Where-can the building be placed on the property?

A building must be placed in accordance with Zone specific setbacks laid out in Zoning By-Law 190-10.

What is the minimum size building I can place on my property?

a) No single-unit dwelling may be placed, erected or altered so that it has an overall width and ground floor area of less than:

i) In the case of a single storey dwelling, 7.3 meters (24 ft) in width and 89.2 square meters (960 square feet) in area; and

ii) In the case of a one and one-half storey or a two storey dwelling, 7.3 meters or 24' wide and 71 square meters or 764 square feet in area .

(b) No two-unit dwelling may be placed, erected or altered so that it contains a dwelling unit with a ground floor area less than:

i. If one unit is above the other, 7.3 meters or 24 ft in width and 89.2 square meters or 960 square feet in area, or

ii. If semi-detached;1. 960 square feet, in the case of a one-story dwelling; and

2. 485 square feet, in the case of a two-storey dwelling.

Is there a limit to the number of Buildings permitted on my property?

A maximum of one. dwelling unit per lot is permitted.

How much will my permit cost?

The permit fee to construct a building is based on $5.00 per $1,000.00 of the estimated value* of your project.

*Estimated Value of project will be calculated in office if contractors estimate is not provided with application.

Is there anything else I need to be concerned with when planning a building project?

It is advised that land owners check their properties for restrictive covenants before beginning a project. While the Town does not enforce these covenants it is in the land owner's best interest to be aware of them.

3.4 Development / Building Permit

a) No person shall undertake a development as defined by the community Planning Act of

New Brunswick, without having obtained a Development and Building Permit.

b) No Development or Building Permit shall be issued unless the proposed development

conforms to all provisions of this By-law, and all other By-laws of the Town of Hampton;

c) Any Development or Building Permit shall be in force for a period of one (1) year from

the date of issue or until the project has been completed or is discontinued for a period

of 6 (six) months and any permit may be reissued upon request, subject to review by

the Town of Hampton Development Officer or Building Inspector;

d) No Development or Building Permit may be issued under this By-law except where the

applicant has paid a fee as established by Council;

e) A development permit is required for any alteration to the interior of a building or

structure involving the following:

i. A change of use (including changing from one permitted use to another

permitted use within the same zone);

ii. An increase in the number of dwelling units;

iii. A structural alteration;

iv. Any alteration to the exterior of a building or structure which involves an

increase in the size or exterior dimensions;

v. Commencement of a home occupation; and

vi. Development (including driveway paving) on Town-owned land.

DECLARATION AND RESPONSIBILITIES OF THE PERMIT HOLDER

By signing the owner/applicant hereby agrees: a) that this is an application only, and until a permit has been issued by the Town of Hampton and received

by the applicant, no part of the intended work shall be undertaken.b) to comply with relevant By-Laws and Regulations.c) that the permit granted under the terms of this application is automatically cancelled if the applicant fails

to conform with any By-Laws or Regulations.d) neither the insurance of this building permit nor the approval of the plans or specifications, relieve the

owner from full compliance with the National Building Code, and applicable Municipal Regulations andBy-laws.

e) that once constructed the applicant agrees to use the structure for the sole purposes indicated in thepreceding application.

f) that this permit expires one year from the date of issuance of the Building Permit andg) all work must be completed within one year of the date of the permit unless written permission for an

extension has been granted by the Building Inspector or designate.

h) if purposed work in any way does not meet the requirements of the aforementioned

By-Laws, there must be a variance application submitted and passed of the particular By-Law

from the Planning Advisory Committee. Until such variance has been granted by that body in

writing, I will not commence work.

i) to contact the Building Inspector:i) At least 48 hours' notice of your intention to start work authorized by the permitii) At least 24 hours' notice for the following is to be provided to the Town Building

Inspector (or designate) in order that proper inspections can be conducted prior tomoving on. With the Failure to provide notice and the continuation of constructionmay result in delays and a request to remove any cover that has been placed overthat which is to be inspected.
