AN ACT PROVIDING FOR REACQUISITION OF PHILIPPINE CITIZENSHIP BY PERSONS

WHO LOST SUCH CITIZENSHIP BY RENDERING SERVICE TO, OR ACCEPTING COMMISSION IN, THE ARMED FORCES OF

AN ALLIED FOREIGN COUNTRY, AND TAKING AN OATH OF ALLEGIANCE

INCIDENT THERETO

1. One must be a citizen of the Philippines on December eight, nineteen hundred forty-one,2. There must be loss of Philippine citizenship,3. There is loss by reason of the loss is:

a. rendering service to, orb. accepting commission in, the armed forces of an

allied foreign country, and taking an oath of allegiance incident thereto,4. He or she must take an oath of allegiance to the Republic of the Philippines5. Register the same with the Local Civil Registry in the place where he resides or last resided in the Philippines within one year from the date of the approval of this Act (June 20, 1953); and6. The said oath of allegiance shall contain, in addition, a renunciation of any other citizenship

AN ACT GRANTING PERMANENT RESIDENT STATUS, OTHER RIGHTS

AND PRIVILEGES TO FILIPINO VETERANS OF WORLD WAR II WHO ACQUIRED AMERICAN CITIZENSHIP

UNDER THE UNITED STATES IMMIGRATION ACT OF 1990, AND

FOR OTHER PURPOSES

REPUBLIC ACT NO. 7837

1. Any Filipino veteran of World War II;2. who acquired American citizenship;3. pursuant to the United States Immigration Act of 1990

QUALIFICATIONS

1. Filipino veterans,2. their spouses and3. their legitimate, natural, recognized illegitimate, and unmarried childrenwho are American citizens and residing in foreign lands.

Those who did not leave the Philippines and acquired American citizenship in the United States Embassy may likewise apply for permanent resident status with the Bureau of Immigration and Deportation.

WHO CAN AVAIL

Those who did not leave the Philippines and acquired American citizenship in the United States Embassy may likewise apply for permanent resident status with the Bureau of Immigration and Deportation.

Filipino veterans and their family members, upon filing their application for permanent residence, shall:

1. present their American passports and2. their birth or baptismal certificates, or any other documents that will prove that they were former Filipino citizensAll other requirements are waived.

REQUIREMENTS

I. Limited Property RightsA. continue to hold and retain

all the lands they have acquired before becoming American citizens

B. If none, acquire one (1) residential lot of not more than one thousand square meters and/or farm lot of not more than three hectares

Q. WHO IS A BALIKBAYAN?A. A balikbayan is:

1. a Filipino citizen who has been continuously out of the Philippines for a period of at least one (1) year,

2. a Filipino overseas worker

R.A. 6768 AN ACT INSTITUTING A BALIKBAYAN

PROGRAM

3. a former Filipino citizen and his family, as this term is defined hereunder, who had been naturalized in a foreign country and comes or returns to the Philippines.“Family" shall mean the spouse and the children of the balikbayan who are not balikbayan in their own right traveling with the latter to the Philippines

“Family" shall mean:1. the spouse and2. the children of the balikbayan

1. tax – free maximum purchase of US$ 1,000.00 or equivalent currency (those of age);

2. special promotion incentive program by the national flag carrier;

3. visa free entry to the Philippines for one (1) year

BENEFITS AND PRIVILEGES

4. travel tax exempted;

5. expeditious processing of documents in especially designated reception areas

1. purchases in US dollars or other acceptable currencies;

2. made within 48 hours from arrival;

3. privilege non – transferable;

LIMITATIONS ON PRIVILEGES

4. availed of once a year

5. a minor is entitled to a US$ 250 purchase tax free; and

6. one item of non consummable where price exceeds US$ 200

Any person who shall willfully:A. derive,B. obtain,C. receive orD. enjoy or cause another to

derive, obtain, receive or enjoy the benefits and privileges under this Act without being entitled thereto.

ACTS PUNISHABLE

1. Fine of not less than Twenty thousand pesos (P20,000.00) but not more than Forty thousand pesos (P40,000.00) or

2. Imprisonment of not less than two (2) years or more than four (4) years, or

PENALTY

3. Both at the discretion of the court

4. Summary deportation upon service of sentence and be forever barred.

COMMONWEALTH ACT No. 473AN ACT TO PROVIDE FOR THE

ACQUISITION OF PHILIPPINE CITIZENSHIP BY NATURALIZATION, AND TO REPEAL ACTS NUMBERED

TWENTY-NINE HUNDRED AND TWENTY-SEVEN AND THIRTY-FOUR

HUNDRED AND FORTY-EIGHT.

First. He must be not less than twenty-one years of age on the day of the hearing of the petition;

Second. He must have resided in the Philippines for a continuous period of not less than ten years

QUALIFICATIONS

Third. Good moral character, believes principles underlynig Philippine Constitution, and conduct irreproacable to government and communityFourth. Owner of real estate (at least P5,000.00) or engaged in lucrative trade, business, profession

Fifth. Able to speak and write English or Spanish or any of the principal Philippine languages;

Sixth. Enrolled children in public or private school recognized by the government

1. honorable held office under the government;

2. established a new industry or useful invention in the Philippines;

3. married to a Filipina;

SPECIAL QUALIFICATIONS

4. Engaged as a teacher in a school that does not cater exclusively to a certain nationality for a period not less than 2 years;

1. Opposes organized government;

2. Defends or teaches violence, assault, or assassination;

3. Polygamist;

4. Convicted of a crime involving moral turpitude

DISQUALIFICATIONS

5. Suffering from mental alienation or incurable contagious disease;

6. Have not mingled socially with Filipinos nor evinced the desire to learn Filipino customs and traditions

6. Citizens or subjects of a country with whom the US or the Philippines is at war during said war

1. under oath;2. sets forth name, age, occupation,

personal description, place of birth, last foreign residence and allegiance, the date of arrival, the name of the vessel or aircraft, if any, in which he came to the Philippines, and the place of residence in the Philippines at the time of making the declaration, and the enrollment requirement of his children

Persons born in the Philippines and have received their primary and secondary education in public schools or those recognized by the Government and not limited to any race or nationality, and those who have resided continuously in the Philippines for a period of thirty years or more before filing their application
