Butts: Thank you for your recent letter and for sharing your views with us regarding the necessity of licensing the Diablo Canyon Nuclear Power Station for operation. He would like to assure you that. the HRC staff and the independent Advisory Committee on Reactor Safeguards are working as expeditiously as possible to resolve questions which have been raised about the ability of the facility to withstand earthquakes. When this question is resolved, the Atomic Safety and Licensing Board will resume the public hearing on Pacific Gas and Electric Company's application to operate the facility. At this time, it is not possible to predict when a final decision will be reached. We, of course, are aware of the problems the current drought, is causing and vill cause in the coming months; nevertheless, oux px'imary consideration in this matter as in all others-- must. be the public health and safety. Xn the meantime, we are taking the liberty of forwarding a copy of your letter for inclusion in the Diablo Canyon file so that all parties to the proceeding will be aware of your views. I am pleased to respond to your transmittal dated February 23, 1977,forwarding a letter from 1Fs. Eathi Schulze of Wisconsin Rapids, Wisconsin.Hs. Schulze referred to a recent ne>rspaper article concerning the Diablo-Canyon Nuclear Pcnmr Plant and e>~ressed an opinion that the plant shouldnot be allowed to operate.

The Hosgri fault vas discovered in 1971 close to the plant and has bc~the subject of investigation by Pacific Gas and Electric Company (PC4F),the U. 8. Geological Survey and the h>clear Regulatory Comission (NBC)since 1973 when PGGH applied for an operating licenm.

Operation of the plant is being held up, at considerable cost, becausethe earthquake safety questions are not yet resolved. The first unit atthis site was essentially completed early last year. Xt appears thatoperation villhave been held up about 1 1/2 years before a decision onthe operating license can be made.

The plant is located 3 1/2 miles from the Hosgri fault on a foundationof co~1 tent rock. What ve are dealing with here is a question ofredesign and mdification to Vithstand more severe ground shaking thanwas considered in the original design. However, there is no reason to beconcerned,about ground rupture at the plant site due to an earthquake.The NRC staff has called for an analysis to determine what changes maybe necessary so that the plant can withstand a magnitude 7.5 earthquakeon the Hosgri fault This is a very severe earthquake design basis.

the plant's owner, Pacific Gas and Electric Company, is performing= thisengineering analysis. Then the matter est be reviemd in turn by theNRC staff and by the independent Advisory Cemittee on Reactor Safeguards.In the process, it vDl have been scrutinized by many competent geologists,seisnelogists and structural engineers, including independent consultantsof national stature. Finally, the matter vill be considered by'he AtomicSafety and Licensing Board at a public hearing. It is not known, at thistime, what.the final decision villbe.
