RELEASE OF ALL CLAIMS Susan Hunt, Curtis Hunt, the Estate of Darrien Hunt and their agents, attorneys, employees, employers, insurers, successors and assigns (“Claimants”) hereby acknowledge receipt of the sum of Nine Hundred Thousand Dollars and No/100 ($900,000.00). In consideration of said sum, Claimants hereby release and forever discharge the City of Saratoga Springs, Utah, Matthew L. Schauerhamer, Nicholas E. Judson and their agents, attorneys, employees, employers, insurers, successors, assigns, officials and officers of the City (“Releasees”) from any and all claims and causes of actions of whatever kind or nature which now exist or which may hereafter accrue, because of, for, arising out of or in any way connected with the incident that occurred on September 10, 2014, detailed in the files and records of the United States District Court, District of Utah, in that certain action entitled Hunt, et al. v. Schauerhamer, et al., Case No. 2:15-CV-00001-TC (the “Incident”). Claimants understand and agree that this is a release of all claims and includes, but is not limited to, claims for wrongful death and personal injuries including any future or unknown personal injuries, claims for aggravation of pre-existing injuries, claims for expenses arising from the treatment of injuries, claims arising out of the treatment of injuries, such as medical, nursing, hospital or other expenses, claims for loss of time, wages, income or profits and all other employment capacity, claims for loss of association, services, society or consortium claims, claim for attorney’s fees, claims for property damage of any kind or character, claims for mental disorders, and claims for punitive damages. The foregoing enumeration of claims is illustrative, and the claims hereby released are in no way limited by the above recitation of specific claims, it being the intent of the Claimants to fully and completely release Releasees for all claims whatsoever in any way relating to the Incident. CLAIMANTS UNDERSTAND AND AGREE THAT THE INCIDENT MAY HAVE LED TO INJURIES OR DAMAGES, THE EXISTENCE AND CONSEQUENCE OF WHICH ARE UNKNOWN BUT WHICH MAY BECOME KNOWN IN THE FUTURE. CLAIMANTS, NEVERTHELESS, INTEND TO AND DO RELEASE ALL CLAIMS FOR ALL INJURIES OR DAMAGES, WHETHER NOW KNOWN OR UNKNOWN, AND WHETHER NOW IN EXISTENCE OR HEREAFTER TO ARISE. Claimants understand and agree that payment of said sum is made for the purpose of compromising a disputed claim and shall not be construed as an admission of liability since any liability is denied. Claimants agree that they will not defame or disparage Releasees. Claimants also agree that they shall not publicly disparage Releasees or Releasees’ practices, policies, personnel or otherwise communicate about Releasees, their practices, policies or personnel in a defamatory or disparaging manner in any medium or to any person or entity without limitation in time and they will not encourage or condone others doing so. Claimants agree to limit their statements regarding the Incident, the action filed in the United States District Court, District of Utah entitled Hunt, et al. v. Schauerhamer, et al., Case No. 2:15-CV-00001-TC, the Utah County

Attorney’s investigation of the Incident, the Department of Justice’s investigation of the Incident, or the settlement agreed upon in this Release, to the Press Release attached hereto as Exhibit 1. Claimants further agree to close all social media accounts that contain negative comments about Releasees or, alternatively, remove all such negative posts and comments to those posts. Releasees agree that they will not defame or disparage Claimants in a defamatory or disparaging manner in any medium or to any person or entity without limitation in time and they will not encourage or condone others doing so. Releasees agree to limit their statements regarding the Incident, the action filed in the United States District Court, District of Utah entitled Hunt, et al. v. Schauerhamer, et al., Case No. 2:15-CV-00001-TC, the Utah County Attorney’s investigation of the Incident, the Department of Justice’s investigation of the Incident, or the settlement agreed upon in this Release, to the Press Release attached hereto as Exhibit 2. Releasees have read and reviewed the Press Release attached hereto as Exhibit 1 and shall not object to the distribution of such Press Release. Claimants have read and reviewed the Press Release attached hereto as Exhibit 2 and shall not object to the distribution of such Press Release. Claimants and Releasees agree they will make no public statements other than those contained in the Press Releases attached as Exhibits 1 and 2 relating to the Incident, the action filed in the United States District Court, District of Utah entitled Hunt, et al. v. Schauerhamer, et al., Case No. 2:15-CV-00001-TC, the Utah County Attorney’s investigation of the Incident, the Department of Justice’s investigation of the Incident, or the settlement agreed upon in this Release. The parties agree and acknowledge that the non-disparagement and confidentiality provisions of this Release are material terms of the parties’ agreement, the absence of which would have resulted in all Parties refusing to enter into this Release. In the event of a violation of the non-disparagement provision and/or confidentiality provision of this Release, the non-breaching parties shall have the right to monetary relief, regardless of the number of instances of alleged breaches. If a person or entity not a party to this release makes a disparaging comment about Releasees, Releasees shall have the right to publicly respond to such comments in a non-disparaging manner without being found to have breached the non-disparagement and/or confidentiality provisions of this Release. Claimants shall not have the opportunity to publicly respond to any statements made by Releasees under such circumstances. If a person or entity not a party to this release makes a disparaging comment about Claimants or Darrien Hunt, Claimants shall have the right to publicly respond to such comments in a non-disparaging manner without being found to have breached the non-disparagement and/or confidentiality provisions of this Release. Releasees shall not have the opportunity to publicly respond to any statements made by Claimants under such circumstances. Releasees further agree they will not object to a request by the Hunt family to the Utah County Attorney to release Darrien Hunt’s personal effects.

Claimants warrant that all outstanding liens of any kind arising from claims Claimants have asserted as a result of the Incident have been or will be satisfied with the funds received in exchange for this Release. Claimants further represents that neither they, Darrien Hunt, nor any dependent (or former dependent) family member is presently eligible for or has ever been enrolled in or received benefits under Medicare or Medicaid. Claimants agree to indemnify and hold Releasees harmless from any claims, attorneys' fees or other expenses that might be asserted against it by any lienholder or other third party as a result of the claims Claimants have asserted as a result.

CLAIMANTS FURTHER STATE THAT THEY HAVE CAREFULLY READ THE FOREGOING RELEASE OF ALL CLAIMS, KNOW THE CONTENTS THEREOF, HAVE CONSULTED WITH THEIR ATTORNEY CONCERNING THE CONTENTS THEREOF AND SIGN THE SAME AS THEIR OWN FREE ACT.

The family of Darrien Hunt has resolved its lawsuit against the City of Saratoga Springs and its officers related to Darrien's death. As previously stated, Darrien’s family believes that Darrien’s death was not justified and that the Utah County Attorney’s investigation was not impartial. However, it is important for families to have closure in order to begin the healing process. The family is gratified that the Saratoga Springs Police Department now has functional body cameras. Both citizens and law enforcement benefit from the use of body cameras, as we have seen with encounters between citizens and officers in other instances. Nothing can replace Darrien in the hearts of his family. With this resolution, the family will try to move forward while honoring Darrien’s memory. In furtherance of the parties’ desires for closure, there will be no further written or oral comment by the parties or their representatives.

PRESS RELEASE Today the family of Darrien Hunt, the City of Saratoga Springs, and its officers settled the lawsuit related to Mr. Hunt’s death for $900,000. The City and the officers involved in the incident dispute the Hunt family’s claims that the officers acted inappropriately, including the family’s allegations that Mr. Hunt was shot in the back while on the ground and that he was targeted because of his race. Officers do not have the time to analyze and debate about how to respond to a situation, which is what occurs during the litigation process. While the Utah County Attorney’s Office concluded the shooting was justified, the current climate surrounding law enforcement makes defending civil rights cases costly and risky, even with favorable facts. The City’s insurance carrier and the City determined that settling the case removes that risk. It additionally provides closure and allows all parties - the Hunt family, the City and the officers - a chance to heal and move on from this very public, emotionally-charged case. Settlement of the Hunt family’s claims will allow the City and the officers to continue to direct their time and energy toward serving the citizens of Saratoga Springs in a positive manner. The City and the officers again express their condolences to the Hunt family for their loss and wish them well as they move forward. In furtherance of the parties’ desires for closure, there will be no further written statements or comments by the parties or their representatives about the incident or the facts and circumstances surrounding it.

SARATOGA SPRINGS — On the one­year anniversary of her son'sshooting death at the hands of police, Susan Hunt vowed Thursdaythat she won't accept a settlement with police that doesn't explicitlyclear him of wrongdoing in the fatal encounter.

Darrien Hunt, 22, died when two Saratoga Springs police officersshot him six times in the back after he unsheathed a 3­footsouvenir katana sword he was carrying and ran from them near aPanda Express restaurant on Redwood Road. The officers hadconfronted Hunt as he walked down the street with the sword onhis back, which family members say was part of a Japanese animecostume.

Flanked by dozens of family members and friends at the site of theshooting Thursday, Hunt announced she declined a $900,000 civilsettlement with the city of Saratoga Springs and the two officers

who shot her son, saying she would have been required to stay quiet about the incident.

"To me it was a gag order (saying), 'Here’shush money, don’t ever say Darrien’s nameagain,'" she said. "I hope there will be a legacyinstead of a hush order."

An attorney for the city declined to commentabout any offer.

"I feel sadly that the majority of (Saratoga Springs residents) would prefer that I just shut up and goaway," she said. "But the truth is Darrien didn’t swing the sword at the officers."

Kerahn "KJ" Hunt retraced hisbrother's last steps by himselfThursday morning to commemoratehis final moments alive. He wasmostly quiet with reporters in theafternoon, but said he was there toshow love for his slain brother. KJHunt also wore patches of other menwho have been killed recently inpolice shootings. He named each manas he pointed at the patches.

"The list goes on and on," he said.

KJ Hunt, 21, also carried a katana sword with him as he walked around the shopping area where hisbrother was killed. Police approached him Thursday after receiving complaints, according to hismother.

"Saratoga Springs said they got calls from multiple people and they pulled him over," Susan Huntsaid. "I reminded them it’s an open carry state."

Cindy Moss, an aunt to Darrien Hunt, spoke to supporters, including several that wore Guy Fawkesmasks and carried flags associated with the Anonymous activist movement. Moss lamented what shecalls a lack of legitimate oversight for police.

"The bad things that we see as a familyis they’re allowed to make any decisionand not be held accountable," Mosssaid.

She also said the investigation by theUtah County Attorney's Office into theshooting was characterized by "secretskept and lies told" that cloud the realityof what actually occurred.

"It’s hurtful, very hurtful to us as afamily that people would think he'd hurtanyone," she said of her nephew.

The family's objective isn't a payout, but rather an acknowledgement that the shooting of DarrienHunt was brutal and unnecessary, Susan Hunt said.

"It was nothing do with (money), it has to do withclearing his name, and with truth and justice," shesaid.

The family last week dismissed their attorney in thelawsuit. Robert Sykes, who lists civil rights andpolice malpractice cases among his notableexperience, said Thursday he received a messagefrom the family last week requesting his files on thecase.

"Susan Hunt wanted to go a different route," Sykessaid. "I don't really know what happened."

Sykes did not elaborate on the difference of opinion. However, Hunt said she dropped Sykes becausehe wanted to accept the settlement offer from Saratoga Springs.

"He was thinking it was a great deal and a good way to go," she said.

The family's new attorney, Paul Lydolph, of Lehi,declined comment Thursday.

The officers — Saratoga Springs Police Cpl. MattSchauerhamer and officer Nicholas Judson —were found legally justified in the shooting byUtah County Attorney Jeffrey Buhman. Buhmansaid at the time that the officers reasonablybelieved Hunt, who was still carrying theunsheathed sword as he ran, posed a threat topatrons in nearby stores.

Over the past year the shooting has attractedwaves of attention, in part because of the outcryfrom Hunt's family and friends.

Hunt believes her son was killed not because the sword he carried posed a threat, but because of thecolor of his skin. Darrien Hunt's aunt has said that her nephew had had previous encounters withSchauerhamer and the officer's judgment was biased by his unfounded assumptions about the 22­year­old.

The shooting has also been the subject of aninvestigation initiated earlier this year by the U.S.Attorney's Office and the FBI. That investigationis still underway, a spokeswoman from the U.S.Attorney's Office confirmed Thursday. No updateshave been released.

Susan Hunt said she called the FBI two weeks ago,asking for an update. They reportedly told herthey were reaching the conclusion of theirinvestigation. However, Hunt criticized thatinvestigation as well, saying they gathered all oftheir information from Saratoga Springs police.

"What kind of independent investigation is that?"she asked.

Meanwhile, Susan Hunt has been the subject of her own legal dispute. Hunt was charged earlier thisyear with misdemeanors stemming from a confrontation with Saratoga Springs police. She haspleaded not guilty to interfering with an arresting officer, a class B misdemeanor; driving on adenied license, a class C misdemeanor; failing to disperse, a class C misdemeanor; and disorderlyconduct, an infraction.

Hunt's attorney in that case, RonYengich, submitted a diversionagreement to Saratoga Springs JusticeCourt on Wednesday, according tocourt dockets. If the agreement issigned by Judge Carolyn Howard, thecase will essentially be put on hold foran agreed upon amount of time until itis eventually dismissed, contingent ongood behavior.

"It was a huge relief, but it was such abogus charge anyway," Hunt said.

Howard indicated in an orderThursday that she will hand down a decision on the agreement at a Sept. 18 hearing.

Saratoga Springs • As she marked the firstanniversary of her son’s fatal shooting bypolice, Darrien Hunt’s mother said she hasturned down a $900,000 offer to settle herlawsuit against the city and two officers.

The settlement would have barred her fromcommenting about the case, according toSusan Hunt, who said that provision wasunacceptable.

“That’s not going to clear his name,” shesaid Thursday. “And I could not, in goodconscience, agree to that.”

Hunt said she has hired the law firm of the late Johnnie Cochran to represent her inthe federal lawsuit. No court dates have been set.

About 35 people gathered Thursday afternoon to mourn 22­year­old Darrien Huntand call for police accountability at the site where he was shot fatally at about 9:30a.m. on Sept. 10, 2014.

The officers say they fired several shots after Hunt swung the sword at them, andthey gave chase when he ran away from them. Schauerhamer fired several morerounds during the chase before Hunt — who was shot six times — collapsed near arestaurant at 1413 N. Redwood Road.

Prosecutors said police were justified in shooting Darrien Hunt because theybelieved he was a threat to shoppers at a nearby store. The lawsuit, though,contends that the shooting violated the civil rights of Hunt, who was black.

On Thursday, Hunt’s younger brother, Kerahn Hunt, re­enacted Darrien Hunt’swalk at about 9:30 a.m., wearing a similar costume and carrying a similar sword.

Susan Hunt said police received multiple calls Thursday about that walk and threeofficers surrounded her son to check on what he was doing.

At Thursday’s event, some of the participants wrote notes on cards and tied them toballoons that they released to commemorate Darrien Hunt.

They then marched the route of his walk before he was shot, and Susan Hunt walkedarm­in­arm with Kerahn Hunt and her sister Cindy Moss — ending at the spotwhere the bullets struck their son, brother and nephew.

“That was pretty hard,” Susan Hunt said.

And to Kerahn Hunt, it’s yet another reminder of how his brother is gone.

“It’s painful every day,” he said.

Still pending is a federal investigation of the shooting. Susan Hunt, who saidThursday that she spoke two weeks ago with Department of Justice and FBIofficials, expressed concern that the federal investigators do not have all theavailable evidence, including surveillance video from two businesses in the vicinityof the shooting.

“My biggest concern,” she said, “is for the truth to be told.”

SALT LAKE CITY — Susan Hunt and the estate of Darrien Hunt are not disputing evidence presentedby Saratoga Springs regarding a $900,000 settlement, "they simply ignore it," a new court filing says.

The latest round in the war of words between the Hunt family and Saratoga Springs officials was filedlast week in federal court.

Darrien Hunt, 22, was shot and killed following a confrontation with two Saratoga Springs police officersin September 2014. He was carrying a 3­foot souvenir katana sword when he was shot six times in theback, with most of the shots hitting him as he fled from officers.

The Utah County Attorney's Office determined the officers were legally justified in the shooting. InJanuary, the Hunt family filed a $2 million civil lawsuit against Saratoga Springs and the two officerswho shot him, calling the officers' use of deadly force unlawful and excessive.

In September, the lawsuit took an unexpected twist when Susan Hunt said she had rejected a $900,000settlement offer and fired her attorney, Robert Sykes, who she claimed was not authorized to accept suchan offer. But Saratoga Springs officials insist she had agreed to it and asked a federal judge to force herto take the money.

In the city's reply, filed Oct. 20 by attorney Heather White, she reiterates that an agreement was reachedon Aug. 7.

"(Ms. Hunt and the estate) do not distinguish the law submitted by defendants, they disregard it. Theiropposition memo is a high­volume, zero­substance affront to both the evidence and the law," Whitewrote in Saratoga Springs' response to Hunt's response outlining her reasons that no settlement was everagreed upon.

White said a settlement was reached, that Sykes had authority to accept a settlement, and that emailswere a sufficient form of binding the settlement.

"Attorney Sykes received from Heather White, counsel for the defendants, a $900,000 offer of settlementfor the client. After consulting with Susan Hunt, attorney Robert Sykes contacted defendants' attorney,

Heather White, and accepted this offer on behalf of Susan Hunt. Curtis Hunt also accepted the settlementoffer of $900,000," according to court documents.

The city also asks the judge to sanction Hunt for "breaching the confidentiality of the settlementagreement and needlessly prolonging this litigation."

The court documents additionally state:

"Ms. Hunt contends she should not be sanctioned because she did not breach theconfidentiality provision, as no settlement was reached. However, as shown above, Ms. Hunthas advanced no cogent argument against the enforceability of the settlement agreement, andshe has ignored undisputed evidence and binding case law. It is clear a settlement wasreached and she breached the confidentiality provision when she told the media that she hadrejected the settlement offer and was being paid 'hush money.' Moreover, she has prolongedthis litigation by obstinately opposing finalization of the settlement in the face of clearevidence and law."

A hearing to present oral arguments in court on the issue is scheduled for December.

In a separate motion, Hunt claims she shouldn't have to pay Sykes' attorney fees because of hisrepresentation.

Earlier this month, Sykes told KSL News that the motion gives a "false impression" of the work hisoffice did.

"Everything that we did, that our firm did and that I did, was completely legal, ethical, competent andwith full disclosure," he said. "Those papers contain many, many falsehoods, inaccuracies,mischaracterizations and partial truths. There are so many I can't comment on them all."

Sykes is expected to file his response to Hunt's motion in federal court this week.
