CHAPTER 2 REPORTS OF PIO’s AND ANALYSIS The Annual Report focuses essentially on status of implementation of the Act by Public Authorities in accordance u/s 25(2) of the Act. The data received from Public Authorities regarding RTI applications for 2013 have been compiled by this commission to be reported in the Annual Report of 2014 of the GSIC. On the whole 50% of the Public Authorities in the category of Departments, Semi-Govt/Autonomous/Colleges and Institutes have submitted their annual returns as stipulated u/s 25(2) of the RTI Act during the reporting year 2014. This commission in the present report has therefore, analysed performance of only 50 Public Authorities Department wise, 14 in Semi Govt/Autonomous bodies while 21 at College/Institution level who have submitted Annual Returns. REPORTS OF PIO’s AND ANALYSIS

The Annual Report focuses essentially on status of implementation of

the Act by Public Authorities in accordance u/s 25(2) of the Act.

The data received from Public Authorities regarding RTI applications

for 2013 have been compiled by this commission to be reported in the

Annual Report of 2014 of the GSIC.

On the whole 50% of the Public Authorities in the category of

Departments, Semi-Govt/Autonomous/Colleges and Institutes have

submitted their annual returns as stipulated u/s 25(2) of the RTI Act during

the reporting year 2014.

This commission in the present report has therefore, analysed

performance of only 50 Public Authorities Department wise, 14 in Semi

Govt/Autonomous bodies while 21 at College/Institution level who have

submitted Annual Returns.

The total number of RTI Applications received by these PIO‟s

is11,544. While the no. of request disposed by Public Authority is

10994.Thus 550 cases either rejected information or kept pending.

Each and every department shows an increase in number of

application every year and PIOs areworking hard to dispose them within the

time limit. This shows that citizens are aware of their Rights about RTI Act

and use it to get maximum benefit of the Act.

However, the 1st and 2

nd appeals from the RTI applicants may also

continue to increase unless practices relating to record management,

Proactive disclosure and effective dissemination of information on the

website are put in place. The Heads of Departments who are also the Public

Authorities have to note that fulfilling their obligation under section 4 of

RTI Act greatly reduces the work of PIO/FAA and the Commission.

It is also evident that most of the PIOs are providing required

information within prescribed time limit. Some of the PIO‟s are required to

put more efforts, in the disposal of the application but generally speaking the

request for information received and provided during the year 2013 has been

quite satisfactory.

The Act contains a provision for filling first appeal with the

designated Appellate Authority of the concerned Department so that

applicants can get the desired information by approaching Head of

Departments. Almost all public authorities have been designated as appellate

authorities under the Act.

GSIC has observed that, there areDepartments, which have adhered to

the “Guidelines” for the submission of the Report.There are several

Departments, who have not taken their Annual Report writing seriously.

They did not submit their „Annual Returns‟ for the reporting year 2013.

Some of them have submitted their Annual Returns after issue of Reminder

I, II, III (table no. 2.6). The Hon‟ble CIC has called the Public Authorities

for the meetingon 9th and 12

th December 2014,to impress upon the need of

timely submission of report. Public Authorities should make more effort for

implementation of RTI Act, 2005 especially in regard to Sec. 4 of the RTI

Act.

It is also possible that some Public Authorities/Autonomous

bodies/Colleges/Institutions who have not received any application under

RTI Act in a reporting year do not realize the necessity of filing report. It

needs to be clearly emphasized that even „nil‟ status has to be reported to

ascertain the number of registered Public Authorities submitting their

Annual Returns.

It is observed that increased effort are needed on the part of Public

Authorities to ensure compliance of order by the CIC & SIC on the various

appeals from time to time. Thus, and the compliance of FAA order, will

reduce the number of penalty cases.

RTI is a excellent tool to promote transparency & accountability in

the working of every Public Authority. Let us take this opportunity and do

the best.
