Bill in the Dáil, Minister for Justice and Equality, Mr. Alan Shatter T.D., said “The effectiveness of the Private Security Authority will be improved by the changes provided for in Part 4 of the Bill. The amendments provide for improvements to the licensing process of the Authority including technical changes to certain aspects of the renewal procedure and the power for the Authority to grant a temporary licence in particular circumstances. The Bill also increases the Authority’s powers to request information about individuals who are involved in the running of a security company. This will augment further the controls on the

management of security companies in addition to tax certification and other compliance measures which are already in place.”

Some of the changes are of an administrative nature and will have little, if any, impact on the operations of the security industry. However, there are other changes that many of you will be interested in learning about. I will give a brief description of these below:

There are two major changes in the definition of “installer of security equipment” with the definition being extended to cover the installation of access control systems for security purposes which controls or records access by persons or individuals either to a premises or within a premises. This is in recognition of the separateness that the installation of access control systems for security purposes has from the other installations of electronic security equipment while still continuing the intent to license this activity.

Another more significant change with immediate impact is the removing of the word ‘remuneration‘ from the definition of installer of security equipment and inserting - in the course of a business, trade or profession” instead. This means that installers of alarm systems who regularly install alarm systems without

charging will be subject to licensing. This will build on the Authority’s existing enforcement resources when dealing with the small amount of disreputable contractors who try to circumvent the legislation by claiming that there was no remuneration involved for an installation. Similarly the definitions of private investigator and security consultant were amended with the replacement of the text “for remuneration” to “in the course of a business, trade or profession”

The concept of a supplier of security equipment as a licensable activity has been removed from the legislation as there is no security service being provided at the point of supply. This will not impact on the Authority using its investigative powers seeking information from suppliers.

The PSA now has the authority to recruit persons who are not staff of the PSA and appoint them as Inspectors. This will enhance the enforcement capacity and expertise of the Authority by allowing us engage specialists in the area of electronic security and recruiting temporary inspectors for targeted enforcement action.

The licence renewal process is also amended and while most of these changes are for administrative purposes, one which will impact on licence holders is the issuing of renewal licences from the expiry date of the previously held licence.

The legislation introduces a new concept of a temporary licence for applicants who need to display competence by providing a security service in order to obtain the standards required for licensing. The temporary licence will replace the exemptions currently issued to installers of intruder alarms and will be extended to all installers of security equipment in due course. The temporary licence will be valid for 6 months with the option to extend by 3 months where there is a delay in obtaining the standards. This temporary licence will be launched later this year, when further details will be available.

A technical amendment applying to our enforcement processes facilitates the recoupment of the Authority’s costs in prosecution cases. A further change allows the Authority to charge fees for services other than the licence fee. One area where this could be used would be to charge non-compliant licence holders the costs involved in inspections undertaken for compliance purposes.

There are also a number of technical and administrative changes to the workings of the Private Security Appeals Board. These are designed to enhance the operation of the Appeal Board and again are based on the experiences of the Appeal Board since 2004.

All these amendments will improve the Authority’s capabilities in a number of key areas. For compliant licencees the amendments will ensure the Authority’s processes are as efficient as possible. For non compliant providers, our enforcement processes have been strengthened and our inspection capacity increased. Our aim is to continue to put unscrupulous operators out of business while improving the service to compliant licence holders.

A certificate of conformance is required for every alarm installed by a licensed Intruder Alarm Installer. Copies of this certificate are required by the customer, the monitoring station (to apply for a unique reference number from An Gardai), the insurance company, the alarm installer (for their records) and the certification body (EQA or other PSA approved certification body).

Up to now, certificates have been sold in books of 20 with each certificate having 4 carbon copies (total 5 copies). This system has worked well, however, the installation company needs to lean hard to ensure the print is transferred to all 4 copies, the certification body needs to contact clients regularly to ensure they keep up to date with the activities of the installers and the customers need to keep copies for the insurance companies.

With the introduction of electronic certificates, there is no need to send copies to the certification body and it is possible to print off multiple copies of the completed certificate (or e-mail the certificate in PDF format to the client and monitoring station). It is also possible to provide extra copies if the customer mislays the initial copy.

EQA teamed up with MSC (Management Systems Certification Ltd.) and ITB (Institute of Technology Blanchardstown) to develop the software for the on-line certificates. The end result is a deceptively simple to use system. Installers log on to the secure website and create the certificates using an easy to follow menu system. Installers can login at any time to review certificates

issued or to issue new certificates (rather than purchase books of certificates, installers purchase credits for issue of on-line certificates). By cooperating with MSC (another PSA approved certification body), we were able to share knowledge and experience to ensure that a robust solution would be achieved.

As part of the testing procedure, EQA made a demonstration version of the website available to all registered clients, this provided valuable feedback in advance of launching the live site. EQA (together with MSC) met with the NMCF (National Monitoring Centres Forum) to confirm that

the electronic security certificates would be acceptable to the monitoring stations, we are pleased to report that the feedback was very positive and encouraging.

In summary, the electronic certificates reduces paperwork, reduces cost, increases legibility and provides for an easy to access permanent record of alarms installed for both the installer and the certification body.

EQA entered the Intruder Alarm Certification market in 2006 and have since built up a sizeable market share by offering a value for money certification service with a focus on flexibility, innovation and customer satisfaction.

Close Protection Course Creates Employee & Industry Opportunities

Close Protection, otherwise known by some as body guarding, is a part of the private security industry that remains unregulated in Ireland. Launching this course is as a first step towards creating an industry with high standards and a step towards setting a measure of best practice in advance of regulation being introduced. Ms. Geraldine Larkin, CEO of the PSA, the regulator for the industry, commended Pulse Security and stated that, “This initiative will ensure we hit the ground running when we come to regulation”.

Pulse Security as members of the Irish Security Industry Association, have shown initiative on behalf of their entire industry with this introduction of this course. Ms. Sarah O’Donnell, ISIA, congratulated Pulse Security on this initiative and stated “The ISIA is thrilled that Pulse as members are progressing their business in this same tradition of the ISIA, by driving standards, while also creating opportunity in Irish business”.

It is estimated that there are a significant number of individuals currently employed in the area of close protection or body

guarding, however it is very difficult to assess if those being employed are truly qualified to do the work as there is no regulation. Close Protection has its own unique challenges and requirements and therefore the industry needs training that is relevant and appropriate to the type of work being undertaken.

Minister Brian Hayes T.D. stated at the launch that having a recognised qualification in the field of close protection creates opportunities for Irish security businesses by allowing their services to be recognised and trusted nationally and globally by private individuals, organisations and governments who require close protection.

This course presents individuals with an opportunity to be trained to the highest level available in Ireland and opens up employment opportunities for those individuals. Those who pursue this qualification which includes the close protection medic will receive a City & Guilds internationally recognised certificate in close protection. COURSE ALPHA commenced in October and the second course will commence in April 2012 and will be a 2 week residential course.

On Monday 12th September 2011, HKC celebrated its 20th birthday. Later that week Minister Richard Bruton formally opened its new head quarters in Dublin.

In his speech the Minster praised the Company for its ingenuity in research and development and said “the government were determined to respond to the needs of companies like HKC so that they can continue to grow and create the sustainable jobs on which our future will depend” Good news for all Irish firms striving in the current economic climate.

Over the last two decades HKC has moved from manufacturing traditional wired intruder systems to its new SecureWave platform which includes SecureWatch wired technology but also accommodates the now growing trend of wireless intruder systems. As part of its growth strategy HKC commenced exporting to the UK this year, this is the first phase of our export plan but as its Managing Director Gerard Kelly (inset photo) states “we will never lose sight of the importance of the Irish market and the need to ensure Irish installers can have access to quality Irish product”.

Two Way RadioSecureWave was launched in March 2010 with the introduction of the SW 1070 control panel. The panel was designed by HKC’s in house R & D team and is hybrid with a mix of wireless zones (70) and wired zones. The product portfolio includes a range of detection devices for both perimeter and trap protection. In addition the RF SABB (external siren) and RF Echo (internal siren) provide installers with a complete wireless solution. Since it was launched the SW 1070 has become the most popular panel in its range replacing the SW 812 which has been a long standing favourite among Irish installers.

The radio in HKC’s product is two way and has proven to be robust and easy to install. Two way radio is extremely important from some key perspectives. Firstly, there is the added security that if a radio message is sent to the control panel by a detector it is acknowledged by the panel and will continue to send a message until an acknowledgment

is received. In one way systems no such acknowledgement takes place and therefore there isan increased chance of missed messages from devices. Secondly two way radio allows for much improved battery life.

Specifying for RF systems The unique RF Wand (inset below) has given installers confidence when specifying installations. The wand is a device that measures RF signal strength in a premises prior to install, it can later be used as a maintenance tool. The RF Wand kit comes complete with a plug-in repeater that mimics the control panel. Simply locate this where the panel will be installed and carry out the survey (if there is no power a battery can be used). The Wand incorporates both voice recording & LED function for survey notes and signal strength and has individual buttons that can mimic radio transmissions for each type of device to be installed.

Life Safety Life safety has become an important part of the HKC product offering. In partnership with EI Electronics in Shannon, the Company has added three life safety devices to the SecureWave portfolio. Smoke, Heat and Carbon monoxide detectors have been enhanced to incorporate the SecureWave RF technology and have proven to be very popular devices.

Quantum 70Earlier this month the much awaited Quantum 70 was launched. The Quantum (see inset above) is designed for the residential market and fills a gap in the HKC product portfolio. The 70 zone wireless panel comes complete with voice integrated keypad, DTV communicator, internal siren and on board DSL filter. The

detection and life safety devices work across both the SW 1070 and Quantum panels so there is no need for installers to carry two ranges of stock – a big advantage in today’s tough economy. Another key advantage is that all HKC devices carry the same battery so there is no need for installers to carry multiple batteries - another cash flow advantage.

The Quantum was launched in two packs – the Primary Pack 1 includes the Quantum 70 together with two RF Quad motion sensors, a Contact Sensor, Contact/Inertia Sensor, and a RF Keyfob. The Primary Pack 2 includes the contents of Pack 1 plus RF SABB Base. The Quantum also has the capability to take an external wired SABB (Sounder) and one ID zone which can take up to 10 wired detectors.

The demand for the Quantum has proved to be spectacular in its first month of launch. When asked why it is so popular, installers have highlighted a number of

features such as two way radio, voice, on board DTV & Filter as standard.

70 it allows them to deal with many differing

installation sites without carrying two

ranges of panels & detectors.

Soon to be added (Q4) to the SecureWave range are an RF Keypad, Plug on GSM, and RF Dual Push panic button. The RF Key Pad will be similar to the current keypad in looks. The low cost GSM will plug on to both the SW 1070 and the Quantum 70 and will also be capable of being wired to a remote location. The Dual Push panic button is an RF version of the current wired dual push button. All of the above devices should be available before the end of Q4 2011 and will complete the current build program for SecureWave.

A final piece in the equation for this year was the acquisition of Astec in July. HKC plan to integrate the Astec sensor, widely perceived as the best in its class, into its inertia sensor range while the rest of the Astec range will be wound down over the coming months.

Next Phase HKC have no intention of stopping here, a new two year R & D plan is having the final touches phaze. While the plan has not been formally released yet, it will include an EN Grade 3 system and a number of additional devices. It will deliver a new communication platform to meet the growing needs of the installation community including IP.

Twenty years on, Gerry Kelly is very pleased with how HKC has grown and matured over the years. At the official opening, he said “Today’s opening is a milestone in providing the infrastructure to support our leading position in intruder alarm technology in Ireland. It will also help to underpin our export growth plans. We are very proud of our dedicated staff and the product we have created for our markets and look forward to continued growth”.

IP Perspective looks at IP technology trends and the IP industry in Ireland.

Typically, surveillance systems are used for many years once installed, it can be 5 years before a total replacement is done. The original system installed therefore shapes what is purchased for nearly 5 years.

In analyzing trends, it is important to categorise surveillance camera sales into Extension sales i.e. adding to existing systems or replacing old/defunct equipment and New Project sales. Analog typically outsells IP for extension sales due to a lack of understanding of how IP systems can

utilize existing analogue cameras. In these cases, existing analog cameras can be encoded to an IP signal to attain the benefits of an IP system and retain investment in existing cameras. This typically happens in cases where an end user wants to take advantage of Megapixel cameras for some critical surveillance areas but isn’t ready to dispose of all of the existing analog cameras.

75% of all new projects are now going with IP. Once a surveillance technology dominates new project sales, the rest of

the market is a foregone conclusion. Just like users with analog only DVRs spent years buying more analog cameras, today’s new projects deploying software only VMS systems will focus their extension purchases on IP cameras over the rest of this decade. With Video Management Software open platforms and megapixel cameras becoming more competitive, IP is more cost effective and attractive.

McDonald’s recently opened a 24 hour drive-thru restaurant in Liffey Valley, Dublin. Noted for their award winning high standards, McDonald’s wanted to put in a future proof system. The critical factors in deciding to go with IP were the clear quality images obtainable with megapixel cameras for both day and night time, ease of use of the Smart Client user interface and the ability to log on to the store remotely via their own Virtual Private Network. Having visited the National IP Experience Centre and seeing a full

working demonstration of the recommended cameras and Milestone XProtect system, the decision was made.

The camera solution consists of 1.3MP and 2MP fully PoE internal mini-domes to cover the restaurant eating areas, the counter areas, the tills, the drive thru hatches and kitchens. For outside to monitor the drive-thru a combination of 2MP Sentinel full body PoE cameras were mounted on poles and 720p vandal resistant domes were positioned to capture registration plates on exiting the drive-thru lanes. All of the cameras record to a Milestone server, which allows management to retrieve video easily and simply using sequence explorer and export video footage.

Megapixel cameras are becoming more popular for use in retail and restaurant

environments as owners realise the quality of images they can get from IP. With an IP network security solution each individual camera can be adjusted for best performance including frame rates, motion detection sensitivity and privacy masking. The security installer can remotely log on to each individual camera and adjust settings, never having to go on site. This eliminates call out charges and reduces annual maintenance costs to the end user.

More and more pubs are being subject to theft, scamming operations and accusations of breaches of health & safety measures. Against this backdrop, publicans are demanding much better quality video surveillance systems but with an eye on price. Traditional box cameras are becoming less popular as they don’t blend in to surroundings. Dome cameras are the preferred choice for wall & ceiling mounting options. 720p and 1080p Dome cameras cover wide areas giving 1 million to 2.1 million pixels respectively. This allows for sharp detail even when zoomed in, whether during daylight hours or during night time.

Using megapixel cameras over tills, gives a sharp image of what notes are transacted, so any shortfalls when cashing up can be isolated using special Transact tools in the Video Management Software. This Transact tool synchronises the video footage with the till receipt, so the POS system is an intelligent video data driven analysis

tool. They can isolate the video footage quickly by searching by transaction type e.g. Laser. This syncs all Laser transactions on the till with the corresponding video footage. This system has helped many a Publican to amicably resolve customer disputes over allegations of incorrect cash back given.

The famous traditional music pub in Westport - Matt Molloy’s – recently upgraded its surveillance system to an IP system. The pub has some very low lit areas and the internal day/night dome cameras are delivering superior results than the previous analog system as you can see in the stills below.

Step 4 Creating a Safety StatementThis statement should include additional details such as the first-aid officer, supervisor details and safety officer. This can be printed locally so the most current safety statement is available at all times.

Risks are present in all work activities and can never be totally avoided. However a simple process of identifying the main loss potentials to a business and managing the risks can be a very effective method of controlling exposures. Once you know what you are dealing with it is a lot easier to address the issues. If risks within a business remain unchecked and uncontrolled, you can expect losses, injuries and damage accidents to occur – resulting in claims and inevitably higher insurance costs. October 4th 2010 saw Hungary hit by an environmental disaster , highlighting the potential risk of many industrial operations and processes. The Hungarian Aluminium plant in the west of the country burst the banks of its reservoir holding chemical waste – a mixture of water and mining waste containing heavy metals. A 700,000 m3 wave of toxic red sludge poured out; sweeping away cars, damaging bridges and surrounding property and forcing the evacuation of hundreds of local residents.

• More than 7,000 local residents were directly affected by this incident

• A state of emergency in 3 countries,

• 10 people were killed

• Over 120 people suffered chemical burns

• The red mud soaked into the surrounding countryside and affected over 800 Hectares, this will have a lasting and harmful effect on the local terrain

The clean up operation is expected to take at least 18 months and, unofficial

preliminary numbers have been quoted in the range of $25m-$50m.

At a recent seminar, an Environmental specialist indicated that over time the total cost could well approach $150m.

From a commercial insurance perspective, it has been reported that the plant’s general liability policy had a very low limit of cover of just under $50,000 for pollution claims. Evidently in this case it was a catastrophic event, importantly though it highlights the significance of companies assessing the level of pollution risk from their operations and comparing this with what cover and limits have been achieved in their current insurance programme. Lack of coverage under general liability programmes and tightening scope of environmental regulation across the EU has focussed many companies to seek Environmental Impairment Liability (EIL) from specialist insurance providers.

Coverage GapsMany companies are of the opinion that Sudden &Accidental pollution cover on a General Liability policy is adequate. The Hungarian case highlights the potential need for companies to hold a stand alone environmental policy, which properly covers

pollution risks and properly responds to Europe’s dynamic environmental legislative landscape.

For example general liability insurance generally does not cover

• Gradual pollution

• First party costs for pollution clean up on your own site

• Complex damages arising under the new EU Environmental Liability Directive (ELD).

Gradual PollutionA public liability policy will not generally cover any damages caused as a result of a gradual pollution whether these are civil liabilities or the new damages as defined by the Directive. Much pollution is gradual, not caused by single sudden event. This would include pollution caused by a range of events such as leaks and regular fumes, not just by fire or explosion. Gradual pollution has the potential to go unnoticed for large periods of time causing extensive environmental damage.

First Party costs for pollution clean up on your own siteStandard General Liability policies in general only cover limited clean up costs for 3rd party’s, this leaves a huge gap in cover for the potential costs involved in repairing your own property as a result of a pollution

event. The case study outlined further in this article explores the potential costs of a spill on your own site.

The Environmental Liability Directive (ELD) The ELD was transposed into Irish legislation under The European Communities (Environmental Liability) Regulations 2008 (the Regulations). The ELD has introduced a ‘polluter pays’ regime with new types of damages and liability. In Ireland, the Environmental Protection Agency (EPA) has been named the designated Enforcing Authority to act who is obligated to act wherever significant harm – or threat of harm – to the environment is occurring. Irish companies may therefore see an increased frequency of enforcement, and clean-up notifications. The ELD also introduces a new remediation concept for damage to biodiversity. In a country with such a unique and diverse natural flora and fauna such as Ireland this could have serious implications.

• The Directive introduces liability for compensating for damage to protected species and habitats. For example, under the Regulations, if an operator of an industrial facility damages a protected habitat, then it may have to compensate for this loss of environment by providing and preparing an alternative site somewhere else. These are new concepts to businesses and the Regulations are causing uncertainty in the Irish insurance market..

A Standard Public Liability Policy is insufficient when it comes to Environmental LiabilityThe result of these gaps is the development of EIL as a separate class of cover - allowing complex risks of a pollution incident to be assessed, properly underwritten - and proactively covered by specialised policy wording. Expanding legislation and therefore client’s increasing liability continue to be the main drivers of the environmental insurance market.

Chartis SolutionsChartis in Ireland has developed products which specifically compliment the liabilities from the ELD and provide broad coverage solutions for a range of industries. Chartis EIL products can help remove the uncertainty operations face about their ability to cover financial losses created by an incident classified under the ELD. Chartis EIL

Scenario‘ABC Healthcare’ (the ‘operator’) is a large pharmaceutical manufacturing facility with significant solvent and chemical usage and storage on site in a designated tank farm. The company operates under an IPPC licence from the EPA. The facility is situated above a locally important fractured bedrock aquifer with moderate groundwater vulnerability (6 metres of clayey subsoil) that is used as a local water supply for a small town in Ireland. During a routine refilling of toluene from a road tanker to the tank farm via an underground pipeline, level meters on the tanks indicated that 3,000 litres of toluene were unaccounted for and have possibly leaked to the ground from a rupture in the underground pipeline.In this case, while the ground was contaminated shortly after the incident, the aquifer has not yet been contaminated. However, if the ground contamination is not addressed, contamination of the aquifer is likely to occur causing a significant risk to human health (toluene is toxic in that it is known to pose a risk to unborn children). In this case there is an imminent threat of damage.

Policy TriggerNeed for clean up of pollution conditions on site to stop imminent threat of further damage onsite &off site. This operator falls into the strict liability regime as defined by the Directive (IPPC licence operation listed in Schedule 3).

Damage Description Threat of damage can be linked directly to the operator (ABC Healthcare) by means of the solvent plume. Toluene entered the ground and sufficiently likely to enter the aquifer if not addressed, creating the ‘imminent threat’. If toluene enters the aquifer, then there is a clear risk to human health based on the toxicological properties of the contaminant, legally requiring ABC Healthcare to clean up the spill.

Immediate ActionIn line with obligations under the Regulations the operator takes the necessary preventive measures to reduce the

imminent threat. The facility operates under an environmental management system, which includes provision for an emergency response procedure, and a range of planned immediate actions are undertaken to limit and contain the contamination. The supplier immediately shuts down the filling operation and evacuates all solvent from the pipeline. The pipeline is tagged off and isolated to prevent further use. A specialist contractor is brought to the site to immediately start excavating the area around the underground pipe. The operator commences excavation of the contaminated soil which is quarantined for future treatment. The EPA is immediately notified by the operator’s environmental manager with details of the nature of the incident and the measures taken up to that point to contain the contamination. The EPA issues a direction instructing the operator to quantify the extent of toluene that has entered the ground, continue the excavation of the contaminated soil and assess the potential for contamination of the aquifer. The local authority and the company’s insurers are also notified by the operator.

Remediation The EPA issued a direction to the operator to identify and implement the necessary preventive measures to address the imminent threat of damage within 2 weeks of the incident. The operator engaged consultants to assess the options for remediation and submitted a report detailing the preferred option to the EPA. The operator issued a proposed remediation strategy that built on the immediate action undertaken and included a monitoring protocol. The operator proposed to excavate fully the soil where the spill occurred within 2 weeks of the date of the incident. In addition, the company proposed installing groundwater monitoring and abstraction wells in the spill zone and immediately down gradient to monitor the impact on the aquifer and prevent the toluene from entering the groundwater.

CostsThe total costs incurred by ABC Healthcare include costs for downtime, consultant’s fees (reporting and assessment),

contractor fees (soil excavation) and waste treatment fees (contaminated soil). In addition, the EPA costs incurred during the investigation including administration time, consultant’s fees, etc. must be met. The total cost incurred by the company for the investigation and remediation strategy would be estimated to amount to €300,000. The costs could have amounted to over €3 million if the threat had not been prevented and resulted in the contamination of the public water supply making is unfit for human consumption. These costs would have included provision of a temporary alternative water supply, a permanent alternative water supply, remediation of the groundwater and soil, EPA costs, public relations, etc.

The extent of the incident was limited through effective and immediate actions. Proactive risk management limited the duration of the incident, the costs and minimised the risks. These preventative costs, and onsite remediation costs are not generally covered by general insurances policies. An environmental impairment product covers the damages outlined below, covering the companies ability to effectively remediate current damage and prevent further damages and costs to the company. In conclusion, a company must now assess their environmental liabilities in a new light and ensure that the correct financial provisions are in place.

A new standard for Emergency Lighting – I.S.3217:2008 – has been developed in conjunction with an industry steering group. Among the participants in this steering group are the Chief Fire Officers Association, Engineers Ireland, Association of Consulting Engineers of Ireland, Association of Electrical Contractors of Ireland, NSAI, ETCI, EMDA, ECSSA and RECI.

We launched a voluntary pilot BESS registration scheme in February 2011 whereby those commissioning or periodically inspecting emergency lighting installations could purchase specific emergency lighting certificates. These requirements are additional to the electrical installation safety requirements of the wiring rules. The scheme will operate on a self funding basis.

During the pilot scheme, electrical contractors already registered with RECI can avail of the new certificates with no additional subscription. Certificates are sold in books of 5, costing €62.00 inclusive of VAT and P & P. An accredited training course is available and will be part of a future permanent scheme. Phase 1 of the scheme will run for a trial period of six months, from 1 February 2011 until 31 July 2011.

During the pilot scheme, non-registered contractors can use the BESS certificates

by registering on a temporary Emergency Lighting register for a fee of €175. Phase 2 will commence at the beginning of August subject to a satisfactory review of the pilot scheme. At this stage those who meet the criteria can register to retain access to the certificates. The register will be hosted on the ETCI website.

From a contractor’s perspective being on the register proves that you have demonstrated competency with regard to I.S. 3217 – Emergency Lighting, your work is subject to inspection, there is a complaints mechanism and the certificate number gives full traceability. In addition, from an employer’s perspective, by engaging a contractor who is on the BESS register, they are engaging “competent persons” thus demonstrating compliance with The Safety, Health and Welfare at Work Act 2005.

Following the implementation of the scheme on 1st August 2011 we have been inundated with requests for controlled certificates from members

who were not on the Provisional Register. These members felt aggrieved that they were excluded from the Provisional Register because they did not purchase the certificates during the 6 month pilot scheme. We have been in contact with the BESS Steering Committee and the other Approved Body and agreed an amendment to clause 7.5.2.2. (Provisional Membership) in the rules.

The effect of this is that all RECI members will have access to controlled certificates up to 31st December 2011 via Provisional Membership of the Register.

Provisional Membership of the Register will cease at the year end and those who have not obtained a FETAC Level 6 Award in Emergency Lighting will be removed from the register and no longer have access to certificates.

Finding the right, competent people to do the job of protecting people from injury and ill-health at work was not an “optional extra”, said the Institution of Occupational Safety and Health Ireland Branch (IOSH) at its conference in Kilkenny. In fact, good health and safety can be used as a means of business survival in the difficult recovery from recession, the Branch said.

IOSH Ireland Branch chair Declan Gibney, who opened the conference, said: “As budgets shrink amidst difficult economic times here in Ireland, businesses can sometimes feel that health and safety is not only an optional extra, but that it involves gambling on whether the person they employ will be able to protect their workforce from injury and ill-health at work”.

“We want to demystify competency, helping practitioners and businesses to stay abreast of what good, practical, proportionate advice looks like. IOSH builds high standards of health and safety into its very fabric, and this is what

we’re trying to do across workplaces in Ireland”.

During the day, Health and Safety Authority (HSA) assistant chief executive Mary Dorgan addressed delegates with a talk on how the organisation is trying to equip employers with the knowledge of who is best to safeguard staff health and safety. She said that those who take health and safety seriously will benefit from profits, growth and survival.

Ms. Dorgan added: “The message we get is that employers are confused, but our inspectors want to help companies to assess competency, via training, knowledge and experience”.

She also spoke about the Occupational Safety and Health Consultants’ Register (OSHCR), launched in the UK in the wake of the Government-commissioned review of health and safety. The register is designed to give businesses a platform from which to pick the right consultant for them, while approving those practitioners who are on its books.

“We have not considered a register here in Ireland as a role for the HSA, although the climate is in some cases similar over here (to the UK). Our approach will focus more on providing employers with the tools and assistance to assess providers”, she added.

In her talk, Ms. Dorgan praised professional bodies for improving workplace health and safety across Ireland, highlighting IOSH’s role in setting and benchmarking standards and influencing businesses.

Earlier in the day, the Royal Society for the Prevention of Accidents’ (RoSPA) occupational safety adviser, Roger Bibbings, placed practitioners’ competence in the context of recent political developments, highlighting the UK’s Government-led review of health and safety.

“Health and safety isn’t about stopping people growing businesses or having fun, getting in the way, or creating anxiety, or stopping fire fighters from rescuing people from burning buildings. It’s about empowering and enabling and it allows people to lead lives more successfully than we already do”, Mr. Bibbings said.

Amongst other speakers was Dr. Noel Richardson, director of the Centre for Men’s Health at the Institute of Technology, Carlow, revealing results from the first EU report on men’s health, which was launched in June.

Notwithstanding the 1989 Directive’s provisions, there is widespread recognition that in many workplaces Hearing Protection Devices (HPD) will continue to be an essential component of the control mechanisms. Risk Assessment and training are also recognised as key requirements and many employers do not fulfil their basic obligations.

Training should be addressed in terms of the expertise of the risk assessment and in terms of the training needs of employees. In terms of the latter, it is essential that occupational noise training should always address the following issues:

• the nature of the risks resulting from exposure to noise

• the organisational and technical measures taken to eliminate noise at source and/or reduce it to a minimum

• the relevant exposure limit values and exposure action values

• the results of the assessment and measurements of noise and an explanation of their significance and the potential risks

• the correct use of hearing protectors

• why and how to detect and report signs of hearing damage

• the circumstances in which health surveillance is made available (audiometric testing)

• safe working practices to minimise exposure to noise

It is noteworthy that the forgoing details have not been extracted from an idealised training manual or from a research paper. They have in fact been extracted (almost verbatim) from Regulation 130 of the Safety, Health and Welfare at Work (General Application) Regulations 2007. In essence, the stated issues constitute the absolute minimum content for the training which must be provided to any employee whose daily personal noise exposure equals or exceeds 80 dBA.

Many employers, safety officers and consultants may have difficulties in addressing risk assessments for noise

and/or communicating the findings of an assessment. The obligations of an acoustic or health and safety consultant in this regard need to be addressed under the concept of ‘a competent person’, as prescribed by the 2005 Safety, Health and Welfare at Work Act. In essence, the competent person is defined in terms of the suitability of their training, experience and knowledge, so as to provide informed and appropriate advice. The complexity of the environment or workplace and/or the selection of appropriate noise controls may in some instances have a major bearing on the question of competency.

All employers have a duty under health and safety law to reduce the risk of hearing damage to their employees by controlling exposure to noise. In many instances, it may be essential that a competent risk assessment is undertaken. In practice, much of the noise assessment and survey work which is routinely undertaken falls far short of the required standard. In fact,

Directive 89/391/EEC (the Framework Directive) provides a well-defined hierarchy for implementing preventative measures, with risk avoidance assuming top priority. An example of a hierarchical control system for construction noise is presented in Appendix I and is based upon many published systems, as adapted by the author.

many ‘assessments’ are clearly inadequate and have been undertaken using suspect equipment and/or methodology. In addition, often the person who undertakes the assessment may have little or no acoustical training or expertise.

Employers must undertake a suitable and appropriate assessment of the risk arising from noise exposure. This is generally done by means of a detailed noise assessment which is undertaken by a qualified and experienced assessor. The primary purpose of the risk assessment is to quantify the exposure levels and clarify what needs to be done to protect the health and safety of employees who are exposed to noise. Noise measurements may not always be required, however, whenever any significant risk exists, it would be difficult to justify not using site-specific measurement data.

This does not mean that every assessment will necessarily require a huge volume of measurement data. Generally a combination of reliable measurement and good interpretation provides the real benefit. Unfortunately some ‘assessments’ consist of a series of noise measurements and provide no interpretation and guidance.

The findings of the risk assessment must be adequately reported and an action plan should be developed to identify and document the steps taken to meet the requirements of the law - e.g., what has been already done, what needs to be done, an indicative timetable and clear identification of the individual/s responsible

for the work. In some companies, these requirements are sometimes addressed in a Hearing Conservation Programme (refer to HCP graphic).

Given that the assessor’s findings will be the foundation on which the company’s

controls are built, it is important that they are RELIABLE. It is up to the employer to take reasonable steps to satisfy himself or herself that the assessment meets all necessary legal requirements, even if the assessment is carried out by someone outside the company (such as a consultant).

Unfortunately many companies learn that their risk assessments are inadequate or their consultants were not ever ‘really’ competent when it is too late, for example, when dealing with a claim for occupational hearing loss. In fact a useful test for a company to apply would be to question whether their assessments or assessor would stand up to scrutiny by an expert in the field (or to a cross examination in a court of law).

Like many aspects of safety management, in order to avoid long term problems and pitfalls, it is imperative that noise risk assessment is undertaken by competent persons and some companies will closely examine an assessor’s credentials and keep records of same. Noise assessors as well

as individuals with responsibility for risk assessment and/or environmental noise management can benefit from training which enables them to interpret and evaluate environmental and workplace assessments. These courses should also enable participants to provide guidance and assistance in risk management as most companies will continue to have residual risk long after the assessment work has been completed.

The Institute of Acoustics (IOA) Certificate of Competence in Workplace and Environmental Noise Measurement have been specifically developed to provide participants with the necessary training to ensure that they can competently perform their duties. Refresher courses are also seen as an important element of Continuing Professional Development (CPD).

Unfortunately some individuals are convinced that an ability to press the correct buttons on a sound level meter entitles them to undertake assessments. With such a cavalier attitude, however, one should be wary of the advice that such individuals provide.

1st Priority

• Eliminate noise and noisy equipment (e.g., use hydraulic tools in prefereence to noisy compressed air tools)

• Reduce Risk at Source (e.g., �t silencers to air inlets and exhausts)

• Control Exposure (e.g., use screens, minimise daily use of certain tools)

2nd Priority

• Designate Hearing Protection Zones (mark these out clearly and post signs)

• Devise Safe Systems of work (explain and enforce these) • Maintain equipment (replace blades, bits and accessories as

required) • Training Information and Instruction (make sure everyone

understands) • Supervision (ensure systems are working)

3rd Priority

• Select appropriate PPE (select PPE for exposure conditions and ensure e�ective use of ear mu�s and ear plugs)

• Provide Health Surveillance (regular audiometric testing)

A recent Harvard study of 1,000 Californian companies has shown that ISO 9000 adopters have a greater chance for survival, suffering less “firm deaths” than non-ISO adopters. Organisations that pursued standards had higher growth rates for sales, employment, payroll and average annual earnings. Sales were close to 10% higher and there was higher employment growth at ISO certified workplaces. In years one to three after certification, there was a 6% growth in employment. This rises to 32.5% growth in year’s seven to nine.

NSAI have certified more than 120 Irish companies in various ISO management systems last year. Mr. Maurice Buckley, CEO, NSAI, said, “I urge other engineering companies to look at certification and standards as a means to achieving the best chance of commercial success for their own organisation”.

The Information Systems Security Association is an international professional body for information security personnel. ISSA was established in California in 1984 and since then has expanded across the world, now serving over 13,000 members through 125 chapters in 35 countries. As a non-profit organisation ISSA relies on volunteers to manage local chapters which provide educational and networking opportunities for members, supported

by an international headquarters in Portland, Oregon. The Irish chapter of ISSA was formed in 2003 by a group of Irish information security professionals who saw the need for a local support organisation with global connections, allowing the Irish security community to not only share information locally but also access international resources.

Following on from the success of the ISSA Ireland conference before the summer we are currently working on several events for later this year.

The first of these will be an evening seminar in Dublin which we plan to hold later this month. We are currently confirming the speaker for this event and hope to announce a date and further details shortly. The second event is earlier in the planning process and is more unusual: a Security Management Forum, aimed at senior

managers and executives leading in-house information security teams. As some of you may know, ISSA International has run a successful CISO programme in the US for several years which brings together senior security leaders for closed-door education and networking sessions. The idea of our Security Management Forum is to take some of the successful elements from this US programme and adapt them to an Irish event. The Security Management Forum represents a new format for us and will differ from our typical events in

several ways. Firstly, attendance will be limited to senior security

managers or executives working in in-house roles. This is a significant change but mirrors the approach taken

in the successful US format where it has been a

key factor in allowing open discussion of potentially sensitive

topics. The second key difference will

be in format and again we are taking the lead in this area from the US CISO Forum, where the events consist of an evening networking reception with a keynote speaker followed by a day-long programme covering a range of security topics. A key element of this format is a significant amount of time set aside for networking and open discussion of current issues, letting security managers and executives come to the event with challenges and leave with the input and advice of their peers. We wanted to “pre announce” this event early to get your feedback on the overall idea and the details needed to make it a success. VSaaS (video surveillance as a service) is the technology behind managed video.

We can draw a parallel from the traditional IT world in which SaaS (software as a service) is the technology behind managed services.

VSaaS and SaaS in general provide the ability to use the providers’ applications, running on a cloud infrastructure, accessible from various client devices.

The end-user does not manage or control even individual application capabilities. VSaaS servers can be found both in traditional or ad-hoc data centres.

What are the opportunities for the security industry?Hosting and managed services are offered to end-users based on the VSaaS/SaaS model.

This business model allows end users to record and view of video surveillance images, access control records and so on from theoretically anywhere via both data centres or direct live-streaming.

These images can then be passed to, or are coming from, security companies or alarm receiving centres.

A major driver at the moment is the possibility of replacing or integrating manned guards by using a remotely monitored system. Some of the most common examples are solutions based around virtual guard tours and visitor management.

If we look at the market potential in 2010 there were only a few hundred thousand cameras remotely managed and/or hosted worldwide, out of the tens of millions of cameras in operation.

There is a massive variation in terms of service costs, with some services starting at €10 and others reaching a few hundreds Euros per month.

The overall market potential for this is limited, however, with average annual growth potential in the next 3-5 years barely entering the double digits.

What are the barriers and challenges to adoption?There are a number of challenges to a stronger uptake in this market. Bandwidth and storage costs are often the major restraints, especially once there are more than a few cameras per site, or there is an increased number of cameras that need continuous recording.

Privacy legislation is also a major issue, especially when considering that for a “traditional” cloud service there are implications on not being able to know where the image is stored and who is ultimately responsible for it. This could

cross international boundaries and be affected by differing privacy legislation.

There are obviously technical solutions around this, but these tend to complicate a sale which is already not easy.

In some vertical markets, such as critical infrastructure, as well as these privacy laws there are other pieces of legislation and regulations that play a key role in limiting

the type of services that can be outsourced and also what data can be sent outside the organization.

In conclusionAt least for the foreseeable future, a mass uptake of the market is destined to be limited to geographically dispersed operations, with a limited number of cameras in which a VSaaS based solution can replace expensive remote patrols, static guards/key-holders, and so on.

Obviously a stronger uptake of VSaaS would be a lot “easier” if the market was based on open-platforms and software/applications instead of being product-centric.

If we look at the market potential in 2010 there were only a few hundred thousand cameras remotely managed and/or hosted worldwide, out of the tens of millions of cameras in operation.

We also take a field trip each year to a location where our members get to see first hand an unusual or interesting site which can present many of the risks our members deal in and where possible all in one location. This year was no exception and 19 of our members had an opportunity to visit Wheatfield Prison in Clondalkin and get a full tour of the facility. Having worked in this Institution for 12 years before my retirement, I was able to arrange the visit. We are happy to say 19 went in and 19 came out, they did not keep anyone!

We would like to take this opportunity to thank the Prison authorities, all the staff and in particular Governor John Farrell and Chief Officer Edwards for their hospitality and courtesy on this most informative trip.

Wheatfield Prison was built in 1998 to house 320 inmates and today the complex houses 700 after an extensive building and expansion programme.

The prison houses all categorises of inmates serving sentences from a month right up to life. There are approximately 30 committals to the Prison everyday and these might come form the courts or transfers from other Prisons. This in itself poses several risk and the largest one being that of an escape during transportation. Risks such as this and the management of same we were not privy to for operational reasons, however we were given some small insight into the problems associated with receiving committals. These ranged from gang affiliations, medical assessments and emotional and psychological issues which could arise particularly with new inmates. The Prison Health Care team includes full time doctors, psychologists, psychiatrists, optician, dentists and fully qualified nurses, other healthcare professionals are brought in if necessary and inmates also attend clinics in the various public hospitals when necessary.

There is a large emphasis on work and training for the inmates. This includes

an education unit with fully qualified teaching staff which caters for courses right up to and including 3rd level degree programmes and Open University. The work programmes for the inmates include construction, joinery, welding, horticulture & cookery. The prison has a fully equipped laundry to cater for all it’s laundry needs. The job of co-ordinating and managing all

of this is the function of almost 400 staff from the different disciplines operating in the prison ranging from security, education and healthcare.

For a complex this size there is also a large maintenance programme to manage and this is done by a number of specialist Prison staff and complimented then by contracted staff brought in. All contractors have to have a background security screening check done before being allowed operate inside the prison.

On arrival at the main gate of the prison we soon became conscious of the fact we were entering a secure environment. We had to leave our mobile phones, memory sticks and cameras behind plus we had to undergo a full security screening process before entering the institution. The prison Authorities in Ireland fight a daily battle to keep drugs and other contraband out of the Institutions and one weapon in the

fight is the searching procedure which is extremely thorough. Sniffer dogs are also utilised as part of the fight against drugs. No one is exempt from this screening, not even the Governors.

The Prison systems and procedures are constantly undergoing risk assessments both in the workshop areas and the security operations. A comprehensive reporting policy exists right through the system from accident reporting right up to incident investigations. Staff training is carried out on an ongoing basis and OHSAS 18001 is soon to be rolled out.

During the tour we also got to see how the monitoring and management of fire incidents are handled. From sophisticated smoke detection and extraction systems right through to evacuation procedures. It was interesting to note the differences in how evacuating people from a hotel for e.g. can differ greatly to evacuating people who are locked in cells and still need to be brought to a safe area away from the smoke. Because of the construction specifications and materials used in Prisons, large or widespread fires are relatively unknown but smoke can be a big issue. This is managed by utilising fire retardant and inflammable material where possible, a sophisticated sprinkler system and of course a very powerful smoke extraction system.

The tour also brought us through the Kitchen area and after we were suitably attired we got some insight into how they managed to provide meals for 700 people four times a day and still maintain good quality and nutritional values in the food. A high degree of food hygiene was particularly noticeable and indeed the Prison has won many awards in this area. Overall it was a very enjoyable insightful and interesting visit and the reports and feedback afterwards from members were very positive. Once again we would like to thank the Governor and all his staff for this most unique and interesting opportunity.

The weather thankfully was reasonably kind and we had a good turnout of members and guests on the day. There was a nice array of prizes and with some additional sponsorship from AVIVA, RSA, ATA Security, McGuirks Golf and Killeen, we were able to ensure that everyone nearly left with at least something small to remember the day.

The course was in its usual splendid condition with testing fast greens.

The seminar dealt with the specialist role that Occupational Hygienist’s play in assisting the risk manager in determining a worker’s exposure to hazardous chemicals and the efficacy of existing risk control measures.

The seminar discussed the criteria for determining hazardous chemicals (such as carcinogens), addressed their physical and chemical characteristics and underlined what legislative requirements manufacturers, distributors and end users must comply

with. Paul highlighted the need for end users to consider not only the active ingredients used in the manufacturing process but also consider the handling, storage, usage, disposal of intermediate, finished goods and waste products.

Attendees were also given a unique insight into how an Occupational Hygienist works in the field when the speaker described the intricacies of using a personal sampling air monitoring programme to aid the risk assessment process. An air monitoring programme determines whether the level of exposure to a hazardous

chemical exceeds the Occupational Exposure Level Value (OELV)*. To ensure the results are credible and accurate, the Occupational Hygienist utilises various industry accepted standards such as the National Institute for Occupational Safety and Health (NIOSH). This entails the affected worker wearing a specifically configured personal sampling device used to detect the chemical, positioned within the worker’s breathing zone (within 15cm of his mouth). To obtain an accurate and credible result it is also imperative that the services of a laboratory accredited to ISO/IEC 17025: “General requirements for the competence of testing and calibration laboratories” by the Irish National Accreditation Board (INAB) are employed to conduct the analysis.

IntroductionThe purpose of this article is to describe the risk of occupational lung disease caused by exposure to toluene di-isocyanate, which may be used during refinishing of vehicles undergoing repair. The second part of this article, which will be published in the next edition, will review the adequacy of various risk control measures with a view to recommending realistic pragmatic improvements where necessary.

BackgroundIt has been reported that isocyanates are the leading cause of occupational asthma in the Western World, accounting for 9-15% of new cases of asthma in adults of working age. Spray painters are considered to be a particularly vulnerable grouping due to the use of Isocyanate based paints, which are known respiratory sensitisers; the causal agents responsible for developing asthma; the UK’s Health and Safety Executive claim that vehicle paint sprayers are 80 times more likely to develop this condition than a general worker.

The exposureIn this theoretical scenario spray painting is carried out in a purpose built “SAICO” spray booth equipped with an integrated computer-controlled “downdraft” mechanical ventilation system with set air exchange rates, which operates under negative air pressure to prevent paint mist leaking out. Spray painting is carried out using a “traditional” hand-held spray gun using water based paints, which contain TDI hardners.

The paint spray gun creates a fine paint mist that envelope the operator. The mist isn’t extracted instantly, the “clearance time” for removing the paint mist takes 5-minutes due to the velocity and flow rate of the spray gun air jet. The severity of the exposure can be under-appreciated due to the fact that the fine” paint mist is tasteless, odourless and largely undetectable under normal lighting.

Isocyanate based paints are known respiratory sensitizers that target the lungs, resulting in chronic reversible obstructive airway disease, more commonly known as occupational asthma. The vapour damages the lower respiratory tract, specifically the alveoli where the exchange of oxygen and carbon dioxide

takes place in the body. TDI has been assigned a Occupational Exposure Level (OEL) value and has an identifying sensitizing “Sen” notation under the Health and Safety Authority’s 2010 code of practice for the Safety Health and Welfare at Work (Chemical Agents) Regulations 2001.

SensitizationOccupational asthma creates a state of immunological hypersensitivity in the lungs that results in the formation of excessive or disproportionate amounts of anti-bodies to fight off the inhaled foreign substances (i.e. antigen). During an asthmatic attack, the antigen-antibody reaction ultimately produces histamine, an inflammatory agent that causes the constriction of smooth muscle, inflammation of the airway wall and thickening of the mucus layer. Combined, these effects narrow the conducting airways and restrict the flow of air reaching the alveoli (see figures below, disrupting the body’s natural balance.

The sensitisation process does not occur after one exposure but develops over time (i.e., latency period). Latency periods are variable and can be as short as several weeks or as long as 30 years. The risk of development of sensitisation is usually dose related, that is the higher the exposure the more likely the individual will become sensitised.

What are the symptoms of occupational asthma?Typical early signs of respiratory sensitization to isocyanate include one or more of the following:

• Chest tightness;

• Persistent cough;

• Persistent cold;

• Wheezing;

• Breathlessness; and

• Flu-like shivers.

The duration of attacks usually varies from a few minutes to hours (status asthmaticus). In severe acute attacks it may prove fatal although these circumstances happen very rarely.

RehabilitationWhilst the effects are localized, this is a debilitating condition that dramatically and adversely affects a person’s quality of life. Once sensitized, even a tiny amount of exposure to isocyanate, even well below occupational exposure limit value, could trigger an attack in a person. Such a physical condition would almost certainly mean the sprayer would need to be re-assigned to safer alternative duties. If exposure to TDI, the causative agent, ceases completely, the condition will nearly always improve. If this happens within the first two years of the development of the condition then complete recovery is usual.

Assessing the riskDuring spraying the sprayer is exposed on a daily basis to inhalation of TDI during the painting episodes and until the ‘clearance time” for extracting vapours has expired. The operative is also exposed during the cleaning of his spray gun using compressed air, which takes place inside the booth and lasts a few minutes.

ConclusionSpray painting using isocyanate paint is a high-risk occupation. Consequently the health surveillance methods aimed at providing medically conclusive evidence of the body’s level of exposure to isocyanates is critical together with comprehensive and robust risk control measures.

The second and concluding part of this article will discuss ways of managing the risk and discussing the various methods of determining the sprayers exposure.
