1. INTRODUCTION

Mt. San Antonio College (Mt. SAC) is interested in obtaining competitive proposals related to the College’s Property, Liability and Worker’s Compensation Program including claims management services. All proposals will be screened for thoroughness and responsiveness to this Request for Proposal (RFP). Following the screening process, the selected finalists may be invited to participate in an oral interview process. This RFP is in no way an agreement, obligation, or contract and in no way is the College responsible for the cost of preparation. The District reserves the unqualified right to accept or reject any and all proposals received as a result of the request, or negotiate separately with competing proposals simultaneously, and to waive any informalities, defects, or irregularities in any proposal. Future proposals may be requested for Owner Controlled Insurance Plan, Employee Life Insurance program and Employee Health Savings Plan. A. History and Description of Operations

Mt. San Antonio College is among the largest of California’s 112 community colleges with 421 acres and serving over 60,000 individuals from diverse backgrounds and generations. The District’s boundaries encompass the communities of Baldwin Park, Bassett, Charter Oak, Covina, and Diamond Bar, the southern portion of Glendora, Hacienda Heights, City of Industry, Irwindale, La Puente, La Verne, Pomona, Rowland Heights, San Dimas, Valinda, Walnut, and West Covina. The College offers more than 200 degree and certificate programs and has earned statewide and national distinction in a number of disciplines. For additional information about Mt. B. General Information

• The Mt. SAC Foundation is provided with general liability and Directors and Officers coverage under the College’s current MOC. While the Foundation handles its own funds, it has two College employees who run the day-to-day operations.

• The College has a student health center that operates solely for the benefit of the students.

• The College owns and operates six single-winged aircraft with a total combined value of $275,000.

• All contractors/vendor service providers are required to provide a Certificate of Insurance with limits of $5,000,000, a contractual hold harmless, and Additional Insured Endorsement.

• The College owns/operates one Co-Generation Plant which is located on campus.

• The College owns and operates one swimming pool that is made available to outside groups/organizations. A certified lifeguard is on duty during those times when outside organizations are utilizing the facility. The swimming pool has one 3-meter diving board and one 1-meter diving board.

• District employees are utilized as a security force. All campus security personnel receive 20 hours or more training as certified by SB1626. We currently have 4 armed post certified police officers within our Campus Security personnel who are licensed and are authorized to carry weapons.

• Buildings are alarmed and monitored by an alarm company. The City of Walnut provides fire protection services.

• Employees and volunteers who drive College vehicles are required to submit to a DMV screening.

• Food service on campus is provided by Mt. SAC Auxiliary Services, which includes a sole contract with Sodexo.

• The College provides Day Care services for children from birth through age 5. The Day Care Center is licensed for 141 children.

D. Current Insurance Program

The College’s core insurance program consists of the following coverage with some SIR/deductible amounts. Our 2017-2018 Worker’s Compensation program is administered with Keenan and insured by Protected Insurance Plans (PIPs) reinsurance after dollar one. Our 2017-2018 Property and Liability program is with Alliance for Schools for Cooperative Insurance Programs (ASCIP). Coverage is as follows:

2. INSTRUCTIONS FOR SUBMITTING PROPOSAL

A. Timeline and Response Guideline

Proposals must be submitted not later than 4:00 p.m. on March 9, 2018. Late submittals will be disqualified. The College expects, but does not guarantee, that a decision on selection of firm(s) will be made on or before March 22, 2018. All submissions must be signed by officials authorized to bind the Firm to its stated provision. Consultant shall submit one original and two (2) copies of the Proposal. All proposals shall be complete and final with no additional information required after the close of the submittal date, unless specifically requested by the District. All proposals shall remain firm for at least ninety (90) days from the date set for proposal opening. B. Admonition of Proposers

Upon issuance of this RFP, Proposers are specifically directed not to contact anyone within the College, except as identified in this RFP, for meetings, conferences or technical discussions related to this RFP, nor initiate discussions with any insurance carrier concerning the College unless authorized in writing to do so. Failure to adhere to this policy may be grounds for rejecting Proposer from consideration.

C. Conformity

Proposals must conform to the requirements of this RFP. The College reserves the right to waive any irregularity in any Proposal or to reject any Proposal that does not comply with this RFP.

D. Costs

The College assumes no obligation for any costs incurred by any firm in preparing the statement of qualifications, attending an interview, or any other activity prior to award of the contract to the chosen firm(s).

E. Public Record

All responses submitted in response to this RFP will become the property of the College upon submittal and a matter of public record pursuant to applicable law. The College reserves the right to retain all Proposals submitted, and all Proposals and materials submitted are subject to the “California Public Records Act.” When Proposals are opened, pries and other information will not be made public until the proposal is awarded. There shall be no disclosure of any Bidder’s information to competing Bidders prior to the award of any contract pursuant to this RFP. At that time, the executed contract and proposals will become public information. Accordingly, each proposal should be submitted on the Bidder’s most favorable terms from a price and technical standpoint.

F. Proposal Format

The content and sequence of the information contained in each copy of the Proposal shall be as follows:

1. Letter of Transmittal

2. Table of Contents. Include a clear identification of the material by section and by Page number.

3. Community College Experience.

a. Provide examples of leadership, creativity, and innovation for

community colleges. b. Provide the number of community colleges being served within

the program and the types of Property & Liability, and Worker’s Compensation services provided.

c. Discuss any insurance or coverage programs available that are specific to the needs of California community colleges and what makes them unique.

d. Discuss any services that would be unique to community colleges and costs associated with those services.

4. Personnel. Provide the name, title, and resume of all personnel who will be assigned to this program, including the primary management contact, all personnel role and responsibilities to the account.

5. Program Overview. Provide an overview of the structure of proposed program, including coverages, deductibles, self-insured retentions layering of primary and excess coverage (if applicable), use of manuscript policies, and any services available or to be provided by insurers, brokers/JPA as part of the proposed program.

Describe the activities and services that would be provided to the College as part of the agreement. If available, include descriptions of support that would be provided in such areas as loss control, risk financing, risk analysis, and other related services. Describe any activities and services that are outside the program and costs associated with those activities and services.

6. Is your company or firm engaged, or planning to engage in any merger, acquisition, litigation, or business reorganization that might have an impact on your relationship with Mt. SAC?

7. Bidder’s Questionnaire (Attachments B-G). All RFP respondents are required to complete Attachments B-G. If Respondent offers more than one carrier, separate Attachments must be completed for each carrier.

All respondents are encouraged to recommend the limits and coverage that they feel would best meet the needs of the College. All prospective bidders will be required to provide sample copies of all insurance coverage forms to be utilized and financial records evidenced in Attachment G. Failure to provide this information will deem the respondent non-responsive. Any JPA providing a response to this proposal must describe precisely how equity is determined and distributed to the community college members. Furthermore, responding JPAs must provide a history of any prior equity distributions or assessments to their community college members, as a percentage of total premium. Please indicate current net position for the JPA specific to the line of coverage being quoted. If experience rating is used in the premium/contribution calculations, bidders must detail the experience rating parameters and formulas used in the proposal for community college members as well as for the group as a whole (if respondent is a JPA).

3. SCOPE OF REQUEST FOR PROPOSALS

A. Scope of Work

Mt. San Antonio College is seeking qualified insurance companies (direct writers), brokers, agents, or direct power authority groups to submit proposals to design and assist with the implementation of a comprehensive Property and Liability and Worker’s Compensation Program. The Scope of Work, may be modified through negotiation and/or by written addendum, while the exact nature and extent of the services are subject to negotiations, the minimum professional services are as follows:

• Proactively provide ongoing review and analysis of the College’s insurance programs and identification of risk transfer and risk financing options.

• Be familiar with the major exposures of the College. • Be familiar with the coverages provided by all relevant insurance

policies and documents issued to the College. • Assure that insurance policies are placed in a timely manner, without

lapses in coverage periods, with reputable and financially responsible insurers.

• Provide service for the insurance policies placed for the College including processing all changes and endorsements and verifying the accuracy of invoices within a reasonable time.

• Provide early warning of rate and coverage changes or renewal problems through a process to be mutually agreed to with the College.

• Upon request, provide a comprehensive report that reviews all of the College’s insurance programs.

• Through a process mutually agreed upon, monitor the College’s operations and loss exposures and make any appropriate recommendations for coverage changes or new coverages.

• Be available to answer questions or obtain answers from underwriters for policy coverage questions.

• Meet with College staff and designated representatives as reasonably requested.

• Provide consultation service and written reports as normally expected of a professional broker and/or JPA to a large client.

• Provide loss control services and assistance with claims as requested by the College. Assist in analyzing loss exposures from existing exposures, new operations and exposures, and determine the appropriate risk management alternatives, indemnification agreements, including types, availability, cost, and extent of coverages that should be considered.

B. Deliverables

Specific deliverables for the College’s Property, Liability, and Worker’s Compensation Program shall include, but may not be limited to the development, design, and implementation of the most highly advantageous plan to improve services and to sustain the lowest possible costs for Worker’s Compensation benefits as required by California law. More specifically, each vendor must demonstrate and submit qualifications which relate to the following:

1. Insurance and Underwriting

• Proof of current license is required to transact insurance sales/service in California.

• Insurance companies (direct writers) must be licensed to transact business with insurance sales/service in California.

• Proposed insurance companies must demonstrate an AM Best rating of no less than (A- VII).

• Review policies and other coverage related documents in detail within fourteen (14) days of receipt of the documents to check the wording and accuracy of each policy, binder, certificate, endorsement or other document received from insurers to ensure that the intended coverage is provided, and all coverage, terms and conditions, and other wording is complete and accurate and in compliance with financial arrangements and administrative procedures acceptable to the College. Obtain revisions needed to achieve compliance with coverage request.

2. Policy Amendments

Process requests for additions or deletions to policies with five (5) business days of receipt. Provide follow up with insurer to verify the insurer has handled request. Advise in writing of any changes to insurance policy(s) within fourteen (14) days.

3. Claims

• Assist the District staff, as necessary, with filing claims. • Work with outside claims adjusters as necessary. • Represent the interests of the District in policy interpretation and

other negotiations with insurance carriers. • Assist the District with review of claim reserves and represent the

District to the insurer/coverage provider with regard to requested explanation or reduction of reserve amounts. Follow-up with insurer/coverage provider as necessary until resolution of any reserve reduction requests are accomplished or until claim is closed.

• Review all quarterly loss runs for all claims on all coverages. Evaluate loss history for trends or other indicators that might dictate changes in coverage strategy, deductibles, retentions or limits.

• Provide annual summaries by policy year for each of the last five years indicating total number of losses by type for each line of coverage and showing earned premium, incurred losses and loss ratio.

4. Certificates of Insurance

Issue certificates of insurance within three (3) business days following the date of request.

5. Contract Review

Review contracts, lease agreements and waivers as requested and notify the District whether the insurance programs of the District are in compliance with insurance requirements of contracts and/or agreements.

6. Legal Compliance

Comply with all State and Federal laws and regulations pertaining to insurance brokers licensed in the State of California.

7. Claims Administration

Property, Liability, Auto, and other miscellaneous coverage: a. Ability to effectively and efficiently administer and process claims in

the volume and complexity anticipated by the College as they relate to a higher education environment and in accordance to the coverage required by California Law.

b. Proof of demonstrated experience in claims administration in the anticipated volume and complexity by the College. Provide examples of experience with Community College Districts of similar size.

1) Information, data, customer surveys, or other information relating to the Vendor’s current customer satisfaction in the Property and Casualty Insurance industry.

2) Information relating to Vendor’s intended use of a third-party administrator(s) TPA, if applicable. The Vendor must provide the TPA’s name, history of the relationship, qualifications, and other information for the College to fully evaluate the TPA based upon services requested in this RFP.

3) Actively participate in strategy sessions with College, defense counsel on employer liability issues.

Worker’s Compensation

a. The Administrator will assign dedicated or designated claim examiners to handle the College’s claim files. Other, non-dedicated personnel (e.g. file clerks, data entry clerks, etc.) may be used for administrative functions.

b. Review all initial claims and make telephone contact with injured employee(s) within 24 hours.

c. Send a letter to injured workers within three days of knowledge of

injury informing them of their rights and benefits.

d. Keep member districts informed and involved in all accepted claims prior to sending acceptance letters to employees. Send acceptance letters according to California Labor Law.

e. Furnish copies of all correspondence to the College that is sent to

employees.

f. Provide to College, permanent disability information within 3 days of knowledge, prior to sending that permanent disability information to the employee.

g. Notify College within 3 days, when any previously closed claim is

reopened and provide the rationale for reopening.

h. Work closely and openly with College contact for return to work discussions.

i. Set appropriate reserves and review for adequacy at least every

time file is scheduled for diary review.

j. Actively participate in strategy sessions with College defense counsel on employee worker’s compensation issues.

k. Obtain index bureau reports on all lost time and apportionment

claims.

l. Obtain medical release forms on all claims that are more than 90 days old in nature and treatment.

Return to Work

a. Actively communicate in return to work, collaborate with College contact.

b. Contact the College to discuss all employees who remain on temporary disability for more than two weeks.

8. Claims and Risk Management

a. Discuss your ability and expertise to pro-actively manage new,

existing, and ongoing claims to ensure that required benefits are neither denied nor extended beyond reasonable requirements.

b. Discuss your approach and methodologies for improving claims and risk management in a higher education environment.

c. Describe the steps you would take in reviewing our current

program.

d. Experience and expertise in the management of a return to work program.

e. Casualty. Describe in detail how you will assist the College design

and implement casualty loss control techniques that will reduce loss frequency and severity and ensure compliance with our client’s requirements and various regulatory agencies.

f. Property. Describe in detail how you will assist the district design

and implement property loss control techniques that will reduce the potential for loss.

g. Employment Liability. Describe in detail how you will assist the

College design and implement risk management to reduce the exposure for this liability.

h. Workers’ Compensation. Describe in detail how you will assist

the College to design and implement risk management to reduce the loss for this area of our business.

i. How would you keep us informed of the current developments in the risk management arena?

j. What is your average caseload for your examiners in Property, General Liability, and Workers’ Compensation? How do you monitor those caseloads for quality?

9. References

a. Not compromising any client confidentiality, submit 3

comprehensive examples of similar Community College programs for property and liability and workers compensation you have managed or implemented in similar Community College environments. Of the 3 submissions, 2 must be Community College client’s that have been with your firm 5 years or longer, and 1 must be a newly acquired client within the last two years.

b. Each reference should include the name of the entity, name and title of person responsible for the entity's property and liability program, entity's address, telephone number, and the date services were provided.

c. References indicating a date of service within the past two (2) years

will be given priority rating upon evaluation of the proposal.

d. Provide the names of 3 accounts which your company has lost in the past five years; state reason why the account was lost and provide contact information for the individual who was the signatory and/or prime contact for each account.

i. Provide at least three (3) client references for the service

representative that would be assigned to Mt. SAC.

10. Compensation

Proposals must include the firm's expectation for compensation whether it is an annual fee, commission, or combination of both. Compensation must indicate a maximum cost (fees and/or commissions) for insurance marketing, risk analysis/loss control, claims administration, and other general account handling services proposed. Broker must disclose all fees and commissions earned separate from insurance premiums. If firm also functions as a broker, discuss how any and all conflicts of interest may be avoided. Also discuss any and all current arrangements with public sector clients in

which your firm plays a role as both an independent consultant and broker. Provide any and all sample “Disclosure of Interest” or “Conflict of Interest” disclosure statements which are a part of your current Agreements with Clients. Please outline your fee for managing MPN providers, and other ancillary costs associated with claims administration such as data conversion and system software. Medical cost containment fees such as:

• Medical Bill Review o Flat rate o Specialty bill review

• Nurse Case Management (hourly rate) o Telephonic o Field o Nurse Triage

• Utilization Review o Nurse Review o Physician Review o Appeals Review

• Peer Review (hourly rate) o Physician Intervention Review

11. Insurance

During the term of the services contemplated, service provider/JPA shall maintain the following insurance coverage: Comprehensive General Liability, with a combined single and Professional Liability (Errors & Omissions), each with a combined single limit of $5,000,000 minimum per occurrence. The Comprehensive General Liability policy must name the District as additional insured and contain a primary insurance endorsement naming the District as such. Service provider/JPA must also maintain insurance meeting statutory limits under the Workers’ Compensation Law. Service provider/JPA shall provide District with satisfactory proof of such insurance prior to commencing the work and shall give District at least thirty (30) day notice prior to the cancellation of such policies. Failure to maintain the above-referenced insurance coverage shall be cause for termination.

12. Background Information a. Provide a brief summary of any investigations by regulatory

agencies resulting in any penalty imposed by the agency.

b. Provide a brief summary of criminal filings against the firm and/or its principles in the past ten (10) years.

c. Describe any business relationships, formal or informal, with

insurance companies or underwriting firms contemplated for service of the College account.

13. Period of Agreement

The District values long term relationships and commitment. It is Mt SAC’s intent to join a program that best suits the needs of our overall insurance programs. Please provide your quote for a three year rate guarantee or multi rate guarantee. Our program commitment is for a period of three (3) years with two (2) additional one-year options, at the Districts’ sole discretion.

14. Minimum Requirements

a. If a broker is providing quotations, the broker must have a current

insurance broker license issued by the California Department of Insurance. A copy of license is to be provided with response.

b. Experience working with community colleges for Property, Liability,

and Workers’ Compensation insurance.

c. No prior history of corrective action with the California Department of Insurance.

15. Questions

Questions regarding the services being requested or the contents of this Request for Proposal (RFP) must be submitted in writing on or before February 22, 2018 and directed to the individual listed in Section 2. Answers to written questions will be provided and posted by February 28, 2018. Request for Loss Run History will be sent directly to the respondents requesting it and will not be posted to the website.

16. Proposal Submission Deadline

Proposals must be received in the offices of the College no later than 2:00 pm, March 9, 2018. Faxes or electronically transmitted proposals will not be accepted in lieu of actual receipt. Proposals received after the deadline will be marked “LATE” and may receive no further consideration.

4. SELECTION PROCESS

A. Basis of Award. The College will select the program which provides the most comprehensive coverage(s) and service which will help reduce the College’s overall risk exposures and insurance costs.

The College may elect to make one individual award for both programs or different individual awards for the individual programs or make no award as a result of this solicitation. This request for proposal is in no way an agreement, obligation, or contract.

B. Rejection of Proposals. The College may reject proposals if they are

conditional or incomplete.

C. Negotiation. The District reserves the right to negotiate any aspect of any proposal deemed responsive to this RFP and may request a best and final offer.

D. Confidential Material. Bidder must notify the District of any specific portions

of proposals considered confidential. District will take reasonable efforts to protect the confidentiality of such material but makes no guarantees that such material may be protected. Entire proposals designated as confidential may be rejected.

CLAIMS ADMINISTRATION

(Please attach a separate sheet and answer the following questions in full):

1. Describe the claims administration procedures and program. Please specify if a third party administrator is required or involved.

2. Indicate if your quotation includes the cost of claims administration and, if so, what is the cost (at zero dollar and/or over the deductible)?

3. Comment on the guidelines regarding the selections and use of attorneys and

settlement authority. Include your panel of approved attorneys.

4. Describe your staffing and caseloads for liability and property claims personnel.

5. Describe your staffing and caseloads for your Workers’ Compensation personnel.

6. Provide a resume of the professionals, supervisors, managers and support staff that may handle the District’s claims in an adjusting/examining position. How long have these employees worked for your company? If it becomes necessary to assign a new examiner, will the District be allowed input into the selection?

7. Describe your firm’s philosophy on communicating with the District regarding claims.

What is the update policy on claim status? Will your firm’s representatives meet with member personnel on a regular basis to review open claims? Will your firm provide a written monthly analysis for claims activity and a brief synopsis of what has occurred including loss runs?

8. Describe the run-off costs and procedures if your contract is terminated in the future.

9. Are allocated expenses included in the claims cost and do they erode limits of

liabilities (photocopy service, sub-rosa defense legal service, etc.)?

10. Provide a sample of your firm’s computerized loss experience reports, management summaries, and other detailed reports.

11. Provide any additional information that may be pertinent to claims administration.

FINANCIAL OVERVIEW

1. Include the past three years’ actuarial studies for your proposed program.

2. Include the past three-years’ audited financial reports that clearly outline the net position of the program you are submitting.

3. Provide the past three years reports evidencing member equity, member distribution

and/or assessments by member.

4. Provide copies of all coverage documents (Policies and/or Memorandum of Coverage) including all exclusions and endorsements.

5. Failure to provide this information in your submitted proposal will deem the

respondent non-responsive.
