Department of Commerce Administration of the Coastal ZoneManagement Act (CZMA)*

The Coastal Zone Management Act of 1972 (CZMA) includes therequirement for a biennial report to Congress concerning theadministration of the program. 16 U.S.C. § 1462. This reportingrequirement was given a sunset date of May 15, 2000, by theFederal Reports Elimination and Sunset Act of 1995 (Sunset Act).Therefore, applying both sections of the Sunset Act § 3003, andHouse Document 103-7, the requirement for the biennial reportceased to be effective on May 15, 2000. The Sunset Act has beenamended a number of times to exempt reports from the May 2000sunset date; however, NOAA believes the CZMA biennial report is

Department of Commerce Data Management Report. A Report toCongress on the status and challenges forNOAA’s Environmental Data Systems*

The August 9, 2013 memo that transmitted the 2011 EnvironmentalData Management Report informed the Congress that this would bethe final report in response to the 1992 directive. The memo notedthat NOAA had made significant strides to address the issuesraised at that time. Catherine Barrett, at that time with SenateCommerce Committee, concurred and informed Mark Moran (thethen) NOAA OLIA Satellite Liaison that the Committee wouldinclude retirement of this reporting requirement with the nextavailable legislative vehicle. At this time NESDIS is not planning tosubmit any reports beyond the 2011 report.

Donations of equipment to schools constitute a small fraction ofNIST's contributions to science and math education, which areexplained in more detail in NIST's annual budget justifications.

Department of Commerce Licensing Activities for Iraq This report was required within the context of ongoing U.S. combatoperations in Iraq as a means of ensuring that exports did notcontribute to the capability of former regime forces and/or foreignfighters. The report has solicited no inquiries orexpressions of interest from Congress, nor from any otherstakeholders. The industry has changed over the last decade, andthis is no longer of controversial topical interest. A lot of this workhas been absorbed into the current stimulus projects.

Department of Energy Annual Report on U.S./Russia Highly EnrichedUranium Purchase Agreement*

In December 2013, NNSA received the final shipment of lowenriched uranium (LEU) from Russia as part of the 1993 U.S.-Russia HEU Purchase Agreement, commonly known as the

Megatons to Megawatts Program. The shipment was the last of theLEU converted from more than 500 metric tons of weapons-originhighly enriched uranium (HEU) downblended from roughly 20,000dismantled Russian nuclear warheads and shipped to the UnitedStates to fuel U.S. nuclear reactors, supplying nearly ten percent ofall U.S. electricity over the past fifteen years. The program wascompleted following this shipment negating the need for this report.

Department of Energy Biennial Report, on Advanced Concepts andTechnologies to Maximize U.S. Geothermal

Resource Potential. - Report to Congress, Advanced Uses of Geothermal Energy

This reporting requirement should be eliminated. The initial reportgives Congress the status of the five technology areas requested.

Two of these - CO2 as a geofluid, and mineral recovery fromgeothermal brines - are active areas of DOE research. Theirprogress will be documented annually in future DOEbriefings/progress reports. Formal Congressional reporting wouldbe duplicative. The remaining three areas - the use of geothermalheat or electricity for processes to make or extract biofuels,hydrogen and natural gas - are not active areas of DOE researchand are currently considered to have less potential for cost-effectiveimpact on energy goals than other geothermal technologies.

Department of Energy Biennial Report, on Award of H-Prize for Advancements in Hydrogen ProductionStorage Distribution and Utilization

This reporting requirement should be eliminated; EERE haspreviously submitted a request to do so related to the currentlegislative language being flawed.

This report requires the Department to provide Congress with five-year proposed appropriations levels for the defense funding for theOffice of Environmental Management. Over the next year, ITP will post higher-level aggregatenumbers, including total energy savings achieved by partners in itsvoluntary programs. Finally, DOE will also ensure that independentverifications have been performed on a sample of the energysavings estimates provided by partner companies.

Department of Energy Triennial Report on Hydrogen and Fuel CellTechnology*

The report is a summary of activities and results of the DOEHydrogen and Fuel Cells Program. This Program includes activities

in the Science, Energy Efficiency and Renewable Energy (EERE),Fossil (FE) and Nuclear Energy (NE) Programs. The report isrecommended for elimination as appropriations for FE and NEhydrogen R&D have been eliminated and the appropriations forScience and EERE have been significantly reduced (about 50%)over the last five years. In addition, the progress andaccomplishments of the Program are publically available on theEERE website for the Fuel Cell Technologies Office includingpresentations and reports from individual projects.

Annual Report on Part D Formularies' Inclusionof Drugs Commonly Used by Dual Eligibles

The transition from Medicaid to Part D drug coverage occurred in2006. Our first annual report under this requirement found no

problems with misalignment between dual eligibles' commonly useddrugs and Part D formularies; because dual eligibles receive theirdrugs through Part D, these findings are expected to be sustainedover time.


Annual Report on Pediatric Initiative NIH already has the authority to conduct and support pediatricresearch. With the advent of RCDCs RePORT, interestedindividuals can obtain a uniform, and thus, more accurate viewincluding new research projects of NIHs entire pediatric researchportfolio. In addition, the information provided in this report isduplicated in annual Congressional Justifications submissions.

Accordingly, deleting the requirement for the annual report wouldincrease efficiency by eliminating redundant dissemination of thesame information.


Annual Report to Congress related to theQualified Independent Contractors (QICs)activities

This report requires a summary of activities for the previous year,recommendations for improvements, et cetera. BIPA also requiredthe QICs to keep accurate records of each decision made in anelectronic database. The Medicare Appeals System (MAS) wasdeveloped for this purpose. This system, used by the QICs and the Administrative Law Judges (ALJs), not only keeps a permanentrecord of each decision issued, it also produces reports that gobeyond the requirements outlined in BIPA for the annual report.

Using data from MAS, CMS creates an annual fact sheet on QICappeals data. CMS makes this report available to the public byposting it on the CMS website. Consequently this report isduplicative of the fact sheet and other monthly agency reportsreceived from the Administrative QIC.

The website of Organ Procurement and Transplantation Network(OPTN), which is operated under statute by HRSA through acontract to a not-for-profit entity, provides historical and current dataand information that would appear in the Biennial Report. Theinformation is available on the website in a more timely andaccessible way and at lower cost. Likewise, an Annual Data Report,that covers information that would be included in the report, isavailable online through HRSA's contract to operate the ScientificRegistry for Transplant Recipients (SRTR).


Biennial Report to Congress: Scientific andClinical Status of Organ Transplantation

The website of Organ Procurement and Transplantation Network(OPTN), which is operated under statute by HRSA through acontract to a non-for-profit entity, provides historical and currentdata and information that would appear in the Biennial Report. The

information is available on the website in a more timely andaccessible way and at lower cost. Leased Aircraft Report to Congress We propose to reduce the report frequency to one submissionevery two years. CDC has reduced the number of dedicated aircraftto one. Once the current contract expires, it will not be renewed.

National Breast and Cervical Cancer EarlyDetection Program

This report was last submitted by CDC in 2003 in response to arequest for a one-time status report on the program. CDC nowreports the screening program data on the National Breast andCervical Cancer Early Detection Program web site. On this pagethere is a link to the screening program data where people can viewthe screening program summaries by selecting a state or territory.The data is presented in 5 year increments with the current datafrom January 2006 through December 2010. Data is reported toCDC in October of each year.


National Coverage Determination AnnualReport

The NCD Report captures only a snapshot of the NCD processwhen compared to the other publicly available venues forinformation on the NCD process. As such the RTC has limited

significance or utility when compared to the interactive andtransparent information reliably available in real time through theMedicare Coverage Center website at www.cms.gov/medicare-coverage-database/. Due to the time involved in clearing andpreparing the report, the report is essentially obsolete upon deliveryas it duplicates information already available to Congress throughthe website. Therefore we recommend we retire the report andinstead dedicate resources to ensuring timely public reporting of allphases of the NCD process, including aspects of the NCD processnot currently captured in the report.


National Institute of Nursing Research BiennialReport

This report was effectively eliminated by the Reports Elimination Actof 1995 (P.L. 104-66). The reports to be eliminated as a result ofP.L. 104-66 were listed in House Document No. 103-7, acommunication from the Clerk, U.S. House of Representativestitled, *Reports to be Made to Congress.* The NIH Biennial waslisted on this report and since Sec. 464Y required a biennial reportto be included in Sec. 403, which no longer existed, NINR no longerproduced the report. However, the NIH Reform Act of 2006 (P.L.109-482), reinstituted the NIH Biennial Report.

SFI operations in the UK and Honduras were reverted back to CSIhigh-risk targeting operations, and SFI operations in South Koreawere terminated. Operations in Pakistan and Oman continuesuccessfully. CBP suggests updating reporting requirement toreflect new situation re: SFI operations, which will cut down on thelength of the report (eliminate the need to report on UK, Honduras,or South Korea) and reduce the time and resources needed to draftand clear it.

USCIS - Impact of the Homeland Security Acton Immigration Functions

After more than ten years since its creation, USCIS continues tomaintain that any impact occurring as a result of the transfer ofimmigration functions from the Immigration & Naturalization Service(Department of Justice) to USCIS (Department of HomelandSecurity) is overcome by operational events. The purpose of this

reporting requirement was to monitor the existing backlog as thelegacy INS transformed into three separate entities within the newDepartment of Homeland Security (DHS). Since the high point ofthe backlog in January 2004 of 3.85 million applications andpetitions, USCIS has successfully eliminated the substantivebacklog and continues to meet or exceed published processingtimes with a focus on quality, efficiency, and dedicated customerservice.


USM - OCPO - Other Transactions Report DHS is required to report annually to Congress on the use of itsOther Transaction (OT) authority. In addition, to the annual report,

DHS is also required by the Department of Homeland SecurityConsolidated Appropriation Act, 2010 (Public Law 111-83) toprovide advance notification to Congress of any planned OT awardvalued at $1 million or more. This reporting requirement issomewhat duplicative of DHS's requirement to provide advancenotification to Congress of any planned OT award valued at $1million or more (ref: Department of Homeland SecurityConsolidated Appropriation Act, 2010 (Public Law 111-83)). DOL is responsible for a biennial report (formerly called theJefferson report) to Congress on progress made by the CAFTA-DRcountries in implementing (i) Chapter 16 (Labor) of the CAFTA-DR,

and (ii) the White Paper, which was developed by the Vice Ministersof Labor in the region before the CAFTA-DR was passed.Information related to implementation of Chapter 16 is publicallyavailable on DOL website. Secretary of Transportation responses to safetyrecommendations*

This report is a duplication of efforts. The FAA and the NTSBalready have an open dialogue on the NTSB's 400 open safetyrecommendations. The FAA responds annually in writing to the

NTSB's recommendations. In turn the NTSB usually responds, inwriting, within 6 months of the FAA's letter. Both the FAA and NTSBletters are posted on the NTSB Web site for public display,providing almost a real time display. The subject report consumes asubstantial amount of hours to produce and coordinate. During thislengthy coordination effort, the information in the report oftenbecomes obsolete as communication between the FAA and theNTSB continues beyond the report's publication.

In addition, as part of the Department of Transportation's Status of

Actions Addressing the Safety Issue Areas on the NTSB's MostWanted List, the FAA prepares an annual update on the areasspecifically highlighted by the NTSB. The Most Wanted List issueareas address a majority of the recommendations related to Part

Interagency research on aviation and theenvironment*

The Section 909 report on integrating environment and energyresearch, submitted every 3 years, is duplicative. The FAAproposes to consolidate its response to this requirement with the

ongoing Agency efforts on the National Research and DevelopmentPlan and NARP. In developing this initial response, the Agencyrecognized that this requirement is duplicative with ongoing FAAefforts. The Aeronautics Science and Technology Subcommittee ofthe Committee on Technology of the National Science andTechnology Council created a National Aeronautics Research andDevelopment Plan that includes research on aviation and theenvironment and this plan is revised every 5 years. Information thatis required in the Section 909 Report is also included in the annualNational Aviation Research Plan (NARP).

Consolidation or elimination of obsolete,redundant, or otherwise unnecessary reports;use of electronic media format*

The review under the requirements of Section 806, P.L. 112-95,identified another reporting requirement for duplicative andoutdated reports; Section 1125 of the Government Performance

and Results Act (GPRA) Modernization Act of2010, P.L. 111 -352. Although the U.S. Department of Transportation responded to thisrequirement and offered twenty reports for elimination, FAA did notparticipate in this review.

Section 806 has been effective in identifying obsolete andredundant reports and has resulted in congressional action to makemore efficient use of FAA resources. However, the valuable reviewsrequired under Section 806 could be continued solely under therequirements of Section 1125 of the GPRA Modernization Act of

2010, or vice versa, thereby eliminating the need for redundantreporting under both requirements and resulting in more efficientuse of agency resources. The FAA recommends the elimination of

Conversion of VA Functions to ContractorPerformance

VA has not submitted this report for several years because 38U.S.C. § 8110(a)(5) prohibits the Veterans Health Administrationfrom conducting any study comparing the cost of the provision byprivate contractors with the cost of the provision by the Departmentof commercial activities, which is required when agencies considercontracting-out certain activities performed by the Department,unless the Congress provides specific funding for the studies. Suchfunding has not been provided for several years. Staffing for Nurses and Nurse Anesthetists This report has served the purpose of showing that the programswork. The requirement to report on the staffing of nursing positionswas put in place in 2000 to ensure that the locality pay system wasadequately addressing VA's staffing needs and that facilities wereusing the salary survey process when necessary to address staffingproblems. Since the establishment of this reporting requirement,nurse staffing across VA has remained satisfactory. No majorstaffing problems have been identified through this reportingprocess. The report has also shown that salary surveys areconsistently conducted when potential pay-related staffing issuesare identified. To our knowledge, there has never been any contactfrom Congress or any other stakeholder to inquire about the report,nor has there ever been any comment or question about itscontents following distribution. VHA does not use the report for anypurpose other than to provide the information to Congress.

Environmental Protection Agency

INDIAN ENVIRONMENTAL GENERAL ASSISTANCE PROGRAM ACT OF 1992

EPA is currently fulfilling its obligation under 42 U.S.C. 4368b toreport to Congress the status of EPA's Tribal General AssistanceProgram by providing information in EPA's annual performancereport and on its website. This information is available "to the

appropriate Committees of the Congress with jurisdiction over theapplicable environmental laws and Indian tribes" consistent with thestatute. Given the availability of this data, a specific annual report isnot necessary. We would ask that the language in 42 U.S.C. 4368bbe amended to provide EPA with additional flexibility to satisfy thisobligation through additional alternative reporting processes.
