The purpose of this „Request for Proposal (RFP)‟ document (also referred as “Tender” or RFP) is
to provide interested parties with information that may be useful to them in making their financial
offers pursuant to this RFP. This RFP includes statements, which reflect various assumptions and
assessments arrived at by the KVIC (Khadi and Village Industries Commission) in relation to the
Project. Such assumptions, assessments and statements do not purport to contain all the
information that each Bidder may require. This RFP may not be appropriate for all persons, and it
is not possible for the KVIC, its employees or advisors to consider the investment objectives,
financial situation and needs of each party who reads or uses this RFP. The assumptions,
assessments, statements and information contained in the RFP Document may not be complete,
accurate, adequate or correct. Each Bidder should, therefore, conduct its own investigations and
analysis and should check the accuracy, adequacy, correctness, reliability and completeness of the
assumptions, assessments, statements, and information contained in this RFP Document and
obtain independent advice from appropriate sources.
The KVIC, its employees and advisors, make no representation or warranty and shall have no
liability to any person, including any Bidder under any law, statute, rules or regulations or tort,
principles of restitution or unjust enrichment or otherwise for any loss, damages, costs or expenses
which may arise from or be incurred or suffered on account of anything contained in this RFP or
otherwise, including the accuracy, adequacy, correctness, completeness or reliability of the RFP
and any assessment, assumption, statement or information contained therein or deemed to form
part of this RFP Document or arising in any way for participation in this Bid Process. The KVIC
also accepts no liability of any nature, whether resulting from negligence or otherwise howsoever
caused, arising from the reliance of any Bidder upon the statements contained in this RFP.
The KVIC may, at its absolute discretion, but without being under any obligation to do so, update,
amend or supplement the information, assessment or assumptions contained in this RFP
Document. The issue of this RFP Document does not imply that the KVIC is bound to select or
appoint a Bidder for the Project and the KVIC reserves the right to reject all or any of the Bidder
or Bids without assigning any reason whatsoever.
The Bidders shall bear all costs associated with or relating to the preparation and submission of its
Bid including but not limited to preparation, copying, postage, delivery fees, expenses associated
with any demonstrations or presentations which may be required by the KVIC or any other costs
incurred in connection with or relating to its Bid. All such costs and expenses will remain with the
Service Provider and the KVIC shall not be liable in any manner whatsoever for the same or for
any other costs or other expenses incurred by a Bidder in preparation or submission of the Bid,
regardless of the conduct or outcome of the Bidding Process.
SECTION-1: LETTER OF INVITATION
PART-1: Invitation to Bid
1. Khadi and Village Industries Commission (KVIC) hereby invites proposal from reputed and
reliable firms empaneled with Ministry of MSME, Government of India for the Engagement
of Consulting Agency for „Impact Assessment Study of Direct Reform Assistance (DRA)
Provided to Khadi Institutions (KIs) and Scope of Further Assistance to Other Non-
DRA KIs‟. The objective of this engagement is to assess the impact of interventions under the
Khadi Reform Development Program (KRDP) at the national level.
2. The RFP document shall be intimated individually to the empaneled agencies with
Ministry of MSME, Government of India.
3. Bidders are advised to study this RFP document carefully before submitting their
proposals in response to the RFP Notice. Submission of a proposal in response to this
notice shall be deemed to have been done after careful study and examination of this
document with full understanding of its terms, conditions and implications.
4. This RFP document is not transferable and the name of the bidder who purchases and
submits the same bid shall be unchanged.
5. Bidder shall not tamper/ modify the tender form including downloaded price bid template
in any manner. In case if the same is found to be tampered/ modified in any manner, the
tender will be completely rejected.
6. Not more than one tender shall be submitted by one bidder or bidders having a business
relationship. Under no circumstance will father and his son(s) or other close relations who
have a business relationship with one another (i.e. when one or more partner(s)/ director(s) are
common) be allowed to tender for the same contract as separate competitors. A breach of this
condition will render the tenders of both parties liable to rejection.
7. Any corrigendum/addendum (if any) shall be intimated individually to the empaneled
agencies prior to the date of submission of bids.
8. The Hard Copy of original affidavits must be delivered at the address as mentioned in the
Data Sheet (Part-2 of Section-II of RFP) Bid will be rejected in case of non-receipt of original
payment instrument like Demand Draft/any other accepted instrument etc. against the
submitted bid.
9. Bids will be opened as per date/ time as mentioned in the Data Sheet of Part-2 of Section-II of
the RFP.
10. The Purchaser shall not be responsible for non-receipt/ non-delivery of the Bid documents due
to any reason whatsoever
11. The response to the RFP should be uploaded on or before the date and time specified in the
schedule for RFP.
12. The KVIC reserves the right to reject any or all the Bids in whole or part without assigning
any reasons.
13. This “Invitation to Bid” is non-transferable under any circumstances.
14. Pre-Bid Queries/ Clarifications may be requested not later than the date defined in the
Schedule. Clarifications may be e-mailed (only) to the following address: [email protected]
15. All email must have Pre-Bid queries: Impact Assessment Study of Direct Reform

16. EMD. There is no EMD1, however, the bidders have to submit the Bid Security Declaration as
per the Form – 3, failing which their bid will be rejected.

2.3 About KVIC
Khadi & Village Industries Commission (KVIC), established under the Act of Parliament
(No.61 of 1956), and as amended by Act No.12 of 1987 and Act No.10 of 2006) is a
statutory organization under the Ministry of MSME (Govt. of India) and engaged in
promoting and developing Khadi and Village industries (KVI) for providing employment
opportunities in the rural areas, thereby strengthening the rural economy.
It has been identified as one of the major organizations in the decentralized sector for
generating sustainable non-farm employment opportunities in rural areas at a low per
capita investment. It undertakes activities like skill improvement; transfer of technology;
research & development; marketing etc. and helps in generating employment/self-
employment opportunities in rural areas.
The prime functions of KVIC are:
Planning and organizing capacity-building programs.
Build up reserves for supply of raw material and implements.
Encourage and assist in creation of common service facilities for all activities related
to production and marketing of products.
Promote sale and marketing of products.
Undertake studies for KVI sector.
Encourage and promote research in the technology used in the sector including non-
conventional energy.
Provide assistance for development and upgradation of designs, prototypes and other
technical information including quality assurance.
Govt. of India is striving to improve the socio-economic conditions of the rural
population-providing host of support to non-farm sector. Such supports primarily include
creation of employment opportunities based on resources and skills with assistance for
improving supply chain, enhancing skills, upgrading technology, expanding market,
augmenting capacity building of the entrepreneurs/artisans and their groups.
As per 2011 Census, around 69% of country‟s population is living in the rural areas. This
vast majority of people draw their livelihood from rural farm and or non-farm sector.
Therefore, growth and development of these sectors are primordial for higher growth
trajectory of Indian economy.
Organization provides such holistic supports for promotion of both self-employment and
wage employment, particularly under rural non-farm sector. Sector plays an important role
in the development of employment opportunities in the hinterland of country, both in rural
and urban areas.
It is engaged in promoting and developing Khadi and Village Industries for providing
employment opportunities with special focus in the rural areas with an eye as well in
setting up micro enterprises in urban areas at a very low per capita investment. The
activities of the sector are source of livelihood for around 14 million rural and urban
people who largely include spinners, weavers and village industries artisan spread across
the country.
2.4 Assignment Background
Khadi and Village Industries Commission (KVIC) has been entrusted with responsibility
for planning, promotion, organization and implementation of programmes for the
development of Khadi and other Village Industries in rural areas in coordination with other
industries engaged in rural development, wherever necessary.
KVIC has played a very significant role by providing employment opportunities to the
poorest of the poor in remote rural areas through Village Industries. Village industries from
the purview of KVIC broadly include Agro based and Food processing industry, Forest
based industry, Hand Made paper and Fiber industry, Mineral based industry, Polymer and
Chemical based industry, Rural engineering and biotech industry and Polyester industry.
In order to fully realize the significant growth potential of KVI sector, the Khadi Reform
and Development Program (KRDP) is being implemented by Government of India and
KVIC since 2010, with assistance from Asian Development Bank (ADB).
The key outcome of the program focused on revitalization of the Khadi and Village
Industries (KVI) subsector with enhanced sustainability and promotion and marketing of
khadi; increased employment, higher incomes and welfare for the Khadi artisans;
institutional strengthening; and development of traditional village industries.
The objective of this engagement is to assess the impact of interventions under the Khadi
Reform Development Program (KRDP) at the national level.

SECTION-3: TERMS OF REFERENCE
PART-3: Scope of Work
Khadi is handcrafted textile of India. It was livery of freedom in independent India, now mandated as
a livery of economic freedom in India for the rural artisans. Khadi is the pride of India and it has the
distinction of being the only cloth to be used in the National Flag. Khadi has been a source of
livelihood for about 10 Lacs spinners, weavers and other across the breadth of our country. Its
inherent characteristics lie in its eco-friendliness by using simple technology and above all, its
suitability to operate from artisan‟s cottage itself.
The Khadi and Village Industries Commission (KVIC) during the last few decades has played a
significant role at the grass root level by providing employment opportunities to the poorest of the
poor in remote rural areas.
Khadi Sector
Khadi means any cloth woven on handlooms in India from cotton, silk or woolen yarn handspun in
India or from a mixture of any two or all of such yarns.
Khadi is estimated to constitute less than 1% of India‟s textile market. The growth in production and
sales of khadi is marginal compared to the increase in the production of textiles.
The textile industry has made tremendous strides with the adoption of modern technology, branding,
and savvy marketing. In contrast, khadi has been unable to adapt to economic and technological
advancements. As a result, the community-based production and marketing model of a product that is
still revered, is neither able to gain market share nor substantially contribute to rural employment.
Another concern area is towards competition taking advantage of non-genuine Khadi in the market -
In the current marketplace, close substitutes and duplicates are getting sold under the Khadi name.
However, given its size and diversity, India has significant opportunities for genuine Khadi if it is
efficiently produced and marketed. Simultaneously, repositioning of khadi is needed to link the
consumer perception of Khadi with its genuineness, environment friendly, socially conscious, and fair
wage characteristics.
Village Industries
As per KVIC act, Village Industry means any industry located in Rural area which produces any
goods or renders any service with or without the use of power, in which the fixed capital investment
per head of an artisan or of a worker does not exceed INR 1 lakh rupees in plain area and INR 1.5
lakhs in hilly area or such other sum to be notified in the official Gazette, be specified from time to
time by the Central Government.
The Village Industries under the purview of KVIC broadly include. Agro based and Food processing
industry, Forest based industry, Hand Made paper and fibre industry, Mineral based industry,
Polymer and Chemical based industry, Rural engineering and biotech industry and Polyvastra
industry
3.1 About - Khadi and Reform Development Program (KRDP)
In order to fully realize the significant growth potential of KVI sector, the Khadi Reform and
Development Program (KRDP) is being implemented by Government of India and KVIC since 2010,
with assistance from Asian Development Bank (ADB). The key outcome of the program focused on
revitalization of the Khadi and Village Industries (KVI) subsector with enhanced sustainability and
promotion and marketing of khadi increased employment, higher incomes and welfare for the Khadi
artisans; institutional strengthening; and development of traditional village industries.
Over the duration of the program, reform measures were made in various areas and a substantial
progress was achieved including but not limited to:
a) Formulation and implementation of the Khadi Mark
b) Development of the 5 village industry clusters
c) Policy level reforms including introduction of benefit chart and production incentive plan
d) Direct reform assistance to Khadi Institutions enabling them to increase their productivity with
the assistance of new implements and increase their sales with the renovation of their sales outlets
e) Capacity building and institutional strengthening of KVIC Amongst several reform components,
KRDP comprises of comprehensive reform package for select Khadi Institutions (KIs). i.e. Direct
Reform Assistance (DRA).
The objective of the assistance is to make the KIs to emerge as Self Reliant and organize Khadi
Programme on their own. The support (maximum INR 105.00 Lakhs) covers all reform activities of
KIs viz. production, marketing, governance, IT/MIS, artisan welfare, etc. The reform package has
been implemented in 465 KIs. As mandated under the program, an overall assessment of Direct
Reform Assistance to 465 KIs and scope for further extending assistance to other KIs needs to be
carried out by an independent agency. The key components of KRDP are as under:

3.2 Objective of the Assignment
The assignment aims at undertaking an independent assessment of the Khadi Reform Package.
Through the assessment study, it is intended to gain an insight of the extent to which the program
components have impacted the sector. The key objectives of the assessment are as follows:
To assess the overall impact of the reforms on the khadi and village industry sub-sector. The
following questions need to be answered (based on primary and secondary data analysis):
Have the reforms contributed to income enhancement and employment growth at the
sectoral level?
Is KVI sub-sector a provider of sustainable employment to artisans with consistently
increasing wages?
Is Khadi effectively promoted and marketed to ensure commercial viability as well as to
ensure generation of market demand for khadi?
Have the reforms contributed to removing major constraints in khadi production value
chain by enabling procurement and production?
Have the reforms contributed in revitalization of khadi institutions?
To understand the impact of reforms on overall progress of the KIs receiving support under
KRDP vis-à-vis comparable KIs not receiving support under KRDP and scope for extending
KRDP assistance to other KIs
To map challenges and gaps in implementation and identify measures to increase the
effectiveness
To identify mitigation measures for further strengthening of the programmes
Would the reforms under KRDP be beneficial for new beneficiaries as well?
3.3 Scope of the Study
The reform package has been implemented at 3 levels viz. Sectoral level, KI level and KVIC level.
Each component of the reform package needs to be assessed for its impact on the performance of
beneficiary KIs and artisans‟ income etc. vis-à-vis performance of Non-Beneficiary KIs on the same
parameters. The details of components at each level are given below.

covering all 6 zones (North, South, East, West, North-East and Central). The survey shall
comprise of both DRA Institutions [465 KIs where Direct Reforms Assistance (DRA) has been
provided] and non-DRA Institutions [appropriate sample size to be selected from exhaustive
list available on KVIC website]. The survey plan shall be prepared and finalized in consultation
with KVIC.
Prepare research report and submit the findings.
Preparation tools, pilot testing and finalization
Finalization of the data collection instruments and a training manual for investigators.
Develop a data analysis and tabulation plan in consultation with the KVIC.
Data collection with CAPI (Computer Aided Personal Interviews) tools with facility for online

4.3 Key Deliverables:
i. Inception report with final scope, methodology and approach. This should also include findings
from the analysis and therefore the areas which will be further explored during field visits.
ii. Mid-term report with initial findings of the study.
iii. Draft Impact Assessment Report for stakeholder consultations.
iv. Final Impact Assessment Report after incorporation of inputs from all the concerned
stakeholders.
The final report should primarily cover the following:
i. Impact of the implementation of the KRDP Programme on beneficiary institutions in
comparison with non-beneficiary institutions in the same time period.
ii. Assess the achievement of desired outputs and outcomes of the programme. Report to have
details highlighting instances where targets could not be achieved along with reasons for such
under achievement, if any, and to recommend remedial measures that may be taken by the
Authority. The parameters shall include the following:
a. Increase in sales, before and after the KRDP intervention
b. Increase in production, before and after the KRDP intervention
c. Increase in wages/earnings, before and after the KRDP intervention
d. Increase in number of artisans, before and after the KRDP intervention
e. Improvement in working capital position
iii. Recommendations on better use of available data management and mechanism for effective
monitoring of the programme.
iv. Recommendations on improvement in infrastructure facilities by Field Offices, NGOs and
other key organizations
v. Recommendations on further improvement of programme with the objective of meeting its
targets, adequacy and timeliness of fund flow & delivery mechanisms, coverage and linkages
with other institutions at the State level and national level.
vi. Recommendations and Framework on continuing of the programme further and providing
support to Non-DRA‟s as well under the KRDP.
PART-5: Instruction to Bidder
5.1 Cost of RFP
The RFP document can be purchased for a fee of INR 10,000/- (non-refundable).
Payment can be remitted by the way of NEFT/ RTGS and the copy of acknowledgement of
such remittance should be provided with the Bid Document.
Proposals not accompanied by remittance receipt of RFP Document Fee shall be treated as
non-responsive.
5.2 Transfer of RFP
The RFP Document is not transferable to any other bidder. The bidder who purchases the
document and submits shall be the same.
5.3 Eligible Bidders
The Bidder should be an agency empaneled with Ministry of MSME, Government of India
like Management Institutions, Economic and Social Research Institutes of National and
International repute, Consultancy firms, etc.
Note:
o Agencies under administrative control of Ministry of MSME are not eligible to
participate in bidding.
o Individuals/proprietorship firms are not eligible.
o NGOs/ Institutions assisted by KVIC/ KVIBs are not eligible.
A Tender Evaluation Committee constituted by KVIC will evaluate the bids and select
appropriate agency for executing the assignment.
The Tender Evaluation Committee may make such investigations as necessary to determine
the ability of the Bidder to adhere to the requirements specified within this RFP. The
Evaluation Committee will reject the proposal of any Bidder who is not a responsible Bidder
or fails to submit a responsive offer/tender.
5.4 Consortium and Joint Ventures
i. Any consortium, joint venture, subcontracting & outsourcing will not be allowed.
5.5 Completeness of Response
i. Bidders are advised to study all instructions, forms, terms, requirements and other
information in the RFP documents carefully. Submission of bid shall be deemed to have
been done after careful study and examination of the RFP document with full
understanding of its implications.
ii. The response to this RFP should be full and complete in all respects. Failure to furnish all
information required by the RFP document or submission of a proposal not substantially
responsive to the RFP document in every respect will be at the Bidder's risk and may
result in rejection of its Proposal.
5.6 Proposal Preparation Costs
i. The bidder shall submit the bid at its cost and, KVIC shall not be held responsible for any
cost incurred by the bidder. Submission of a bid does not entitle the bidder to claim any
cost and rights over KVIC and KVIC shall be at liberty to cancel any or all bids without
giving any notice.
ii. All materials submitted by the bidder shall be the absolute property of KVIC and no
copyright /patent etc. shall be entertained by KVIC.
5.7 Bidder Inquiries
Bidder shall send in their written queries as prescribed in the Section 5 - Form 2 to the contact
address at which the bids are to be submitted. Bidders can also email their queries on
[email protected] The response to the queries will be emailed to individual bidding agencies. No
telephonic queries will be entertained. Responses of KVIC shall become integral part of RFP
document.
5.8 Amendment of RFP Document
i. All the amendments made in the document would be shared via email and shall be an
integral part of RFP document.
ii. The bidders are advised to check their respective emails on regular basis for checking
latest updates of this RFP document. KVIC also reserves the rights to amend the dates
mentioned in this RFP for successful bid process.
5.9 Supplemental Information to the RFP
If KVIC deems it appropriate to revise any part of this RFP or to issue additional data to clarify
an interpretation of provisions of this RFP, it may issue supplements to this RFP. Any such
corrigendum shall be deemed to be incorporated by this reference into this RFP.
5.10 KVIC’s right to terminate the process
KVIC may terminate the RFP process at any time and without assigning any reason and KVIC
shall not be held responsible for any cost incurred by the bidder in bid preparation. KVIC reserves
the right to amend/edit/add delete any clause of this Bid Document. However, this will be
informed to all and will become part of the Bid/ RFP.
5.11 Earnest Money Deposit (EMD)
There is no EMD requirement; however, the bidders have to submit the Bid Security
Declaration as per the Form – 3, failing which their bid will be rejected.
5.12 Performance Bank Guarantee (PBG)
i. Performance Security should be submitted by the successful bidder/agency within a period
of 05 working days from the date of award of the assignment. The selected agency will
have to furnish the required Performance Security, which should be 3% of the total cost of
the assignment. The same should be furnished through RTGS/NEFT or Bank Guarantee
from a Nationalize Bank as per format provided in Form 6.
ii. The PBG should remain valid for a period of Sixty days beyond the date of submission of
final report and its acceptance by the KVIC.
iii. Failure of the successful Bidder to submit the above-mentioned Performance Bank
Guaranty equivalent or sign the Contract/Agreement shall constitute sufficient grounds for
the annulment of the award. In that event, KVIC may award the Contract to the next
evaluated Bidder whose offer is substantially responsive and is determined by KVIC to be
qualified to perform the Contract satisfactorily.
iv. No interest will be paid on the Performance Security.
5.13 Authentication of Bid
The original copy shared via email shall be signed, stamped and should be uploaded along
with the bid. Authorized person of the bidder who signs the bid shall have the authority letter
from the bidder, which shall be submitted with the Bid. All pages of the bid and its annexures,
etc. shall be initialed and stamped by the person or persons signing the bid. In the case of the
Board resolution authorizing a person as the person responsible for the bid, the Board
resolution shall be submitted.
5.14 Language of Bids
This bid should be submitted in English language only. If any supporting documents are
submitted in language other than English, translation of the same in English language is to be
duly attested by the bidder and should be summited along-with the bid, and English
translation shall be validated at KVIC‟s discretion.
5.15 Data/ Documents Prepared by the Successful Bidder to be the Property of the KVIC
All information collected plans, specifications, reports, other documents and data shall be
absolute property of KVIC. The Successful Bidder shall not use this information anywhere,
without taking permission, in writing, from the KVIC and the KVIC reserves right to grant or
deny any such request.
5.16 Bid Submission Format
The entire proposal shall be submitted strictly as per the format specified in this Request for
Proposal (RFP). Bids with deviation from this format are liable for rejection.
5.17 Submission of Bids
While preparing the Proposal, the bidder must give particular attention to the following:
i. Scope of work of each component under KRDP programme
ii. List of KVIC offices (Zonal/ State/ Divisional Offices) placed at Annexure - III
iii. Number of key professionals and support team staff-months estimated by the firm. It is
desirable that the key professional staff proposed be permanent employees of the firm
or has an extended and stable working relation with it.
iv. Forwarding Letter on company letterhead of the Bidder indicating the submission of
the Bid signed by an authorized person holding the Power of Attorney (Please refer to
Annexure IV- Form 7)
v. Bid Security Declaration in accordance with clause 5.11 Earnest Money Deposit/ Bid
Security
vi. All relevant forms and documents as per the Tender requirement
vii. Tender Acceptance Letter
viii. Any other document required in the data sheet
ix. Any other document to support the bid
x. Bids shall be submitted physically in a properly designated envelope at KVIC office
address: Dy. Director I/C (RID), KVIC, 3, IRLA Road, Gramodaya, Vile Parle West,
Mumbai – 400056. Bidders shall be responsible for the submission of their respective
bids at the above-mentioned address; Tendering Authority shall not be responsible for
any loss of bid documents during transit.
xi. In preparing the Financial Proposal, the bidders are expected to take into account the
requirements and conditions of the RFP document. The Financial Proposal should
follow Standard Forms as provided in the RFP document and list all costs associated
with the Assignment.
xii. The Bidders should express the price of their services (inclusive of taxes) applicable in
Indian Rupees only. The taxes should be shown separately along with cost.
xiii. The cost of study should be inclusive of all expenses viz. travelling, material,
contingency expenditure, all taxes applicable etc.
xiv. The financial proposal shall not include any conditions attached to it and any such
conditional financial proposal shall be liable for rejection. The agency shall be fully
responsible for all claims made by any third party and shall also be responsible for all
expenses incurred by KVIC in any litigation initiated by any third party.
xv. KVIC, may, at any time, by a written order given to an agency, make changes within
the general scope of the contract related to terms & references, enlarging the scope,
analysis or specifications. If any such change causes an increase or decrease in the
cost, or the time required for the execution of the work, mutual adjustment shall be
made in the contract price or delivery schedule, or both, and the work order shall
accordingly be amended.
xvi. The Bidder must submit Financial Quotes as per format provided in Form 5 (Financial
Proposal Format)
xvii. The Financial Proposal should clearly identify as separate amounts such as local
taxes, duties, fees, levies, and other charges imposed under the applicable law, on
the bidder. All taxes, duties and levies, and charges for any permits or other
privileges as per prevalent rates as on date of Bid submission. The Agency shall be
solely responsible for the taxes that may be levied on the Agency persons or on
earnings of any of his employees and shall hold KVIC indemnified and harmless
against any claims that may be made against KVIC. KVIC does not take any
responsibility whatsoever regarding taxes under Indian Income Tax Act, for the
Agency or his personnel. If it is obligatory under the provisions under the Indian
Income Tax Act, deduction of Income Tax at source shall be made by KVIC.
xviii. The prices/rates quoted by the Bidder shall remain firm (fixed) during the entire
Contract Period and shall not be subject to any escalation/variation on any account
except in case of statutory taxes, duties and levies. A Bid submitted with an
adjustable/variable price quotation will be treated as non-responsive and hence will be
liable to be rejected.
xix. The final quoted prices shall be inclusive of statutory taxes, duties and other
levies.
5.18 Late Bids and Bid Validity Period
Any bid received by KVIC after the deadline for submission of bids shall be declared late and
will be rejected and returned unopened to the bidder at the discretion of KVIC. The validity of
the bids submitted before deadline shall be till 180 days from the date of opening of the
Financial Bid.
5.19 Submission and Receipt of Proposals
The Bidder shall submit the Proposal using the appropriate Forms furnished in RFP. These
forms must be completed without any alterations to their format, and no substitutes shall
be accepted. All blank spaces shall be filled in with the information requested.
The proposal shall contain no interlineations or overwriting. Submission letters for
Proposal should respectively be as per the specified formats.
Scanned copy of proof for payment of Tender Fee should be provided.
Bidders are advised to provide each, and every document as mentioned in the respective
packets.
Any interlineations, erasure or overwriting shall only be valid if they are signed by the
Authorized Signatory of the Bidder with date.
Vague and ambiguous responses and responses such as “Refer covering letter, conditions
of Bid etc.” shall be avoided. Such responses shall be deemed to be incomplete.
KVIC may, at any time, at its discretion, extend the deadline for the submission of Bids in
which case all rights and obligations of KVIC and Bidders previously subject to the
deadline shall thereafter be subject to the deadline as extended.
5.20 Bid Opening
KVIC shall conduct the opening of Proposals of all Bidders in the presence of Bidders`
representatives who choose to attend at the address, date and time specified by KVIC. The
Bidder‟s representatives who are present shall be requested to sign a register evidencing
their attendance.
The date, time, and location of the opening of Financial Proposals will be communicated
in writing/ email by KVIC.
Proposals shall be opened one at a time and the details shall be displayed.
i. The name of the Bidder
ii. Whether there is a modification or substitution;
iii. The Bid Prices, including any other details as KVIC may consider appropriate.
5.21 Bid Evaluation
KVIC will examine the Bids to determine whether they are complete, or whether any
computational errors have been made, or whether the documents have been properly
signed and whether the Bids are generally in order and conform to all the terms,
conditions and specifications of the RFP Document without any deviations.
Prior to the detailed evaluation, KVIC will determine whether each Bid is of acceptable
quality, is generally complete and is substantially responsive to the Tender Document. For
purposes of this determination, a substantially responsive Bid is one that conforms to all
the terms, conditions and specifications of the Tender Document without material
deviations, objections, conditionality or reservations.
A deviation, objection, conditionality or reservation is:
i. That affects in any substantial way the scope, quality or performance of the
Contract
ii. That limits in any substantial way, inconsistent with the Tender Document,
KVIC‟s rights or the successful Bidder‟s obligations under the Contract
iii. Whose rectification would unfairly affect the competitive position of other Bidders
who are presenting substantially responsive bids.
A Tender Evaluation Committee constituted by KVIC will evaluate the bidding agency
and select appropriate agency for executing the assignment.
The proposals will be opened on the mentioned date in this RFP. The Bids will be
examined by the KVICs‟ Tender Evaluation Committee.
5.22 Clarifications on Bids
In the process of examination, evaluation and comparison of proposals, Tender Evaluation
Committee, at its discretion, may ask bidder(s) for clarifications of its proposal which the
Bidder shall be obliged to furnish.
Tender Evaluation Committee may undertake oral clarifications from the Bidder. The
primary function of clarification in the evaluation process is to clarify ambiguities and
uncertainties, if any, that may arise during the evaluation of bids.
Bidders have to provide the required clarification/ documents within the time as specified
by Tender Evaluation Committee at time of requesting for clarification. Failure to do so
may result in the rejection of the bids.
When deemed necessary, prior to Financial Proposal opening, Tender Evaluation
Committee may seek clarifications on any aspect from the Bidder. However, if price
change is envisaged due to any clarification, supplementary Bid in a separate sealed cover,
commensurate with addition/deletion only, shall be submitted prior to Financial Proposal
opening only if agreed by Tender Evaluation Committee.
During Financial Proposal evaluation, Tender Evaluation Committee may, at its
discretion, ask the Bidder for a clarification on any information provided in the Bid, to be
responded to within a stipulated number of days to be specified by Tender Evaluation
Committee. The request for clarification and the response shall be in writing, to be
communicated either through e-mail or through a paper-based communication, and no
change in the price or substance of the Bid shall be sought, offered or permitted except to
confirm the correction of arithmetical errors discovered by Tender Evaluation Committee
in the evaluation of the Bids.
5.23 Bid Evaluation
If there is a discrepancy between words and figures, the amount in words shall prevail. For
any other calculation/ summation error etc. the bid may be rejected.
The Tender Evaluation Committee of the KVIC will assess the financial bids of the
competent bidders and the lowest financial bid will be selected for award of the
assignment/work.
The agency shall be fully responsible for all claims made by any third party and shall also
be responsible for all expenses incurred by KVIC in any litigation initiated by any third
party.
5.24 Award Criteria
KVIC shall award the contract to the bidder who has quoted the least amount. The Tender
Evaluation Committee, however, reserves the right to accept or reject any or all bids without
giving any reasons thereof.
5.25 Signing of Contract
The successful bidder shall enter into contract agreement with KVIC within 05 working days.
The Agreement format is attached in Annexure I - Agreement for conducting Impact
Assessment Study of KRDP.

6.3 Dispute Resolution
If a dispute arises out of or in connection with the agreement, or in respect of any defined legal
relationship associated herewith or derived there from, the parties agree either to seek an amicable
settlement of that dispute by conciliation under the ICADR Conciliation Rules, 1996 or to submit
that dispute to Arbitration under the ICADR Arbitration Rules, 1996.
The authority to appoint Conciliator/Arbitrator shall be the International Centre for Alternative
Dispute Resolution. The place of conciliation /arbitration proceedings shall be in Mumbai.
6.4 Consequences of Default
On the occurrence of any of the event of default on the part of Agency, KVIC may terminate this
Agreement and claim refund of any money paid or invoke the bank guarantee and refuse to make
any more payment.
In case of default being limited to delay only not exceeding 5 weeks, KVIC may claim the penalty
@ 0.5% of the total cost of assignment for every week of delay up to 6 weeks and @ 5% in case
of delay is beyond 6 weeks. The amount of liquidated damages shall be withheld and /or
recovered from the payment to be made to the Agency. In case of default other than delay, the
KVIC shall terminate the Agreement by giving a short notice of 14 days and shall assign the work
to some other Agency at its discretion.

AGREEMENT FOR CONDUCTING Impact Assessment Study of Khadi reform and
Development Program (KRDP) of Khadi & Village Industries Commission
AGREEMENT
THIS AGREEMENT is entered into this ____________day of____________ 202I, between
the Khadi and Village Industries Commission, a body corporate established under the
Khadi and Village Industries Commission Act, 1956 (Act No. 61 of 1956 and amended up to
22nd March, 2006 ) having its Central Office at 3, Irla Road, Vile Parle (West), Mumbai-
56, herein after referred to as "COMMISSION" and M/s ________________________
herein after referred to as "the AGENCY" having its principal office located at
____________________________________________________ acting through
__________________________.
WHEREAS, the Commission wishes to have the Agency to perform the assignment
hereinafter referred to, and WHEREAS, the Agency is willing to perform this assignment,
NOW, THEREFORE, THE PARTIES hereby agree as follows:
1. Services
The Agency shall perform the assignment as per the “RFP Document and
Scope of Assignment".
The Agency shall provide the personnel list as per Annexure – I A –
„Agency's Personnel‟ to perform the Assignment.
The Agency shall submit to the KVIC the reports in the form and numbers
and within the time periods specified in Annexure – I B „Agency‟s
Reporting Obligations‟.
2. Term
The Agency shall perform the assignment within 90 days from the date of
award of the work order for evaluation study subject to liquidated damages
for the delay attributable to the Agency.
3. Payment
A. Ceiling
For the assignment, the KVIC shall pay the Agency the sum of Rs.
_________________(Rupees____________) including taxes. This
amount includes the Agency's overall costs and deliverables as well as
any tax obligation that may be imposed on the Agency.
B. Performance Security
The selected agency will have to furnish the required Performance
Security, which should be 3% of the cost of the assignment within a
period of 05 days from the date of award of the assignment along with
Agreement.
The same should be furnished through RTGS/NEFT or Bank Guarantee
from a Nationalize Bank as per the format provided in Form- 6. The
Performance Security should remain valid for a period of 30 days after
acceptance of the final report by the KVIC.
C. Schedule of Payments
The schedule of payments is specified below:
i. First installment: 15% of the total cost of the assignment after
signing of the agreement and furnishing of the required bank
guarantee equal to the first instalment of payment. The tenure of the
Bank Guarantee will be up to the period of submission of the final
report and acceptance by the KVIC.
ii. Second installment: 10% of the total cost of the assignment will
be paid after submission of the sampling plan and questionnaires
and acceptance of the same by the competent authority at KVIC.
iii. Third installment: 50% of the total cost of the assignment will be
paid after submission of draft report(s), presentation & other
deliverables to KVIC and acceptance of the same by the competent
authority at KVIC.
iv. Fourth Installment: Balance 25% of the total cost of the
assignment as full as final settlement will be paid on successful
completion of the work and submission of final deliverable/final
reports and acceptance of the same by the competent authority at
KVIC. The final report should be submitted as per the structure of
template for evaluation of Central Sector Scheme as issued by the
Ministry - attached at Annexure – V in the RFP.
v. The final report must be submitted in 10 hard copies, 15 hard copies
of Executive Summary and 10 CDs containing the final report shall
be submitted before submitting the final bill for payment.
vi. The draft/final report would be the intellectual property of KVIC
and would not be published by the agency concerned without
prior approval of KVIC. The raw data/processed data/findings
should not be disclosed by the agency to any third party without
the prior approval of KVIC.
vii. The total fee for the study as agreed with organization will
include all taxes and the liability of payment of tax will be of the
Agency conducting the study. However, KVIC will deduct the
GST, tax from each installment while releasing the installment.
4. Project
Administration
The CEO, KVIC designates Dy.Director I/C (RID) as the KVIC Coordinator
for this assignment.
The Coordinator will be responsible for the coordination of activities and
monitoring the progress of the study under this Agreement, for acceptance
and approval of the reports and of other deliverables by the KVIC and for
receiving and approving invoices for the payment.
5. Performance
Standards
The Agency shall promptly but not later than 7 days replace any employees
assigned under this Contract that the KVIC considers unsatisfactory. The
Agency shall also promptly carry out any modification/improvement in the
report and or other deliverables as suggested by the Coordinator, failing
which the KVIC shall have the right to terminate this Agreement by giving a
short notice of 14 days to the Agency.
6. Confidentiality
The Agency shall not disclose any proprietary or confidential information
relating to the Services, this Agreement or the KVIC business or operations
without the prior written consent of the KVIC.
7. Ownership of
Material
Any study reports or other materials, graphic, software or otherwise,
prepared by the Agency for the Commission under the Agreement shall
belong to and remain the property of the Commission. The Agency may
retain a copy of such documents and software for the purpose of this
Agreement.
8. Insurance The Agency will be responsible for taking out any appropriate insurance
coverage at its own cost.
9. Re-Assignment The Agency shall not sub-contract/ outsourcing of this Agreement or sub-
contracts any portion of it without the KVICs‟ prior written consent.
10. Dispute
Resolution
If a dispute arises out of or in connection with this agreement, or in respect
of any defined legal relationship associated herewith or derived there from,
the parties agree either to seek an amicable settlement of that dispute by
conciliation under the ICADR Conciliation Rules, 1996 or to submit that
dispute to Arbitration under the ICADR Arbitration Rules, 1996.
The authority to appoint Conciliator/Arbitrator shall be the International
Centre for Alternative Dispute Resolution.
The place of conciliation/arbitration proceedings shall be in Mumbai.
11. Events
of Default
i. Delay in furnishing of any report beyond the period mentioned in
Annexure I B provided that there shall not be default for the period or
Force Majeure and delays solely attributable to the KVIC.
ii. Any report being non-acceptable to the KVIC for lack of professional
quality.
iii. Breach of any of the terms of this Agreement: If it is found that the
details furnished by the successful bidder regarding its past experience,
location of office etc. are false or incorrect, in that event the said bidder
will be liable for forfeiture, apart from initiating other legal action, as
deemed fit.
12. Consequences
of Default
i. On the occurrence of any of the event of default on the part of Agency,
the KVIC may terminate this Agreement and claim refund of any money
paid with interest @24% p.m. or invoke the bank guarantee and refuse to
make any more payment.
ii. In case of default being limited to delay only not exceeding 5 weeks,
KVIC may claim the penalty @ 0.5% of the total cost of assignment for
every week of delay up to 6 weeks and @ 5% in case of delay is beyond
6 weeks. The amount of liquidated damages shall be withheld and /or
recovered from the payment to be made to the Agency. In case of default
other than delay, the KVIC shall terminate the Agreement by giving a
short notice of 14 days and shall assign the work to some other Agency
at its discretion.
iii. The KVIC reserves the right to terminate the assignment and contract at
any time at its sole discretion. In case the termination is made on account
of the reasons not attributable to the Agency, then the Agency is entitled
to get the actual cost of work done by it. In the event of such
termination, all the information and documents collected by the Agency
shall be returned to the KVIC.
13. Force Majeure
The agency shall not be liable for forfeiture of its performance, Bank
Guarantee or termination of contract for default if any to the extent that the
delay in performance or other failure to perform its obligations under the
contract is the result of an event of Force Majeure.
For the purposes of this clause; Force Majeure means an event beyond the
control of Agency. Such events may include wars, riots, earthquakes, fire,
flood, epidemics etc.
If a Force Majeure situation arises, the Agency shall promptly notify KVIC
in writing of such situations.

Any notice, request or consent required or permitted to be given or made
pursuant to this contract shall be in writing. Any such notice, request or
consent shall be deemed to have been given or made when delivered in

notarized written power of attorney, and all attachments, for a period of 180 days/Bid Validity
period as mentioned in Annexure: II (Bid Data Sheet), from the date fixed for submission of
Proposals as stipulated in the RFP and modifications resulting from contract negotiations, and
it shall remain binding upon us and may be accepted by you at any time before the expiration
of that period.
7. We declare that we do not have any interest in downstream business, which may ensue from
the RFP prepared through this assignment.
8. I/ We acknowledge that KVIC will be relying on the information provided in the Bid and the
documents accompanying such Bid, and we certify that all information provided in the Bid
and all Forms are true and correct; nothing has been omitted which renders such information
misleading; and all documents accompanying such Bid are true copies of their respective
originals. We accept that any misrepresentation or misinterpretation contained in this Bid may
lead to our disqualification.
9. I/We acknowledge the right of KVIC to reject our Bid without assigning any reason or
otherwise and hereby waive, to the fullest extent permitted by applicable law, our right to
challenge the same on any account whatsoever.
10. We understand you are not bound to accept any proposal you receive, not to give reason for
rejection of any proposal and that you will not defray any expenses incurred by us in bidding.
11. I/ We hereby irrevocably waive invoking any right or remedy which are available to us at any

Agency or to vary the prices of the total contract value or to release or forbear from enforcement of
all or any other security or any other securities now or anytime held by KVIC and such arrangements
with the Agency or release or forbearance whatsoever shall absolve the bank of the full liability to
KVIC hereunder or prejudice the rights of KVIC against the bank.
4. The guarantee shall not be determined or affected by the liquidation or winding up of, dissolution
or change in constitution or insolvency of the Agency but shall in all respect and for all purposes be
binding and operative until payment of all moneys payable to Agency in terms thereof.
5. The bank hereby waives all rights at any time inconsistent with the terms of this guarantee and the
obligations of the bank in terms hereof shall not be in anywise affected or suspended by reasons of
any dispute or disputes having been raised by the Agency (whether or not pending before any
arbitrator, Tribunal or court) or purporting to stop or prevent any payment by the bank to KVIC in
terms thereof. The Bank‟s liability under these presents being absolute and unequivocal.
6. The amount stated in any notice of demand addressed by KVIC to the bank as liable to be paid to
KVIC by the Agency or as suffered or incurred by KVIC on account of any losses, damages, costs,
charges and expenses shall be conclusive evidence of the amount so liable to be paid to KVIC or
suffered or incurred by Agency as the case may be and in terms hereof.
7. This guarantee / undertaking shall be in a continuing guarantee / undertaking and shall remain valid
and irrevocable for all claims of KVIC and liabilities of the Agency arising up to and until midnight
of <date>
8. This guarantee/ undertaking shall be in addition to any other guarantee or security whatsoever that
KVIC may now or any time anywise may have in relation to the Agency obligations or liabilities
under and/or in connection with the said contract, and KVIC shall have full authority to have recourse
to or enforce this security in preference to any other guarantee or security which KVIC may have or
obtain and not forbearance on the part of KVIC in enforcing or requiring enforcement of any other
security shall have the effect of releasing the bank from its full liability hereunder.
9. It shall not be necessary for KVIC to proceed against the said Agency before proceeding against
the Bank and the guarantee herein contained shall be enforceable against the bank notwithstanding
that any security which KVIC may have obtained or obtain from the Agency shall at the time when
proceedings are taken against the said bank hereunder be outstanding or unreleased.
10. We the said bank undertake not to revoke this guarantee during this currency except with the
consent of KVIC in writing and agree that any change in the constitution of the said bank shall not
discharge our liability hereunder.
11. Notwithstanding anything contained herein above, our liability under this guarantee shall be
