Thls Code ~dent~f~es and uses specific standards and codes published by the National Fire Protect}on Association and sets those requirements necessary for the administration of th~s Code

1 3 3 1 Whenever this Code requires a particular system condition arrangement mater~al equipment or any other particular prows~on the Fire Marshal may accept alternatives provided that such alternatives shall afford a substant}ally equwalent level of safety

1 3 3 2 Appl~cat~on for Alternatives Each app1~cat~on for an alternatlve shall be f~led w~th the F~re Marshal and shall be accompanied by such evidence letters statements results of tests or other supporting ~nformat~on as may be required to jus t i fy the request The F~re Marshal shall keep a record of his actions on such applications and a s~gned copy of h]s decision shall be prowded for the applicant

1 3 4 1 To the fu l l extent permitted by law any f~re of f ic ia l engaged ~n f i re prevention and ~nspect~on work ~s authorized at all reasonable tlmes to enter and examine any building structure marine vessel vehicle or premises for the purpose of making f~re safety ~nspectlons Before entering a prwate building or dwelhng the f~re of f ic ia l shall obtain the consent of the occupant thereof or obtaln a court warrant author~zlng hls entry for the purpose of ~nspect~on except ~n those ~nstances where an emergency exists As used ~n this section Emergency means c~rcumstances which the f l re of f ic ia l knows or has reason to believe exist and which reasonably may constitute immediate danger to l~fe and property

1 3 5 Authority to Investigate Fires and Exploslons The Fire Marshal shall have the authority to investigate the cause origin and circumstances of any f l re or explosion lnvolvlng a loss of l i fe inJurles to persons or destructlon or damage to property When in the opinlon of the Fire Marshal reasonable cause exlsts that the f i re or explosion may have been of incendiary origin the Fire Marshal shall have the authority to take custody of all physical evldence relatlng to the cause of the f ire or exploslon and to continue the lnvestlgatlon to concluslon Proprietary informatlon which may relate to trade secrets or processes shall not be made part of the public record except as may be directed by a court of law

i-4 1Responslbillty for Code Enforcement

I-4 1 1Admlnlstratlon and Enforcement The Fire Marshal shall be responsible for the admlnlstratlon and enforcement of this Code to insure compllance therewith

1-4 1 2 Issuance of Code Related Documents The Fire Marshal shall be responslble for the issuance of permits certlflcates notices and approvals or orders pertaining to f l re control and f i re hazards as prowded for in this Code

1-4 1 3 Assistants to Fire Marshal Quallflcatlons of the personnel assigned to assist the Fire Marshal in carrying out the inspection and enforcement procedures requlred by thls Code shall be establlshed on the basis of merit by reason of education experlence technlcal competence or examlnatlon

1-4 I 4 Members of the Fire Department may be requlred to carry out inspection functlons to accompllsh the duties Imposed by thls Code

1-4 2 Hazard Abatement Procedures

1-4 2 1 Summary Abatement The Fire Marshal shall have the authority to summarily abate any condition which is In vlolatlon of any provlslon of this Code and which presents immedlate f i re hazard to l l fe or property

I-4 2 2 Wrltten Notlce Except as provided in i-4 2 1 of thls Code whenever the F1re Marshal shall find vlolatlons of this Code he shall issue a wr i t ten notice to conflrm such findings

.Every notice shall set for th a tlme l lm l t for compllance Such tlme l lm l t shall be correlated to the degree of hazard created by the v lo la t lon and a v a i l a b i l l t y of means of abatement

i-4 2 3 Exlstlng Condltlon Correction Notlce The Fire Marshal shall Issue a wr i t ten notlce whenever he flnds that a certain provlsion of th ls Code shall be applled to exlst ing conditions under the author i ty of 1 2 1 of th ls Code

1-4 3 Servlng of Notlces Any order or notlce issued pursuant to th ls Code shall be served upon the owner operator occupant or other person responsible for the condltlon or v lo la t lon ei ther by personal servlce mall or by del lver lng the same to and leaving i t wlth some person of responslb111ty upon the premises For unattended or abandoned locations a copy of such order or notice shall be posted on the premises in a conspicuous place at or near the entrance to such premises and the order or notlce shall be mailed by reglstered or certlf led mall w~th return receipt requested to the last known address of the owner occupant or both

I-4 4 Revocation Suspenslon or Denial of Permits Approvals or Certiflcates The Fire Marshal shall have the authority to revoke suspend or deny the granting of any permit approval or certif icate required by thlS Code for noncompliance wlth the provlsions of such a permit approval certif icate or fallure to meet the provlslons of this Code for the issuance of such permit certif icate or approval

I-4 5 Records Required The Fire Marshal shall keep a record of all f l re prevention Inspections Including the date of such inspections and a summary of any vlolatlons found to exist the date of the services of notices and a memorandum of the flnal dlSposltlon of ~ll vlolatlons

All records required to be kept by this section shall be malntalned untll thelr usefulness has been served or as otherwise may be required

1 5 i Appointment A Board of Appeals shall be appointed conslsting of members who by education and experlence are qualified to pass upon the application of this Code as i t affects the interests of the general public Board members shall not be officers agents or employees of this jurisdlctlon All members and any alternate members shall be appointed and serve in accordance wlth the terms and conditions of the authority having jurlsdlction ~he Board shall establlsh rules and regulatlons for conducting its business and shall render all declsions and findings in writing to the Fire Marshal with a copy to the appellant

No more than one of said members or their alternates shall be engaged in the same buslness profession or llne of endeavor No member of the Board of Appeals shall sit in judgement on any case in which he personally is directly interested

i 1 5 2 Purpose The Board of Appeals shall provlde for reasonable interpretation of the provlslons of this Code and rule on appeals from declslons of the Fire harshal

1 5 3 Duties The Board of Appeals shall meet whenever dlrected by the appointing authority for the purpose of Interpretlng the provlslons of thls Code and to consider and rule on any properly f i led appeal from a declslon of the Flre Marshal giving at least f ive days notice of hearing but in no case shall i t fa l l to meet on an appeal within 30 days of the f l l lng of notlce of appeal All of the meetings of the Board shall be open to the publlc

1 5 4 Fire Marshal Order Stayed Pending flnJl declslon of the Board of Appeals the order of the Fire Marshal shall be stayed unless there Is an immediate f i re hazard to l l fe or property

1 6 Vlolatlons

1 6 1 General Any person who fal ls to comply with the provlslons of this Code or who fal ls to carry out an order made pursuant of thls Code or violates any condltlon attached to a permit approval or certlf icate shall be subject to the penalties establlshed by thls JUrlSdlCtlon (See Appendlx D i b i )

1 7 Permlts (See Appendlx D 1 7 ) i

1 7 1 General

1 7 1 1A permit shall be predicated upon compliance with the requlrements of this Code and shall constitute written authority issued by the Fire Marshal to malntaln store use or handle materials or to conduct processes which could produce unless controlled condltlons hazardous to l i fe or property or to install equipment used in connection with such actlvlt les Any permit issued under this Code shall not take the place of any other license or permit required by other codes or laws of this 3urlsdlctlon (See 1 2 4 2 )

1 7 1 2 A permit issued under this Code shall continue until revoked or for the period of tlme designated thereln at the tlme of the Issuance of the permit The permit shall be issued to one person or business only and for the location or purpose descrlbeo in the permit Any change which affects any of the conditions of the permit shall require a new or modlfled permit (See Appendix D 1 7 1 2 )

1 7 1 3 The Fire Marshal may grant an extension of the permlt time perlod upon presentation by the permlttee of a satisfactory reason for failure to start or complete the work or act lwty authorlzed by the permlt wlthln the required tlme period of the permit

1 7 2 Permlt Requlred In accordance wlth the detailed requlrements of thls jurlsdlctlon a permit shall be obtalned to conduct the following operatlons or to store handle or use those hazardous materlals whlch are consldered to present an extra or unusual f l re hazard to l i fe or property (See Appendix D 1 7 2 )

Bonflres and Outdoor Rubbish Fires Combustible Dust Producing Operations Compressed and Llquefled Gases Explosive Materlals Flammable and Combustlble Llqulds Flammable Flnlshlng Fireworks Pyroxylin Plastlcs (Cellulose Nitrate) Weldlng Cutting and Other Hot Work

1 7 2 3 Temporary Permit When a temporary hazardous sltuatlon is antlclpated for condltlons not otherwise regulatea by this Code the Fire Marshal is authorized based on applicable data to issue a temporary special permit for the duratlon of the hazard

1 7 2 4 Consolidated Permt Only one permit shall be requlred for each location of a flrm which may be required to obtaln more than one permit under permit requlrements Such consolldated permit shall l i s t all hazardous materials or operations covered by the permit Revocation of any port~on or portions of such consolidated permit for spec~flc hazardous materials or operations shall not ~nvalidate any remaining portlon of the permit (See Appendix D 1 7 2 4 )

1 7 3 Processing and Use of Permits

1 7 3 I Application for Permit Apphcat~ons for permts shall be made to the Fire Marshal on forms prowded by the Jurisdiction and shall include the appllcant s answers ~n ful l to inquiries set forth on such forms Appl~catlons for permits shall be accompanied by such data as may be required by the Fire Marshal and fees as may be requlred by the jurlsd~ctlon (See Appendix D 1 7 3 1 )

i 7 3 2 Rewew and Issuance The Fire Marshal shalI review all applications submitted determine compliance wlth applicable provisions of the Code and ~ssue permits as requlred I f an application for a permlt ~s rejected by the F~re Marshal he shall advise the applicant of the reasons for such rejection Permits for act~wties requiring evidence of f~nanclal responsibility by the jurisdiction shall not be issued unless proof of required flnanc~al respons~b]hty is furnished

1 7 3 3 D~splay of Permits A copy of the permit shall be posted or otherwlse readily accessible at each place of operation or carried by the permit holder as specified by the Fire Marshal

1 7 3 4 Authority to Require Exposure or Stop Work Whenever any ~nstallation that ~s subject to inspection prior to use ~s covered or concealed w~thout having f i r s t been inspected the Fire Marshal may require by written notlce that such work be exposed for inspectlon The F~re Marshal shall be notified when the installation ~s ready for ~nspect~on and the F~re Marshal shall conduct the Inspect~on wlth]n a reasonable period of t~me

When any construction or installation work ]s being performed In violation of the plans and specifications as approved by the Fire Marshal a written notice shall be ~ssued to the responslble party to stop work on that port~on of the work which Is ~n wolatlon The notlce shall state the nature of the v~olat]on and no work shall be continued on that portion until the wolatlon has been corrected

I 7 3 5 Comphance Required Any act lv l ty authorized by any permit ~ssued under th~s Code shall be conducted by the perm~ttee hls agents or employees ]n compliance w}th al] requlrements of th~s Code apphcable thereto and ]n accordance w~th the approved plans and spec~flcat]ons No permit ~ssued under this Code shall be ~nterpreted to jus t i fy a wolat~on of any provision of th~s Code or any other applicable law or regulation Any addlt~on or alteration of act~vlt~es conducted under a permit ~ssued under thls Code or any addlt]on or alteration of approved plans or specif~catlons shall be approved ~n advance by the F~re Marshal as evidenced by the Issuance of a new or amended permit

i 7 3 6 Permit Contents Permits shall be ~ssued by the Fire Marshal and shall bear h~s name and s~gnature or that of h~s designated representatwe In addition the permit sh~ll show

(a) Operation or activit ies for which the permit Is ~ssued

(b) Address or location where the operat}on or act~wty ]s to be conducted

\ (c) Name and address of the perm~ttee

(d) Permit number and date of ~ssuance

(e) Period of vahd~ty of the permit (See Appendix D 1 7 1 2)

(f) Inspection requlrements

1 8 Approvals

1 8 1 General The Fire Marshal shall examine the submitted plans for evidence of compliance with th~s Code The F~re MarshaI may requlre tests or other investlgatlons to be conducted by an agency satisfactory to the jur~sd]ctlon when an appliance device equipment or systems ~ntended for ]nstallatlon does not specifically meet the requirements of thls Code but meets the Intent of th~s code Such tests or Investigations shall be based on nationally accepted test standards or prlnc~ples (See Appendix D 1 8 1 )

1 8 2 Buildings and structures shall not be occupied prlor to being approved by the F~re Marshal that app1~cable provisions of thls Code have been met

1 8 3 Records A record of examinations approvaIs and exceptions granted shall be maintained ~n the Offlce of the Fire Marshal and shall be available to all persons for pubhc inspection durlng business hours

1 9 Certlf~cates of F~tness When certificates of f~tness are required by th~s jur~sdlctlon for performance of actw~tles related to f~re safety the F~re Marshal shall be responsible for their ~ssuance (See Appendix D 1 9 )

3 1 1 10 Required Access for F~re Apparatus All premises which the F~re Department may be called upon to protect ~n case of f~re and which are not readily accesslble from public roads shall be provided wlth suitable gates access roads and f~re lanes so that al l buildings on the premises are accesslble to f~re apparatus

3 6 2 1 Electrical Installation Class~flcatlon Areas which require hazardous location electrical classlflcat~on shall meet the requirements of appllcable NFPA standards and codes listed in Annex A of th~s Code (See Appendix D 3 6 2 1 )

3 6 2 2 Open Containers Proh]blted The transporting of flammable IIqulds In open containers is prohibited unless otherwise permitted by an applicable NFPA code or standard as listed In Annex A of th~s Code

3 6 2 3 Empty Containers Empty containers which previously contained Class I flammable liquids shall be kept t ight ly covered or properly vented when not ~n use or until rendered vapor free

3 6 2 4 Underground Leakage of Flammable and Combustible Liqu}ds When the potential of f l re or explosion due to the underground leakage of flammable or combustlble l~qu~ds exists the Fire Marshal shall requlre proper action (NFPA 329 Recommended Practice on Underground Leakage of Flammable and Combustible L~qu~ds provides guidance) to assure l i fe safety and protection of property

3 6 3 Roofing Kettles

3 6 3 1 Applicability This section shall apply to portable equipment either with or without wheels used for heatlng tar pitch asphalt or other s~mllar substances for application on roofs streets floors p~pes or other objects

3 6 3 2 Construction The materials and methods of construction of roofing kettles shall be acceptable to the Fire Marshal The following are minimum requirements

(a) This section shall apply to all roofing kettles or tar pots In excess of one gallon (3 785 L) capacity

(b) No roofing kettle shall have a capacity ~n excess of f lve barrels

(c) Roofing kettles of two barrel capacity or less shall be constructed of steel sheet having a thlckness of not less than 0 105 in (No 12 Manufacturers Standard Gage) and kettles of more than two barrel capacity shall be constructed of steel sheet having a thickness of not less than 0 135 ~n (No 10 Manufacturers Standard Gage)

All supports corners the top and bottom of the f i re box shall be bound w~th angle iron or other reinforcements approved by the Fire Marshal All doors shall be h~nged closely f i t ted and adequately latched Fire boxes shall be of sufficient height from the ground or provided with a system of shields or ~nsulat]on to prevent heat damage to the street surface

(d) A lld which can be gravity operated shall be provided on all roofing kettles The tops and covers of all kettles shall be constructed of steel sheet hawng a thickness of not less than 0 075 ~n (No 14 Manufacturers Standard Gage) close f l t t ]ng and attached to the kettle w~th h~nges In a manner so as to allow for grawty closing of the lld

(e) The chassls shall be substantially constructed and capable of carrying the load ~mposed upon ] t whether standing s t i l l or being transported

(f) Fuel containers burners and related appurtenances of roofing kettles ]n which l~quef~ed petroleum gas is used for heating shall comply with all the requlrements of NFPA 58 Standard for the Storage and Handling of Liquefied Petroleum Gases (see Annex A)

(g) Fuel containers which operate under alr pressure shall not exceed 20 gal (75 7 L) ]n capacity and shall be subject to approval of the F~re Marshal

(h) All fuel contalners shall be maintained ~n accordance w~th the applicable BFPA codes and standards as listed in Annex A of this Code or at least ten f t (3 05 m) from the burner flame or at least two f t CO 61 m) therefrom when properly insulated from heat or flame

F~re Safety Regulations

I t shall be ~llegal for any person to throw or place or cause to be thrown or placed any lighted match clgar cigarette matches or other flaming or glowlng substance or thing on any surface or article where i t may cause or start a f l re

Any person who dehberately or through negligence sets f~re to or causes the burning of any bedding furniture rug curtain drape or other combustible material ~n such a manner to endanger the safety of any person or property shall be deemed to be ~n wolat~on of Ordlnance (Fire Code Adoptlng Ordinance Number) of the (Name of Jurisdiction)

The person d~scover~ng any f l re regardless of magnitude shall

1 Immediately notify the person ~n charge of the premises and all occupants and guests ~n the ~mmedlate v~c]n~ty of the f i re

2 Notify the Fire Department (F~re Department Telephone Number)

3 Evacuate the area by use of the stairs or other access to the outside Do not use the elevators Do not take t~me to gather personal belongings I f the f l re prohlblts evacuation keep the door to your room closed attempt to seal cracks which are lettlng ~n smoke open an exterior w~ndow i f possible (top and bottom) and stay close to the floor

Section 1 An ordinance to prowde the (Name of Jurisdiction) w~th rules and regulatlons to ~mprove public safety by promoting the control of f i re hazards regulating the Installatlon use and maintenance of equipment regulating the use of structures premlses and open areas providing for the abatement of f~re hazards establlsMng the responsib~l~tles and procedures for code enforcement and setting forth the standards for compliance and achievement of these objectwes

Th~s Code shall be known as (Jurisdiction s Name for this Code) TMs code adopts NFPA i Fire Prevention Code of the National F~re Protection Assoc~atlon and ~ts ~ncorporated standards and codes as published in the National Fire Codes of the National Fire Protection AsSoclatlon and llsted ~n Annex A of the NFPA Fire Prevention Code and being particularly the (Adopted Year of Issue) edlt~on thereof save and except those portions such as are hereinafter deleted mod~fled or amended by Section 18 of th~s ordlnance The same are hereby adopted and ~ncorporated as fu l ly as i f set out at length here~n Not less than (Number) cop~es of the adopted ~ssue of NFPA 1 Fire Preventlon Code of the National F~re Protect}on Assoc~atlon and the adopted standards and codes of the National F~re Codes shall be f11ed ~n the office of (Publ~c Place of f~l~ng) and the prov~slons thereof shall be controlling w~thln the l~mlts of (Name of Jurlsdlctlon)

Thls Bureau shall operate under the supervlslon of the Fire Chlef of the (Name) Fire Department The Fire Chlef of the Fire Department shall deslgnate a f l re of f lc la l of the (Name) Fire Department as Fire Marshal The Fire Marshal shall be the admnlstrator of the Bureau (Department or D1vlslon) of Fire Prevention The Fire Marshal shall be responslble for the dlrect admnlstratlon and enforcement of the (Name of Code) as may be set forth by the Fire Chlef of the (Name) Fire Department The Fire Marshal shall be appolnted on the basls of examlnatlon or other method for determlnlng hls quallflcatlons The Fire Chlef of the (Name) Fire Department may also designate such number of Technlcal Inspectors as shall from tlme to tlme be authorlzed by thu (Name of the Appolntlng Authoroty of the Jurlsdlctlon) Such Technical Inspectors shall be selected through an examlnatlon to determne thelr fltness for the posltlon

Sectlon 4 I t shall be the duty of the offlcers of the Bureau of F~re Prevention to enforce all laws and ordlnances of (Name of Jurlsdlctlon) coverlng the followlng

7 The malntenance of f l re cause and loss records

They shall have such other powers and perform such other dutles as are set forth In other sectlons of tMs ordinance and as may be conferred and imposed from t~me to tlme by law The Fire Chief of the (Name) F~re Department may delegate any of h~s powers or duties under th~s ordinance to the Fire Marshal

Section 5 The F~re Chief of the (Name) F~re Department shall prepare ~nstruct~ons for the Fire Marshal and hls assistants and forms for their use in the reports required by th~s ordinance

S~ctlon 6 The Bureau of Fire Preventlon shall ~nvest~gate the cause orlg]n and clrcumstances of every f i re occurrlng ~n the (Name of Jurisdiction) by wMch property has been destroyed or damaged and so far as possible shall determine whether the f i re Is the result of carelessness or design Such invest~gat~ons shall beg~n ~mmed~ately upon the occurrence of such a f i re The F~re Marshal shall take charge immediately of the physical evidence shall notify the proper authorlt~es designated by law to pursue the ~nvest~gat~on of such matters and shall further cooperate w~th the authorltles in the collection of ewdence and in the prosecution of the case Every f l re shall be reported in writing to the Bureau of F}re Prevention w~th~n (Number) days after the occurrence of the same by the Fire Department officer ~n whose jurlsd~ct~on such a f~re has occurred Such report shall be ~n such form as shall be prescribed by the F~re Marshal of the (Name) Fire Department and shall contain a statement of all facts relatlng to the cause origin and clrcumstances of such f l re the extent of the damage thereof and the insurance upon such property and such other ~nformat~on as may be required ~nclud~ng the ~nJury death or rescue of persons

Sectlon 7 Before permits may be ~ssued as required by th~s Code the Fire Marshal or his assistants shall inspect and approve the receptacles processes vehicles bu~Idlngs or storage places to be used for any such purposes

Section 8 The F~re Marshal shall ~nspect or cause to be inspected all premises on a perlod]c bas~s and shall make such orders as may be necessary for the enforcement of the laws and ordlnances governing the same and for safeguarding of l~fe and property from f~re

Section 9 Whenever any inspector as deflned above shall f~nd ]n any bulld~ng or upon any premises or other places#combustible or explosive matter or dangerous accumulations of rubblsh or unnecessary accumulation of waste paper boxes shavings or any h~ghly flammable materlals especially hable to f l re and which is so s~tuated as to endanger property or shall find obstructions to or on f~re escapes stairs passageways doors or windows llable

i to interfere w~th the operations of the hre Department or egress of occupants in case of f~re he shall order the same to be removed or remedied and such order shall forthwith be compiled with by the owner or occupant of such premises or bu~Idlngs subject to the appeals procedure provided for In the (Name of Code)

Any owner or occupant fa11~ng to comply w~th such order w~th~n a reasonable perlod after the serwce of the sa~d order shall be liable to penalties as hereinafter prowded

The servlce of any such order may be made upon the occupant of the tprem~ses to whom It ~s d~rected either by del~verlng a copy of same to such occupant personally or leaving i t w~th any person in charge of the premlses or ~n case no such person ~s found upon the premises by aff~xlng a copy thereof ~n a consplcuous place on the door to the entrance of said premses Whenever ~t may be necessary to serve such an order upon the owner of premises such order may be served either by de1~ver~ng to and leawng w~th the said person a copy of the sa~d order or ~f such owner is absent from the aur~sdlct~on of the off lcer making the order by ma~llng such copy by cert}f~ed mall to the owner s last known post offlce address

Sectlon 10 The F~re Marshal shall compile and keep a record of a11 f~res and of a11 the facts concerning the same includ~ng lnaur~es deaths rescue of persons and statistics as to the extent of such flres and the damage caused thereby and whether such losses were covered by ~nsu~ance and ~f so ~n what amount Such record shall be made dally from the reports made by the Technical Inspectors under the prowslons of this ordinance A11 such records shall be publ~c

Section 11 The F~re Marshal shall make an annual report of the act~wt~es of the Bureau of F~re Preventlon and shall transmlt th~s report to the Chlef Executive Officer of the (Name of Jurisdiction) through the F~re Chief of the (Name) F~re Deartment The report shall contaln al l proceedlngs under the (Name of Code) w~th such statistics as the Fire Chief may w~sh to ~nclude there~n

Sectlon 12 The Fire Chlef of the (Name) F~re Department or the F~re Marshal shall also recommend any amendments to the (Name of Code) or ordinance which in hls judgment shall be desirable

Sectlon 13 The prov~slons of the (Name of Code) shall apply equally to both public and private property and ~t shall apply to all structures and their occupancies except as otherwise speclf~ed

Sectlon 14 Th~s act shall be deemed ~n exercise of the police powers of (Name of Jur~sd~ct~on) for the preservatlon and protectlon of the pub1~c health peace safety and welfare and all the prowslons of the (Name of Code) shall be l~berally construed for that purpose

Sectlon 15 Any person who shall wolate any of the provisions of the Code hereby adopted or shall fa l l to comply therewith or shall wolate or fa~l to comply w~th any order made thereunder or shall build in violation of any details statements specifications or plans submitted or approved thereunder or shall operate not ~n accordance w~th the provisions of any cert~flcate permit or approval ~ssued thereunder and from which no appeal has been taken or who shall fa l l to comply w~th such an order as affirmed or modified by the Fire Marshal or by a court of competent 3ur~sd~ct~on within the time fixed herein shall severally for each and every v~olatlon and noncompliance respectively be guilty of a mlsdemeanor punishable by a flne of not less than (Dollar Amount) nor more than (Dollar Amount) or by ~mprlsonment for not less than (Number) days nor more than (Number) days or by both such f~nes and impr~sonment The ~mpos~t~on of a penalty for any v~olat~on shall not excuse the wolatlon nor shall the wolat~on be permitted to continue All such persons shall be required to correct or remedy such vlolat~ons or defects wlth~n a reasonable tlme and when not otherwise spec~fled the application of the above penalty shall not be held to prevent the enforced removal of prohlblted conditions

Section 16 A Board of Appeals isthereby establ~shed cons~stlng of (Number) members and (Number) alternate members who shall be appointed by the (Name of Appo~ntlng Off~clal) by reason of educatlon experience and knowledge and are deemed to be competent to s~t ~n judgment on matters concerning the (Name of Code) and ~ts enforcement The members shall serve for a term of (Number) years except for the ~n~tlal appointees which shall serve as follows (Number) for a term of one year (Number) for a term of two years and (Number) for a term of three years

D Section 19 (Appendix C) The local jurisdiction has the ( responsibility for determining i f fees are to be charged for permits certlflcates of fitness and other written authorlzatlon In which the f i re deparbnent is to become ~nvolved When fees are determined by the jurlsdlctlon to be necessary they should not be used as just another source of revenue but should be correlated to the cost of f i re department involvement in that act iv i ty A fee wil l more clearly define the responslbillty of the f ] re department to ensure code compliance for a particular act lv l ty The establishment of a fee schedule requires careful conslderatlon of all impllcatlons including legal requirements for public hearings before adoption of the fee schedule by the jurlsdlctlon

Appendix E

General Authority To Combat F1res and Related Emergencies

This Appendix is a suggested section for adoption by a jurlsd]ctlon requiring legislation setting forth Fire Department authority relative to f i re fighting operations

E 1 1 The f i re offlClal conducting operations ]n connection with the extlngulshment and control of any f i re exploslon or other emergency shall have fu l l power and authority to dlrect all operations of f i re extinguishment or control and to take the necessary precautions to save l l fe protect property and prevent further injury or damage In the pursuit of such operation including the investigation of the cause of such emergency the f i re of f lc la l may control or prohlblt the approach to the scene of such emergency by any vehicle vessel or thing and all persons (See Appendix D F 1 1 )

E 1 2 No person shall obstruct the operations of the Fire Department in connection with extlngulsh]ng any f i re or actlons relative to other emergencies or disobey any lawful command of the f l re of f ]c la l in charge of the emergency or any part the eof or any lawful order of a police officer assisting the Fire Department

E 1 3 The f i re of f ic ia l In charge of an emergency scene shall have the authority to establish f i re line barriers to control access in the v]c ln l ty of such emergency and to place or cause to be placed ropes guards barricades or other obstructions across any street or alley to delineate such f i re line barrier No person except as authorized by the f i re of f ic ia l in charge of the emergency may cross such f i re line barriers

E i-4 The Fire Marshal is authorized to issue passes entit l ing the holders thereof to cross f i re line barriers Such passes shall not authorize trespass at the scene of an emergency Credentlals which clearly establish the authority and identity of the holder thereof to enter the premises whether or not issued by the Fire Marshal may be honored by the f i re of f lc la l in charge of the emergency scene i f concurred with by the person in charge of the premises ~nvolved in the emergency

E i 5 No person except a person authorized by the f i re of f lc la l in charge of an emergency scene or a public officer acting within the scope of public duty shall remove unlock destroy or tamper with or otherwise molest in any manner any locked gate door or barricade chain enclosure s ign tag or seal which has been lawfully installed by the Fire Department or by its order or under its control

This Appendix Is a suggested section for adoption by a jurisdiction desiring to establish an appeals procedure (See Section 16 of Appendlx C )

F 1 1 Where any person seeks re l ief from a decision of a f i re of f lc la l enforcing provlslons of this Code includlng permits certificates waivers alternate materlals alternate methods approvals or variances or matters of Code interpretations he may request reconslderatlon of the f i re of f lc la l s decision by appealing in writing to the Fire Marshal within 15 days of the receipt of the declslon stating the reasons why he seeks re l lef and what decision he feels should be forthcoming The Fire Marshal shall wlthln 10 days after receiving a copy of the appeal in writing hold a hearing and decide the question after hearing testlmony from all concerned persons The Fire Marshal shall render his written decision within f ive days after the hearing is completed

F 1 2 After such a hearing by the Fire Marshal any person seeking rel lef from a declslon of the Fire Marshal regardlng provisions of this Code may appeal to the Board of Appeals within 15 days after receipt of written notice of the Fire Marshal s declslon Such appeal shall be in wrlt]ng and directed to the Fire Marshal Copies of the appeal shall be promptly transmitted to the Board of Appeals by the Fire Marshal Upon glVlng not less than five business days notice to the persons interested a hearing shall be held The Board may after such hearing by a majority vote afflrm annul or modify the action of the Fire Marshal The decision of the Board shall be in wrltlng and a copy shall be malled to the appellant within seven business days after the conclusion of the hearln 9 and any decisions made shall be final Further recourse shall be through established legal procedures

I 2 2 Application All appllcatlons for a cert l f lcate of fltness shall be f l ied wlth the Fire Marshal on forms provlded by the Fire Marshal

I 2 3 Proof of Quallflcatlons Every person applylng for a certlf lcate of fltness shall furnlsh satlsfactory proof to the Fire Marshal that he is fam111ar wlth the materlals formulas tools techniques standards laws ordinances recognlzed good practices safety precautions and manufacturer s recommendatlons pertaining to the particular system materlals devices or operatlons he w111 be Involved wlth and for whlch the certlf lcate of fltness Is issued He shall further prove that he Is physlcally competent to perform any and all actlons necessary or inc~dental to the operation for which the certlf lcate of f}tness ~s issued

I 2-4 Investlgat~on and Exam~natlon The Fire Marshal shall lnvestlgate every appllcatlon for a certlf lcate of fitness The investlgatlon shall include an examlnatlon of the appilcant as to his experience and tralnlng in the f ield of the cert}flcate of fitness for which he has app1~ed The examlnat~on may include a practical test When the Fire Marshal determines that the applicant for the certlf~cate of fltness conforms to all of the requirements of th~s Code he shall ~ssue the certlf~cate of fltness

I 2 5 Refusal of Certlflcate of F~tness When the Fire Marshal determines that an appl~cant ~s not f i t to receive the certlf lcate of fltness because of h~s ~nabiIity to comply wlth the provlslons of th~s Code he shall refuse to issue the certlf~cate of fltness I f the refusal is based upon the applicant s ~nab11~ty to pass a written examlnatlon whlch ~s given to determine competency the applicant may not apply again for the certif icate of fltness w~thln a ten day period fo l lowing the examination

I 2 6 3 Renewal of Certlf~cate of Fitness Appllcat~ons for renewal of a certif icate of f~tness shall be f i led in the same manner as an application for an original certif icate Each such appl~cation shall be accompanied by applicable fees The grantlng of a renewal of a certif icate of fitness shall be accomplished ~n the same manner as for an original certif icate of f~tness

I 2 6 4 Restricted Certificates of F~tness The F~re Marshal ~s authorized upon appl~catlon therefore to issue certlficates of fltness that are restricted to one or more actlvlt les systems items or devices or to a partlcular premise

I 2 6 5 Change of Address Each person holding a certif icate of fitness shall notify the F~re Marshal in writing of any change in his business residential or other not}flca~ion address w~thln ten days after such change Failure on the part of a person to glve such notification shall constltute grounds for revocation of sa~d certif icate of fitness

I 2 6 6 Contents of Certificate of Fitness A certlf~cate of fitness issued by the Fire Marshal shall be ~n the form of an ~dent]fication card Said card shall contain the following information to be valid

(a) The purpose for which the certlf~cate of f~tness has been issued

(b) The date the certif icate of f~tness ~s issued and the date of expiration

(c) Other informatlon as may be necessary to properly identify the person to whom the certlf lcate of fitness ~s ~ssued

(d) The signature of the person to whom the cert~flcate of f~tness ~s issued

(e) The name and slgnature of the F~re Marshal who issued the certlf icate of fitness or the F~re Marshal s name and countersignature of h~s deslgnated representative

(f) Printed thereon in bold type the foIIowlng THIS CERTIFICATE DOES NOT EXCLUSIVELY RECOMMEND THE BEARER

I 2 6 7 Requlrement to D~splay Cert~flcate of F~tness Any person to whom a certif icate of f~tness has been granted in conformance with th~s Code shall upon request produce and show proper identlflcat~on and h~s certif icate of fitness to anyone for whom he seeks to render h~s services or to the Fire Marshal

Thls Appendix is a suggested guldellne for mlnlmum requlrements of on premises f i re flght~ng organlzatlons in allowlng exceptlons to the F~re Prevention Code of the National Fire Protectlon Association

The basic guidellnes are found in NFPA 6 Recommendatlons For Organlzation of Industrlal Fire Loss Preventlon and NFPA 7 Recommendatlon for Management Control of Fire Emergencle~ To qualify for the exemption the flrm must have

(a) A wrltten emergency procedural plan coordlnated with the procedures of the local f l re department

(b) Personnel assigned to carry out the dut es of the emergency plan (either fu l l tlme or assigned addltlonal dutles)

(c) Equipment to conduct f l re suppression actlvlt]es (water supply system hose capability to provlde water under pressure at any posslble f~re locatlon necessary speclal extlngulshing agents forclble entry tools etc )

(d) Verifiable tralnlng of asslgned f l re flghtlng personnel in basic f i re fightlng technlques and additional f~re fighting techniques germane to the partlcular ~ndustry involved

(e) Verlflable f~re prevention inspection and enforcement program (coverlng f i re equipment maintenance regulation of smoklng housekeeping practices proper handling storage and use of hazardous materials abatement procedures etc )

NOTE Only requirement (e) ~s necessary for the exception to 3 1 1 12

Appendlx K

K 1 1 Vapor Degreasing Where vapor degreasing systems are used the following shall apply

(a) The steam supply line to the coils which heat the liquld shall be equipped with an automatlc shut off valve with manual vent that will operate when liquid trlchlorethylene reaches 200OF (93 3oC) or llquid perchlorethylene reaches 2650F (129 4oC)

1 (b) The temperature in the vapor area shall be controlled to

assure that equlllbrlum between vaporlzatlon and condensatlon under atmopherlc pressure wil l be establlshed at a polnt at least 18 In (457 2 mm) below the loading and unloading openlng in the degreaser

(c) An automatlc temperature control that w111 shut off the heat source to the ]lquld at 180oF (82 2oC) for trlchlorethylene or 240oF (115 55oC) for perchlorethylene shall be establlshed at the point just above the vapor level For other solvents the recommendatlons of the manufacturers shall be followed A separate l lmit swltch set for a maximum of lOoF ( 12 22oC) above the recommended hlgh temperature settlng of the thermostat shall be provided to shut off the heat source in the event that the thermostat fal ls

(d) A low llquld level control shall be installed so as to shut off the heat source when the llquld fal ls below a certaln level whlch Is predetermlned by design to be safe

K 1 2 Spray Cleaing The use of heated combustlble liqulds for spray cleanlng shall be automatlcally controlled so that the temperature of the llquld w111 not be ralsed to its flash polnt Where automatlc conveyor belt systems passlng through a cablnet are used the cablnet shall be equlpped wlth a vapor recovery system and an automatlc f l re extlngulshlng system

The atomlzatlon of llqulds may create a f i re hazard at temperatures lower than the normal flash polnt of the llquld Such posslb11~tles should be invest~gated in the appllcatlon of thls sectlon
