The IllinoisChapter Ie by Mr. Rivadeneria has been recognized by theNational HA since on or about 2007.

However, th faction represented by Steve Orlando is again tryingto confuse t e RNHA membership by using a letter dated July 16,2012, signed by Ms. Maldonado stating in effect that theRivadeneira Illinois RNHA charter was revoked and that she isrecognizing he Steve Orlando group. The July 16th letter isentirely ille timate and done without regard to RNHAConstitutio and Bylaws. The dispute to resolve which group wasofficially sa ctioned by National RNHA, although scheduled, nevertook place. y attempt to decertify the Illinois Chapter isimproper be ause there has never been any proceeding with notice

The purpoped national RNHA Chairman Alci Maldonado is fromFlorida. It;008 she was elected chairman at a national conventionheld in Vir inia. After her initial election she he has not beenre-elected 0 the position at a constitutionally sanctionedconvention

From the t me Ms. Maldonado was elected in 2008, she has notheld any HA national executive committee meetings, althoughseveral of t e RNHA state chapters demanded that meetings beheld as req ired by the RNHA National Constitution and bylaws.

On Labor ay weekend 2011 Ms. Maldonado held a conventionwhich did ot comply with the RNHA constitution and bylawswhich was nconstitutional because of the following violations ofthe RNHA onstitution and bylaws:

1. Rule N . 34 of the bylaws required the call for the NationalConve tion on or before March 1, 2011. Ms. Maldonado sentnotice t selected chapters two weeks before the NationalConve ion held this September 2011.

2. Ms. M ldonado did not send notice of the call to convention toduly co stituted RNHA State Chapters who did not supporther ree ction as Chair. Those chapters were neither notifiednor inv ted to the National Convention even though thesechapter are and were in good standing. This includes theCalifor ia, Illinois, Michigan, Arizona, New York, andMinnes ta.

3. Rule N . 17 (1) of the bylaws require the formation of aCreden .als & Membership Committee "composed of twomembe s of the RNHA National Committee from each of thefour regions, specifically Northeast, Midwest, Westernand So hern States.

4. The Cr dentials and Membership Committee is elected bymembe s ofthe RNHA National Committee from the four (4)regions 'to review the credentials of delegates to the NationalConven ion." Ms. Maldonado did not form such a CredentialsCommi ee to verify how many delegates each State Chaptershould ave. There was a lack of transparency for the actionsof Ms. aldonado in holding the convention.

On March 9,2011, April 8, 2011, April 27, 2011, because of Ms.Maldonad 's utter disregard for the RNHA rules and regulations,Constituti n and bylaws many of the RNHA State Chapters andregional re resentatives called on her to hold an RNHA NationalCommittee Meeting. A copy of the request dated April 27, 2011 isattached h reto as Attachment Number One. She ignored all therequests.

On Novem er 1, 2011 various State Chapters and Regional Chairsrebuked M . Maldonado for her failures to follow the RNHAconstitutio~and bylaws. These chapters and regional chairs do notrecognize s. Maldonado as the national RNHA Chairman. Anyactions tak· n by her in the name of the National RNHA afterSeptember rd and 4th 2011 are held by the Chapters that signedthe docum ts cited in Attachment One and Two to be illegitimateand outsid the requirements of the RNHA constitution andbylaws. Se the complete statement and emails which is attachedas Attachm nt Number Two.

The belate attempt by Steve Orlando to have the Courts of Illinoisissue a rest aining order against the Illinois RNHA Chapterconvention hich was long ago scheduled for Saturday January26th should e summarily denied.

According t RULE No. 14 d) of the Rules of the Republican NationalHispanic A sembly Adopted June 21,2007, "Upon written petition oftwenty-five (25%) or more members ofthe RNHANC, representing nofewer than enty-five (25%) of the states represented in theRNHANC, iled jointly or severally with the Secretary, requesting ameeting to t e RNHANC, it shall be the duty of the Chairman, with ten(10) days fr m receipt of said petition, to issue a call for a meeting ofthe RN C", "to be not later than twenty (20) days or earlier thanten (10) day from the date of the calL"

For the review of the members of the RNHA NC, attached are theinstructions hat were sent by the Republican National HispanicAssembly E ecutive Committee including Mr. Robert Bunn, the Chairof the RN Legal Team, to the RNHA of Illinois on February 26,2011.

In the instruftions, the RNHA EC and Mr. Bunn recognized the RNHAIL organizat~ n and RNHA IL Executive Committee which was electedat the Comf rt Inn in Dixon, IL on February 5, 2011. Furthermore, theRNHA EC d Mr. Bunn stated they "will not disturb such findingsabsent a ShOr' g of an abuse of discretion or other legally compellingreason."

The RNHA C and Mr. Bunn, then outlined a process for the minorityfaction of th RNHA IL to file an appeal with the RNHA EC if theychose to do o. Despite the minority faction of the RNHA IL notfollowing th instructions outlined by the RNHA EC and Mr. Bunn

when sub itting their appeal/complaint to the RNHA EC, therecognized IL Executive Committee submitted their rebuttalaccording t the instructions outlined by the RNHA EC and Mr. Bunn.

The instruc ions sent by the RNHA EC and Mr. Bunn then called forthe RNHA C to "set a private teleconference which will serve as ahearing", however, that is where this process has stalled. NoteleCOnfere!ce has been set since the submission of the rebuttal.

Madam Ch irman, it has now been more than 6 weeks since the RNHAIL Executi Committee sent the RNHA EC their rebuttal to theappeal/com laint filed with the National RNHA against our honorableorganizatio ,the RNHA of Illinois.

Furthermor ,it has now been 3 weeks since Mr. Bunn sent the attachedmemo that ays the "Legal Team has taken over the RNHA of Illinoiscase" and w have still not heard from him on this pending matter.

Finally, it is important to note that the final and ultimate authority ofthis matter lfes with the RNHA NC per the Rules of the RepublicanNational HiipaniC Assembly Adopted June 21,2007.

According t, RULE No.3 ofthe Rules of the Republican NationalHispanic As embly Adopted June 21, 2007, "Jurisdiction ...AlI StateChapters sh 11be autonomous, however, the RNHA NationalCommittee ~hereinafter referred to as the "RNHANC") shall have thefmal authori~ to certify or de-certify State Chapters, or anysubdivision I~ereof."

According t~RULE No.7 of the Rules of the Republican NationalHispanic As embly Adopted June 21, 2007, "...The RNHANC shall bethe ultimate uthority of the RNHA, and will be the last recourse inresolving an and all elections or certification disputes."

ATTAC ENTNUMBER TWO

On Novem I er 1, 2011 the undersigned representatives of the variousregions and state chapters stated the following rebuking the actions andfailures of s. Maldonado in failing to follow the RNHA constitutionand bylaws:

We, the Na ional Committee of the RNHA, strongly reject the illegalleadership Alci Maldonado.

Ms. A1ci Mfldonado hosted an illegal National Convention of theRNHA this past Labor Day weekend, which violated several bylawsand therefore we, the RNHA National Committee, don't recognize AIciMaldonado' leadership and her illegal re-election as president of theRNHA.

This self-Se~ing disregard for the rule of law is a Dictatorship thatknows no e d and cannot continue to be overlooked. We must pushforward and demand answers. Only transparency can end thiscorruption tiat is replete with negative consequences. Let it not be saidthat we faile to act.
