ROAD REHABILITATION PROJECT
ENVIRONMENTAL MANAGEMENT PLAN (EMP)
A. INTRODUCTION
OVERVIEW
Integral part of each project financed through the Bank is the Environmental Management Plan.Road Rehabilitation Project, which is financed in this cycle, includes civil works on rehabilitationof 12 sections on main and regional roads in Republic of Srpska. Rehabilitation works will beco-financed by the European Bank for Reconstruction and Development (EBRD), the EuropeanInvestment Bank (EIB) and the World Bank (WB), 54 sections in total.
(a)Project description and objectives: Part of this Project concerning civil works inside Republicof Srpska, includes works on rehabilitation of 12 sections on main and regional roads. On somesections, beside rehabilitation, corrections of black spots will be made in order to increase safetylevel of traffic flow.(b)(c)Rehabilitation, in case of roads, means certain group of activities which includes: arrangement ofroad zone, repair of drainage system, shoulder repair, bringing of road surface into high-qualitystate regarding conditions of traffic flow, reparation and installation of new equipment and trafficsignalization.

ENVIRONMENTAL REVIEW
Environmental rationale. The nature of the physical investments is minor civil works consistingpreliminary of repaving existing roads. There is no widening or realignment of any of the roadsections. As a result, the environmental impact are associatedprimarily with the constructionaspects, and are likely to include dust, noise, minor releases of volatile organic chemicals (VOCs)during repaving, traffic disruption materials management and possibly disposal of solid wastes.No signficant environmental issues are related to the operational aspects: since the roadsalready exist, no changes to runoff patterns are likely. All the issues are of limited extend andduration and reversible. They can be mitigated through standard practices of good engineeringand housekeeping.The proposed project does not present any unique or difficult environmrntal issue. There are notlikely to be any other environmental safeguard policies triggered.
Road Directorate needs an official approval of this EMP document issued by the Ministry ofPhisical Planing, Civil Engineering and Ecology.Ministry of Phisical Planing, Civil Engineering and Ecology will issue a letter of “no objection” tothe Road Directorate, based upon the official decission of no impact on natural habitats andcultural properties, issued by the Institute for Protection of Cultural Heritage and ConservationAreas. This “no objection” letter will be a part of this EMP.
Environmental impacts associated with the rehabilitation of 12 sections (205,99 km) of main andregional roads can be readily identified and assessed. Preliminary assessment confirmed thatthe project will not have significant environmental impacts and will bring about some safetybenefits. Any adverse impacts can be efficiently mitigated through project design, planning andwork practices.
Significant environmental impacts. The investigations showed that the most significant impactof the project is the improvement of road safety. The project will improve the safety andappearance of the road surface. The road rehabilitation will also introduce drainage system.
All other impacts are likely to be minor and they can be readily prevented or mitigated.
The key issue during the rehabilitation works is the management of the excavated material,including the old pavement surface. The tender documents will require the road Contractor(s) toprepare a waste disposal plan so as to cater for the safe control and handling of waste, especiallyexcavated material.
Proposed mitigation measures. This Environmental Management Plan (EMP) is prepared inorder to define the environmental measures and procedures that will need to be adopted for thescheme and to identify those responsible for their implementation. The EMP defines the timing,frequency and duration of mitigation measures and integrate these actions within the overallproject work plan. The EMP may need to be revised during the course of the project, oralternatively be prepared when the design of the project is completed and the Contractor(s)’working methods are known and agreed.
The main focus is on the management of excavated material, including the old pavement surface.It is important that run-off from the excavated material will not contaminate streams when it rains.The tender documents will thus include recommended sites for the disposal of excavatedmaterial and suggestions on managing the run-off. The Contractor will be required to state hisunderstanding of the design recommendations, requirements for disposal of excavated material,and his willingness to comply with good environmental practice.
Part of the EMP is an Environmental Monitoring Plan, which sets out a programme for monitoringenvironmental impacts and the implementation of mitigation measures during the constructionphase.
Disclosure of Information and Public Consultation. Environmental information on the projectwill be released and an announcement will be published in a national newspaper. This summary

will be translated in local language and made available for public review near the project sites andat the office of the Road Directorate. The Road Directorate will complete the permitting processand disclosure of information on the project in accordance with the relevant law.Preparation of the Project will include a public consultation process as an element of theenvironmental and social review. This process will allowe the draft EMP to be discussed througha series of meetings with national govemment agencies, local governments and localnongovernmental organizations. In order to fulfill all the requirements the Client, in cooperationwith the relevant Ministry, will undertake a series of public consultation meetings concerning theenvironmental and social aspects of the proposed Project. A brief written summary of the Project,including environmental and social aspects, will be provided to the participants, as well as anexplanation of the structure of the construction process. Minutes of these meetings, as well as alist of invitees and attendees, will be included as an attachment to this EMP. The ProjectImplementation Plan will also contain provisions for periodic consultations with officials andresidents along the road coridors to solicit their views concerning the environmental and socialaspects of the construction process used for road rehabilitation.
Supervision and Reporting. The Client will report to EBRD annually on the measuredenvironmental impacts and on the implementation of the EMP. The Bank will evaluate theproject's compliance with the applicable environmental and social requirements during thelifetime of the project by reviewing these reports. EBRD environmental specialist may conductmonitoring visits to the site when and if deemed appropriate. In addition, independentenvironmental monitoring audits may be carried out.
POTENTIAL IMPACTS
Potential Environmental Impacts - Rehabilitation Phase. The Project will result in significantenvironmental, health and safety improvements along the road sections to be rehabilitated. Theimpact will be neutral given that the current levels of traffic have already been established and theroad improvements are anticipated only to provide for more efficient movement.
It is possible to foresee some of impacts which could appear during works and endanger normalfunctioning of natural processes. Impacts can be grouped according to time and place ofappearance, so following phases are noticeable.
During material supply, negative impact of dust and fumes in construction material productionplants can appear and as a consequence ecosystem disturbance and water quality decrease.Also, care should be taken regarding safety and health of workers at those plants.
Larger quantities of dust, fumes and vehicle exhaust emerge during material transport and slowmovement of loaded vehicles causes road congestion.
Works at construction site have the biggest impact on environment, where increased levels ofnoise, dust and vibrations can be expected, as well as traffic disruption and reduced access toroadside activities. Because of works and irregular conditions on roads, safety of trafficparticipants will be decreased, pollution of water, soil and air can happen, as well as destructionof crops, trees and meadows in the vicinity of site. Site workers will be exposed to certain impactthat can endanger their safety and health.
Other Issues - Protected Areas. The current status of protected areas was reviewed. Thisreview indicated that no present protected areas are located within or adjacent to the proposedProject area.Ministry of Phisical Planing, Civil Engineering and Ecology will issue a letter of “no objection” tothe Road Directorate, based upon the official decission of no impact on natural habitats andcultural properties, issued by the Institute for Protection of Cultural Heritage and ConservationAreas.

Potential Environmental Impacts - Operation Phase. Potential environmental impactsassociated with the operation phase of the Project: The rehabilitated road sections will requireregular maintenance which if deferred will result in immediate deterioration and a return to currentconditions. Efforts will also need to be taken to improve and maintane traffic safety control. Thereis a risk of increase in the number and severity of vehicle collisions as a result of faster driving onthe improved road surface.
MITIGATION MEASURES
Mitigation Measures. The EMP supports specific measures to mitigate potential constructionand operation period impacts and to address road safety issues.
The EMP provides for instructions to be given to the design engineers and constructioncontractors for undertaking specific actions to support implementation of portions of the Plan. TheEMP supports the following:
Reduction of Potential Construction Impacts. Specific measures to reduce potentialconstruction impacts will be taken regarding the detailed design, construction tenders,construction process and contractor performance monitoring. Contracts will contain requirementsfor proper management of construction waste; control measures for waste fuel, oil and lubricants;reduction of noise and dust levels; and rehabilitation of areas used for bypass roads and sitesused construction materials.
Procedures which provide less impact on water and soil will be obeyed, like isolation of washdown areas of equipment, isolation of asphalt work from watercourses, waste disposal only atdefined location, etc. Contractor will also provide alternative access to roadside activities andacquisite land as little as it is possible. Workers will be required to receive safety instruction andwear protective equipment.
Thus, construction contractor has to use existing asphalt plants, stone quarries and borrow pitswith valid license, cover and/or wet materials during transport and storage, use alternative routesfor transport. Local Law on Environment Protection foresees issuing of ecological permissions forexisting asphalt plants.
Specific provisions should be included in construction contracts to mandate the use of formalhealth and safety measures to minimize accidents and avoid fatalities during the constructionprocess.
Construction contractor will provide correct traffic management plan and install appropriatesignalization in order to assure traffic flow with as less impacts as it is possible. Works will betimely limited to period from 7 a.m. to 8 p.m. and equipment will operate with noise mufflers.
(b) Management of Operational Impacts. The Project will address operational impacts throughsupport for a road maintenance period to avoid deterioration of the rehabilitated road andassociated dust and safety problems. Maintenance teams will be required to follow proceduressimilar to those for the construction contractors concerning proper disposal of construction waste,control measures for waste fuel, oil and lubricants and adoption of health and safety measures forpersonnel. It is not anticipated that the road rehabilitation will result in a significant increase intraffic volume, therefore air pollution from vehicle emissions will stay neutral or decrease due touse of improved vehicle standards. Suspended dust caused by vehicles will be reduced by therehabilitation of the road, which will include resurfacing and sealing operations.(c) Road Safety Measures. Most important mitigation action to support improved road safety is
Axle-Load Control. This intervention should reduce the incidence of excessive loads on trucksand help to lower the rate of accidents due to axle and tire failure.
Measures for Design and Construction Contracts. The EMP includes the following mitigationmeasures for detailed design, construction tenders and construction contracts:

(a) Detailed Design. The detailed design process for rehabilitation of roads will includeconsideration for environmental, cultural heritage and sacred sites issues. In locations where theroad will pass close to local communities, measures will be taken for consultation with localauthorities and public representatives to support finalization of designs. In addition, asappropriate the staff of the Consultant will investigate localized design issues that would reduceimpacts to the environment.(b) Construction Tender. All construction contracts will include specific provisions concerningenvironmental, health and safety measures. The Pre-Tender Conference for potentialconstruction contractors will include a briefing concerning their responsibilities to addressenvironmental, health and safety issues. These briefings will outline the specific provisions of theConstruction Tender Documents and Contracts.Pre-Tender Conference. All pre-qualified contractors will be called to a Pre-Tender Conferenceat which issues of special interest or concern will be outlined. With regard to environmental,health and safety issues the Contractors will be briefed on:(i) Environment, Health and Safety. This includes provisions in the contracts regardingrequirements to address environmental, health and safety issues as part of the road rehabilitationworks. These include provisions for the proper management and disposal of waste materials, oil,lubricants and fuel and adoption and use of proper health and safety measures for constructionworkers.(ii) Sensitive Areas. Areas within or immediately adjacent to the construction area which issensitive from an environmental, cultural heritage or sacred sites perspective, if any, will beidentified in the final engineering drawings. Standard conditions requiring special care in thevicinity of the defined sites so as not to disturb them will be issued by the Client.(iii) Procedures for New Borrow Areas and Quarry Sites. The location of new borrow areas andquarry sites selected by the contractor will be reviewed and formally approved by the Client andrelevant Inspection Authorities to prevent environmental values being damaged by quarrying orborrow excavation. Such inspection will not be unreasonably delayed.
MONITORING ACTIVITIES
Monitoring Plan. The Monitoring Plan of the EMP for the Project will be implemented by theClient, and include the measures outlined below. The main responsibility for monitoring activitieswill rest with the Client, with the support of the supervising engineer, who will work together tointegrate environmental, health and safety concerns into the overall planning, implementationand operation of the Project. The Client will monitor application of measures for detailed design,construction tenders and construction contracts. The results of monitoring activities will beincluded as routine elements of reports prepared by the Client, with the assistance of thesupervising engineer. Key activities include:
(a) Reduction of Potential Construction Impacts. The Client, with the support of thesupervising engineer as appropriate, will regularly monitor implementation of the mitigationmeasures adopted for the Project to address construction period impacts for road rehabilitationactivities.(b) Management of OperationaI Impacts. The Client, with the support of the supervisingengineer as appropriate, will regularly monitor implementation of the mitigation measuresadopted for the Project to address operational impacts. These procedures should be continuedafter the close of the Project.(c) Road Safety Measures. Implementation of the various interventions to support road safetywill be the responsibility of the Client and will be included in the routine reporting on Projectprogress.

LABOUR ISSUES
The consulting engineer shall take all reasonable steps to ensure that all national legislation onlabour and health and safety, and any other relevant standards identified by the Bank, arecomplied with in respect of any direct or indirect employees.The consulting engineer shall ensure that all subcontractors are required to comply with allnational legislation on labour and health and safety, and any other relevant standards identifiedby the Bank.The consulting engineer will ensure that systems are in place to monitor compliance with labourand health and safety standards.
ESTIMATED IMPLEMENTATION SCHEDULE
Estimated Implementation Schedule. Most of the proposed EMP mitigation and monitoringactivities will be addressed under provisions of the construction contracts and engineeringsupervision contract. In addition, the Project will include an implementation schedule thatintegrates the activities of the EMP into the overall schedule.
REPORTING AND SUPERVISION
Reporting. As an element of Project reporting requirements, the Client will prepare routinereports concerning progress in implementation of activities related to the EMP. These reportsshould note any contractor non-compliance with the EMP and provide guiding remarks on theactions to be taken. The significance of the non-compliance should also be noted. As necessary,supplemental reports with greater detail than the routine reports also will be prepared on thesetopics.Project Supervision. The Supervision Plan for the proposed Project will include the participationof the Bank environmental staff in supervision missions, as appropriate, to review progress inimplementation of the EMP. The performance of the Client in the implementation of theseactivities under the Project will be a standard element of supervision reports.(d)(e)(f)(g)

D. SCHEDULE
During construction phase of the Project, mitigation and monitoring activities will run parallel tothe physical activities. They will commence at the time when men, equipment and/or materialsare moved to the site and will end after the job is completed and all men, equipment and/ormaterials are removed from the site and the work at particular location is complete. If it isnecessary monitoring activities could be extended to the period after completion of works, suchas monitoring of waste material depository areas.
Terms of Reference for monitoring services (Appendix 1) state out in detail what is going to bemonitored and which specific parameters, where the monitoring will take place, how frequentlyetc. Detailed monitoring plan, including what will be measured, where, type of instruments andtheir accuracy, frequency of measurements etc. will be specified by monitoring contractor aspredicted by the Terms of Reference.
Exact start and end dates of mitigation and monitoring activities can not be stated, as the overallproject schedule charts are not defined. Schedule charts will be adopted after selection ofConstruction Contractor and in accordance with schedule of activities proposed in tenderdocuments.
Mitigation and monitoring activities during operation will run together with maintenance activitiesor when responsible institution decides to check the road environment quality. These activitieswill be planned after completion of rehabilitation works in cooperation with Contractors.

E. INSTITUTIONAL ARRANGEMENTS
Construction Contractor will make proposal for environmental protection, including safety ofpersons associated with the works and also the public, during pre-construction period. Thisproposal will be reviewed by the Republic of Srpska Road Directorate Environmental Unit inorder to obtain the "no objection" to the proposal's recommendations. In this regard attention willbe given to:
- taking all reasonable steps to protect the environment on and off site and avoiding damage ornuisance to persons or to property arising from its operations,
- maintaining conditions of safety for all persons entitled to be on site and
- provision and maintenance of all lights, guards, fencing, warning signs, traffic control andwatching for protection of the works and other property and for the safety and convenience ofthe public.
Construction Contractor will provide monthly reports to the Republic of Srpska Road DirectorateEnvironmental Unit which document the environmental mitigation and protection measurescarried out during that month's reporting period. Same applies to the Monitoring, Supervisionand Maintenance Contractors for their part of mitigating and monitoring activities. If some kind ofaccident or endangerment of environment would happen reporting will be immediate. Agreementwith Traffic Police (Ministry of Internal Affairs) on regular reporting (monthly or quarterly) shouldalso be made.
Monitoring Contractor will be selected after procurement process of monitoring activities duringconstruction and operation phases on sections under project. Monitoring Contractor will monitorenvironment quality (air, water and soil quality, noise levels and equipment supply) throughthose phases and report monthly to the Road Directorate Environmental Unit (Appendix 1).These reports will encompass list and explanation of all undertaken activities at the site andresults of the field research, as well as recommendations for future field activities and protectionmeasures.
The Road Directorate Environmental Unit will prepare quarterly Environmental MonitoringReports for submission to the Project Implementation Directorate of the Road Directorate,according to the received data from all Contractors and Traffic Police. In those reportsEnvironmental Unit will resume information gathered at the field and evaluate effectiveness ofthe mitigation program in the light of monitored parameters. Part of report will concentrate onpossible future mitigation and monitoring activities that could be utilized to assure better qualityof road environment.
The Project Implementation Directorate will prepare and submit an Annual Environmental Reportwhich summarizes the environmental protection measures implemented by the Construction andMaintenance Contractors, problems encountered, actions taken to resolve environmentalproblems and results of environmental monitoring.
The Project Implementation Directorate will have the authority to spend, shutdown or changeoperations according to recommendation of Environmental Unit. This will be the case ifenvironment conditions along road section included in project are not in accordance withenvironmental standards and regulations or if works are not performed according to technicalspecifications and contract requirements related to the environment. This will be proved byMonitoring or Supervision Contractor reports to Environmental Unit.
All expenditures referring to mitigation and monitoring activities will be authorized through theProject Implementation Directorate after checking and confirmation or on recommendation ofEnvironmental Unit.

Ministry of Environment Inspection will have the authority for immediate suspension of works ifperformance is not in accordance with environmental standards and regulations. Inspection willthen inform the Road Directorate Environmental Unit about suspension and order to proceedaccording to its directive.
At present the Republic of Srpska Road Directorate does not have the capability to carry outmonitoring function. Road Directorate will make an agreement with institution capable to performenvironmental monitoring. An in-house Environmental Unit will coordinate the work ofenvironmental monitoring contractors, manage information, make decisions and reports.
Institutional arrangements flow chart is detailed on Fig. 1 with all relations presented ascontrolling and reporting activities.
Before starting work on any road section, a description of the proposed activity would besubmitted to the Ministry of Environment and any municipal environment authorities. Theseenvironmental institutions will define any necessary documentation/actions required by the RoadDirectorate to receive all appropriate licenses, permits, approvals, etc. Road Directorate willassure that all necessary approvals are obtained prior to commencing any work.
During implementation of this Project public has the right to participate either directly or indirectlywhich introduces the possibility to present its interests and opinion in the process of decisionmaking. In order to reach the best option during this process, state should enable for eachindividual to get appropriate knowledge connected with basic relation between nature and humanhealth, activities with harmful influence on nature and importance resulting from it. Public or eachindividual will be allowed to bring legal action at competent court if it considers that its claim forparticipation or information is ignored, groundlessly refused or provided information isinadequate.

TERMS OF REFERENCE
for monitoring services during rehabilitation of roads
BackgroundThe World Bank (the “WB”) has been assisting the Government of Bosnia and Herzegovina withthe development and management of its road network. The road sector is managed by publiccompanies in each of the two Entities: the Road Directorate of the Federation of Bosnia andHerzegovina (“FBHRD”) and Republika Srpska Roads (“RSR”). In each of the Entities, there is aMinistry of Transport and Communications. A State Ministry of Transport and Communications(“MoTC”) has been formed with responsibilities covering the whole transport sector. The Ministryworks on behalf of the State Council of Ministers, and aims to define policies and priorities thatare binding on both Entities, particularly in respect of links to neighbouring countries, andrepresents the State in discussions with other countries.This Project comprises rehabilitation of main and regional roads and procurement of goods andconsultant services in order to establish efficient road management in Republic of Srpska.
The Project will support creation of core environmental capacIties within the road administrationand performance of monitoring activities during works on rehabilitation of roads.The Project Implementation Directorate (PID) in the hierarchy of the RSRD is responsible forimplementation of the Project and for contacts with the Bank. The PID is seeking for themonitoring agency which will perform environmental monitoring.
Objectives of monitoring services
The objective of these monitoring services is to monitor work activities during construction andoperation phases on sections under Project. Monitoring agency will monitor environment quality(air, water and soil quality, noise levels and equipment supply) through those phases and reportmonthly to the Road Directorate Environmental Unit (RDEU). These monitoring activities will becarried out in order to prove that the influence of the works is not severe than permitted.
Scope of the services
Monitoring will be carried out by sampling, measuring and processing of measured data.
Monitoring agency will perform following tasks:
Task I: Monitoring of air quality with mobile laboratory for quick, precise and simultaneousmeasurement of main air pollutant and micrometeorological parameters relevant forevaluation and/or estimation of pollution. Following parameters, at least, should bemeasured: 02, COx, NOx, S02, CxHy, PMp, suspended solids, mercury and flying heavymetal particles. Meteorological station should carry out following measurement: winddirection and velocity, air pressure and temperature, relative humidity and totalradiation.
Task 2: Control of waste water and water with mobile laboratory. Mobile laboratory should be, atleast, equipped with instruments for measurement and analysis of: oils/greases, organicsubstances, ammonia, fluorides, Na+, K+ and N03
+ ions content, pH value, waterconductance and water quality.
Task 3: Monitoring of noise levels with mobile sound level detectors as part of mobile laboratoryequipment.
Task 4: Monitoring of soil pollution with mobile laboratory. Measurement should, at least, include:concentration of heavy metals (lead-Pb, cadmium-Cd, zinc-Zn), oils and organiccompounds and acid conditions.
Task 5: Processing and review of measured data.
In addition to the above mentioned equipment mobile laboratory should be equipped with PC and

necessary software in order to analyze collected data immediately at the field.
Measurement will be carried out at least once per week during construction and operation phases
and on complain.
Specified parameters will be measured at several locations along and in the vicinity of roadsections under consideration as well as at depository sites, which will be agreed throughMonitoring Plan submitted by monitoring agency.
Project schedule
The Project should start by the middle of 2008 and be completed by the end of 2011.
The bulk of monitoring activities will be during construction phase of the Project in order to assureprotection of environment and performance of works according to laws and regulations.Monitoring activities will run parallel to the physical activities according to the schedule charts ofworks for each section under consideration. They will commence at the time when men,equipment and/or materials are moved to the site and will end after the job is completed and allmen, equipment and/or materials are removed from the site and the work at particular location iscomplete.
During operation phase of the Project monitoring activities will consist of intermittent inputs whichwill provide data on environment quality along road sections under consideration. Monitoringactivities during operation will run together with maintenance activities. These activities will beplanned after completion of rehabilitation works.
Implementation agreements
The PID will be responsible for the implementation of this Project and the assignment will bemanaged and monitored by the RDEU.
The PID will make available all existing documents and studies related to the Project formonitoring agency.
Monitoring agency will be responsible for support of its team during the services. Monitoringagency will pay local transport, services and stationary. The PID will assist monitoring agency infinding competent bilingual (Serbian-English) secretarial assistance, but monitoring agency willbe responsible for payment of such assistance.
Deliverables
Monitoring agency will be required to satisfy following reporting requirements for each sectionunder consideration:
Monitoring Plan (to be agreed by the RDEU) which should follow part C of EnvironmentalManagement Plan and include:
(i) proposed program of work,
(ii) what parameters will be measured,
(iii) where parameters will be measured,
(iv) type of instruments to be used and their accuracy,
(v) frequency of measurement and
(vi) key personnel to perform monitoring.
Monitoring Plan will be submitted in three copies in Serbian and one copy in English to the RDEU.
The RDEU will agree/disagree with this report within two weeks. In the case of non-approval
monitoring agency will submit corrected Monitoring Plan within two weeks.

Progress and Final Report(s) which should include:
(i) description of the work carried out during reporting period,
(ii) summary of the relevant measured data,
(iii) recommendations for mitigation measures,
(iv) key personnel changes in the staff of monitoring agency,
(v) matters which may affect the service cost,
(vi) identification of any unresolved issues with recommended actions to resolve them and
(vii) a brief description of the work to be carried out during next period.
Progress Reports will be submitted every month during construction phase of the works andevery three months during operation phase. If some kind of accident or endangerment ofenvironment would happen reporting will be immediate.
Draft Final Report will be submitted within one month after the Project completion. The RDEU willsubmit its comments about the Final Report within one month. The final version will be submittedwithin two weeks after receipt of the RDEU's comments.
Monitoring agency will submit three copies of each Progress Report and of the draft version of theFinal Report in Serbian and one copy in English to the RDEU.
Five copies of the final version of the Final Report will be submitted in Serbian and three copies inEnglish to the RDEU.
